PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
Article 1. This Circular guides the management and model certificate of the capacity building program; organizing capacity building for civil servants and officials abroad using state budget funds; standards for lecturers at training and capacity building institutions for civil servants and officials; evaluating the quality of capacity building for civil servants and officials.
Article 2. The contents guiding management, model certificates of the capacity building program, and evaluation of the quality of capacity building for civil servants and officials set forth in this Circular apply to the following capacity building courses (including direct classroom teaching or distance learning):
a) Capacity building courses on knowledge and skills in state administration according to the standard of civil servant grades.
b) Capacity building courses according to the standard of professional titles for specialized officials.
c) Capacity building courses according to the requirements of leadership and management positions.
d) Capacity building courses according to the requirements of professional and vocational positions.
đ) Capacity building courses according to the standard of positions and titles of cadres and civil servants at commune level.
Article 2. Applicability
Article 1. The following agencies and organizations:
a) Agencies and units managing and using cadres, civil servants, and officials...
b) National Academy of Public Administration.
c) Political Theory Schools of provinces and centrally governed cities, training and capacity building institutions for civil servants and officials of ministries, ministerial-level agencies, government agencies, Vietnam Fatherland Front, central-level political and social organizations (hereinafter referred to as training and capacity building institutions).
d) Academies, research institutes, universities, colleges, secondary vocational schools (hereinafter referred to as training and research institutions).
Article 2. The following individuals:
a) Cadres in state agencies.
b) Civil servants in agencies of the Communist Party of Vietnam, State, Vietnam Fatherland Front, central-level, provincial-level, district-level, and commune-level civil servants (hereinafter referred to as commune-level civil servants).
c) Officials in public service units.
Article 3. Explanation of Terms
In this Circular, the following terms shall be understood as follows:
Article 1. Quality of capacity building: Satisfaction of related parties and achievement of capacity building objectives for cadres, civil servants, and officials.
Article 2. Criteria: A component forming part of the assessment content, specifically detailing the assessment content.
Article 3. Index: Numerical values used to measure criteria.
Article 4. Former trainees: Trainees who have completed the capacity building course and returned to work at their agencies or units.
Article 5. Independent assessment agency: An organization that has been licensed to operate under the law for educational quality assurance and vocational education quality assurance.
Article 4. Purpose and Content of Quality Training Evaluation for Civil Servants and Public Officials
1. Provide the Ministry of Home Affairs; agencies and units managing and using civil servants and public officials; National Academy of Public Administration; training and development institutions; educational and research institutions with objective information on the quality of training for civil servants and public officials.
2. Based on the results of the quality evaluation, the Ministry of Home Affairs; agencies and units managing and using civil servants and public officials; National Academy of Public Administration; training and development institutions; educational and research institutions propose and implement solutions to innovate and improve the quality of training for civil servants and public officials.
3. Content of evaluation:
a) Programs and materials.
b) Trainees.
c) Lecturers.
d) Physical facilities and supporting activities.
d) Training courses.
e) Post-training effectiveness.
Chapter II
TRAINING PROGRAM CERTIFICATE
FOR CIVIL SERVANTS AND PUBLIC OFFICIALS
Article 5. Printing, Issuing, Reissuing and Managing Certificates and Certificates of Completion
1. The National Academy of Public Administration; training and development institutions; educational and research institutions have the right to print and issue certificates for training programs assigned by authorized authorities. The certificate format is specified in Appendix I attached to this Circular.
2. The training program certificate is issued once to trainees who complete the course on the final day of the course.
3. The National Academy of Public Administration, training and development institutions, educational and research institutions are responsible for:
a) Issuing a certificate of course completion for cases where the certificate is lost or damaged. The certificate of course completion has the same validity as the training program certificate. The format of the certificate of course completion is specified in Appendix II attached to this Circular.
b) Reissuing the training program certificate for cases where there are errors in the certificate already issued due to the fault of the National Academy of Public Administration, training and development institutions, educational and research institutions.
c) Reissuing the certificate of course completion for cases where the certificate of course completion is lost or damaged.
