Providing detailed regulations and guidance on the implementation of the Law on the Supervisory Activities of the National Assembly and People's Councils National Assembly

and regarding the supervisory activities of the People's Councils

 THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY 

Pursuant to the Constitution of the Socialist Republic of Vietnam which has been amended and supplemented by Resolution No. 203/2025/QH15 Pursuant to the Law on Local Administration Organization No. 72/2025/QH15;;

Pursuant to the Law on Organization of the National Assembly No. 57/2014/QH13 amended and supplemented by Law No. 65/2020/QH14 and Law No. 62/2025/QH15;

Pursuant to the Law on the Supervisory Activities of the National Assembly and People's Councils /QH1

Pursuant to the Law on Issuing Legal Normative Documents No. 64/2025/QH15 number 121/2025which has been amended and supplemented by Law No. 87/2025/QH15;5;

REGULATIONS has This Resolution provides detailed regulations and guidance on the procedures, formalities, responsibilities of agencies, organizations, and individuals in organizing the implementation of the supervisory activities of the People's Councils, the Standing Committee of the People's Councils, Committees of the People's Councils, Delegation Groups of the People's Councils, and People's Council representatives as stipulated in Articles 9, 12, 27, 28, 30, 31, 33, 34, 36, 37, 39, 40, 41, and 42 of the Law on the Supervisory Activities of the National Assembly and People's Councils, except for the provisions at point b, Clause 1 and point b, Clause 2 Article 28, point c, Clause 1, point b, Clause 2 and point b, Clause 3 Article 31, point b, Clause 1, point b, Clause 2 and point b, Clause 3 Article 34, point b and point d, Clause 1 and point b and point d, Clause 2 Article 36.

RESOLUTION:

 PART I

1. The People's Councils, the Standing Committee of the People's Councils, Committees of the People's Councils, Delegation Groups of the People's Councils, and People's Council representatives; the Office of the Delegation Group of the National Assembly and People's Councils at the provincial level, the Office of the People's Councils and People's Committee at the commune level (hereinafter referred to as the People's Council support agencies).G

Article 1. Scope of Regulation

2. Agencies, organizations, and individuals subject to supervision; other agencies, organizations, and individuals related to supervisory activities.

Article 2. Applicability

Article 3. Objects of Supervision by the People's Councils

1. The objects of supervision by the provincial-level People's Councils are as follows:

a) The provincial-level People's Councils supervise the Standing Committee of the People's Councils, Committees of the People's Councils, Provincial People's Committee, Special Zone People's Committee where no local administrative level is organized, People's Court, People's Procuracy, civil enforcement agency, other organizations under central agencies organized vertically in the locality, and other state agencies in the locality.

In cases deemed necessary due to practical requirements, the provincial-level People's Councils may conduct supervision over other agencies, organizations, and individuals at the commune level;

b) The Standing Committee of the People's Councils, Committees of the provincial-level People's Councils supervise the Provincial People's Committee, specialized agencies, other administrative organizations, and public service units under the Provincial People's Committee, Special Zone People's Committee where no local administrative level is organized, People's Court, People's Procuracy, civil enforcement agency, other organizations under central agencies organized vertically in the locality, People's Councils at the district level, and other state agencies in the locality.

In cases deemed necessary due to practical requirements, the Standing Committee of the People's Councils, Committees of the provincial-level People's Councils may conduct supervision over other agencies, organizations, and individuals at the commune level;

c) Representatives of the provincial-level People's Councils supervise agencies, organizations, and individuals in the locality according to Clause 1, Article 36 of the Law on the Supervisory Activities of the National Assembly and People's Councils.

2. The objects of supervision by the commune-level People's Councils are as follows:

a) The commune-level People's Councils supervise the Standing Committee of the People's Councils, Committees of the People's Councils, Commune People's Committee, and other state agencies in the locality;

b) The Standing Committee of the People's Councils, Committees of the commune-level People's Councils supervise the Commune People's Committee, specialized agencies, other administrative organizations, and public service units under the Commune People's Committee, and other state agencies in the locality;

c) Representatives of the commune-level People's Councils supervise agencies, organizations, and individuals in the locality according to Clause 2, Article 36 of the Law on the Supervisory Activities of the National Assembly and People's Councils.

b) The Standing Committee of the People's Council, Committees of the People's Council at the commune level shall supervise the People's Committee at the commune level, specialized agencies, other administrative organizations, and public service units under the People's Committee at the commune level, and other state agencies in the locality;

c) Deputies of the People's Council at the commune level shall supervise agencies, organizations, and individuals in the locality in accordance with Clause 2 of Article 36 of the Law on the Supervision Activities of the National Assembly and People's Councils.

