Rules on organizing activities, using electronic mail and

websites of higher education institutions

Pursuant to the Law on Electronic Transactions dated November 29, 2005;

Pursuant to the Law on Information Technology dated June 29, 2006;

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007, stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 64/2007/NĐ-CP dated April 10, 2007 of the Government on the application of information technology in the operation of state agencies;

Pursuant to Decree No. 97/2008/NĐ-CP dated August 28, 2008 of the Government on management, provision, and use of Internet services and electronic information on the Internet;

Pursuant to Directive No. 34/2008/CT-TTg dated December 3, 2008 of the Prime Minister on enhancing the use of email systems in the operation of state agencies;

The Ministry of Education and Training hereby stipulates rules on organizing activities and using electronic mail and websites of higher education institutions as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This document regulates the organization of activities and the use of electronic mail (email) and websites of higher education institutions.

2. This document applies to organizations and individuals related to higher education institutions within the national education system including universities, academies, colleges, and research institutes assigned the task of training master's and doctoral level students.

Article 2. Interpretation of Terms

1. Electronic information portal is the sole access point for educational management agencies and educational institutions on the network environment, linking and integrating various information channels, services, and applications through which users can exploit and utilize.

1. Website (website) is a place for providing and exchanging public information on the Internet. A website may include multiple web pages, among which the Home page or First page is the first page displayed when opening the website. Information on web pages is transmitted through multimedia techniques: text, sound, voice, graphics, charts, images, video, and live television broadcasts. Access to information on other web pages can be achieved through hyperlinks.

2. Portal (portal) is a website integrating various channels of information, services, and applications according to a unified method, accessible through a single point of entry for users.

Websites or portals of higher education institutions hereinafter referred to collectively as Website.

3. Web Conference (web conference) is a form of virtual meeting or virtual class organized via the web, where participants can exchange information through video images, voice, presentations, screen sharing, file sharing, instant messaging (chat), polls, and other utilities.

4. Webinar (webinar) is a form of unidirectional information broadcast to multiple participants through accessing a specific website; information includes events such as lectures, reports, presentations, and may include audio and visual elements from a presenter.

5. 3. Method of receiving reply documents: (Choose one of the two methods below) (email) is a means of communication and information exchange through electronic mailboxes on the Internet of organizations and individuals. Each mailbox has a name consisting of personal-name@domain-name.

6. Domain Name (domain name) of higher education institutions is the registered ownership name of the institution on the Internet. Higher education institutions in Vietnam must have a second-level domain name of edu.vn. The domain name of higher education institutions (hereinafter referred to as personal-domain-name) is structured as follows:

Code-of-higher-education-institution.edu.vn

Research institutes assigned the task of training master's and doctoral level students may use a domain name structured as Code-of-higher-education-institution.ac.vn

Where Code-of-higher-education-institution is a short abbreviation in Vietnamese or English of the higher education institution.

7. Online Public Service is an administrative public service and other services of state agencies provided to organizations and individuals on a network environment. Online public services are evaluated at different levels:

a) Level 1 online public service: ensures the provision of complete information about procedures, formalities; documents; deadlines; fees and charges for implementing the service.

b) Level 2 online public service: is a Level 1 online public service that allows users to download and fill out forms to complete their documents as required. Completed documents are sent directly or by post to the agency or organization providing the service.

c) Level 3 online public service: is a Level 2 online public service that allows users to fill out and submit forms online to the agency or organization providing the service. Transactions during the processing of documents and provision of services are conducted over the network. Payment of fees (if applicable) and receipt of results are carried out directly at the agency or organization providing the service.

d) Level 4 online public service: is a Level 3 online public service that allows users to pay fees (if applicable) online. Delivery of results can be done online, delivered directly, or sent by post to the user.

Chapter II

ELECTRONIC MAIL

Article 3. Email Box Name

Each higher education institution must establish an email system structured according to a common model: Name-emailbox@Specific-domain.

Article 4. Methods for Establishing an Email System

Higher education institutions may establish an email system through two methods:

1. Setting up their own email server. It is encouraged to exploit and use open-source software for establishment.

2. Using free email services provided under the specific domain of the higher education institution from a service provider. This includes additional services such as text resource sharing and scheduling.

