Pursuant to Decision No. 257/2006/QĐ-TTg dated November 9, 2006 of the Prime Minister promulgating regulations on frequency band allocation for economic and social purposes, national defense, and security;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Clause 3, Article 4 of Decree No. 35/2012/NĐ-CP dated April 18, 2012 of the Government on adjusting pensions, social insurance benefits, and monthly allowances for village cadres who have retired (Decree No. 35/2012/NĐ-CP);
Pursuant to Decision No. 142/2008/QĐ-TTg dated October 27, 2008 of the Prime Minister on implementing policies for military personnel participating in the resistance war against the United States to save the country with less than 20 years of service in the military who have been demobilized and returned to their localities (Decision No. 142/2008/QĐ-TTg);

Pursuant to Decision No. 62/2011/QĐ-TTg dated November 9, 2011 of the Prime Minister on policies and measures for individuals who participated in wars to protect the Fatherland and international missions in Cambodia and assisting Laos after April 30, 1975 who have been demobilized, discharged, or retired (Decision No. 62/2011/QĐ-TTg);
The Minister of National Defense and the Minister of Finance issue this Joint Circular guiding the adjustment of monthly allowances for military personnel and individuals engaged in confidential work who receive salaries equivalent to those of military personnel and public security officers currently receiving monthly allowances,
Article 1. Scope of Regulation and Applicability
This Circular guides the adjustment of monthly allowance levels for the following subjects:
1. Military personnel currently receiving monthly allowances as stipulated in Decision No. 142/2008/QĐ-TTg and Decision No. 38/2010/QĐ-TTg.
2. Military personnel and individuals engaged in confidential work who receive salaries equivalent to those of military personnel and public security officers currently receiving monthly allowances as stipulated in Decision No. 62/2011/QĐ-TTg.
Article 2. Time and Level of Adjustment
1. From May 1, 2012, increase the monthly allowance by 26.5% for the subjects guided in Article 1 of this Circular.

2. The adjustment amount for the subjects specified in Article 1 of this Circular from May 1, 2012 is as follows:
- For those with 15 to under 16 years of service, the monthly allowance is VND 1,170,000;
- For those with 16 to under 17 years of service, the monthly allowance is VND 1,229,000;
- For those with 17 to under 18 years of service, the monthly allowance is VND 1,287,000;
- For those with 18 to under 19 years of service, the monthly allowance is VND 1,346,000;
- For those with 19 to under 20 years of service, the monthly allowance is VND 1,404,000.
1. The funding for the implementation of the policy on exemption and subsidy of tuition fees shall be guaranteed by the state budget in accordance with the provisions of the law on the decentralization of budget management.
The funds for paying monthly allowances to the subjects guided in Article 1 of this Circular shall be guaranteed by the State budget. The Ministry of Finance shall ensure the allocation according to the proposal of the Ministry of Labor, Invalids and Social Affairs to authorize the People's Committee of provinces and cities to pay.
Article 4. Effective date
1. This Circular takes effect from October 15, 2012.
2. Abolish the monthly allowance levels for the subjects guided in the following Circulars:
a) Joint Circular No. 82/2011/TTLT-BQP-BLĐTBXH-BTC dated June 9, 2011 of the Ministry of National Defense, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance amending and supplementing Circular No. 110/2010/TTLT-BQP-BLĐTBXH-BTC dated September 8, 2010 of the Ministry of National Defense, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance guiding the implementation of Decision No. 142/2008/QĐ-TTg and Decision No. 38/2010/QĐ-TTg.
b) Joint Circular No. 01/2012/TTLT-BQP-BLĐTBXH-BTC dated January 5, 2012 of the Ministry of National Defense, the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance guiding the implementation of Decision No. 62/2011/QĐ-TTg.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. The Ministry of National Defense shall take the lead and coordinate with the Ministry of Finance to direct, guide, and inspect agencies, units, and localities in implementing this Circular.
2. For subjects who had decisions on receiving monthly allowances before the effective date of Decree No. 35/2012/NĐ-CP, the competent labor and social affairs authorities shall be responsible for adjusting the allowance level according to the guidance in this Circular.
For subjects currently being considered for allowance, the Ministry of National Defense shall be responsible for adjusting the allowance level according to the guidance in this Circular.
3. During implementation, if there are any difficulties, agencies, units, and localities shall report to the Ministry of National Defense for coordination with the Ministry of Finance to examine and resolve them./.