 Chapter II

ANNUAL OVERSIGHT PROGRAM

Section 1

DEVELOPMENT AND IMPLEMENTATION OF THE OVERSIGHT PROGRAM

BY THE PEOPLE'S COUNCIL, THE STANDING COMMITTEE OF THE PEOPLE'S COUNCIL

Article 4. Basis for developing the oversight program of the People's Council and the Standing Committee of the People's Council

1. The oversight program of the People's Council shall be developed based on the Party's guidelines and policies, laws, regulatory legal documents of higher-level state agencies, resolutions of the same-level People's Council, results of the previous year's oversight program of the People's Council, proposals from the Standing Committee of the People's Council, Committees of the People's Council, Delegation Groups of the People's Council, People's Council members, the same-level Vietnam Fatherland Front Committee, opinions and petitions of voters, and actual conditions at the locality.

2. The oversight program of the Standing Committee of the People's Council shall be developed based on the Party's guidelines and policies, laws, regulatory legal documents of higher-level state agencies, resolutions of the same-level People's Council, the oversight program of the People's Council, results of the previous year's oversight program of the Standing Committee of the People's Council, proposals from the Committees of the People's Council, Delegation Groups of the People's Council, People's Council members, the same-level Vietnam Fatherland Front Committee, opinions and petitions of voters, and actual conditions at the locality.

Article 5. Proposing contents for the oversight program of the People's Council and the Standing Committee of the People's Council

1. At least thirty days before the opening day of the regular annual session of the People's Council, the Committees of the People's Council, Delegation Groups of the People's Council, People's Council members, and the same-level Vietnam Fatherland Front Committee shall submit proposals for the contents to be included in the oversight program of the People's Council and the Standing Committee of the People's Council for the following year to the Standing Committee of the People's Council.

The proposal document must clearly specify the oversight activities according to Articles 28 and 31 of the Law on the Activities of Supervision of the National Assembly and People's Councils, and simultaneously explain the necessity, content, scope, subjects, and time frame of the supervision.

2. The People's Council's working agency has the responsibility to request and urge relevant agencies, organizations, and individuals to submit proposals within the deadline; organize the collection, synthesis of proposals, and report to the Standing Committee of the People's Council.

Article 6. Developing the proposed oversight program of the People's Council, the Standing Committee of the People's Council

1. Based on the provisions of Article 4 of this Resolution and the results of collecting and synthesizing proposals, the People's Council's working agency is responsible for developing the proposed oversight program of the People's Council and the Standing Committee of the People's Council, including the proposed contents that the People's Council and the Standing Committee of the People's Council will directly oversee; the contents that the People's Council assigns the Standing Committee of the People's Council, Committees of the People's Council, and Delegation Groups of the People's Council to organize implementation (if applicable); the contents that the Standing Committee of the People's Council assigns Committees of the People's Council and Delegation Groups of the People's Council to organize implementation (if applicable).

2. The People's Council's working agency seeks opinions from Committees of the People's Council, the same-level Vietnam Fatherland Front Committee, and the provincial inspection agency regarding the proposed oversight program of the People's Council and the Standing Committee of the People's Council to synthesize and present to the Standing Committee of the People's Council; if necessary, it may seek opinions from other related agencies at the locality and experts on the proposed oversight program.

Article 7. Providing opinions on the proposed supervision program of the People's Council, Standing Committee of the People's Council

1. The Standing Committee of the People's Council provides opinions on the proposed supervision program of the People's Council, Standing Committee of the People's Council at the meeting prior to the regular annual session of the People's Council.

2. The dossier submitted to the Standing Committee of the People's Council includes:

a) Report from the working agency of the People's Council on the proposed supervision program of the People's Council, Standing Committee of the People's Council;

b) Compilation of proposals arranged by content, clearly stating the name of the agency, organization, or individual making the proposal;

c) Explanation of the contents proposed in the supervision program;

d) Other related documents (if any).

