CIRCULAR

Regulations on the selection and implementation of policies and benefits

for citizens performing their duty to participate in the People's Public Security Force

Pursuant to the Law on Military Service dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of 11 Laws on Military Affairs and National Defense dated June 27, 2025;

Pursuant to the Law on the People's Public Security Force dated November 20, 2018; the Law Amending and Supplementing Certain Provisions of the Law on the People's Public Security Force dated June 22, 2023; the Law on Forces Participating in Ensuring Security and Order at the Grassroots Level dated November 28, 2023; the Law on National Defense and Security Industry and Industrial Mobilization dated June 27, 2024; the Law Amending and Supplementing Certain Provisions of the Law on Officers of the Vietnam People's Army dated November 28, 2024; the Law Amending and Supplementing Certain Provisions of the Penal Code dated June 25, 2025;

BASED ON DECREE NO. 02/2025/ND-CP DATED FEBRUARY 18, 2025 OF THE GOVERNMENT ON FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF PUBLIC SECURITY; Decree No. 11/2025/NĐ-CP dated July 1, 2025 of the Government amending and supplementing certain provisions of Decree No. 02/2022/NĐ-CP dated December 28, 2022 of the Government detailing certain provisions of the Law on Mobile Police, Decree No. 06/2024/NĐ-CP dated November 15, 2024 of the Government stipulating policies for the Guard Force and guard work, Decree No. 02/2025/NĐ-CP dated February 18, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Pursuant to Decree No. 70/2019/NĐ-CP dated August 23, 2019 of the Government on the implementation of the duty to participate in the People's Public Security Force; Decree No. 184/2025/NĐ-CP dated July 1, 2025 of the Government stipulating the authority when organizing local administrative bodies at two levels and amending and supplementing certain provisions of Government Decrees in the field of security and public order;

Pursuant to Decree No. 13/2016/NĐ-CP dated February 19, 2016 of the Government stipulating the procedures and formalities for registration and policies for citizens during the period of registration, health examination, and physical fitness check for military service; Decree No. 220/2025/NĐ-CP dated August 7, 2025 of the Government amending and supplementing certain provisions of several decrees in the field of national defense and military affairs when organizing local administrative bodies at two levels;

Pursuant to Decree No. 27/2016/NĐ-CP dated April 6, 2016 of the Government stipulating certain policies and benefits for non-commissioned officers and conscripts serving in the military, demobilized, and their dependents; Decree No. 209/2025/NĐ-CP dated July 21, 2025 of the Government amending and supplementing certain provisions of 11 Government Decrees under the management of the Ministry of National Defense;

At the proposal of the Director of the Cadre and Civil Servant Management Department;

The Minister of Public Security promulgates this Circular stipulating the selection and implementation of policies and benefits for citizens performing their duty to participate in the People's Public Security Force.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the criteria, time, subjects, standards for selecting citizens to perform their duty to participate in the People's Public Security Force (referred to collectively as recruitment); allocation of responsibilities and coordination in recruitment; implementation of policies and benefits for citizens during the period of implementing the decision to examine health and training, assignment of work, policies and benefits for non-commissioned officers and conscripts during the period of service and demobilization.

Article 2. Applicability

1. Citizens registering to perform their duty to participate in the People's Public Security Force

2. Non-commissioned officers and conscripts serving in the military, demobilized.

3. Units under the Ministry of Public Security and Provincial/Municipal Public Security Departments (referred to collectively as Public Security units and localities).

4. Agencies, units, and individuals related to the recruitment process, calling up citizens to perform their duty to participate in the People's Public Security Force, and organizing and implementing policies and benefits for non-commissioned officers and conscripts.

Chapter II
RECRUITMENT OF CITIZENS TO PERFORM THEIR DUTY TO PARTICIPATE IN THE PEOPLE'S PUBLIC SECURITY FORCE

Article 3. Object and criteria for recruitment

In addition to the provisions on objects and selection criteria stipulated in Article 4 and Article 5 of Decree No. 70/2019/ND-CP dated August 23, 2019 of the Government on the implementation of the obligation to participate in the People's Public Security (hereinafter referred to as Decree No. 70/2019/ND-CP), citizens selected to fulfill the obligation to participate in the People's Public Security must meet the age requirements, political standards, and health standards as follows:

1. Age:

a) Citizens from 18 years old to 25 years old;

b) For citizens who have been trained at the college or university level and temporarily exempted from military service according to the Law on Military Service 2015, the selection can be extended up to 27 years old.

