BASED ON THE INTELLECTUAL PROPERTY LAW NO.50/2005/QH11 AMENDED AND ENHANCED BY LAWS NO.36/2009/QH12, NO.42/2019/QH14, NO.7/2022/QH15, NO.93/2025/QH15, AND NO.131/2025/QH15;

BASED ON THE DECREE NO.17/2023/NĐ-CP OF THE GOVERNMENT REGULATING DETAILS OF SOME ARTICLES AND IMPLEMENTATION MEASURES OF THE INTELLECTUAL PROPERTY LAW REGARDING COPYRIGHT AND RELATED RIGHTS AMENDED AND ENHANCED BY THE DECREE NO.134/2026/NĐ-CP;

BASED ON THE DECREE NO.43/2025/NĐ-CP OF THE GOVERNMENT REGULATING THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF CULTURE, SPORTS AND TOURISM;

IN ACCORDANCE WITH THE REQUEST OF THE DIRECTOR OF THE COPYRIGHT OFFICE;

THE MINISTER OF CULTURE, SPORTS AND TOURISM ISSUES THIS CIRCULAR REGULATING FORMS OF DOCUMENTS IN THE REGISTRATION ACTIVITIES OF COPYRIGHT AND RELATED RIGHTS.

ARTICLE 1. SCOPE OF APPLICATION

This Circular details Article 50(4) and Article 51(4) of the Intellectual Property Law No.50/2005/QH11, amended and enhanced by Laws Nos.36/2009/QH12, Nos.42/2019/QH14, Nos.7/2022/QH15, Nos.93/2025/QH15, and No.131/2025/QH15 regarding the forms of documents in the registration activities of copyright and related rights.

ARTICLE 2. APPLICABLE PARTIES

This Circular applies to agencies, organizations, and individuals participating in the registration activities of copyright and related rights.

ARTICLE 3. FORMS OF DOCUMENTS ACCOMPANYING THIS CIRCULAR

1. The forms of application for registration of copyright and related rights specified in Appendix I accompanying this Circular include:

a) Form No. 01: Application form requesting issuance of a certificate of registration of copyright for literary, scientific works; lectures, speeches, and other oral presentations; data collections; journalistic works; folk literature and art works and other works expressed in writing or other characters;

b) Form No. 02: Application form requesting issuance of a certificate of registration of copyright for applied artistic works;

c) Form No. 03: Application form requesting issuance of a certificate of registration of copyright for computer programs;

d) Form No. 04: Application form requesting issuance of a certificate of registration of copyright for musical works;

e) Form No. 05: Application form requesting issuance of a certificate of registration of copyright for artistic and photographic works;

f) Form No. 06: Application form requesting issuance of a certificate of registration of copyright for cinematographic and theatrical works;

g) Form No. 07: Application form requesting issuance of a certificate of registration of copyright for textbooks, teaching materials;

h) Form No. 08: Application form requesting issuance of a certificate of registration of copyright for architectural works, drawings, diagrams, maps related to topography, architecture, scientific works;

i) Form No. 09: Application form requesting issuance of a certificate of registration of related rights;

l) Form No. 10: Application form requesting reissuance of a certificate of registration of copyright; m) Form No. 11: Application form requesting reissuance of a certificate of registration of related rights;

n) Form No. 12: Application form requesting replacement of a certificate of registration of copyright;

o) Form No. 13: Application form requesting replacement of a certificate of registration of related rights;

p) Form No. 14: Application form requesting cancellation of the effect of a certificate of registration of copyright/certificate of registration of related rights.

APPENDIX:

- Declaration of the author/co-author regarding the creation of the work (In case the author/co-author is not simultaneously the signatory in the application for issuance of a certificate of registration of copyright accompanying Form No. 01, 02, 03, 04, 05, 06, 07 or Form No. 08 of this Appendix);

- Description and declaration regarding the use of artificial intelligence system support in the creation process (In case an artificial intelligence system is used in the creation process accompanying Form No. 01, 02, 03, 04, 05, 06, 07 or Form No. 08 of this Appendix);

- Description and declaration regarding the use of artificial intelligence system support in the shaping or implementation of a performance/recording, video recording/program broadcast (In case an artificial intelligence system is used in the shaping or implementation of a performance/recording, video recording/program broadcast accompanying Form No. 09 of this Appendix).

2. The forms of certificates of registration of copyright and certificates of registration of related rights specified at

Appendix II accompanying this Circular: a) Form No. 01: Certificate of registration of copyright;

b) Form No. 02: Certificate of registration of related rights;

c) Form No. 03: Certificate of registration of copyright (In case of replacement or reissuance);

d) Form No. 04: Certificate of registration of related rights (In case of replacement or reissuance).

The forms specified in this paragraph are designed to be used on A4 paper.

The sample forms prescribed in this clause are designed for use on A4 paper.

Article 4. Enforceability

1. This Circular shall come into enforceable effect from the date of signature.

2. The Circular No. 08/2023/TT-BVHTTDL dated June 2, 2023 by the Minister of Culture, Sports and Tourism, which stipulates models in the registration activities for copyright and related rights, Article 12 and Appendix 1a of the Circular No. 21/2025/TT-BVHTTDL dated December 26, 2025 by the Minister of Culture, Sports and Tourism, amending and supplementing certain provisions of several Circulars concerning administrative procedures related to production and business activities under the management scope of the Ministry of Culture, Sports and Tourism, shall cease to be enforceable from the date this Circular comes into enforceable effect.

