CIRCULAR

Regulations on the delineation of authority and the decentralization of tasks in state management in the field of civil service administration

Pursuant to the Law on Government Organization on February 18, 2025;

Pursuant to the Law on Local Administration Organization dated June 16, 2025;

Pursuant to the Government Decree No. 25/2025/NĐ-CP dated February 21, 2025 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to the Decree No. 128/2025/NĐ-CP dated June 11, 2025 of the Government stipulating the delegation and decentralization in state management in the field of civil service administration;

Pursuant to the Decree No. 129/2025/NĐ-CP dated June 11, 2025 of the Government stipulating the delineation of authority for two levels of local administration in the field of state management by the Ministry of Civil Affairs;

At the proposal of the Director of the Legal Department;

The Minister of Civil Affairs issues this Circular stipulating the delineation of authority and the decentralization of tasks in state management in the field of civil service administration.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates the authority, procedures, and formalities for implementing tasks and powers of agencies and authorized persons as prescribed in Circulars and Joint Circulars issued by the Minister of Civil Affairs aimed at delineating authority and decentralization in the field of civil service administration.

2. This Circular applies to agencies, organizations, and authorized persons implementing tasks related to the delineation of authority and decentralization in the field of civil service administration.

Article 2. Regarding fees and charges

1. When administrative procedures are resolved and require payment of fees and charges as prescribed by laws on fees and charges, individuals and organizations must submit the application dossier along with the payment of fees and charges to the agency receiving the dossier.

2. The level of fees and charges, the management, and utilization of such fees and charges shall be implemented according to the regulations of the Government, the Minister of Finance, or the People's Council of the province corresponding to the respective fees and charges.

PART II
SPECIFIC REGULATIONS ON THE DELINEATION OF AUTHORITY

Article 3. Medical facilities have the authority to conclude on injuries requiring treatment and convalescence as a basis for determining the duration of treatment and convalescence to assess the title "Advanced Worker" or "Advanced Soldier".

Individuals participating in combat, serving in combat, or performing courageous acts to save people or State property as prescribed in Circular No. 01/2024/TT-BNV dated February 24, 2024 of the Minister of Civil Affairs implementing the Law on Commendation and Reward and Decree No. 98/2023/NĐ-CP dated December 31, 2023 of the Government detailing the implementation of certain provisions of the Law on Commendation and Reward, who suffer injuries requiring treatment and convalescence as concluded by a hospital or medical center at the provincial level or higher, shall have their treatment and convalescence periods counted towards the assessment for the titles "Advanced Worker" or "Advanced Soldier".

Article 4. Authority of the Chairman of the People's Committee at the commune level regarding commendation of individuals and groups under party and mass organizations

The commendation of individuals and groups specializing in party and mass organization work as prescribed in Circular No. 01/2024/TT-BNV shall be carried out as follows:

Individuals and groups specializing in party and mass organization work at the commune level shall be commended by the Chairman of the People's Committee at the commune level or reported to the Chairman of the People's Committee at the provincial level for commendation or reported to a higher level for commendation.

Article 5. Commendation in the People's Council at the commune level

The commendation in the People's Council at the commune level as prescribed in Circular No. 01/2024/TT-BNV shall be carried out as follows:

The commendation of the Chairperson, Vice-Chairperson, Committees of the People's Council, specialized representatives, and concurrently serving representatives of the People's Council shall be conducted according to the principle that the level managing organizational structure, personnel, and salary fund is responsible for examination, commendation, and recommending commendation to a higher level.

Article 6. Authority of the Provincial Military Command (or former managing unit) regarding confirmation of documents for commendation of achievements in the resistance war against America

The commendation of achievements in the resistance war against America as stipulated in Clause 2, Article 4 of Circular No. 02/2024/TT-BNV dated June 12, 2024 of the Minister of Civil Affairs implementing the Decree No. 28/2024/NĐ-CP dated March 6, 2024 of the Government detailing the procedures and formalities for awarding and posthumously awarding the "Vinh Moc Youth Volunteer Medal" and the commendation of achievements in the resistance war shall be carried out as follows:

For commendation proposals of demobilized military personnel, there must be a decision on demobilization, discharge, or transfer to another profession; in cases where documents are lost, confirmation from the Provincial Military Command (or former managing unit) regarding the period of active service, including clear references to which documents, volumes, and serial numbers in the list; date of enlistment, date of discharge, time spent in battle zones B, C, K (if applicable), and the date of assignment to a unit or registration in the reserve force at the Provincial Military Command, accompanied by a copy of the list bearing the name of the person confirmed (a copy stamped by the Provincial Military Command or former managing unit).

