Circular No. 05/2019/TT-NHNN Abolishes Certain Legal Normative Documents Issued by the Governor of the State Bank of Vietnam

CIRCULAR

Repeal certain regulatory legal documents issued by the Governor

of the State Bank of Vietnam, jointly issued

Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;

On the basis of Law issuing regulatory legal documents dated 22 June 2015;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some articles and implementing mechanisms for the Law on Issuing Regulatory Legal Documents;

Pursuant to Decree No. 16/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;

Upon the proposal of the Head of the Legal Department;

After reaching consensus with the Minister of Justice, the Governor of the State Bank of Vietnam issues this Circular to repeal certain regulatory legal documents issued by the Governor of the State Bank of Vietnam, jointly issued.

This Circular takes effect from January 25, 2026.

Repeal all regulatory legal documents issued by the Governor of the State Bank of Vietnam, jointly issued as follows:

1. Circular No. 03/1997/TT-NH2 dated July 14, 1997 guiding accounting for financial leasing operations.

2. Decision No. 237/1999/QĐ-NHNN8 dated July 8, 1999 on the issuance of the Regulation on managing foreign activities of the State Bank.

3. Decision No. 296/2000/QĐ-NHNN1 dated September 6, 2000 announcing the basic interest rate as the basis for credit institutions to set interest rates for loans in Vietnamese Dong to customers.

4. Decision No. 440/2000/QĐ-NHNN1 dated October 10, 2000 announcing the basic interest rate as the basis for credit institutions to set interest rates for loans in Vietnamese Dong to customers.

5. Decision No. 464/2000/QĐ-NHNN1 dated November 2, 2000 announcing the basic interest rate as the basis for credit institutions to set interest rates for loans in Vietnamese Dong to customers.

6. Decision No. 495/2000/QĐ-NHNN1 dated November 30, 2000 on the number of days for calculating annual interest on deposits and loans in US dollars.

7. Decision No. 500/2000/QĐ-NHNN1 dated December 5, 2000 announcing the basic interest rate as the basis for credit institutions to set interest rates for loans in Vietnamese Dong to customers.

8. Decision No. 85/2001/QĐ-NHNN dated January 31, 2001 announcing the basic interest rate as the basis for credit institutions to set interest rates for loans in Vietnamese Dong to customers.

9. Decision No. 154/2001/QĐ-NHNN dated February 27, 2001 announcing the basic interest rate as the basis for credit institutions to set interest rates for loans in Vietnamese Dong to customers.

10. Decision No. 237/2001/QĐ-NHNN dated March 28, 2001 announcing the basic interest rate as the basis for credit institutions to set interest rates for loans in Vietnamese Dong to customers.

11. Decision No. 557/2001/QĐ-NHNN dated April 26, 2001 announcing the basic interest rate as the basis for credit institutions to set interest rates for loans in Vietnamese Dong to customers;

12. Decision No. 703/2001/QĐ-NHNN dated May 24, 2001 announcing the basic interest rate as the basis for credit institutions to set interest rates for loans in Vietnamese Dong to customers.

13. Decision No. 836/2001/QĐ-NHNN dated June 28, 2001 announcing the basic interest rate as the basis for credit institutions to set interest rates for loans in Vietnamese Dong to customers.

14. Decision No. 893/2001/QĐ-NHNN dated July 17, 2001 on implementing foreign exchange swap transactions between the State Bank and banks to meet short-term capital needs in Vietnamese Dong for banks.

15. Decision No. 932/2001/QĐ-NHNN dated July 27, 2001 announcing the basic interest rate as the basis for credit institutions to set interest rates for loans in Vietnamese Dong to customers.

16. Decision No. 1033/2001/QĐ-NHNN dated August 15, 2001 on adjusting the exchange rate applied by the State Bank when reselling US Dollars to banks implementing foreign exchange swap transactions according to Decision No. 893/2001/QĐ-NHNN dated July 17, 2001 of the Governor of the State Bank on implementing foreign exchange swap transactions between the State Bank and banks to meet short-term capital needs in Vietnamese Dong for banks.

17. Decision No. 1078/2001/QĐ-NHNN dated August 27, 2001 announcing the basic interest rate as the basis for credit institutions to set interest rates for loans in Vietnamese Dong to customers.

18. Decision No. 1247/2001/QĐ-NHNN dated September 28, 2001 announcing the basic interest rate as the basis for credit institutions to set interest rates for loans in Vietnamese Dong to customers.

19. Decision No. 1289/2001/QĐ-NHNN dated October 11, 2001 on amending Decision No. 893/2001/QĐ-NHNN dated July 17, 2001 of the Governor of the State Bank on implementing foreign exchange swap transactions between the State Bank and banks to meet short-term capital needs in Vietnamese Dong for banks.

