CIRCULAR

Regulations on the conditions for training and research institutions to organize and implement programs for civil servant capacity building in the Transport Industry

Pursuant to the Civil Servant Law No. 58/2010/QH12 dated November 15, 2010;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Civil Servant Law No. 52/2019/QH14 dated November 25, 2019;

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to the Government Decree No. 101/2017/NĐ-CP dated September 1, 2017 on training and capacity building for cadres, public officials, and civil servants;

The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.

The Minister of Transport hereby promulgates this Circular stipulating the conditions for training and research institutions to organize and implement programs for civil servant capacity building in the Transport Industry.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates the conditions for training and research institutions to organize and implement programs for civil servant capacity building in the Transport Industry, including: conditions regarding the training programs and materials; lecturers; physical facilities and practical training bases; experience in organizing training and capacity building of training and research institutions; implementation of capacity building; evaluation of capacity building quality; printing, issuing, and managing capacity building certificates.

Article 2. Scope of Application. This Circular applies to academies, research institutes, universities, colleges, secondary vocational schools; training and capacity building institutions under the Ministry of Transport (hereinafter referred to collectively as training and research institutions) and related agencies, organizations, and individuals.

Article 3. Purpose of Capacity Building

Clause 1. To enhance the professional skills and occupational ethics of civil servants in the Transport Industry.

Clause 2. To meet the occupational title standards prescribed by law as a basis for considering promotion, taking promotion exams according to occupational title standards, and implementing other relevant policies and regulations.

Article 4. Organization of Capacity Building

Clause 1. Academies, research institutes, universities, and training and capacity building institutions that satisfy the conditions stipulated in Chapter II of this Circular shall organize and implement capacity building programs for Grade I and Grade II civil servants in the Transport Industry.

Clause 2. Colleges and training and capacity building institutions that satisfy the criteria stipulated in Chapter II of this Circular shall organize and implement capacity building programs for Grade II and Grade III civil servants in the Transport Industry.

Clause 3. Secondary vocational schools and training and capacity building institutions that satisfy the criteria stipulated in Chapter II of this Circular shall organize and implement capacity building programs for Grade IV and Grade V civil servants in the Transport Industry.

Article 5. Evaluation of Capacity Building Quality for Civil Servants in the Transport Industry and Printing, Issuing, and Managing Capacity Building Certificates

Clause 1. The evaluation of capacity building quality for civil servants in the Transport Industry shall be carried out in accordance with the provisions of Circular No. 10/2017/TT-BNV dated December 29, 2017 issued by the Minister of Home Affairs on evaluating the quality of capacity building for cadres, public officials, and civil servants, and other relevant provisions.

Clause 2. The printing, issuance, and management of capacity building certificates for civil servants in the Transport Industry shall be conducted in accordance with the provisions of Article 4 of Circular No. 01/2018/TT-BNV dated January 8, 2018 issued by the Minister of Home Affairs guiding certain provisions of Government Decree No. 101/2017/NĐ-CP dated September 1, 2017 on training and capacity building for cadres, public officials, and civil servants.

Chapter II

Article 5. CONDITIONS FOR EDUCATIONAL AND RESEARCH INSTITUTIONS TO IMPLEMENT TRAINING PROGRAMS FOR CIVIL SERVANTS IN THE TRANSPORT SECTOR

Article 5. Training Programs

1. The training program based on occupational standards for civil servants in the transport sector shall be issued by the Minister of Transport in accordance with the provisions of the law.

2. The training program based on job position requirements, knowledge, skills, and specialties for civil servants in the transport sector shall be issued by the Minister of Transport.

Article 6. Training Materials

Educational and research institutions must have training materials compiled or selected and issued based on the training programs stipulated in Article 5 of this Circular.

Article 7. Lecturers

1. Lecturers from educational and research institutions, part-time lecturers, and invited lecturers must meet the lecturer standards specified in Articles 34 and 35 of Decree No. 101/2017/ND-CP dated September 1, 2017, of the Government on training and upgrading cadres, civil servants, and civil employees.

2. Lecturers from educational and research institutions must be sufficient to participate in teaching at least 50% of the assigned training program workload.

Article 8. Physical Facilities and Practical Training Sites

1. Must have adequate classrooms, functional rooms, and necessary equipment to meet the theoretical and practical skill training requirements consistent with the training programs stipulated in Article 5 of this Circular.

2. Must have adequate information resources, including books, textbooks, lectures, and related materials consistent with the training programs stipulated in Article 5 of this Circular.

Article 9. Experience in Organizing Training and Upgrading

Educational and research institutions must have at least three years of experience in organizing upgrading for civil servants or organizing training at the intermediate level or higher in fields under the management of the Ministry of Transport related to the training programs based on occupational standards for civil servants in the transport sector.

Chapter III

IMPLEMENTATION

Article 10. Responsibilities of Educational and Research Institutions Assigned to Implement Upgrading

1. Compile or select and issue training materials for specialized civil servants in the transport sector according to the upgrading programs issued by the Minister of Transport, ensuring suitability for each target group; provide reference materials for teaching and learning.

2. Develop plans and organize upgrading for civil servants in the transport sector for each target group in compliance with legal regulations.

3. Decide on the list of students admitted, manage the learning process, evaluate learning outcomes, and recognize learning results of students in accordance with legal regulations.

4. Annually compile and submit the results of upgrading civil servants in the transport sector to the direct superior administrative body and the Ministry of Transport for consolidation, monitoring, and management.

Article 11. Responsibilities of Agencies and Units with Civil Servants Participating in Upgrading

1. Annually develop plans for upgrading civil servants in the transport sector within their jurisdiction; send them to the direct superior administrative body and coordinate with educational and research institutions to implement upgrading according to the plan.

2. Have the responsibility to manage files; ensure the standards of civil servants sent for upgrading as prescribed.

Article 12. Effective Date

1. This Circular takes effect from April 15, 2021.

2. During implementation, if the normative legal documents cited in this Circular are amended, supplemented, or replaced, the amended, supplemented, or replaced documents shall apply.

Article 13. Responsibility for Implementation

The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Heads of educational and research institutions, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
