Pursuant to Decree No. 38/2001/PL-UBTVQH10 dated August 28, 2001 on Fees and Charges;

Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges; Decree No. 24/2006/NĐ-CP dated March 6, 2006 amending and supplementing certain articles of Decree No. 57/2002/NĐ-CP dated June 3, 2002;

Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

At the proposal of the Director of the Department of Tax Policy,

The Minister of Finance issues this Circular stipulating the fee levels, collection procedures, payment, management, and utilization for the verification of documents and materials to recognize diplomas issued by foreign educational institutions for Vietnamese citizens, as follows:

Article 1. Scope of Regulation

Article 1. This Circular stipulates the fee levels, collection procedures, payment, and management for the verification of documents and materials to recognize diplomas issued by foreign educational institutions for Vietnamese citizens.

Diplomas include: graduation certificates or certificates of completion of general education programs at various levels, certificates of completion of secondary vocational education, certificates of completion of college education, certificates of completion of university education, master's degrees, and doctoral degrees issued by foreign educational institutions for Vietnamese citizens.

Article 2. This Circular does not apply to the verification of documents and materials for certificates or certificates of study results issued by foreign educational institutions for Vietnamese citizens after completing part of a training program or finishing a short-term course or training session.

Article 2. Persons paying fees and collecting agencies

Clause 1. Organizations and individuals who handle the procedures for verifying documents and materials to recognize diplomas issued by foreign educational institutions as specified in Clause 1 of Article 1 of this Circular must pay the fees as prescribed.

Clause 2. The Department of Testing and Quality Assurance in Education (Ministry of Education and Training) and the Departments of Education and Training of provinces and cities shall organize the verification and recognition of educational diplomas of Vietnamese citizens issued by foreign educational institutions and collect fees according to this Circular.

Article 3. Level of Fees

The fee levels for the verification of documents and materials to recognize diplomas are as follows:

Point 1. Verification to recognize diplomas of Vietnamese citizens issued by foreign educational institutions currently operating in Vietnam is 250,000 VND/diploma;

Point 2. Verification to recognize diplomas of Vietnamese citizens issued by foreign educational institutions after completing a training program abroad is 500,000 VND/diploma.

Article 4. Management and use of fees

The verification fee is a revenue item managed and utilized by the state budget as follows:

Clause 1. The collecting agency retains 60% of the collected fee to cover the costs of fee collection and document verification as prescribed. The remaining amount (40%) of the fee collected by the collecting agency shall be remitted to the state budget according to the current State Budget Classification.

Clause 2. Other matters related to the collection, payment, management, utilization, and public disclosure of the fee not detailed in this Circular shall be implemented in accordance with Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws on fees and charges, Circular No. 45/2006/TT-BTC dated May 25, 2006 amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002, Circular No. 28/2011/TT-BTC dated February 28, 2011 of the Ministry of Finance guiding the implementation of certain provisions of the Law on Tax Administration, guiding the implementation of Decree No. 85/2007/NĐ-CP dated May 25, 2007 and Decree No. 106/2010/NĐ-CP dated October 28, 2010 of the Government, Circular No. 153/2012/TT-BTC dated September 17, 2012 of the Ministry of Finance guiding the printing, issuance, management, and use of types of receipts for fees and charges belonging to the state budget, and other amended and supplemented documents (if any).

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

Article 3. This Circular takes effect from September 5, 2013.

2. During the implementation process, if there are any difficulties, it is requested that agencies, organizations, and individuals promptly report them to the Ministry of Finance for research and guidance./.
