DECREE
REGULATIONS ON THE TREATMENT OF OPIATE SUBSTANCE DEPENDENCY WITH SUBSTITUTION MEDICATIONS
Pursuant to the Law on Government Organization dated June 19, 2015;
WHEREAS the Investment Law on November 26, 2014;udated November 26, 2014;
Pursuant to the Law on Prevention and Control of Infection with Human Immunodeficiency Virus (HIV) and Acquired Immune Deficiency Syndrome (AIDS) dated June 29, 2006;
At the proposal of the Minister of Health;
The Government promulgates this Decree to regulate the treatment of opiate substance dependency with substitution medications.logosubstitute drugs.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree provides for:
1. Registration for participation in the treatment of opiate substance dependency with substitution medications (hereinafter referred to as opiate substance dependency treatment).
2. Conditions for opiate substance dependency treatment facilities (hereinafter referred to as treatment facilities); announcement of meeting the conditions for opiate substance dependency treatment, suspension of opiate substance dependency treatment services, cancellation of announcements meeting the conditions for opiate substance dependency treatment.
3. Conditions ensuring the work of opiate substance dependency treatment.
Article 2. Interpretation of Terms
In this Decree, the following terms shall be understood as follows:
1. Opiate substances are natural, synthetic, and semi-synthetic substances that have effects similar to opiates.
2. An opiate substance dependent person is someone who uses and is addicted to opiate substances.
3. Substitution medication is a synthesized substance or mixture of substances that can replace opiate substances listed in the drug addiction medication catalog as prescribed by law.
4. Treatment of opiate substance dependency with substitution medication is the use of substitution medication to treat opiate substance dependent persons.
5. Maintenance dose is the corresponding dose of substitution medication for each patient, ensuring safety and long-term use to help patients reduce or stop using opiate substances.
Article 3. Application of laws in the treatment of opiate substance dependency
1. Opiate substance dependent persons have the right to choose to participate in opiate substance dependency treatment according to this Decree or voluntarily undergo detoxification at home and in the community according to Decree No. 94/2010/NĐ-CP of the Government dated September 9, 2010, regulating the organization of drug detoxification at home and in the community.
2. No file shall be established to propose the application of educational measures at commune, ward, town level against opiate substance dependent persons who do not violate administrative violation regulations but voluntarily participate in opiate substance dependency treatment; no file shall be established to propose the application of compulsory drug rehabilitation center placement measures for those currently participating in opiate substance dependency treatment.
3. This provision in Clause 2 shall not apply to persons who have been terminated from opiate substance dependency treatment according to Clause 2 of Article 10 of this Decree but continue to use drugs illegally.
Article 4. Principles of opiate substance dependency treatment
1. Opiate substance dependency is a chronic disease requiring long-term treatment.
2. Opiate substance dependency treatment can only be carried out when opiate substance dependent persons voluntarily participate in treatment.
3. Opiate substance dependency treatment can only be carried out at facilities that have announced meeting the conditions for opiate substance dependency treatment as stipulated in this Decree.
4. Opiate substance dependency treatment must comply with professional guidelines as prescribed by the Minister of Health.
5. Opiate substance dependency treatment must go through stages: Initial dosing, dose adjustment or titration, maintenance treatment, dose reduction leading to cessation of treatment.
Article 5. Management of Substitute Medications
1. Medicines used for treating opiate addiction must be legally circulated in Vietnam.
2. Medicines used for treating opiate addiction shall be managed in accordance with regulations on managing addictive drugs, psychotropic substances, and relevant laws.
Chapter II
REGISTRATION FOR TREATMENT OF OPIATE ADDICTION
Article 6. Subjects registering to participate in treatment of opiate addiction
1. Individuals voluntarily participating in opiate addiction treatment and committing to comply with such treatment must be at least six years old but under fifteen years old, and their participation in treatment can only occur after obtaining written consent from their legal representatives.
2. Students, prisoners, inmates, students in correctional schools addicted to opiates who voluntarily join opiate addiction treatment and commit to complying with such treatment before being placed under compulsory rehabilitation facilities, prisons, detention centers, compulsory educational facilities, or correctional schools. For individuals aged at least six but under fifteen years old, their participation in treatment can only occur after obtaining written consent from their legal representatives. Prisoners participating in opiate addiction treatment enjoy all rights like other prisoners.