2. Political standards:

The citizen themselves, their biological father and mother; father and mother-in-law or father-in-law and mother-in-law; the person directly raising the citizen, their spouse, or the spouse’s parents; spouse; and full siblings of the citizen must meet the political standards to be recruited into the People's Public Security as prescribed by the Minister of Public Security.

3. Health criteria:

Health standards for selecting citizens to fulfill the obligation to participate in the People's Public Security shall be implemented according to the regulations of the Minister of Public Security.

Article 4. Recruitment of female citizens to fulfill the obligation to participate in the People's Public Security

1. Female citizens who have graduated from training at the intermediate level or higher and meet the criteria stipulated in Article 3 of this Circular, if willing and there is a need from the Public Security unit or locality, may be considered and recruited to fulfill the obligation to participate in the People's Public Security.

2. Based on the actual needs for use by the Public Security unit or locality, the Director of the Personnel Department proposes other necessary levels of education for recruiting female citizens to fulfill the obligation to participate in the People's Public Security to the Minister of Public Security for consideration.

Article 5. Proposing recruitment quotas

1. For local public security:

a) After completing and drawing lessons from the recruitment work, the provincial-level public security (referred to collectively as provincial-level public security) develops plans and directs communal-level public security (referred to collectively as communal-level public security) to review, grasp sources, and create recruitment sources annually;

b) Based on the results of the review, communal-level public security cooperates with the military authority at the same level to accurately grasp the number of citizens within the age range for conscription who have registered for military service obligations and the number of female citizens with willingness, meeting the criteria for selection to fulfill the obligation to participate in the People's Public Security, compile the situation, and report the results to the Personnel Department of the provincial-level public security before April 30 each year;

c) After compiling the reports from communal-level public security, the provincial-level public security proactively coordinates with units: Mobile Police Command, Security Police Command, Investigation Security Bureau, Office of the Criminal Police Department under the Ministry of Public Security, Prison Management Police Bureau, Educational Institution for Compulsory Education and Training Center, Detention and Custody Management Police Bureau and Community Enforcement Bureau, Immigration Management Bureau (collectively referred to as units receiving recruits under the Ministry of Public Security) to unify annual recruitment quotas for these units, develop the recruitment plan for their locality, and submit a document proposing recruitment quotas to the Ministry of Public Security (through the Personnel Department) before June 15 each year; the proposal content should clearly state the quantity, using units, and recruitment areas (for recruitment for their own unit and units under the Ministry of Public Security, including recruitment quotas for female citizens);

2. For units receiving recruits under the Ministry of Public Security:

Based on the need for conscript soldiers, they proactively coordinate with local public security to grasp recruitment sources and exchange and unify with the provincial-level public security before May 15 each year regarding recruitment quotas for their unit before proposing recruitment quotas (quantity and recruitment areas) to the Ministry of Public Security (through the Personnel Department) before June 15 each year; the proposal content should clearly state the quantity, using units, and recruitment areas (for recruitment for their own unit, including recruitment quotas for female citizens);

3. On the basis of reports from local public security units, the Personnel Department advises the Minister of Public Security to propose to the Prime Minister for a decision on the number of citizens called upon to fulfill the obligation to participate in the People's Public Security in each locality.

Article 6. Allocation of Recruitment Quotas

1. Based on the Prime Minister's decision, the Minister of Public Security decides to allocate recruitment quotas for each unit under the Ministry of Public Security (as stipulated to use non-commissioned officers and conscripts) and provincial public security agencies.

2. Based on the recruitment quotas assigned by the Prime Minister and the Minister of Public Security, provincial public security agencies coordinate with military authorities at the same level to submit to the Chairman of the Provincial People's Committee (referred to collectively as the Chairman of the Provincial People's Committee) to decide on allocating recruitment quotas for each commune-level area ensuring suitability with actual circumstances.

Article 7. Organization of Recruitment

1. Provincial public security agencies:

a) Advise the Party committee and the People's Committee at the same level to direct the implementation of propaganda, dissemination, and education to raise awareness and responsibility in implementing the provisions of the Law on Military Service, the Law on People's Police, and related documents regarding the obligation to participate in the People's Police among the people, especially male citizens of conscription age, and coordinate with military authorities, the Military Service Council at the same level, and relevant sectors to implement such directives;

b) Coordinate with military authorities to advise the Chairman of the People's Committee at the same level to assign annual recruitment quotas suitable to the sources of recruitment in each locality and instruct the Military Service Council and relevant sectors to coordinate with the public security agency at the same level in recruitment work;

c) Direct, guide, and inspect subordinate units and communal public security agencies to carry out recruitment in accordance with regulations, ensuring sufficient quotas and quality of recruits;

d) Organize a health re-examination for all citizens after receiving the Decision to call up for performing the duty of participating in the People's Police and make replacements before the day of handover and reception of troops (if necessary) to ensure quotas and standards as prescribed. In cases where political verification results or health assessment results are awaited and cannot be completed in time for the handover and reception of troops, timely proactive replacements should be made before the day of handover and reception of troops (if necessary);