4. Within the shortest period of five working days from the date of receiving the application (accompanied by the erroneous or damaged certificate), the National Academy of Public Administration, training and development institutions, educational and research institutions shall be responsible for reviewing and deciding to issue or reissue the certificate of course completion, training program certificate to the trainee.
5. The National Academy of Public Administration, training and development institutions, educational and research institutions shall establish a record of management for issuing training program certificates and certificates of course completion in accordance with the law. Ensure transparency and openness.
Article 6. Conditions for Issuing a Training Program Certificate
A training program certificate will be issued to trainees meeting the following conditions:
1. Participating fully in training according to the provisions of the training program.
2. Completing all required tests, term papers, essays, and projects as stipulated in the training program; each test, term paper, essay, and project must achieve at least 50% of the points according to the grading scale specified in the program.
3. Adhering strictly to all laws regarding the training of civil servants and public officials; rules and regulations of the National Academy of Public Administration; training and development institutions; educational and research institutions.
Article 7. Language on certificates and certification papers
The language on certificates and certification papers shall be Vietnamese. For certificates and certification papers that also include a foreign language, the foreign language must be accurately recorded and consistent with the content in Vietnamese; the size of the foreign language font shall not exceed the size of the Vietnamese font.
Article 8. Revocation and cancellation of training program certificates and completion course certification papers
1. Training program certificates and completion course certification papers shall be revoked in the following cases:
a) There is fraud in the enrollment or study process for the certificate or certification paper holder.
b) Issued to individuals who do not meet the requirements; issued without proper authority.
c) The certificate has been erased or altered.
d) Allowed others to use it.
d) Due to errors from the National Academy of Public Administration, training institutions, or research institutions.
2. The National Academy of Public Administration, training institutions, research institutions have the authority to revoke and cancel certificates and certification papers issued by their units. In cases where these units have merged, split, separated, or dissolved, the competent authorities directly above these units have the authority to revoke and cancel certificates and certification papers.
3. The head of the agency mentioned in Clause 2 of this Article shall issue a decision to revoke and cancel certificates and certification papers. The content of the decision must clearly state the reasons for revocation and cancellation. The decision shall be published on the official website of the authority responsible for revoking and cancelling certificates and certification papers; sent to the individual whose certificate or certification paper is being revoked; the inspection agency that discovered the violation (if applicable); the agency where the individual whose certificate or certification paper is being revoked is currently working (if applicable); and other relevant agencies and organizations.
Chapter III
TRAINING ABROAD
FUNDED BY THE STATE BUDGET
Article 9. Tasks of agencies and units assigned to organize overseas training programs for officials, civil servants, and employees
1. Develop and approve plans for overseas training of officials, civil servants, and employees.
2. Develop detailed content and programs for the training courses after the plan has been approved.
3. Sign contracts with foreign organizations with training and development functions. The contract must specify the commitments of both parties regarding the format, duration, content, program, funding, living conditions, study conditions, and other related matters.
4. Issue a decision to establish an outbound training delegation, appointing one member as the team leader and another as the secretary. The authority to decide on sending officials, civil servants, and employees abroad for training shall be carried out according to regulations on departure and entry for Vietnamese citizens.
5. Inform each member of the delegation before going for training:
a) Regulations on managing the delegation and officials, civil servants, and employees studying and researching abroad; an overview of the laws, culture, and religion of the host country.
b) Content, duration, program of the training course, and related benefits.
Article 10. Responsibilities and tasks of the team leader and officials, civil servants, and employees sent for overseas training
1. Responsibilities and tasks of the team leader:
a) Responsible for and accountable for all activities of the delegation during the period of studying abroad.
b) Represent the delegation in transactions with foreign training and development institutions, Vietnamese diplomatic agencies abroad (if necessary).
c) Monitor and ensure that the study and research program of the delegation is implemented in accordance with the signed contract.
d) Manage members of the delegation.
đ) Sign and send reports on the implementation of the plan and the results of the study of the delegation to the competent authority after the training course ends.
2. Responsibilities and tasks of officials, civil servants, and employees sent for overseas training:
a) Strictly comply with all regulations on managing the delegation and officials, civil servants, and employees studying and researching abroad; follow the instructions of the team leader.
b) Comply with the law, respect local customs, traditions, and cultural norms of the country of study, and abide by the rules of the training institution and accommodation facilities.
c) Report on the results of study as stipulated in Articles 11 and 12 of this Circular.
