Article 1. Scope of Regulation

Article 2. Applicability

3. Employees in public institutions as prescribed in the Civil Service Law 2010;
4. Persons working under labor contracts in agencies and units of the Party, State, and political-social organizations according to Decree No. 68/2000/NĐ-CP dated November 17, 2000 of the Government on implementing the system of certain types of work contracts in administrative state agencies and public institutions;y Under public institutions according to the decision of the Prime Minister;

Article 3. Basic Salary Levelin
1. As of July 1, 2013, the base salary is VND 1,150,000 per month.
a) The base salary will be adjusted based oncouncillORSthe State budget capacity, inflation rate, and economic growth rate of the country.
b) Utilizing 10% of the regular expenditure savings (excluding salaries and salary-like items) according to the approved budget for 2013 of administrative agencies and public institutions.
c) Utilizing at least 40% of retained revenue and fees according to the 2013 regulations of administrative agencies and public institutions; for service revenue, utilizing at least 40% of the difference between income and expenses from service activities. For public health institutions, utilizing at least 35% of retained revenue (after deducting drug, blood, transfusion fluid, chemical, and consumable costs).
2. Utilizing 50% of local government additional revenue, excluding revenue from land use fees (including 50% of actual revenue exceeding the 2012 budget revenue target set by the Prime Minister and 50% of the projected 2013 revenue exceeding the 2012 budget revenue target set by the Prime Minister).
3. Utilizing surplus funds from the implementation of salary reform remaining at the end of 2012 of administrative agencies, public institutions, and local government budgets.êThe Central Government will supplement the funding for the base salary in cases where Ministries, central agencies, and centrally-administered cities and provinces have implemented the provisions of Clauses 1, 2, 3, and 4 of this Article but still lack sufficient resources.无效 The Central Government will support difficult regions that cannot balance their sources to ensure the additional allowance fund for non-professional staff at the commune level, village level, and neighborhood association level as prescribed in Decree No. 29/2013/NĐ-CP dated April 8, 2013 of the Government amending and supplementing some articles of Decree No. 92/2009/NĐ-CP dated October 22, 2009 of the Government regarding positions, number, and some policies for commune-level civil servants and non-professional staff.inThis Decree takes effect from August 15, 2013.
Article 4. Implementation funds
1. The base salary prescribed in this Decree shall be effective from July 1, 2013, and replace the general minimum wage prescribed in relevant documents on salary systems and other systems related to salary issued by competent authorities.
2. Article 5. Effective dateệu Iitselffor implementation
1. Nghị định này có hiệu lực thi hành kể từ ngày 15 tháng 8 năm 2013.
2. Mức lương cơ sở quy định tại Nghị định này được tính hưởng kể từ ngày 01 tháng 7 năm 2013 và thay thế mức lương tối thiểu chung quy định tại các văn bản về chế độ tiền lương và các chế độ khác có liên quan đến tiền lương của cơ quan có thẩm quyền.
Article 6. Responsibilities for guidance and implementation

b) Thẩm định và bổ sung kinh phí thực hiện mức lương cơ sở cho các Bộ, cơ quan Trung ương và các tỉnh, thành phố trực thuộc Trung ương theo quy định tại Khoản 5 Điều 4 và bổ sung có mục tiêu đối với những địa phương khó khăn theo quy định tại Khoản 6 Điều 4 Nghị định này; kết thúc năm, tổng hợp báo cáo Thủ tướng Chính phủ kết quả thực hiện.