The Health Re-examination Board of the provincial public security agency shall be established by the Director of the provincial public security agency, responsible for concluding the health re-examination for all citizens who have received the Decision to call up for performing the duty of participating in the People's Police; Units receiving troops under the Ministry of Public Security shall cooperate and send representatives to participate in the Health Re-examination Board;

đ) Distribute uniforms to new soldiers before organizing the Handover and Reception Ceremony, ensuring uniformity and suitability with each force, weather conditions, climate, and regions (including citizens performing the duty of participating in the People's Police in units under the Ministry), transfer troops to training units ensuring absolute safety, without leaving troops stationed in localities for extended periods;

e) Receive files handed over by communal public security agencies; manage files of citizens performing the duty of participating in the People's Police in their own locality; hand over files of citizens performing the duty of participating in the People's Police in units receiving troops under the Ministry to units receiving troops under the Ministry of Public Security;

g) Advise the People's Committee at the same level to formulate policies for慰问、赠礼和鼓励被征召执行义务的公民;为来自偏远地区、经济和社会条件特别困难地区以及少数民族地区的选民亲属提供交通费用支持,将他们送到交接仪式,并指导和检查实施情况;

h) Organize experience sharing, mid-term reviews, summaries, and report the results of recruitment work according to regulations.

2. Communal public security agencies:

a) Fulfill responsibilities at points a, g, and h Clause 1 of this Article; coordinate with military authorities at the same level to advise the Chairman of the Communal People's Committee to issue Decisions to call up for health examinations and Decisions to call up citizens to perform the duty of participating in the People's Police;

b) Implement the recruitment procedures as prescribed in Article 7 of Decree No. 70/2019/ND-CP, amended and supplemented by Clause 2 of Article 11 of Decree No. 184/2025/ND-CP dated July 1, 2025, of the Government on the authority when organizing two-level local administrative bodies and amending and supplementing certain articles of Government Decrees in the field of national security and social order (hereinafter referred to as Decree No. 184/2025/ND-CP);

c) Announce publicly to each village, hamlet, ward, group, community to inform the people about the recruitment quota in the locality, conditions, standards, selection procedures, deadlines, and locations for receiving citizen registration forms for recruitment;

d) Leverage the effectiveness of residential management in the locality, combining the application of the national population database system to grasp households, individuals, and areas; proactively select recruitment sources and unify specific personnel for the military authority at the same level;

đ) Coordinate with departments, mass organizations, and families to firmly grasp political criteria, morality, and newly emerging issues, and manage citizens after receiving the Decision to call up for performing the duty of participating in the People's Police, promptly provide information and supply it to the provincial public security agency, the Communal People's Committee, and the receiving units for knowledge and management;

e) Coordinate with military authorities at the same level, departments, mass organizations to encourage, visit, and assist families with citizens preparing to join the military;

g) Complete the file procedures (including party member files, youth league member files, and other related files) of citizens called up for performing the duty and hand them over fully to the Personnel Department of the provincial public security agency as prescribed.

4. Responsibilities of units receiving troops under the Ministry of Public Security:

a) Upon notification of recruitment quotas and areas, units receiving troops under the Ministry of Public Security shall issue recruitment plans and coordinate with local public security agencies to implement them;

b) Within five days from the date of receipt of the document assigning recruitment quotas, they must send representatives to the provincial public security agency to unify selection criteria, research file time, contact, choose candidates, unify lists, methods of troop handover and reception, and other related matters. Researching files, contacting, choosing candidates, and unifying lists with the provincial public security agency must be completed ten days before the Chairman of the Communal People's Committee issues the Decision. calls citizens to fulfill their obligation to participate in the People's Public Security Force;

c) Maintain regular communication with the provincial Public Security to ensure timely and accurate information on the time and personnel participating in the Health Review Board of the provincial Public Security; coordinate with the provincial Public Security to unify the composition, time, and results of health reviews for citizens recruited by the provincial Public Security for units under the Ministry of Public Security through written documentation and implement adjustments before the handover date (if necessary);

d) Assign subordinate units to proactively collaborate with functional units of the provincial Public Security to send officers directly to the public security stations at the commune level to participate in the selection process from the grassroots level; support and cooperate with local public security authorities in verifying and investigating the backgrounds of citizens proposed for recruitment by the local public security authorities (if applicable).