Article 7. Documents, procedures for supporting medical expenses and actual lost or reduced income, sources of funding

The procedures for supporting medical expenses and actual lost or reduced income, sources of funding as stipulated in Clauses 1 and 2, Article 5 of Circular Joint No. 02/2013/TTLT-BNV-BLDTBXH-BTC-BYT dated July 9, 2013 by the Minister of Home Affairs, Ministry of Labor, Invalids and Social Affairs, Ministry of Finance, and Ministry of Health guiding the process, procedures, documents, and support levels for individuals directly participating in Red Cross activities who have been injured leading to health damage shall be carried out as follows:

1. Within ten days from the date when the injured person has been treated and recovered, or their lost or reduced functions have been restored, the Red Cross Association managing the injured person shall prepare one set of documents and submit it to the Cultural and Social Affairs Office under the People's Committee at the commune level where the incident occurred for review.

The documents prepared by the Red Cross include:

a) A letter requesting review from the Red Cross (original);

b) A record confirming the condition of the injured person prepared by the Red Cross with confirmation from the People's Committee at the commune level where the accident occurred or the police station where the accident occurred (original or certified copy if sent via postal service, certified copy and original for comparison if sent directly);

c) Discharge certificate, payment receipts for medical examination and treatment costs, and other costs not covered by health insurance for workers enrolled in health insurance (original or certified copy if sent via postal service, certified copy and original for comparison if sent directly);

d) Valid documents regarding actual income based on monthly wages or salaries of the injured person confirmed by the organization or individual employing the worker for the competent state authority to determine the actual lost or reduced income (original or certified copy if sent via postal service, certified copy and original for comparison if sent directly), including: Employment contracts, salary increase decisions by the organization or individual employing the worker, or lists of actual income of the injured person, and other documents proving legitimate actual income (if any).

2. Within twenty days from the date of receiving all documents as stipulated in Clause 1 of this Article, the Cultural and Social Affairs Office under the People's Committee at the commune level shall cooperate with the social insurance agency and relevant agencies to review and issue a response letter to the Red Cross.

3. Within ten days from the date of receiving the review letter from the Cultural and Social Affairs Office under the People's Committee at the commune level, the Red Cross shall consider and pay the expenses. In case of disagreement, a reply letter stating the reasons shall be issued.

Article 8. Tasks and Authorities of the Provincial Elderly Work Board

The tasks and authorities of the Provincial Elderly Work Board as stipulated in Point a, Clause 1 of Article 1; Points b and d, Clause 1 of Article 2 of Circular No. 08/2014/TT-BNV dated September 19, 2014 by the Minister of Home Affairs concerning the Provincial Elderly Work Board and the Elderly Work Board of districts, towns, cities under provinces shall be implemented as follows:

1. The Provincial Elderly Work Board is an inter-departmental coordinating body assisting the Chairman of the People's Committee at the provincial level in directing and coordinating between specialized agencies under the People's Committee at the provincial level, People's Committees at the commune level, and related organizations in resolving issues regarding mechanisms and policies to implement elderly work.

2. Assist the Chairman of the People's Committee at the provincial level in directing and coordinating activities among departments, People's Committees at the commune level, and related organizations in developing plans and implementing elderly work and the National Action Program on Elderly People in each phase.

3. Assist the Chairman of the People's Committee at the provincial level in urging, inspecting, and evaluating the activities of departments, People's Committees at the commune level, and related organizations in implementing legal provisions and supportive policies for elderly people. Summarize, conclude, and periodically report to the Chairman of the People's Committee at the provincial level and the National Elderly People's Council of Vietnam on the implementation of elderly care and the promotion of their roles.

Article 9. Competence of the Department of Home Affairs and People's Communes' Committees on building databases for workers

The construction of the database on workers as stipulated in Article 12 of Circular No. 11/2022/TT-BLDTBXH dated June 30, 2022, guiding certain contents to implement sustainable employment support under the National Target Program on Sustainable Poverty Reduction for the period of 2021-2025 shall be carried out as follows:

1. The Department of Home Affairs shall advise and assist the People's Committee at the provincial level to organize the implementation of the following tasks:

a) Develop plans to organize the collection, updating, and editing of information about local workers;

b) Guide the People's Commune Committees to organize the collection, updating, and editing of information about workers residing within their administrative areas;

c) Aggregate and synchronize the database on workers according to the guidelines of the Ministry of Home Affairs to build a national database on workers.

