Guidelines for Implementing Certain Projects under the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the Period 2021-2030, Phase I: from 2021 to 2025

         

Pursuant to Decree No. 41/2025/NĐ-CP dated February 26, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Ethnic Minorities and Religion; Decree No. 114/2025/NĐ-CP dated June 3, 2025 of the Government amending Clause 12, Article 3 of Decree No. 41/2025/NĐ-CP dated February 26, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Ethnic Minorities and Religion;

Pursuant to Decree No.27/2022/NĐ-CPdated April 19, 2022 of the Government stipulating the management mechanism and organization of implementation of national target programs; Decree No.38/2023/NĐ-CPdated June 24, 2023 of the Government amending and supplementing certain provisions of Decree No.27/2022/NĐ-CP; Decree No. 125/2025/NĐ-CP dated June 11, 2025 of the Government stipulating the division of authority of local governments at two levels in the field of state management by the Ministry of Finance;

Pursuant to Decision No. 04/2023/QĐ-TTg dated February 23, 2023 of the Prime Minister on the level of support for using public investment capital to implement certain contents of Project 1 and Sub-project 1, Project 4 of the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030 Phase I: from 2021 to 2025; Stage I: from 2021 to 2025;

Pursuant to Decree No. 132/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the division of authority of local governments at two levels in the field of state management by the Ministry of Science and Technology;

Pursuant to Decree No. 150/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the organization of specialized agencies under provincial people's committees and central city people's committees and village, ward, special zone people's committees under provincial and central city people's committees;

Pursuant to Decree No. 151/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the division of authority of local governments at two levels, decentralization, and delegation of authority in the land sector;

Implementing Decision No. 1719/QĐ-TTg dated October 14, 2021 of the Prime Minister approving the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030; Phase I: from 2021 to 2025; Decision No. 920/QĐ-TTg dated May 14, 2025 of the Prime Minister adjusting certain contents of the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030; Phase I: from 2021 to 2025;

Based on the proposal of the Director of the National Office for Ethnic Minorities and Mountainous Areas;

The Minister of Ethnic Minorities and Religion issues this Circular guiding the implementation of certain projects under the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030, Phase I: from 2021 to 2025.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

a) This Circular guides the implementation of Project 1; Project 2; Content No. 01 and Content No. 03, Sub-project 2 of Project 3; Sub-project 1, Sub-project 2 of Project 4; Sub-project 2, Sub-project 4 of Project 5; Sub-project 1, Sub-project 2 of Project 9; Content No. 01 and Content No. 02 of Sub-project 1, Sub-project 2, Sub-project 3 of Project 10 under the Program pursuant to Decision No. 1719/QĐ-TTg dated October 14, 2021 of the Prime Minister approving the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030; Phase I: from 2021 to 2025 (hereinafter referred to as Decision No. 1719/QĐ-TTg); Decision No. 920/QĐ-TTg dated May 14, 2025 of the Prime Minister adjusting certain contents of the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030; Phase I: from 2021 to 2025 (hereinafter referred to as Decision No. 920/QĐ-TTg).

b) This Circular does not include provisions: tasks carried out by the Ministry of Education and Training, People's Committee of Tuyen Quang Province as the main responsible body in Sub-project 2 of Project 4; tasks carried out by the Ministry of Defense, Ministry of Public Security, Ministry of Education and Training, Ho Chi Minh National Political Academy as the main responsible body in Sub-project 2 of Project 5; Tasks carried out by the Ministry of Culture, Sports and Tourism, Ministry of Science and Technology as the main responsible body in Content No. 02 of Sub-project 1, tasks carried out by the Ministry of Science and Technology, Vietnam Union of Science and Technology Associations as the main responsible body in Sub-project 2 of Project 10 under the Program pursuant to Decision No. 1719/QĐ-TTg and Decision No. 920/QĐ-TTg.

This Circular applies to communes, villages in ethnic minority and mountainous areas (hereinafter referred to as DTTS&MN); households, individuals of ethnic minorities; households, individuals of the Kinh ethnicity who are poor or near-poor living in particularly difficult communes and villages (hereinafter referred to as DBKK); enterprises, cooperatives (hereinafter referred to as HTX), cooperative unions, economic and social organizations operating in the areas of particularly difficult communes and villages; public service units operating in the field of ethnic affairs within and outside the list of communes, villages, and hamlets in ethnic minority and mountainous areas according to current regulations, prioritizing areas with extremely difficult socio-economic conditions and relevant agencies, organizations, and individuals participating in implementing the Program.

Article 2. Interpretation of Terms

In this Circular, the following terms are understood as follows:

1. An ethnic minority household is a household where the head of the household or the spouse of the head of the household is an ethnic minority person as provided by law.

2. Poor and near-poor households are determined based on the multidimensional poverty standard for the period 2022-2025 as stipulated in Decree No. 07/2021/NĐ-CP dated January 27, 2021 of the Government.

3. Natural disasters are defined in point a, Clause 1, Article 1 of Law No. 60/2020/QH14 on Amending and Supplementing Certain Provisions of the Law on Prevention and Control of Natural Disasters and the Law on Dikes.

4. Leaky and dilapidated houses are types of temporary and leaky houses as prescribed by the Ministry of Construction regarding guidelines for implementing the criteria for rural housing.

5. Production land is agricultural land as stipulated in Clause 2, Article 9 of the Land Law No. 31/2024/QH15 dated January 18, 2024 of the National Assembly.

6. A household lacking production land is a household lacking more than 50% of the production land area according to the local standard.

7. Domestic water supply as defined in Article 2 of the Law on Water Resources No. 28/2023/QH15 dated November 27, 2023 of the National Assembly.

8. Sanitary domestic water supply is colorless, odorless, tasteless water that does not contain components that may affect human health, and can be used for drinking after boiling.

9. Particularly difficult areas include particularly difficult communes and hamlets within ethnic minority and mountainous regions.

10. Stable resettlement of residents through centralized relocation: refers to the arrangement of households and individuals to centralized resettlement points to form new residential areas.

11. Stable resettlement of residents through interlaced resettlement: refers to the arrangement of households and individuals to interlace with existing residential points.

12. Stable resettlement of residents through in-place stabilization: refers to the implementation of stable arrangements for households and individuals at their original place of residence through support for investment in infrastructure construction and production.

13. Entrepreneurship and business start-up models in ethnic minority and mountainous regions are understood as production and business projects aimed at providing new products or services, or improving existing products to meet market demands, create jobs and income, implemented in ethnic minority and mountainous regions.

14. Support for building entrepreneurship and business start-up models in ethnic minority and mountainous regions: Refers to the provision of partial funding for implementing these models and maintaining support over phases from 1 to 5 years in various forms such as information provision, personal and organizational support for model leaders to participate in activities of the business start-up and entrepreneurship ecosystem in ethnic minority and mountainous regions.

15. The business start-up and entrepreneurship ecosystem in ethnic minority and mountainous regions is a network of partners with the common goal of promoting business start-ups and entrepreneurship in ethnic minority and mountainous regions, including: Business start-up and entrepreneurship support centers and investment attraction centers in ethnic minority and mountainous regions at universities; trade and tourism connection centers and product promotion centers in ethnic minority and mountainous regions in provinces such as Quang Ninh, Lao Cai, Lam Dong; state management agencies and mass organizations responsible for supporting entrepreneurship and business start-ups in ethnic minority and mountainous regions at the local level; business incubation consultants; commercial enterprises and enterprises leading value chain linkages in ethnic minority and mountainous regions; electronic information markets attracting investment and consuming products from ethnic minority business start-up and business start-up projects nationwide (Project 10 under the Program); national innovation and entrepreneurship ecosystem partners participating until 2025 (Decision No. 844/QĐ-TTg dated May 18, 2016 of the Prime Minister approving the Project "Supporting the National Innovation and Entrepreneurship Ecosystem until 2025") operating in ethnic minority and mountainous regions.

16. Newly established enterprises and cooperatives conducting activities and employing labor in particularly difficult communes in ethnic minority and mountainous regions are enterprises and cooperatives established from the effective date of Decision No. 1719/QĐ-TTg, engaging in business and production activities and employing labor in particularly difficult communes in ethnic minority and mountainous regions.

Article 3. Principles of Implementation

1. Comply with the provisions of Article 4 of Decree No. 27/2022/NĐ-CP dated April 19, 2022 of the Government stipulating the management mechanism and organization of implementation of national target programs (hereinafter referred to as Decree No. 27/2022/NĐ-CP).

2. Transparency, democracy from the grassroots level, correct targeting, correct standards, no overlap. Ensuring the participation and supervision of the people during the assessment and implementation of project support contents.

3. Prioritize: ethnic groups still facing many difficulties, with special difficulties; female ethnic minorities; affected individuals due to natural disasters in the locality.

4. Diversify and integrate resources for the implementation of the Program. Strengthen coordination between the state, organizations, households, and individuals related to the Program. Allocate resources for support and investment in a coordinated manner to achieve the Program's goals.

5. Focus on implementing key investment projects, put them into use early and maximize their effectiveness; do not approve and implement scattered and short-term effective investment projects; avoid accumulating construction debts.

6. Respect cultural values, traditional knowledge, community institutions; ensure market factors, gender equality, reduce disaster risks, and adapt to climate change.

7. Investment and support standards for implementing Projects, Sub-projects, and Components of the Program shall be carried out in accordance with the regulations of the competent authority.

Chapter II

GUIDELINES FOR IMPLEMENTING PROJECT 1: RESOLVING THE SHORTAGE OF HOUSING LAND, DWELLINGS, PRODUCTION LAND, AND DOMESTIC WATER SUPPLY

Section 1 SUPPORT FOR RESIDENTIAL LAND

Article 4. Recipients

1. Poor households of ethnic minorities living in areas inhabited by ethnic minority groups and mountainous regions; poor Han households living in communes and villages within areas inhabited by ethnic minority groups and mountainous regions that do not have residential land.

2. Households that have already received support for residential land from previous programs and policies but have since transferred, given, or gifted such land shall not be supported again.

Article 5. Content of Support and Implementation Methods

1. Based on the land fund, residential land allocation quota, and budget capacity of each locality, the People's Committee of the province/city directly under the central government (hereinafter referred to as the Provincial People's Committee) shall issue specific regulations as the basis for allocating residential land for housing construction for households eligible to benefit from the policy, ensuring compatibility with local conditions and customs, and compliance with land laws. The allocation of residential land must be tied to plans for constructing houses on the allocated land area, avoiding situations where households are allocated residential land but do not have houses.

2. Implementation method

a) In places with favorable land conditions, local authorities shall use state budget funds to create flat surfaces and develop technical infrastructure to allocate residential land to beneficiaries;

b) In localities without favorable land conditions, local authorities shall allocate funds to support residents in stabilizing their residences through intermingled arrangements or self-transfer of land use rights. The People's Committee of the commune, ward, or special economic zone (hereinafter referred to as the Commune People's Committee) shall inspect, determine specifically, and compile lists to submit to the Provincial People's Committee for approval of support, while guiding eligible households to implement the transfer of land use rights in accordance with land laws.

3. Level of Support and Support Mechanism

a) The level of support from the state budget is stipulated in Clause 1, Article 3 and Clause 1, Article 4 of Decision No. 04/2023/QĐ-TTg dated February 23, 2023 of the Government Chairman regarding the level of support using public investment capital to implement certain contents of Project 1 and Sub-project 1, Project 4 of the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030; Phase I: from 2021 to 2025 (hereinafter referred to as Decision No. 04/2023/QĐ-TTg);

b) Support mechanism: applying special mechanisms for supporting investment for policy recipients within the scope of the national target program stipulated in Clause 5, Article 1 of Decree No. 38/2023/NĐ-CP dated June 24, 2023 of the Government amending and supplementing some articles of Decree No. 27/2022/NĐ-CP (hereinafter referred to as Decree No. 38/2023/NĐ-CP); Supporting credit loans according to Articles 8, 9, 10, 11, 12, and 13 of Decree No. 28/2022/NĐ-CP dated April 26, 2022 of the Government on preferential credit policies to implement the National Target Program on Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030; Phase I: from 2021 to 2025 (hereinafter referred to as Decree No. 28/2022/NĐ-CP).