3. The Standing Committee of the People's Council provides opinions on the proposed supervision program of the People's Council, Standing Committee of the People's Council in the following sequence:

a) A representative from the working agency of the People's Council presents the report on the proposed supervision program of the People's Council, Standing Committee of the People's Council;

b) The Standing Committee of the People's Council discusses;

c) Representatives from agencies, organizations, and individuals attending the meeting express their opinions (if any);

d) The chairperson concludes on: the proposed content of the supervision program of the People's Council, Standing Committee of the People's Council; matters of concern for drafting the proposal of the Standing Committee of the People's Council to submit to the People's Council; other related issues.

4. The working agency of the People's Council assists the Standing Committee of the People's Council in drafting the proposal and draft resolution on the supervision program of the People's Council to submit to the People's Council; drafting the draft resolution on the supervision program of the Standing Committee of the People's Council.

Article 8. Deciding on the supervision program of the People's Council

1. The People's Council decides on the supervision program for the next year at the regular annual session.

2. The dossier submitted to the People's Council includes:

a) Proposal from the Standing Committee of the People's Council on the proposed supervision program of the People's Council;

b) Compilation of supervision proposals arranged by content, clearly stating the name of the agency, organization, or individual making the proposal;

c) Explanation of the contents proposed in the supervision program;

d) Draft resolution on the supervision program of the People's Council;

đ) Other relevant documents (if any).

3. The People's Council decides on the supervision program in the following sequence:

a) A representative from the Standing Committee of the People's Council presents the proposal on the proposed supervision program;

b) The People's Council discusses;

c) The chairperson concludes on: the proposed content of the supervision program of the People's Council; matters of concern for perfecting the draft resolution on the supervision program of the People's Council; other related issues.

4. In necessary cases, the Standing Committee of the People's Council sends ballots to the People's Council representatives for opinions on selecting topics for supervision and reports to the People's Council.

5. The People's Council votes to pass the resolution on the supervision program of the People's Council. The resolution includes the following main contents:

a) Contents directly supervised by the People's Council;

b) Contents assigned to the Standing Committee of the People's Council, Committees of the People's Council, Delegation of People's Council representatives to organize implementation and report results to the People's Council (if any);

c) Responsibilities of agencies, organizations, and individuals;

d) Methods of organizing implementation.

6. The number and content of supervision in a year must ensure feasibility, suitability with the organizational capacity of the People's Council, Standing Committee of the People's Council, Committees of the People's Council, Delegation of People's Council representatives, and actual conditions; avoid overlap in content, time, location, and subjects of supervision; the form of supervision must be appropriate to the content of supervision.

Article 9. Decision on the supervision program of the Standing Committee of the People's Council

1. Within the latest seven days from the date the People's Council passes the resolution on the supervision program of the People's Council, the Standing Committee of the People's Council shall pass the resolution on the supervision program of the Standing Committee of the People's Council based on the proposal of the People's Council's working agency.

2. The resolution on the supervision program of the Standing Committee of the People's Council shall include the following main contents:

a) Contents that the Standing Committee of the People's Council directly supervises;

b) Contents assigned to Committees of the People's Council, Delegation of People's Council representatives to organize implementation and report results to the Standing Committee of the People's Council (if any).

c) Responsibilities of agencies, organizations, and individuals;

d) Methods of organizing implementation.

3. The quantity and content of supervision in a year must ensure feasibility, be appropriate to the organizational capacity of the Standing Committee of the People's Council, Committees of the People's Council, Delegation of People's Council representatives, and actual conditions; avoid overlap in content, time, location, and subjects of supervision; the form of supervision must be suitable for the content of supervision.

Article 10. Implementation of the supervision program of the People's Council, the Standing Committee of the People's Council

1. Within the latest seven days from the date the Standing Committee of the People's Council passes the resolution on the supervision program of the Standing Committee of the People's Council, the People's Council's working agency shall submit to the Standing Committee of the People's Council for issuance of a plan to implement the supervision program of the People's Council and the Standing Committee of the People's Council.

