AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF THE LAW ON THE FRONT UNION OF VIET NAM, THE LAW ON TRADE UNIONS, THE LAW ON YOUTH, AND THE LAW ON PROMOTING DEMOCRACY AT THE LOCAL LEVEL THE FRONT ORGANIZATION OF VIETNAM, THE TRADE UNION LAW, THE YOUTH LAW, AND THE LAW ON PROMOTING DEMOCRACY AT THE PRIMARY LEVEL/2022/QH15 HAS BEEN AMENDED AND COMPLEMENTED WITH SOME ARTICLES ACCORDING TO LAW NO. 47/2024/QH15

Pursuant to the Constitution of the Socialist Republic of Vietnam amended and supplemented by Resolution No. 203/2025/QH15;

The National Assembly enacts this Law amending and supplementing certain articles of the Law on the Front Union of Vietnam, the Law on Trade Unions, the Law on Youth, and the Law on Promoting Democracy at the Local Level. Law No. 75/2015/QH13 on the Front Union of Vietnam, Law No. 50/2024/QH15 on Trade Unions, Law No. 57/2020/QH14 on Youth, and Law No. /2022/QH15 on Promoting Democracy at the Local Level, which have been amended and supplemented by Law No. 47/2024/QH15. 10has been amended and supplemented with certain articles pursuant to Law No. 47/2024/QH15.

Article 1. Amendments and supplements to certain articles of the Law on the Front Union of Vietnam

1. Amend and supplement Article 1 as follows:

"Article 1. The Front Union of Vietnam

Inheriting the historical role of the National United Front of Vietnam established and led by the Communist Party of Vietnam and President Ho Chi Minh, the Front Union of Vietnam is a political alliance and voluntary association of political organizations, political-social organizations, social organizations, and outstanding individuals from various social classes, ethnic groups, religions, and overseas Vietnamese.

The Front Union of Vietnam is part of the political system of the Socialist Republic of Vietnam; it is the political foundation of people's administration; it gathers and mobilizes the strength of national solidarity; it reflects the will, aspirations, and exercises the right of self-determination of the people; it represents and protects the legitimate rights and interests of the people; it promotes democracy, strengthens social consensus; it monitors and provides social feedback; it reflects the opinions and suggestions of the people to state agencies; it participates in building the Party and State, and people's diplomacy contributing to the construction and defense of the country."

2. Amend and supplement Clause 3 of Article 4 as follows:

"3. Political-social organizations together with other member organizations of the Front shall engage in democratic consultations, coordinate, and unify their actions under the chairmanship of the Front Union of Vietnam, while promoting the initiative and creativity of each member organization.

When coordinating and unifying their actions, member organizations of the Front Union of Vietnam shall act in accordance with the Constitution, laws, the Charter of the Front Union of Vietnam, and the charter of each organization."

3. Amend and supplement Article 5 as follows:

"Article 5. Members of the Front Union of Vietnam

1. Members of the Front Union of Vietnam are organizations and individuals specified in Article 1 of this Law and the Charter of the Front Union of Vietnam.

2. Political-social organizations (including the Vietnam General Confederation of Labor, the Vietnam Farmers' Association, the Ho Chi Minh Communist Youth Union, the Vietnam Women's Union, and the Vietnam Veterans' Association) and mass associations assigned tasks directly under the Front Union of Vietnam by the Party and State shall be organized and operate uniformly within the Front Union of Vietnam.

3. The rights and responsibilities of member organizations of the Front Union of Vietnam are stipulated in this Law, relevant laws, the Charter of the Front Union of Vietnam, and the charter of each organization.

4. The conditions for joining, ceasing membership, and the rights and responsibilities of members of the Front Union of Vietnam are stipulated in the Charter of the Front Union of Vietnam."

4. Amend and supplement Point b of Clause 2 of Article 6 as follows:

"b) At the local level, there are Provincial People's Councils of the Front Union of Vietnam (hereinafter referred to as provincial level) and Commune-level People's Councils of the Front Union of Vietnam (hereinafter referred to as commune level). At each level, there is a Standing Board of the People's Council of the Front Union of Vietnam.

The organization, tasks, and powers of the organs of the Front Union of Vietnam are prescribed in the Charter of the Front Union of Vietnam."

5. Replace the phrase "propose" with the phrase "unify with" in Clause 1 of Article 25 and Clause 1 of Article 32; replace the phrase "According to the proposal of" with the phrase "After unifying with" in Clause 3 of Article 26 and Clause 3 of Article 33.

6. Add the phrase "provincial level" after the phrase "People's Council" in Clause 2 of Article 20; add the word "in accordance with" before the phrase "legal regulations" in Clause 3 of Article 26 and Clause 3 of Article 33.

