of the Prime Minister on continuing to implement support for relocation and settlement of ethnic minority groups until 2022;June 2024;The Ministers of the National Ethnic Minorities Committee,policies the Minister of Financeâhereby issue this Circular guiding the implementation of support for relocation and settlement of ethnic minority groups until 2015.No. This Circular guides the policy supporting relocation and settlement (hereinafter referred to as "Settlement") for households of ethnic minority groups (hereinafter referred to as "households") still practicing shifting cultivation and nomadic lifestyles in difficult areas as defined in Decision No. 30/2007/QĐ-TTg dated March 5, 2007 of the Prime Minister on issuing the List of Administrative Units in Difficult Areas and Decision No. 1733/QĐ-TTg dated October 29, 2009 recognizing Administrative Units in Difficult Areas in Gia Lai Province.

Households practicing shifting cultivation and nomadic lifestyles must meet all three criteria below:June 2024;a) Not having stable land for production under their right of use according to State regulations;"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."This Circular guides the determination of beneficiaries, conditions, methods of support, and the organization and implementation of housing support for poor households in rural areas or poor households residing in villages, hamlets, villages, communes, wards, or settlements (collectively referred to as villages) directly under towns, urban districts, or communes directly under district-level cities, provincial-level cities, as provided for in Article 2 of Decision No. 33/2015/QĐ-TTg dated August 10, 2015 of the Prime Minister on housing support policies for poor households according to the poverty standard during the period 2011-2015 (hereinafter referred to as Decision No. 33/2015/QĐ-TTg).of ethnic minority groups until 2022âb) Unstable place of residence, far from populated areas, moving residences according to production locations;15;

Article 2. Support Policies 1. Article 1. Scope of Regulation and Applicability

Thông tư này quy định chi tiết khoản 4 Điều 38 Luật Thủy sản số 18/2017/QH14 đã được sửa đổi, bổ sung tại điểm c khoản 21 Điều 14 Luật số 146/2025/QH15.

- Rural roads and community roads leading to Settlement points (Class B rural roads and community roads ensuring motorbike access);

Thông tư này áp dụng đối với tổ chức, cá nhân có liên quan đến hoạt động kinh doanh đối tượng thủy sản nuôi chủ lực trên lãnh thổ Việt Nam.

- Electricity supply to concentrated Settlement points;

- Small-scale irrigation works for production;

- Water supply facilities;

- Classrooms and kindergartens;

- Community houses for villages and hamlets;

- Other essential projects based on local needs;

b) For intermixed Settlement points: The State budget supports the commune budget with VND 20 million per household for compensation for residential and production land taken from local households and transferred to relocated households according to regulations; any surplus funds may be used to supplement the investment and upgrade essential infrastructure in the commune;

c) Support for community development staff at concentrated Settlement points, including: one health worker and one agricultural extension worker; the level of support is equivalent to the salary grade 1 of civil servants and public officials as stipulated in Decree No. 204/2004/NĐ-CP dated December 14, 2004, Decree No. 76/2009/NĐ-CP dated September 15, 2009, and Decree No. 66/2013/NĐ-CP dated June 27, 2013 of the Government; the support period is 3 years starting from when households move to new Settlement points;

d) Support for applying scientific and technological knowledge and new seeds in the first three years of production, VND 30 million per village or hamlet annually (for concentrated Settlement points).

2. Direct support for households practicing shifting cultivation and nomadic lifestyles implementing Settlement

a) Households practicing shifting cultivation and nomadic lifestyles implementing Settlement (including both concentrated and intermixed Settlement) are allocated residential and production land according to the minimum area specified in Decision No. 134/2004/QĐ-TTg dated July 20, 2004 of the Prime Minister on certain support policies for production land, residential land, housing, and water supply for poor households of ethnic minorities with difficult living conditions and Decision No. 198/2007/QĐ-TTg dated December 31, 2007 of the Government amending and supplementing some articles of Decision No. 134/2004/QĐ-TTg;

b) Average support of VND 15 million per household for constructing housing, developing production, purchasing food for the first six months after relocation, and water supply; specific support levels for each household and purpose are determined by the provincial People's Committee;

c) For intermixed Settlement households according to plans, they are supported VND 1 million per household for leveling land for housing;

d) Support for relocation expenses from old residences to new Settlement locations (based on actual project planning); the support amount is determined based on actual distance and the common fare for transportation means in the locality;

- Implementation method: The project investor organizes the relocation through the project management board or directly assigns households to relocate themselves. Depending on actual conditions, the provincial People's Committee specifies the methods for organizing relocation to Settlement points;

e) After relocation to Settlement points, households enjoy current policies like local residents; priority is given to loans from the Social Policy Bank under Decision No. 54/2012/QĐ-TTg dated December 4, 2012 of the Prime Minister and related implementing guidelines to develop production and improve living standards.

