Regarding the organization and operation of the Banking Inspection
Pursuant to the Law on the Organization of the Government number 63/2025/QH15;

ChapterI
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree stipulates the organization and inspection activities within the State Bank of Vietnam (hereinafter referred to as the Banking Inspection).
Article 2. Applicability
1. The State Bank of Vietnam (hereinafter referred to as the State Bank), the Governor of the State Bank, the Banking Inspection, the Chief Inspector of the State Bank, the State Bank branch in the Regions (State Bank Region), the Director of the State Bank Region, the Banking Inspection of the State Bank Region, the Chief Inspector of the State Bank Region, the Head of the Inspection Team, members of the Inspection Team, inspectors of the State Bank, agencies, organizations, individuals related to the inspection activities of the State Bank.
2. The inspected entities in banking as provided for in Article 3 of this Decree.
Article 3. Inspected entities in banking
1. Agencies, organizations, and individuals under the management authority of the State Bank.
2. Vietnamese agencies, organizations, and individuals; foreign agencies, organizations, and individuals in Vietnam who have obligations to implement laws and regulations on currency and banking operations within the scope of state management of the State Bank.
3. The inspection of agencies, organizations, and individuals who are members of the International Financial Center in compliance with laws and regulations on currency and banking operations shall be carried out in accordance with the provisions of the law on the International Financial Center in Vietnam.
Article 4. Principles of banking inspection activities
1. Banking inspection activities shall be conducted in accordance with the Law on Inspection, the provisions of this Decree, and relevant laws.
2. Ensuring democracy, transparency, objectivity, timeliness, accuracy, and compliance with jurisdiction, contributing to ensuring the safety of the monetary and banking system.
3. Avoid overlapping in scope and time between inspection agencies, between inspection agencies and the state auditing agency; avoid overlapping in exercising rights during the inspection process.
Article 5. Implementation of independent auditing to serve the needs of banking inspection
1. The State Bank has the right to require inspected entities in banking to conduct partial or full auditing of organizational structure, operations, and finances to serve the needs of banking inspection in the following cases:
a) When it is necessary to assess the current financial status or when the data and documents provided by the inspected entity in banking show signs of discrepancy and lack credibility;
b) When the content of the inspection exceeds the professional expertise, technical capabilities, or resources of the inspection team;
c) Other cases as prescribed by law or decided by the Governor of the State Bank.
2. Within thirty days from the date of receiving the request for auditing from the State Bank, the inspected entity in banking must hire an independent auditing organization to conduct the audit; within five days from the date of obtaining the audit results, the inspected entity required to conduct the audit must submit the audit report to the State Bank.
3. The inspected entity in banking that must conduct independent auditing as stipulated in Clause 1 of this Article must pay for the costs of independent auditing.
Chapter II
ORGANIZATION OF THE BANKING INSPECTION
Article 6. Organization of the Banking Inspectionof the State Bank
The organization of the Banking Inspection includes:
1. The State Bank Inspection.
2. The State Bank Regional Inspection.
Article 7. Banking Inspection State
1. The State Bank of Vietnam's Banking Inspection is an administrative organization within the organizational structure of the State Bank of Vietnam, assisting the Governor of the State Bank of Vietnam in state management of inspection work, receiving citizens, handling complaints and denunciations, and preventing corruption and wastefulness; conducting inspections on agencies, organizations, and individuals under the Governor's jurisdiction and within the scope of the State Bank of Vietnam's state management; performing tasks of receiving citizens, handling complaints and denunciations, and preventing corruption, wastefulness, and negative practices according to the provisions of the law.
The State Bank of Vietnam's Banking Inspection is subject to the direction and management of the Governor of the State Bank of Vietnam and is subject to the direction regarding inspection work and guidance on business procedures from the Government Inspector General.
2. The State Bank of Vietnam's Banking Inspection has a Chief Inspector, Deputy Chief Inspectors, inspectors, and other civil servants.
The appointment, reappointment, dismissal, removal, transfer, rotation, and assignment of the Chief Inspector of the State Bank of Vietnam's Banking Inspection shall be carried out by the Governor of the State Bank of Vietnam after receiving written comments from the Government Inspector General.