7. Delete the phrase "at district level," in Clause 2 of Article 16; delete the phrase "from district level upwards" in Clause 2 of Article 18; delete the phrase ", at district level" in Clause 2 of Article 20.

Article 2. Amending and supplementing some articles of the Trade Union Law

1. Amend and supplement Article 1 as follows:

" Article 1. The Vietnam General Confederation of Labor

The Vietnam General Confederation of Labor is a broad political-social organization of the working class and workers, established on a voluntary basis, is a member of the political system led by the Communist Party of Vietnam, subordinate to the Vietnam Fatherland Front; it represents, cares for, and protects the legitimate rights and interests of trade union members and workers; it is the sole representative of workers at the national level in labor relations and international relations concerning trade unions; participates in state management, economic and social management; participates in inspection, audit, and supervision of activities of state agencies, organizations, units, enterprises regarding issues related to the rights and obligations of workers; propagandizes and mobilizes workers to study, improve their qualifications and vocational skills, comply with laws, build and defend the Fatherland."

2. Amending and supplementing Clause 2 and Clause 3 of Article 4 as follows:

"2. Basic-level trade union is the basic-level organization of the Vietnam General Confederation of Labor, uniting trade union members within one or several organizations, units, enterprises, recognized by the higher-level trade union according to the provisions of the law and the Charter of the Vietnam General Confederation of Labor.

3. Basic-level industry association is the basic-level organization of the Vietnam General Confederation of Labor, uniting those who work without labor relations, in the same industry or profession, or other special types of workers, recognized by the higher-level trade union according to the provisions of the law and the Charter of the Vietnam General Confederation of Labor."

"The entity organizing the examination, issuance, and revocation of specialized bidding business certificates is a public service institution with training and enhancement functions under the management of ministries, ministerial-level agencies, provincial people's committees, or centrally governed municipalities."

"Article 8. The organizational system of the Vietnam General Confederation of Labor

1. The Vietnam General Confederation of Labor is a unified organization comprising the following levels:

a) Central level is the Vietnam General Confederation of Labor;

b) Higher-level basic organizations include provincial labor federations (hereinafter referred to as provincial labor federations); central industry trade unions; trade unions of economic groups, general companies directly under the Vietnam General Confederation of Labor, and other higher-level basic organizations permitted to be established by competent authorities in accordance with the organization of the trade union;

c) Basic-level organizations include basic-level trade unions and basic-level industry associations."

4. Amending and supplementing Clause 2 and Clause 3 of Article 14 as follows:

"2. The Chairman of the provincial labor federation shall be invited to attend sessions, meetings, conferences of the People's Council, Standing Committee of the People's Council, People's Committee at the same level, and relevant agencies and organizations when discussing issues related to the rights and obligations of trade union members, workers, trade union organizations, and socio-economic development in the locality.

3. The Chairmen of central industry trade unions, economic group trade unions, general company trade unions, and other higher-level basic organizations shall be invited to attend meetings and conferences of specialized agencies, relevant agencies, and organizations when discussing issues related to the rights and obligations of trade union members, workers, and trade union organizations."

5. Amending and supplementing Clause 2 of Article 19 as follows:

"2. Higher-level basic organizations have the right and responsibility to send trade union cadres to enterprises, cooperatives, cooperative federations, organizations, and units to propagate, mobilize, and guide workers to join and establish basic-level trade unions."

6. Supplementing Clause 7 after Clause 6 of Article 31 as follows:

"7. Annually, the Vietnam General Confederation of Labor reports to the Standing Committee of the Central Committee of the Vietnam Fatherland Front the budget estimate and final financial accounts of the Vietnam General Confederation of Labor as stipulated in Points a, b, and d of Clause 1 of Article 29 and Clause 2 of Article 31 of this Law."

7. Amending and supplementing Point a of Clause 2 of Article 32 as follows:

"a) The management, utilization, and exploitation of trade union assets at the Vietnam General Confederation of Labor, higher-level basic organizations, and non-profit units of the trade union shall be carried out in accordance with the provisions of the law on the management and use of public property and other relevant laws;"

8. Replacing the phrase "agencies, organizations, units, enterprises, cooperatives, cooperative federations" with the phrase "enterprises, non-profit units not receiving 100% salary from the State budget, cooperatives, cooperative federations, and other agencies, organizations, and units employing workers as prescribed by law" in Point b of Clause 1 of Article 29; supplementing the phrase "in accordance with the provisions of the State budget law" after the phrase "State budget support" in Point c of Clause 1 of Article 29; supplementing the phrase "; non-profit units not receiving 100% salary from the State budget as stipulated in Point b of Clause 1 of this Article" after the phrase "in cases of non-payment or delayed payment of trade union fees" in Clause 2 of Article 29.