- Certain other essential works as required by the actual needs of the locality;

b) For intermixed relocation points: The state budget shall support the commune budget at a rate of VND 20 million per household for land compensation and production land for local households whose land has been expropriated and transferred to relocated households according to the prescribed regime; any surplus funds may be used to supplement the investment and upgrade essential infrastructure of the commune;

c) Support for community development staff (employees) at concentrated relocation points, including: one medical worker and one agricultural and forestry extension worker; the level of support is equivalent to the salary grade 01 stipulated in Decree No. 204/2004/NĐ-CP dated December 14, 2004, Decree No. 76/2009/NĐ-CP dated September 15, 2009, and Decree No. 66/2013/NĐ-CP dated June 27, 2013 of the Government; the period of support is three years from when the households move to the new relocation point;

d) Support for applying science and technology, new seeds in production during the first three years, VND 30 million per year per village or hamlet (concentrated relocation points);

2. Direct support for households engaged in shifting cultivation and settlement

a) Households engaged in shifting cultivation and settlement (including both concentrated and intermixed relocation) shall be allocated residential and production land according to the minimum area specified in Decision No. 134/2004/QĐ-TTg dated July 20, 2004 of the Prime Minister on certain policies supporting production land, residential land, housing, and drinking water for poor ethnic minority households with difficult living conditions, and Decision No. 198/2007/QĐ-TTg dated December 31, 2007 of the Government amending and supplementing certain provisions of Decision No. 134/2004/QĐ-TTg;

b) Average support of VND 15 million per household for building houses, developing production, purchasing food for the first six months upon arrival at the relocation point, and drinking water; the specific amount of support for each household and purpose shall be determined by the provincial People's Committee;

c) For intermixed relocation households according to the plan, they will be supported with VND 1 million per household for house foundation construction;

d) Support for relocation expenses for households moving from their previous residence to the relocation site (based on actual costs when preparing the project); the level of support is determined based on the actual distance and the common fare of transportation means in the locality;

- Implementation method: The project sponsor shall organize the relocation through the project management board, or directly assign households to relocate themselves. Depending on actual conditions, the provincial People's Committee shall specify the methods for organizing relocation to the relocation site;

đ) After relocating to the relocation point, households shall enjoy current policies applicable to local residents, including priority access to loans from the Social Policy Bank under Decision No. 54/2012/QĐ-TTg dated December 4, 2012 of the Prime Minister and related implementing regulations to develop production and improve living standards.

Article 3. Sources of funds and use of funds

1. The State budget supplements targeted funding to local budgets for implementing the support policies stipulated in Article 2 of this Circular.

2. Local budgets are responsible for allocating funds for propaganda, mobilization of households within the target group to voluntarily implement concentrated residential development; managing, measuring, issuing certificates of land use rights, ownership of houses and other assets attached to the land for households that have completed residential development; supplementing funding (if any) to implement relocation policies according to Article 2 of this Circular.

3. Provincial People's Committees are responsible for mobilizing and integrating Program 135 funds and other policies, programs, and projects on the provincial level to implement residential development for households of ethnic minority groups.

Article 4. Budget Estimates and Allocation of Funds

1. Preparation of budget estimates and allocation of funds

a) Annually, based on the number of households practicing shifting cultivation and nomadic residence receiving support; the number of concentrated and intermixed residential development points approved by the Prime Minister under Decision No. 1342/QĐ-TTg, the Department of Finance shall take the lead in coordinating with the Ethnic Work Agency at the provincial level and the Department of Planning and Investment to advise the Provincial People's Committee in preparing budget estimates for implementing Decision No. 33/2013/QĐ-TTg, itemized by each policy component; clearly identifying sources of support from the Central Government budget, local government budget, and other program/project/policy funds, and submitting them to the Ministry of Finance, the National Ethnic Council, and the Ministry of Planning and Investment for consolidation and submission to the Prime Minister;

b) Based on the targeted supplementary budget allocated by the Prime Minister, local government budget (if any), integrated program/project funds, and other mobilized funds for implementing Decision No. 33/2013/QĐ-TTg, the Ethnic Work Agency at the provincial level shall coordinate with the Department of Finance and the Department of Planning and Investment to develop detailed budget allocation plans for each task and each district, town, city within the province (hereinafter referred to as district) and submit them to the Provincial People's Committee for approval by the Provincial People's Assembly in the local budget estimate for 2014 and 2015;