Article 7. Registration Documents for Treatment of Opiate Addiction
The registration documents for opiate addiction treatment include:
1. Application for opiate addiction treatment using substitute medications according to Form No. 01 prescribed in the Appendix accompanying this Decree.
2. A copy of one of the following documents (applicable only to cases stipulated in Clause 1 of Article 6 of this Decree): Identity card, passport, birth certificate, household registration book, or driver's license.
Article 8. Acceptance of Participation in Opiate Addiction Treatment for Opiate Addicts
1. Acceptance of opiate addiction treatment for community opiate addicts:
a) Opiate addicts submit registration documents for opiate addiction treatment in accordance with Article 7 of this Decree to the treatment facility where they wish to receive treatment.
b) Upon receiving valid registration documents for opiate addiction treatment, the head of the treatment facility is responsible for:
- Organizing an examination and evaluation for the person registering for opiate addiction treatment;
- Accepting cases meeting the conditions for participation in opiate addiction treatment according to Form No. 02 prescribed in the Appendix accompanying this Decree. If not agreeing to accept, a written response must be provided with clear reasons.
c) The acceptance certificate for cases meeting the conditions for participation in opiate addiction treatment is made in two copies: one copy sent to the person undergoing opiate addiction treatment or their legal representative if the person is at least six but under fifteen years old; one copy kept in the treatment file of the person undergoing opiate addiction treatment at the treatment facility.
2. Acceptance of opiate addiction treatment for opiate addicts when being placed under management in compulsory rehabilitation facilities, prisons, detention centers, compulsory educational facilities, or correctional schools:
a) Students, prisoners, inmates, students in correctional schools (hereinafter referred to as management subjects) addicted to opiates submit registration documents for opiate addiction treatment in accordance with Article 7 of this Decree to the management facility where they wish to receive treatment before being placed under management;
b) Upon receiving valid registration documents for opiate addiction treatment, the head of the management facility is responsible for:
- Organizing or coordinating with community healthcare facilities to examine and evaluate the person registering for opiate addiction treatment;
- Accepting cases meeting the conditions for participation in opiate addiction treatment according to Form No. 02 prescribed in the Appendix accompanying this Decree. If not agreeing to accept, a written response must be provided with clear reasons.
c) The acceptance certificate for cases meeting the conditions for participation in opiate addiction treatment is made in two copies: one copy sent to the person undergoing opiate addiction treatment or their legal representative if the person is at least six but under fifteen years old; one copy kept in the treatment file of the person undergoing opiate addiction treatment at the management facility.
Article 9. Transfer of treatment for opiate addiction
1. Transfer of treatment for opiate addiction for individuals with opiate addiction outside the community:
a) The patient submits an application for transfer of treatment for opiate addiction using substitute drugs according to Form No. 03 prescribed in the Appendix accompanying this Decree to the head of the treatment facility where the patient is currently receiving treatment;
b) The head of the treatment facility is responsible for preparing a summary of the medical record for treatment of opiate addiction using substitute drugs (hereinafter referred to as the summary medical record) according to Form No. 04 prescribed in the Appendix accompanying this Decree to be provided to the patient when the patient transfers;
c) The head of the treatment facility where the patient is transferring to is responsible for accepting treatment for the patient. In case of disagreement with acceptance, a written response must be given along with a clear explanation of the reasons.
2. Transfer of treatment for opiate addiction for individuals with opiate addiction in cases where the treatment facility is suspended from operation for a limited period pursuant to the administrative penalty decision:
a) Upon receipt of the administrative penalty decision against the treatment facility with a form of suspension from operation for a limited period (hereinafter referred to as the suspended treatment facility), the suspended treatment facility is responsible for preparing a summary medical record according to Form No. 04 prescribed in the Appendix accompanying this Decree to be provided to the patient;
b) Within two working days from the date of receipt of the administrative penalty decision against the treatment facility with a form of suspension from operation for a limited period, the Department of Health where the suspended treatment facility is located is responsible for designating treatment facilities under its management to carry out the transfer of treatment for patients of the suspended treatment facility;
c) Within two working days from the date of receipt of the designation from the Department of Health, the designated treatment facility is responsible for accepting treatment for opiate addiction for patients of the suspended treatment facility;
d) The suspended treatment facility is responsible for transferring treatment for opiate addiction for patients back to treatment at the treatment facility after the Department of Health completes the re-publication procedures for the treatment facility upon expiration of the suspension period as stipulated in Clause 2, Article 18 of this Decree.