2. The People's Commune Committees shall base themselves on available resources, guidance from the provincial People's Committee, and the Department of Home Affairs to carry out the following:

a) Develop plans and organize the collection, updating, and editing of information about workers residing within their administrative areas; handle arising issues;

b) Establish mechanisms for cross-checking, updating, and sharing data on collected workers with the national population database and other databases as the basis for verifying and completing electronic labor books for workers.

3. The form for collecting information on workers aged 15 years and older residing in the area is specified in Form No. 01 of Appendix I attached to this Circular.

Article 10. Tasks of the People's Commune Committees on reporting the implementation of public employment policies

Reporting on the implementation of public employment policies as stipulated in Article 7 of Circular No. 11/2017/TT-BLDTBXH dated April 20, 2017, guiding the implementation of certain provisions of Decree No. 61/2015/NĐ-CP dated July 9, 2015, of the Government on employment support policies and the National Employment Fund regarding public employment policies shall be carried out as follows:

The People's Commune Committees shall report the results of implementing projects and activities related to public employment policies where the People's Commune Committees are the main investors, according to Form No. 02 of Appendix I attached to this Circular, to the provincial People's Committee through the Department of Home Affairs before December 5 each year.

Article 11. Procedures for Implementing Benefits for Military Personnel and Cadres Participating in War Zones B, C, K During the Anti-American Resistance Period Without Directly Dependent Family Members and Military Personnel and Cadres Sent by the Party to Continue Working in the South After the Geneva Agreement in 1954

The procedures for implementing benefits for military personnel and cadres participating in war zones B, C, K during the anti-American resistance period without directly dependent family members and military personnel and cadres sent by the Party to continue working in the South after the Geneva Agreement in 1954 as stipulated in Section III of the Joint Circular No. 17/1999/TTLT-BLDTBXH-BTC-BTCCBCP dated April 15, 1999, of the Minister of Labor, Invalids, and Social Affairs, the Ministry of Finance, and the Head of the Civil Service Management Board of the Government guiding the implementation of Decree No. 23/1999/NĐ-CP dated April 15, 1999, of the Government on benefits for military personnel and cadres participating in war zones B, C, K during the anti-American resistance period without directly dependent family members and military personnel and cadres sent by the Party to continue working in the South after the Geneva Agreement in 1954 shall be carried out as follows:

1. Responsibilities of the beneficiary and the file management authority:

a) Beneficiaries must fill out an application form according to Form No. 03 of Appendix I attached to this Circular. The application form must be certified by the agency where they work if they are still employed, or by the People's Commune Committee regarding their place of residence for those who are not. Subsequently, beneficiaries must submit their individual applications to the receiving agencies as follows:

- For cadres and officers belonging to the armed forces: if they are still working, they should submit to their current workplace; if they have retired, been granted disability retirement, been discharged due to illness, or transferred to another profession, they should submit to the Military Command of the commune; if they are retired police officers, they should submit to the local police station;

- For civilian cadres, party members (whether currently working or retired), they should submit to the People's Commune Committee.

b) Agencies managing files and records are responsible for copying and certifying the time spent fighting and working in war zones B, C, K based on one of the following files or records: cadre, party member, military personnel, or pensioner:

- For individuals currently working in the armed forces or state agencies, the head of the agency or unit where the individual works shall, based on the managed files and records, be responsible for copying and certifying the time spent fighting and working for the individual according to regulations;

- For individuals currently working outside the state sector, retirees, those granted disability retirement, discharged due to illness, or transferred to another profession, the People's Commune Committee shall request the file management agency at the commune level to copy and certify for the individual;

In the case of deceased persons or those who died in service, representatives of their families are responsible for handling the procedures and forms as specified in point a and b of Clause 1, Article 11 of this Circular and filling out the application form according to Form No. 04 of Appendix I attached to this Circular.

2. Responsibilities of agencies and units receiving applications, reviewing, and disbursing one-time benefits:

a) For military units:

- The Military Command of the commune and the local police station are responsible for receiving, compiling application forms, copying files and records about the time spent fighting and working for the individual (if they manage the files and records) and sending them to the Provincial Military Command and the Provincial Police Station;

- The Provincial Military Command and the Provincial Police Station shall, based on stored files, be responsible for reviewing the eligibility of individuals to receive benefits within their jurisdiction. At the same time, they shall compile lists along with individual applications and copies of records and send them to the Ministry of Defense if it concerns the Army and the Ministry of Public Security if it concerns the Police.