9. Abolishing Clause 4 of Article 4 and Clause 3 of Article 19.

Article 3. Amending and supplementing some articles of the Youth Law

1. Amending and supplementing Clause 3 of Article 17 as follows:

"3. Creating conditions for young people to borrow from preferential sources to create employment opportunities and develop production and business."

2. Amending and supplementing Clause 1 of Article 28 as follows:

"1. The Communist Youth Union of Ho Chi Minh is a political-social organization of Vietnamese youth, under the Vietnam Fatherland Front, playing a core role in youth movements and organizations; organizing guidance on activities of children and teenagers, and overseeing the Ho Chi Minh Pioneer Team."

Article 4. Amending and supplementing some articles of the Law on Promoting Democracy at the Grassroots Level

1. Amending and supplementing Article 62 as follows:

"Article 62. Activities of the People's Inspection Board

1. Based on the resolution of the staff, civil servant, and employee meeting of the agency or unit, the People's Inspection Board builds a work program for each quarter, six months, and annually, and organizes its implementation.

2. The People's Inspection Board has the responsibility to report on its activities at the staff, civil servant, and employee meeting of the agency or unit."

2. Amending and supplementing Point a of Clause 2 of Article 83 as follows:

"a) Assisting the Government in managing state administration over the promotion of democracy at communes, towns, special zones, state agencies, public service units, and labor-using organizations;"

3. Replacing the phrase "town" with the phrase "special zone" in Clause 1 of Article 2, Clause 1 of Article 4, the name of Chapter II, the name of Section 1, and the name of Subsection 2 of Section 4 of Chapter II, Clauses 3, 4, and 14 of Article 11, Point k of Clause 1 of Article 12, Clauses 7 and 9 of Article 25, Clause 2 of Article 26, the name of Article 29, Clause 2 of Article 31, Clause 3 of Article 34, Point c of Clause 2 of Article 35, the name of Article 36, Clause 1 and Clause 3 of Article 36, the name of Article 37, the name of Article 38, the name of Article and Clause 1 of Article 39, the name of Article and Clause 3 of Article 40, Clause 1 of Article 41, Point c of Clause 2 of Article 86.

4. Replacing the phrase "Coordinating with the Trade Union Executive Committee of the agency or unit based on" with the phrase "Based on" in Point a of Clause 1 of Article 59; replacing the phrase "Trade Union and other mass organizations" with the phrase "other mass organizations" in Clause 5 of Article 54 and Point c of Clause 1 of Article 59.

5. Removing the phrase "at commune level," in Clause 3 of Article 8, Clause 4 and Clause 10 of Article 11, Clause 3 of Article 24, Clause 2 of Article 30, Point b and Point c of Clause 1 of Article 31, Clause 2 of Article 37, and Clause 1 of Article 38.

6. Removing the phrase "district level" in Clause 2 of Article 25; removing the phrase "and District People's Committee" in the name of Article 85.

7. Removing the phrase ", Trade Union Executive Committee of the agency or unit" in Point e of Clause 1 of Article 47; removing the phrase "Trade Union Executive Committee of the agency or unit," in Clause 1 of Article 50; removing the phrase "after reaching consensus with the Trade Union Executive Committee of the agency or unit" in Clause 2 of Article 50; removing the phrases ", coordinating with the Trade Union of the agency or unit" and "after soliciting opinions from the Trade Union of the agency or unit" in Clause 1 of Article 51; removing the phrase "reaching consensus with the Trade Union of the agency or unit" in Point b of Clause 2 of Article 51; removing the phrase ", representative of the Trade Union Executive Committee of subordinate agencies and units" in Point d of Clause 2 of Article 51; removing the phrase ", Chairman of the Trade Union of the agency or unit" in Point d of Clause 4 of Article 51; removing the phrase "coordinating with the Trade Union Executive Committee of the agency or unit to unify policies" in Clause 1 of Article 52; removing the phrase "coordinating with the Trade Union Executive Committee of the agency or unit" in Clause 2 of Article 52; removing the phrase "coordinating with the Trade Union Executive Committee of the agency or unit" in Clause 3 of Article 52; removing the phrase "Trade Union Executive Committee of the higher level," in Clause 4 of Article 52; removing the phrase "based on the proposal of the Trade Union Executive Committee of the agency or unit" in Clause 1 of Article 60; removing the phrase "Trade Union Executive Committee of the agency or unit proposing" in Clause 3 of Article 60.

8. Abolishing Point b and Point h of Clause 4 of Article 51, Clause 2 of Article 55, Clause 2 of Article 63, Clause 3 and Clause 4 of Article 83, Clause 3 and Clause 4 of Article 86.

Article 5. Implementation Provisions

1. This Law shall take effect from July 1, 2025.

2. Trade Unions and Trade Union Executive Committees of non-state-funded public service units shall continue to implement the provisions of Chapter III of the Law on Promoting Democracy at the Grassroots Level No. 10/2022/QH15.