Article 11. Report on Study Results
1. The report on study results of the delegation includes the following main contents:
a) Composition of the delegation.
b) Overview of the situation in the country where they studied.
c) Content, duration, and program of the training course.
d) Organization work of the training course, compliance with regulations by trainees and the delegation.
d) Implementation results and comments and evaluations on the content, program, methods, duration, and organization work of the training course.
e) Contents absorbed and experiences drawn from the training course.
g) Proposals for recommendations and solutions to improve the quality of overseas training courses.
2. The report on study results of the trainee includes the following main contents:
a) Name, year of birth.
b) Position, title, working agency/unit, contact phone number; email address.
c) Implementation results and comments and evaluations on the content, program, methods, duration, and organization work of the training course.
d) Knowledge and experience acquired and proposals for application in professional work and management at the current working agency/unit.
đ) Opinions on cadre training work outside the country.
Article 12. Reporting System
1. Within the latest 15 days from the date the delegation returns to the country, the delegation's report must be submitted to the following agencies:
a) Ministry of Home Affairs (if the delegation participates in the annual overseas training plan for cadres, civil servants, and public officials organized by the Ministry of Home Affairs).
b) Agency that decided to establish the delegation.
2. Within the latest 15 days from the date the delegation returns to the country, the trainee's report must be submitted to the following agencies:
a) Agency that decided to establish the delegation.
b) Agency/unit employing cadres, civil servants, and public officials.
3. Within the latest 30 days from the date the delegation returns to the country, the delegation's report must be publicly posted on the electronic information portal of the agencies as stipulated in Clause 2 of this Article (excluding state secrets according to regulations).
4. Annually, ministries, ministerial-level agencies, government agencies, provincial/municipal people's committees under the central government, and central-level political-social organizations have the responsibility to submit reports on cadre, civil servant, and public official training outside the country (if applicable) to the Ministry of Home Affairs.
Chapter IV
STANDARDS, TASKS, WORKING REGIME, AND POLICIES
FOR TEACHERS IN TRAINING AND DEVELOPMENT INSTITUTIONS FOR CADRES, CIVIL SERVANTS, AND PUBLIC OFFICIALS.

Article 13. Standards
1. Senior Teacher:
a) Hold a doctoral degree appropriate to the job position, major, and teaching discipline.
b) Have theoretical political level as prescribed.
c) Hold a certificate for teacher vocational qualification standards training.
d) Be able to use information technology and foreign languages as required by the job position.
2. Principal Teacher:
a) Hold a master's degree or higher appropriate to the job position, major, and teaching discipline.
b) Have theoretical political level as prescribed.
c) Hold a certificate for teacher vocational qualification standards training.
d) Be able to use information technology and foreign languages as required by the job position.
3. Teacher:
a) Hold a bachelor's degree or higher appropriate to the job position, major, and teaching discipline.
b) Have theoretical political level as prescribed.
c) Hold a certificate for teacher vocational qualification standards training.
d) Be able to use information technology and foreign languages as required by the job position.
Article 14. Working Time, Standard Teaching Hours, and Standard Teaching Hour Quotas
1. Teachers' working time follows a 40-hour workweek system.
2. The total working time of teachers in a year to fulfill teaching, scientific research, learning, training, and other tasks is 1,760 hours after deducting the number of days off as prescribed.
3. Standard teaching hour is a unit of time converted from the necessary labor hours to complete a certain workload within the teaching task of the teacher equivalent to one theoretical or practical class session (or remote teaching), including necessary labor hours before, during, and after the class session.
4. Teaching time in the training and development plan is calculated in standard teaching hours, wherein one session (45 minutes) of direct classroom teaching and discussion (or remote teaching) is counted as one standard teaching hour and is specifically defined in Article 19 of this Circular.
5. Framework of standard teaching hour quotas in a year:
a) Probationary Teacher: Maximum 90 standard hours.
b) Teacher: 270 standard hours.
c) Principal Teacher: 290 standard hours.
d) Senior Teacher: 310 standard hours.
