CIRCULAR

REGULATING THE AUTHORITY TO RECRUIT TEACHERS

Pursuant to the Teachers Law No. 73/2025/QH15;

Pursuant to Resolution No. 248/2025/QH15 of the National Assembly on certain special mechanisms and policies for breakthrough development in education and training;

Pursuant to Decree No. 37/2025/NĐ-CP dated February 26, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

On the proposal of the Director of the Teacher and Educational Management Staff Department;

The Minister of Education and Training issues this Circular regulating the authority to recruit teachers.

Article 1. Scope of Regulation

This Circular regulates the authority to recruit teachers in public educational institutions within the national education system (hereinafter referred to as public educational institutions).

Article 2. Applicability

1. This Circular applies to public educational institutions, Departments of Education and Training, other organizations and individuals related thereto.

2. This Circular does not apply to educational institutions specified in points a, b, and c, Clause 2, Article 14 of the Teachers Law No. 73/2025/QH15.

Article 3. Authority to Recruit Teachers in Early Childhood Education Institutions, Primary and Secondary Schools, Continuing Education Institutions, Specialized Schools (excluding Preparatory Universities), and Public Vocational High Schools

The authority to recruit teachers in early childhood education institutions, primary and secondary schools, continuing education institutions, specialized schools (excluding preparatory universities), and public vocational high schools shall be implemented according to point a, Clause 1, Article 2 of Resolution No. 248/2025/QH15 of the National Assembly on certain special mechanisms and policies for breakthrough development in education and training.

Article 4. Authority to Recruit Teachers in Other Educational Institutions within the National Education System

1. The Principal of the Preparatory University, School T78, School 80, and Northern Highlands General School has the authority to recruit teachers under their management.

2. The heads of schools under state agencies, political organizations; provincial-level political schools; and political centers at communes, wards, and special administrative regions directly under provinces and centrally-administered cities have the authority to recruit teachers under their management.

3. The Director of the Department of Education and Training has the authority to recruit teachers in other educational institutions (excluding those specified in Article 3 of this Circular) under the management of provinces and centrally-administered cities.

Article 5. Effectiveness and Responsibility for Implementation

1. This Circular takes effect from the date of issuance.

2. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new documents.

3. In cases where the competent authority has approved plans and programs for organizing teacher recruitment before January 1, 2026, such plans and programs shall continue to be implemented until December 31, 2026. After this period, if not completed, the authority to recruit teachers shall be implemented according to this Circular.

4. The Heads of the Office, Directors of the Teacher and Educational Management Staff Department, Heads of relevant units under the Ministry of Education and Training, Directors of Departments of Education and Training, heads of public educational institutions, Heads of organizations, units, and individuals related thereto are responsible for implementing this Circular.