Article 5. Provision of Email Boxes

1. The higher education institution is responsible for providing free email boxes according to the specific domain (including email address and storage space on the server) for:

a) Affiliated units

b) Lecturers, administrative staff, and other employees.

c) Individuals managing email boxes according to their position.

d) Students, graduate students, and doctoral candidates.

2. An individual may manage multiple email boxes: personal email box, position-based email box, unit-named email box.

Article 6. Full Name of Individuals and Groups Receiving Email

1. In the Name-emailbox@Specific-domain format

2. Full display name for recipients to clearly identify:

Last name and first name + Name of affiliated unit + Name of higher education institution

Article 7. Email Group (e-mail group)

Creating email boxes for groups to distribute system management workload and facilitate information exchange and communication within a group.

Article 8. Use of Email Boxes of the Ministry of Education and Training

Higher education institutions use email boxes @moet.edu.vn provided by the Ministry of Education and Training for transactions and receiving operational information sent by the Ministry of Education and Training. The email box name format is as follows:

Where Code-admission-school is the admission code of the university or college issued by the Ministry of Education and Training.

Article 9. Use of Email in Administrative and Operational Work

1. Members of higher education institutions must use email boxes according to the specific domain of the higher education institution when conducting official transactions with agencies, organizations, and individuals.

2. Staff assigned to manage email boxes of their working units are responsible for regularly checking and processing information..

3. Confidential documents may not be sent through the email system.

4. Recipients must verify the origin of the content of the email with the sender through other forms of communication.

5. Documents transmitted through the email system in accordance with legal regulations and guaranteed to be authenticated in electronic transactions will have equivalent legal value to paper documents in transactions between state agencies and sending agencies which may not need to send additional paper documents.

6. Sending and Receiving Information Through the Email System:

Sending emails to notify about downloading legally binding and highly reliable documents published on the website of the higher education institution as stipulated below and on the website of the Ministry of Education and Training:

a) Schedule of work of the higher education institution to affiliated units (in addition to the form of publication on the website as stipulated below);

b) Materials for work exchanges, materials for meetings;

c) Documents sent to agencies for information and reporting;

d) Using the email system to send and receive various types of documents: invitations, circulars, reports at various levels, directive and operational information from leaders, and other documents.

Article 10. Use of email in training activities

1. Units under higher education institutions shall send information, notifications, and materials to relevant lecturers and students.

2. Exchange of information between lecturers and students.

3. Surveying and collecting opinions on training programs and other activities after students graduate.

Article 11. Security and safety measures for information when using email

1. Adhere to regulations on security, safety, and confidentiality of information during the use of email systems, prohibited behaviors, and according to laws, internal rules of higher education institutions, and related state regulations.

2. Prohibition of sending spam emails.

3. Prohibition of intentionally disseminating, forwarding emails containing offensive cultural content, anti-state propaganda, inciting violence and war, causing division among ethnic groups, religions, complaints, denunciations, defaming the school, and causing internal discord.

4. When there are incidents disrupting security and safety of information on the network, immediate notification must be made to responsible persons for handling.

Chapter III

ELECTRONIC WEBSITE

Article 12. Functions of the electronic information portal of higher education institutions

1. Information published on the electronic information portal of higher education institutions has legal validity. (the website of higher education institutions hereinafter referred to as the Website)

2. The Website of higher education institutions is a significant criterion for self-representation of the institution's capacity and its responsibility to publicly disclose information to society and must bear legal responsibility before the law.

Article 13. Tasks of the Website

1. Publicly, fully, accurately, and promptly disclose information of higher education institutions.

2. Establish online relationships between higher education institutions and organizations and individuals both domestically and internationally in accordance with the law.

Article 14. Management of the Website

1. Heads of higher education institutions shall decide to establish an Editorial Board for the Website including leadership of the higher education institution as Chair, editors, and system administrators.