4. The Commune People's Committee shall allocate local budgets and issue certificates of land use rights for households receiving residential land support in accordance with regulations.

Section 2

SUPPORT FOR HOUSING

Article 6. Objectives

1. Poor households of ethnic minorities living in areas inhabited by ethnic minority groups; poor Kinh households living in communes and villages of ethnic minority groups without housing or with dilapidated and damaged houses.

2. Households supported with residential land shall be concurrently considered for housing support.

Article 7. Content of Support and Implementation Methods

1. Investment support to construct a new house according to local customs and traditions, meeting the quality requirements for housing as stipulated in Article 4 of Circular No. 01/2022/TT-BXD dated June 30, 2022, issued by the Minister of Construction guiding the provision of housing support for poor and near-poor households in poor districts under the National Target Program on Sustainable Poverty Reduction for the period 2021-2025 (hereinafter referred to as Circular No. 01/2022/TT-BXD). The level of support from the state budget is specified in Clause 2, Article 3 and Clause 2, Article 4 of Decision No. 04/2023/QĐ-TTg; special support mechanisms apply to investment support for policy beneficiaries as provided in Clause 5, Article 1 of Decree No. 38/2023/NĐ-CP.

2. Loan support for constructing or repairing and improving existing housing to meet the quality requirements for housing as stipulated in Article 4 of Circular No. 01/2022/TT-BXD. The content of loan support for housing is regulated in Articles 14, 15, 16, 17, 18, and 19 of Decree No. 28/2022/NĐ-CP.

3. Depending on the actual situation of each locality, based on the wishes of the beneficiaries, the People's Committee of the commune guides households to organize the construction of new housing using state budget support funds, credit funds from the Social Policy Bank, and other lawful sources (if any); guides households to organize the repair and improvement of existing housing using credit funds from the Social Policy Bank and other lawful sources (if any). In cases where people cannot build new or repair and improve their housing, the People's Committee of the commune directs and guides social organizations to assist the beneficiaries in building new or repairing and improving their housing to meet the quality requirements for housing as stipulated.

Section 3

SUPPORT FOR AGRICULTURAL PRODUCTION LAND

Article 8. Objectives

1. Poor households of ethnic minorities living in areas inhabited by ethnic minority groups; poor Kinh households living in communes and villages of ethnic minority groups engaged in agriculture, forestry, and fisheries without agricultural production land and having a need for direct support with agricultural production land.

2. Poor households of ethnic minorities living in areas inhabited by ethnic minority groups; poor Kinh households living in communes and villages of ethnic minority groups engaged in agriculture, forestry, and fisheries lacking more than 50% of the agricultural production land according to the prescribed standards of each locality, and having a need to change occupations or support for agricultural production land but unable to be allocated such land, shall be considered for support to change occupations.

The provincial People's Committee bases its regulations on the land fund and actual conditions of the locality to set the standard for agricultural production land, but it shall not exceed the maximum limit for allocating agricultural land to each household and individual as prescribed by the laws on land, serving as the basis for identifying households lacking agricultural production land.

Article 9. Content of support and methods of implementation

1. Direct support with production land

a) In cases where localities still have land funds capable of production without needing to implement land clearance, restoration, or improvement, the People's Committee at the commune level shall base on the land planning and land use plans that have been approved by competent state authorities to allocate production land to households belonging to the target beneficiaries who do not yet have production land, in accordance with the laws on land.

b) In cases where localities still have production land but need to clear, restore, or improve the land to make it capable of production, the People's Committee at the commune level shall direct the organization to establish and implement land clearance, restoration, and improvement projects according to the land planning and land use plans that have been approved by competent state authorities to allocate production land to households belonging to the target beneficiaries who do not yet have production land, in accordance with the laws on land. The level of support from the central budget for implementing land clearance, restoration, and improvement projects is specified in Clause 3, Article 3 of Decision No. 04/2023/QĐ-TTg.

c) Households eligible for direct support with production land under Clause 1, Article 8 of this Circular, if local authorities cannot allocate production land and they have a need to borrow capital to create a fund for production land, may be considered for borrowing credit from the Social Policy Bank in accordance with Articles 20, 21, 22, 23, 24, and 25 of Decree No. 28/2022/NĐ-CP, and shall not be supported for occupational conversion.

d) The People's Committee at the commune level shall allocate local budgets and issue certificates of land use rights for households receiving production land support in accordance with the regulations.

2. Support for occupational conversion

a) Households eligible under Clause 2, Article 8 of this Circular may be considered for support in purchasing agricultural tools and machinery, providing agricultural production services, converting to planting, animal husbandry, other production and business activities, or supporting vocational training for occupational conversion, and may borrow credit in accordance with Articles 20, 21, 22, 23, 24, and 25 of Decree No. 28/2022/NĐ-CP.

b) Based on the list of households receiving occupational conversion support that has been approved by competent authorities, and the list of households registering support methods (in cash, in kind, or vocational training), the People's Committee at the commune level shall compile the needs and classify them according to each method of implementation, then submit to the Ethnic and Religious Affairs Agency at the provincial level, which will coordinate with the Department of Finance to aggregate and report to the People's Committee at the provincial level to decide the level of support for each household (each household can only receive support once).

In cases where households receive support in cash, the People's Committee at the commune level shall guide households to purchase agricultural tools and machinery, provide agricultural production services, undergo vocational training, and convert to planting, animal husbandry, or other production and business activities according to their registered needs and implement settlement procedures in accordance with regulations. In cases where households register to receive support in kind, the People's Committee at the provincial level shall, based on needs, direct specialized agencies or the People's Committee at the commune level to organize purchases in accordance with the law and distribute to households. In cases where households register for vocational training, the People's Committee at the commune level shall aggregate and coordinate with training institutions to provide vocational training for households in accordance with regulations.

Section 4

SUPPORT FOR DRINKING WATER

Article 10. Objectives

1. Dispersed domestic water supply support: Ethnic minority households living in areas with ethnic minority and mountainous people groups that are poor; poor Han households living in communes and villages within areas with ethnic minority and mountainous people groups facing difficulties in accessing clean water.

2. Centralized domestic water supply support: Areas where ethnic minorities live in communities (hamlets, villages, towns within regions with ethnic minority and mountainous people groups) without access to hygienic water sources suitable for centralized water supply projects, and areas not yet invested in centralized water supply facilities shall be considered for investment support. In cases where water supply facilities have been supported under other programs and policies but are now severely damaged and unusable, they will be considered for investment.

Article 11. Content of Support and Implementation Methods

1. Dispersed Domestic Water Supply Support

a) Households specified in Clause 1, Article 10 of this Circular shall be considered for support to create water sources for daily use or purchase water storage containers.

b) The method of dispersed domestic water supply support shall be flexible, adapted to the actual conditions of each village and commune and the living conditions of each household, such as digging wells, purchasing water conveyance and storage equipment (buckets, tanks, reservoirs, water containers; self-made water reservoirs), or creating alternative water sources ensuring that households receiving financial support have stable domestic water supply and are conveniently located for family use.

c) Depending on the actual situation of each locality, based on the wishes of beneficiaries, support can be provided in groups to build shared facilities, with group members voluntarily committing to maintaining and operating the facilities to ensure a stable water source. The number of group members is determined through discussion and agreement among the residents.

2. Centralized Domestic Water Supply Support

Households specified in Clause 2, Article 10 of this Circular shall be supported to invest in building centralized domestic water supply facilities according to current regulations to ensure hygienic water supply for residents. The People's Committee at the provincial level shall direct the People's Committee at the commune level to conduct detailed reviews and prepare files for submission to the competent authority for approval. Localities shall proactively allocate funds for maintenance and operation when the facilities are put into use.

Section 5

IMPLEMENTATION OF PROJECT 1

Article 12. Organization and Implementation

The Provincial People's Committee directly or through delegation shall guide and organize implementation:

1. Establish procedures for reviewing beneficiaries; define priority beneficiaries; review, establish, and approve lists of beneficiaries and projects as the basis for organizing implementation according to regulations.

2. Determine capital requirements and develop implementation plans by phase and annually.

3. Specify management, payment, and settlement procedures according to special mechanisms for supporting investments for policy beneficiaries under the National Target Program as stipulated in Clause 5, Article 1 of Decree No. 38/2023/NĐ-CP of the Government; Circular No. 55/2023/TT-BTC dated August 15, 2023 of the Ministry of Finance on managing, using, and settling state budget funds for implementing national target programs from 2021 to 2025 (hereinafter referred to as Circular No. 55/2023/TT-BTC).

4. Allocate funds for organizing reviews, guiding implementation, and inspecting execution at local levels.

Chapter III

GUIDELINES FOR IMPLEMENTATION OF PROJECT 2: PLANNING, ARRANGEMENT, AND STABILIZATION OF POPULATION IN NECESSARY AREAS

Article 13. Object

The object of the project is specified in point b, Clause 2, Section II of the Program issued together with Decision No. 920/QĐ-TTg.

Article 14. Principles of Implementation

1. Ensure the provisions set forth in Article 3 of this Circular.

2. Population resettlement must be consistent with planning at various levels as prescribed by laws on planning, land, construction, and related plans.

3. Projects for population resettlement and stabilization must ensure the correct target groups and areas; priority should be given to areas frequently affected by natural disasters or at high risk of such events.

4. Prioritize population resettlement through interwoven resettlement, combined with centralized resettlement and in-place stabilization.

5. Population resettlement and stabilization are both objectives and solutions for economic, cultural, and social development; ensuring national defense, security, and ecological environment.

6. Population resettlement and stabilization must focus on key points, ensuring essential infrastructure and production development so that residents can have stable long-term living conditions in their new locations.

7. Population resettlement and stabilization should aim to form residential clusters meeting new rural area standards, building people's national defense and public security systems; aligning with customs, traditions, and culture of each ethnic group.

Article 15. Content of Support

1. Support for surveying positions and locations for planning work, project establishment, review, and approval of investment projects for population resettlement.

2. Investment support for infrastructure construction

a) Compensation, clearance, and leveling of land for residential relocation sites;

b) Opening up land for agricultural production;

c) Investment in construction: internal roads within the project area and connecting roads from new residential clusters to the nearest transportation routes; small water conservancy works, power supply, drinking water, and other essential facilities according to actual needs of the locality.

3. Direct support to households

a) Housing and production land support (for cases requiring change of residence):

Households subject to population resettlement and stabilization who are poor will receive housing support according to the level specified in Project 1; if not poor, they will receive support equivalent to 50% of the level specified in Project 1. Households subject to population resettlement and stabilization will receive production land support according to the level specified in Project 1 under the Program.

b) Funding support for moving households from old residences to new relocation sites, implemented in accordance with Clause 1, Article 7 of Circular No. 55/2023/TT-BTC.

Implement current support policies for households relocated to ensure stable livelihoods and production over the long term.

4. Support for interwoven resettlement areas

Implemented in accordance with point c, Clause 2, Section III of the Program issued together with Decision No. 920/QĐ-TTg and Article 8 of Circular No. 55/2023/TT-BTC.

Article 16. Organization and Implementation

The Provincial People's Committee shall direct, guide, and organize implementation:

1. Establish procedures for reviewing target groups; organize reviews, determine, and approve target groups; select forms of population resettlement (concentrated, interwoven, or in-place stabilization) in compliance with regulations and local realities.

2. Establish, review, approve, and implement investment projects for population resettlement and stabilization in accordance with regulations.

Chapter IV

GUIDANCE FOR CONTENT NUMBER 01 AND CONTENT NUMBER 03 OF SUBPROJECT 2 OF PROJECT 3

Section 1

CONTENT NUMBER 01: SUPPORT FOR PRODUCTION DEVELOPMENT ALONG VALUE CHAINS

Article 17. Principles of Implementation

1. Support for developing production along value chains must comply with the principles stipulated in Clause 11, Article 1 of Decree No. 38/2022/NĐ-CP and Article 3 of this Circular.

2. Focus on building stable raw material areas, supporting the application of synchronized technology and quality management, enhancing initial processing, manufacturing capabilities, and market development; consolidate, expand, upgrade value chain linkages tied to current product consumption while establishing new production linkage models according to value chains.

