CIRCULAR

Regarding the issuance of the "Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam"

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/NĐ-CP amending Article 3 of Decree No. 01/2008/NĐ-CP of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production, business, and use; Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production, business, and use;

Pursuant to the Law on Product Quality dated November 21, 2007;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Law on Product and Goods Quality;

Pursuant to Decision No. 100/2008/QĐ-BNN dated October 15, 2008 of the Minister of Agriculture and Rural Development on the issuance of regulations on fertilizer production, business, and use;

The Ministry of Agriculture and Rural Development hereby issues the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam,

Article 1. Attached hereto is the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam (Annex 1 attached hereto), including 228 types, divided into:

Seven single mineral fertilizers;

Eight compound fertilizers;

Twenty organic biological fertilizers;

Twenty-six organic-mineral fertilizers;

Four microbial fertilizers;

Fourteen organic-microbial fertilizers;

One hundred forty-eight foliar fertilizers;

One soil improvement agent.

Article 2. Organizations and individuals are permitted to produce, trade, and use the types of fertilizers listed in this Supplementary List when they meet the conditions prescribed in Article 5 of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production, business, and use; and the provisions at Clause 4, Article 1 of Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production, business, and use.

Article 3. This Circular shall take effect forty-five days from the date of issuance. From the date this Circular takes effect, the following fertilizers will be removed from the list of fertilizers permitted for production, business, and use in Vietnam (1064 types of fertilizers - Annex 2 attached):

1. The list of fertilizers issued together with Decision No. 40/2004/QĐ-BNN dated August 19, 2009 of the Minister of Agriculture and Rural Development;

2. Organic-mineral fertilizers (No. 89, 90); Organic-biological fertilizers (No. 6) in the Supplementary List of Fertilizers issued together with Decision No. 77/2005/QĐ-BNN dated November 23, 2005 of the Minister of Agriculture and Rural Development;

3. Organic-mineral fertilizers (No. 18, 19) in the Supplementary List of Fertilizers issued together with Decision No. 10/2007/QĐ-BNN dated February 6, 2007 of the Minister of Agriculture and Rural Development;

4. Organic-biological fertilizers (No. 1, 2) in the Supplementary List of Fertilizers issued together with Decision No. 84/2007/QĐ-BNN dated October 4, 2007 of the Minister of Agriculture and Rural Development;

5. Organic-biological fertilizers (No. 1, 2) in the Supplementary List of Fertilizers issued together with Decision No. 79/2008/QĐ-BNN dated July 8, 2008 of the Minister of Agriculture and Rural Development;

6. Organic-biological fertilizers (No. 19) in the Supplementary List of Fertilizers issued together with Circular No. 17/2009/TT-BNN dated March 27, 2009 of the Minister of Agriculture and Rural Development;

7. Organic-mineral fertilizers (No. 5); Organic-microbial fertilizers (No. 1) in the Supplementary List of Fertilizers issued together with Circular No. 62/2009/TT-BNNPTNT dated September 25, 2009 of the Minister of Agriculture and Rural Development;

Article 4. The Director of the Ministry's Office, the Director of the Crop Cultivation Department, the Director of the Science, Technology, and Environment Department, the Directors of the Departments of Agriculture and Rural Development of provinces and centrally-administered cities, the Heads of units, organizations, and individuals related to fertilizer production, business, and use in Vietnam are responsible for implementing this Circular./.