c) Based on the resolution of the Provincial People's Assembly, the Provincial People's Committee shall allocate the budget to districts (detailed by each task). Based on the amount of funds allocated by the Provincial People's Committee, the District People's Committee shall decide on the allocation and notify the Commune People's Committee (hereinafter referred to as commune) of detailed tasks and households eligible for benefits according to the list decided by the competent authority;

d) Based on the decision of the District People's Committee, the Commune People's Committee shall publicly announce the support levels to each village, residential development point, and household according to each supported policy and benefit system;

2. Consolidation and allocation of capital annually, based on the central government budget estimate and reports on the implementation of residential development projects in provinces, the National Ethnic Council shall consolidate and prepare the capital plan for implementing Decision No. 33/2013/QĐ-TTg, submit it to the Ministry of Finance and the Ministry of Planning and Investment for consolidation and submission to the Prime Minister; prioritizing capital distribution for unfinished residential development projects lacking funds to complete construction works and residential development projects in some provinces and areas with many ethnic minority households migrating in and out to stabilize their lives, develop production, limit spontaneous migration, and reduce impacts on security and public order in the destination areas;

Article 5. Management, Distribution, and Payment

Issuance and payment of funds for implementing the policies stipulated in Decision No. 33/2013/QĐ-TTg to agencies, units, and households must ensure compliance with objectives and beneficiaries, especially direct payments in cash (or in kind) to households; the Commune People's Committee shall prepare a list for each household implementing residential development, sign off on receipt, and fully comply with prescribed procedures and documents. Specifically:

1. For community investment support

a) Investment capital support Advance payments and settlement of capital for projects and constructions (land compensation, clearance, leveling of residential land, opening up agricultural land; building roads, small-scale electricity, irrigation systems, water supply systems, classrooms, kindergartens, and communal facilities in villages and other essential facilities according to actual needs) shall be carried out in accordance with the Construction Law, Bidding Law, Land Law, and current guiding documents;

b) Management and issuance of funds for supporting community development staff and applying new science and technology shall be implemented in accordance with the State Budget Law and its implementing regulations.

2. Direct support to households practicing shifting cultivation and nomadic residence for residential development

a) Regarding housing construction, water supply infrastructure, production development, and food purchase support

- For housing construction and water supply infrastructure:

+ In cases where households construct themselves but require advance funding to purchase materials, the Commune People's Committee shall compile a list of households requesting advances, and the finance agency shall process the advance through the State Treasury to the Commune People's Committee, which will then provide the advance to the households. The maximum advance amount equals 60% of the total state budget support for each household;

Upon completion of the project, based on the acceptance results for each household confirmed by the Commune People's Committee, the finance agency shall issue a payment order through the State Treasury to the Commune People's Committee to settle the accounts with the households and simultaneously recover the advanced amounts;

+ In cases where households require material supply, the Commune People's Committee shall compile the material requirements of the households. Based on the quantity of materials registered by the households and the specific conditions of each village, the Commune People's Committee (or a unit assigned by the Commune People's Committee) shall enter into contracts with material suppliers to provide materials to the households in the villages;

Based on the delivery record of materials supplied to each household (signed by the household head and confirmed by the village representative) and the request of the Commune People's Committee, the finance agency shall issue a payment order to the State Treasury to settle the accounts with the material suppliers according to current regulations;

+ In cases where households are unable to construct their own housing and water supply infrastructure. Based on the number of households registered and the specific conditions of each village, the Commune People's Committee (or a unit assigned by the Commune People's Committee) shall enter into contracts with contractors (or introduce and guide households to enter into contracts with contractors) to build housing and water supply infrastructure for the households;

BASED ON THE HANDOVER PROTOCOL BETWEEN THE CONTRACTOR AND EACH HOUSEHOLD (WITH THE SIGNATURE OF THE HEAD OF THE HOUSEHOLD AND THE ACKNOWLEDGEMENT OF THE VILLAGE REPRESENTATIVE) AND THE REQUEST OF THE PROVINCE/CITY LEVEL PEOPLE'S COMMITTEE; THE FINANCE AUTHORITY ISSUES AN ORDER TO TRANSFER FUNDS TO THE STATE TREASURY FOR PAYMENT TO THE CONTRACTOR IN ACCORDANCE WITH CURRENT REGULATIONS.