Article 8. Organization of Handover and Reception of Military Personnel

1. The provincial Public Security shall coordinate with the Provincial Military Command to organize the Handover and Reception Ceremony at the Defense Command of the defense area or cluster of communes within the defense area determined by the provincial People's Committee to ensure compliance with regulations.

The provincial Public Security shall direct the public security stations to advise the People's Committee at the commune level to coordinate with the Defense Command of the defense area to carry out the Handover and Reception Ceremony and related tasks according to regulations.

2. The provincial Public Security shall receive citizens selected to fulfill their obligations to join the People's Public Security Force from the sending locality and transfer them to receiving units within three days from the day the locality organizes the Handover and Reception Ceremony.

3. Units under the Ministry of Public Security that receive military personnel shall ensure safe transfer to training units without leaving troops stationed for extended periods in the locality.

4. Information and Reporting System:

a) Within ten days from the date of receiving military personnel, the unit shall prepare a list of new recruits and eligible family members for health insurance and report according to regulations;

b) Within five days from the date the locality organizes the Handover and Reception Ceremony, the Head of the Commune Public Security has the responsibility to report the results of the recruitment period to the Personnel Department of the provincial Public Security;

c) No later than ten days from the date of organizing the Handover and Reception Ceremony, the local Public Security and units under the Ministry of Public Security receiving military personnel must report the results of the recruitment period to the Ministry (through the Personnel Bureau).

Article 9. Training and Assignment of Obligatory Service Soldiers

1. Public Security units assigned the task of training new recruits shall develop plans and organize the opening and closing ceremonies of the training course for new recruits according to regulations and directives from the Minister of Public Security.

2. After completing the training course for new recruits, the head of the Public Security unit shall decide on the assignment of obligatory service soldiers to various units according to regulations. Units under the Ministry of Public Security when assigning duties to obligatory service soldiers to work in subordinate units shall simultaneously submit the list of duty assignments for obligatory service soldiers to the Public Security units in the recruitment areas for tracking and coordination when required.

3. In cases where obligatory service soldiers have not completed the training course for new recruits (not meeting the conditions to obtain a completion certificate), the head of the Public Security unit shall receive, arrange, and assign appropriate tasks to obligatory service soldiers while ensuring regulations. Public Security units shall review and coordinate with units responsible for training new recruits to organize supplementary training for obligatory service soldiers who have not completed the course (individual training or joint training with the next year's new recruit training course) to ensure compliance with regulations.

Article 10. Responsibilities of Relevant Units under the Ministry of Public Security

1. The Legal System and Administrative Reform Department shall take the lead and coordinate with relevant units and mass media both within and outside the People's Public Security to organize propaganda, dissemination, and legal education on fulfilling obligations to participate in the People's Public Security as prescribed by law.

2. The Cadre and Personnel Organization Department shall take the lead and coordinate with relevant units to guide and inspect the implementation of regulations concerning the obligations to participate in the People's Public Security by local public security agencies; review proposals from local public security agencies for approval and allocation of annual recruitment quotas; advise the Ministry leadership on plans to attend handover ceremonies at local units; and draft plans for such ceremonies.

3. The Political Work Department shall take the lead and coordinate with local public security agencies to develop content for annual recruitment propaganda; instruct local public security agencies on various forms of propaganda; and propose commendations for outstanding collectives and innovative methods in recruitment work.

4. The People's Public Security Mass Media Department shall organize propaganda on annual recruitment activities (before, during, and after the recruitment period).

5. The Planning and Finance Department shall take the lead and instruct local public security agencies on budget preparation, management, utilization, and settlement of recruitment expenses; implement systems and policies for citizens during the time they fulfill the health examination decision; and coordinate with functional units to inspect the management, expenditure, and settlement of funds according to the State Budget Law and detailed regulations guiding its implementation in the fields of national security and social order and safety, as well as other related laws.

6. The Equipment and Logistics Department shall develop plans to ensure uniforms for recruitment work, distribute uniforms to conscripts assigned to local public security agencies and units receiving recruits under the Ministry of Public Security in accordance with specified requirements and deadlines; and guide and inspect the implementation thereof.

7. The Health Department shall take the lead in advising and proposing standards for health conditions, recruitment medical examinations, and cooperate in guiding and inspecting their implementation; instruct on infectious disease prevention during recruitment, post-examination health checks, screening tests, HIV, drug detection, and vaccination for new soldiers.

