CIRCULAR

Repeal certain regulatory legal documents issued by the Governor

of the State Bank of Vietnam, jointly issued

Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;

On the basis of Law issuing regulatory legal documents dated 22 June 2015;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some articles and implementing mechanisms for the Law on Issuing Regulatory Legal Documents;

Pursuant to Decree No. 16/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;

Upon the proposal of the Head of the Legal Department;

After reaching consensus with the Minister of Finance, the Minister of Industry and Trade, the Minister of Transport, the Minister of Agriculture and Rural Development, the Minister of Health, the Governor of the State Bank of Vietnam issues this Circular to abolish certain regulatory legal documents issued by the Governor of the State Bank of Vietnam, and jointly issued documents.

Article 1. Repeal of legal regulatory acts

Repeal all regulatory legal documents issued by the Governor of the State Bank of Vietnam, jointly issued as follows:

1. Decision No. 181/QD-NH dated October 10, 1991 promulgating the Rules on organization and technical procedures for inter-bank settlement operations.

2. Decision No. 394/1997/QD-NHNN1 dated November 28, 1997 on providing loans in designated tranches to state-owned commercial banks to mitigate the aftermath of Typhoon No. 5.

3. Decision No. 218/1998/QD-NHNN1 dated July 1, 1998 on assigning tasks to the Vietnam Commercial Joint Stock Bank to manage and provide loans from the Training Credit Fund.

4. Decision No. 134/2000/QD-NHNN2 dated April 18, 2000 promulgating the Technical Procedures for Electronic Funds Transfer Operations within the State Bank System.

5. Decision No. 1234/2001/QD-NHNN dated September 26, 2001 promulgating the Loan Regulations applicable to students and trainees at universities, colleges, vocational high schools, and vocational training institutions.

6. Circular No. 11/2003/TT-NHNN dated December 11, 2003 guiding foreign exchange management for the purchase and sale of government bonds denominated in foreign currencies by organizations and individuals pursuant to Decision No. 182/2003/QD-TTg dated September 5, 2003 of

7. Directive No. 03/2004/CT-NHNN dated February 9, 2004 on providing loans to state-owned forestry and farm enterprises.

8. Circular No. 06/2004/TT-NHNN dated September 27, 2004 guiding internal credit operations of cooperatives.

9. Decision No. 19/2006/QD-NHNN dated May 4, 2006 promulgating the Action Program of the banking industry on thrift and anti-waste practices.

10. Directive No. 05/2006/CT-NHNN dated December 21, 2006 strengthening the dissemination and education of laws in the banking sector.

11. Circular No. 04/2007/TT-NHNN dated June 13, 2007 amending and supplementing Circular No. 06/2004/TT-NHNN dated September 27, 2004 of the State Bank guiding internal credit operations of cooperatives.

12. Directive No. 04/2007/CT-NHNN dated October 8, 2007 on compliance with traffic regulations.

13. Decision No. 47/2007/QD-NHNN dated December 25, 2007 on service fees for credit information.

14. Circular Jointly Issued No. 01/2008/TTLT-BCT-BTC-BGTVT-BNN&PTNT-BYT-NHNN dated January 31, 2008 guiding the implementation of Decision No. 254/2006/QD-TTg dated November 7, 2006 of

15. Directive No. 03/2008/CT-NHNN dated April 22, 2008 on strengthening inspection and supervision work of the State Bank.

16. Decision No. 17/2008/QD-NHNN dated May 16, 2008 providing interest rate information for determining the base interest rate.

17. Decision No. 19/2008/QD-NHNN dated July 1, 2008 promulgating the Program on Dissemination and Education of Laws in the Banking Sector (2008-2012).

18. Directive No. 04/2008/CT-NHNN dated August 27, 2008 on rectifying the activities of People's Credit Funds.

19. Directive No. 05/2008/CT-NHNN dated October 9, 2008 on certain measures to ensure safety and efficiency in the business operations of credit organizations.

20. Circular No. 18/2009/TT-NHNN dated August 14, 2009 detailing the provision of loans by commercial banks to low-income households purchasing or leasing houses in urban areas.

Article 2. Effective Date

This Circular takes effect from August 12, 2017.

Article 3. Implementation Organization

The Head of the Legal Department, Heads of units under the State Bank of Vietnam, Chairmen of Management Boards, Chairmen of Board of Members, General Directors (Directors) of credit organizations, General Directors (Directors) of foreign bank branches, and related agencies and organizations are responsible for implementing this Circular./.