3. Transfer of treatment for opiate addiction for individuals with opiate addiction in cases where the treatment facility requests cancellation of the registration file confirming eligibility for treatment of opiate addiction:
a) Upon receipt of the request from the treatment facility to the Department of Health to cancel the registration file confirming eligibility for treatment of opiate addiction, the treatment facility is responsible for preparing a summary medical record according to Form No. 04 prescribed in the Appendix accompanying this Decree to be provided to the patient;
b) Within two working days from the date of receipt of the request from the treatment facility to cancel the registration file confirming eligibility for treatment of opiate addiction, the Department of Health is responsible for designating treatment facilities under its management to carry out the transfer of treatment for patients of the treatment facility requesting cancellation of the registration file confirming eligibility for treatment of opiate addiction;
c) Within two working days from the date of receipt of the designation from the Department of Health, the designated treatment facility is responsible for accepting treatment for opiate addiction for patients of the treatment facility requesting cancellation of the registration file confirming eligibility for treatment of opiate addiction.
4. Transfer of treatment for opiate addiction between management facilities:
a) The head of the management facility is responsible for preparing a summary medical record according to Form No. 04 prescribed in the Appendix accompanying this Decree to be provided to the patient when the patient transfers;
b) The management facility where the patient is transferring to is responsible for accepting treatment for the patient. In case of disagreement with acceptance, a written response must be given along with a clear explanation of the reasons.
5. Transfer of treatment for opiate addiction for individuals with opiate addiction returning to the community from a management facility:
a) The head of the management facility is responsible for preparing a summary medical record according to Form No. 04 prescribed in the Appendix accompanying this Decree to be provided to the patient when the patient returns to the community;
b) The head of the community-based treatment facility where the patient has registered for treatment is responsible for accepting treatment for the patient. In case of disagreement with acceptance, a written response must be given along with a clear explanation of the reasons.
Article 10. Termination of Treatment for Individuals Participating in Opioid Addiction Treatment
1. An individual participating in opioid addiction treatment may terminate treatment upon expressing a desire not to continue with the treatment.
2. An individual participating in opioid addiction treatment shall have their treatment terminated if they violate any of the following provisions:
a) Failing to comply with the professional procedures for opioid addiction treatment two or more times within six months;
b) Testing positive for opioids continuously two or more times (excluding substitute medications) within twelve months after reaching the maintenance dose;
c) Testing positive for other illegal drugs outside of opioids;
d) Engaging in acts that harm personal or organizational property; the property, health, reputation, and dignity of citizens, foreign nationals; or violating public order and social safety.
Chapter III
CONDITIONS FOR OPIOID ADDICTION TREATMENT FACILITIES, ANNOUNCEMENT OF SATISFACTORY CONDITIONS FOR OPIOID ADDICTION TREATMENT, SUSPENSION OF OPIOID ADDICTION TREATMENT SERVICES, AND REVOCATION OF ANNOUNCEMENTS OF SATISFACTORY CONDITIONS FOR OPIOID ADDICTION TREATMENT
Section 1. OPIOID ADDICTION TREATMENT FACILITY
Article 11. Classification of Treatment Facilities
Treatment facilities include:
1. Substitute treatment facility is an entity providing opioid addiction treatment through substitute medication for opioid addicts, including the distribution of substitute treatment medications.
2. Medication distribution facility (hereinafter referred to as the distribution facility) is a facility solely responsible for distributing substitute medications to individuals participating in opioid addiction treatment.
