GUIDELINES FOR IMPLEMENTING THE SUBSIDY REGIME FOR YOUTH VOLUNTEERS WHO HAVE COMPLETED THEIR MISSIONS IN THE RESISTANCE WAR ACCORDING TO DECISION NO. 40/2011/QD-TTg OF JULY 27, 2011 ISSUED BY THE PRIME MINISTER

Joint Circular No. 08/2012/TTLT-BLDTBXH-BNV-BTC dated April 16, 2012 issued by the Minister of Labor, Invalids and Social Affairs, the Minister of Home Affairs, and the Minister of Finance guiding the implementation of the subsidy regime for youth volunteers who have completed their missions in the resistance war according to Decision No. 40/2011/QD-TTg of July 27, 2011 issued by the Prime Minister, which took effect from June 1, 2012, has been amended and supplemented by:

Circular No. 08/2023/TT-BLDTBXH dated August 29, 2023 issued by the Minister of Labor, Invalids and Social Affairs amending and supplementing, abolishing certain provisions of the Circulars and Joint Circulars concerning the submission and presentation of paper household registration books, temporary residence certificates, or other documents requiring confirmation of place of residence when performing administrative procedures under the management of the Ministry of Labor, Invalids and Social Affairs, which took effect from October 12, 2023.

Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;

Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 40/2011/QD-TTg dated July 27, 2011 issued by the Prime Minister stipulating the regime for youth volunteers who have completed their missions in the resistance war,

The Minister of Labor, Invalids and Social Affairs, the Minister of Home Affairs, and the Minister of Finance issue this Joint Circular guiding the implementation of the subsidy regime for youth volunteers who have completed their missions in the resistance war according to Decision No. 40/2011/QD-TTg dated July 27, 2011 issued by the Prime Minister.

Article 1. Time for Enjoying Subsidy Regime

1. The time for enjoying the subsidy regime shall be calculated from the day the youth volunteer (hereinafter referred to as TNXP) concentrates to participate in the resistance war until the day they complete their mission and return to their home province.

2. In cases where TNXP has non-continuous periods of concentration to participate in the resistance war, the time for enjoying the subsidy regime shall be the total actual time of all periods of concentration to participate in the resistance war.

Article 2. One-time Subsidy Regime

1. The one-time subsidy regime shall be calculated based on the actual number of years directly participating in the resistance war as stipulated in Article 1 of this Circular, specifically as follows:

a) From two full years or less, the amount of one-time subsidy is 2,500,000 VND;

b) Over two years, each additional year from the third year onwards will add 800,000 VND.

When calculating the time for implementing the one-time subsidy regime, if there is a fractional month, six months or more will be counted as a full year, and less than six months will be counted as half (1/2) year.

Calculation formula:

Amount = 2,500,000 VND + [(number of years enjoyed - 2 years) x 800,000 VND/year]

Example 1: Ms. Nguyen Thi A joined the TNXP force in October 1960 and completed her mission and returned to her home province in September 1963. The calculation of the one-time subsidy regime for Ms. Nguyen Thi A is as follows:

The period from October 1960 to September 1963 is three years; the benefit received is:

2,500,000 VND + [(3 years - 2 years) x 800,000 VND/year] = 3,300,000 VND

Example 2: Mr. Tran Van B joined the TNXP force in May 1965 and completed his mission and returned to his home province in August 1968. The calculation of the one-time subsidy regime for Mr. Tran Van B is as follows:

The period from May 1965 to August 1968 is three years and four months, which is calculated as 3.5 years; the benefit received is:

2,500,000 VND + [(3.5 years - 2 years) x 800,000 VND/year] = 3,700,000 VND

Example 3: Ms. Nguyen Thi C joined the TNXP force in May 1955 and completed her mission and returned to her home province in November 1958. The calculation of the one-time subsidy regime for Ms. Nguyen Thi C is as follows:

The period from May 1955 to November 1958 is three years and seven months, which is rounded up to four years; the benefit received is:

2,500,000 VND + [(4 years - 2 years) x 800,000 VND/year] = 4,100,000 VND

Example 4: Mr. Tran Van D joined the TNXP force in October 1955, completed his mission and returned to his home province in September 1957; then he continued to join the TNXP force in March 1960 and completed his mission and returned to his home province in February 1962. The calculation of the one-time subsidy regime for Mr. Tran Van D is as follows:

The period from October 1955 to September 1957 is two years; the period from March 1960 to February 1962 is two years. The total time Mr. D spent in the TNXP force over two periods is four years; the benefit received is:

2,500,000 VND + [(4 years - 2 years) x 800,000 VND/year] = 4,100,000 VND

2,500,000 VND + [(4 years - 2 years) x 800,000 VND/year] = 4,100,000 VND

2. In cases where the documents in the application file for considering the one-time subsidy regime for TNXP as stipulated at points a and b of Clause 1, Article 4 of this Circular do not clearly show the specific time of concentration to participate in the resistance war, only the one-time subsidy of 2,500,000 VND shall be implemented.