3. Provide focused support; prioritize support for developing production of specialty products, unique products, those with comparative advantages, high economic value, significant importance for poverty reduction, sustainable development, ecological environment protection, adaptation to climate change, disaster risk management, promoting gender equality, and production linked to national defense and security consolidation.

4. The support cycle must be long enough to ensure stability, effectiveness, sustained maintenance, and replicability of the model or project, but the support period shall not exceed five years and shall not exceed the implementation duration of Phase I of the Program.

Article 18. Support for Developing Production Linked to Value Chains

1. Objectives and Areas: Implemented according to the provisions at Item b, Clause 2, Section II of the Program issued together with Decision No. 920/QĐ-TTg.

2. Content and Mechanism: Implemented according to the provisions at Item b, Clause 2, Section II of the Program issued together with Decision No. 920/QĐ-TTg and the provisions at Clause 12, Article 1 of Decree No. 38/2023/NĐ-CP.

Article 19. Support for Community-Based Production Development

1. Objectives and Areas

a) Projects must meet the requirements regarding the participation rate of beneficiaries under the Program as stipulated in Clause 11, Article 1 of Decree No. 38/2023/NĐ-CP. Priority is given to extremely poor households headed by ethnic minorities; extremely poor households headed by women who are the sole breadwinners directly caring for family members unable to work or below working age. Priority is also given to projects initiated by groups or cooperatives where at least 50% of households are extremely poor or near-poor living in communes in Region II, Region III, or particularly difficult-to-develop villages.

b) Implementation areas include extremely difficult-to-develop communes and villages within regions inhabited by ethnic minority and mountainous people.

2. Content and Mechanism: Implemented according to the provisions at Item b, Clause 2, Section II of the Program issued together with Decision No. 920/QĐ-TTg and the provisions at Clause 13, Article 1 of Decree No. 38/2023/NĐ-CP.

Article 20. Support for Developing Production Linked to Value Chains and Community-Based Production Development Organized by Ministries and Central Agencies

Activities supporting the development of production linked to value chains and community-based production development using state budget funds allocated to ministries and central agencies under the Program (for implementing model demonstrations, pilot models, activities according to plans and tasks assigned to ministries and central agencies within the Program) shall be carried out in accordance with the general provisions at Clauses 12 and 13, Article 1 of Decree No. 38/2023/NĐ-CP and specific regulations issued by ministries and central agencies within their authority.

Article 21. Support for production development according to tasks and special support for production development

Activities supporting production development according to tasks and special support for production development shall be implemented in accordance with the general provisions stipulated in Clause 14, Article 1 of Decree No. 38/2023/NĐ-CP, Article 24 of Decree No. 27/2022/NĐ-CP, and specific regulations issued by the Ministry of Ethnic Affairs and Religion, relevant ministries, central agencies, and provincial People's Committees within their respective jurisdictions.

Article 22. Allocation, management, and settlement of state budget funds

1. Allocation of state budget funds

The allocation of capital for implementing activities to support production development shall comply with the principles, criteria, and allocation standards for state budget funds established by the Prime Minister and specific regulations of the Provincial People's Councils.

2. Mobilization and integration of other sources of capital

a) Based on specific conditions, localities shall proactively mobilize and integrate various sources of capital to maximize the effectiveness of fund utilization.

b) Encouragement is given to enterprises, organizations, and individuals to participate in investment, support, and legal funding for the implementation of production support activities under the Program.

3. Credit policy loan capital

Implementation shall follow the provisions set out in Chapter VI of Decree No. 28/2022/NĐ-CP.

4. Management and settlement of state budget funds for implementing activities to support production development shall comply with the regulations of the Ministry of Finance.

Article 23. Organization and Implementation

1. The provincial People's Committee shall assign the Provincial Project Management Agency as the lead agency to coordinate with departments and sectors to provide advisory services, guidance, and organize the implementation of Content Item 01 under Sub-project 2 of Project 3 at the local level.

2. Ministries, sectors, and localities shall implement investment and support for production development in accordance with the assigned functions and responsibilities, achieving the goals and targets set forth in the Program.

Section 2

CONTENT ITEM 03: PROMOTING BUSINESS START-UP AND ENTREPRENEURSHIP AND ATTRACTION OF INVESTMENT IN AREAS WITH ETHNIC MINORITY POPULATIONS AND MOUNTAINOUS REGIONS

Article 24. Target Groups

1. Enterprises and cooperatives currently operating in ethnic minority concentrated communes in mountainous regions that plan to expand business and production.

2. Newly established enterprises and cooperatives conducting activities and employing labor in ethnic minority concentrated communes in mountainous regions.

3. Universities with a large number of ethnic minority students enrolled and engaging in activities to support student entrepreneurship and business start-ups in ethnic minority concentrated communes in mountainous regions.

4. Households and individuals from ethnic minorities, poor households of the Kinh ethnicity residing in ethnic minority concentrated communes and villages in mountainous regions.

Article 25. Principles of Implementation

In addition to the principles stipulated in Article 3 of this Circular, the implementation of content promoting business start-up, entrepreneurship, and investment attraction in areas with ethnic minority populations must ensure the following principles:

1. Each ethnic minority concentrated commune shall have at least one business start-up or entrepreneurship model supported. The supported model must create employment and have purchase contracts for products from at least 15 households in the third-tier area of the commune.

2. Priority shall be given to supporting business start-up and entrepreneurship models led by women or having at least 50% female workers participating in the model, and projects developing production along value chains supported by Program funds.

3. Each selected business start-up or entrepreneurship model will receive phased support not exceeding three years in the form of partial funding for implementing the model, information provision support, connection support for individuals or organizations leading the model to participate in activities of the ecosystem promoting business start-up and entrepreneurship in areas with ethnic minority populations, integration of resources to support sustainable development and expansion of the entrepreneurship and business start-up model, and enhance the effectiveness of Program investments.

Article 26. Content of Implementation and Support Standards

The contents and support standards for promoting business start-ups, entrepreneurship, and attracting investment in areas with ethnic minority communities shall be implemented in accordance with the provisions set forth in Article 14 of Circular No. 55/2023/TT-BTC.

Article 27. Procedures for Establishing and Approving Plans to Promote Business Start-ups, Entrepreneurship, and Attract Investment at Local Levels

1. The People's Committee of the province shall assign a subordinate agency to take the lead in promoting business start-ups, entrepreneurship, and attracting investment (hereinafter referred to as the Provincial Agency Leading Entrepreneurship), which shall coordinate with relevant departments and agencies to guide the People's Committees of communes in determining needs and developing annual and phased plans to promote business start-ups, entrepreneurship, and attracting investment, to be submitted to the People's Committee of the province for approval.

2. Based on the capital allocation decision made by the competent authority, the agencies assigned to implement the plans to promote business start-ups, entrepreneurship, and attract investment shall develop such plans according to the procedures stipulated in Clause 3 and Clause 4 of Article 1 of Decree No. 38/2023/NĐ-CP.

3. Procedures for Approving Plans to Promote Business Start-ups, Entrepreneurship, and Attract Investment

a) The People's Committee of the commune shall develop support plans for models promoting business start-ups and entrepreneurship, and submit them to the Provincial Agency Leading Entrepreneurship for consolidation; the Provincial Agency Leading Entrepreneurship shall take the lead and coordinate with relevant departments and agencies to review, determine the list, and develop support plans for commune-level models to be submitted to the People's Committee of the province for approval as the basis for implementation;

b) Relevant departments and agencies, and the People's Committee of the commune shall develop support plans for activities attracting investment, and submit them to the Provincial Agency Leading Entrepreneurship for consolidation and submission to the People's Committee of the province for approval.

Article 28. Procedures for Establishing and Approving Plans to Support the Operation of Business Start-up and Entrepreneurship Support Centers in Ethnic Minority Areas at Universities

1. Announcing and Receiving Proposals for Business Start-up and Entrepreneurship Support Center Projects in Ethnic Minority Areas at Universities

a) The Ministry of Ethnic Affairs and Religion shall take the lead and coordinate with the Ministry of Education and Training and the People's Committee of the province where universities with a high number of ethnic minority students are located to issue notifications regarding the registration of support project requirements for Business Start-up and Entrepreneurship Support Centers in ethnic minority areas;

b) The National Office for Ethnic Minorities and Mountainous Regions shall serve as the focal point for receiving and consolidating lists of Business Start-up and Entrepreneurship Support Center projects in ethnic minority areas.

2. Selecting and Approving Plans to Support Business Start-up and Entrepreneurship Support Center Projects in Ethnic Minority Areas at Universities

The National Office for Ethnic Minorities and Mountainous Regions shall take the lead in advising on the establishment of a Selection Committee for Business Start-up and Entrepreneurship Support Center projects in ethnic minority areas as the basis for submitting a list of approved projects to the Minister of Ethnic Affairs and Religion for approval to organize implementation.

3. Implementing the Operation of Business Start-up and Entrepreneurship Support Center Projects in Ethnic Minority Areas at Universities

Based on the list of selected Business Start-up and Entrepreneurship Support Center projects in ethnic minority areas at universities, the National Office for Ethnic Minorities and Mountainous Regions shall enter into contracts with universities to implement the projects according to the plan for both the phase and annually.

Article 29. Support for the construction and pilot operation of projects titled "Trade and Tourism Connection Centers for Promoting Ethnic Minorities' Products" in the provinces of Quang Ninh, Lao Cai, and Lam Dong.

The provincial People's Committee shall develop and approve project proposals, allocate funds from local budgets or counterpart funds from local budgets to integrate resources, mobilize participation and collaboration from organizations and individuals with capacity to implement pilot projects titled "Trade and Tourism Connection Centers for Promoting Ethnic Minorities' Products" at the local level.

Chapter V

IMPLEMENTATION GUIDELINES FOR CONTENT NUMBER 01 OF SUBPROJECT 1 AND SUBPROJECT 2 (EXCEPT TASKS MANAGED AND IMPLEMENTED BY THE MINISTRY OF EDUCATION AND TRAINING AND THE PEOPLE'S COMMITTEE OF TUYEN QUANG PROVINCE) OF PROJECT 4

Section 1

CONTENT NUMBER 01 OF SUBPROJECT 1: INVESTMENT IN CRUCIAL INFRASTRUCTURE IN ETHNIC MINORITY AREAS; PRIORITY GIVEN TO REMOTE AND HARD-TO-REACH COMMUNITIES

Article 30. Target Groups

1. Remote and hard-to-reach communes and villages (communes in category III, remote and hard-to-reach villages), ATK communes in categories I and II (communes not yet recognized by competent authorities as meeting new rural standards, communes not yet recognized as completing the objectives of Program 135).

2. Communes and villages in ethnic minority areas (for the content of investment in constructing roads to commune centers and inter-commune roads).

Article 31. Implementation Content

As stipulated in point a, Clause 3, Section II of the Program issued together with Decision No. 920/QD-TTg.

Article 32. Principles of Implementation

In addition to the principles prescribed in Article 3 of this Circular, the implementation of infrastructure investment in ethnic minority areas must ensure the following principles:

1. All communes and villages eligible for investment must be allocated funds from subprojects.

2. Funding for special projects must be allocated according to the approval of the competent authority.

3. Projects funded by the Program must have signs indicating the following information: Name of the project; Source of funding: National Target Program on Socio-Economic Development in Ethnic Minority Areas for the period 2021-2030; Project sponsor; Construction unit; Total investment capital; Scale of the project; Date of commencement; Date of completion.

Article 33. Mechanism for Infrastructure Investment

1. Based on the degree of priority and the actual situation of the locality, the provincial People's Committee will concentrate development funds to start new projects that the people urgently need in remote and hard-to-reach communes and villages in rotation, but must ensure that the investment does not exceed the total development investment budget allocated to the commune or village for the phase.

2. For projects applying a special management mechanism for investment and construction (hereinafter referred to as the special mechanism), the implementation process shall follow the provisions of Clause 8, Clause 9, and Clause 10 of Article 1 of Decree No. 38/2023/NĐ-CP, Chapter IV of Decree No. 27/2022/NĐ-CP, and specific regulations of the provincial People's Committee.

3. For projects not applying a special mechanism, the implementation process shall follow current regulations on investment and construction management and related regulations.