Article 11. Discharge and Discipline

1. The discharge and early discharge of non-commissioned officers and conscripts shall be implemented in accordance with Article 10 of Decree No. 70/2019/ND-CP, amended and supplemented by Clause 4 of Article 11 of Decree No. 184/2020/ND-CP, as follows:

a) In cases where they are not physically fit to continue serving:

Based on the application of non-commissioned officers and conscripts, the Commander, Director-General, and equivalent positions, and the Provincial Public Security Director shall request the Medical Board at the same level or the Medical Board of the Ministry of Public Security to examine and conclude.

Based on the conclusion of the Medical Board, the Commander, Director-General, and equivalent positions, and the Provincial Public Security Director shall decide on the discharge of non-commissioned officers and conscripts within their authority.

b) For cases stipulated in points b and c of Clause 1, and points a, b, and c of Clause 2 of Article 41 of the Military Service Law 2015:

Based on the application of non-commissioned officers and conscripts (confirmed by the People's Committee and Public Security Office at the commune level), the Commander, Director-General, and equivalent positions, and the Provincial Public Security Director shall decide on the discharge of non-commissioned officers and conscripts within their authority.

2. After non-commissioned officers and conscripts are discharged, units receiving recruits under the Ministry of Public Security shall provide the Provincial Public Security Office (where citizens were selected to fulfill obligations to participate in the People's Public Security) with lists of non-commissioned officers and conscripts who have been transferred to professional status, admitted to public security schools, had their public security titles revoked, and those who have completed their obligations and returned to their home provinces.

3. The consideration and disciplinary actions against non-commissioned officers and conscripts shall be carried out in accordance with Circular No. 38/2022/TT-BCA dated October 14, 2022, issued by the Minister of Public Security on disciplinary measures in the People's Public Security, amended and supplemented by Circular No. 84/2025/TT-BCA dated September 3, 2025, and Circular No. 32/2021/TT-BCA dated March 26, 2021, issued by the Minister of Public Security on the management and education of students at public security schools.

Chapter III
REGIME AND POLICY

Article 12. Regime and policies for citizens during the time of conducting health examinations pursuant to the Health Examination Call Decision of the Chairman of the People's Committee at the commune level

1. Regime and policies:

During the time of conducting health examinations, citizens participating in the selection process to fulfill their duty to join the People's Public Security are entitled to the regime and policies stipulated for citizens during the time of conducting health examinations for military service obligations as provided in Article 12 of Decree No. 13/2016/NĐ-CP dated February 19, 2016 of the Government on procedures and formalities for registration and the regime and policies of citizens during the time of registration, health examination, and health check-up for military service obligations, amended and supplemented by Clause 9, Article 7 of Decree No. 220/2025/NĐ-CP dated August 7, 2025 of the Government amending and supplementing some articles of several decrees in the field of national defense and military when organizing local administrative authorities at two levels, specifically as follows:

a) Citizens working at agencies and organizations receiving salaries from the state budget, state-owned enterprises during the time of conducting health examinations pursuant to the Health Examination Call Decision of the Chairman of the People's Committee at the commune level shall be entitled to full salary, current allowances, and travel expenses according to the current regulations of the law;

b) Citizens not belonging to agencies and organizations receiving salaries from the state budget, state-owned enterprises during the time of conducting health examinations pursuant to the Health Examination Call Decision of the Chairman of the People's Committee at the commune level shall be guaranteed the following regimes: Food allowance equivalent to the basic daily food allowance of conscripted non-commissioned officers and soldiers. Payment of travel expenses according to the current regulations of the law.

2. Principles of entitlement to the regime:

Time spent traveling and conducting health examinations for four hours or more in a day counts as a full day; less than four hours counts as half a day.

3. Responsibility for payment:

a) Citizens working at agencies and organizations receiving salaries from the state budget, state-owned enterprises when conducting health examinations pursuant to the Health Examination Call Decision of the Chairman of the People's Committee at the commune level shall be paid by the agency, organization, or enterprise where they work;

b) Citizens not belonging to agencies and organizations receiving salaries from the state budget, state-owned enterprises when conducting health examinations pursuant to the Health Examination Call Decision of the Chairman of the People's Committee at the commune level shall be proposed by the Public Security Office at the commune level and paid by the Public Security Department at the provincial level, with settlement and finalization.