Article 3. Monthly Allowance System

1. The subjects eligible for consideration to receive the monthly allowance system are TNXP (Vietnamese Youth Volunteers) who have concentratedly participated in the resistance war, completed their tasks, returned to their localities, and are no longer capable of working and living alone without support.

Subjects eligible for consideration to receive the monthly allowance system shall not be entitled to the one-time allowance as prescribed in Article 2 of this Circular.

2. The monthly allowance amount is 360,000 VND. This allowance will be adjusted accordingly when the Government adjusts the monthly allowance for the subjects specified in Decree No. 13/2010/NĐ-CP dated February 27, 2010, of the Government on amending and supplementing certain articles of Decree No. 67/2007/NĐ-CP dated April 13, 2007, of the Government regarding social assistance policies for beneficiaries.

3. The date of receiving the monthly allowance system shall be implemented from the date the Chairman of the People's Committee of the province or centrally governed city (hereinafter referred to as provincial level) signs the Decision on resolving the monthly allowance system for TNXP.

4. For subjects currently receiving the monthly allowance system under Decision No. 104/1999/QĐ-TTg dated April 14, 1999, of the Prime Minister on the policy for TNXP who have completed their tasks in the resistance war, they will be adjusted to receive the monthly allowance system according to the provisions of Clause 2 of this Article, starting from October 1, 2011 (no need to reapply for the allowance benefit).

Article 4. Application Documents for Considering Allowance Benefits

The application documents for considering allowance benefits include:

1. One of the following documents proving that the subject is a TNXP (original or certified copy by the People's Committee of the commune):

a) Officer's or Party member's resume filed before Decision No. 104/1999/QĐ-TTg dated April 14, 1999, came into effect.

b) Documents issued by authorized agencies before TNXP returned to their locality such as: Certificate of completion of tasks by the management unit of TNXP; Medical transfer certificates, health certificates; Certificates of commendation during participation in TNXP forces; Certificates of TNXP participation; Transfer orders, appointment letters, task assignments.

c) In cases where TNXP no longer possess any of the documents stipulated in points a and b of this clause, they must submit a verified personal declaration from the People's Committee of the commune where they registered their permanent residence before joining TNXP (original). The People's Committee of the commune has the responsibility to verify the declaration for TNXP who are from another locality but now registered their permanent residence elsewhere (content of verification according to Model No. 02 issued together with this Circular).

2. Personal Declaration Form (filled out according to Model No. 1A, 1B, or 1C issued together with this Circular), specifically:

a) In case of requesting a one-time allowance, fill out Model No. 1A if the TNXP is still alive; if deceased, the relative of TNXP fills out Model No. 1B.

b) In case of requesting a monthly allowance, fill out Model No. 1C.

3. For subjects meeting the conditions to receive the monthly allowance system, in addition to the documents stipulated in Clauses 1 and 2 of this Article, there must be a health certificate from a medical facility at the district level or higher (original).

Article 5. Procedures and Time Limits for Resolving Allowance Benefits

1. TNXP subjects or relatives of TNXP (in case TNXP has passed away) shall submit one set of application documents as prescribed in Article 4 of this Circular to the People's Committee of the commune where they registered their permanent residence.

2. Responsibilities of the People's Committee of the commune:

Within five working days from the date of receipt of complete application documents (per batch), the People's Committee of the commune shall complete the following tasks:

a) Organize a meeting and prepare a record confirming the application documents for considering allowance benefits (prepared according to Model No. 02 issued together with this Circular). Participants in the meeting include representatives from the commune leadership (People's Committee, Party Committee, People's Council, Association of Former TNXP or Former TNXP Liaison Board), Village Head where the TNXP subject requests resolution of allowance benefits.

b) Summarize the application documents for considering allowance benefits for TNXP and report to the People's Committee of the district (sent through the Civil Service Department).