- REGARDING SUPPORT FOR PRODUCTION DEVELOPMENT AND PURCHASE OF GRAIN

BASED ON THE LIST OF SUPPORT FOR HOUSEHOLDS APPROVED BY THE AUTHORIZED BODY AND THE APPLICATIONS OF HOUSEHOLDS ON THE METHODS OF IMPLEMENTATION; THE PROVINCE/CITY LEVEL PEOPLE'S COMMITTEE SUMMARIZES THE NEEDS AND CLASSIFIES THEM ACCORDING TO THE METHODS OF IMPLEMENTATION (RECEIVING IN KIND OR IN CASH) AND SENDS IT TO THE FINANCE AUTHORITY AS A BASIS FOR INSPECTION, CONTROL, AND ISSUE OF FUNDS FOR IMPLEMENTATION. THE DISTRIBUTION AND PAYMENT SHALL BE CONDUCTED AS FOLLOWS:

+ FOR HOUSEHOLDS RECEIVING IN KIND: BASED ON THE APPLICATION LIST OF HOUSEHOLDS, THE SUPPLY CONTRACT BETWEEN THE AUTHORIZED BODY AND THE SUPPLIER; THE QUANTITY HANDOVER PROTOCOL BETWEEN THE SUPPLIER AND EACH HOUSEHOLD (WITH THE SIGNATURE OF THE HEAD OF THE HOUSEHOLD AND THE ACKNOWLEDGEMENT OF THE VILLAGE REPRESENTATIVE) AND THE REQUEST OF THE PROVINCE/CITY LEVEL PEOPLE'S COMMITTEE, THE FINANCE AUTHORITY WILL CHECK AND ISSUE AN ORDER TO TRANSFER FUNDS TO THE STATE TREASURY FOR PAYMENT TO THE SUPPLIERS;

+ FOR HOUSEHOLDS RECEIVING IN CASH: BASED ON THE LIST OF HOUSEHOLDS REGISTERED WITH THE CONFIRMATION OF THE PROVINCE/CITY LEVEL PEOPLE'S COMMITTEE, THE FINANCE AUTHORITY WILL ISSUE AN ORDER TO TRANSFER FUNDS THROUGH THE STATE TREASURY TO THE PROVINCE/CITY LEVEL PEOPLE'S COMMITTEE FOR PAYMENT TO THE HOUSEHOLDS.

b) SUPPORT FOR HOUSEHOLDS TO CREATE HOUSE FOUNDATIONS (AT MIXED SETTLEMENT POINTS) AND SUPPORT FOR MOVEMENT COSTS

BASED ON THE LIST OF HOUSEHOLDS APPROVED BY THE AUTHORIZED BODY, THE PROVINCE/CITY LEVEL PEOPLE'S COMMITTEE GUIDES LOCAL ASSOCIATIONS AND COMMUNITY TO ASSIST HOUSEHOLDS IN IMPLEMENTATION. THE FINANCE AUTHORITY WILL ISSUE AN ORDER TO TRANSFER FUNDS THROUGH THE STATE TREASURY TO THE PROVINCE/CITY LEVEL PEOPLE'S COMMITTEE FOR PAYMENT TO THE HOUSEHOLDS BASED ON THE RESULTS OF THE QUANTITY ACCEPTANCE AND PROJECT (IF ANY) OF THE PROVINCE/CITY LEVEL PEOPLE'S COMMITTEE.

ARTICLE 6. ACCOUNTING REPORTS AND FINAL ACCOUNTS

THE AMOUNT OF CENTRAL BUDGET FUNDS ADDED WITH SPECIFIC PURPOSES FOR THE LOCAL BUDGET TO IMPLEMENT DECISION NUMBER 33/2013/QĐ-TTg IS RECORDED AND SETTLED IN THE LOCAL BUDGET IN ACCORDANCE WITH CURRENT REGULATIONS;

THE PROVINCE/CITY LEVEL PEOPLE'S COMMITTEE AND THE COUNTY FINANCE DEPARTMENT ARE RESPONSIBLE FOR COORDINATING WITH THE STATE TREASURY AND OTHER RELATED AUTHORITIES TO MONITOR THE CAPITAL DISTRIBUTION FOR IMPLEMENTATION OF DECISION NUMBER 33/2013/QĐ-TTg; MONTHLY, THE PROVINCE/CITY LEVEL PEOPLE'S COMMITTEE AND THE COUNTY FINANCE DEPARTMENT REPORT TO THE COUNTY PEOPLE'S COMMITTEE ON THE RESULTS AND PROGRESS OF CAPITAL PAYMENTS, WHICH ARE THEN SUBMITTED TO THE DEPARTMENT OF FINANCE AND THE ETHNIC MINORITY AFFAIRS OFFICE AT THE PROVINCIAL LEVEL FOR COMBINED REPORTING TO THE PROVINCIAL PEOPLE'S COMMITTEE;