đ) Direct classroom teaching hours of the positions specified in points b, c, and d of this clause account for at least 50% of the corresponding quota.
6. Heads of training and development institutions specify specific standard teaching hour quotas for each teacher, consistent with the actual situation of the unit but not exceeding or falling below 15% compared to the standard teaching hour quotas prescribed in Clause 5 of this Article.
Article 15. Teaching Duties
1. Teaching Preparation:
a) Mastering the objectives, content, curriculum, teaching methods, position, requirements of the subject, specialized topics assigned to teach, examination and assessment regulations for students' learning outcomes.
b) Developing teaching plans, course outlines, lectures, and designing materials and data to serve teaching.
2. Delivering lectures, guiding students in self-study skills, discussion, problem-solving, scientific research, participating in practical activities, writing graduation theses (if applicable), term papers, projects.
3. Understanding the level, knowledge, and aspirations of students; regularly updating information to supplement, improve, and innovate teaching content, methods, and data serving teaching.
4. Implementing the process of evaluating student learning outcomes and guiding students to evaluate teaching activities.
5. Observing classes, demonstrating teaching, and participating in evaluating the teaching activities of other lecturers according to the training institution's regulations.
Article 16. Research Duties
1. Leading or participating in implementing research programs, projects, and topics assigned; results must be evaluated by the Scientific Council as meeting or exceeding requirements.
2. Leading or participating in developing training programs, reference materials for training and development; innovative teaching methods and examination and assessment for subjects and specialized topics within the assigned training and development curriculum.
3. Writing articles published in scientific journals; specialized topics, reports, presentations at conferences and seminars assigned to attend.
4. Conducting the evaluation of students' research outcomes; participating in assessing and certifying the quality of training and development.
5. Participating in international cooperation activities in science when assigned.
6. Assigning research tasks to lecturers must align with the training institution's scientific conditions, development strategy, and lecturers' professional capabilities.
7. Each year, lecturers must complete the assigned research tasks corresponding to their positions or job responsibilities. Lecturers' research outcomes are assessed through scientific and technological products, research activities, and technology transfer.
8. The head of the training and development institution assigns research tasks to lecturers and specifies the number of research hours converted from various types of scientific and technological products, research activities, and technology transfer.
Article 17. Duties in Participating in Training and Development Management, Scientific Research, Party Work, Mass Organizations, and Other Activities
1. Participating in building, implementing, and monitoring the execution of teaching and learning plans of the training institution.
2. Participating in recruitment, admission processes, class management, internship supervision, laboratory management (if applicable); departmental management, scientific management, party work, mass organizations, social activities at the training and development institution, and other tasks assigned by authorized bodies.
Article 18. Training and Development Duties
1. Continuously enhancing political, professional, state administration, foreign language, computer skills, and teaching methods to meet the requirements of educational reform and improving the quality of cadre, civil servant, and public official training and development.
2. Annually participating in practical research, supplementing practical knowledge into lectures and problem-solving skills in work situations.
Article 19. Conversion to standard teaching hours
1. Teaching:
a) One lecture class or discussion session is counted as 1 standard teaching hour.
b) One session guiding the resolution of case studies is counted from 2 to 2.5 standard teaching hours.
c) One session guiding practical exercises in class is counted from 1.5 to 2 standard teaching hours.
d) One session delivering a specialized topic report is counted from 1.5 to 2 standard teaching hours.
2. Guidance:
a) Guiding a student to write a graduation thesis (if applicable) is counted from 8 to 10 standard teaching hours.
b) Guiding a student to write a summary, essay, or project is counted from 3 to 5 standard teaching hours.
c) Guiding and taking students to conduct practical research for 1 working day is counted from 3 to 4 standard teaching hours.
3. Preparing and reviewing examination questions:
a) Preparing 1 written examination question and answer is counted from 2 to 2.5 standard teaching hours. Reviewing 1 written examination question and answer is counted as 0.5 standard teaching hour.
b) Preparing 5 oral examination questions and answers is counted from 1.5 to 2 standard teaching hours. Reviewing 5 oral examination questions and answers is counted as 0.5 standard teaching hour.
c) Preparing 1 multiple-choice examination question and answer is counted from 2 to 2.5 standard teaching hours. Reviewing 1 multiple-choice examination question and answer is counted as 0.5 standard teaching hour.
