Amending and supplementing certain Articles of Circulars
in the field of housing

Pursuant to the Law on Housing No. 27/2023/QH15 amended and supplemented by: Law No. 43/2024/QH15; Law No. 47/2024/QH15; Law No. 84/2025/QH15; Law No. 90/2025/QH15; Law No. 93/2025/QH15;
Pursuant to Decree No. 33/2025/NĐ-CP stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;
Pursuant to Decree No. 140/2025/NĐ-CP stipulating the division of authority between two levels of local government in the field of state management by the Ministry of Construction;
Pursuant to Decree No. 54/2026/NĐ-CP amending and supplementing certain Articles of Decrees in the fields of housing and real estate business;
At the proposal of the Director of the Department of Housing Management and Real Estate Market.
The Minister of Construction issues this Circular amending and supplementing certain Articles of Circulars in the field of housing,
Article 1. Amending and supplementing certain Articles of Circular No. 05/2024/TT-BXD dated July 31, 2024, issued by the Minister of Construction detailing certain provisions of the Law on Housing, which has been amended and supplemented by Circular No. 09/2025/TT-BXD dated June 13, 2025, and Circular No. 32/2025/TT-BXD dated November 10, 2025, issued by the Minister of Construction (hereinafter referred to as Circular No. 05/2024/TT-BXD amended)
1. Amending and supplementing Point c, adding Point c2 after Point c1 of Clause 1, Article 6 as follows:
a) Amending and supplementing Point c of Clause 1, Article 6 as follows:
"c) The subjects specified in Paragraphs 9, 10, and 11 of Article 76 of the Law on Housing shall implement Model No. 01 attached as an appendix to this Circular;"
b) Adding Point c2 after Point c1 of Clause 1, Article 6 as follows:
"c2) The subject specified in Paragraph 5 of Article 76 of the Law on Housing who does not have a labor contract and does not receive a pension from the Social Insurance Agency shall implement Model No. 05 attached as an appendix to this Circular."
2. Replacing Model No. 01, Model No. 02, and Model No. 05 in Appendix I issued with Circular No. 05/2024/TT-BXD amended as follows:
a) Replacing Model No. 01 in Appendix I issued with Circular No. 05/2024/TT-BXD amended with Model No. 01 attached as an appendix to this Circular;
b) Replacing Model No. 02 in Appendix I issued with Circular No. 05/2024/TT-BXD amended with Model No. 02 attached as an appendix to this Circular;
c) Replacing Model No. 05 in Appendix I issued with Circular No. 05/2024/TT-BXD amended with Model No. 05 attached as an appendix to this Circular.
3. Abolishing the phrase "(photocopy of the wage/salary list for the 12 months immediately preceding the date of confirmation by the competent authority)" in Model No. 01a and Model No. 04 in Appendix I issued with Circular No. 05/2024/TT-BXD amended.
Article 2. Implementation Provisions
This Circular takes effect from February 15, 2026.
Article 3. Transitional Provisions
Documents proving the subject and conditions for enjoying social housing support policies that have been confirmed by the competent authority according to regulations before the effective date of this Circular shall continue to be used and remain valid for a period of 12 months from the effective date of this Circular./.