3. The State Bank of Vietnam's Banking Inspection has its own seal.
Article 8. Tasks and Authorities of the Chief Inspector of the State Bank of Vietnam's Banking Inspection
1. Leading, directing, inspecting, and supervising inspection work within the scope of the State Bank of Vietnam's state management; leading the State Bank of Vietnam's Banking Inspection to perform inspection tasks and authorities according to the provisions of the law.
2. Directing the development, issuance, and implementation of the inspection plan of the State Bank of Vietnam's Banking Inspection.
3. Deciding on the responsibility inspection of the heads of agencies and units under the Governor's management in the implementation of laws on inspection, receiving citizens, handling complaints and denunciations, and preventing corruption, wastefulness, and negative practices.
4. Deciding on the inspection of cases within the authority when signs of law violations by the inspected objects are discovered; inspecting other cases when assigned by the Governor of the State Bank of Vietnam.
5. Requesting the Director of the State Bank of Vietnam's Regional Branch to direct the Regional Branch's Banking Inspection to conduct inspections on inspected objects that have been assigned by the Governor of the State Bank of Vietnam when signs of law violations are discovered; if the Director of the State Bank of Vietnam's Regional Branch does not comply with the request, report to the Governor of the State Bank of Vietnam for consideration and decision.
6. Deciding on the re-inspection of cases that have already been concluded by the Regional Branch's Banking Inspection based on the provisions of Clause 1, Article 25 of the Inspection Law.
7. Imposing administrative penalties or recommending competent authorities to impose administrative penalties according to the provisions of the law on administrative penalty handling.
8. Handling overlaps and repetitions between the activities of the State Bank of Vietnam's Banking Inspection and other inspection agencies; reporting to the Government Inspector General for consideration and decision on handling overlaps and repetitions between the activities of inspection agencies. Cooperating with the National Audit Office to avoid overlaps and repetitions during inspection and audit operations.
9. Recommending the Governor of the State Bank of Vietnam to suspend, within his authority, the execution of decisions contrary to the law in the field of state management of the State Bank of Vietnam discovered through inspections.
10. Recommending the Governor of the State Bank of Vietnam to resolve issues related to inspection work.
11. Recommending agencies and persons with authority to amend, supplement, or issue documents to meet management requirements; recommending suspension, cancellation, or abolition of regulations contrary to the law discovered through inspections.
12. Recommending the Governor of the State Bank of Vietnam to direct the implementation of the contents of inspection conclusions according to the provisions of Article 52 of the Inspection Law. Directing the monitoring, urging, and checking of the implementation of inspection conclusions and timely handling of arising issues. Reporting the results of implementing inspection conclusions to the Governor of the State Bank of Vietnam.
13. Recommending the Governor of the State Bank of Vietnam to consider responsibilities and handle organizations and individuals under his management who violate the law discovered through inspections or fail to implement, fully implement, or promptly implement inspection conclusions, recommendations, and decisions on handling inspections; requesting the heads of agencies and organizations to consider responsibilities and handle organizations and individuals under their management who violate the law discovered through inspections or fail to implement, fully implement, or promptly implement inspection conclusions, recommendations, and decisions on handling inspections.
14. Recommending the Governor of the State Bank of Vietnam to issue a document requiring inspected objects to conduct independent audits to serve inspection needs.
15. Receiving and resolving recommendations about the content of inspection conclusions from inspected objects and agencies, organizations, and individuals related to the content of the State Bank of Vietnam's Banking Inspection's inspection conclusions.
16. Resolving complaints against decisions and actions of himself, the Head of the Inspection Team, and members of the Inspection Team according to the provisions of the law.
17. Performing other tasks and authorities as prescribed by law or assigned by the Governor of the State Bank of Vietnam.
Article 9. Banking Inspection at the Regional Level Scope
1. The Banking Inspection at the Regional Level is an organizational unit under the structure of the State Bank of Vietnam at the Regional Level, responsible for inspecting banking inspection objects within the jurisdiction of the Director of the State Bank of Vietnam at the Regional Level and within the scope of state management on the local territory according to the division and delegation of authority by the Governor of the State Bank of Vietnam; it performs tasks related to receiving citizens, handling complaints, accusations, preventing corruption, waste, and negative practices in accordance with the provisions of the law.