Article 34. Maintenance, Repair, Management, and Operation of Projects

1. Public works serving communal interests within the commune or village (including those not funded by the Subproject) managed by the commune People's Committee may use maintenance and repair support funds from the Subproject for their implementation; funds from the Subproject shall not be used for the maintenance and repair of works handed over to households or groups of households for management and use.

2. Maintenance and repair support funds can only be used for minor repairs, regular maintenance, and upkeep to maintain normal operation of the works; they cannot be used for new construction, upgrading, or major repairs of works.

3. The commune People's Committee is the investor for maintenance and repair funds.

a) Annually, based on the maintenance and repair procedures issued by the provincial People's Committee and the current status of works in the commune, the commune People's Committee shall prepare a list of works and components requiring maintenance and repair; announce and organize public discussions on the maintenance and repair plan to the people and community; organize the preparation, review, and approval of maintenance and repair funds for each work, complete the maintenance and repair plan for the commune, submit it to the Commune People's Council for approval, and simultaneously send it to the specialized agency under the provincial People's Committee for consolidation; prioritize maintenance and repair for essential works in remote and hard-to-reach communes and villages;

b) Based on the decision allocating maintenance and repair funds by the provincial People's Committee and the resolution of the Commune People's Council, the commune People's Committee shall assign community organizations, teams, or groups in the commune to undertake the maintenance and repair of works managed by the village, or organize households in the village to carry out maintenance and repair; if community organizations, teams, groups, or households in the village lack the conditions and ability to undertake the work, the commune People's Committee shall enter into contracts with organizations or individuals capable of carrying out maintenance and repair;

c) On the basis of current State regulations and the provisions of this Circular, the provincial People's Committee shall issue guidelines for the management, operation, and maintenance and repair of works.

Section 2

SUBPROJECT 2: INVESTMENT IN MATERIAL INFRASTRUCTURE FOR PUBLICLY ESTABLISHED ORGANIZATIONS OPERATING IN THE FIELD OF NATIONALITY AFFAIRS

Article 35. Object

Public service units operating in the ethnic affairs sector include: The Central Ethnic University Preparatory School, Sam Son Ethnic University Preparatory School, Nha Trang Central Ethnic University Preparatory School, Ho Chi Minh City University Preparatory School, Friendship School T78, Friendship School 80, Northern Highlands General Secondary School, Northwest University, Central Highlands University, Tan Trao University.

Article 36. Content Implementation

Investment in constructing facilities for teaching and living activities for teachers and students (dormitory buildings, administrative office buildings, student health stations, laboratory buildings, comprehensive library buildings, multi-purpose buildings, lecture halls, residential buildings for boarding teachers, sports fields, swimming pools, sports facilities, teacher offices, dining halls, kitchens, dormitory management rooms, sanitation facilities, communal activity houses, cultural education houses for ethnic minorities; renovation and upgrading of infrastructure systems); purchasing equipment to support teaching and learning activities (equipment and tools for digital transformation and application of information technology in teaching and learning, practical and experimental equipment; computer systems, projectors; equipment for teaching computer science, foreign languages, medicine, pharmacy; physical education teaching tools and other equipment for teaching and learning activities); equipment for the daily life of boarding students, administrative services, meeting rooms, teacher waiting rooms, dining halls, kitchens, multi-purpose buildings, and other equipment for management, teaching, learning, and living activities as prescribed.

Article 37. Organization and Implementation

The Ministry of Ethnic Affairs and Religion is the supervising agency for investment and procurement of equipment for the following schools: The Central Ethnic University Preparatory School, Sam Son Ethnic University Preparatory School, Nha Trang Central Ethnic University Preparatory School, Ho Chi Minh City University Preparatory School, Northern Highlands General Secondary School. Project planning, procurement, review, approval, budget allocation, implementation organization, final settlement, and handover of projects for operation must comply with legal regulations.

Chapter VI

GUIDANCE FOR THE IMPLEMENTATION OF SUB-PROJECT 2 AND SUB-PROJECT 4 OF PROJECT 5

Section 1

SUB-PROJECT 2: ETHNIC KNOWLEDGE ENHANCEMENT; PREPARATORY UNIVERSITY, UNIVERSITY, AND POSTGRADUATE TRAINING TO MEET THE NEEDS OF HUMAN RESOURCES IN ETHNIC MINORITY AREAS AND MOUNTAINOUS REGIONS

Section 1 CONTENT NUMBER 01: ETHNIC KNOWLEDGE ENHANCEMENT

Article 38. Object

The object of ethnic knowledge enhancement is defined in Content Number 01, Point b, Clause 4, Section II of the Program issued together with Decision No. 920/QD-TTg.

Article 39. Principles of Enhancement

In addition to the principles stipulated in Article 3 of this Circular, the implementation of ethnic knowledge enhancement must also ensure the following principles:

1. Ethnic knowledge enhancement shall be carried out in accordance with the provisions of Government Decree No. 101/2017/NĐ-CP dated September 1, 2017 on training and enhancing cadres, civil servants, and public officials, and Government Decree No. 89/2021/NĐ-CP dated October 18, 2021 amending and supplementing certain articles of Government Decree No. 101/2017/NĐ-CP; Circular No. 03/2023/TT-BNV dated April 30, 2023 of the Minister of Home Affairs guiding certain provisions of Government Decree No. 101/2017/NĐ-CP dated September 1, 2017 on training and enhancing cadres, civil servants, and public officials, and Government Decree No. 89/2021/NĐ-CP dated October 18, 2021 amending and supplementing certain articles of Government Decree No. 101/2017/NĐ-CP of the Government on training and enhancing cadres, civil servants, and public officials (hereinafter referred to as Circular No. 03/2023/TT-BNV) and guidance provided in this Circular.

2. Ethnic knowledge enhancement must ensure the improvement of capabilities and knowledge about ethnic affairs, ethnic policies, and ethnic culture for cadres, civil servants, and public officials; armed forces; cadres, civil servants, and public officials who directly interact and work with ethnic minority communities.

3. Ethnic knowledge enhancement should be linked to the work of using and managing cadres, civil servants, public officials, and armed forces in accordance with the training plan and the need to build and develop human resources for each ministry, sector, and locality.

Article 40. Training Program and Forms of Training

1. The form of training shall be implemented in accordance with the provisions of Decision No. 771/QĐ-TTg dated June 26, 2018 of the Prime Minister approving the Project "Training on Ethnic Knowledge for Civil Servants and Public Officials during the period 2018-2025".

2. In cases where the training institution ensures material conditions, it may choose to conduct remote training forms, applying information technology in online training activities for trainees, ensuring the objectives, content, methods, and duration as prescribed.

Article 41. Training Programs, Materials, and Certificates

1. The National Academy of Ethnic Groups shall take the lead and coordinate with relevant agencies and units to draft the program; issue training materials on ethnic knowledge for civil servants and public officials in Group 3 and Group 4 according to Decision No. 771/QĐ-TTg.

2. The Ministry of National Defense and the Ministry of Public Security shall take the lead and coordinate with the Ministry of Ethnic Affairs and Religion to compile and integrate practical knowledge about ethnic affairs into the training programs on national defense and security, aligning with the training plans of their respective sectors and forces.

3. Provincial People's Committees shall concretize the ethnic knowledge training programs and materials suitable to the characteristics of regions and areas for civil servants and public officials in Group 3 and Group 4 at local levels.

4. The content of the programs and materials must ensure a combination of theory and practice; knowledge, experience, and practical skills; integration and embedding of similar training programs; no duplication. The programs and materials must be regularly updated and improved to suit current realities.

Article 42. Organization of Ethnic Knowledge Training

1. The National Academy of Ethnic Groups shall take the lead in organizing training sessions to enhance the capacity of lecturers and speakers participating in ethnic knowledge training and organize ethnic knowledge training for civil servants and public officials in Group 3 and Group 4 when assigned tasks.

2. The Ministry of Home Affairs, the Ministry of Public Security, the Ministry of National Defense, and the Ho Chi Minh National Academy of Politics, within their respective authorities, functions, and responsibilities, shall organize the implementation of ethnic knowledge training as prescribed.

3. Provincial People's Committees shall take the lead in organizing ethnic knowledge training for civil servants and public officials in Group 3 and Group 4 under their management authority.

Article 43. Training Institutions

1. Training institutions providing ethnic knowledge training must comply with the provisions of Decree No. 101/2017/ND-CP dated September 1, 2017 of the Government on training and retraining of civil servants and public officials; Decree No. 89/2021/ND-CP dated October 18, 2021 of the Government amending and supplementing certain articles of Decree No. 101/2017/ND-CP; and Circular No. 03/2023/TT-BNV.

2. Training institutions entrusted with organizing ethnic knowledge training must have at least five years of experience in organizing training for civil servants and public officials or conducting training at the intermediate level or higher in related fields or specialties.

Article 44. Lecturers and Reporters

1. Training institutions must have a core team of lecturers and guest lecturers who meet the requirements for ethnic knowledge training. The criteria for lecturers shall be implemented in accordance with the provisions of Chapter IV of Circular No. 03/2023/TT-BNV.

2. The Ministry of Ethnic Affairs and Religion shall annually organize training sessions to enhance the capabilities of the team of lecturers for ethnic knowledge training.

Article 45. Training in Ethnic Minority Languages

1. The People's Committee of the province shall assign a subordinate agency to take the lead, coordinate with relevant departments, agencies, and specialized bodies to select widely used ethnic minority languages that meet the practical needs of the locality for implementation according to regulations. For ethnic minority languages without writing systems, the assigned leading agency shall coordinate with relevant departments, agencies, and specialized bodies to study and propose training programs to be submitted to the People's Committee of the province for consideration and decision.

2. The content, program, and organization of ethnic minority language training shall be carried out in accordance with Circular No. 09/2023/TT-BGDĐT dated April 18, 2023, issued by the Ministry of Education and Training on the organization of training, enhancement, and issuance of certificates for ethnic minority languages (hereinafter referred to as Circular No. 09/2023/TT-BGDĐT); ethnic minority language training for military forces shall be implemented in accordance with general regulations and those of the Ministry of National Defense and the Ministry of Public Security.

Article 46. Management, Issuance of Certificates for Ethnic Knowledge Enhancement and Ethnic Minority Language Training

1. Management and issuance of certificates for ethnic knowledge enhancement shall be conducted by training and enhancement institutions in accordance with Circular No. 03/2023/TT-BNV.

2. Management and issuance of certificates for ethnic minority language training shall be carried out in accordance with Circular No. 09/2023/TT-BGDĐT.

3. Documents related to training and enhancement under the Program shall be stored at the training and enhancement units and organizations in accordance with laws on archiving and shall be reported as required.

Article 47. Allocation of Funds, Content and Amount of Expenditure

1. Funds for ethnic knowledge enhancement and ethnic minority language training shall be allocated to ministries, sectors, and localities based on their responsibilities and levels of authority for training and enhancement activities.

2. The content and amount of expenditure for ethnic knowledge enhancement and ethnic minority language training shall be implemented in accordance with Clause 1, Article 21 of Circular No. 55/2023/TT-BTC.

Subsection 2

CONTENT NUMBER 02: UNDERGRADUATE AND POSTGRADUATE TRAINING

Article 48. Recipients

1. Undergraduate Training

a) Students studying at higher education institutions who have been admitted after completing a preparatory undergraduate program as specified in point b, Clause 1 of this Article;

b) Students studying at higher education institutions belonging to ethnic minority groups facing many difficulties and having special difficulties as defined in Decision No. 1227/QD-TTg dated July 14, 2021, of the Prime Minister approving the list of ethnic minorities facing many difficulties and having special difficulties during the period from 2021 to 2025 (hereinafter referred to as Decision No. 1227/QD-TTg); and ethnic minority groups with low quality human resources as stipulated in Resolution No. 52/NQ-CP dated June 15, 2016, of the Government on accelerating the development of human resources for ethnic minorities during the period from 2016 to 2020, with a vision to 2030 (hereinafter referred to as Resolution No. 52/NQ-CP).

2. Postgraduate Training

Civil servants and public officials belonging to ethnic minority groups facing many difficulties and having special difficulties as defined in Decision No. 1227/QD-TTg; and ethnic minority groups with low quality human resources as stipulated in Resolution No. 52/NQ-CP, with priority given to civil servants and public officials working in ethnic affairs; female cadres.