4. Source of budget guarantee:

a) The funds for implementing the regime and policies during the time of conducting health examinations for the subjects specified in point a, Clause 3 of this Article shall be guaranteed by the state budget according to the current state budget classification;

b) The funds for implementing the regime and policies during the time of conducting health examinations for the subjects specified in point b, Clause 3 of this Article shall be guaranteed by the state budget and allocated within the annual regular expenditure budget of the Public Security unit and locality.

Article 13. Promotion and advancement of rank

1. Promotion of rank:

Citizens selected to fulfill their duty to join the People's Public Security shall be promoted to the rank of Private Second Class from the date of handover of troops; in cases where there is no centralized handover of troops, they shall be promoted to the rank of Private Second Class from the date the People's Public Security unit receives them.

2. Term for advancement of rank:

a) Advancement to the rank of Private First Class: Private Second Class has held the rank for six months;

b) Advancement to the rank of Corporal: Private First Class has held the rank for six months;

c) Advancement to the rank of Sergeant: Corporal has held the rank for twelve months;

d) Advancement to the rank of Senior Sergeant: Sergeant has held the rank for twelve months or, during the period of active service, a conscripted non-commissioned officer who has achieved outstanding results in protecting national security, maintaining public order and safety, combating crime and violations of the law and has been awarded a Commendation Certificate from the Prime Minister or higher, and has held the rank of Corporal for twelve months;

đ) Conscripted non-commissioned officers and soldiers who are disciplined or fail to complete tasks or have more than three months (66 working days, including cumulative) of sick leave or medical treatment leave (except in cases of injury during training or combat) will have their term for advancement of rank extended by the duration of each rank to be advanced. In cases of disciplinary action involving demotion in rank, the provisions of the Minister of Public Security regarding disciplinary measures in the People's Public Security shall be followed.

3. Advancement of rank

a) Conscripted non-commissioned officers and soldiers are eligible for advancement of rank if they meet the following conditions:

Completing tasks at a satisfactory level or above; not violating discipline from a reprimand or higher; not currently under investigation for disciplinary action; not temporarily suspended, suspended from work, or having complaints or accusations or issues requiring verification and clarification.

Meeting the term for advancement of rank for each level as stipulated in Clause 2 of this Article.

During the term of holding the rank, having no more than three months (66 working days, including cumulative) of sick leave or medical treatment leave (except in cases of injury during training or combat).

b) Conscripted non-commissioned officers and soldiers currently serving a disciplinary decision are not eligible for advancement of rank. After completing the disciplinary decision (when the effect of the disciplinary decision ends), if they meet the conditions and criteria, they may be considered for advancement of rank starting from the month immediately following the completion of the disciplinary decision;

c) Conscripted non-commissioned officers and soldiers currently temporarily suspended, suspended from work, or having complaints or accusations or issues requiring verification and clarification are not eligible for advancement of rank. After a conclusion that they were not in violation (wrongly accused), they may be advanced in rank from the month of the term for advancement of rank. If the conclusion does not reach the level requiring disciplinary action, they may be considered for advancement of rank after the date of the conclusion.

4. Enlisted personnel who are successfully admitted to police academies or schools shall have their study period at such institutions, including any time spent studying at external institutions outside the police force (if applicable), counted towards the term for promotion to rank grade. During the study period, they may be promoted up to the rank of Senior Sergeant, receive rank grade allowances and other benefits as if they were on active duty (excluding duty allowances, special allowances, benefits related to work locations as stipulated in Article 17 of this Circular, and additional allowances specified in Article 17 of this Circular), and shall not be converted to professional status. Upon graduation, their salary and rank grade will be determined according to regulations set forth by the Minister of Public Security.

5. Authority to confer, promote, demote, or revoke rank grades for enlisted personnel:

The head of the local public security unit shall base decisions to confer, promote, demote, or revoke rank grades for enlisted personnel on the division of responsibilities among various levels of the public security force as prescribed by the Ministry of Public Security regarding organizational and cadre work, and the term for promotion to rank grade as stipulated in Clause 2 of this Article.

6. Enlisted personnel who are conferred or promoted to a certain rank grade shall enjoy the corresponding rank grade allowance as prescribed in Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary systems for civil servants, public officials, and members of the armed forces, amended and supplemented by Decree No. 117/2016/ND-CP dated July 21, 2016, specifically:

a) Rank grade of Senior Sergeant: allowance coefficient of 0.70;

b) Rank grade of Staff Sergeant: allowance coefficient of 0.60;

c) Rank grade of Junior Sergeant: allowance coefficient of 0.50;

d) Rank grade of Private First Class: allowance coefficient of 0.45;

đ) Rank grade of Private Second Class: allowance coefficient of 0.40.

