THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
On the basis of the Constitution of the Socialist Republic of Vietnam;
BASED ON THE LAW ON THE ORGANIZATION OF THE NATIONAL ASSEMBLY NO. 57/2014/QH13, AS AMENDED BY SOME ARTICLES IN LAW NO. 65/2020/QH14;
Pursuant to the Law on Science and Technology No. 29/2013/QH13 amended and supplemented by some articles under Law No. 28/2018/QH14; Pursuant to the Regulation on Operation of the Standing Committee of the National Assembly issued together with Resolution No. 1075/2015/UBTVQH13 dated December 11, 2015;
Considering the proposal of the Head of the Delegation Work Committee at the Report No. 760/TTr-BCTĐB
dated September 27, 2021, Article 1. Position and functions of the Legislative Research Institute
RESOLUTION:
The Legislative Research Institute is an agency under the Standing Committee of the National Assembly with the function of conducting scientific legislative research, organizing information on scientific legislative research to advise policies, provide consultation, support, and serve the National Assembly, its agencies, agencies under the Standing Committee of the National Assembly, and National Assembly deputies in performing their functions, tasks, and powers; assisting the Standing Committee of the National Assembly in managing scientific and technological activities within the National Assembly's agencies, agencies under the Standing Committee of the National Assembly, Delegations of National Assembly members, and the National Assembly Office.
Article 2. Tasks and powers of the Legislative Research Institute
1. Conducting research and organizing research to advise and serve the National Assembly, its agencies, agencies under the Standing Committee of the National Assembly, and National Assembly deputies in reforming the organizational structure and operational methods of the National Assembly and the advisory and supporting machinery of the National Assembly and the Standing Committee of the National Assembly.
2. Proactively or upon request from the National Assembly, its agencies, agencies under the Standing Committee of the National Assembly, and National Assembly deputies, conducting research and organizing research on theoretical and practical foundations related to the National Assembly's exercise of constitutional lawmaking power, legislative power, decision-making on important national issues, and supreme oversight over state activities.
3. Advising and supporting National Assembly deputies in exercising their right to propose petitions for laws and ordinances; proposing the drafting of laws and ordinances; supporting during the drafting process of law projects, ordinance projects, and draft resolutions submitted to the National Assembly and the Standing Committee of the National Assembly by National Assembly deputies. Participating closely with the Ethnic Councils, Committees of the National Assembly, and agencies under the Standing Committee of the National Assembly in the legislative process.
4. Proactively or upon request from the National Assembly, its agencies, agencies under the Standing Committee of the National Assembly, and National Assembly deputies, organizing the provision of scientific information and results of legislative scientific research to serve the National Assembly, its agencies, agencies under the Standing Committee of the National Assembly, Delegations of National Assembly members, and National Assembly deputies in performing assigned tasks and powers.
5. Publishing the Journal of Legislative Research and the Electronic Journal of Legislative Research to publish, provide, and exchange legislative scientific information and promote the dissemination of legislative scientific information, legislative practice, and normative legal documents issued by the National Assembly and the Standing Committee of the National Assembly; compiling publications, research works, and research materials.
6. Assisting the Standing Committee of the National Assembly in managing state affairs concerning science and technology within the National Assembly's agencies, agencies under the Standing Committee of the National Assembly, Delegations of National Assembly members, and the National Assembly Office according to the Law on Science and Technology; performing the role of the permanent office of the Scientific Council of the Standing Committee of the National Assembly.
7. Implementing cooperative activities to deploy research and provide legislative scientific information with domestic and foreign research and information agencies; receiving, managing, exploiting, and disseminating results of legislative scientific research, documents, and products containing legislative scientific information from domestic and foreign agencies, organizations, and individuals to provide services to the National Assembly, its agencies, agencies under the Standing Committee of the National Assembly, and National Assembly deputies.
8. Attracting experts and collaborators to participate in research activities and organizing the provision of legislative scientific information.
9. Organizing conferences and seminars to serve law projects, ordinance projects, draft resolutions, and other tasks and powers as prescribed by law or assigned by the National Assembly, the Standing Committee of the National Assembly, and the National Assembly leadership.