20. Decision No. 1379/2001/QĐ-NHNN dated November 2, 2001 on issuing regulations on equipping, using, and paying telephone charges within the State Bank system.

21. Decision No. 1474/2001/QĐ-NHNN dated November 23, 2001 on defining the objects and levels of payment for official telephone charges in State Bank units.

22. Decision No. 1510/2001/QĐ-NHNN dated November 30, 2001 on abolishing the reporting accounting provisions applicable to State Bank units under the Information and Reporting System issued pursuant to Decision No. 516/2000/QĐ-NHNN1 dated December 18, 2000 of the Governor of the State Bank.

23. Joint Circular No. 02/2002/TTLT-NHNN-BTP dated February 5, 2002 guiding the implementation of Decision No. 149/2001/QĐ-TTg dated October 5, 2001 of the Prime Minister on procedures for selling collateral assets, notarizing, certifying sale documents, and transferring assets to commercial banks based on court judgments and decisions.

24. Decision No. 236/2002/QĐ-NHNN dated March 27, 2002 on amending Article 13, Clause 1 of the Regulation on Managing Foreign Activities of the State Bank issued together with Decision No. 237/1999/QĐ-NHNN8 dated July 8, 1999.

25. Circular No. 05/2002/TT-NHNN dated September 27, 2002 on guiding the provision of loans to producers and enterprises signing contracts for the purchase of agricultural products according to Decision No. 80/2002/QĐ-TTg dated June 24, 2002 of the Prime Minister.

26. Decision No. 1448/2002/QĐ-NHNN dated December 31, 2002 on amending and supplementing the standards and quotas for fixed-line telephones at home and mobile phones in the State Bank system issued together with Decision No. 1379/2001/QĐ-NHNN dated November 2, 2001 and Decision No. 1474/2001/QĐ-NHNN dated November 23, 2001 of the State Bank.

27. Directive No. 08/2003/CT-NHNN dated December 24, 2003 on improving the quality of credit services provided by credit institutions.

28. Directive No. 04/2004/CT-NHNN dated April 1, 2004 on strengthening management and supervision to ensure safe, effective, and sustainable credit operations.

29. Decision No. 365/2004/QD-NHNN dated April 13, 2004 on lending to Vietnamese workers going to work abroad.

30. Directive No. 07/2005/CT-NHNN dated December 8, 2005 on strengthening preventive work for business information systems in the banking sector.

31. Decision No. 1839/2005/QD-NHNN dated December 19, 2005 on exchanging and collecting overdue payment bills.

32. Decision No. 22/2006/QD-NHNN dated May 18, 2006 promulgating the Fire Prevention and Control Regulations within the State Bank of Vietnam system.

33. Decision No. 31/2006/QD-NHNN dated July 18, 2006 promulgating the standards for members of the Board of Directors, members of the Supervisory Board, and managers of people's credit funds.

34. Decision No. 45/2006/QD-NHNN dated September 11, 2006 promulgating the organization and operation regulations of the Board of Directors, the Supervisory Board, and the management body of people's credit funds.

35. Circular No. 31/2011/TT-NHNN dated September 30, 2011 stipulating the inspection and handling of normative legal documents of the State Bank of Vietnam.

36. Circular No. 26/2014/TT-NHNN dated September 16, 2014 stipulating the provision of rediscounting by the State Bank of Vietnam to credit institutions in Vietnamese dong pursuant to Decision No. 540/QD-TTg dated April 16, 2014 of the Prime Minister on credit policies for shrimp and catfish farmers.

Article 2. Repealing part of legal normative documents

Repealing part of the normative legal documents issued by the Governor of the State Bank of Vietnam as follows:

1. Chapter 2 and Chapter 3 of the Regulation on Managing Commemorative Coins, Souvenir Coins, and Coins Ceased from Circulation issued together with Decision No. 1506/2001/QD-NHNN dated November 30, 2001 of the Governor of the State Bank of Vietnam.

2. Article 6 of Circular No. 25/2011/TT-NHNN dated August 31, 2011 on implementing plans to simplify administrative procedures in the foreign exchange sector according to Government Resolutions on simplifying administrative procedures under the management functions of the State Bank of Vietnam.

Article 3. Effectiveness

This Circular takes effect from August 9, 2019.

Article 4. Organization of Implementation

The Head of the Legal Department, Heads of units under the State Bank of Vietnam, Governors of the State Bank of Vietnam branches in provinces and centrally governed cities; Chairmen of the Board of Directors, Chairmen of the Board of Members, General Directors (Directors) of credit organizations, foreign bank branches, and related agencies, organizations, and individuals are responsible for implementing this Circular./.