The plan must clearly state the purpose, requirements, content, scope, form of supervision, subjects under supervision; allocation of agencies responsible for implementation; progress schedule; organization and coordination work; in cases where reports from subjects under supervision must be reviewed according to regulations and relate to areas managed by different agencies, the plan must specify the leading reviewing agency and the coordinating reviewing agencies.

2. In case of necessity due to practical requirements, the Standing Committee of the People's Council decides to adjust its supervision program; during periods when the People's Council is not in session, it decides to adjust the supervision program of the People's Council and reports to the People's Council at the nearest regular session.

Article 11Reporting on the results of implementing the supervision program of the People's Council, the Standing Committee of the People's Council

1. Within the latest fifteen days before the opening day of the first regular session of the next year of the People's Council, Committees of the People's Council, Delegation of People's Council representatives assigned to mainly implement contents in the previous year's supervision program of the People's Council and the Standing Committee of the People's Council shall send reports on the results of implementation to the Standing Committee of the People's Council for consolidation and reporting to the People's Council.

2. The People's Council's working agency assists the Standing Committee of the People's Council in drafting the report on the results of implementation of the previous year's supervision program of the People's Council and the Standing Committee of the People's Council, sends it for comments from Committees of the People's Council; incorporates feedback, revises, and reports to the Standing Committee of the People's Council for consideration and submission to the People's Council at the first regular session of the next year.

3. The report stipulated in Clause 2 of this Article must evaluate achievements, shortcomings, limitations, causes; the degree of completion of the People's Council and the Standing Committee of the People's Council's supervision program; effectiveness of supervision as prescribed in Clause 1 of Article 11 of the Law on Supervision Activities of the National Assembly and People's Councils; responsibilities of related agencies; lessons learned; recommendations.

Section 2

BUILDING AND IMPLEMENTATION OF THE SUPERVISION PROGRAM OF THE COMMITTEE

OF THE PEOPLE'S COUNCIL, PEOPLE'S COUNCIL DELEGATES

Article 12. Basis for building the supervision program of the Committee of the People's Council, People's Council delegates

1. The supervision program of the Committee of the People's Council shall be established based on the Party's guidelines and policies, laws, regulatory legal documents of higher-level state agencies, resolutions of the same-level People's Council, the supervision program of the People's Council, the Standing Body of the People's Council, the results of the previous year's supervision program of the Committee of the People's Council, opinions of Committee members, citizens' opinions and petitions, and actual conditions of the locality.

2. If applicable, the supervision program of People's Council delegates shall be established based on citizens' opinions and petitions and the actual conditions of the locality.

Article 13. Decision-making and implementation of the supervision program of the Committee of the People's Council, People's Council delegates

1. Based on Clause 1 of Article 12 of this Resolution and the contents of supervision assigned by the People's Council and the Standing Body of the People's Council, the Chairman of the Committee of the People's Council shall direct the preparation of a draft supervision program, submit it to the Committee of the People's Council for consideration and approval not later than December 20 of the preceding year. The Committee of the People's Council shall have the responsibility to report to the same-level Standing Body of the People's Council about its supervision program.

The Chairman of the Committee of the People's Council shall direct the organization and implementation of the Committee's supervision program. The implementation plan must clearly specify the purpose, requirements, content, scope, form of supervision, allocation of Committee members to organize implementation, progress schedule, organizational work, and coordination.

In case of necessity due to practical requirements, the Committee of the People's Council may decide to adjust the supervision program and report to the same-level Standing Body of the People's Council.

2. Based on Clause 2 of Article 12 of this Resolution, People's Council delegates shall decide their supervision program for the following year (if applicable) and report to the same-level Standing Body of the People's Council through the Delegation of People's Council delegates not later than December 30 of the preceding year.

The Standing Body of the People's Council shall be responsible for organizing People's Council delegates to implement the supervision program. In case of necessity due to practical requirements, People's Council delegates may adjust their supervision program and report to the same-level Standing Body of the People's Council through the Delegation of People's Council delegates for coordination and cooperation.

3. The quantity and content of supervision in a year must ensure feasibility, suitability with the organizational capacity of the Committee of the People's Council, People's Council delegates, and actual conditions; avoid overlap in content, time, area, and subjects of supervision; the form of supervision must be appropriate to the content of supervision.