4. Examination basis:
Each examination session is counted as 0.5 standard teaching hours per lecturer.
5. Grading examination papers, summaries, essays, projects (grading two rounds, each round by one lecturer):
a) Each round grading from 4 to 6 written examination papers is counted as 1 standard teaching hour.
b) Each round grading an oral examination for 1 student is counted as 0.5 standard teaching hour.
c) Each round grading from 8 to 10 multiple-choice examination papers is counted as 1 standard teaching hour.
d) Each round grading 1 graduation thesis (if applicable) is counted as 2 standard teaching hours.
đ) Each round grading 4 summaries or essays is counted as 1 standard teaching hour.
e) Each round grading 1 project is counted as 2 standard teaching hours.
6. Admissions Board or Graduation Recognition Board (if applicable): The Chairperson is counted as 2 standard teaching hours per session; the Vice-Chairperson and Secretary are counted as 1.5 standard teaching hours per session; Members are counted as 1 standard teaching hour per session.
7. Graduation Examination Board or Thesis Grading Board (if applicable): The Chairperson is counted as 3 standard teaching hours per session; the Vice-Chairperson is counted as 2 standard teaching hours per session; the Head of the Examination Grading Committee, Examination Supervisor is counted from 1.5 to 2 standard teaching hours per session; the Deputy Head of the Examination Grading Committee, Examination Supervisor is counted from 1 to 1.5 standard teaching hours per session.
8. Supervising the graduation examination is counted from 1.5 to 2 standard teaching hours per session per person.
9. Grading the best teacher examination is counted from 3 to 4 standard teaching hours per session per person.
10. For tasks that have been supported with remuneration from other funding sources, the conversion of task implementation time to standard teaching hours is not carried out. However, these tasks are included in the total standard teaching hours quota for evaluating and ranking the quality of lecturers who do not meet the labor quota.
11. Based on the above regulations, the head of the training and development institution shall specifically convert the time spent on activities under Clause 1, Clause 2, Clause 3, Clause 5, Clause 6, Clause 7, Clause 8, and Clause 9 of this Article into standard teaching hours, ensuring compliance with the requirements of each training and development program and actual conditions.
Article 20. Management and utilization of time for performing tasks and other activities of lecturers
1. The head of training and upgrading institutions assigns teaching, scientific research, study, upgrading, and other tasks appropriate to the lecturer's capacity and occupational title; considering this as one of the bases for evaluating and classifying the quality of lecturers annually based on their capabilities, conditions, and development orientation of the training and upgrading institutions.
2. Each lecturer must complete assigned teaching, scientific research, study, upgrading, and other tasks corresponding to their current occupational title or position each year.
Article 21. Application of standard hour quotas
1. Lecturers who exceed the standard hour quota in teaching, scientific research, and other professional activities shall be entitled to overtime work benefits according to the law. The annual overtime working hours of lecturers shall not exceed the limits stipulated by labor laws.
2. Female lecturers with children under 36 months old shall have their standard hour quotas reduced by 10%. Non-resident studying lecturers shall have their standard hour quotas reduced according to the category of lecturer they hold (or the part-time lecturer if they are part-time) corresponding to the duration of study. If lecturers concurrently meet both aforementioned cases, they shall accumulate the reduction ratio of the standard hour quota.
3. During periods of receiving social insurance benefits or taking leave as prescribed by the current Labor Code, lecturers shall be exempted from the standard hour quota for teaching according to the ratio corresponding to the duration of leave.
Article 22. Standard hour quotas for teaching for lecturers holding leadership, management positions or concurrently undertaking party and mass organization work

2. Individuals appointed to leadership or management positions without holding any lecturer occupational titles shall not implement the standard hour quota prescribed in Clause 1 of this Article.
3. If lecturers hold multiple leadership or management positions or concurrently undertake multiple tasks, they shall only apply the lowest standard hour quota for teaching corresponding to their positions.