Article 49. Principles of Implementation

In addition to the principles stipulated in Article 3 of this Circular, the implementation of preparatory university, university, and postgraduate training programs must adhere to the following principles:

1. Prioritize training and capacity building for ethnic minority groups with low human resource quality; ethnic minority groups still facing many difficulties, including those with special difficulties in communes and villages in Region III; female cadres.

2. The demand and quotas for each university and postgraduate major shall be decided by the Provincial People's Committee based on local requirements, ensuring compliance with the target groups specified in Clause 1 and Clause 2 of Article 47 of this Circular.

3. Recruitment, training, and capacity building activities shall be carried out in accordance with current regulations issued by the Government, the Prime Minister, and guidelines from the Ministry of Home Affairs and the Ministry of Education and Training.

Article 50. Allocation of Funding, Content of Expenditure, and Levels of Expenditure

1. University and postgraduate training funding shall be allocated to provinces and centrally governed cities to implement through the signing of procurement contracts for training with higher education institutions. The selection of the method of signing procurement contracts shall be decided by the Provincial People's Committee upon consideration.

2. The content and levels of expenditure for university and postgraduate training shall be implemented according to the provisions set forth in Clause 2 of Article 21 of Circular No. 55/2023/TT-BTC.

Section 2

SUBPROJECT 4: ENHANCING CAPACITY TRAINING FOR COMMUNITIES AND IMPLEMENTATION STAFF AT ALL LEVELS OF THE PROGRAM

Article 51. Target Groups

The target groups are defined in Point d, Clause 4, Section II of the Program issued together with Decision No. 920/QĐ-TTg.

Article 52. Implementation Content

The implementation content is defined in Point d, Clause 4, Section II of the Program issued together with Decision No. 920/QĐ-TTg.

Article 53. Planning and Implementing Capacity Enhancement Training

1. Developing the Framework Program and Training Materials

a) The Department of Ethnic Minorities and Religion shall develop and promulgate the Framework Program for training and the set of training materials, along with establishing and operating an electronic learning resource repository and an electronic learning management system to fulfill the task of enhancing the capacity of communities and grassroots staff implementing the Program;

b) The Provincial People's Committee shall assign the leading agency of the capacity enhancement subproject at the provincial level (hereinafter referred to as the Provincial Leading Agency for Training) to take the lead and coordinate with relevant departments and localities, based on the Framework Program for training issued by the Department of Ethnic Minorities and Religion, referring to the training and capacity-building materials issued by the Department of Ethnic Minorities and Religion and related ministries and sectors, to formulate plans for organizing and implementing in line with local conditions and actual circumstances, promoting digital transformation and the application of information technology; submit to the Provincial People's Committee for approval or delegate to the heads of relevant departments and agencies under the committee for approval.

2. Planning

a) The Provincial People's Committee shall assign the Provincial Leading Agency for Training to coordinate with the People's Committees at the commune level and relevant agencies to review objectives and tasks, determine specific needs for capacity enhancement that are appropriate for each group of people in different areas;

b) The Provincial Leading Agency for Training shall take the lead and coordinate with relevant departments to review objectives and tasks, determine and compile specific needs for capacity enhancement for provincial-level program managers and the needs of communes; develop training and capacity-building plans to submit to the Provincial People's Committee for approval.

3. Organization of Implementation

a) The Provincial Leading Agency for Training shall submit to the Provincial People's Committee regarding the delegation of the project sponsor in implementing the subproject;

b) The Provincial Leading Agency for Training shall take the lead and coordinate with relevant agencies to advise the Steering Committee for National Target Programs and the Provincial People's Committee to coordinate the implementation of subproject activities in conjunction with other capacity-enhancing activities in the same area to avoid duplication and wastage of resources;

c) Organize capacity enhancement training through direct or online methods;

d) For the community: Use a combination of theoretical and practical learning methods, minimizing purely theoretical lectures;

đ) For program implementation staff at all levels: Use short-term training methods centered around the learner, encouraging sharing and discussion;

e) Duration of training: Each training session shall not exceed four days for the community, five days for program implementation staff at all levels, and ten days for each organized study tour;

g) Training venue: The selection of the training venue must ensure convenient travel and cost-effectiveness.

Chapter VII:

 GUIDELINES FOR IMPLEMENTING PROJECT 9: INVESTMENT AND DEVELOPMENT OF ETHNIC MINORITY GROUPS WITH VERY FEW PEOPLE AND ETHNIC MINORITY GROUPS STILL FACING MANY DIFFICULTIES

Section 1

SUBPROJECT 1: INVESTMENT AND DEVELOPMENT OF ECONOMY AND SOCIETY FOR ETHNIC MINORITY GROUPS STILL FACING MANY DIFFICULTIES AND ETHNIC MINORITIES WITH SPECIAL DIFFICULTIES

Article 54. Scope

Poor households of ethnic minorities listed as facing many difficulties, households of ethnic groups with special difficulties, households of Dan Lai people, and villages in Zone III, and particularly difficult communes in the mountainous and ethnic minority areas during the period from 2021 to 2025. Households and villages benefiting from the policies of this Sub-project shall only enjoy one policy with the highest level of support, which has the same content as other projects under the Program.

Article 55. Investment in Construction, Upgrading, Renovation, and Repair of Infrastructure

1. Recipients

Ethnic groups listed as facing special difficulties according to Decision No. 1227/QD-TTg dated July 14, 2021 of the Prime Minister living stably in communities in villages in Zone III and particularly difficult communes in the mountainous and ethnic minority areas during the period from 2021 to 2025; poor households of ethnic minorities listed as facing many difficulties according to Decision No. 1227/QD-TTg; families of Dan Lai people (from the Thai ethnic group) residing in two hamlets: Co Phat, Bun in the core area of Pu Mat National Park in Nghe An Province; particularly difficult communes in the mountainous and ethnic minority areas where ethnic groups listed as facing special difficulties and ethnic groups listed as facing many difficulties live stably in communities during the period from 2021 to 2025.

The People's Committee at the provincial level shall direct the review and consolidation of lists of hamlets and villages eligible for investment, to be submitted to the Provincial People's Council for decision-making, ensuring flexibility, feasibility, effectiveness, focused investment, and alignment with the medium-term state budget investment plan allocated for the period from 2021 to 2025.

2. Content of Investment

Implemented in accordance with the provisions set out in point a, Clause 8, Section II of the Program issued together with Decision No. 920/QD-TTg.

3. Repair of Infrastructure Projects

Implemented in accordance with the provisions set out in Clause 1, Article 40 of Circular No. 55/2023/TT-BTC.

4. Implementation Mechanism

a) Implementation Process

Implemented in accordance with the provisions set out in Article 13 of Decree No. 27/2022/NĐ-CP (amended and supplemented by Clause 8, Article 1 of Decree No. 38/2023/NĐ-CP); Articles 14, 15, 16, and 17 of Decree No. 27/2022/NĐ-CP; Article 18 of Decree No. 27/2022/NĐ-CP (amended and supplemented by Clause 9, Article 1 of Decree No. 38/2023/NĐ-CP), and relevant provisions suitable to the actual situation of each village and hamlet in the locality.

b) Commune-level People's Committees shall act as project owners; for projects spanning multiple villages with complex technical requirements, the provincial-level People's Committee shall direct implementation according to the management hierarchy; community residents shall have the responsibility to monitor and evaluate projects implemented in their locality.

Article 56. Content of Support for Production Development and Livelihoods

1. For Households of Ethnic Minorities with Special Difficulties

a) Target Group: Households belonging to ethnic groups listed as facing special difficulties according to Decision No. 1227/QD-TTg;

b) Content and Level of Support

Implemented in accordance with the provisions set out in point a, Clause 8, Section II of the Program issued together with Decision No. 920/QD-TTg; point a, Clause 2, Article 40 of Circular No. 55/2023/TT-BTC. For support content related to building models, cooperative chains linking production and consumption chains, and other production development activities proposed by the community, implementation shall be carried out in accordance with Clause 12, Clause 13 of Article 1 of Decree No. 38/2023/NĐ-CP and specific regulations of the Provincial People's Council.

2. For Households of Ethnic Minorities Facing Many Difficulties

a) Target Group: Poor households belonging to ethnic groups listed as facing many difficulties according to Decision No. 1227/QD-TTg;

b) Content of Support

Implemented in accordance with the provisions set out in point a, Clause 8, Section II of the Program issued together with Decision No. 920/QD-TTg.

Article 57. Support for the conservation and promotion of distinctive traditional cultural values and information-communication to enhance the spiritual life of ethnic minorities

1. Recipients

a) Ethnic groups listed in the special difficulty group decision No. 1227/QĐ-TTg;

b) Villages with ethnic minorities listed in the special difficulty group according to current regulations.

2. Content and support levels

Implemented in accordance with the provisions at point a, Clause 8, Section II of the Program issued together with Decision No. 920/QĐ-TTg, Article 41 of Circular No. 55/2023/TT-BTC.

Article 58. Support for the protection and development of ethnic minority groups with special difficulties

1. Recipients

a) Pregnant women and children under five years old belonging to households of ethnic minorities with special difficulties approved in Decision No. 1227/QĐ-TTg;

b) Public kindergartens in villages with ethnic minorities with special difficulties listed in the special difficulty village list according to current regulations.

2. Content and level of support

Implemented in accordance with the provisions at point a, Clause 8, Section II of the Program issued together with Decision No. 920/QĐ-TTg, Article 42 of Circular No. 55/2023/TT-BTC.

3. The provincial People's Committee decides on the form of nutritional formula meal support for children under five years old at public kindergartens within its management level to ensure flexibility, feasibility, effectiveness, and suitability with actual conditions.

Article 59. Support for building models to improve population quality in villages with concentrated populations of ethnic minority groups with special difficulties

1. Conditions for support

There must be a voluntary participation proposal from individuals or community residents certified by the People's Committee of the commune.

2. Model content

Based on local socio-economic planning and orientation, the provincial or commune People's Committee selects support content to build models to improve the quality of the population for ethnic groups with special difficulties affecting physical health, intelligence, and spirit across various fields:

a) Health care and physical development for residents;

b) Education development and psychological support to enhance personal integration into the community;

c) Maintenance and preservation of cultural and traditional festival values;

d) Community tourism development and other appropriate models based on local capacity and conditions.

3. Duration of model implementation: from 1 to 5 years during the program implementation phase.

4. Main activities

a) Organizing surveys, meetings, conferences, dialogues, seminars, cultural exchanges, specialized lectures to serve the model's activities;

b) Hiring experts, consultants to support research, design, and implementation of the model;

c) Renting or purchasing goods, transportation, materials, raw materials, technology to serve the construction of the model (nutritional products, tools, reference books);

d) Compiling, editing, providing materials, training on methods and skills for building and expanding the model; writing articles and promoting through the local radio system;

đ) Establishing clubs; organizing regular club activities according to selected model content (if applicable); organizing experimental/practical/demonstration activities of models; developing communication and promotional products on various media platforms, introducing, promoting, registering trademarks for model products/activities (if applicable);

e) Directly supporting participants in the model; supporting specialized activities of implementing organizations; providing technical assistance between levels, community consultations, and other activities as directed by local authorities (if applicable);

g) Organizing inspections, monitoring, preliminary and final evaluations of the model;

h) Other management, construction, and implementation activities of the model (if applicable) carried out in accordance with current regulations and actual needs approved by the competent authority deciding on the model.

5. Support levels Implemented in accordance with the provisions of Article 43 of Circular No. 55/2023/TT-BTC.

6. Procedures, processes, application forms, formalities, and approval of the model

a) For models implemented by Ministries or central agencies: The Minister or Head of the Central Agency decides or delegates to the Heads of subordinate agencies or units to decide on content, procedures, formalities, and implementation methods;

b) For models implemented by localities: The Chairman of the Provincial People's Committee decides or delegates to the Heads of provincial departments or sectors to decide on content, procedures, formalities, and implementation methods.

Article 60. Implementation Organization

The Provincial People's Committee shall direct, guide, and organize implementation:

1. Review and identify the target groups and areas that primarily benefit from investment policies aimed at developing the economy and society for ethnic minorities facing many difficulties, and those with special difficulties.