The Banking Inspection at the Regional Level is subject to the direction and management of the Director of the State Bank of Vietnam at the Regional Level and is subject to the direction regarding inspection work and business guidance from the Banking Inspection of the State Bank of Vietnam.
2. The Banking Inspection at the Regional Level has an Inspector-in-Chief, Deputy Inspector-in-Chief, inspectors, and other civil servants.
The Inspector-in-Chief of the Banking Inspection at the Regional Level is appointed, reappointed, relieved of duty, dismissed, transferred, rotated, or detailed by the Governor of the State Bank of Vietnam based on the proposal of the Director of the State Bank of Vietnam at the Regional Level and the written opinion of the Inspector-in-Chief of the Banking Inspection of the State Bank of Vietnam.
3. The Banking Inspection at the Regional Level has its own seal.
Article 10. Duties and Authorities of the Inspector-in-Chief of the Banking Inspection at the Regional Level
1. Leading and directing inspection work within the scope of management of the State Bank of Vietnam at the Regional Level; leading the Banking Inspection at the Regional Level to perform duties and authorities as prescribed in this Decree and other relevant legal documents.
2. Directing the development, issuance, and implementation of the inspection plan of the Banking Inspection at the Regional Level.
3. Deciding to inspect the compliance with policies and laws by agencies, organizations, and individuals in areas under the scope of state management of the State Bank of Vietnam at the Regional Level.
4. Deciding to inspect cases within their jurisdiction when signs of law violations by banking inspection objects are discovered; inspecting other cases when assigned by the Director of the State Bank of Vietnam at the Regional Level.
5. Imposing administrative penalties or recommending competent authorities to impose administrative penalties in accordance with the law on handling administrative violations.
6. Handling overlaps and repetitions between activities of the Banking Inspection at the Regional Level and other inspection agencies.
7. Recommending the Director of the State Bank of Vietnam at the Regional Level to suspend, within their authority, the execution of decisions contrary to the law in the field of state management of the State Bank of Vietnam at the Regional Level discovered through inspections.
8. Recommending agencies and competent authorities to amend, supplement, or issue documents to meet management requirements; recommending suspension, cancellation, or abolition of regulations contrary to the law discovered through inspections.
9. Recommending the Director of the State Bank of Vietnam at the Regional Level to direct the implementation of the contents of inspection conclusions as stipulated in Article 52 of the Inspection Law. Directing the monitoring, urging, and checking the implementation of inspection conclusions and timely addressing arising issues. Reporting the results of implementing inspection conclusions to the Director of the State Bank of Vietnam at the Regional Level.
10. Recommending the Director of the State Bank of Vietnam at the Regional Level to consider responsibility and handle organizations and individuals under their management who have violated the law discovered through inspections, or who have not implemented, fully or promptly implemented inspection conclusions, recommendations, and decisions on handling inspections.
11. Proposing to the Director of the State Bank of Vietnam at the Regional Level to recommend the Governor of the State Bank of Vietnam to issue a document requiring banking inspection objects to conduct independent audits to serve the needs of banking inspections.
12. Receiving and resolving recommendations about the content of inspection conclusions from inspected objects and agencies, organizations, and individuals related to the content of inspection conclusions of the Banking Inspection at the Regional Level.
13. Resolving complaints against their own decisions, actions, or those of the Head of the Inspection Team or members of the Inspection Team in accordance with the law.
14. Performing other tasks and authorities as prescribed by law or assigned by the Director of the State Bank of Vietnam at the Regional Level.
Chapter III
ACTIVITIES OF THE BANKING INSPECTION DEPARTMENT
Article 11. Construction and issuance of annual inspection plans
1. The annual inspection plan of the Banking Inspection includes the inspection plan of the State Bank of Vietnam Inspection and the inspection plan of the Regional State Bank Inspection; ensuring that there is no overlap or duplication in inspection activities between the State Bank of Vietnam Inspection and the Regional State Bank Inspection.
2. Not later than November 20 each year, the Chief Inspector of the State Bank of Vietnam shall base on the Inspection Program Orientation, guidelines of the Government Inspectorate, and requirements for socio-economic development tasks and management work within the jurisdiction of the State Bank of Vietnam to submit the inspection plan of the State Bank of Vietnam Inspection to the Governor of the State Bank of Vietnam for consideration and comments.
