Amending and supplementing some articles of Circular No. 05/2024/TT-BXD July 31, 2024, of the Minister of Construction detailing certain provisions ofthe Law on Housing

On the basis of the Law on Housing No. 27/2023/QH15 November 27, 2023;

Pursuant to the Law amending and supplementing certain articles of the Land Law number amending and supplementing some articles of the Land Law No.31/2024/QH15 27/2023/QH15; the Law on Housing No. ; the Law on Real Estate Business No., the Law on Credit Institutions number 32/2024/QH15 June 29, 2024;

Decree No. 33/2025/NĐ-CP February 25, 2025, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Decree No. 140/2025/NĐ-CP June 12, 2025, of the Government stipulating the division of authority between two levels of local government in the field of state management by the Ministry of Construction;

Decree No. 261/2025/NĐ-CP October 10, 2025, of the Government amending and supplementing certain articles of Decree number 100/2024/NĐ-CP July 26, 2024, of the Government detailing certain provisions of the Law on Housing regarding the development and management of social housing and Decree number 192/2025/NĐ-CP July 1, 2025, of the Government detailing certain provisions and measures for implementing Resolution number 201/2025/QH15 May 29, 2025, of the National Assembly piloting concerning certain mechanisms, policies special for developing social housing;

At the proposal of the Director of the Department of Housing Management and Real Estate Market,

The Minister of Construction issues this Circular amending and supplementing certain provisions of Circular number 05/2024/TT-BXD July 31, 2024, of the Minister of Construction detailing certain provisions of the Law on Housing.

Article 1. Amending and supplementing certain provisions of Circular number 05/2024/TT-BXD July 31, 2024, of the Minister of Construction detailing certain provisions of the Law on Housing

1. Amending and supplementing Point c, adding Point c1 after Point c Clause 1 Article 6 as follows:

a) Amending and supplementing Point c as follows:

"c) The subjects specified in Clauses 9, 10, 11 Article 76 of the Law on Housing and the subject specified in Clause 5 Article 76 of the Law on Housing who do not have a labor contract and do not receive pension from the Social Insurance Agency shall implement according to Model No. 01 attached as Appendix I of this Circular."

b) Adding Point c1 after Point c as follows:

"c1) The subjects specified in Clauses 5, 6, 8 Article 76 of the Law on Housing, except for the subject specified in Clause 5 Article 76 of the Law on Housing who do not have a labor contract and do not receive pension from the Social Insurance Agency, shall implement according to Model No. 01a attached as Appendix I of this Circular."

2. Amending and supplementing Clause 1, Point d Clause 2, adding Clause 2a after Clause 2 Article 8 as follows:

a) Amend and supplement Clause 1 as follows:

"1. The form of proof of income conditions to be eligible to purchase or lease social housing shall be implemented as follows:

Model No. 01a attached as Appendix I of this Circular, applicable to the subjects specified in Clauses 5, 6, 8 Article 76 of the Law on Housing, except for the subject specified in Clause 5 Article 76 of the Law on Housing who do not have a labor contract and do not receive pension from the Social Insurance Agency.

Model No. 04 attached as Appendix I of this Circular, applicable to the subject specified in Clause 7 Article 76 of the Law on Housing.

Model No. 05 attached as Appendix I of this Circular, applicable to the subject specified in Clause 5 Article 76 of the Law on Housing who do not have a labor contract and do not receive pension from the Social Insurance Agency.

In case the person applying to purchase or lease social housing is married, then the spouse must also declare the form of proof of income conditions according to Model No. 01a or Model No. 04 or Model No. 05 attached as Appendix I of this Circular."

b) Amending and supplementing Point d Clause 2 as follows:

"d) Civil servants, public officials, and civil servants as prescribed by laws on civil servants, public officials, and civil servants."

c) Adding Clause 2a as follows:

"2a. The subject specified in Clause 2 of this Article who has retired and receives pension from the Social Insurance Agency according to laws on social insurance shall have the Social Insurance Agency currently paying the pension or the People's Committee of the district of permanent residence or temporary residence or current place of residence implement the confirmation according to Model No. 01a attached as Appendix I of this Circular."

3. Replacing Models No. 01, 04, 05, adding Model No. 01a at Appendix I issued with Circular number 05/2024/TT-BXD as follows:

a) Replacing Model No. 01 at Appendix I issued with Circular number 05/2024/TT-BXD with Model No. 01 at Appendix issued with this Circular;

b) Adding Model No. 01a after Model No. 01 at Appendix I issued with Circular number 05/2024/TT-BXD with Model No. 01a at Appendix issued with this Circular;

c) Replacing Model No. 04 at Appendix I issued with Circular number 05/2024/TT-BXD with Model No. 04 at Appendix issued with this Circular;

d) Replacing Model No. 05 at Appendix I issued with Circular number 05/2024/TT-BXD with Model No. 05 at Appendix issued with this Circular.

4. The documents stipulated in Models No. 01, 01a, 02, 03, 04, 05 at Appendix I of Circular number 05/2024/TT-BXD amended and supplemented by this Circular and Circular number 09/2025/TT-BXD dated June 3, 2025, of the Minister of Construction shall be valid for six months from the date of confirmation by the competent authority.

5. Amending and supplementing Item 3 Part I Appendix II as follows:

"3. The level of expertise and daily work unit price are divided into four levels and marked as follows: Level 1 Expert (CG1), Level 2 Expert (CG2), Level 3 Expert (CG3), Level 4 Expert (CG4) determined based on the regulations on the salary of domestic consulting experts as the basis for determining the tender package price issued by the Minister of Home Affairs."

6. Abolishing Part III Appendix II.

7. Removing the phrase ", specified in Table No. 04 of Appendix II issued with this Circular" at Point a Clause 3, Point a Clause 4 Article 10.

8. Replacing the phrase "Ministry of Labor, Invalids and Social Affairs" with the phrase "Minister of Home Affairs", replacing the phrase "Ministry of Finance" with the phrase "Minister of Finance" at Clause 5 Article 10, Clause 4 Article 11.

Article 2. Implementation clause

1. This Circular takes effect from November 10, 2025.

2. During the implementation process, if there are difficulties, please report to the Ministry of Construction for consideration and guidance within its authority.

Article 3. Transitional Provisions

1. Documents proving the subject, income conditions, and housing conditions that have been confirmed by the competent authority according to Circular number 05/2024/TT-BXD shall continue to be used and remain valid for six months from the date this Circular takes effect.

2. Subjects regulated under Clauses 5, 6, and 8 of Article 76 of the Law on Housing, except for low-income individuals in urban areas without labor contracts who do not receive pension benefits from social insurance agencies as stipulated in Clause 5 of Article 76 of the Law on Housing, who have proof of income conditions but lack proof of eligibility as specified in Circular No. 05/2024/TT-BXD, shall have their proof of income serve concurrently as proof of eligibility and be valid for a period of six months from the date this Circular takes effect./.