2. Tasks of the Editorial Board for the Website:

a) Building and operating the Website, including components such as network infrastructure, equipment, human resources, training, content, backup, preventing illegal intrusion, antivirus, removing inappropriate information upon discovery;

b) Establishing operational rules and providing information and data from subordinate units. Directing, urging units to provide information and data; reviewing, inspecting, updating additional information;

c) Editing and processing information of various sections and topics;

d) Collecting feedback from visitors; reporting and proposing timely measures to address issues to higher education institution leadership; organizing exchanges and discussions on the website forum;

e) Sending news articles, data of the higher education institution to the Ministry of Education and Training’s Website as prescribed. Updating and promoting useful specialized information pages for higher education institutions and news from the Ministry of Education and Training’s Website.

3. Editors are responsible for managing the content of various information sections on the Website.

4. System administrators (admins) have the task of designing, building, and managing the Website including domain registration and management; managing hosting space or server hosting the Website; classifying, granting permissions, creating accounts, passwords; implementing security and safety measures.

5. Activities on the Website must comply with legal regulations on managing information on the Internet and current related laws.

6. When republishing on the Website, please clearly indicate the source of the cited information.

Article 15. Responsibilities for organizing, providing, and updating information and data on the Website

1. Units under higher education institutions shall be responsible for coordinating, providing fully, accurately, and promptly to the Website all contents of information and data within their management areas as stipulated in Chapter IV of this Regulation.

2. Heads of units under higher education institutions shall be responsible before the leadership of the higher education institution for the information and data provided by their units.

Article 16. Time limit for providing and updating information and data on the Website

Information and data on the Website must be provided and updated quickly and promptly.

1. Immediately after the document and data are signed and stamped on the same day;

2. Not exceeding ten days from the end of other events.

Article 17. General provisions regarding information posted on the Website

1. Clause 2, Article 28 of the Law on Information Technology dated June 29, 2006.

2. Circular No. 09/2009/TT-BGDĐT dated May 7, 2009 of the Minister of Education and Training on Implementing Transparency for Educational Institutions in the National Education System. Higher education institutions shall complete Annexe Forms 20, 21, 22, and 23 of Circular No. 09/2009/TT-BGDĐT annually to post on the Website and submit to the Ministry of Education and Training as prescribed.

The three public disclosures for higher education institutions include:

a)Disclosure of quality education commitments and actual quality of education;

b) Disclosure of conditions ensuring educational quality;

c) Disclosure of financial income and expenditure.

Article 18. Application of technology and standards for the Website

1. Uniformly using only Vietnamese font, Unicode code set, and Vietnamese standard TCVN 6909:2001.

2. Having a full-text search tool.

3. Registering for automatic news reading RSS.

4. Attaching tags or keywords on the Website to serve search work.

5. Applying standards and technologies supporting people with disabilities to access and use information and communication technology as prescribed in Circular No. 28/2009/TT-BTTTT dated September 14, 2009 of the Ministry of Information and Communications.

6. Prioritizing exploitation and use of open-source software to build websites or electronic portals. Prioritizing the use of open document formats when posting information on the Website.

Chapter IV

CONTENT OF INFORMATION ON THE ELECTRONIC INFORMATION PAGE

Article 19. General Information about Organization and Administration

1. Information introducing the organization, functions, tasks, and powers of the higher education institution and each subordinate unit, including:

a) Mission and vision of the higher education institution;

b) Organizational structure diagram;

c) Functions, tasks, and powers of each subordinate unit;

d) Summary of formation and development process;

đ) Full name, position, telephone number, official email address, and duties undertaken by leaders in the unit;

e) Transaction information: address, telephone number, fax number, official email address for transactions and receiving information;

g) List of staff and lecturers (including positions, academic titles and degrees, and official email addresses) of each department, subject area, and subordinate units of the higher education institution;

h) Each subordinate unit of the higher education institution such as departments, subject areas, research centers, computer centers, and research institutes shall have its own webpage within the higher education institution's Website system.