- The Ministry of National Defense and the Ministry of Public Security are responsible for reviewing the beneficiaries within their jurisdiction, collecting, examining, confirming, and preparing budget estimates to be submitted to the Ministry of Finance for funding approval. Based on the proposals from the Ministry of National Defense and the Ministry of Public Security, the Ministry of Finance will issue financial limits or payment orders to the Ministry of National Defense and the Ministry of Public Security for disbursement according to the beneficiaries and settlement as prescribed.

b) For civilian, administrative, and party agencies:

- The People's Committee at the commune level is responsible for receiving individual declarations, requesting the local file management agency to extract records for the beneficiaries, and compiling lists to submit to the Chairman of the Provincial People's Committee;

- The Chairman of the Provincial People's Committee directs relevant agencies to review beneficiaries within their jurisdiction, collect, confirm, and prepare budget estimates to be submitted to the Ministry of Finance for funding approval. Based on the proposal from the Provincial People's Committee, the Ministry of Finance will provide funds as prescribed;

- For beneficiaries under central management, based on stored files, the Central Organization Commission will review the beneficiaries, compile, confirm, prepare budget estimates, and send a letter to the Ministry of Finance for funding approval. Based on the approved list from the Central Organization Commission, the Ministry of Finance will issue financial limits or payment orders to relevant Ministries, Committees, and sectors for disbursement to the beneficiaries and settlement as prescribed.

c) The Ministry of National Defense, the Ministry of Public Security, central and local Ministries, Committees, and mass organizations shall organize supervision of disbursements according to the correct beneficiaries, benefit levels, and settlement of funds as prescribed.

The Ministry of Finance will only provide subsequent funding to units that have reported the settlement of previously provided funding.

d) For those who died or passed away, the benefits will be granted to the main close relatives (with authorization from other relatives) of the beneficiaries including: father, mother, spouse, biological children, and legally adopted children.

Article 12. Documents for Reviewing Entitlement to Subsidies for Volunteer Youth Who Completed Their Duties During the Resistance War

The documents for reviewing entitlement to subsidies for volunteer youth who completed their duties during the resistance war, as stipulated in Article 4 of Circular Jointly Issued No. 08/2012/TTLT-BLDTBXH-BNV-BTC dated April 16, 2012, issued by the Minister of Labor, Invalids, and Social Affairs, the Minister of Interior, and the Minister of Finance guiding the implementation of subsidies for volunteer youth who completed their duties during the resistance war pursuant to Decision No. 40/2011/QĐ-TTg dated July 27, 2011, of the Prime Minister, amended and supplemented by Circular No. 08/2023/TT-BLDTBXH dated August 29, 2023, of the Minister of Labor, Invalids, and Social Affairs, include:

1. One of the following documents proving to be a volunteer youth (original or certified copy by the People's Committee at the commune level):

a) A resume or party member resume filed before April 29, 1999;

b) Documents issued by authorized agencies before the volunteer youth returned to their home province such as: Certificate of completion of duty from the managing unit of volunteer youth; Medical transfer certificate, hospitalization certificate, health record; Commendation certificate during service in the volunteer youth force; Certificate of participation in volunteer youth; Transfer of duty, appointment, assignment certificate;

c) In cases where the volunteer youth does not have any of the documents specified in points a and b of this clause, they must submit a declaration with certification by the People's Committee at the commune level where they registered their permanent residence before participating in the volunteer youth force (original). The People's Committee at the commune level is responsible for certifying the declaration for individuals who were volunteer youth from the locality but are currently registered as permanent residents in another locality (certification content according to Model No. 08 Appendix I attached to this Circular).

2. Individual declaration, specifically:

a) In cases where the volunteer youth is still alive, a request for one-time subsidy should be made according to Model No. 05 Appendix I attached to this Circular;

b) In cases where the volunteer youth has passed away, the relative of the volunteer youth should make a request according to Model No. 06 Appendix I attached to this Circular;

c) In cases of requesting monthly subsidies, it should be made according to Model No. 07 Appendix I attached to this Circular.

3. For beneficiaries eligible for monthly subsidies, in addition to the documents specified in Clauses 1 and 2 of this Article, there must be a health certificate from a Hospital or Health Center at the district level or higher (original).

Article 13. The authority of the People's Committee at the commune level, the People's Committee at the provincial level, and the procedures and time limits for resolving the allowance system for volunteers who have completed their tasks during the resistance war.

