REGULATING TECHNICAL-ECONOMIC QUOTAS FOR CREATIVE ACTIVITIES OF ARTISTS AT CREATIVITY CAMPS SERVING POLITICAL MISSIONS
BASED ON DECREE NO. 32/2019/NĐ-CP DATED APRIL 10, 2019 OF THE GOVERNMENT REGULATING TASK ASSIGNMENTS, CONTRACTS OR TENDER PROCESSES FOR CULTURAL AND PUBLIC SERVICES USING STATE BUDGET FROM ONGOING FUND SOURCES;
BASED ON DECREE NO. 60/2021/NĐ-CP DATED JUNE 21, 2021 OF THE GOVERNMENT REGULATING FINANCIAL AUTONOMY MECHANISMS FOR PUBLIC SECTOR UNITS, AMENDED AND SUPPLEMENTED BY DECREE NO. 111/2025/NĐ-CP;
BASED ON DECREE NO. 43/2025/NĐ-CP DATED FEBRUARY 28, 2025 OF THE GOVERNMENT REGULATING FUNCTIONAL ROLES, MISSIONS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF CULTURE, SPORTS AND TOURISM;
IN ACCORDANCE WITH THE PROPOSAL OF THE DIRECTOR OF THE DEPARTMENT OF ARTS PERFORMANCE;
THE MINISTER OF CULTURE, SPORTS AND TOURISM ISSUES THIS CIRCULAR TO REGULATE TECHNICAL-ECONOMIC QUOTAS FOR CREATIVE ACTIVITIES OF ARTISTS AT CREATIVITY CAMPS SERVING POLITICAL MISSIONS.
ARTICLE 1. SCOPE OF APPLICATION AND APPLICABLE PARTIES
1. SCOPE OF APPLICATION
This Circular regulates technical-economic quotas for creative activities of artists to encourage creative talents, forming literary and artistic works with valuable content, ideology, and artistry at creativity camps serving political missions using state budget (hereinafter referred to as public service projects).
2. APPLICABLE PARTIES
a) Parties utilizing the state budget to provide public services;
b) Parties related to the implementation of public services using the state budget.
ARTICLE 2. GENERAL PROVISIONS ON TECHNICAL-ECONOMIC QUOTAS
1. The technical-economic quotas in this Circular are the maximum level required to complete the provision of public services.
2. Technical-economic quotas serve as a basis for calculating the wastage costs of labor, materials, machinery, and equipment used to complete a unit product or a specific volume of work under the specific conditions of the public service.
3. Determination of Labor Positions
a) The labor positions in the manpower component of the quota are determined according to Circular No. 10/2023/TT-BVHTTDL guiding leadership, management, and professional position placements, staffing structure based on professional positions within public sector units under the culture, sports, and tourism sectors;
b) In cases where labor positions in the manpower component are not specified in this Circular, they shall be determined according to Decree No. 204/2004/NĐ-CP on remuneration for civil servants, public sector employees, and military personnel, amended and supplemented by Decree No. 117/2016/NĐ-CP and Decree No. 07/2026/NĐ-CP; Decree No. 111/2022/NĐ-CP on contracts for certain types of work in administrative agencies and public sector units, or by considering equivalent conversion based on positions approved by the competent authority;
c) In cases where the rank or grade of a labor position currently being performed at an agency does not conform to the technical-economic quota table, the competent authority shall consider and decide on applying equivalent ranks or grades for the current labor position and the cost according to actual conditions. In such cases, it must ensure that manpower costs do not exceed those calculated from this Circular;
d) Civil servants and public sector employees receiving state budgetary remuneration when participating in implementing various components of work in the service provision process are exempt from applying the technical-economic labor cost quotas specified in this Circular.
d) Civil servants and staff receiving salaries from state budget shall not be subject to the labor cost allocation standards prescribed in this Circular when participating in implementing various components of work in the public service provision process.
Article 3. Content of Economic and Technical Quotas
1. The content of economic and technical quotas includes:
a) Labor Wastage: Refers to the necessary direct labor time and indirect labor time for average levels of workers to complete the execution of a public service. The wastage level of direct labor is the time spent on the processes of the public sector service, measured in "gong." One gong corresponds to 8 hours of working time of a worker as stipulated by labor law. The wastage level of indirect labor is calculated at 15% of the total direct labor wastage within the same quota table;
b) Machinery and Equipment Wastage: Refers to the necessary usage time for each type of machinery and equipment to provide public sector services. The machinery and equipment wastage in the quota is measured by shifts, with one shift corresponding to 8 hours of working time as stipulated by labor law;
c) Material Wastage: Refers to the specific quantities and necessary materials used directly for providing public sector services. The material wastage in the quota is calculated based on the quantity of each type of specific material. The wastage level of auxiliary materials is calculated at 5% of the total value of material wastage within the same quota table.
2. The structure of economic and technical quotas includes:
a) Quota Title;
b) Description of Work Content: The main processes to be carried out for providing public sector services;
c) Quota Table, including:
- Labor Wastage: Job title and labor grade, unit of measurement for wastage, and the quota value for labor wastage;
- Machinery and Equipment Usage Wastage: Type of machinery and equipment, unit of measurement for wastage, and the quota value for usage of machinery and equipment;
- Material Usage Wastage: Name and specification of materials, unit of measurement for wastage, and the quota value for material usage;
- Quota Value: The numerical value representing the actual time or quantity executed on labor, machinery and equipment usage, and material usage in the process of providing public sector services;
- Notes: Guidance on how to calculate the quota under different technical conditions (if applicable) or for completing a different volume of work than that specified in the Quota Table.
3. Economic and technical quotas support the organization of creative camps as stipulated in the annex to this Circular.
Article 4. Implementation
1. Based on the economic and technical quotas prescribed in this Circular, central and local departments and agencies shall implement support for the creative activities of artists at creative camps serving political tasks by proposing and submitting decisions to organize creative camps applying specific quotas.
2. Encourage non-governmental organizations providing public sector services without using state funds to apply the economic and technical quotas prescribed in this Circular.
3. Implementation must ensure alignment with objectives, specificity, transparency, and effectiveness.
Article 5. Enforceability
1. This Circular shall take effect from July 6, 2026.
2. In the event that any legislative documents serving as the basis for the formulation of this Circular are amended, supplemented, or replaced, such changes shall be implemented in accordance with the newly issued document.
3. During implementation, if any issues arise, difficulties occur, relevant agencies, organizations, and individuals may reflect to the Ministry of Culture, Sports and Tourism (through the Department of Fine Arts) for consideration and resolution./.