4. For lecturers working in functional departments of educational institutions without holding leadership or management positions or concurrently undertaking other tasks, the teaching standard hour quota shall be 40% of the standard hour quota of the lecturer category they hold.
Article 23. Policies for lecturers
1. Lecturers at training and upgrading institutions shall enjoy salary systems, preferential allowances, seniority allowances, teaching allowances, extra-hour teaching pay, and other policies and systems for university education lecturers as stipulated by law; they shall also benefit from political, professional, and vocational upgrading programs.
2. Lecturers at training and upgrading institutions shall be eligible for appointment as associate professors, professors, and may be awarded the titles of Excellent Teacher and National Teacher as prescribed by law.
Chapter V
QUALITY UPGRADING ASSESSMENT
FOR CIVIL SERVANTS AND PUBLIC OFFICIALS
Section 1
CRITERIA, TOOLS, FEEDBACK COLLECTION,
IMPLEMENTATION OF QUALITY UPGRADING ASSESSMENT
FOR CIVIL SERVANTS AND PUBLIC OFFICIALS
Article 24. Evaluation Criteria
1. Programs and materials:
a) The objectives of the program are clearly defined.
b) The program's output standards are clearly defined and meet the requirements that students need to achieve upon completion of the program.
c) The content of the materials does not overlap with the content of other materials.
d) The content of the materials ensures a combination of theory and practice.
đ) The compilation of materials ensures a balance between theory, discussion questions, practical exercises, and situational problem-solving.
e) The materials have a logical structure and sequence; language, spelling, and format comply with regulations.
g) The contribution of each part and each topic in the materials towards achieving the program's output standards is clear.
h) The materials are designed and compiled based on the program's output standards.
2. Students:
a) Actively exchange and discuss the content of each topic in the training course.
b) Actively share practical experience and real-life situations during the study period.
c) Properly implement the instructors' learning guidelines.
d) Fully comply with the regulations of the training course, the National Academy of Public Administration, the training and development institution, and the research institution.
3. Teacher:
a) The knowledge, skills, and experience of the instructors are appropriate for the teaching content.
b) Instructors guide, encourage, and promote students' practical experience during the learning process.
c) Instructors strictly adhere to the program and material regulations regarding theoretical lectures, discussions, practical sessions, and guidance on solving situational problems.
d) Instructors demonstrate good political ideology.
đ) Instructors treat students politely and civilly in communication.
e) Instructors use suitable teaching methods to achieve the program's output standards.
4. Physical facilities and supporting activities:
a) Classrooms and equipment meet teaching and learning requirements.
b) Teaching and learning materials and tools meet the course requirements.

Article 25. Collection of Evaluation Opinions
1. Collect evaluation opinions of trainees and lecturers from the training course on the contents stipulated in Clause 1, Clause 2, Clause 3, and Clause 5 of Article 24 of this Circular.
2. Collect evaluation opinions of trainees, lecturers, Director of the National Academy of Public Administration, heads of training and development institutions, and research institutions on the content stipulated in Clause 4 of Article 24 of this Circular.
3. Collect evaluation opinions of former trainees and heads of agencies and units employing civil servants and public officials on the contents stipulated in Clause 6 of Article 24 of this Circular. The collection of opinions shall be conducted at least six months and up to twelve months after the completion of the training course.
4. The collection of evaluation opinions as prescribed in Clause 1 and Clause 2 of this Article shall be carried out on the day following the closing ceremony of the training course.
Article 26. Evaluation Tools, Levels, and Results
1. Use the quality evaluation software for cadre, civil servant, and public official training (hereinafter referred to as the software) to evaluate the contents stipulated in Article 24 of this Circular.
2. Evaluation level: From 1 to 5.
3. The evaluation results for each content shall be implemented according to the guidelines set forth in Appendix IX attached to this Circular.
4. Depending on the level achieved by the overall evaluation index for each content, the evaluation results will be classified into corresponding levels as follows:

Article 27. Implementation of Evaluation
1. The National Academy of Public Administration, training and development institutions, and research institutions shall access and log into the software to enter the following information immediately after trainees complete their enrollment procedures.
a) Training Course: Name of the training course and topics; opening and closing dates.
b) Lecturer: Full name, phone number, and email address of lecturers teaching each topic; working unit, rank, position, leadership or management position (current or retired).
c) Trainee: Full name, phone number, and email address; working unit, rank, position, leadership or management title.