Article 14Reporting on the results of implementing the supervision program of The Committee of the People's Council, People's Council delegates, and the results of the Delegation of People's Council delegates' supervisory activities

1. Not later than 15 days before the opening of the first regular session of the People's Council in the following year, the Committee of the People's Council shall send a report on the results of implementing its supervision program in the previous year, and the Delegation of People's Council delegates shall send a report on the results of their supervisory activities in the previous year (if applicable) and of People's Council delegates in the Delegation (if applicable) to the Standing Body of the People's Council; at the same time, send them to the People's Council's working body for consolidation and reporting to the People's Council and the Standing Body of the People's Council.

Not later than 30 days before the opening of the first regular session of the People's Council in the following year, People's Council delegates shall send a report on the results of implementing their supervision program in the previous year (if applicable) to the Delegation of People's Council delegates.

2. The People's Council's working body shall prepare a draft report on the results of implementing the supervision program of the Committee of the People's Council, People's Council delegates, and the results of the Delegation of People's Council delegates' supervisory activities in the previous year, seek opinions from the Committee of the People's Council, the Delegation of People's Council delegates; incorporate feedback, revise, and report to the Standing Body of the People's Council for consideration and submission to the People's Council at the first regular session of the following year.

3. The reports stipulated in Clauses 1 and 2 of this Article must evaluate achievements, shortcomings, limitations, causes; the extent of completion of the supervision program of the Committee of the People's Council, People's Council delegates; the extent of completion of the results of the Delegation of People's Council delegates' supervisory activities; the effectiveness of supervision as prescribed in Clause 1 of Article 11 of the Law on Supervision Activities of the National Assembly and People's Councils; responsibilities of related agencies; lessons learned; recommendations and proposals.

Chapter III

IMPLEMENTATION OF SUPERVISION ACTIVITIES

Section 1

REVIEW AND AUDIT REPORTS  

Article 15. Responsibilities for reviewing reports of the People's Council and the Standing Committee of the People's Council

1. At each session, the People's Council shall review the following reports:

a) Reports of the same-level People's Committee on economy and society, state budget, local state budget settlement;

b) Mid-year and annual work reports, term-of-office work reports of the same-level People's Committee;

c) Mid-year and annual work reports, term-of-office work reports of the Standing Committee of the People's Council and Committees of the People's Council;

d) Reports of the same-level People's Committee on anti-corruption and wasteful practices, thrift and anti-waste, crime prevention and law enforcement, handling of complaints, denunciations, and proposals from organizations and individuals;

đ) Other reports as prescribed by law, resolutions of the People's Council, or requests of the Standing Committee of the People's Council.

2. In addition to the reports specified in Clause 1 of this Article, the provincial People's Council shall also review the following reports:

a) Reports of the special zone People's Committee on economy and society, state budget, state budget settlement where there is no local administrative level;

b) Mid-year and annual work reports, term-of-office work reports of the provincial People's Court, Provincial People's Procuracy, provincial civil execution agency, and special zone People's Committee where there is no local administrative level.

3. During the period between two sessions of the provincial People's Council, the Standing Committee of the provincial People's Council shall review the work reports of the People's Committee, People's Court, People's Procuracy, provincial civil execution agency, special zone People's Committee where there is no local administrative level, and other reports as stipulated in Points a, b, d, and đ of Clause 1 and Clause 2 of this Article assigned by the People's Council.

During the period between two sessions of the communal People's Council, the Standing Committee of the communal People's Council shall review the work reports of the communal People's Committee and other reports as stipulated in Points a, b, d, and đ of Clause 1 of this Article assigned by the People's Council.

4. The time for reviewing the reports as specified in Clauses 1 and 2 of this Article shall be carried out according to the provisions of the law; in cases where the law does not clearly specify the time for review, it shall be implemented according to the requirements of the Standing Committee of the same-level People's Council.

Article 16. Procedures and formalities for the People's Council to review reports

1. The review and discussion of reports as specified in Clauses 1 and 2 of Article 15 of this Resolution shall be decided by the People's Council based on the proposal of the Standing Committee of the same-level People's Council.

