Circular No. 01/2024/TT-BNNPTNT promulgates the Harmonized System (HS) code list for goods under the management authority of the Ministry of Agriculture and Rural Development and the list of goods subject to specialized inspection before and after clearance in the agricultural and rural development sector.

Issuing the Harmonized System code list for goods under the management authority of the Ministry of Agriculture and Rural Development and the list of goods subject to specialized inspection upon import and export in the agricultural and rural development sector

Pursuant to Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 69/2018/NĐ-CP dated May 15, 2018 of the Government detailing some provisions of the Law on Foreign Trade Management;

Pursuant to Decree No. 85/2019/NĐ-CP dated November 14, 2019 of the Government stipulating the implementation of administrative procedures under the national single window mechanism, ASEAN single window mechanism, and specialized inspection of goods for export and import;

At the proposal of the Director of the Legal Department and the Directors of the Forests, Fisheries, Plant Protection, Animal Health, Livestock Production, Crop Production, Cooperative Economy and Rural Development, Quality, Processing and Market Development Departments;

The Minister of Agriculture and Rural Development issues this Circular on issuing the Harmonized System code list for goods under the management authority of the Ministry of Agriculture and Rural Development and the list of goods subject to specialized inspection upon import and export in the agricultural and rural development sector.

Article 1. Issued with this Circular is the Harmonized System code list for goods under the management authority of the Ministry of Agriculture and Rural Development and the list of goods subject to specialized inspection upon import and export in the agricultural and rural development sector.

1. Appendix I. Harmonized System code list for goods under the management authority of the Ministry of Agriculture and Rural Development, specifically:

Section 1. Harmonized System code list for terrestrial animals and animal products subject to quarantine inspection.

Section 2. Harmonized System code list for other terrestrial animals in livestock farming.

Section 3. Harmonized System code list for prohibited export pet animal breeds.

Section 4. Harmonized System code list for endangered pet animal breeds.

Section 5. Harmonized System code list for aquatic animals and animal products subject to quarantine inspection.

Section 6. Harmonized System code list for aquatic species permitted for trade in Vietnam.

Section 7. Harmonized System code list for conditionally exported aquatic species.

Section 8. Harmonized System code list for prohibited export aquatic species.

Section 9. Harmonized System code list for plant quarantine objects in Vietnam.

Section 10. Harmonized System code list for imported plant-based food.

Section 11. Harmonized System code list for crop seeds.

Section 12. Harmonized System code list for prohibited export crop germplasm.

Section 13. Harmonized System code list for salt (including table salt and salt that has been altered).

Section 14. Harmonized System code list for commercial feed products published on the Ministry of Agriculture and Rural Development's electronic portal.

Section 15. Harmonized System code list for prohibited chemical substances, biological products, and microorganisms in livestock feed.

Section 16. Harmonized System code list for permitted chemical substances, biological preparations, microorganisms, and raw materials for feed production in aquaculture in Vietnam and finished aquafeed and environmental treatment products for aquaculture.

Section 17. Table of HS codes for the list of chemicals, biological preparations, microorganisms prohibited from use in aquafeed, and products for treating aquaculture environments.

Section 18. Table of HS codes for the list of veterinary drugs and raw materials for veterinary drugs permitted to be imported and circulated in Vietnam.

Section 19. Table of HS codes for the list of fertilizers.

Section 20. Table of HS codes for the list of goods prohibited from export, which include round logs and sawn timber of all kinds from natural forests within the country.

Section 21. Table of HS codes for the list of wood and wood products when exported must have a legal forestry document.

Section 22. Table of HS codes for the list of forestry plant seeds.

Section 23. Table of HS codes for the list of plant protection products.

Section 24. Table of HS codes for the list of plant protection products prohibited from use in Vietnam.

Section 25. Table of HS codes for the list of items related to fisheries exploitation.

Section 27. Table of HS codes for the list of agricultural machinery and equipment.

2. Appendix II. Table of HS codes for the list of goods subject to specialized inspection before clearance under the authority of the Ministry of Agriculture and Rural Development.

3. Appendix III. Table of HS codes for the list of goods subject to specialized inspection after clearance under the authority of the Ministry of Agriculture and Rural Development.

Article 2. Provisions on the use of the list.

1. The list of goods under the authority of the Ministry of Agriculture and Rural Development, which has been determined and issued together with this Circular, serves as the basis for organizations and individuals to declare customs when exporting and importing into Vietnam.

2. When exporting or importing goods in the field of agriculture but without a code in the list issued together with this Circular, the customs declaration shall be made based on the actual description of the goods and the List of Export and Import Goods of Vietnam issued together with Circular No. 31/2022/TT-BTC dated June 8, 2022, by the Minister of Finance. After clearance, organizations and individuals shall submit a document to the Ministry of Agriculture and Rural Development to coordinate with the Ministry of Finance to examine and update the supplementary list.

3. Specialized inspections for goods exported under the authority of the Ministry of Agriculture and Rural Development shall be carried out at the request of enterprises to facilitate the clearance of goods at the importing country.

Article 3. Effectiveness

1. This Circular takes effect from March 20, 2024.

2. This Circular replaces and abolishes the following Circulars and regulations:

a) Replaces Circular No. 11/2021/TT-BNNPTNT dated September 20, 2021, issued by the Minister of Agriculture and Rural Development, concerning the table of HS codes for the list of goods under the authority of the Ministry of Agriculture and Rural Development and the list of goods for export and import that require specialized inspection in the field of agriculture and rural development;

b) Replaces Section 3.1, Section 4, Section 8, and Section 9 of the Appendix issued together with Circular No. 16/2021/TT-BNNPTNT dated December 20, 2021, issued by the Minister of Agriculture and Rural Development, concerning the list of products and goods potentially causing safety risks under the responsibility of the Ministry of Agriculture and Rural Development, with corresponding sections in Appendix IV issued together with this Circular;

c) Abolishes Article 9 of Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022, issued by the Minister of Agriculture and Rural Development, amending and supplementing some Circulars in the field of fisheries;

d) Abolishes Appendix XXIII issued together with Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022, issued by the Minister of Agriculture and Rural Development, amending and supplementing some Circulars in the field of fisheries.

Article 4. Responsibilities for Implementation

1. The Director of the Ministry's Office, the Head of the Legal Department, the Heads of units under the Ministry of Agriculture and Rural Development, and relevant agencies, organizations, and individuals are responsible for implementing this Circular.

2. During the implementation of this Circular, if there are any difficulties, they should promptly report to the Ministry of Agriculture and Rural Development for research, amendment, and supplementation as appropriate./.