Article 12. Conditions for Operation of Substitute Treatment Facilities
1. Physical conditions:
a) There must be reception areas, administrative offices, medication dispensing and storage rooms, counseling rooms, medical examination rooms, and laboratory testing rooms. Each room in the substitute treatment facility must have an area of at least 10 square meters.2 /second or more;
b) The rooms in the substitute treatment facility must be constructed securely, well-lit, with dust-proof ceilings, walls and floors made of easily cleanable materials, secure windows, and doors with locks;
c) The testing area must use non-porous materials resistant to water, heat, and corrosive chemicals; it must have hand washing basins, emergency eye wash stations, first aid boxes;
d) Adequate electricity and water supply must be ensured, and the facility must meet the legal requirements for managing medical waste, fire prevention, and firefighting.
2. Equipment conditions:
a) Medication dispensing and storage room:
- Hygrometer;
- Room temperature thermometer;
- Air conditioning;
- Two sturdy locked cabinets for storing medication, one for daily dispensing and one for storage;
- Medication dispensing tools;
- File cabinet or shelf for storing records, logs, and treatment follow-up forms;
- Sterilization equipment for tools and specimens;
- Monitoring equipment for treatment implementation.
b) Medical examination room:
- Thermometer for body temperature;
- Stethoscope;
- Emergency medicine cabinet (including antidotes);
- Blood pressure monitor;
- First aid kit;
- Examination table;
- Scale for measuring weight and height;
- Sterilization equipment for tools and specimens.
c) Laboratory testing room:
- Urine and blood sampling equipment;
- Refrigerator for preserving biological samples and specimens.
d) Patient urine collection area:
- Toilet with a water supply valve located outside the collection area;
- One-way tinted glass partition allowing facility staff to observe patients collecting their own urine samples.
3. Personnel conditions:
a) At least one full-time specialist responsible for professional matters, who is a doctor certified in opioid addiction treatment training and works exclusively at the substitute treatment facility;
b) At least one employee supporting medical examination and treatment tasks with a minimum level of secondary specialized education in healthcare;
c) At least two employees responsible for medication distribution with a minimum level of secondary specialized education in healthcare or pharmacy. The warehouse manager must meet the professional requirements stipulated by the pharmaceutical laws;
d) At least one employee responsible for testing with a minimum level of secondary specialized education in one of the fields of healthcare, pharmacy, biology, or chemistry;
đ) At least one employee responsible for counseling with a minimum level of secondary specialized education in one of the fields of healthcare, pharmacy, or social work;
e) At least one administrative employee with a minimum level of secondary education;
g) Depending on actual circumstances, the substitute treatment facility should arrange security personnel either at the facility's location or cooperate with local police to ensure security for the facility; in necessary cases, up to two dedicated security personnel can be arranged for the facility;
h) The number of full-time employees must reach at least seventy-five percent of the total number of employees at the substitute treatment facility. The allocation of human resources for opioid addiction treatment at the facility should be carried out according to a dedicated or part-time system, ensuring compliance with the professional requirements set forth in Clause 3 of this Article and the scale of the substitute treatment facility.
Article 13. Conditions for the operation of drug dispensing facilities
1. Physical conditions:
a) Having reception areas, dispensing rooms, and medicine storage rooms. The dispensing and storage rooms must have an area of at least 10 square meters.2 /second or more;
b) The dispensing and storage rooms must be constructed solidly, with adequate lighting, ceiling dust-proof, walls and floors made of easy-to-clean materials, windows must be sturdy, and entry doors must be lockable;
c) Ensuring sufficient electricity and water supply, and meeting the requirements for medical waste management, fire prevention, and firefighting as stipulated by law.
2. Equipment conditions:
Drug dispensing facilities must meet the equipment conditions prescribed in point a, Clause 2, Article 12 of this Decree.
