CIRCULAR

Issuing economic and technical standards for managing and maintaining inland waterways

Circular No. 10/2023/TT-BGTVT dated June 22, 2023, issued by the Minister of Transport on Economic and Technical Standards for Managing and Maintaining Inland Waterways, which took effect from September 1, 2023, was amended and supplemented by:

Circular No. 01/2025/TT-BGTVT dated January 6, 2025, issued by the Minister of Transport to supplement certain contents of the Economic and Technical Standards for Managing and Maintaining Inland Waterways issued together with Circular No. 10/2023/TT-BGTVT dated June 22, 2023, issued by the Minister of Transport, which took effect from March 1, 2025.

BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;

Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019, issued by the Government, stipulating the assignment of tasks, placing orders, or tendering for the provision of products and services using state budget funds from regular expenditure;

Pursuant to Decree No. 45/2018/NĐ-CP dated March 13, 2018, issued by the Government, stipulating the management, use, and operation of infrastructure assets for inland waterway transport;

At the proposal of the Director of the Infrastructure Department and the Director of the Vietnam Inland Waterway Administration;

The Minister of Transport issues this Circular on Economic and Technical Standards for Managing and Maintaining Inland Waterways^[1].

Article 1. Scope of Regulation

This Circular hereby promulgates the Economic and Technical Standards for Managing and Maintaining National Inland Waterways.

Article 2. Applicability

Article 1. This Circular applies to agencies, organizations, and individuals related to the management and maintenance of national inland waterways.

Article 2. The economic and technical standards promulgated with this Circular serve as the basis for preparing and approving budgets and service prices for public services in managing and maintaining national inland waterways.

Article 3. For local inland waterways and specialized inland waterways, the economic and technical standards promulgated with this Circular may be applied.

Article 4. For work in managing and maintaining inland waterways where maintenance is carried out based on actual volume, the economic and technical standards and approved service prices serve as the basis for acceptance, payment, settlement, and cost management.

Article 5. For work in managing and maintaining the infrastructure of inland waterways where maintenance is carried out based on actual quality, the economic and technical standards serve as the basis for determining maintenance contract prices. Acceptance, payment, and settlement are carried out based on the assessment of the results of management and maintenance according to actual performance.

Article 3. Implementation Provisions^[2]

Article 1. This Circular takes effect from September 1, 2023.

Article 2. Repeal Circular No. 64/2014/TT-BGTVT dated November 10, 2014, issued by the Minister of Transport on Economic and Technical Standards for Managing and Maintaining Inland Waterways and Circular No. 25/2016/TT-BGTVT dated October 3, 2016, issued by the Minister of Transport amending and supplementing the Economic and Technical Standards for Managing and Maintaining Inland Waterways promulgated with Circular No. 64/2014/TT-BGTVT dated November 10, 2014, issued by the Minister of Transport on Economic and Technical Standards for Managing and Maintaining Inland Waterways.

Article 3. For contracts for managing and maintaining inland waterways signed before this Circular takes effect, they shall continue to be implemented until the end of the contract; if the contract is adjusted to include additional volumes, the additional volumes shall apply the Economic and Technical Standards promulgated with this Circular.

Article 4. For works in managing and maintaining national inland waterways not specified in the Economic and Technical Standards promulgated with this Circular, similar standards issued by competent authorities shall be applied on the principle of ensuring economic and technical feasibility, or the relevant authorities shall organize the establishment and submission to the Ministry of Transport for decision-making.

Article 4. Organization of Implementation

The Head of the Ministry's Office, the Inspector General, the Directors of Departments, the Director of the Vietnam Inland Waterway Administration, and the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.

^[1] Circular No. 01/2025/TT-BGTVT supplementing certain contents of the Economic and Technical Standards for Managing and Maintaining Inland Waterways promulgated with Circular No. 10/2023/TT-BGTVT dated June 22, 2023, issued by the Minister of Transport, is based on the following grounds:

At the proposal of the Director of the Infrastructure Department and the Director of the Vietnam Inland Waterway Administration;

The Minister of Transport issues this Circular supplementing certain contents of the Economic and Technical Standards for Managing and Maintaining Inland Waterways promulgated with Circular No. 10/2023/TT-BGTVT dated June 22, 2023, issued by the Minister of Transport.”

^[2] Article 2 of Circular No. 01/2025/TT-BGTVT supplements certain contents of the Economic and Technical Standards for Management and Maintenance of Inland Waterways issued together with Circular No. 10/2023/TT-BGTVT dated June 22, 2023, of the Minister of Transport, which shall take effect from March 1, 2025, as follows:

“Article 2. Implementation clause

This Circular shall take effect from March 1, 2025.”
