Regarding the issuance of the "Supplementary List of Fertilizers Permitted for Production, Business and Use in Vietnam"

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production, business, and use;

Pursuant to Decree No. 179/2004/NĐ-CP dated October 21, 2004 of the Government stipulating state management of product quality;

Pursuant to Decision No. 36/2007/QĐ-BNN dated April 24, 2007 of the Minister of Agriculture and Rural Development on regulations concerning fertilizer production, business, and use;

At the proposal of the Director of the Crop Production Department,

DECISION:

Article 1. Attached hereto is the Supplementary List of Fertilizers Permitted for Production, Business and Use in Vietnam, which includes 95 types, divided into:

1. Organic fertilizers: 02 types;

2. Organic-mineral fertilizers: 08 types;

3. Organic-biological fertilizers: 07 types;

4. Organic-microbiological fertilizers: 01 type;

5. Microbial fertilizers: 01 type;

6. Foliar fertilizers: 73 types;

7. Mineral-blended fertilizers: 01 type;

8. Trace element fertilizers: 02 types;

Article 2. Organizations and individuals meeting the conditions prescribed in Article 5 of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production, business, and use are permitted to produce, trade, and use the types of fertilizers listed in this Supplementary List.

Article 3. a) Providing testimonies and expert opinions for the case for which they have been summoned; This Decision shall take effect fifteen days from the date of publication in the Official Gazette. The types of fertilizers specified in the following Decisions shall cease to be legally effective from the date this Decision takes effect:

1. Decision No. 40/2004/QĐ-BNN dated August 19, 2004 of the Minister of Agriculture and Rural Development on the Announcement of the List of Fertilizers Permitted for Production, Business and Use in Vietnam

a) Organic-biological fertilizers: Item number 23, page 23;

b) Foliar fertilizers: Item numbers 260, 261, 262, 263, 268, page 50;

2. Decision No. 77/2005/QĐ-BNN dated November 23, 2005 of the Minister of Agriculture and Rural Development on the Issuance of the List of Fertilizers Permitted for Production, Business and Use in Vietnam

a) Mineral fertilizers: Item number 6, page 1;

b) Organic-mineral fertilizers: Item number 7, page 16; item number 69, page 20; item numbers 105, 106, page 22;

c) Foliar fertilizers: Item numbers 1, 2, 3, 4, 5, 6, page 31; item numbers 168, 169, 170, 171, 172, 173, 174, 175, page 44; item numbers 176, 177, 178, page 45; item numbers 308, 309, 310, page 53; item numbers 311, 312, 313, page 54;

3. Decision No. 55/2006/QĐ-BNN dated July 7, 2006 of the Minister of Agriculture and Rural Development on the Issuance of the Supplementary List of Fertilizers Permitted for Production, Business and Use in Vietnam

4. Decision No. 67/2007/QĐ-BNN dated July 10, 2007 of the Minister of Agriculture and Rural Development on the Issuance of the Supplementary List of Fertilizers Permitted for Production, Business and Use in Vietnam

a) Organic fertilizers: Item numbers 1, 2, 3, 4, 9, page 2;

b) Organic-mineral fertilizers: Item number 4, page 3; item numbers 10, 11, page 4;

c) Microbial fertilizers: Item number 1, page 5;

d) Organic-microbiological fertilizers: Item number 7, page 6;

e) Foliar fertilizers: Item numbers 10, 11, 12, 13, page 8; item number 40, page 10;

Article 4. The Heads of the Ministry's Office, the Director of the Crop Production Department, the Director of the Science and Technology Department, the Directors of the Departments of Agriculture and Rural Development of provinces and centrally-administered cities, the Heads of units, organizations, and individuals related to fertilizer production, business, and use in Vietnam are responsible for implementing this Decision./.