3. Personnel conditions:
a) Drug dispensing facilities must meet the personnel conditions prescribed in points c and g, Clause 3, Article 12 of this Decree;
b) The allocation of human resources to implement opiate addiction treatment at drug dispensing facilities shall be carried out on a dedicated or兼任或专责制度,确保符合本条第三款第a点和戒毒药品供应设施规模的专业要求。
Section 2. ANNOUNCEMENT OF SATISFACTORY CONDITIONS FOR OPIATE ADDICTION TREATMENT, SUSPENSION OF OPIATE ADDICTION TREATMENT SERVICES, AND DESTRUCTION OF ANNOUNCEMENTS OF SATISFACTORY CONDITIONS FOR OPIATE ADDICTION TREATMENT
Article 14. Announcement of satisfactory conditions for opiate addiction treatment
1. Treatment facilities shall announce their satisfactory conditions for opiate addiction treatment through one of the following two methods:
a) Submitting the original announcement filing for satisfactory conditions for opiate addiction treatment (hereinafter referred to as the announcement filing) to the Department of Health for publication on the Department's electronic information website;
b) Submitting the announcement filing electronically to the Department of Health for publication on the Department's electronic information website. In cases where the announcement filing is submitted electronically, the treatment facility is responsible for retaining the original copy of the announcement filing and bears legal responsibility for the accuracy and truthfulness of the announcement filing.
2. The announcement filing includes:
a) A request form for announcing satisfactory conditions for opiate addiction treatment using substitute drugs according to Form No. 05 as specified in the Appendix attached to this Decree;
b) A copy of the establishment decision of the competent state authority or a copy of the investment certificate or a copy of the business registration certificate or equivalent documents of the facility;
c) A list of personnel according to Form No. 06 as specified in the Appendix attached to this Decree, accompanied by copies of the professional qualifications of each staff member;
d) An inventory of equipment of the treatment facility according to Form No. 07 as specified in the Appendix attached to this Decree;
đ) A floor plan of the treatment facility.
Article 15. Procedures for announcing satisfactory conditions for opiate addiction treatment for initial announcement facilities 1. Procedures for announcing satisfactory conditions for opiate addiction treatment for facilities submitting original announcement filings to the Department of Health:
a) Before commencing operations, opiate addiction treatment facilities that meet the conditions stipulated in this Decree shall submit the original announcement filing to the Department of Health where the treatment facility is located;
b) Upon receiving the announcement filing from the treatment facility, the Department of Health shall issue a Receipt for Announcement Filing for Opiate Addiction Treatment Conditions (hereinafter referred to as the Receipt for Announcement Filing) to the treatment facility according to Form No. 08 as specified in the Appendix attached to this Decree. If the filing does not comply with the provisions of Clause 2, Article 14 of this Decree, the Department of Health shall send a letter to the treatment facility requesting supplementary and completion of the announcement filing;
c) If the announcement filing complies with the provisions of Clause 2, Article 14 of this Decree, within five working days from the date recorded on the Receipt for Announcement Filing (the receipt date is calculated based on the Department of Health's receipt stamp), the Department of Health shall be responsible for reviewing the filing and publishing the following information on its electronic information website: Name, address, contact phone number, and the full text of the announcement filing of the treatment facility.
2. Procedures for announcing satisfactory conditions for opiate addiction treatment for facilities submitting announcement filings electronically to the Department of Health:
a) Before commencing operations, opiate addiction treatment facilities that meet the conditions stipulated in this Decree shall submit the announcement filing (in PDF format) to the email box of the Department of Health where the treatment facility is located;
b) Upon receiving the announcement filing from the treatment facility, the Department of Health shall issue a Receipt for Announcement Filing (in PDF format) to the treatment facility via email according to Form No. 08 as specified in the Appendix attached to this Decree. If the filing does not comply with the provisions of Clause 2, Article 14 of this Decree, the Department of Health shall send a letter (in PDF format) via email to the treatment facility requesting supplementary and completion of the announcement filing;
c) If the announcement filing complies with the provisions of Clause 2, Article 14 of this Decree, within five working days from the date of receipt of the announcement filing from the treatment facility, the Department of Health shall be responsible for reviewing the filing and publishing the following information on its electronic information website: Name, address, contact phone number, and the full text of the announcement filing of the treatment facility.
c) In case the announcement dossier meets the provisions stipulated in Clause 2, Article 14 of this Decree, within five working days from the date of receipt of the announcement dossier of the treatment facility, the Department of Health shall be responsible for checking the dossier and publicly disclosing on its electronic website the following information: Name, address, contact phone number, and the full text of the announcement dossier of the treatment facility.