The resolution of the allowance system for volunteers who have completed their tasks during the resistance war as stipulated in Article 5 of Circular Joint No. 08/2012/TTLT-BLDTBXH-BNV-BTC shall be implemented as follows:

1. The volunteer or the relative of the volunteer (in case the volunteer has passed away) shall submit one set of documents according to the provisions of Article 12 of this Circular to the People's Committee at the commune level where they are registered as residents.

2. Within five working days from the date of receiving complete documents as prescribed (by each batch), the People's Committee at the commune level shall be responsible for:

a) Organizing a meeting and drafting a record confirming the application file for the allowance according to Model No. 08 in Appendix I attached to this Circular. The meeting participants include representatives from the commune leadership (People's Committee, Party Committee, Fatherland Front, Association of Former Volunteers or the Association of Former Volunteer Contact Committees), and the Village Chief where the volunteer requesting the allowance resides.

b) Compiling the application files for the allowance for volunteers and reporting them to the People's Committee at the provincial level through the Department of Civil Service Management.

3. Within ten days from the date of receiving complete documents as prescribed (by each batch), the People's Committee at the provincial level shall be responsible for:

a) Completing the review, verification, compilation, and issuance of decisions on the allowance according to Models No. 09, No. 10, and No. 11, along with the summary list of volunteers applying for the allowance compiled according to Models No. 12, No. 13, and No. 14 in Appendix I attached to this Circular;

In cases where volunteers lack one of the proof documents specified in point a, b of Clause 1, Article 12 of this Circular, compiling and transferring the list of beneficiaries to the Association of Former Volunteers at the provincial level for verification, confirmation, and participation in opinions before making a decision.

b) Completing the compilation of the list of beneficiaries entitled to a one-time allowance according to Model No. 15 in Appendix I attached to this Circular after issuing the decision on resolving the allowance for volunteers (by each batch), accompanied by a letter requesting additional budget for the one-time allowance, sending two copies to the Ministry of Civil Affairs. At the same time, organizing the payment of monthly allowances to beneficiaries according to current regulations.

c) Retaining the files of beneficiaries entitled to the allowance according to the regulations.

Article 14. The authority and responsibility of the People's Committee at the commune level regarding the resolution of one-time allowances for individuals dispatched as experts to assist Laos and Cambodia pursuant to Decision No. 57/2013/QĐ-TTg dated October 14, 2013 of the Prime Minister on one-time allowances for individuals dispatched as experts to assist Laos and Cambodia.

The authority and responsibility of the People's Committee at the commune level as stipulated in Article 4 of Circular Joint No. 17/2014/TTLT-BLDTBXH-BTC dated August 1, 2014 of the Minister of Labor, Invalids, and Social Affairs and the Minister of Finance guiding the implementation of one-time allowances for individuals dispatched as experts to assist Laos and Cambodia pursuant to Decision No. 57/2013/QĐ-TTg dated October 14, 2013 of the Prime Minister shall be implemented as follows:

1. Guiding the beneficiary of the allowance or the relative of the beneficiary to prepare the application file according to the prescribed regulations.

2. Checking the validity of the application file; returning invalid application files to the applicant for completion.

3. Monthly accepting valid application files of the beneficiary or the relative of the beneficiary who are registered as permanent residents in the locality; compiling and preparing the list of beneficiaries according to Model No. 16 in Appendix I attached to this Circular, completing it before the 10th day of each month.

4. Publicizing the list of beneficiaries within ten days from the date of completing the list of beneficiaries; accepting relevant opinions from the beneficiary or the relative of the beneficiary during the publicizing period; informing the content of the feedback to the beneficiary or the relative of the beneficiary; compiling the opinions and reporting them to the People's Committee at the provincial level for consideration and decision.

5. Sending the list along with the application files of the beneficiary to the People's Committee at the provincial level through the Department of Civil Service Management within five working days from the end of the publicizing period for the list of beneficiaries.

