DECREE
Amending and supplementing certain Articles of Decree No. 92/2009/NĐ-CP dated October 22, 2009 of the Government on titles, number, some benefits, and policies for cadres and civil servants at commune, ward, town levels and non-professional workers at commune level
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Public Officials and Civil Servants dated November 13, 2008;
||| Based on the proposal of the Minister of Home Affairs;
The Government promulgates this Decree amending and supplementing certain Articles of Decree No. 92/2009/NĐ-CP dated October 22, 2009 of the Government on titles, number, some benefits, and policies for cadres and civil servants at commune, ward, town levels and non-professional workers at commune level.
Article 1. Amending and supplementing certain Articles of Decree No. 92/2009/NĐ-CP dated October 22, 2009 of the Government on titles, number, some benefits, and policies for cadres and civil servants at commune, ward, town levels and non-professional workers at commune level
1. Supplementing the end of Point c Clause 1 Article 5 as follows:
"For the Chairman of the Vietnam Veterans Association at the commune level who is currently receiving retirement benefits, in addition to the current retirement pension, he shall be entitled to receive 100% of the salary grade 1 of the current position according to Point a Clause 1 Article 5 of this Decree and shall not have to contribute to social insurance and health insurance. After five years (60 months) of being ranked at grade 1, if he fulfills assigned tasks and does not receive disciplinary action during this period, he shall be entitled to receive 100% of the salary grade 2 of the current position."
2. Supplementing Clause 3b after Clause 3 Article 16 as follows:
"3b. Those who had worked as commune-level cadres before January 1, 1998, and during this time held positions specified in Decree No. 09/1998/NĐ-CP dated January 23, 1998 of the Government amending and supplementing Decree No. 50/CP dated July 26, 1995 of the Government on living allowances for commune, ward, town cadres, and were subsequently mobilized, recruited into the People's Army, Public Security Force, or employed in state agencies, units, enterprises, political organizations, or political-social organizations, the time spent in such positions before January 1, 1998, which has not been counted towards monthly allowance or one-time allowance, shall be considered as time contributing to social insurance."
3. Article 14 shall be amended and supplemented as follows:
Non-professional workers at commune level shall enjoy subsistence allowances and health insurance benefits. The central budget shall allocate a subsistence allowance fund, including 3% for health insurance, to pay monthly for non-professional workers at commune level as follows:
1. Commune type 1 shall be allocated a subsistence allowance fund equivalent to 20.3 months of the national minimum wage;
2. Commune type 2 shall be allocated a subsistence allowance fund equivalent to 18.6 months of the national minimum wage;
3. Commune type 3 shall be allocated a subsistence allowance fund equivalent to 17.6 months of the national minimum wage."
4. Clause 3 Article 19 shall be amended and supplemented as follows:
"3. Implementing the benefits and policies stipulated in this Decree for non-professional workers at village and neighborhood levels. The central budget shall allocate a subsistence allowance fund, including 3% for health insurance, to pay monthly for non-professional workers at each village and neighborhood as follows:
a) For villages in key and complex security areas according to the decision of the competent authority; villages in border, island communes; villages in financially difficult communes according to the regulations of the Ministry of Finance and villages in commune types 1 and 2 shall be allocated a subsistence allowance fund equivalent to 5.0 months of the national minimum wage;
b) For villages outside the provisions of Point a of this Clause and neighborhoods shall be allocated a subsistence allowance fund equivalent to 3.0 months of the national minimum wage."
5. Supplementing Clause 3b after Clause 3 Article 19 as follows:
"3b. Based on the subsistence allowance fund, including 3% for health insurance, allocated by the central budget for each commune, village, and neighborhood as stipulated in Article 14 and Clause 3 Article 19 of this Decree, taking into account the specific circumstances of each commune, village, and neighborhood, management requirements, local funds for salary reform, and the provisions of this Decree; Decree No. 38/2006/NĐ-CP dated April 17, 2006 of the Government on protecting people's security; Decree No. 73/2009/NĐ-CP dated September 7, 2009 of the Government detailing the implementation of certain articles of the Law on Village Police; Decree No. 58/2010/NĐ-CP dated June 1, 2010 of the Government detailing and guiding the implementation of certain articles of the Law on Civil Defense Militia; Decision No. 75/2009/QĐ-TTg dated May 11, 2009 of the Prime Minister on the regulation of subsistence allowances for health workers in villages and hamlets, the People's Committee of the province shall submit to the Provincial People's Council to specify the following contents:
a) Specifying the number and titles of non-professional workers at commune, village, and neighborhood levels;

c) Specifying the detailed amount of operational funding for political-social organizations at commune, village, and neighborhood levels to ensure suitability with the actual situation of the locality.”
Article 2. Effective Date
This Decree takes effect from June 1, 2013.
Article 3. Responsibility for Implementation
1. The Ministry of Finance shall guide the accounting of expenditures as prescribed in this Decree.
2. The Ministry of Labor, Invalids and Social Affairs shall guide the implementation of Clause 3b Article 16 of this Decree.
3. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of provincial People's Committees, directly governed municipalities, and related agencies, organizations, and individuals are responsible for implementing this Decree./.