3. Responsibilities of the People's Committee of the district directing the Civil Service Department:

Within five working days from the date of receipt of complete application documents (per batch), the Civil Service Department shall complete the task of reviewing the documents and summarizing them to report to the People's Committee of the province (sent through the Provincial Civil Service Department).

4. Responsibilities of the People's Committee of the province:

a) Direct the Civil Service Department:

Within ten working days from the date of receipt of complete application documents (per batch), the Civil Service Department shall lead and coordinate with the Department of Labor, Invalids, and Social Affairs to complete the review, examination, summary, and preparation of a decision on allowance benefits (prepared according to Model No. 3A, 3B, 3C along with a list of TNXP requesting allowance benefits prepared according to Model No. 4A, 4B, 4C issued together with this Circular).

For cases where TNXP no longer possess any of the documents proving their status as TNXP stipulated in point a and b of Clause 1 of Article 4 of this Circular, the Civil Service Department shall compile and transfer the list of subjects to the Association of Former TNXP at the provincial level for inspection and confirmation before submitting to the People's Committee of the province for decision.

After the Chairman of the People's Committee of the province issues a decision, the Civil Service Department shall transfer the decision along with the application documents for allowance benefits of the subject to the Department of Labor, Invalids, and Social Affairs for management.

b) Direct the Department of Labor, Invalids, and Social Affairs:

Within five working days from the date of receipt of the decision on resolving allowance benefits for TNXP (per batch), the Department of Labor, Invalids, and Social Affairs shall complete the task of compiling a list of subjects receiving one-time allowances (prepared according to Model No. 05 issued together with this Circular) along with a letter requesting additional budget for one-time allowance payments, sending two copies to the Ministry of Labor, Invalids, and Social Affairs. At the same time, organize the payment of monthly allowance benefits to the subjects according to current regulations.

The Department of Labor, Invalids, and Social Affairs is responsible for retaining the files of subjects receiving allowance benefits as prescribed.

Article 6. Administrative Work Expenses

1. Content and expenditure levels for administrative work:

a) Payment of remuneration to staff directly responsible for disbursing allowances. The specific expenditure level shall be determined by the Director of the Department of Labor, Invalids, and Social Affairs in accordance with actual conditions at the local level and guidelines from the Ministry of Labor, Invalids, and Social Affairs.

b) Dissemination of preferential policies for TNXP. Expenditure levels shall be in accordance with current regulations on the dissemination and education of laws.

c) Information and propaganda about the system and policies for TNXP through mass media. Expenditure levels shall be implemented according to contracts between the propaganda agency and the mass media.

d) Office supplies and printing of forms for professional use. Expenditures shall be settled based on actual costs within the approved budget by the competent authority.

đ) Expenditures for training seminars, mid-term reviews, and final summaries; expenditures for supervising the implementation of allowance systems for TNXP. Content and expenditure levels shall follow current regulations on conference expense and travel allowances.

e) Examination and review of application files. Expenditure level is 10,000 VND per file.

g) Expenditures for meetings of the village-level examination council. The maximum expenditure for members of the examination council is 20,000 VND per person per session.

2. Sources of funds for administrative work expenses:

a) Funds for managing one-time allowance recipients at the local level are combined with the allowance funds for recipients and guaranteed by the central government from the budget implementing preferential policies for persons who have rendered meritorious service to the revolution, with a rate of 1.7% of the total one-time allowance fund for recipients as stipulated in Circular Joint No. 47/2009/TTLT-BTC-BLDTBXH dated March 11, 2009 issued by the Ministry of Finance and the Ministry of Labor, Invalids, and Social Affairs guiding the distribution, management, and use of funds implementing preferential policies for persons who have rendered meritorious service to the revolution; persons directly participating in the resistance war managed by the labor sector.

The Department of Labor, Invalids, and Social Affairs shall take the lead and coordinate with the Department of Home Affairs to unify the allocation of funds for administrative work expenses for relevant agencies and units to use. The Department of Labor, Invalids, and Social Affairs is responsible for consolidating and settling accounts for administrative work expenses in accordance with current regulations.

b) Funds for managing monthly allowance recipients are guaranteed by the local government budget from the cost of managing social welfare beneficiaries as stipulated in Article 9 of Circular Joint No. 24/2010/TTLT-BLDTBXH-BTC dated August 18, 2010 issued by the Ministry of Labor, Invalids, and Social Affairs and the Ministry of Finance.

c) Central government funds for administrative work (including: training expenses; supervision and inspection expenses, and other expenses serving administrative work) of the Ministry of Labor, Invalids, and Social Affairs, and the Ministry of Home Affairs shall be allocated, used, and settled within the annual regular budget of the Ministry of Labor, Invalids, and Social Affairs and the Ministry of Home Affairs.