Article 15. Procedures for confirmation and resolution of preferential treatment for persons who have rendered meritorious service to the revolution and their dependents

The procedures for confirmation and resolution of preferential treatment for persons who have rendered meritorious service to the revolution and their dependents as stipulated in Clause 26 of Circular No. 05/2013/TT-BLDTBXH dated May 15, 2013, issued by the Minister of Labor, Invalids, and Social Affairs guiding the procedures for file establishment, file management, and implementation of preferential treatment for persons who have rendered meritorious service to the revolution and their dependents shall be carried out as follows:

1. Persons suffering from illness or their dependents submit an application for preferential treatment along with the following documents to the People's Committee at the commune level:

a) One of the following documents:

Transfer to hospital certificate; certified copy of party member history, military personnel history, public security personnel history fully recording the work process;

Certificate of activity in areas with particularly difficult economic and social conditions issued by the head of the competent authority based on the file, history, and area of operation;

Decision to perform international duty issued by the head of the competent authority;

In cases where old diseases recur after discharge leading to mental disorders resulting in loss of capacity, the confirmation of the competent authority according to the regulations of the Ministry of National Defense and the Ministry of Public Security shall be the basis.

b) Documents issued during service time indicating the presence of disease accompanied by a medical record of mental disorder due to recurrence of old disease from provincial-level hospitals or equivalent.

In cases where old diseases recur after discharge leading to mental disorders resulting in loss of capacity, the medical records of treatment from provincial-level hospitals or equivalent shall serve as the basis.

Discharge decision or demobilization decision.

In case such decisions are no longer available, a certificate from the Provincial Military Command or the competent authority according to the regulations of the Ministry of Public Security must be provided.

2. The People's Committee at the commune level shall verify and prepare a report within 15 days from the date of receipt of the application, attaching relevant documents as specified in Clause 1 of this Article, and send it to the Provincial Military Command or the competent authority according to the regulations of the Ministry of Public Security.

3. The Provincial Military Command or the competent authority according to the regulations of the Ministry of Public Security shall check and issue a certificate regarding the period of service in the military or police (in cases where there is no discharge or demobilization decision) within 15 days from the date of receipt of valid documents as specified in Clause 2 of this Article, and transfer the documents to the competent authority for issuance of a health certificate according to the regulations of the Ministry of National Defense or the Ministry of Public Security.

4. The competent authority according to the regulations of the Ministry of National Defense or the Ministry of Public Security shall issue a health certificate and refer the case to the competent Medical Appraisal Board.

5. The competent authority of the Ministry of National Defense or the Ministry of Public Security shall base its decision to issue a disabled veteran certificate and allowances on the conclusion of the Medical Appraisal Board and transfer the case to the Department of Civil Service Management at the place of residence of the disabled veteran for implementation of preferential treatment. SPECIFIC PROVISIONS ON DELEGATION

PART III
Article 16. Delegation of the People's Committee at the provincial level to manage the quality of products and goods that may pose safety risks upon importation

1. The People's Committee at the provincial level shall organize the acceptance and processing of registration files for quality inspection of imported products and goods that may cause safety risks according to the List attached as Appendix II to this Circular.

2. The state inspection of the quality of imported goods shall be conducted in accordance with Clause 2b of Article 7 of Decree No. 132/2008/NĐ-CP dated December 31, 2008, issued by the Government detailing certain provisions of the Law on Product and Goods Quality, supplemented by Clause 3 of Article 1 of Decree No. 74/2018/NĐ-CP dated May 15, 2018, issued by the Government amending and supplementing certain provisions of Decree No. 132/2008/NĐ-CP dated December 31, 2008, detailing the implementation of certain provisions of the Law on Product and Goods Quality.

2. The state inspection of the quality of imported goods shall be carried out in accordance with the provisions of Clause 2b, Article 7 of Decree No. 132/2008/ND-CP dated December 31, 2008 of the Government detailing certain articles of the Law on Product and Goods Quality, which has been supplemented in accordance with Clause 3, Article 1 of Decree No. 74/2018/ND-CP dated May 15, 2018 of the Government amending and supplementing certain articles of Decree No. 132/2008/ND-CP dated December 31, 2008 of the Government detailing the implementation of certain articles of the Law on Product and Goods Quality.

Article 17. Implementing the task of receiving and issuing approval documents for preparing labor sources for service enterprises.

The components of the dossier for preparing labor sources for service enterprises as stipulated in point a Clause 1 Article 10 and point 1 Section 3 Appendix II of Decree No. 128/2025/NĐ-CP dated June 11, 2025 of the Government on decentralization and delegation in state management in the civil affairs sector shall be detailed as follows:

1. Labor source preparation document according to Model No. 17 in Appendix I attached hereto.

2. A copy of the foreign party's labor reception request document or cooperation agreement between the Vietnamese enterprise and the foreign party receiving labor, accompanied by a Vietnamese translation, including the following contents:

a) The number of workers needed by the Vietnamese enterprise, their occupations, and gender;

b) Requirements regarding qualifications, vocational skills, and foreign languages of the workers;

c) Basic information about overseas employment (place of work, salary, duration of the labor contract);

d) Expected recruitment time.