2. The People's Council shall review and discuss reports in the following sequence:

a) The head of the agency submitting the report presents the report.

b) The Chairman of the Committee of the People's Council presents the audit report for reports requiring audit as stipulated in Clause 1, Article 18 of this Resolution;

c) The People's Council discusses;

d) The head of the agency with the report explains related issues;

đ) The People's Council reviews and decides on the issuance of a resolution regarding the work of the agency with the report.

3. The Resolution of the People's Council shall include the following main contents:

a) Evaluation of achievements, limitations, shortcomings, and their causes; responsibilities of the agency with the report and its head, and responsibilities of related agencies, organizations, and individuals;

b) Solutions and deadlines for addressing limitations and shortcomings;

c) Responsibilities for implementation by agencies, organizations, and individuals;

d) Responsibilities for reporting on the implementation results of the resolution on the work of the agency with the report.

Article 17. Procedure and formalities for the Standing Committee of the People's Council to examine reports

1. The Standing Committee of the People's Council shall examine and discuss the report as prescribed in Clause 3, Article 15 of this Resolution according to the following procedure:

a) The head of the agency submitting the report presents the report.

b) The Chairman of the Committee of the People's Council presents the audit report for reports requiring audit as stipulated in Clause 1, Article 18 of this Resolution;

c) The Standing Committee of the People's Council discusses;

d) Representatives of agencies and organizations participating in the session make statements (if any);

đ) The head of the agency submitting the report explains related issues;

e) The Standing Committee of the People's Council concludes on the work of the reporting agency.

2. The conclusion shall include the following main contents:

a) Contents as prescribed in Points a, b, and c, Clause 3, Article 16 of this Resolution;

b) Responsibility to report on the results of implementing the conclusions regarding the work of the reporting agency.

3. The Standing Committee of the People's Council shall report to the People's Council on the results of examining the report.

Article 18. Committees of the People's Council to audit reports

1. Reports as prescribed in Points a, b, d, and đ, Clause 1 and Clause 2, Article 15 of this Resolution shall be audited by the Committees of the People's Council before being submitted to the People's Council and the Standing Committee of the People's Council as follows:

a) Reports as prescribed in Point a, Point d, Clause 1 and Point a, Clause 2 of Article 15 of this Resolution within the scope of responsibility of the Committees of the People's Council;

b) Reports as prescribed in Point b, Point đ, Clause 1 and Point b, Clause 2 of Article 15 of this Resolution shall be audited when assigned by the Standing Committee of the People's Council at the same level.

2. The Committees of the People's Council shall organize a meeting to audit the reports as prescribed in Clause 1 of this Article according to the following procedure:

a) The head of the agency submitting the report presents the report.

b) The Committees of the People's Council discuss;

c) Representatives of agencies and organizations participating in the meeting make statements (if any);

d) The head of the agency submitting the report explains related issues;

đ) The Committees of the People's Council vote when deemed necessary.

3. The audit report of the Committees of the People's Council must reflect the opinions of the members of the Committees of the People's Council and the opinions of agencies and representatives participating in the audit.

4. To serve the audit activities, when deemed necessary, the Committees of the People's Council may request agencies, organizations, and individuals submitting the report to provide relevant information and materials; request appraisal, invite experts for consultation, meet and exchange with relevant agencies, organizations, and individuals; organize examination and verification of issues of concern to the Committees of the People's Council; organize a Working Group to conduct surveys and collect information.

The Working Group includes some members of the Committees of the People's Council; representatives of agencies, organizations, and individuals concerned (if necessary). The tasks and authorities of the Working Group are decided by the Committees of the People's Council. The Committees of the People's Council are responsible for notifying relevant agencies, organizations, and individuals about the program and composition of the Working Group at least 10 days before the Working Group conducts its work.

Section 2

ACTIVITIES OF QUESTIONING AND REVIEWING RESPONSES TO QUESTIONS AT THE SESSION OF THE PEOPLE'S COUNCIL

Subsection 1

ACTIVITIES OF QUESTIONING AND REVIEWING RESPONSES TO QUESTIONS AT THE SESSION OF THE PEOPLE'S COUNCIL

AT THE SESSION OF THE PEOPLE'S COUNCIL

Article 19. Responsibilities for compiling information to select the group of issues to be questioned and the person to be questioned

1. At least 30 days before the opening day of the session of the People's Council, the office assisting the People's Council shall issue a document requesting the Committees of the People's Council, the Delegation of People's Council representatives to submit proposals on issues to be questioned and the person to be questioned. The Delegation of People's Council representatives is responsible for collecting opinions from representatives in the delegation and compiling proposals on issues to be questioned and the person to be questioned. In case of necessity, representatives of the People's Council may directly submit proposals to the office assisting the People's Council.