2. Relevant regulatory documents related to the activities of the higher education institution.

3. Information on administrative procedures including:

a) Announcement of the list of online public services being implemented;

b) Procedures, formalities, files, places of receipt, names, and transaction information of the person directly processing the file, time limit for resolution, fees, and charges (if any);

c) Organization of online public services and levels of online implementation as stipulated in Clause 7, Article 2 of this Circular.

4. Information for propaganda, dissemination, guidance on implementing laws, policies, strategies, and planning of the higher education institution.

5. Section for collecting opinions and contributions from organizations and individuals:

a) List of issues seeking opinions;

b) Each issue seeking opinions needs to provide all relevant information and requirements of the issue such as: Full text of the opinion-seeking issue; view the content of comments; email address for receiving opinions and deadline for receiving opinions;

c) Encouraging a section for collecting public opinion surveys.

Article 20. Information page on training activities

1. Training program: training objectives, knowledge, professional skills, foreign language proficiency, and job positions after graduation at various levels and by fields of study; requirements for students' attitudes towards learning.

2. Courses of each academic year and major: public information about teaching instructors and thesis advisors (if any), course objectives, content and schedule, reference materials, methods for assessing students' learning quality.

3. Training activities according to state, local government, and business orders: ordering units, quantity, duration, fields, levels, and training outcomes.

4. Actual education quality: number of students, trainees, and research fellows at various training levels, training systems, and majors, distinguishing the number of students, trainees, and research fellows based on graduation results, state, local government, and business orders, the ratio of graduates who find employment and pursue higher levels within one year after graduation.

Article 21. Student examination and academic performance lookup

1. Examination schedules for courses before examinations.

2. Examination results for courses by class, academic year, faculty, or through individual access accounts depending on the nature of the examination period.

Article 22. Information page on admission examinations

1. Admission examination information for each training level: target examinees, major names and corresponding enrollment quotas, examination blocks, schedules, locations, examination fees, tuition fees, application forms for examinations and admissions, other examination conditions; announcements of examination results, lists of successful candidates; other online public services registration.

2. Examination and admission information of higher education institutions published on the Ministry of Education and Training's Examination and Admission Portal at http://thi.moet.gov.vn, which is official and legally binding information. Higher education institutions create links to the Ministry of Education and Training's Examination and Admission Portal.

3. Before January 15 of the year organizing university and college entrance examinations, specialized staff members of higher education institutions responsible for examinations and admissions must provide and update examination and admission information (major names, enrollment quotas, time, location, and other examination conditions) on the Ministry of Education and Training's Examination and Admission Portal.

After this deadline, higher education institutions are responsible for regularly updating information when changes occur.

4. From the Ministry of Education and Training's Examination and Admission Portal, higher education institutions print out the application form for the corresponding quota of each major; sign, stamp, and send it back to the Ministry of Education and Training.

5. The Ministry of Education and Training's Information Technology Department is responsible for providing each higher education institution with a username and password for self-management and self-publication. Higher education institutions register with the Information Technology Department via the email address [email protected].

Article 23. Information page on master’s degree training

1. List of majors and codes for master’s degree training.

2. Statistical annual reports on master’s degree training over the years.

3. Examination and admission information for master’s degree training as stipulated in Clause 1 of Article 22 of this Circular.

4. Encouraging the establishment of a database of master’s theses for online lookup on the website.

Article 24. Information on Doctoral Training Programs

1. List of specializations and codes for doctoral training programs.

2. Annual statistical yearbooks on doctoral training programs over the years.

3. Content of information on examinations or admissions for doctoral training programs as prescribed in Clause 1, Article 22 of this Circular.

4. List of ongoing doctoral dissertation topics: Names of dissertation topics; research outlines; names of doctoral candidates.

5. List of dissertations after successful defense at the institutional level: Abstracts of dissertations; new points of dissertations; full texts of dissertations; date and location of defense, and a section for recording comments and remarks (if any) from website readers.

6. Successful national-level doctoral dissertations defended before the thesis evaluation board, where the doctoral candidate is responsible for incorporating any feedback (if any) from the thesis evaluation board and publishing the revised full text of the dissertation (if applicable). A search table for doctoral dissertations by specialization name, code, candidate's name, topic name, supervisor(s)' name(s), and summary of new points in the dissertation.