2. The Ministry of Home Affairs shall send login information to trainees, lecturers, Director of the National Academy of Public Administration, heads of training and development institutions, and research institutions through the software.
3. On the day following the closing ceremony of the training course, trainees, lecturers, Director of the National Academy of Public Administration, heads of training and development institutions, and research institutions shall access and conduct evaluations according to the instructions provided in the software.
4. Six months or more, but not exceeding twelve months after the completion of the training course, the Ministry of Home Affairs shall send information requesting the evaluation of the quality of cadre, civil servant, and public official training to former trainees and heads of agencies and units employing civil servants and public officials through the software.
Section 2
IMPLEMENTATION OF QUALITY EVALUATION
TRAINING OF CADRES, CIVIL SERVANTS, AND PUBLIC OFFICIALS
Article 28. Ministry of Home Affairs
1. Organize the evaluation of the quality of cadre, civil servant, and public official training for the courses specified in Clause 2 of Article 1 of this Circular through the following methods:
a) Direct evaluation.
b) Assign tasks or commission independent evaluation agencies to carry out evaluations.
2. Monitor and urge the National Academy of Public Administration and research institutions to implement regulations on the quality evaluation of cadre, civil servant, and public official training.
3. Guide and inspect the quality evaluation activities of cadre, civil servant, and public official training conducted by ministries, ministerial-level agencies, government agencies, central-level political and social organizations, and provincial People's Committees.
4. Develop, manage, transfer, and guide the use of the quality evaluation software for cadre, civil servant, and public official training.
5. Send the quality evaluation results of cadre, civil servant, and public official training to Personnel Departments of ministries, ministerial-level agencies, government agencies, central-level political and social organizations; Provincial Departments of Home Affairs, and related agencies.
6. Study and implement measures to improve the quality of cadre, civil servant, and public official training within its authority.
Article 29. Ministries, ministerial-level agencies, government-affiliated agencies, central-level political-social organizations; People's Committees of provinces and centrally governed cities
1. On the basis of the guidelines for assessing the quality of cadre, civil servant, and public official training stipulated in this Circular, select and adjust to suit actual conditions to assess the quality of cadre, civil servant, and public official training courses within their jurisdiction through various methods:
a) Direct evaluation.
b) Assign tasks or commission independent evaluation agencies to carry out evaluations.
2. Coordinate with the Ministry of Home Affairs to implement the assessment of the quality of cadre, civil servant, and public official training within their jurisdiction.
3. Supervise and urge training and retraining institutions; training and research institutions to implement regulations on assessing the quality of cadre, civil servant, and public official training.
4. Based on the assessment results report, propose and implement measures to improve the quality of cadre, civil servant, and public official training within their scope of responsibility.
5. Have the responsibility to submit reports on the assessment results of cadre, civil servant, and public official training, implemented measures, and the implementation status and results of these measures to the Ministry of Home Affairs as prescribed in Clause 1, Article 44 of Decree No. 101/2017/NĐ-CP.
6. The Cadre and Civil Service Departments of ministries, ministerial-level agencies, government-affiliated agencies, central-level political-social organizations; Provincial Departments of Home Affairs of provinces and centrally governed cities are the lead units assisting the Minister, head of a ministerial-level agency, head of a government-affiliated agency, head of a central-level political-social organization, and the Chairman of the provincial People's Committee in implementing the guidelines on assessing the quality of cadre, civil servant, and public official training as stipulated in this Circular.
Article 30. National Academy of Public Administration, training and retraining institutions of ministries, ministerial-level agencies, government-affiliated agencies, central-level political-social organizations; Provincial Political Schools of provinces and centrally governed cities; training and research institutions
1. On the basis of the guidelines for assessing the quality of cadre, civil servant, and public official training stipulated in this Circular, select and adjust to suit actual conditions to assess the quality of cadre, civil servant, and public official training courses directly organized through various methods:
a) Direct evaluation.
b) Assign tasks or commission independent evaluation agencies to carry out evaluations.
