Issuing Technical Regulations and Economic-Tech Standards on the Work of Collecting, Storing, Preserving, and Providing Information and Data on Natural Resources and Environment

Pursuant to the Law on Minerals dated November 17, 2010;

Pursuant to the Law on Water Resources dated June 21, 2012;

Pursuant to the Law on Land dated November 29, 2013;

Pursuant to the Law on Meteorology and Hydrology dated November 23, 2015;

Pursuant to the Law on Marine and Island Resources and Environment dated June 25, 2015;

Pursuant to the Law on Surveying and Mapping dated June 14, 2018;

Pursuant to the Law on Environmental Protection dated November 17, 2020;

Pursuant to the Law on Information Technology dated June 29, 2006;

Pursuant to the Law on Archives dated November 11, 2011;

Pursuant to the Law on Access to Information dated April 6, 2016;

Pursuant to the Government Decree No. 01/2013/NĐ-CP dated January 3, 2013 detailing certain provisions of the Law on Archives;

On the basis of Decision No. 36/2017/NĐ-CP dated April 4, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

Pursuant to Decree No. 73/2017/NĐ-CP dated June 14, 2017 of the Government on the collection, management, exploration, and utilization of information and data on natural resources and the environment;

WHEREAS, Decree No. 03/2019/ND-CP dated January 4, 2019 of the Government on remote sensing activities;

Pursuant to Decree No. 30/2020/NĐ-CP dated March 5, 2020 of the Government on archival work;

At the proposal of the Director of the Department of Information Technology and Natural Resources Data, the Head of the Science and Technology Department, the Head of the Planning and Finance Department, and the Head of the Legal Department;

The Minister of Natural Resources and Environment issues this Circular on Technical Regulations and Economic-Tech Standards on the Work of Collecting, Storing, Preserving, and Providing Information and Data on Natural Resources and Environment.

Article 1. Attached herewith are the Technical Regulations and Economic-Tech Standards on the Work of Collecting, Storing, Preserving, and Providing Information and Data on Natural Resources and Environment.

Article 2.

1. This Circular shall take effect from April 15, 2022.

2. This Circular replaces the following Circulars:

a) Circular No. 27/2009/TT-BTNMT dated December 14, 2009 of the Minister of Natural Resources and Environment on Economic-Tech Standards for Managing and Providing Survey and Mapping Data;

b) Circular No. 31/2013/TT-BTNMT dated October 23, 2013 of the Minister of Natural Resources and Environment on Procedures for Archiving Land Documents;

c) Circular No. 33/2013/TT-BTNMT dated October 25, 2013 of the Minister of Natural Resources and Environment on Economic-Tech Standards for Archiving Land Documents;

d) Circular No. 34/2013/TT-BTNMT dated October 30, 2013 of the Minister of Natural Resources and Environment on Submission, Collection, Archiving, Preservation, and Provision of Environmental Data;

đ) Circular No. 46/2016/TT-BTNMT dated December 27, 2016 of the Minister of Natural Resources and Environment on Retention Periods for Specialized Natural Resources and Environmental Records;

e) Circular No. 32/2017/TT-BTNMT dated September 29, 2017 of the Minister of Natural Resources and Environment on Techniques for Collecting, Preserving, Archiving, and Exploiting Meteorological and Hydrological Data;

g) Circular No. 29/2018/TT-BTNMT dated December 26, 2018 of the Minister of Natural Resources and Environment on Economic-Tech Standards for Meteorological and Hydrological Information and Data Work;

h) Circular No. 32/2018/TT-BTNMT dated December 26, 2018 of the Minister of Natural Resources and Environment on Collection of Natural Resources and Environmental Information and Data for Archiving, Preservation, Publication, Provision, and Utilization.

3. This Circular abolishes certain provisions of the following Circulars:

a) Abolish Clause 3.2 (Storage Warehouse Preservation) and Clause 3.9 (Computerization of Reports) Section 3 Chapter I Part IX Circular No. 11/2010/TT-BTNMT July 5, 2010 of the Minister of Natural Resources and Environment on Economic-Tech Standards for Geological Works;

b) Abolish Section I and Section II of the Technical Procedure Regulation on Environmental Materials; Section A and Section B of the Economic-Tech Standards on Environmental Materials Circular No. 42/2011/TT-BTNMT dated December 12, 2011 of the Minister of Natural Resources and Environment on Technical Procedures and Economic-Tech Standards for Environmental Materials;

c) Abolish Chapter III Circular No. 12/2013/TT-BTNMT dated June 5, 2013 of the Minister of Natural Resources and Environment on Submission, Collection, Holding, Preservation, and Provision of Data on Geology and Mineral Resources;

d) Abolish Chapter IX and Chapter X Circular No. 47/2015/TT-BTNMT dated November 5, 2015 of the Minister of Natural Resources and Environment on Procedures and Economic-Tech Standards for Twelve Categories of Work in Basic Geological Surveys and Mineral Exploration.

Article 3. Transitional Provisions

Professional tasks and projects on collecting, storing, preserving, and providing information and data on natural resources and environment approved and implemented before the effective date of this Circular shall continue to be carried out according to the approved bases, except where there is a requirement to implement according to the provisions of this Circular.

Article 4. Ministries, ministerial-level agencies, government agencies, provincial people's committees under the central government, units under the Ministry of Natural Resources and Environment, and related organizations and individuals are responsible for implementing this Circular.

In the process of implementing this Circular, if there are difficulties or obstacles, please report them to the Ministry of Natural Resources and Environment for consideration and decision./.