Article 16. Procedures for re-publication regarding drug addiction treatment facilities that have changes in name, address, material infrastructure, equipment, and personnel.in 2. Material infrastructure, equipment, and personnel
1. Within ten working days from the date of any change in name, address, material infrastructure, equipment, or personnel, the treatment facility shall notify in writing the Department of Health which has received and published the facility's dossier on the Department of Health’s electronic information website.
2. Within five working days from the date of receipt of the notification letter from the treatment facility (the receipt date is calculated based on the Department of Health’s receipt stamp), the Department of Health shall update the changed information in the published dossier of the treatment facility on the Department of Health’s electronic information website.
Article 17. Procedures for re-publication when the drug addiction treatment facility’s dossier is damaged or lost. other Deputy Directorsi drug addiction treatment facility that has been declared qualified to treat drug addiction through electronic means when the publication dossier is damaged or lost.
1. Within twenty-four hours from the discovery of the loss or damage of the publication dossier, the treatment facility shall notify in writing (in PDF format) to the email box of the Department of Health where the treatment facility is headquartered.
2. The treatment facility shall complete the publication dossier according to Clause 2, Article 14 of this Decree and send the publication dossier (in PDF format) to the email box of the Department of Health where the treatment facility is headquartered within thirty days from the date of the notification letter to the Department of Health.
3. The procedures for re-publishing the drug addiction treatment facility with a damaged or lost publication dossier that meets the qualification requirements shall be carried out according to Points b and c, Clause 2, Article 15 of this Decree.
Article 18. Procedures for publishing the suspension of operations of a treatment facility due to administrative penalties and procedures for re-publishing the treatment facility after the suspension period.in treatment facility after the suspension period ends.policiessuspension period
1. Procedures for publishing the suspension of operations of a treatment facility due to administrative penalties:
a) Within five working days from the date of receiving the administrative penalty decision imposing a limited suspension of operations on the treatment facility (excluding cases requiring public announcement on mass media, as stipulated in Article 72 of the Law on Handling Administrative Violations), the Department of Health where the treatment facility is headquartered shall publish the temporary suspension of operations of the treatment facility on the Department of Health’s electronic information website;
b) Within five working days before the end of the suspension period as specified in the administrative penalty decision, the suspended treatment facility must submit documentation on the completion of the administrative penalty decision (hereinafter referred to as the violation rectification dossier) to the Department of Health.
2. Procedures for re-publishing the treatment facility after the suspension period ends:
a) Within five working days from the date of receipt of the violation rectification dossier of the suspended treatment facility (the receipt date is calculated based on the Department of Health’s receipt stamp), the Department of Health shall republish the treatment facility on the Department of Health’s electronic information website if the Department of Health agrees with the violation rectification dossier of the treatment facility. If not agreed, the Department of Health shall notify in writing the treatment facility and specify the reasons for disagreement;
b) Within five working days from the date of receipt of the notification letter disagreeing from the Department of Health, the suspended treatment facility must rectify the violations and submit the violation rectification dossier to the Department of Health;
c) Within five working days from the date of receipt of the violation rectification dossier of the suspended treatment facility (the receipt date of the violation rectification dossier is calculated based on the Department of Health’s receipt stamp), the Department of Health shall examine and revoke the suspension decision against the treatment facility according to Point a, Clause 2 of this Article;
d) Within five working days from the date the suspension decision becomes ineffective, if the suspended treatment facility fails to rectify the violations or the rectification does not meet the requirements set forth in Articles 12 and 13 of this Decree, the Department of Health shall cancel the publication dossier of the treatment facility on the Department of Health’s electronic information website according to Article 21 of this Decree;
e) In case the treatment facility is penalized with a suspension of operations exceeding twelve months, the Department of Health shall cancel the publication dossier of the treatment facility on the Department of Health’s electronic information website according to Article 21 of this Decree. After the suspension period ends according to the administrative penalty decision, the publication of the qualification to treat drug addiction for the treatment facility shall be carried out according to Article 15 of this Decree.
Article 19. Procedure for requesting cancellation of registration dossier for treatment facilitiesin request to cancel registration dossier
1. Within thirty days prior to the cessation of operations, the treatment facility requesting cancellation of the registration dossier shall be responsible for notifying in writing the Department of Health where the facility's registration dossier was published on the Department of Health’s electronic information website.