3. Documents proving that the competent authority of the country has permitted the recruitment of foreign workers for the first-time collaborating foreign party with the Vietnamese service enterprise:

a) In case the foreign party is the employer, the proof documents include:

One copy of the business license or equivalent document issued by the competent authority showing the business field suitable for the occupation and profession of recruiting foreign workers, accompanied by a Vietnamese translation;

For countries with regulations on conditions for receiving foreign workers, provide one copy of the document showing the employer meets these requirements, accompanied by a Vietnamese translation.

b) In case the foreign party is a job placement service organization, the proof documents include:

One copy of the business license or equivalent document issued or confirmed by the competent authority showing the business field includes job placement services, accompanied by a Vietnamese translation;

One copy of the cooperation agreement between the job placement service organization and the employer regarding the recruitment of Vietnamese workers or the employer's request for the job placement service organization to prepare the workforce or recruit Vietnamese workers, accompanied by a Vietnamese translation;

Proof documents for the employer as specified in point a of this clause.

4. The plan for preparing the labor source includes the following contents:

a) The expected number of workers (maximum equal to the number stated in point a of Clause 2 of this Article); occupations; gender; qualifications, vocational skills, and foreign language proficiency of the workers;

b) Methods for preparing the labor source:

Preliminary selection (if applicable): Start date of preliminary selection, location of preliminary selection;

Planned vocational skill training (if applicable): Duration (start date, end date), location, training method (direct/cooperative);

Planned foreign language training (if applicable): Duration (start date, end date), location, training method (direct/cooperative).

5. The commitment letter from the service enterprise regarding the priority selection of workers who have participated in labor source preparation activities.

CHAPTER IV
IMPLEMENTATION

Article 18. Effective Date

1. This Circular takes effect from July 1, 2025.

2. For dossiers that have been implemented by agencies, units, organizations, or individuals before the effective date of this Circular and fall within the scope regulated by Article 1 of this Circular, they shall continue to be implemented according to the previous relevant legal documents on decentralization and delegation until the tasks and works are completed.

3. For tasks and authorities involving administrative procedures, the agency, organization, or individual receiving the task or authority shall implement the administrative procedure as currently practiced, except where specifically provided for in this Circular. Based on the current administrative procedures, the People's Committee of the province may specify details appropriate to local circumstances, ensuring that no additional procedural elements, deadlines, or costs are added to the administrative procedure.

4. Replace the phrase "People's Committee of the district" with the phrase "People's Committee of the commune" in point a, b Clause 4 Article 4 of Circular No. 17/2014/TTLT-BLDTBXH-BTC.

5. Repeal certain provisions of the following Circulars and Joint Circulars:

a) Clause 2, 3 Article 7 of Circular No. 11/2017/TT-BLDTBXH dated April 20, 2017 of the Minister of Labor, Invalids, and Social Affairs guiding the implementation of certain provisions of Decree No. 61/2015/NĐ-CP dated July 9, 2015 of the Government on employment policy and the national employment fund concerning public employment policy;

b) Article 4, 5 of Joint Circular No. 08/2012/TTLT-BLDTBXH-BNV-BTC dated April 16, 2012 of the Minister of Labor, Invalids, and Social Affairs, the Minister of Home Affairs, and the Minister of Finance guiding the implementation of the allowance system for young volunteers who have completed their mission during the resistance war pursuant to Decision No. 40/2011/QĐ-TTg dated July 27, 2011 of the Prime Minister;

c) Clause 2, 3 Article 4 of Joint Circular No. 17/2014/TTLT-BLDTBXH-BTC dated August 1, 2014 of the Minister of Labor, Invalids, and Social Affairs and the Minister of Finance guiding the implementation of one-time allowances for those dispatched as experts to assist Laos and Cambodia pursuant to Decision No. 57/2013/QĐ-TTg dated October 14, 2013 of the Prime Minister;

d) Clause 6 Article 12 of Circular No. 11/2022/TT-BLDTBXH dated June 30, 2022 of the Minister of Labor, Invalids, and Social Affairs guiding certain contents of sustainable employment support under the National Target Program on Sustainable Poverty Reduction for the period 2021-2025;