Not later than November 30 each year, the Governor of the State Bank of Vietnam shall provide comments in writing on the inspection plan of the State Bank of Vietnam Inspection. The Chief Inspector of the State Bank of Vietnam shall issue the inspection plan not later than five working days from the date of receipt of the Governor's comments. The annual inspection plan of the State Bank of Vietnam Inspection shall be immediately sent to the Government Inspectorate, the National Audit Office, and the Regional State Bank Inspection; at the same time, it shall be notified to the inspected banking entities and relevant agencies and units for implementation.
3. Based on the Inspection Program Orientation, guidelines of the Government Inspectorate, the Chief Inspector of the State Bank of Vietnam shall guide the Regional State Bank to build the annual inspection plan.
Not later than December 10 each year, the Chief Inspector of the Regional State Bank shall base on the guidance on building the inspection plan of the State Bank of Vietnam Inspection and management requirements in the region to submit the inspection plan of the Regional State Bank Inspection to the Director of the Regional State Bank for consideration and comments.
Not later than December 15 each year, the Director of the Regional State Bank shall provide comments in writing on the inspection plan of the Regional State Bank Inspection. The Chief Inspector of the Regional State Bank shall issue the inspection plan not later than five working days from the date of receipt of the Director's comments. The annual inspection plan of the Regional State Bank Inspection shall be immediately sent to the Director of the Regional State Bank and the State Bank of Vietnam Inspection; at the same time, it shall be notified to the inspected banking entities and relevant agencies and units for implementation.
Article 12. Basis for issuing inspection decisions and announcing inspection decisions
1. Issuing an inspection decision must be based on one of the grounds specified in Clause 1, Article 26 of the Inspection Law.
2. Announcing an inspection decision shall be carried out through direct or online methods.
Article 13. Inspection Team Logbook
1. The head of the inspection team is responsible for organizing the recording of the Inspection Team Logbook. The recording of the Inspection Team Logbook must ensure accuracy, objectivity, and truthfulness regarding contents related to the activities of the Inspection Team from the announcement of the inspection decision to the issuance of the inspection conclusion. The Inspection Team Logbook shall be stored in the inspection file.
2. The Inspection Team Logbook may be recorded in the form of a logbook or electronic logbook.
3. Management and use of the electronic logbook shall be carried out according to the guidelines of the Chief Government Inspectorate.
Article 14. Inspection Period
1. The period for conducting an inspection by the State Bank of Vietnam Inspection shall not exceed 45 days; in complex cases or in mountainous, border, island, remote, and difficult-to-reach areas, it may be extended once, not exceeding 25 days.
2. The period for conducting an inspection by the Regional State Bank Inspection shall not exceed 30 days; in complex cases or in mountainous, border, island, remote, and difficult-to-reach areas, it may be extended once, not exceeding 10 days.
Article 15. Supervision of Inspection Team Activities
The person issuing the inspection decision is responsible for supervising the activities of the Inspection Team. If necessary, the person issuing the inspection decision may issue a decision assigning civil servants or establishing a Supervision Group to supervise the activities of the Inspection Team (referred to collectively as the supervisor), specifying clearly the content, composition, time, and method of supervision.
The content of supervision of Inspection Team activities shall be implemented in accordance with Clause 2, Article 32 of the Inspection Law.
Article 16. Report on the Results of Inspection
1. After completing the inspection process, the Head of the Inspection Team shall be responsible for preparing a report on the results of the inspection to be submitted to the person who issued the inspection decision. The content of the report on the results of the inspection shall be carried out in accordance with the provisions of Clause 1, Clause 2, and Clause 3 of Article 33 of the Inspection Law.
2. The time for preparing the report on the results of the inspection shall be calculated from the date the Inspection Team completes the direct inspection process and shall be regulated as follows:
a) For inspections conducted by the State Bank Inspectorate, the time for preparing the report on the results of the inspection shall not exceed twenty days, and may be extended but not more than thirty days in complex cases;
b) For inspections conducted by the Regional State Bank Inspectorate, the time for preparing the report on the results of the inspection shall not exceed fifteen days, and may be extended but not more than twenty-five days in complex cases.