9. Organize conferences and seminars to serve legislative projects, ordinances, draft resolutions, and to carry out other tasks and authorities as prescribed by law or assigned by the National Assembly, the Standing Committee of the National Assembly, or the leadership of the National Assembly.
Article 3. Organizational Structure of the Legislative Research Institute
1. The Legislative Research Institute shall have a Director, Deputy Directors, and civil servants, officials, and employees.
2. The staffing and organizational structure of civil servant and official positions at the Legislative Research Institute shall be decided by the Standing Committee of the National Assembly based on job positions and functions, tasks, powers of the Legislative Research Institute. In addition to the prescribed staffing quota, the Legislative Research Institute may utilize expert and associate systems.
3. The Legislative Research Institute shall have the following subordinate units:
a) Administrative-State Law Research Center;
b) Economic-Social Law Research Center;
c) Scientific Management Board;
d) Office of the Legislative Research Institute;
đ) Legislative Research Journal.
The Legislative Research Journal is a public service organization operating under the Press Law and relevant laws, possessing legal personality, having its own bank account and seal.
Article 4. Tasks and Powers of the Director and Deputy Directors of the Legislative Research Institute
1. The Director and Deputy Directors of the Legislative Research Institute shall be appointed, dismissed, or removed from office by the Standing Committee of the National Assembly. The Director of the Legislative Research Institute shall be responsible to the Standing Committee of the National Assembly for the organization and operation of the Legislative Research Institute.
2. The Director of the Legislative Research Institute shall have the following tasks and powers:
a) Leading, directing, organizing management, and operational activities of the Legislative Research Institute;
b) Being subject to the direction of the Standing Committee of the National Assembly, the leadership of the National Assembly; maintaining relations with the Standing Committee of the National Ethnic Council, the Standing Committees of the National Assembly, the leadership of agencies under the Standing Committee of the National Assembly, the National Assembly Office, and related agencies and organizations;
c) Representing the Legislative Research Institute in international cooperation within the scope of authority of the Legislative Research Institute;
d) Deciding on recruitment, utilization, management, rewards, and handling violations of civil servants, officials, and employees working at the Legislative Research Institute according to the law, except in cases stipulated in Clause 1 of this Article;
đ) Specifying the organizational structure, functions, tasks, powers, and activities of subordinate units of the Legislative Research Institute; mechanisms for coordination and work relationships within the Legislative Research Institute and with related agencies and organizations;
e) Deciding on the establishment of the Scientific Council of the Legislative Research Institute;
g) Performing other tasks and powers assigned by the Standing Committee of the National Assembly and the leadership of the National Assembly.
3. Deputy Directors of the Legislative Research Institute shall assist the Director of the Legislative Research Institute in performing tasks as delegated by the Director. When the Director of the Legislative Research Institute is absent, a Deputy Director shall be authorized by the Director to perform the Director's tasks and powers.
Article 5. Budget and Assurance Conditions
1. The Legislative Research Institute is a public service organization serving political tasks and state administration operations under an administrative mechanism, having its own seal and bank account.
2. The operating budget of the Legislative Research Institute shall be fully guaranteed by the state budget, with additional funds provided for urgent tasks. The material basis and operational conditions of the Legislative Research Institute shall be ensured by the National Assembly Office.
3. The Standing Committee of the National Assembly shall assign the National Assembly Office to assume the role of the superior financial management agency for the Legislative Research Institute.
4. Staff, civil servants, officials, and employees working at the Legislative Research Institute shall enjoy benefits and policies similar to those of staff, civil servants, and employees of the National Assembly Office, consistent with the special nature of the National Assembly's operations.
Heads of subordinate units of the Legislative Research Institute as stipulated in Clause 3 of Article 3 of this Resolution shall enjoy salaries, benefits, and policies equivalent to those of Department Heads, and Deputy Department Heads shall enjoy salaries, benefits, and policies equivalent to those of Deputy Department Heads of central ministries and sectors.
Article 6. Implementation Provisions
1. This Resolution shall take effect from the date of signature.
2. This Resolution replaces Resolution No. 1050/2015/UBTVQH13 dated October 9, 2015 of the Standing Committee of the National Assembly.
3. The Director of the Legislative Research Institute, the Head of the National Assembly Office, the Chairman of the Delegation Work Board, and related agencies, organizations, and individuals shall implement this Resolution according to their responsibilities./.