Article 25. Information on Teaching Staff, Management Personnel, and Staff Members

1. Number and titles of teaching staff and management personnel, differentiated by recruitment form and educational qualifications.

2. Brief curriculum vitae of lecturers: full name (with photo), age, years of teaching experience, title, professional qualification, scientific works, teaching and research experience, domestic and international research activities, published articles domestically and internationally; information about the full name of students and doctoral candidates successfully guided to master’s and doctoral degrees, summaries of research topics, and duration of implementation.

3. Number of lecturers, management personnel, and staff members trained and developed; forms, contents, levels, and timeframes for training and development during the academic year and the following two years.

Article 26. Information on Scientific Research Activities, Technology Transfer, Pilot Production, and Consultation Services

1. List of scientific and technological projects or tasks in the last five years, or since establishment for newly established higher education institutions, project leaders and participants, domestic and international partners, timeframes and budgets, summaries of project or research task products, practical applications.

2. Scientific conferences and seminars within the institution: conference and seminar themes, purposes, expected outcomes, dates and locations, number of attendees, and full records and presentation slides.

3. Scientific research works (including reprints of full articles published in conference proceedings, scientific and technological journals both domestically and internationally).

4. Information on student scientific research activities.

Article 27. Information on Book Libraries and Electronic Learning Material Libraries

1. Textbooks and reference materials organized by the institution: names of textbooks (including electronic textbooks), reference materials, publication year, plans for textbook and reference material compilation for various specializations.

2. Library webpage allowing searches for textbooks and reference books, and tracking borrowing and returning of library books. Introduction to the book library: Statistics on the number of books, types, Vietnamese and foreign language books, journals, and other publications.

3. Full-text electronic textbook library page.

4. Open learning resources including presentations, reference materials, laboratory experiment guides, internship report guides, virtual experiments, handwritten drafts of lectures.

5. Introduction to links to open-source software libraries, free or licensed software for students to download and use, including the educational network library:

http://edu.net.vn/media, http://ebook.moet.gov.vn.

Article 28. Information on educational technology, electronic learning (e-Learning)

1. Organize specialized websites for online electronic learning (e-Learning online) to allow students to refer to and support self-study.

2. Organize online training services to serve various types of training such as regular, part-time, and distance education.

3. Exchange experiences in applying information technology in teaching and learning.

Article 29. Organization of virtual meeting rooms and online classrooms

1. Conduct morning meetings, meetings between educational institutions and other organizations within and outside the country.

2. Provide online teaching and learning between locations under higher education institutions, with domestic and international partners.

3. Organize participation in thesis defense boards and scientific reports through networks for remote members.

2. The address of the virtual meeting room does not necessarily have to be within the domain name of the higher education institution's website.

3. Organize storage to replay lectures, presentations, outstanding scientific reports, or those with current relevance on video channels and through virtual classrooms.

4. Organize live broadcasts of important events through virtual classrooms.

5. Organize webinars.

Article 30. Information on planning, finance, bidding, and projects

1. Publicize income and expenditure according to the regulations of the Ministry of Education and Training.

2. Publicize tuition fees and other charges for each academic year and the entire course; scholarship policies and their implementation results for each academic year; sources of income from training contracts, scientific research, technology transfer, production, consulting, and other lawful sources of income.

3. Information on projects and investment items: List of projects being prepared for investment, ongoing projects, completed projects. Each project must include at least the following information: Project name, main objectives, field of expertise, type of project, duration, type of funding, sponsor, status of project implementation.

4. Publicize information on bidding, tendering, and public procurement.

Article 31. Statistical Yearbook on Education

1. The statistical yearbook of higher education institutions for at least the last five years or since establishment for newly established higher education institutions.

2. The statistical yearbook includes the following basic information: Academic year, number of lecturers and teachers, including the number of professors, associate professors, doctors, and masters; number of students, divided according to types and levels of training; number of incoming students; number of graduates.

