Guidelines for Implementing Short-term Vocational Training Support Policies for Rural Labor

Based on the State Budget Law and guiding documents for implementing the State Budget Law;

Based on Decision No. 81/2005/QĐ-TTg dated April 18, 2005, of the Government Chairman regarding short-term vocational training support policies for rural labor;

The Ministry of Finance and the Ministry of Labor, Invalids, and Social Affairs provide guidelines for implementing short-term vocational training support policies for rural labor as follows:

I. APPLICABLE OBJECTS

The objects eligible to apply for short-term vocational training support under this Circular are rural laborers within working age who have not previously received vocational training, have a need for vocational training, meet the admission criteria for short-term vocational training courses, and are selected in the following priority order:

1. Laborers from households whose agricultural land has been reclaimed due to urbanization or construction of public works, industrial zones, export processing zones, and other national security projects for the benefit of the country, with a need for vocational training to change their professions;

2. Laborers belonging to groups entitled to preferential policies for persons with meritorious service to the revolution according to the law;

3. Laborers from ethnic minority groups and particularly difficult communes as decided by the Prime Minister;

4. Unemployed female laborers;

5. Laborers from traditional craft villages included in projects to restore and develop traditional crafts where the project does not have separate funding for vocational training;

6. Laborers from specialized farming areas who wish to change their occupations;

7. Other rural laborers who wish to receive vocational training.

II. ORGANIZING SHORT-TERM VOCATIONAL TRAINING FOR RURAL LABORERS

1. Conditions for Supporting Short-term Vocational Training

Short-term vocational training courses for the aforementioned target group shall be supported financially when they meet the following conditions:

a. The course has been approved by the People's Committees of provinces and centrally-administered cities in the annual support plan and lasts for at least one month;

b. The class size ranges from 25 to 30 trainees;

c. The training program must be developed, reviewed, and approved in accordance with Decision No. 212/2003/QĐ-BLĐTBXH dated February 27, 2003, of the Minister of Labor, Invalids, and Social Affairs on principles for developing and implementing vocational training programs;

d. Trainees completing the course must be examined and evaluated; if they meet the requirements, they will be issued a vocational certificate in accordance with Decision No. 1012/1998/QĐ-BLĐTBXH dated October 9, 1998, of the Minister of Labor, Invalids, and Social Affairs on issuing vocational certificates and Decision No. 1536/1998/QĐ-BLĐTBXH dated December 1, 1998, of the Minister of Labor, Invalids, and Social Affairs on temporarily regulating the issuance and management of vocational certificates.

2. Training Fields

Training fields are determined based on the demand for labor mobility and economic-social development needs of localities as decided by the People's Committees of provinces and centrally-administered cities.

3. Entities Conducting Vocational Training

Organizing short-term vocational training for rural laborers is carried out by vocational training institutions and other training entities with vocational training functions at both provincial and central levels within the locality. Mobile training methods are encouraged to facilitate access and reduce costs for trainees.

III. USE AND MANAGEMENT OF FUNDS FOR SHORT-TERM VOCATIONAL TRAINING FOR RURAL LABORERS

1. Sources of Funds for Short-term Vocational Training for Rural Laborers:

a. Local budget allocated from the annual regular education and vocational training funds;

b. Central budget supplemented with specific targets from the "Strengthening Vocational Training Capacity" Project under the National Target Program on Education and Training for provinces that cannot balance their budgets and have a large number of rural laborers;

c. Integration from national target programs and other projects on the local level;

d. Contributions from trainees;

đ. Mobilization from enterprises and other lawful sources.

2. Level of Training Support

The level of support for vocational training is calculated based on the actual number of graduates from each course, but not exceeding 300,000 VND per person per month and not more than 1,500,000 VND per person per course. The specific level of support for each course is determined by the People's Committees of provinces and centrally-administered cities in accordance with local conditions.

3. Content and Levels of Expenditure

a. Costs for organizing classes include:

- Costs for enrollment, opening, closing ceremonies, and issuing vocational certificates;

- Remuneration for theoretical instructors and practical guidance instructors;

- Rental fees for classrooms and equipment (if applicable);

- Management costs for the class.

Expenditure levels are in accordance with current state regulations.

b. Costs for vocational training materials;

c. Costs for compiling programs and textbooks (for trades without existing teaching programs and textbooks) applied according to the expenditure level for secondary vocational education as stipulated in Circular No. 87/2001/TT-BTC dated October 30, 2001, of the Ministry of Finance on the content and expenditure levels for building framework programs for higher education, college, and secondary vocational education and compiling subject textbooks.

