At the time of ceasing to receive monthly disability allowance
PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to Decision No. 60/HĐBT dated March 1, 1990 of the Council of Ministers (now the Government);
At the proposal of the Minister of Labor, Invalids and Social Affairs,
DECISION:
Article 1. For those individuals receiving monthly disability allowance at the time of ceasing to receive such allowance according to Decision No. 60/HĐBT dated March 1, 1990 of the Council of Ministers (now the Government), who have reached retirement age (men aged 60 or older, women aged 55 or older), they shall be entitled to receive monthly allowances, including those who fall under this category and have ceased to receive monthly disability allowance also shall be entitled to receive from the date this Decision takes effect.
Article 2. The monthly allowance rate applicable to the subjects specified in Article 1 of this Decision is VND 100,000/month, in addition, they are entitled to social health insurance benefits, and upon death, their relatives shall receive funeral expenses according to current regulations.
Article 3. The source of funds for implementing the allowance stipulated in Article 2 of this Decision shall be guaranteed by the State budget.
The Vietnam Social Security shall organize the implementation and manage the funds for paying the allowance according to the guidance of the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Finance.
Article 4. The Chairman of the People's Committee of provinces and centrally governed cities shall consider and decide on granting hardship allowance to those who cease to receive monthly disability allowance and do not fall under the subjects specified in Article 1 of this Decision when reaching retirement age (men aged 60 or older, women aged 55 or older) with specific circumstances as defined by the People's Committee of provinces and centrally governed cities, specifying the level of hardship allowance.
Article 5. This Decision takes effect from July 1, 2000.
The Ministry of Labor, War Invalids and Social Affairs and the Ministry of Finance shall provide guidance on the implementation of this Decision.
Article 6. The Minister of Labor, War Invalids and Social Affairs, the Minister of Finance, the General Director of the Vietnam Social Security, and the Chairman of the People's Committee of provinces and centrally governed cities are responsible for enforcing this Decision.