2. Develop, review, and approve support plans for ethnic minority groups with special difficulties; compile capital requirements, and develop annual and phased implementation capital plans.

Section 2

SUBPROJECT 2: REDUCING EARLY MARRIAGE AND CONSANGUINEOUS MARRIAGE IN AREAS WITH ETHNIC MINORITY POPULATIONS AND MOUNTAINOUS REGIONS

Article 61. Communication and Enhancement of Professional Competence

1. Enhance Awareness through Communication

a) Compile and provide materials, conduct training on communication knowledge and skills, mobilization, and legal counseling related to marriage and family: compile training materials on knowledge and skills related to communication, mobilization, and legal counseling concerning marriage, family, early marriage prevention, and consanguineous marriage in areas with ethnic minority populations; question-and-answer materials on marriage, early marriage, and consanguineous marriage; leaflets, brochures, banners, posters, propaganda paintings, slogans promoting laws on marriage, population, and family; compile handbooks and information materials on marriage and family; reproductive health;

b) Organize integrated conferences, seminars, discussion forums, cultural exchanges to promote awareness and reduce early marriage and consanguineous marriage in areas with ethnic minority populations;

c) Organize contests to enhance understanding of laws, marriage, and early marriage and consanguineous marriage.

2. Capacity Building for Ethnic Minority Officials and Legal Counselors

a) Conduct training and capacity building on legal knowledge and communication skills, mobilization, and legal counseling related to marriage, population, and family for ethnic minority officials and legal counselors at the local level;

b) Support and provide materials and communication products related to marriage, population, and family for organizations and individuals involved in preventing early marriage and consanguineous marriage in areas with ethnic minority populations;

c) Organize conferences, seminars, discussion forums, exchanges, and visits to learn experiences to enhance professional competence, knowledge, and skills in communication, mobilization, and legal counseling for ethnic minority officials and legal counselors at central and local levels.

Article 62. Counseling and Integrated Interventions

Strengthen counseling and integrated interventions with programs, projects, and models related to reproductive health care, maternal and child health, population planning, nutrition, and physical development in the field of marriage to reduce early marriage and consanguineous marriage in areas with ethnic minority populations.

Article 63. Maintenance and Expansion of Models in Communes/Schools with High Rates of Early Marriage and Consanguineous Marriage

Implement the expansion of pilot models and relevant specialized models to change behaviors, improve access to information, and mobilize community participation in preventing and reducing early marriage and consanguineous marriage in areas with ethnic minority populations.

1. Areas, Number, and Scale of Implementation

a) Areas implementing models in communes/schools with high rates of early marriage and consanguineous marriage among ethnic minority populations;

b) The number and scale of model implementation are decided by provincial People's Committees, commune-level People's Committees, and schools.

2. Model Activities

Based on allocated funds, select appropriate activities to ensure the purpose, target group, content, organizational methods, time frame, and progress of implementation:

a) Conduct training on implementing the model for cadres and participants;

b) Organize communication and promotional activities, mobilization, and enhanced awareness, behavior change through mass media and grassroots information systems;

c) Establish communication and mobilization points, clubs, core groups such as respected community members, women's groups, young people, students from ethnic minority communities in villages and schools to organize promotional, mobilization, counseling, and intervention activities to change behaviors, improve information access, and mobilize community participation in preventing and reducing early marriage and consanguineous marriage;

d) Establish advisory groups on reproductive health and gender health for ethnic minority youth and adolescents;

đ) Compile, print, and provide suitable communication products to serve the promotion activities of the model.

Article 64. Organization of inspection, evaluation, interim review, and final summary

1. Annually organize inspections to promptly detect, prevent, and handle violations of laws on marriage and family.

2. Organize inspections and evaluations of the results of implementing activities under the Project at commune, provincial, and centrally governed city levels; cooperation among relevant ministries, agencies, and sectors in implementation.

3. Organize interim reviews and final summaries, and evaluate the results of implementation.

Chapter VIII

IMPLEMENTATION GUIDELINES FOR CONTENT NUMBER 01 AND CONTENT NUMBER 02 (EXCLUDING TASKS MANAGED AND IMPLEMENTED BY THE MINISTRY OF CULTURE, SPORTS AND TOURISM, AND THE MINISTRY OF SCIENCE AND TECHNOLOGY) BELONGING TO SUBPROJECT 1 OF PROJECT 10

Section 1

CONTENT NUMBER 01: PUBLIC RECOGNITION AND HONORING EXEMPLARY MODELS, PROMOTING THE ROLE OF PEOPLE WITH CREDIBILITY

Article 65. Public recognition and honoring exemplary models in ethnic minority and mountainous regions

1. Contents of activities

a) Organizing communication and propaganda activities, showcasing good people and deeds, and exemplary models in ethnic minority and mountainous regions:

- Organizing production, editing, publishing, broadcasting, and airing promotional materials and publications on newspapers, radio stations, television channels, online information websites, and social media platforms to promote and introduce good people, deeds, and exemplary models in ethnic minority and mountainous regions.

- Preparing, compiling, printing, and distributing information, materials, handbooks, notebooks, promotional publications, conference proceedings, and seminar papers to promote and introduce good people, deeds, and exemplary models in ethnic minority and mountainous regions.

- Organizing contests to understand, promote, and showcase good people, deeds, and exemplary models in ethnic minority and mountainous regions.

b) Organizing conferences, seminars, roundtable discussions, exchanges, meetings, receptions, visits, and learning experiences from exemplary models in various aspects of social life in ethnic minority and mountainous regions;

c) Building, implementing, and expanding exemplary model templates;

d) Inspecting, interim reviewing, summarizing, and evaluating the results of public recognition and honoring exemplary models in ethnic minority and mountainous regions according to regulations.

2. Content, procedures for building, implementing, and expanding exemplary model templates

a) Surveying, identifying, and selecting outstanding collectives and individuals in implementing the Program to build exemplary model templates (hereinafter referred to as models);

b) Building, registering, and approving models

- The model must have a specific name, clearly define objectives, requirements, contents, progress, implementation measures, responsibilities of related organizations and individuals participating, and expected outcomes and effects.

- Depending on the model, determine appropriate activities based on the actual situation of the agency or unit and allocated budget, including main activities such as training and deployment; organizing communication, consulting, knowledge contests, promotion, education, showcasing to enhance awareness; preparing, printing, and providing suitable information, materials, and promotional publications to serve the activities of the model; organizing conferences, seminars, roundtable discussions, visits, exchanges, learning experiences, recognition, and rewards.

- Registering and approving models

+ Models implemented by communes: register with the Provincial People's Committee and approved by the Chairman of the Provincial People's Committee;

+ Models implemented by provincial departments and agencies: register through the provincial Ethnic Affairs and Religion Office. The provincial Ethnic Affairs and Religion Office will compile and submit for approval by the Chairman of the Provincial People's Committee;

+ Models implemented by central-level organizations and individuals: approved by the head of the central-level agency;

+ For individual models (exemplary role models): register with the current workplace or directly managing organization for consolidation and submission for approval by the competent authority along with collective models at the same level.

c) Developing plans and implementing approved models;

d) Evaluating and recognizing models and awarding honors

- At the end of the period, organizations and individuals participating in the implementation of the model will summarize and evaluate the results and propose recognition of the model.

- The model registered with which organization or unit will be guided and recognized by that organization or unit.

- Criteria for recognizing models

+ General criteria: collectives and individuals with outstanding achievements in implementing the Program at localities, agencies, and units; exemplary in complying with Party guidelines and State policies; making positive contributions to the development of ethnic minority and mountainous regions;

+ Provinces, centrally governed cities, and central agencies: based on assigned goals and tasks, establish specific criteria for each type of model to build, evaluate, confirm, recognize, honor, reward, and expand exemplary role models appropriately.

- Honoring and rewarding models according to the Law on Competition and Reward and current guiding documents on competition and reward.

- Regularly organizing interim and final summaries, evaluating results, and proposing expansion of models.

3. Organization of Implementation

a) The Ministry of Ethnic Affairs and Religion

- Taking the lead and coordinating with relevant agencies to guide, inspect, and urge localities to implement activities for public recognition and honoring exemplary models in ethnic minority and mountainous regions according to the approved objectives and contents in Decision No. 920/QĐ-TTg.

- Taking the lead and coordinating with central mass media agencies (print newspapers, online newspapers, radio, television) to organize promotion, introduction, and public recognition of good people, deeds, and exemplary models in ethnic minority and mountainous regions.

- Organizing conferences, seminars, knowledge contests, exchange activities, learning experiences, meetings, roundtable discussions, gift-giving ceremonies for exemplary models from localities; implementing the provision of information, materials, and promotional publications to promote, introduce, and honor good people, deeds, and exemplary models in ethnic minority and mountainous regions.

- Organize national conferences every five years to commend, honor, and award outstanding models; organize exchange and learning activities every three years for outstanding models in regions and areas; and organize commendation conferences every two years for outstanding models at the provincial level.

- Summarize, conclude, and evaluate the results of commending and honoring outstanding models in ethnic minority areas according to regulations.

b) The Provincial People's Committee shall direct the provincial ethnic affairs agency to take the lead and coordinate with relevant agencies to assist the Provincial People's Committee in guiding the implementation and organization of the following activities:

- Communication, propaganda, and showcasing exemplary individuals and outstanding models through local mass media (print newspapers, online newspapers, radio, television).

- Organizing conferences, seminars, competitions, exchanges, learning experiences, receptions, meetings, discussions, and gift-giving events for local outstanding models; providing information, materials, and publications to promote and commend exemplary individuals and outstanding models in ethnic minority areas within the jurisdiction.

- Developing, implementing, and expanding local exemplary models in organizing and implementing the Program.

- Summarize, conclude, and evaluate the results of commending and honoring outstanding models within the jurisdiction, and compile reports to the Ministry of Ethnic Affairs and Religion as prescribed.

Article 66. Promoting the role of influential persons in ethnic minority areas

1. Contents of activities

a) Implementing activities to publicize, educate, and enhance awareness about the position and role of village elders, headmen, and influential persons in ethnic minority areas:

- Collaborating with central and local mass media organizations to organize communication, propaganda, education, and enhancement of awareness regarding the role of village elders, headmen, and influential persons in ethnic minority areas.

- Organizing production, editing, publishing, broadcasting, and distributing materials and publications on the press, radio, television, electronic news websites, and social networks to promote the role of village elders, headmen, and influential persons in ethnic minority areas across various aspects of social life.

- Organizing training sessions, capacity building, compiling, printing, and distributing handbooks, notebooks, publications, conference proceedings, and seminar records to provide information and materials promoting the role of village elders, headmen, and influential persons in ethnic minority areas.

- Organizing competitions to promote, introduce, and showcase exemplary individuals and outstanding models who are village elders, headmen, and influential persons in ethnic minority areas.

b) Organizing conferences, seminars, discussions, exchanges, meetings, receptions, tours, and experience-sharing sessions for exemplary village elders, headmen, and influential persons in various aspects of social life in ethnic minority areas.

c) Preparing specialized materials suitable for the practical needs of the locality to serve training and capacity-building activities for influential persons among ethnic minorities.

d) Providing appropriate audio-visual equipment to village elders, headmen, and influential persons to enhance their capabilities and information reception abilities to meet the requirements of their assigned roles.

đ) Inspecting, supervising, commending, rewarding, summarizing, concluding, and evaluating the results of promoting the role of village elders, headmen, and influential persons in ethnic minority areas according to regulations.

2. Implementation Organization:

a) The Ministry of Ethnic Affairs and Religion

- Taking the lead and coordinating with relevant agencies to guide, inspect, and urge localities to implement activities to promote the role of village elders, headmen, and influential persons according to the objectives and contents approved in Decision No. 920/QĐ-TTg.

- Taking the lead and coordinating with central mass media organizations (print newspapers, online newspapers, radio, television) to organize publicity, education, and enhancement of awareness about the role of village elders, headmen, and influential persons in ethnic minority areas.

- Compiling, editing, printing, and distributing information, materials, handbooks, notebooks, publications, conference proceedings, and seminar records; organizing and supporting localities in conducting training and capacity-building activities for village elders, headmen, and influential persons by region.

- Organizing conferences, seminars, receptions, meetings, discussions, exchanges, experience-sharing sessions, visits, and gift-giving events for influential persons according to regulations.