Article 14. Benefits and policies for enlisted personnel during their service period and upon discharge

1. Enlisted personnel during their service period and upon discharge shall enjoy benefits and policies prescribed for non-commissioned officers and soldiers serving in the national armed forces as stipulated in Article 50 of the Law on Military Service 2015, Decree No. 27/2016/ND-CP dated April 6, 2016 of the Government on certain benefits and policies for non-commissioned officers and soldiers serving on active duty, discharged from service, and relatives of non-commissioned officers and soldiers on active duty (hereinafter referred to as Decree No. 27/2016/ND-CP), amended and supplemented by Decree No. 209/2025/ND-CP dated July 21, 2025 of the Government amending and supplementing several articles of 11 decrees of the Government under the purview of the Ministry of National Defense, Clause 2 of this Article, and Articles 15, 16, 17, and 18 of this Circular.

2. Enlisted personnel who are discharged from service and have served in the public security force for at least 12 months shall be entitled to vocational training support according to current state regulations.

3. In cases where enlisted personnel are disciplined with the revocation of their public security officer title, they shall not be eligible for benefits and policies for enlisted personnel upon discharge as stipulated in Clause 2 of this Article and Article 18 of this Circular, except for social insurance benefits.

Article 15. Policy and regulations for cases where conscripts are sent to study, during their study period, training institutions decide to terminate their studies and return them to their original units to fulfill their duty to participate in the People's Public Security Force.

1. In cases where conscripts are fulfilling their duty to participate in the People's Public Security Force and are admitted to training institutions within the People's Public Security Force or outside it (sent for training by the Ministry of Public Security), during their study period, if the training institutions decide to terminate their studies and return them to the public security units or localities where they originally fulfilled their duty to participate in the People's Public Security Force (the initial selection unit), upon receiving the conscripts, the public security units or localities shall implement procedures to resolve policies for conscripts with termination of study decisions from the training institutions as follows:

a) In cases where the time when conscripts are terminated from their studies and returned to the public security units or localities coincides with the remaining service term of other conscripts who enlisted at the same time (same class), they continue to fulfill their duty to participate in the People's Public Security Force until the end of their service term; upon discharge, they will be subject to the policy and regulations applicable to conscripts who did not attend training at any institution.

b) In cases where the time when conscripts are terminated from their studies and returned to the public security units or localities coincides with the completion of the service term and discharge of other conscripts who enlisted at the same time (same class), the head of the public security unit or locality decides on the discharge of conscripts with termination of study decisions according to regulations; upon discharge, they will be subject to similar policies and regulations as conscripts of the same class who were discharged.

2. The period during which conscripts fulfill their duty to participate in the People's Public Security Force at their units to implement policies and regulations (excluding social insurance benefits) is calculated from the date they begin fulfilling their duty to participate in the People's Public Security Force to the date they enroll in training institutions within or outside the People's Public Security Force, and the period during which conscripts continue to fulfill their duty to participate in the People's Public Security Force after being terminated from their studies and returned to the public security units or localities (if any), without counting the time spent studying at the training institutions.

Article 16. Payment in lieu of leave days that cannot be granted

Conscripts who meet the conditions to take annual leave as prescribed but cannot be granted leave due to combat requirements, readiness for combat, or difficult travel conditions in certain areas, shall be paid leave benefits as follows:

1. The amount paid for each day of ungranted leave is equivalent to the daily basic food allowance of conscripts as prescribed at the time of ungranted leave; the maximum number of days that can be paid for each conscript is ten days. Transportation costs, travel allowances, and travel time are not included in the payment.

2. Commanders at the regiment level and above are responsible for reviewing and deciding on cases eligible for payment in lieu of leave at the unit.

3. Special leave cases as prescribed in Clause 4, Article 3 of Decree No. 27/2016/NĐ-CP are not eligible for payment in lieu of leave.

Article 17. Additional Allowance System

1. Non-professional non-commissioned officers and soldiers serving from the 25th month onwards shall be entitled to an additional allowance of 250% of their current rank grade allowance on a monthly basis.

3. The additional allowance system does not apply to non-professional non-commissioned officers and soldiers who are waiting to transfer to a professional status; those awaiting admission to school, examination for enrollment, and other similar cases.

Article 18. Discharge Allowance System

1. Upon discharge, non-professional non-commissioned officers and soldiers shall be entitled to a one-time social insurance benefit or shall have their social insurance contribution period preserved according to the law on social insurance and a one-time discharge allowance. The one-time discharge allowance shall be calculated as follows: For each year (full 12 months) of service in the People's Public Security, they will receive an allowance equivalent to two months' basic salary as stipulated by the Government at the time of discharge.