đ) Model No. 05, Model No. 06, Model No. 07, Model No. 08, Model No. 09, Model No. 10, Model No. 11, Model No. 12, Model No. 13, Model No. 14, Model No. 15 in Appendix I of Circular No. 08/2023/TT-BLDTBXH dated August 29, 2023 of the Minister of Labor, Invalids, and Social Affairs amending, supplementing, and abolishing certain provisions of Circulars and Joint Circulars related to the submission and presentation of paper household registration books, temporary residence books, or documents requiring confirmation of place of residence when implementing administrative procedures under the Ministry of Labor, Invalids, and Social Affairs' jurisdiction.

e) Article 3 of Circular No. 21/2021/TT-BLDTBXH dated December 15, 2021, issued by the Minister of Labor, Invalids, and Social Affairs, detailing certain provisions of the Law on Vietnamese Workers Working Abroad under Contracts.

g) Clause 1, Article 1 of Circular No. 02/2024/TT-BLDTBXH dated February 23, 2024, issued by the Minister of Labor, Invalids, and Social Affairs, amending and supplementing certain provisions of Circular No. 21/2021/TT-BLDTBXH dated December 15, 2021, issued by the Minister of Labor, Invalids, and Social Affairs, detailing certain provisions of the Law on Vietnamese Workers Working Abroad under Contracts.

h) Point a, Clause 1, Clause 2, Article 1; point b, d, Clause 1, Clause 2, Article 2; Clause 2, Article 3; Clause 2, Article 4 of Circular No. 08/2014/TT-BNV dated September 19, 2014, issued by the Minister of Home Affairs, stipulating the regulations for the Provincial Committee for the Elderly and the District Committee for the Elderly.

i) Point a, Clause 5, Article 1; point c, Clause 1; point b, Clause 2, Article 6 of Circular No. 01/2024/TT-BNV dated February 24, 2024, issued by the Minister of Home Affairs, detailing measures to implement the Law on Commendation and Awards and Decree No. 98/2023/NĐ-CP dated December 31, 2023, issued by the Government, detailing certain provisions of the Law on Commendation and Awards.

k) Clause 2, Article 4 of Circular No. 02/2024/TT-BNV dated June 12, 2024, issued by the Minister of Home Affairs, detailing measures to implement the Decree detailing procedures and formalities for awarding and posthumously awarding the "Medal of Merit for Volunteer Youth" and commendations for summarizing achievements in the resistance war.

l) Clause 1, 2, Article 5 of Joint Circular No. 02/2013/TTLT-BNV-BLDTBXH-BTC-BYT dated July 9, 2013, issued by the Ministers of Home Affairs, Labor, Invalids, and Social Affairs, Finance, and Health, guiding the procedures, formalities, files, and support levels for people directly participating in Red Cross activities who have been injured and suffered health damage.

m) Clause 1, 2, Section III of Joint Circular No. 17/1999/TTLT-BLDTBXH-BTC-BTCCBCP issued by the Ministers of Labor, Invalids, and Social Affairs, Finance, and the Head of the Civil Service Organization Department of the Government, guiding the implementation of Decree No. 23/1999/NĐ-CP dated April 15, 1999, issued by the Government, regarding the system of benefits for military personnel and officials who went to the B, C, K battlefields during the period of fighting against the United States to save the country without direct dependents to support and those who were sent by the Party to stay in South Vietnam to work after the Geneva Agreement in 1954.

n) Article 26 of Circular No. 05/2013/TT-BLDTBXH dated May 15, 2013, issued by the Minister of Labor, Invalids, and Social Affairs, guiding the procedures for establishing and managing files, implementing preferential policies for persons with meritorious service to the revolution and their relatives.

Article 19. Transitional Provisions and Responsibility for Implementation

1. Transitional Provisions

a) For files submitted before this Circular takes effect, the agency receiving the files shall continue to process them according to current regulations until the administrative procedure is completed.

b) In cases where the conditions for implementing the tasks specified in Article 16 of this Circular are not met at the local level, the Ministry of Home Affairs (Employment Department) shall continue to undertake the responsibility of receiving and processing applications for product quality inspections and imported goods registration at the request of organizations and individuals producing, trading, and importing products and goods until December 31, 2025.

2. Enforcement Responsibility

a) The People's Committees at all levels shall be responsible for directing relevant functional agencies to inspect and implement this Circular.

b) In case difficulties arise during the implementation process, the relevant agencies, organizations, units, and individuals shall have the responsibility to report to the Ministry of Home Affairs for examination and guidance in accordance with the law.