Article 17. Inspection Conclusion
1. Within five working days from the date of receipt of the report on the results of the inspection, the person who issued the inspection decision shall instruct the Head of the Inspection Team to prepare a draft inspection conclusion.
The time for preparing the draft inspection conclusion shall be calculated from the date the person who issued the inspection decision assigns the preparation of the draft inspection conclusion and shall be regulated as follows:
a) For inspections conducted by the State Bank Inspectorate, the time for preparing the draft inspection conclusion shall not exceed twenty days, and may be extended but not more than thirty days in complex cases;
b) For inspections conducted by the Regional State Bank Inspectorate, the time for preparing the draft inspection conclusion shall not exceed fifteen days, and may be extended but not more than twenty-five days in complex cases.
2. The draft inspection conclusion of the State Bank Inspectorate must be reviewed before signing and promulgating. The draft inspection conclusion of the Regional State Bank Inspectorate shall be reviewed when necessary. The review of the draft inspection conclusion shall be carried out in accordance with the provisions of Article 35 of the Inspection Law.
3. Within fifteen days from the date of receipt of the draft inspection conclusion, the person who issued the inspection decision shall sign and promulgate the inspection conclusion and bear responsibility for their conclusions and recommendations.
Article 18. Publicizing the Inspection Conclusion
1. The person who issued the inspection decision shall be responsible for determining the content of the inspection conclusion to be publicized in accordance with the provisions of Clause 2 of Article 37 of the Inspection Law. The time and form of publicizing the inspection conclusion shall be implemented in accordance with the provisions of Clause 1 and Clause 3 of Article 37 of the Inspection Law.
2. After being publicized, the inspection conclusion shall be sent to the relevant agencies, organizations, and individuals as follows:
a) For inspections conducted by the State Bank Inspectorate, the inspection conclusion must be sent to the Governor of the State Bank, the General Inspector of the Government, the inspected banking entity, and related agencies, organizations, and individuals;
b) For inspections conducted by the Regional State Bank Inspectorate, the inspection conclusion must be sent to the Director of the Regional State Bank, the State Bank Inspectorate, the inspected banking entity, and related agencies, organizations, and individuals.
Article 19. Coordination and Handling Overlap and Duplication in Banking Inspection Activities
1. The Banking Industry Inspectorate shall be responsible for coordinating in activities such as state audit, investigation, prosecution, and inspection in accordance with the provisions of Articles 56, 57, and 58 of the Inspection Law.
2. Overlap and duplication in inspection activities among inspection agencies shall be handled as follows:
a) Overlap and duplication between the inspection activities of the State Bank Inspectorate and other inspection agencies shall be handled in accordance with the regulations of the Government;
b) Overlap and duplication between the inspection activities of the State Bank Inspectorate and the Regional State Bank Inspectorate shall be conducted by the State Bank Inspectorate;
c) Overlap and duplication between the Regional State Bank Inspectorate and the Provincial Inspectorate or other inspection agencies shall be resolved through exchanges between the Heads of the Inspectorates;
d) The Head of the Regional State Bank Inspectorate shall be responsible for coordination in activities and regular exchanges with other Regional State Bank Inspectorates to avoid overlap and duplication during inspections and audits.
Chapter IV
RESPONSIBILITIES OF AGENCIES, ORGANIZATIONS, AND INDIVIDUALS IN THE ACTIVITIES OF THE BANKING INSPECTION INDUSTRY
RESPONSIBILITIES OF AGENCIES, ORGANIZATIONS, AND INDIVIDUALS IN THE ACTIVITIES OF THE BANKING INSPECTION INDUSTRY
Article 20. Responsibilities of the Governor of the State Bank
1. Lead and direct the inspection activities of the banking sector within the State Bank's management scope.
2. Provide comments on the annual inspection plan of the State Bank Inspectorate.
3. Require the State Bank Inspectorate and the Regional State Bank to instruct the Regional State Bank Inspectorate to conduct inspections when signs of law violations are detected or according to the requirements for handling complaints, accusations, anti-corruption, anti-waste, anti-passivity, or as assigned or requested by competent authorities.
4. Ensure the operation of the State Bank Inspectorate; do not illegally interfere with inspection activities. Urge and inspect to ensure that inspection conclusions are issued within the prescribed time limit.