The above expenditure items are supported through vocational training institutions and not directly provided to trainees.

4. In addition to the above expenditure items and levels of support for vocational training, depending on the specific conditions of each course, each trainee, local government budget capacity, and other mobilized resources, the People's Committees of provinces and centrally-administered cities may consider and decide additional support for living expenses, travel, and accommodation for trainees.

5. Funds for supporting short-term vocational training for rural laborers are managed, utilized, and settled by the Provincial Departments of Labor, Invalids, and Social Affairs.

1. Ministry of Finance:

a. Summarize financial resource needs annually for short-term vocational training for rural laborers and submit them to the Government for consideration and to the National Assembly;

b. Coordinate with the Ministry of Labor, Invalids, and Social Affairs to inspect and supervise the implementation of these policies by localities.

2. The Ministry of Labor, Invalids and Social Affairs:

a. Guide localities in developing five-year and annual plans for short-term vocational training for rural laborers;

b. Summarize and evaluate the implementation situation of short-term vocational training for rural workers; propose annual resource needs to be sent to the Ministry of Finance and the Ministry of Planning and Investment for consolidation and submission to the Government for consideration, and to the National Assembly;

c. Take the lead and coordinate with the Ministry of Finance to monitor, urge, and inspect and supervise the implementation situation of localities;

3. Provincial People's Committees under the Central Government:

a. Develop support plans for short-term vocational training for rural workers to be submitted to the People's Council for decision; based on the plan approved by the People's Council, the provincial People's Committee shall approve the annual plan regarding targets and funding for short-term vocational training for rural workers in their respective areas, and instruct the Department of Labor, Invalids and Social Affairs to implement it;

b. Summarize and evaluate the implementation situation of short-term vocational training for rural workers in their respective areas; propose annual resource needs to be sent to the Ministry of Labor, Invalids and Social Affairs for consolidation and reporting to the Government;

c. Allocate resources and specify expenditure levels for each course; direct, inspect the implementation of the annual plan for short-term vocational training for rural workers in their respective areas;

4. The Department of Labor, Invalids and Social Affairs:

a. Develop the annual plan regarding targets and funding for short-term vocational training for rural workers, to be submitted to the provincial People's Committee for approval;

b. Publicly announce the annual plan regarding targets and funding that has been approved to districts, counties, towns; communes, wards, townships and vocational training institutions within the province to register the number of trainees;

c. Contract with vocational training institutions meeting the conditions (including non-state vocational training institutions) to organize short-term vocational training courses for rural workers according to the plan and expenditure level approved by the provincial People's Committee;

d. Maintain records, tally the number of trainees supported with training funding for each course, ensuring that only the specified groups defined in Section I of this Circular receive short-term vocational training funding;

e. Inspect, supervise, urge vocational training institutions to implement; compile and report results every six months to the provincial People's Committee and the Ministry of Labor, Invalids and Social Affairs (according to Form No. 1 attached to this Circular);

f. Manage, utilize, and settle accounts for vocational training support funding for rural workers in accordance with the State Budget Law and guiding documents;

5. The Department of Finance: Coordinate with the Department of Labor, Invalids and Social Affairs to inspect, supervise, and manage vocational training funding according to assigned functions and tasks;

6. Vocational training institutions participating in vocational training for rural workers:

a. Organize recruitment, provide training to the correct target group and content as stipulated in the contract signed with the Department of Labor, Invalids and Social Affairs;

b. Use funds for the intended purpose effectively, without waste; collect and retain financial receipts and payment vouchers in accordance with current accounting regulations; bear responsibility for the legality and rationality of these vouchers;

c. Conduct inspections, evaluations, and issue certificates to trainees who meet requirements immediately upon completion of the course;

7. Workers participating in vocational training:

a. Choose a profession and vocational training institution according to the guidance of the Department of Labor, Invalids and Social Affairs;

b. Submit an application for vocational training with confirmation from the People's Committee of the commune, ward, township where they have permanent residence registration (Form No. 2 attached to this Circular) to the chosen vocational training institution;

c. Sign a vocational training contract with the vocational training institution after the training application is accepted; perform duties and enjoy rights of trainees as stipulated currently;

V. EFFECTIVE DATE

This Circular takes effect fifteen days after its publication in the Official Gazette. The Joint Circular No. 65/2004/TTLT/BTC-BLDTBXH dated July 2, 2004 of the Ministry of Finance and the Ministry of Labor, Invalids and Social Affairs guiding the implementation of funding for short-term vocational training for rural workers is hereby abolished. Any difficulties encountered during implementation should be reported to the relevant ministries for consideration and resolution./.
