Pursuant to the Law on Prevention and Control of Corruption dated November 20, 2018;

BASED ON THE GOVERNMENT DECREE NO. 52/2022/NĐ-CP OF AUGUST 8, 2022, PROVIDING THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF CONSTRUCTION;

Pursuant to Decree No. 59/2019/NĐ-CP dated July 1, 2019 of the Government detailing some provisions and measures to implement the Law on Prevention and Control of Corruption; Decree No. 134/2021/NĐ-CP dated December 30, 2021 of the Government amending and supplementing certain articles of Decree No. 59/2019/NĐ-CP dated July 1, 2019;

The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.

The Minister of Construction hereby promulgates this Circular stipulating the list and periodic rotation terms for positions for civil servants not holding leadership or management positions and officials directly interacting with and handling matters in the construction sector.

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates the list and periodic rotation terms for positions for civil servants not holding leadership or management positions and officials directly interacting with and handling matters in the construction sector.

2. This Circular applies to:

a) Agencies and units under the Ministry of Construction;

b) Agencies, organizations, and units within the scope of administration according to the construction sector at local authorities;

c) Civil servants not holding leadership or management positions and officials directly interacting with and handling matters in the construction sector at agencies, organizations, and units specified in points a and b of this clause.

Article 2. List of positions in agencies and units under the Ministry of Construction that must periodically rotate

1. Issuing permits in the construction sector:

a) Reviewing and evaluating applications for issuance of practice certificates for construction activities; conversion of practice certificates for construction activities of foreign individuals or Vietnamese individuals residing abroad;

b) Reviewing and evaluating applications for issuance of practice certificates and certificates of competence for construction activities;

c) Reviewing and evaluating applications for recognition of social-professional organizations meeting the conditions for issuance of practice certificates and certificates of competence for construction activities;

d) Reviewing and evaluating applications for recognition of social-professional organizations practicing architecture, research institutions, and architectural training institutions meeting the conditions for conducting examinations to issue practice certificates for architecture;

đ) Reviewing and evaluating applications for issuance of certificates of registration for testing activities under the management of the Ministry of Construction;

e) Reviewing and evaluating applications for issuance of certificates of registration for certification activities under the management of the Ministry of Construction;

g) Reviewing applications for appointment, removal, and issuance of construction judicial appraisal cards;

h) Reviewing and evaluating applications for issuance of certificates of qualification for technical safety inspection organizations for machines, equipment, and materials with strict requirements for labor safety used in construction;

i) Reviewing and evaluating applications for issuance of certificates of qualification for individuals conducting inspections of machines, equipment, and materials with strict requirements for labor safety used in construction.

2. Appraisal of construction projects:

a) Appraisal of feasibility studies for investment in construction and adjusted feasibility studies for investment in construction;

b) Appraisal and adjustment of design documents implemented after basic design.

3. Management of construction planning:

a) Appraisal of tasks and adjusted tasks for construction planning;

b) Appraisal of planning schemes and adjusted planning schemes.

4. Management and supervision of quality of construction works:

a) Inspection of acceptance work for construction works;

b) Inspection and evaluation of applications for opinions on the results of construction work safety assessments; opinions on construction works that have exceeded their service life but require continued use.

Article 3. The list of job positions in agencies, organizations, units under the management scope of construction sectors and fields at local authorities must be periodically rotated.

1. Issuing permits in the construction sector:

a) Reviewing and evaluating applications for issuance of practice certificates for construction activities; conversion of practice certificates for construction activities of foreign individuals or Vietnamese individuals residing abroad;

b) Inspect and evaluate the application for issuance of construction activity capability certificates; issue construction business licenses for foreign contractors operating in Vietnam.

c) Inspect and evaluate the application for issuance of new construction permits; issue construction permits for repairs and renovations; issue permits for relocating constructions.

d) Inspect and evaluate the application for issuance of architectural practice certificates; recognize and convert foreign architects' practice certificates in Vietnam.

đ) Inspect and evaluate the application for issuance of certificates confirming eligibility to conduct specialized construction testing activities.

e) Inspect and evaluate the application for appointment, removal, and issuance of judicial appraisal cards for construction.

g) Inspect and evaluate the application for issuance of real estate brokerage practice certificates.

2. Appraisal of construction projects:

a) Appraisal of feasibility studies for investment in construction and adjusted feasibility studies for investment in construction;

b) Review and review adjustments to design documents implemented after basic design.

c) Inspect and evaluate the application for announcement of future housing projects meeting conditions for sale or lease purchase.

3. Management of construction planning:

a) Appraisal of tasks and adjusted tasks for construction planning;

b) Appraisal of planning schemes and adjusted planning schemes.

4. Management and supervision of quality of construction works:

a) Inspection of acceptance work for construction works;

b) Inspection and evaluation of applications for opinions on the results of construction work safety assessments; opinions on construction works that have exceeded their service life but require continued use.

5. Review, plan, control, supervise, coordinate, compensate, and clear land.

Article 4. Periodic rotation term for job positions.

The periodic rotation term for civil servants and employees working in the positions specified in Articles 2 and 3 of this Circular is from three to five years. The time limit for job position rotation is the date when the competent authority issues the dispatch, deployment, or assignment document for civil servants and employees.

Article 5. Implementation Provisions

1. This Circular takes effect from November 20, 2023.

2. Heads of agencies and units under the Ministry of Construction; Chairpersons of People's Committees of provinces and centrally-administered cities, and related organizations and individuals are responsible for implementing this Circular.

3. In the course of implementation, if there are any difficulties, agencies and organizations should report to the Ministry of Construction for guidance.