2. At least 20 days before the opening day of the session of the People's Council, the office assisting the People's Council is responsible for compiling proposals on issues to be questioned and the person to be questioned from the Committees of the People's Council, the Delegation of People's Council representatives, and representatives of the People's Council as prescribed in Clause 1 of this Article, and compiling opinions and suggestions from voters and public opinion on prominent issues in economic and social affairs, national defense, security, and foreign relations in the locality to serve as the basis for selecting the group of issues to be questioned and the person to be questioned, and report to the Standing Committee of the People's Council.

Article 20. Criteria for selecting issues to be questioned and those being questioned at the session of the People's Council

1. The content of questioning shall be selected based on one of the following criteria:

a) Issues that are urgent, emerging, or significantly affecting the lives of citizens, economic and social development, national defense, security, and foreign relations of the locality, which have been raised and proposed by members of the People's Council, voters, and citizens, or other issues decided by the People's Council or the Standing Committee of the People's Council in accordance with the supervision requirements and practical situation of the locality;

b) Issues aimed at enhancing the effectiveness of leadership, management, and state administration at the local level, or issues identified through supervision and investigation as needing clarification and solutions to address deficiencies and inadequacies;

c) Issues showing signs of violations of laws on preventing and combating corruption, waste, and negative practices; increasing trends of law violations and crimes; limitations in handling complaints, petitions, proposals, and reflections from voters and organizations and individuals in the locality;

d) Issues that have been answered in writing by the person being questioned but the member of the People's Council disagrees with the content of the answer, and such disagreement has been approved by the Standing Committee of the People's Council to be addressed during the session of the People's Council;

đ) Issues not included in the resolution on supervision of the People's Council within the last twelve months prior to the date of questioning.

2. The selection of the content of questioning must be appropriate to the time scheduled for the questioning session.

3. The person being questioned shall be chosen in accordance with the group of issues to be questioned.

Article 21. Procedures and formalities for selecting issues to be questioned and those being questioned at the session of the People's Council

1. Based on the provisions of Articles 19 and 20 of this Resolution, no later than fifteen days before the opening day of the People's Council session, the office assisting the People's Council shall propose groups of issues to be questioned and those being questioned, and seek opinions from the Committees of the People's Council.

Based on the opinions of the Committees of the People's Council, the office assisting the People's Council shall compile and select groups of issues to be questioned and those being questioned, and report to the Standing Committee of the People's Council.

2. No later than ten days before the opening day of the People's Council session, the Standing Committee of the People's Council shall consider the proposal of the office assisting the People's Council, and select groups of issues to be questioned and those being questioned.

The office assisting the People's Council shall incorporate the opinions of the Standing Committee of the People's Council, prepare a report by the Standing Committee of the People's Council on the proposed groups of issues to be questioned and those being questioned, and submit it to the members of the People's Council for their opinion on selecting groups of issues to be questioned and those being questioned.

3. Based on the proposed agenda of the session and the results of compiling opinions of the members of the People's Council, the office assisting the People's Council shall assist the Standing Committee of the People's Council to incorporate and explain the opinions of the members of the People's Council, and present them to the People's Council for decision. On the basis of the results of compiling opinion forms, the People's Council shall select groups of issues to be questioned according to the principle of choosing from highest to lowest based on the number of agreeing votes from the members of the People's Council, and choose the person being questioned suitable for the group of issues to be questioned.

4. In addition to the person being questioned, other persons may be invited to attend the questioning session and participate in explaining and clarifying the content of questioning related to their responsibilities.

Article 22. Organization of Questioning Sessions at the Session of the People's Council

1. Based on the session program, the selected group of issues for questioning and the person to be questioned chosen by the People's Council, the working agency of the People's Council assists the Standing Office of the People's Council in performing the following tasks:

a) Sending a document requesting the person to be questioned to report in writing on the content related to the group of issues for questioning and sending it to the People's Council deputies at least five days before the questioning session is held;

b) Drafting the program for the questioning session and notifying the People's Council deputies, the person to be questioned, and relevant agencies, organizations, and individuals at least three days before the questioning session is held.

