Pursuant to the Law on Statistics dated November 23, 2015;
At the proposal of the Minister of Planning and Investment;
The Government promulgates this Decree to regulate the structure, tasks, and powers of centralized statistical organizations and ministry-level statistical organizations.
PART I
GENERAL PROVISIONS
Article 1. Scope and Applicability
1. This Decree regulates the structure, tasks, and powers of centralized statistical organizations and ministry-level statistical organizations.
2. This Decree applies to ministries, ministerial-level agencies; provincial People's Committees under the central government (hereinafter referred to collectively as provincial People's Committees); district, county, town, and city People's Committees under provinces (hereinafter referred to collectively as district-level People's Committees), and commune, ward, and town People's Committees (hereinafter referred to collectively as commune-level People's Committees).
Chapter II
STRUCTURE, TASKS, AND POWERS
OF THE CENTRALIZED STATISTICAL ORGANIZATION SYSTEM
Article 2. Centralized Statistical Organization System
The centralized statistical organization system includes the central statistical agency and local statistical agencies.
Local statistical agencies include provincial statistical agencies and district statistical agencies.
Article 3. Tasks and Limitations
1. Drafting laws, draft resolutions of the National Assembly; draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft resolutions, decrees of the Government; decisions, directives of the Prime Minister; circulars of the Ministry of Planning and Investment concerning the field of statistics for submission to competent authorities for consideration, decision-making, and implementation after approval by competent authorities.
2. Taking the lead and coordinating with relevant agencies to perform the following tasks:
a) Building and managing the national statistical information system at the provincial and district levels.
b) Guiding, inspecting, and reporting on the results of implementing national statistical indicators at the provincial, district, commune, and village levels and the national census program.
c) Organizing and coordinating research activities, applying advanced statistical methods; developing and applying information technology; connecting and providing data and information between state statistical information systems; consulting users of statistical information and international cooperation in state statistical activities.
3. Reviewing statistical indicator systems, statistical classifications, survey plans, reporting regulations, and statistical data according to the provisions of the law.
4. Taking the lead and coordinating with relevant agencies to organize the implementation of comprehensive surveys and other statistical surveys; implementing coordination regulations, management, and use of administrative data for state statistical activities; implementing reporting regulations and compiling statistical indicators according to the provisions of the law.
5. Receiving reports on the results of statistical surveys outside the national census program conducted by ministries, ministerial-level agencies, and provincial People's Committees.
6. Analyzing, forecasting, and publishing economic and social statistical information according to the provisions of the law.
7. Conducting specialized statistical inspections according to the provisions of the law.
Chapter III
MINISTRY-LEVEL STATISTICAL ORGANIZATIONS
1. The position and functions of the Social and Cultural Department shall be carried out in accordance with Article 11 of Decree No. 150/2025/NĐ-CP.
1. Ministry-level statistical organizations are units under ministries and ministerial-level agencies responsible for advising and assisting ministers and heads of ministerial-level agencies in managing state affairs related to statistics, organizing statistical activities within their sectors and fields according to the provisions of the law.
2. Ministry-level statistical organizations are subject to guidance, inspection, and review of professional statistical matters by the central statistical agency.
Article 5. Tasks and Powers
1. Taking the lead and coordinating with related units to submit to ministers and heads of ministerial-level agencies for consideration and decision-making:
a) Programs, projects, proposals, plans, policies, strategies, and related documents on statistics of ministries and ministerial-level agencies and their implementation after approval by competent authorities.
b) Statistical indicator systems, sectoral classifications, and reporting regulations at the ministry and sector level within their scope of responsibility after being reviewed by the central statistical agency regarding professional statistical matters.
c) Economic and technical standards and quality management in the areas under the management of ministries and sectors in accordance with the provisions of the law.
d) Conducting statistical surveys within the national census program; conducting statistical surveys outside the national census program.
đ) Coordination regulations between ministries and ministerial-level agencies and the central statistical agency regarding the use of administrative data for state statistical activities.
e) Schedules for disseminating statistical information of ministries and ministerial-level agencies; unified regulations for disseminating state statistical information applicable within ministries and ministerial-level agencies.
g) Developing and implementing plans to inspect compliance with laws on statistics by agencies and organizations under their sectors and fields; recommending measures to deal with violations of statistics laws by organizations and individuals.
2. Cooperating with organizations under ministries and ministerial-level agencies to develop plans to inspect compliance with laws on statistics by agencies and organizations under their sectors and fields according to the provisions of the law.
3. Submitting to ministers and heads of ministerial-level agencies for issuance of statistical indicators, sectoral classifications, and reporting regulations for agencies under the Government assigned to them.
4. Building, developing, and managing the operation of the statistical information system of ministries and ministerial-level agencies.
5. Taking the lead and coordinating with relevant agencies and units to collect, compile, and publish national statistical indicators, sectoral statistical indicators; analyzing and forecasting statistics; compiling yearbooks and statistical publications according to the provisions of the law.
6. Collecting, compiling, and reporting the results of statistical surveys conducted by ministries and ministerial-level agencies.
7. Preparing review files on statistical indicator systems, sectoral classifications, survey plans, reporting regulations, and statistical data of ministries and sectors within the national statistical indicator system for submission to the central statistical agency for review and publication according to the provisions.
8. Providing opinions on amendments and supplements to the national census program and comprehensive national census.
9. Coordinate with the central statistical agency to inspect the use of statistical data and information for national statistical indicators, provincial, district, and commune-level statistical indicators that have been published by authorized bodies.
10. Organize training, capacity building, and guidance on statistical business for personnel engaged in statistical work within ministries and ministerial-level agencies.
11. Organize research and implementation of scientific topics related to statistics; apply information technology and communication technologies to statistical work within ministries and ministerial-level agencies.
12. Perform other statistical tasks and powers assigned by the Minister or head of a ministerial-level agency.
Article 6. Statistical organization of ministries and ministerial-level agencies
The statistical organization of ministries and ministerial-level agencies is the Statistics Office under the Department of Planning and Finance or another administrative organization under the ministry or ministerial-level agency.
Article 7. Personnel engaged in statistical work of ministries and ministerial-level agencies
1. Personnel engaged in statistical work of ministries and ministerial-level agencies must meet the criteria stipulated in Clause 2, Article 66 of the Statistics Law.
2. Personnel engaged in statistical work of ministries and ministerial-level agencies are responsible for complying with legal provisions on statistics; implementing and being accountable for statistical activities assigned to them.
3. Personnel engaged in statistical work of ministries and ministerial-level agencies shall be trained, developed, and enhanced in their professional expertise, information technology, foreign languages, and knowledge in other fields to serve statistical work; they shall enjoy benefits and policies as prescribed by law.
Chapter IV
IMPLEMENTING PROVISIONS
Article 8. Effective Date
1. This Decree takes effect from September 5, 2017.
2. This Decree replaces Decree No. 03/2010/NĐ-CP dated January 13, 2010 of the Government on the tasks, powers, and organizational structure of statistical work in ministries, ministerial-level agencies, and government agencies.
Article 9. Responsibility for implementation
The Minister, heads of ministerial-level agencies, heads of government agencies, Chairpersons of People's Committees of provinces and centrally-administered cities are responsible for enforcing this Decree./.