THE PROVINCE/CITY LEVEL PEOPLE'S COMMITTEE REPORTS THE IMPLEMENTATION PROGRESS QUARTERLY, YEAR-END, AND SUBMITS THE FINAL ACCOUNTS TO THE ETHNIC MINORITY COMMISSION, THE MINISTRY OF FINANCE, AND THE MINISTRY OF PLANNING AND INVESTMENT.

Article 7. Implementation Organization

1. THE PROVINCE/CITY LEVEL PEOPLE'S COMMITTEE TASKS THE ETHNIC MINORITY AFFAIRS OFFICE AT THE PROVINCIAL LEVEL TO LEAD AND COOPERATE WITH RELATED DEPARTMENTS AND SECTIONS OF THE PROVINCE TO ADVISE THE PROVINCE/CITY LEVEL PEOPLE'S COMMITTEE:

a) TO GUIDE THE COUNTY PEOPLE'S COMMITTEES IN DEVELOPING IMPLEMENTATION PLANS FOR RESIDENTIAL SETTLEMENT PROJECTS, IDENTIFYING IMPLEMENTATION OBJECTIVES IN THE LOCAL AREA, AND IMPLEMENTING ACCORDING TO ANNUAL PLANS;

b) TO SUMMARIZE AND COOPERATE WITH THE DEPARTMENT OF FINANCE AND THE DEPARTMENT OF PLANNING AND INVESTMENT TO DEVELOP THE NATIONAL BUDGET ESTIMATE PLAN FOR IMPLEMENTING THE ETHNIC MINORITY SETTLEMENT POLICY AT THE PROVINCIAL LEVEL AND REPORT TO THE PROVINCE/CITY LEVEL PEOPLE'S COMMITTEE;

c) TO ISSUE REGULATIONS ON RAISING AND INCORPORATING RESOURCES TO IMPLEMENT THE POLICY SUITABLE TO LOCAL CONDITIONS;

d) TO IMPLEMENT AND MONITOR, FOLLOW UP, AND EVALUATE THE IMPLEMENTATION OF RESIDENTIAL SETTLEMENT PROJECTS ACCORDING TO THE PLAN, ENSURING EFFECTIVENESS AND SUSTAINABILITY; TO SUMMARIZE THE IMPLEMENTATION RESULTS AND REPORT TO THE PROVINCE/CITY LEVEL PEOPLE'S COMMITTEE.

2. EVERY SIX MONTHS AND ANNUALLY, THE PROVINCE/CITY LEVEL PEOPLE'S COMMITTEE REPORTS THE IMPLEMENTATION RESULTS OF THE ETHNIC MINORITY SETTLEMENT POLICY TO THE ETHNIC MINORITY COMMISSION, THE MINISTRY OF PLANNING AND INVESTMENT, AND THE MINISTRY OF FINANCE FOR COMBINED REPORTING.

Article 8. Effective Date

THIS CIRCULAR TAKES EFFECT FROM FEBRUARY 10, 2014 AND REPLACES CIRCULAR NUMBER 03/2007/TT-UBDT OF JUNE 8, 2007 OF THE ETHNIC MINORITY COMMISSION GUIDING THE IMPLEMENTATION OF THE POLICY TO SUPPORT ETHNIC MINORITY POPULATIONS IN RESIDENTIAL SETTLEMENTS FOR THE PERIOD 2007-2010 AND CIRCULAR NUMBER 99/2007/TT-BTC OF AUGUST 10, 2007 OF THE MINISTRY OF FINANCE GUIDING THE FINANCIAL MECHANISM FOR IMPLEMENTING ETHNIC MINORITY SETTLEMENT WORK ACCORDING TO DECREE NUMBER 33/2007/QĐ-TTg OF MARCH 5, 2007 OF THE PRIME MINISTER.

ANY DIFFICULTIES ENCOUNTERED DURING IMPLEMENTATION SHOULD BE REFLECTED TO THE ETHNIC MINORITY COMMISSION AND THE MINISTRY OF FINANCE FOR REVIEW AND RESOLUTION./.