2. Within five working days from the date of receipt of the notification letter from the treatment facility (the receipt date is calculated based on the Department of Health’s stamp upon receipt of the official document), the Department of Health shall carry out the procedure to cancel the registration dossier of the treatment facility in accordance with Article 21 of this Decree.
Article 20. Cancellation of registration dossier of treatment facilities
In addition to the cases stipulated in points d and đ Clause 2 Article 18 and Clause 2 Article 19 of this Decree, the treatment facility will have its registration dossier canceled in the following cases:
1. The treatment facility does not implement drug addiction treatment within twelve months from the date the facility's registration dossier was posted on the Department of Health’s electronic information website.
2. The treatment facility suspends operations for a continuous period of twelve months.
Article 21. Procedure for canceling registration dossier of treatment facilities
Within five working days from the date the treatment facility violates the provisions stipulated in points d and đ Clause 2 Article 18 or requests cancellation of the registration dossier according to Clause 1 Article 19 of this Decree, or violates the provisions stipulated in Articles 20 Clause 1 and 2 of this Decree, or receives inspection results or audit conclusions on the operation of the treatment facility, the Department of Health shall be responsible for:
1. Notifying in writing the treatment facility about the cancellation of the registration dossier on the Department of Health’s electronic information website.
2. Carrying out the cancellation of the registration dossier of the treatment facility on the Department of Health’s electronic information website.
Chapter IV
CONDITIONS TO ENSURE DRUG ADDICTION TREATMENT WORK
Article 22. Regulations and policies for persons participating in treatment and those engaged in drug addiction treatment work and drug addiction treatment 1. Persons participating in drug addiction treatment are entitled to free substitute medication provided by the state budget.
2. The state budget ensures all costs for health check-ups and drug addiction treatment for individuals undergoing compulsory detoxification, inmates in prisons, detainees in temporary detention centers, and students in compulsory education centers.
3. The state budget covers part of the costs for health check-ups and drug addiction treatment for participants in drug addiction treatment programs under the following categories:
b) Individuals affected by chemical warfare agents with a labor capacity reduction of 81% or more;
a) War invalids;
c) Poor individuals;
4. Regulations and policies for personnel engaged in drug addiction treatment at public treatment facilities:
d) Elderly people living alone without support;
đ) Orphan children;
e) Severely and extremely disabled persons.
a) Civil servants, public officials, and direct workers involved in testing, examination, and treatment of patients at public treatment facilities shall be entitled to a subsidy equal to seventy percent of their current salary grade plus position allowance and seniority allowance exceeding the standard range, if applicable;
b) Civil servants, public officials, administrative staff, counselors, pharmacists, and direct workers involved in dispensing medication to patients at public treatment facilities shall be entitled to a subsidy equal to thirty percent of their current salary grade plus position allowance and seniority allowance exceeding the standard range, if applicable.
5. The Minister of Finance shall provide guidance on implementing the provisions of Clauses 2 and 3 of this Article. The Minister of Health shall establish a framework for the cost of drug addiction treatment services applied in public treatment facilities after obtaining the agreement of the Minister of Finance.
5. The Minister of Finance shall provide guidance on implementing the provisions in Clauses 2 and 3 of this Article. The Minister of Health shall establish a pricing framework for opiate addiction treatment services to be applied in public treatment facilities after obtaining the agreement of the Minister of Finance.
Article 23. Financial Sources of Treatment Facilities
1. State budget to implement the provisions set forth in Clauses 1, 2, and 3 of Article 22 of this Decree.
2. Revenue from providing treatment services for drug addiction.
3. Funding, fundraising, and contributions from domestic and foreign organizations and individuals.
4. Other lawful sources.
Chapter V
RESPONSIBILITIES FOR IMPLEMENTATION
Article 24. Responsibilities of Patients
1. Respect and refrain from acts that infringe upon the dignity, personality, health, and life of staff at treatment facilities.
