REGULATING ECONOMIC-TECHNICAL STANDARDS FOR THE INVENTORY CHECK OF CULTURAL HERITAGE SITES, SCIENTIFIC FILE PREPARATION FOR RANKING CULTURAL-HISTORICAL, LANDSCAPE AND SCENERY SITES

BASED ON THE CULTURAL HERITAGE LAW NO. 45/2024/QH15;

BASED ON DECREE NO. 308/2025/NĐ-CP DATED NOVEMBER 28, 2025 OF THE GOVERNMENT REGULATING SOME ARTICLES AND ORGANIZATIONAL MEASURES AND GUIDELINES FOR IMPLEMENTING THE CULTURAL HERITAGE LAW;

BASED ON DECREE NO. 32/2019/NĐ-CP DATED APRIL 10, 2019 OF THE GOVERNMENT REGULATING THE TASKS, COMMISSIONS OR BIDDING FOR THE SUPPLY OF PUBLIC PRODUCTS AND SERVICES USING STATE-BUDGET FUNDS FROM ONGOING EXPENSES;

BASED ON DECREE NO. 43/2025/NĐ-CP DATED FEBRUARY 28, 2025 OF THE GOVERNMENT REGULATING THE FUNCTIONS, MISSIONS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF CULTURE, SPORTS AND TOURISM;

IN ACCORDANCE WITH THE RECOMMENDATION OF THE DIRECTOR OF THE CULTURAL HERITAGE DEPARTMENT;

THE MINISTER OF CULTURE, SPORTS AND TOURISM ISSUES THIS CIRCULAR REGULATING ECONOMIC-TECHNICAL STANDARDS FOR THE INVENTORY CHECK OF CULTURAL HERITAGE SITES, SCIENTIFIC FILE PREPARATION FOR RANKING CULTURAL-HISTORICAL, LANDSCAPE AND SCENERY SITES.

ARTICLE 1. SCOPE OF APPLICATION AND APPLICABLE PARTIES

1. This Circular stipulates economic-technical standards for the inventory check of cultural heritage sites and scientific file preparation for ranking historical-cultural, landscape and scenic sites that utilize state budget funds.

2. Applicable parties:

a) Public authorities, organizations, or individuals utilizing state budget funds to provide public services as specified in paragraph 1 of this Article (hereinafter referred to as "public service");

b) Public authorities, organizations, or individuals involved in the implementation and provision of public services using state budget funds;

c) Encourages non-public sector entities providing public services without utilizing state budget funds to apply economic-technical standards prescribed herein.

ARTICLE 2. General Provisions on Economic-Technical Standards

1. The economic-technical standards in this Circular are the maximum levels, including labor costs, machinery and equipment, materials used for completing the provision of public services.

2. Labor positions within the labor cost component of the Bidding Rate Tables shall be determined according to the following principles:

a) The labor positions within the labor cost component of the Bidding Rate Table apply in accordance with Circular No. 16/2021/TT-BVHTTDL dated December 22, 2021, issued by the Minister of Culture, Sports and Tourism, which stipulates job code numbers, professional position standards, and salary grades for cultural heritage professionals; Circular No. 10/2023/TT-BVHTTDL dated August 9, 2023, issued by the Minister of Culture, Sports and Tourism, which provides guidelines on leadership positions, management positions, and professional job titles, as well as the organizational structure based on job titles in public sector units under the fields of culture, sports, and tourism;

b) In cases where labor positions within the labor cost component are not found in Circular No. 10/2023/TT-BVHTTDL or Circular No. 16/2021/TT- BVHTTDL, they shall be applied according to Decree No. 204/2004/NĐ-CP dated December 14, 2004, issued by the Government on remuneration for civil servants, public officials, and military personnel, which has been amended and supplemented by Decree No. 117/2016/NĐ-CP dated July 21, 2016, issued by the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP on remuneration for civil servants, public officials, and military personnel; or Decree No. 111/2022/NĐ-CP dated December 30, 2022, issued by the Government on contracts for certain types of work in administrative agencies and public sector units, or shall be considered equivalent based on the job position approved by competent authorities;

c) In cases where the actual grade and level of labor positions do not conform to those specified in the annex attached to this Circular, the superior management authority of the service-providing unit shall consider applying equivalent grades and levels of labor positions or the current grade and level of the position being performed, along with cost adjustments based on actual circumstances. In such cases, it must be ensured that labor costs do not exceed those calculated from the standards in this Circular;

d) Civil servants and public officials receiving salaries from state budget funds when participating in the implementation of various work components in the service provision process are exempt from applying the labor cost standards specified in this Circular.