2. Implement regulations on assessing the quality of cadre, civil servant, and public official training.
3. Based on the assessment results report, propose and implement measures to improve the quality of cadre, civil servant, and public official training within their scope of responsibility.
4. Have the responsibility to submit reports on training and retraining results; assessment results of cadre, civil servant, and public official training quality, implemented measures, and the implementation status and results of these measures to ministries, ministerial-level agencies, government-affiliated agencies, central-level political-social organizations; People's Committees of provinces and centrally governed cities before January 15 of the following year or as required by the competent authority.
Article 31. Independent Evaluation Agency
1. Conduct evaluations of the contents as required by the agency assigning tasks or placing orders, ensuring compliance with regulations, objectivity, and accuracy.
2. Report the assessment results of cadre, civil servant, and public official training quality as required by the agency assigning tasks or placing orders.
Article 32. Regarding the subjects whose opinions are collected for evaluation
1. The subjects whose opinions are collected for evaluation shall be responsible for participating in the quality assessment of cadre training, civil servant, and public official capacity building, ensuring compliance with procedures, completeness, objectivity, and honesty.
2. Subjects whose opinions are collected for evaluation who fail to fulfill their responsibilities in implementing the regulations on quality assessment shall be evaluated as not meeting the criteria for organizational discipline as stipulated by law.
Chapter VI
IMPLEMENTING PROVISIONS
Article 33. Transitional Provisions
1. The Ministry of Home Affairs shall use Appendices III, IV, V, VI, VII, VIII, IX, X issued together with this Circular to assess the quality of capacity building until the assessment software is put into use.
2. Agencies and organizations specified in Articles 29 and 30 of this Circular shall refer to and use the appendices mentioned in Clause 1 of this Article to assess the quality of capacity building for cadres, civil servants, and public officials within their jurisdiction.
3. In cases where lecturers at training and capacity-building institutions already hold one of the Level I, Level II, or Level III instructor training certificates as prescribed by law before June 30, 2022, they shall be deemed to meet the requirements for the certificate of the instructor training program according to the occupational title standards corresponding to each level, which may be used when participating in examinations or evaluations for promotion to higher occupational titles without having to undergo the instructor training program prescribed in this Circular.
Article 34. Effective Date
1. This Circular takes effect from June 15, 2023.
2. Abolish all the following normative legal documents:
a) Circular No. 01/2018/TT-BNV dated January 8, 2018, issued by the Minister of Home Affairs guiding certain provisions of Decree No. 101/2017/NĐ-CP dated September 1, 2017, of the Government on training and capacity building for cadres, civil servants, and public officials.
b) Circular No. 10/2017/TT-BNV dated December 29, 2017, issued by the Minister of Home Affairs providing for the quality assessment of capacity building for cadres, civil servants, and public officials.
Article 35. Responsibility for Implementation
1. The Minister, Heads of Ministries equivalent to ministries, agencies under the Government, Chairpersons of People's Committees of provinces and centrally-administered cities, and relevant agencies, organizations, and individuals shall be responsible for implementing the provisions of this Circular.
2. Any difficulties encountered during implementation should be reported to the Ministry of Home Affairs for guidance or consideration and resolution.

Evaluation Implementation Unit:
1. Conduct the evaluation during the last class before the end of the training program.
2. Prepare a list of participants for the quality evaluation of cadre, civil servants, and public officials; prepare evaluation forms and number them sequentially.
3. Inform respondents about the purpose, content, and method of responding to the evaluation (select only one option for each criterion).
4. Collect the evaluation forms and check the information provided in the answers to ensure all criteria have been addressed.
5. Gather all forms and transfer them to the processing unit of the organization.
6. Compile all evaluation forms and sort them according to their sequential numbering.
7. Depending on specific conditions, agencies and units should use appropriate tools to aggregate and analyze data and complete the combined evaluation results table as stipulated in Appendix IX annexed with this Circular.
8. Submit the evaluation report and the combined evaluation results table to the head of the agency or organization responsible for implementing the evaluation.