- Inspecting, urging, guiding localities; summarizing, concluding, and evaluating the results of promoting the role of village elders, headmen, and influential persons in ethnic minority areas according to regulations.

b) The Provincial People's Committee shall direct the provincial ethnic affairs agency to take the lead and coordinate with relevant agencies to assist the Provincial People's Committee in guiding the implementation and organization of the following activities:

- Communication, propaganda, and enhancing awareness about the role of village elders, headmen, and influential persons in ethnic minority areas within the province.

- Compiling, editing, printing, and distributing information, materials, handbooks, notebooks, publications, conference proceedings, and seminar records suitable for local conditions and the characteristics and needs of village elders, headmen, and influential persons within the province.

- Organizing training and capacity-building activities; organizing conferences, seminars, discussions, exchanges, experience-sharing sessions, receptions, meetings, visits, and gift-giving events for influential persons (listed and approved by the locality according to Decision No. 12/2018/QĐ-TTg dated March 6, 2018 of the Prime Minister).

- Receiving and working with influential persons (listed and approved by the locality according to Decision No. 12/2018/QĐ-TTg dated March 6, 2018 of the Prime Minister) visiting the locality.

- Providing information, materials, and press coverage according to Decision No. 12/2018/QĐ-TTg.

- Conduct surveys on subjects, conditions, needs, and decide to select appropriate audio-visual means (the selection of audio-visual means is based on the provisions of Clause 13, Article 3 of Decree No. 71/2007/NĐ-CP dated May 3, 2007 of the Government detailing and guiding the implementation of certain articles of the Law on Information Technology regarding the information technology industry and Circular No. 09/2013/TT-BTTTT dated April 8, 2013 of the Ministry of Information and Communications (now the Ministry of Science and Technology) promulgating the list of software and electronic hardware products) and organize the issuance to persons of trust (listed in the approval of localities according to Decision No. 12/2018/QĐ-TTg dated March 6, 2018 of the Prime Minister) in accordance with the laws on bidding; issue management and usage regulations aimed at enhancing capacity, information reception ability, and maximizing the effectiveness of equipment issued to persons of trust, meeting the requirements of assigned tasks.

- Implement protective measures, support, and create practical conditions suitable for persons of trust in the locality to promote their roles and fulfill assigned tasks.

- Inspect, urge implementation, commend, reward, and conduct mid-term and final evaluations of the results of work promoting the role of village elders, headmen, and persons of trust in ethnic minority areas within the province/city, and report to the Ministry of Ethnic Affairs and Religion as prescribed.

Article 67. Funding

The funding for implementing contents and tasks shall be guaranteed by the state budget. The content and level of expenditure for activities shall be carried out in accordance with Clause 10, Article 1 of Circular No. 75/2024/TT-BTC dated October 31, 2024 of the Ministry of Finance.

Section 2 NUMBER 02: SPREADING AND EDUCATION OF LAWS AND LEGAL PUBLICITY AND MOTIVATION FOR ETHNIC MINORITY GROUPS

Subsection 1 SPREADING AND EDUCATION OF LAWS AND LEGAL PUBLICITY

Article 68. Target Groups

Citizens in ethnic minority regions; cadres, civil servants, and employees in the ethnic affairs and religious system from central to local levels; cadres, civil servants, and employees tasked with spreading and educating the law and publicizing and mobilizing ethnic minorities; leaders of Party organizations, administrative bodies, and mass organizations at commune, village, and hamlet levels; village elders, headmen, persons of trust, religious functionaries in ethnic minority regions; enterprises, cooperatives, economic organizations, and social organizations operating in ethnic minority areas.

Article 69. Implementation Principles

The principles of spreading and educating the law and publicizing and mobilizing shall be implemented in accordance with Article 5 of the Law on Spreading and Educating the Law, Article 3 of this circular, and the following principles:

1. Persistent, regular, simple, easy to understand, remember, and implement.

2. Encourage the use of language and prioritize forms that are suitable with customs, traditions, and cultural practices of each ethnic group and region.

3. Strengthen the application of information technology and digital transformation.

Article 70. Content of Spreading and Educating the Law and Publicizing and Mobilizing

1. Spread the content of the Constitution, laws, regulatory legal documents, and ethnic policies related to ethnic minority regions; focusing on contents suitable with the actual situation in various areas and regions.

2. Focus on spreading the law to ethnic minority groups, raising awareness of respecting, complying with, and protecting the law; prohibited acts and sanctions; basic rights and obligations of citizens; main contents of policies and laws on criminal, civil, marriage and family, land, environmental protection, labor, health, education, national defense, security, traffic, basic rights and obligations of citizens, authorities and responsibilities of state agencies, food safety, climate change, digital transformation, start-up support; newly issued regulatory legal documents; policies on ethnic affairs work and ethnic policies and other relevant policies to ethnic minority regions.

3. Publicize ethnic policies and the results of implementing ethnic policies, the unity of all ethnic groups by the Party and State; exemplary models of good people and deeds in complying with and implementing laws and ethnic policies; publicize and mobilize ethnic minorities to eliminate outdated customs, be vigilant against the "peaceful evolution" plot, exploiting ethnic, democratic, human rights issues, illegal proselytism to undermine the Party and State, disrupting the unity of all ethnic groups; refute false arguments of reactionary forces; raise awareness about border sovereignty and security; other contents related to ethnicity and ethnic policies.

4. Train skills and expertise in spreading and educating the law and publicizing and mobilizing ethnic minorities.

Article 71. Forms of popularizing, educating the law and propaganda, mobilization among ethnic minority and mountainous regions' people

The forms of popularizing, educating the law and propaganda, mobilization shall be implemented according to Article 11 of the Law on Popularizing and Educating the Law and the following forms:

1. Through printed newspapers, radio broadcasts, television programs, and online news.

2. Workshops for sharing, exchanging experiences, skills, and professional knowledge.

3. Building and maintaining activities of models and clubs.

4. Compiling and issuing books, skill handbooks, policy and legal Q&A; providing policy and legal texts.

5. Compiling and issuing leaflets, brochures; posters, banners, billboards; audio tapes, discs, mobile film screenings.

6. Through festivals, cultural traditions' activities.

7. Other appropriate forms in accordance with the conditions of ethnic minority and mountainous regions and actual circumstances in various areas.

Subsection 2

ORDERING THE PRODUCTION OF CERTAIN PRINTED MATERIALS FOR NEWSPAPERS AND MAGAZINES AND RESEARCHING TO REVISE FORMS OF INFORMATION DELIVERY SUITABLE FOR THE SPECIAL CONDITIONS OF ETHNIC MINORITY AND MOUNTAINOUS REGIONS, AS WELL AS DIFFICULT AND REMOTE AREAS

Article 72. Ordering the production of certain printed materials for newspapers and magazines for ethnic minority and mountainous regions, difficult and remote areas

Implementing policies for producing certain printed materials for ethnic minority and mountainous regions, difficult and remote areas according to Decision No. 752/QD-TTg dated June 23, 2023 of the Prime Minister approving the plan for ordering the production of certain printed materials for newspapers and magazines for ethnic minority and mountainous regions, difficult and remote areas for the period 2023-2025, and Decision No. 1513/QD-TTg dated December 5, 2024 of the Prime Minister amending and supplementing Decision No. 752/QD-TTg.

1. Recipients of printed materials for newspapers and magazines

a) Party Committee, People's Council, People's Committee, United Front Organization, Farmers' Association, Youth Union, Women's Union, Veterans' Association at communes in ethnic minority and mountainous regions as decided by competent authorities;

b) Villages, hamlets (or equivalent) in communes in ethnic minority and mountainous regions as decided by competent authorities;

c) Classes in primary schools and junior high schools in communes in ethnic minority and mountainous regions as decided by competent authorities; classes in boarding and semi-boarding schools;

d) Khmer Buddhist temples based on reports from competent authorities;

đ) Notable individuals among ethnic minority groups as decided by competent authorities.

2. Quantity of printed materials published and distributed as stipulated in Decision No. 920/QD-TTg; the number of copies kept for record and the number sent to management agencies will be specifically notified by the Ministry of Ethnic Minority Affairs and Religion.

3. Specifications and quality of printed materials for newspapers and magazines as guided by the Ministry of Ethnic Minority Affairs and Religion.

4. Criteria for evaluating the quality of printed materials for newspapers and magazines as prescribed by the Ministry of Culture, Sports and Tourism.

5. Implementation

a) The Ministry of Ethnic Minority Affairs and Religion orders media organizations to publish and distribute printed materials in accordance with the provisions of Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, placing orders, or tendering for the provision of public products and services using state budget funds from regular operating expenses; Decree No. 125/2025/NĐ-CP dated June 11, 2025 of the Government on defining the authority of local governments at two levels in the field of financial administration managed by the Ministry of Finance (hereinafter referred to as Decree No. 125/2025/NĐ-CP); Circular No. 55/2023/TT-BTC;

b) Ensuring timely and accurate distribution of printed materials for newspapers and magazines to the designated recipients as required by law.

Article 73. Management and Use of Newspapers and Magazines

1. Newspapers and magazines distributed to localities (communes, villages)

a) Organizations and individuals receiving newspapers and magazines shall be responsible for managing and using them to serve advisory work, guidance, and propaganda dissemination to the people in order to effectively implement the Party's policies and the State's laws at the locality level. In addition, they shall also be responsible for distributing these publications down to the grassroots level so that everyone can read them;

b) Localities with libraries, reading rooms, village cultural postal service points, community activity centers: concentrate newspapers and magazines so that the people have the opportunity to come and read or organize readings for everyone to listen;

c) The People's Committee of communes shall manage and use newspapers and magazines effectively, creating favorable conditions for all residents within their jurisdiction to read newspapers and magazines. At the same time, they shall regularly organize inspections, supervision, and timely correction of the management and use of newspapers and magazines distributed to villages; evaluate and grasp the wishes of the people regarding the quality, form, and effectiveness of each newspaper and magazine to provide accurate and timely feedback to the agencies implementing the policy.

2. Newspapers and magazines distributed to classes for use during class meetings, then transferred back to the school library. Schools shall be responsible for managing, utilizing, and ensuring that all students have the opportunity to read.

3. Newspapers and magazines distributed to mass organizations and political-social organizations shall be centrally managed, utilized, and made available for members to read, view, and listen, while serving as propaganda materials in concentrated activities.

4. Newspapers and magazines distributed to influential individuals in ethnic minority areas shall be used to serve propaganda dissemination and mobilization work to encourage the people to effectively participate in implementing the Party's policies and the State's laws at the locality level. Additionally, influential individuals shall be responsible for sharing and guiding those around them to read.