3. Other costs related to the provision of public services shall be handled as follows:

3. For other costs related to the provision of public service activities performed as follows:

a) For other costs related to the inventory service, preparation of scientific files for proposing the classification of historical and cultural relics, scenic spots, including: purchasing documents, translating documents, printing, photocopying documents; preparing and printing technical maps, drawings delineating the protected area of the relic site, technical drawings of the relic site; information storage equipment; hiring for filming, photographing, building photo albums; hiring experts for research, consultation, preparation of scientific files on relics, identification, determination of the value of relics; travel expenses; costs of appraising artifacts and antiques; costs of organizing professional training courses for personnel participating in the inventory of relics; costs of organizing meetings, conferences, seminars, symposiums to collect opinions, perfecting the inventory file, scientific file for proposing the classification of historical and cultural relics, scenic spots; costs of using specialized machinery and equipment as well as other incidental expenses, public institutions apply according to the expenditure level set by competent state authorities. In case there are no specific expenditure levels prescribed, they shall be based on contracts, invoices, or separate budget estimates for processes exceeding the standard level, submitted to the competent authority for examination and approval in accordance with the laws on state budget;

b) For actual costs and other rental or purchase services, they are carried out in accordance with the laws on the state budget. For payment items falling within the bidding limit, they shall be implemented in accordance with the laws on bidding.

Article 3. Content and Structure of Economic and Technical Quotas

1. The content of economic and technical quotas includes:

a) Labor consumption: is the time required for direct and indirect labor by average levels of labor categories to complete the provision of public service. The level of direct labor consumption is the time spent on each stage of the public service, measured in "gong," with one gong equivalent to eight hours of work per working day (as defined in Article 105 of the Labor Code). The level of indirect labor consumption is calculated as 15% of the total direct labor consumption;

b) Consumption of machinery and equipment: is the time required for each type of machinery or equipment to complete the provision of public service. The level of machinery and equipment consumption in the quota is measured by shifts, with one shift equivalent to a total machine depreciation period over eight hours per working day (as defined in Article 105 of the Labor Code);

c) Consumption of materials: is the specific quantities and types of materials required for direct use in providing public service. The level of material consumption in the quota is measured by the quantity of each type of material. The level of auxiliary material consumption is calculated as 10% of the total value of material consumption within the same Quota Table.

2. The structure of economic and technical quotas includes:

a) Quota name;

b) Description of work content: the main stages to be carried out in providing public service;

c) Quota table, including: - Labor consumption quota: job title and labor category level, unit of measurement for consumption, quota value; - Machinery and equipment usage consumption quota: name of machinery or equipment type, unit of measurement for consumption, quota value; - Material usage consumption quota: material name and specification, unit of measurement for consumption, quota value; - Quota consumption value: the actual time spent on labor, machinery and equipment, and materials in providing public service during the process is measured by a numerical value; - Notes: instructions for calculating quotas under different technical conditions or to complete a different volume of work than that specified in the Quota Table.

Article 4. Economic and Technical Quotas Belong to the Scope of Application of this Circular

The economic and technical quotas for public sector service projects are detailed in the Annex attached to this Circular, specifically:

1. Economic and Technical Quota for Inventory Services of Cultural Relics.

2. Economic and Technical Quota for Scientific File Preparation Proposing Classification of Historical-Cultural Sites and Scenic Spots.

Article 5. Implementation

1. Based on the economic and technical quotas for public sector service projects attached to this Circular, central ministries, agencies, provincial people's committees, directly-attached cities' people's committees, and relevant agencies and organizations shall examine and decide on the application of specific economic and technical quotas that are appropriate to the conditions of the units providing public sector services under their management.

2. Agencies and organizations using state budget funds for the provision of related public sector service projects shall, based on practical conditions, propose to competent authorities for examination and decision-making regarding the application of specific quotas.

Article 6. Effective Date

1. This Circular will take effect 45 days from the date of issuance.

2. In case the legal documents cited in this Circular are amended, supplemented, or replaced, implementation shall be carried out according to the newly issued amended, supplemented, or replaced document.

3. During implementation, if any issues arise, relevant agencies, organizations, and individuals may reflect to the Ministry of Culture, Sports and Tourism (through the Department of Cultural Heritage) for examination and resolution.

- In the case of preparing a scientific file proposal for provincial ranking of national cultural relics, the estimated wastage is calculated by multiplying the estimated wastage for one scientific file proposal for provincial ranking of cultural relics with a factor K = 1.5.

- In the case of preparing a scientific file proposal for exceptionally important national cultural relics, the estimated wastage is calculated by multiplying the estimated wastage for one scientific file proposal for provincial ranking of cultural relics with a factor K = 2.0.

- Where the cultural relic consists of multiple component cultural relics, the estimated wastage for each component cultural relic shall be calculated by multiplying the estimated wastage for one scientific file proposal for provincial ranking of cultural relics or national cultural relics or exceptionally important national cultural relics with a factor K = 0.7.

- For tasks where the grade and level of the national relic participate, the actual conditions and nature of the work shall be considered by the service provider preparing the scientific file proposal for proposing ranking of cultural relics to establish specific standards in accordance with legal provisions.

- For work contents where the grade and level of the participating cultural heritage must be determined based on reality, the service provider unit requesting the ranking of the cultural relic shall base its establishment of specific quotas on the specific conditions and nature of the work in accordance with legal provisions.