2. Provide truthful information related to their health status and fully cooperate with staff at treatment facilities.
3. Adhere to diagnostic and treatment instructions given by medical personnel at treatment facilities.
4. Adhere to and require family members to adhere to internal regulations and rules of treatment facilities.
5. Pay for examination and treatment costs for drug addiction, except in cases where exemptions or reductions are granted according to this Decree.
Article 25. Responsibilities of Treatment Facilities
1. Only conduct treatment for drug addiction after announcing compliance with treatment conditions for drug addiction.
2. Organize treatment for drug addiction in accordance with professional guidelines established by the Minister of Health.
3. Regularly report monthly lists of patients receiving treatment, treatment progress, and adherence to treatment procedures for drug addiction to competent authorities as prescribed.
Article 26. Responsibilities of the Ministry of Health
1. Develop and promulgate legal documents governing drug addiction treatment activities, development plans, and system planning for treatment facilities within its authority or submit them to competent authorities for issuance.
2. Direct, guide, publicize, and organize the implementation of legal documents guiding drug addiction treatment activities, development plans, and system planning for treatment facilities.
3. Take the lead and coordinate with relevant ministries, sectors, and localities in ensuring the supply of substitute drugs, managing, producing, supplying, and stockpiling substitute drugs as prescribed.
4. Inspect, audit, resolve complaints and reports, and handle violations concerning drug addiction treatment.
5. Develop training programs and curricula, organize continuous training and capacity building for human resources; research and apply science and technology in drug addiction treatment.
6. Implement cooperation with experts, transfer new treatment methods, and other international cooperation activities on drug addiction treatment.
Article 27. Responsibilities of the Ministry of Labor, Invalids, and Social Affairs
1. Lead and coordinate with relevant ministries, sectors, and localities to guide subordinate facilities in implementing drug addiction treatment.
2. Regularly inspect, audit, and report on the implementation of drug addiction treatment at subordinate facilities as prescribed.
Article 28. Responsibilities of the Ministry of Public Securityi1. Organize the implementation of drug addiction treatment in facilities under its jurisdiction.
2. Lead and coordinate with the Ministry of Health and relevant agencies to guide subordinate facilities in implementing drug addiction treatment.
3. Regularly inspect, audit, and report on the implementation of drug addiction treatment at facilities under its jurisdiction as prescribed.
4. Direct public security agencies at all levels to coordinate with health and labor, invalids, and social affairs agencies at the same level to implement drug addiction treatment activities, maintain public security and social order in areas with treatment facilities.
4. Direct the police agencies at all levels to cooperate with health sector agencies and labor, invalids, and social affairs agencies at the same level to implement opiate addiction treatment activities, maintain public security, order, and social safety in areas where treatment facilities are located.
Article 29. Responsibilities of the Ministry of Planning and Investment
Coordinate with the Ministry of Finance and relevant ministries and sectors to develop the state budget estimates and mobilize investment resources for drug addiction treatment programs.
Article 30. Responsibilities of the Ministry of FinanceiAllocate funds to implement the provisions of this Decree according to the current State Budget Law.
Article 31. Responsibilities of the Provincial People's Committee
1. Manage state affairs related to drug addiction treatment within the assigned functions, tasks, and authorities.
2. Based on the number of drug addicts and the local budget, direct the organization of service provision for drug addiction treatment in accordance with the following regulations:
a) A district with 250 or more drug addicts must implement drug addiction treatment.
b) A district with fewer than 250 drug addicts shall decide on implementing drug addiction treatment based on actual conditions and local needs.
3. Prioritize personnel allocation and ensure funding for the construction of physical facilities and operational costs of local treatment centers (excluding structured service fees for drug addiction treatment) as stipulated.
4. Organize inspections and supervision of drug addiction treatment activities under their management authority.
Article 32. Effectiveness of this Decree
Chapter VI
IMPLEMENTING PROVISIONS
This Decree takes effect from July 1, 2016, and replaces Government Decree No. 96/2012/NĐ-CP dated November 15, 2012, concerning drug addiction treatment using substitute drugs.ệTreatment centers that have been licensed to operate before the effective date of this Decree must comply with the requirements for drug addiction treatment using substitute drugs as stipulated in this Decree by December 31, 2017.i ADJUSTMENT