Article 32. Foreign Language Websites and International Cooperation Information

1. Have websites in English and other foreign languages.

2. Activities related to international cooperation projects.

Article 33. Information on Infrastructure

1. Number and area of lecture halls, classrooms, specialized rooms, and practice workshops.

2. Information on dormitories: Number, area, location, registration conditions, rental fee (if applicable), dormitory rules.

3. Area and location of sports and cultural activity zones.

4. Types of training and experimental equipment used.

Article 34. Information on Support Services for Learning and Living

1. Career counseling and vocational guidance.

2. Scholarships, student loans, and other supporting services for students.

3. Answer inquiries from students regarding issues related to higher education institutions.

Article 35. Information on Quality Assessment of Education

Publicly disclose information on quality assessment of educational institutions and education programs including: plans for quality assessment of education, self-assessment reports, external evaluation reports, and recognition of meeting or not meeting the standards of educational quality.

Article 36. Other Information

1. A forum page for exchanging opinions on activities of higher education institutions.

2. Information about Party organizations, Youth Union organizations, and other mass organizations.

3. Press releases, interview responses, and official statements of higher education institutions regarding related issues.

Article 37. Forms of Providing and Updating Information and Data on the Website

1. Information and data from units under higher education institutions shall be sent to the Website Editorial Board.

a) Through the email address [email protected].

b) Or through other data storage means.

2. Time for updating information:

a) For administrative and management documents: Announced immediately after signing and stamping for issuance;

b) For news and events: Provide information promptly, no later than 24 hours after the activity or event occurs.

Article 38. Creating Links to Information and Data with the Website of the Ministry of Education and Training

Enhance the dissemination and sharing of information and data on the Website of the Ministry of Education and Training through links to the following important pages:

1. Legal regulatory text page http://vanban.moet.gov.vn

IMPLEMENTATION

Article 39. Funding for the Website and Email

1. The funding for the website and email of the higher education institution is balanced within the budget estimate of the higher education institution.

2. The funding for the website of the higher education institution is allocated for:

a) Investment and upgrading of infrastructure and equipment; construction and upgrading of website software; renting space for hosting the website;

b) Provision of internet connection devices to ensure continuous 24-hour access for network administrators and chief editors to monitor, manage, and update website information;

c) Management work, remuneration for contributors, editors, and staff of the website;

d) The level of expenditure is implemented according to current state regulations.

Article 40. Organization of Evaluation of Website and Email Activities

1. Annually, the Ministry of Education and Training organizes evaluations, rankings, and publishes results and rankings based on the order of activities of the email system and the content of information on the website of higher education institutions.

2. For emails: Evaluate the percentage of teachers and students provided with email accounts by the higher education institution;

3. For websites:

a) Evaluate the degree of compliance with the information items specified in this Circular;

b) Evaluate the implementation of online public services;

c) Evaluate accuracy;

d) Evaluate the timeliness of information updates;

e) Evaluate according to criteria for transparency implementation for higher education institutions.

4. Evaluate the updating of information on the Ministry's Test and Admission Portal.

5. The evaluation results are publicly announced annually on the Ministry of Education and Training’s website http://www.moet.gov.vn. These results are used by the Ministry of Education and Training for:

a) Quality assessment of education;

b) Evaluation of competition activities for higher education institutions.

Article 41. Responsibilities of units under the Ministry of Education Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and measures for implementing the Law on Enacting Legal Normative Documents; Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing certain provisions of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and measures for implementing the Law on Enacting Legal Normative Documents;

1. The Information Technology Department is responsible for:

a) Directing, urging, and guiding the implementation of the contents of this Circular;

b) Organizing training, supporting services and technology for website creation, online meetings, and web-based training; establishing a separate email system for higher education institutions with such needs;

c) Annually organizing the evaluation and ranking of websites of higher education institutions and publicly announcing them on the website of the Ministry of Education and Training.

2. Units under the Ministry of Education and Training shall use information on the websites of higher education institutions as official sources with legal value for their operational work.

Article 42. This Circular takes effect from April 1, 2010.

Article 43. The Director of the Office, Heads of units under the Ministry of Education and Training; Heads of higher education institutions are responsible for implementing this Circular./.