5. Promptly address inspection recommendations, direct the implementation of inspection conclusions, and direct the monitoring, urging, and inspecting of the implementation of inspection conclusions and decisions on inspection handling.
a) Within fifteen days from the date of receipt of the inspection conclusion, the Governor of the State Bank shall issue a directive document to implement the inspection conclusion in accordance with Clause 1 and Clause 2, Article 53 of the Inspection Law, except for cases stipulated in point b of this clause. Consider and handle difficulties and obstacles in implementing the State Bank Inspectorate's inspection conclusion to ensure effective state management.
b) For inspection conclusions of the Government Inspectorate, within thirty days from the date of receipt of the inspection conclusion, the Governor of the State Bank shall issue a document to organize the implementation of the inspection conclusion for contents within his authority.
6. Resolve complaints against inspection handling decisions made by himself and by agencies and individuals directly under his management in accordance with the law on complaints.
7. Ensure conditions to strengthen inspection activities and promote professional, standardized, and modernized inspection activities, contributing to enhancing the effectiveness of state management.
8. Other responsibilities as prescribed by law.
Article 21. Responsibilities of the Directorof the Regional State Bank
1. Lead and direct the inspection activities of the Regional State Bank Inspectorate within the Regional State Bank's management scope.
2. Provide comments on the annual inspection plan of the Regional State Bank Inspectorate.
3. Require the Regional State Bank Inspectorate to conduct inspections when signs of law violations are detected in inspected banks or according to the requirements for handling complaints, accusations, anti-corruption, anti-waste, anti-passivity, or as assigned or requested by the Governor of the State Bank or competent authorities.
4. Ensure the operation of the Regional State Bank Inspectorate; do not illegally interfere with inspection activities. Urge and inspect to ensure that inspection conclusions are issued within the prescribed time limit.
5. Promptly address inspection recommendations, direct the implementation of inspection conclusions, and direct the monitoring, urging, and inspecting of the implementation of inspection conclusions and decisions on inspection handling.
a) Within fifteen days from the date of receipt of the inspection conclusion, the Director of the Regional State Bank shall issue a directive document to implement the inspection conclusion in accordance with Clause 1 and Clause 2, Article 53 of the Inspection Law, except for cases stipulated in point b of this clause. Consider and handle difficulties and obstacles in implementing the Regional State Bank Inspectorate's inspection conclusion to ensure effective state management.
b) For inspection conclusions of the State Bank Inspectorate, within twenty days from the date of receipt of the inspection conclusion, the Director of the Regional State Bank shall issue a document to organize the implementation of the inspection conclusion for contents within his authority.
c) For inspection conclusions of the Government Inspectorate, within thirty days from the date of receipt of the inspection conclusion, the Director of the Regional State Bank shall issue a document to organize the implementation of the inspection conclusion for contents within his authority.
6. Resolve complaints against inspection handling decisions made by himself and by agencies and individuals directly under his management in accordance with the law on complaints.
7. Ensure conditions to strengthen the inspection activities of the Regional State Bank Inspectorate and promote professional, standardized, and modernized inspection activities, contributing to enhancing the effectiveness of state management.
8. Other responsibilities as prescribed by law.
Article 22. Responsibilities, rights, and obligations of the inspected banking entity and related agencies, organizations, and individuals
1. The inspected banking entity shall have responsibilities, rights, and obligations as prescribed in Articles 41, 42, 50, and 54 of the Inspection Law, Article 53 of the State Bank of Vietnam Law, and Article 208 of the Credit Organizations Law.
2. Agencies, organizations, and individuals possessing information and documents related to the banking inspection must provide them fully, promptly, and accurately according to the requirements of the Banking Inspection Authority and as stipulated in this Decree and other relevant laws.
3. Agencies, organizations, and individuals provided with information, documents, and inspection results by the Banking Inspection Authority must responsibly manage and use them for their intended purposes and in accordance with the law; they may not use such information, documents, and inspection results to negatively impact the stability and safety of banking operations and credit organizations, including foreign bank branches.
Chapter V
IMPLEMENTING PROVISIONS
Article 23. Effectiveness of Implementation
1. This Decree shall take effect from January 15, 2026.
2. The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central city administrations, and related agencies, organizations, units, and individuals shall be responsible for implementing this Decree.