Article 5. Transitional Provisions

1. In the case where applications for copyright registration or related rights registration are submitted to competent state agencies before the date this Circular comes into enforceable effect, they will continue to be processed in accordance with the provisions of the then-effective legal documents at the time of submission.

2. Copyright and related rights certificates issued prior to the date this Circular comes into enforceable effect shall continue to maintain their validity.

Article 6. Implementation

1. The Copyright Office, agencies, organizations, and individuals involved in copyright and related rights registration activities are responsible for implementing this Circular.

2. In the course of implementation, if any difficulties arise, it is requested that relevant agencies, organizations, and individuals promptly report to the Ministry of Culture, Sports and Tourism (through the Copyright Office) for research and resolution./.

5.4 For lectures, specify for which audience the lecture is intended to be used in teaching activities;

5.5 For data collection, specify where the collected data are applied or incorporated into a computer program or activity;

5.6 For journalistic works, specify the type of work and its publication on which it appears;

5.7 For folk literary and artistic works, specify the form according to paragraph 1 of Article 23 of the Law on Intellectual Property and paragraph 12 of Circular No. 17/2023/NĐ-CP dated April 26, 2023 of the Government on implementing certain provisions and measures for the implementation of the Law on Intellectual Property regarding copyright and related rights as amended and supplemented by Circular No. 134/2026/NĐ-CP dated April 6, 2026.

(6) Declaration: The content of the work is created by the author/co-author without copying from another person's work, and does not violate any provisions of Vietnamese law.

For works containing content related to national sovereignty, territory, borders, history, religion, beliefs, customs, health, reputation, prestige, legal rights and interests of organizations or individuals; state and public interest... a declaration must be made: There is no content or imagery that violates these issues, does not distort them, and does not cause adverse effects on these matters.

I/we fully bear responsibility for the shaping or performing of the performance/recording, video recording/program broadcast, including in cases where disputes arise related to the content created by the artificial intelligence system.

The performance/recording, video recording/program broadcast shaped or performed by me (us) meets all the conditions for copyright protection as provided for in the Intellectual Property Law. Providing input data to the artificial intelligence system does not cause harm to copyright, related rights of protected objects, and related rights.

I/we assure that I/we will retain records in accordance with paragraph 7 and paragraph 8 of Article 5a of Decree No. 17/2023/NĐ-CP dated April 26, 2023, of the Government's detailed provisions for certain articles and measures to implement the Intellectual Property Law on copyright, related rights as amended and supplemented by Decree No. 134/2026/NĐ-CP dated April 6, 2026, to provide to competent authorities in case there is a request for protection of related rights concerning this performance/recording, audio recording/video recording/program broadcast.

Guidance :

(1) A detailed description of the use of artificial intelligence systems in shaping or performing a performance/recording, video recording/program broadcast:

- Name of the artificial intelligence system used;

- Use of the artificial intelligence system at which stage;

- Nature of using the artificial intelligence system (support, generation, suggestion…);

- What content was created by the person shaping/performing a performance/recording, video recording/program broadcast and what content was created by the artificial intelligence system;

- Commands set to control the artificial intelligence system; whether template commands or commands directly established by the person shaping/performing a performance/recording, video recording/program broadcast;

- Contents as provided in paragraph 1 of Article 5a of Decree No. 17/2023/NĐ-CP dated April 26, 2023, of the Government's detailed provisions for certain articles and measures to implement the Intellectual Property Law on copyright, related rights as amended and supplemented by Decree No. 134/2026/NĐ-CP dated April 6, 2026.

1. Basis for the emergence of copyright, related rights (Article 6 Intellectual Property Law)

- Copyright arises from the creation of a work and its expression in a tangible form, regardless of content, quality, form, medium, language, whether published or unpublished, registered or unregistered.

- Related rights arise from the shaping or performance of a performance, audio recording/video recording/program broadcast, encoded satellite signal program without causing harm to copyright.

2. Author, co-author (Article 12a Intellectual Property Law)

The author is the person who directly creates the work. In cases where two or more people jointly create a work with the intent that their contributions be combined into a complete whole, those individuals are co-authors.

3. Registration of copyright, related rights (Article 49 Intellectual Property Law)

- Copyright and related rights registration is the act of an author, owner of copyright, or owner of related rights submitting a file to a competent state authority to record information about the author, work, owner of copyright, or owner of related rights.

- Submitting a file for issuance of a Copyright Registration Certificate, Related Rights Registration Certificate does not constitute a mandatory procedure to enjoy copyright, related rights under this Law's provisions.

- The author, owner of copyright, or owner of related rights must bear responsibility for the information contained in the copyright and related rights registration application.

2. Authors and joint authors (Article 12a Intellectual Property Law)

The author is the person who directly creates a work. Where two or more persons jointly create a work with the intention that their contributions be combined into a complete whole, such persons are co-authors.

3. Registration of copyright and related rights (Article 49 Intellectual Property Law)

- The registration of copyright and the registration of related rights is the act by which the author, owner of copyright, or owner of related rights submits an application to a competent state authority for recording information about the author, work, owner of copyright, or owner of related rights.

- Submission of an application for issuance of a Certificate of Registration of Copyright and a Certificate of Registration of Related Rights is not a mandatory procedure for enjoying copyright and related rights as provided by this Law.

b) Filming, editing, composing music, designing visual effects, sound design, lighting, special effects, actors in cinematographic works, and other persons who perform creative work on a cinematographic work enjoy the rights provided for in paragraph 2 of Article 19 of this Law;