Article 74. Implementation Organization

1. Ministry of Ethnic Affairs and Religion

a) Take the lead and coordinate with relevant ministries, agencies, and localities to direct, manage; guide, monitor, urge implementation, inspect, and evaluate the effectiveness of the policy on distributing some newspapers and magazines;

b) Take the lead in reviewing publication plans for printed newspapers and magazines (including publication and distribution costs) for each newspaper and magazine, build price proposals for competent state authorities to approve maximum prices; the Ministry of Ethnic Affairs and Religion shall issue specific prices for each newspaper and magazine not exceeding the maximum prices set by competent authorities for each publication;

c) Take the lead and coordinate with relevant localities to review, determine, and compile the number and addresses of recipients of newspapers and magazines;

d) Develop inspection, monitoring, post-inspection plans, collect opinions from beneficiaries of newspapers and magazines; propose the Prime Minister to temporarily suspend participation in ordering if products do not meet contractual requirements;

e) Organize mid-term and final reviews, draw lessons, assess results and effectiveness of the policy on distributing some newspapers and magazines to ethnic minority areas and remote regions, compile reports for evaluation and recommendations to the Prime Minister for adjustment and supplementation as necessary;

2. Central Ministries and Agencies

a) Ministry of Culture, Sports and Tourism

Take the lead and coordinate with the Ministry of Ethnic Affairs and Religion and related agencies to inspect and supervise the activities of newspapers and magazines to ensure they adhere to their objectives; direct and inspect the transportation and distribution of newspapers and magazines to ensure timeliness, correct target groups, and correct addresses; establish criteria for evaluating the quality, form, and effectiveness of propaganda, and conduct annual reviews and evaluations of each distributed newspaper and magazine;

b) Ministry of Education and Training

Direct the Department of Education and Training to compile lists of recipients of newspapers and magazines belonging to educational institutions in the locality and send them to the Ministry of Ethnic Affairs and Religion before August 30th every year (before the start of the new academic year) or on an ad hoc basis;

c) Border Guard Command

Direct functional agencies to review and compile the number, list, and addresses of recipients who are border communes, villages, and communities and send them to the Ministry of Ethnic Affairs and Religion before September 1st every year or on an ad hoc basis;

3. Provincial People's Committees

a) Compile lists of recipients from various departments, communes, villages, political-social-professional organizations, and influential individuals within their jurisdiction and send them to the Ministry of Ethnic Affairs and Religion before September 1st every year or on an ad hoc basis as required;

b) Specify the roles and responsibilities of departments in implementing the policy;

c) Direct, manage, guide, monitor, urge, inspect, and evaluate the implementation of the policy at the local level; periodically or on an ad hoc basis review, adjust, supplement, compile lists, and addresses of policy beneficiaries within their jurisdiction and submit them to the Provincial People's Committee for signature and submission to the Ministry of Ethnic Affairs and Religion before September 1st every year; conduct mid-term and final reviews and report the results of policy implementation to the Ministry of Ethnic Affairs and Religion before November 25th every year; conduct annual surveys to collect public opinions on information needs, evaluate the effectiveness and quality of content and form of newspapers and magazines, report results and difficulties encountered during policy implementation to the Ministry of Ethnic Affairs and Religion for consolidation and submission to the Prime Minister for appropriate adjustments and supplements; organize various forms to attract readers, guide reading, and follow good practices and exemplary actions reflected in newspapers and magazines;

4. Commune People's Committees

b) Periodically inspect, identify, and promptly address any issues in the issuance, management, storage, utilization, and exploitation of newspapers and magazines issued on the local territory; grasp and truthfully reflect opinions and evaluations regarding the quality of content and form of publications, report to higher-level ethnic affairs and religious authorities.

5. News agencies, magazines, and distribution units

a) Establish operational regulations for responsible departments, publication procedures, and distribution processes of newspapers and magazines to target beneficiaries according to guidelines from the Ministry of Ethnic Affairs and Religion and other relevant documents;

b) Propose to competent state authorities and the Ministry of Ethnic Affairs and Religion regarding publication costs, distribution fees for various types of newspapers and magazines; production funding;

c) Regularly conduct self-inspections and evaluations every quarter, six months, and annually on the results of publishing and distributing newspapers and magazines based on established criteria, along with recommendations to improve the quality of publication and distribution activities to better serve the information needs of ethnic minority groups, reporting to the Ministry of Ethnic Affairs and Religion and related ministries and sectors for consideration and resolution.

Subsection 3

BUILDING VIETNAMNET INTO AN EFFECTIVE AND TIMELY MEDIA ORGANIZATION FOR ETHNIC AFFAIRS WORK AND INFORMATION, PUBLICITY REGARDING THE OVERALL PROGRAM AND THE NATIONAL TARGET PROGRAM ON ECONOMIC AND SOCIAL DEVELOPMENT IN ETHNIC MINORITY AND MOUNTAINOUS REGIONS FROM 2021 TO 2030

Article 75. Implementation Content

1. Utilize information technology to support professional activities and management of VietnamNet and Development, diversifying languages in information and publicity (including Vietnamese, English, and ethnic minority languages); diversifying media products; and diversifying forms of information and publicity.

2. Implement the production, posting, and distribution of journalistic works; supplements, specialized pages with in-depth content on ethnic affairs, the implementation results of ethnic policies under the Overall Program and the National Target Program on economic and social development in ethnic minority and mountainous regions from 2021 to 2030 as stipulated in Resolution No. 88/2019/QH14 dated November 18, 2019, and Resolution No. 120/2020/QH14 dated June 19, 2020 of the National Assembly.

3. Train and enhance knowledge and skills in professional fields and vocational areas; transfer technology to the staff and workers of VietnamNet.

Article 76. Organization and Implementation

VietnamNet shall develop a project or plan to fulfill its tasks, report to the competent authority for approval in accordance with the Press Law, Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, placing orders, or tendering for the provision of public goods and services using state budget funds from regular expenditure; Decree No. 125/2025/NĐ-CP; Circular No. 55/2023/TT-BTC, and current laws.

Subsection 4

BUILDING THE ELECTRONIC JOURNAL OF ETHNIC AND RELIGIOUS STUDIES

Article 77. Implementation Content

1. Train and enhance knowledge and skills in professional fields and vocational areas; transfer technology to the staff and workers of the Journal of Ethnic and Religious Studies.

2. Utilize information technology to support professional activities and management of the Journal of Ethnic and Religious Studies, diversifying languages (including Vietnamese, English, and ethnic minority languages); diversifying professional activity products.

3. Support the production of works and products in journalism including:

a) Production costs, royalties, editing fees; system management; registration and leasing domain name and internet connection fees;

b) Leasing services to complete the Electronic Journal of Ethnic and Religious Studies product.

Article 78. Implementation Organization

The Journal of Ethnic Groups and Religion shall base on actual conditions and the need to enhance capacity in building projects or plans to implement tasks, report to the competent authority for approval in accordance with the Law on Press, Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government stipulating the assignment of tasks, placing orders, or tendering for the provision of public products and services using state budget funds from regular expenditure; Decree No. 125/2025/NĐ-CP; Circular No. 55/2023/TT-BTC and other current legal provisions.

Subsection 5

PROPAGANDA AND COMMUNICATION TO MOTIVATE THE PEOPLE IN REGIONS OF ETHNIC MINORITY GROUPS AND MOUNTAINOUS AREAS, BORDER REGIONS TO PARTICIPATE IN THE ORGANIZATION AND IMPLEMENTATION OF THE OVERALL PROJECT AND NATIONAL TARGET PROGRAM

Article 79. Target Audience

a) People residing in regions inhabited by ethnic minority groups and mountainous areas, border regions.

b) Leaders, managers, experts, researchers, artists, policy makers related to the Overall Project and Program;

c) Agencies, departments, units directly and indirectly involved in implementing the Overall Project and Program;

d) Communities of Vietnamese people both inside and outside the country, and international organizations interested in ethnic groups and ethnic issues in Vietnam.

Article 80. Content, Language, and Form of Implementation

1. Implementation Content

a) Propaganda and communication about the Overall Project: propaganda on viewpoints, objectives, tasks, solutions, and implementation status of the Overall Project;

b) Propaganda and communication about the Program: propaganda on objectives, tasks, solutions, policies, laws related to the implementation of the Program, and mobilizing resources at central agencies and localities.

2. Language: Vietnamese, ethnic minority languages.

3. Forms of Implementation

a) Propaganda and communication through various types of press, publications, documentary films, video clips, online information portals, and other communication products (including the production of appropriate columns and special topics based on the purpose, content, and specific characteristics of regions inhabited by ethnic minority groups);

b) Through seminars, conferences, competitions, training sessions, television games, radio stories, stage performances (live, online, or hybrid live and online);

c) Production and editing of programs, roundtable discussions, reports, documentaries, and other communication products promoting the Overall Project and Program on mass media platforms;

d) Broadcasting and rebroadcasting of radio and television products on different platforms; production, duplication, and distribution of communication products (newspapers, magazines, leaflets, posters, banners, video clips) to strengthen informational content for propaganda purposes.

Article 81. Methods of Implementation

The Ministry of Ethnic Groups and Religion will place orders in accordance with Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government stipulating the assignment of tasks, placing orders, or tendering for the provision of public products and services using state budget funds from regular expenditure; Decree No. 125/2025/NĐ-CP; Circular No. 55/2023/TT-BTC.

Chapter IX

GUIDELINES FOR IMPLEMENTING SUBPROJECT 2 UNDER PROJECT 10: APPLICATION OF INFORMATION TECHNOLOGY TO SUPPORT ECONOMIC AND SOCIAL DEVELOPMENT AND ENSURE SECURITY AND ORDER IN REGIONS OF ETHNIC MINORITY GROUPS AND MOUNTAINOUS AREAS

Article 82. Digital Transformation in the Implementation of the National Target Program for Socio-Economic Development in Ethnic Minority and Mountainous Areas for the Period 2021-2030

Based on the current situation, local needs, and in accordance with the guidelines set forth in the Project of the Ministry of Ethnic Affairs and Religion, the Provincial People's Committee shall instruct the steering body of the Program to draft detailed Projects/Plans/Policies for approval by the Provincial People's Committee and implementation in accordance with Decree No. 73/2019/ND-CP dated September 5, 2019 of the Government on the management of investment in the application of information technology using state budget funds, Decree No. 82/2024/ND-CP dated July 10, 2024 of the Government amending and supplementing certain articles of Decree No. 73/2019/ND-CP dated September 5, 2019, Decree No. 132/2025/ND-CP dated June 12, 2025 of the Government on the division of authority of two-level local governments in the field of state management by the Ministry of Science and Technology, Circular No. 55/2023/TT-BTC, and other current regulations.

Article 83. Organization of Activities such as Conferences, Seminars, and Online Meetings of the Central Steering Committee and its Supporting Agencies Related to Guidance and Implementation of the Program

Based on actual local needs, referring to the content directions in the Project of the Ministry of Ethnic Affairs and Religion, the Provincial People's Committee shall instruct the steering body of the Program to draft detailed Plans for approval by the Provincial People's Committee and implementation in accordance with current regulations.

Chapter X

IMPLEMENTATION AND EFFECTIVE PROVISIONS

Article 84. Implementation Organization

1. Ministry of Ethnic Affairs and Religion

To take the lead and coordinate with relevant ministries, sectors, and provincial people's committees to implement the contents stipulated in this Circular.

2. Relevant Ministries and Sectors

Based on the tasks assigned by the Prime Minister, to coordinate with the Ministry of Ethnic Affairs and Religion to implement the contents stipulated in this Circular.

Direct functional agencies to review and compile the number, list, and addresses of recipients who are border communes, villages, and communities and send them to the Ministry of Ethnic Affairs and Religion before September 1st every year or on an ad hoc basis;

a) In accordance with their functions, tasks, and authorities, to direct, guide, and organize the implementation of the contents stipulated in this Circular in a manner that is consistent and compliant with the law; to be directly and fully responsible for the progress, quality, and effectiveness of the implementation of Projects, Sub-Projects, and Component Contents under the Program.

b) To comply with reporting requirements as prescribed by current regulations.

Article 85. Transitional Provisions

1. For contents and tasks implemented before the effective date of this Circular that are in compliance with the law, they shall continue to be implemented according to the decisions approved by competent authorities and the guidance provided in Circular No. 02/2022/TT-UBDT dated June 30, 2022, and Circular No. 02/2023/TT-UBDT dated August 21, 2023 of the Chairman of the State Committee for Ethnic Affairs, or adjusted in accordance with this Circular.

2. The Provincial People's Committee shall instruct a review and adjustment of the contents and tasks of the Program's implementation in accordance with the guidance provided in this Circular and related laws.

Article 86. Effective Date

Article 32. Responsibilities of Agencies

2. The following Circulars shall cease to be effective from the date this Circular takes effect:

a) Circular No. 02/2022/TT-UBDT dated June 30, 2022 of the State Committee for Ethnic Affairs guiding the implementation of certain projects under the National Target Program for Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030, Phase I: from 2021 to 2025;

b) Circular No. 02/2023/TT-UBDT dated August 21, 2023 of the State Committee for Ethnic Affairs amending and supplementing certain articles of Circular No. 02/2022/TT-UBDT dated June 30, 2022 of the Chairman of the State Committee for Ethnic Affairs guiding the implementation of certain projects under the National Target Program for Socio-Economic Development in Ethnic Minority and Mountainous Areas for the period 2021-2030, Phase I: from 2021 to 2025.

3. In cases where the cited documents in this Circular are amended, supplemented, or replaced by other documents, the provisions of the amended, supplemented, or replacing documents shall apply.

4. During the implementation process, if there are difficulties, please report them to the Ministry of Ethnic Affairs and Religion for study and appropriate amendment and supplementation.
