DECISION OF THE PRIME MINISTER
Approving the list of communes that have completed the targets of the Socio-Economic Development Program for ethnic minority and mountainous communes, border areas, and remote and far-flung areas during the period of 1999-2005, supplementing communes, villages, and hamlets to the investment scope of the Program 135 Phase II and coastal and island communes to the investment scope of the National Target Program on Poverty Reduction for the period of 2006-2010

PRIME MINISTER
Based on the Law on the Organization of the Government dated December 25, 2001;
Pursuant to Decision No. 07/2006/QĐ-TTg dated January 10, 2006, of the Prime Minister approving the Socio-Economic Development Program for particularly difficult communes in ethnic minority and mountainous areas for the period of 2006-2010;
Pursuant to Decision No. 20/2007/QĐ-TTg dated February 5, 2007, of the Prime Minister approving the National Target Program on Poverty Reduction for the period of 2006-2010;
Considering the proposal of the Minister of Labor, Invalids and Social Affairs and the Chairman of the Committee for Ethnic Minorities Affairs,
DECISION:
Article 1.
1. Approves the supplementary list of 65 particularly difficult communes in 20 provinces (Annex I attached hereto) which have completed the targets of the Socio-Economic Development Program for particularly difficult communes in ethnic minority and mountainous areas, border areas, and remote and far-flung areas during the period of 1999-2005.
2. For particularly difficult communes, border communes, safe area communes, particularly difficult villages and hamlets in Zone II, which are supplemented into the investment scope of Program 135 Phase II, implement the tasks of the Program from the 2007 plan:
a) Approves the list of 155 particularly difficult communes, border communes, and safe area communes in 29 provinces (Annex II attached hereto) which are supplemented into the investment scope of Program 135 Phase II.
The state budget will support investment for the 155 communes supplemented into the investment scope of the Program:
- Central budget support for investment: 153 communes;
- Local budget investment: 02 communes.
b) Entrusts the Chairman of the Committee for Ethnic Minorities Affairs to decide on approving the list of particularly difficult villages and hamlets in Zone II into the investment scope of Program 135 Phase II after reaching consensus with the Minister of Planning and Investment and the Minister of Finance.
c) The remaining particularly difficult communes and villages and hamlets in Zone II proposed by the People's Committees of provinces and centrally-administered cities will be considered for supplementation into the investment scope of Program 135 Phase II after the results of the three-zone classification are available.
3. Particularly difficult communes in coastal and island areas within the investment scope of the National Target Program on Poverty Reduction for the period of 2006-2010 shall be supported to develop essential infrastructure according to the mechanism and level of investment support for essential infrastructure for particularly difficult communes under Program 135 Phase II from the 2008 plan, including:
a) 157 communes in 21 provinces which are supported to invest in essential infrastructure as stipulated in Decision No. 257/2003/QĐ-TTg dated December 3, 2003, of the Prime Minister regarding support for investment in building essential infrastructure for particularly difficult communes in coastal and island areas, approved by the Prime Minister at Decision No. 106/2004/QĐ-TTg dated June 11, 2004.
b) Supplements the list of 114 particularly difficult communes in coastal and island areas in 13 provinces (Annex III attached hereto).
Article 2.
1. Poor households according to the poverty standard prescribed in Decision No. 170/2005/QĐ-TTg dated July 8, 2005, of the Prime Minister on issuing the poverty standard applicable for the period of 2006-2010 (referred to as poor households), persons belonging to poor households, students in communes that have completed the Program 135 targets, and officials, civil servants, employees, military officers, and police officers working in communes that have completed the Program 135 targets during the period of 1999-2005 shall enjoy preferential policies currently implemented for communes under Program 135 Phase II until the end of 2008.
2. Poor households, persons belonging to poor households, students in particularly difficult villages and hamlets in Zone II, and officials, civil servants, military officers, and police officers working in particularly difficult villages and hamlets in Zone II approved as stipulated in point b, Clause 2, Article 1 of this Decision shall enjoy policies similar to those for communes under Program 135 Phase II.
Article 3.
1. Corrects the name of Bình Trung commune, Chợ Đồn district, which was specified in Decision No. 163/2006/QĐ-TTg dated July 11, 2006, of the Prime Minister on approving the list of particularly difficult communes that have basically completed the targets of the Socio-Economic Development Program for particularly difficult communes in ethnic minority and mountainous areas, border areas, and remote and far-flung areas, to Nghĩa Tá commune, Chợ Đồn district, Bac Kan province.
2. Corrects some commune names and district names specified in Decision No. 164/2006/QĐ-TTg dated July 11, 2006, of the Prime Minister on approving the list of particularly difficult communes, border communes, and safe area communes to be included in the investment scope of Program 135 Phase II, as follows:
- In Son La province: replaces Mường Sai commune, Sốp Cộp district with Mường Cai commune, Sông Mã district;
- In Bac Kan province: replaces Xuân La commune, Ba Bể district with Xuân La commune, Pắc Nặm district; replaces Cao Trĩ commune, Pắc Nặm district with Bành Trạch commune, Ba Bể district;
- In Quang Nam province: replaces Trà Vân commune, Nam Trà My district with Trà Don commune, Nam Trà My district;
- In Quang Ngai province: replaces Trà Nham commune, Trà Bồng district with Trà Nham commune, Tây Trà district; replaces Trà Bùi commune, Tây Trà district with Trà Bùi commune, Trà Bồng district;
- In Lam Dong province: replaces Đạ Long commune, Lạc Dương district with Đạ Long commune, Đam Rông district.
Article 4.
1. The Committee for Ethnic Minorities Affairs shall take the lead and coordinate with relevant ministries and sectors to guide, direct, inspect, urge localities to effectively implement and utilize the capital for supporting investment for particularly difficult communes, villages, and hamlets within the investment scope of Program 135 Phase II in accordance with current regulations.
2. The Ministry of Labor, Invalids and Social Affairs shall take the lead and coordinate with relevant ministries and sectors:
a) Guide, direct, inspect, urge localities to effectively implement and utilize the capital for supporting investment for particularly difficult communes in coastal and island areas in accordance with current regulations;
b) Annually, conduct a review of communes that meet the conditions to be removed from the list of particularly difficult coastal and island communes eligible for support in essential infrastructure investment.
3. The Ministry of Planning and Investment and the Ministry of Finance shall allocate targeted financial support funds for provincial People's Committees and centrally governed city People's Committees with particularly difficult communes, villages, and hamlets within the scope of investment under the Programs.
4. Provincial People's Committees and centrally governed city People's Committees with particularly difficult communes, villages, and hamlets within the scope of investment under the Programs shall have the responsibility to direct the establishment, approval, and implementation in accordance with the intended purpose, target recipients, and content of the support as stipulated by current regulations.
Article 5. This Decision shall take effect fifteen days after its publication in the Official Gazette.
Article 6. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