In cases where the service period includes partial months, it will be calculated as follows:

a) Less than one month will not be eligible for a discharge allowance;

b) From one month to six months inclusive, they will receive an allowance equivalent to one month's basic salary;

c) More than six months up to twelve months, they will receive an allowance equivalent to two months' basic salary.

2. Upon discharge, non-professional non-commissioned officers and soldiers will receive additional allowances as follows:

a) Service period from the 25th month to less than 30 months will entitle them to an additional one-month rank grade allowance;

b) Service period of thirty months or more will entitle them to an additional two-month rank grade allowance.

3. Non-professional non-commissioned officers and soldiers who complete their service obligation as prescribed upon discharge will receive an employment creation allowance equivalent to six months' basic salary as stipulated by the Government at the time of discharge.

4. Upon discharge, non-professional non-commissioned officers and soldiers will be organized by the directly managing unit to attend a farewell meeting before discharge, with expenses covered according to the Government's regulations on certain benefits and policies for non-commissioned officers and soldiers during service, upon discharge, and for the families of non-commissioned officers and soldiers during service; they will be escorted back to their place of residence according to regulations or provided with train or bus fare (ordinary class) and travel allowance from the unit to their place of residence.

5. Non-professional non-commissioned officers and soldiers discharged before the term will also implement the benefits and policies prescribed in this article.

Article 19. Budget Sources Ensuring Benefits and Policies for Non-Professional Non-Commissioned Officers and Soldiers During Service and Upon Discharge

1. The funds to implement the benefits and policies for non-professional non-commissioned officers and soldiers as stipulated in this Circular shall be guaranteed by the State budget and allocated in the annual regular budget of the Ministry of Public Security assigned to local public security units.

2. Annually, local public security units shall be responsible for preparing the budget for implementing the benefits and policies for non-professional non-commissioned officers and soldiers and consolidating it into their own unit's annual budget report to the Ministry of Public Security (through the Department of Planning and Finance) for consolidation and submission of the Ministry of Public Security's budget expenditure plan to the Ministry of Finance in accordance with the Law on State Budget and detailed regulations and implementation guidelines in the field of national security and social order and safety.

Chapter IV
IMPLEMENTATION

Article 20. Effective Date

1. This Circular takes effect from the date of issuance and replaces Circular No. 63/2023/TT-BCA dated November 15, 2023, issued by the Minister of Public Security regarding the selection and implementation of benefits and policies for citizens performing their duty to participate in the People's Public Security..

2. In case the legal normative documents cited for application in this Circular are amended, supplemented, or replaced, the amended, supplemented, or replaced documents shall apply.

3. Attached to this Circular are appendices containing forms related to the selection process and implementation of benefits and policies for non-professional non-commissioned officers and soldiers.

Article 21. Responsibility for Implementation

1. Heads of local public security units shall be responsible for disseminating and implementing this Circular among cadres and soldiers and organizing its implementation.

2. The Director of the Cadre Organization Department shall be responsible for supervising, guiding, and inspecting the implementation of this Circular.

Any difficulties encountered during the implementation process shall be reported to the Ministry (through the Cadre Organization Department) for consolidation and reporting to the Minister for consideration and decision./.

Results of selecting citizens to fulfill the obligation

to join the People's Public Security Force in the year ….

I. Recruitment situation (focus on the following contents):

1. Propaganda work, dissemination, raising awareness and responsibility in fulfilling regulations regarding the obligation to join the People's Public Security Force among the people, especially citizens within the recruitment age range;

2. Coordination with military agencies, local authorities at the same level in recruitment source creation work and in conducting recruitment procedures, handover, and receipt of recruits;

3. Advisory work and proposals to the People's Committee at the same level in allocating recruitment areas and in directing recruitment implementation;

4. Coordination between subordinate units of the Ministry (units receiving recruits) and provincial-level Public Security agencies.

II. Recruitment results

1. Provincial Public Security agencies compile recruitment results according to Model 9.

2. Units receiving recruits compile recruitment receipt results according to Model 10.

III. Difficulties and obstacles in recruitment

1. Focus on difficulties and obstacles in recruitment coordination work; guidance and direction from functional agencies; obstacles in implementing related regulations. For each difficulty and obstacle, clearly identify the cause and measures to address them.

2. Specifically state the reasons for not meeting recruitment quotas, responsibilities of units and localities, or experiences in recruitment work (if the quota was met), highlighting exemplary districts, counties, etc., in recruitment work./.