Article 7. Implementation Organization

1. Provincial People's Committees are responsible for allocating the local government budget to implement the monthly allowance system as stipulated in this Circular; directing and supervising the implementation of the allowance system for TNXP who have completed their tasks in the resistance war.

2. The Ministry of Labor, Invalids, and Social Affairs: Within no more than five working days from receiving a request for supplementary budget estimates for one-time allowance payments from localities, it shall be responsible for supplementing the budget estimates so that localities can make payments and settle accounts in accordance with regulations.

3. The Ministry of Home Affairs is responsible for directing the Departments of Home Affairs to proactively coordinate with related departments to promptly resolve any issues arising in the process of establishing files, confirming files, reviewing, and verifying files to submit to the Chairman of the Provincial People's Committee for decision in accordance with this Circular.

4. The Ministry of Finance is responsible for allocating the state budget to implement the one-time allowance system for TNXP as stipulated in this Circular.

5. It is requested that the Vietnam Veterans' Association organize propaganda and dissemination about the system and policies for TNXP as stipulated in this Circular; guide local veterans' associations to cooperate with local organizations to verify and confirm eligible recipients to avoid false claims and abuse of benefits.

Article 8. Effective Date

This Circular takes effect from June 1, 2012.

This Circular abolishes Circular Joint No. 17/2003/TTLT-LĐTBXH-TWĐTNCSHCM dated June 9, 2003 and Circular Joint No. 26/2007/TTLT-LĐTBXH-TWĐTNCSHCM dated November 21, 2007 issued by the Ministry of Labor, Invalids, and Social Affairs and the Central Youth Union.

In the course of implementation, if there are any difficulties, they should be reported promptly to the Ministry of Labor, Invalids, and Social Affairs, the Ministry of Home Affairs, and the Ministry of Finance for consideration and resolution.

1 Circular No. 08/2023/TT-BLĐTBXH dated August 29, 2023 of the Minister of Labor, Invalids and Social Affairs amending, supplementing, and abolishing certain articles of Circulars and Joint Circulars related to the submission and presentation of paper household registration books, temporary residence certificates, or documents requiring confirmation of place of residence when performing administrative procedures under the management of the Ministry of Labor, Invalids and Social Affairs is based on the following grounds:

"Pursuant to the Law on Household Registration dated November 13, 2020;

Pursuant to the Law on Issuing Legal Documents dated June 22, 2015 and the Law Amending and Supplementing Certain Provisions of the Law on Issuing Legal Documents dated June 18, 2020;

Based on Decree No. 62/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

BASED ON Decree No. 104/2022/NĐ-CP dated December 21, 2022 of the Government amending and supplementing certain articles of decrees related to the submission and presentation of paper household registration books and temporary residence books when performing administrative procedures and providing public services;

At the proposal of the Director of the Legal Department;

THE MINISTER OF LABOR, INVALIDS AND SOCIAL AFFAIRS issues this Circular to amend, supplement, and abolish certain articles of Circulars and Joint Circulars issued by the Minister of Labor, Invalids and Social Affairs;

The monthly allowance has been adjusted to VND 540,000 according to Article 1 of Decision No. 29/2016/QĐ-TTg dated July 5, 2016 of the Prime Minister adjusting the monthly allowance for volunteers who have completed their tasks during the resistance war.

Clause 5 of Circular No. 08/2023/TT-BLĐTBXH amending, supplementing, and abolishing certain articles of Circulars and Joint Circulars concerning the submission and presentation of paper household registration books, paper temporary residence books, or other documents requiring confirmation of place of residence when performing administrative procedures under the management of the Ministry of Labor, Invalids and Social Affairs shall take effect from October 12, 2023 and is stipulated as follows:

This Circular shall take effect from October 12, 2023.

For sample documents that are part of the administrative procedure files received before the date this Circular takes effect and have not yet been resolved, they shall continue to be processed according to the provisions of the Circulars and Joint Circulars that have not been amended, supplemented, or abolished by this Circular.

3. The Director of the Legal Department, Heads of units under the Ministry of Labor, Invalids, and Social Affairs responsible for state management, and relevant agencies, organizations, and individuals are responsible for implementing this Circular.

During the implementation process, if there are difficulties, they should be promptly reported to the Ministry of Labor, Invalids, and Social Affairs for research and resolution.