2. The person to be questioned may not delegate another person to answer on their behalf, except where otherwise provided by law. In case they cannot attend the questioning session directly, the person to be questioned must send a document explaining the reason to the Standing Office of the People's Council for reporting to the People's Council to consider and decide.

3. Duties and powers of the People's Council deputies, the person to be questioned, and other agencies, organizations, and individuals during the questioning session:

a) The People's Council deputy raises questions and may provide evidence through images, recordings, or specific physical evidence; if they disagree with the content of the answers given, they have the right to debate, and the person to be questioned has the responsibility to respond;

b) The person to be questioned responds directly and fully to the issues raised by the People's Council deputy; clearly define responsibilities, measures, and deadlines for rectifying shortcomings and inadequacies (if any);

c) Invited persons participate in clarifying and elaborating further on the issues raised by the People's Council deputy within their responsibility.

4. The questioning session of the provincial-level People's Council shall be broadcast live via radio and television, except in cases decided by the provincial-level People's Council.

Article 23. Procedure and Formalities of the Questioning Session at the Session of the People's Council

1. The Chairman of the People's Council directs the questioning session. In the absence of the Chairman of the People's Council, a Vice-Chairman of the People's Council will be assigned to direct the questioning session.

2. The procedure for the questioning session is conducted as follows:

a) The Chairman of the People's Council or the Vice-Chairman of the People's Council assigned to direct the questioning session presents the group of issues for the People's Council deputies to focus on questioning;

b) The People's Council deputies register to question;

c) The Chairman of the People's Council or the Vice-Chairman of the People's Council assigned to direct the questioning session invites the registered People's Council deputies to question in order; invites the person to be questioned to answer the questions raised by the People's Council deputies regarding issues within their responsibility;

d) Based on the content and actual situation, the Chairman of the People's Council or the Vice-Chairman of the People's Council assigned to direct the questioning session invites the registered People's Council deputies who have raised questions to make statements debating the answers given by the person to be questioned; when multiple People's Council deputies register to debate the same issue being questioned, the People's Council deputy who initially raised the question is prioritized to debate first;

e) The Chairman of the People's Council or the Vice-Chairman of the People's Council assigned to direct the questioning session has the authority to request the People's Council deputies to stop questioning or debating if they exceed the time limit or question or debate outside the scope; request the person to be questioned to stop answering if their response is off-topic or exceeds the time limit;

f) The Chairman of the People's Council or the Vice-Chairman of the People's Council assigned to direct the questioning session makes concluding remarks to end the questioning session.

3. The People's Council deputies have the right to debate with the person to be questioned to clarify the issues being questioned; they may not use the right to debate to ask questions or debate with the People's Council deputies who previously raised questions.

4. The time for raising questions, answering questions, and debating is implemented according to the Rules of Procedure of the People's Council session or the Working Regulations of the People's Council.

Article 24. The People's Council issues a resolution on questioning

1. After the questioning session at the meeting, the People's Council shall issue a resolution on questioning. The resolution shall include the following main contents:

a) Evaluation of the results of performing duties, powers, responsibilities of the person being questioned, limitations, inadequacies, and related causes to the questioned issue;

b) Solutions and deadlines for addressing limitations and shortcomings;

c) Responsibilities for implementation by agencies, organizations, and individuals;

d) Responsibility for reporting the results of implementing the resolution on questioning.

2. The Committee of the People's Council or the office assisting the People's Council shall be assigned to take the lead and coordinate with relevant agencies to draft the resolution on questioning, seek opinions from other Committees of the People's Council, the person being questioned, and submit it to the Standing Committee of the People's Council for comments before sending it to the People's Council representatives for their opinions.

3. The office assisting the People's Council helps the Standing Committee of the People's Council to compile the opinions of the People's Council representatives; the Committee of the People's Council or the office assisting the People's Council, which is assigned to take the lead and coordinate with other Committees of the People's Council, assists the Standing Committee of the People's Council to incorporate and explain the opinions of the People's Council representatives, perfecting the draft resolution on questioning for the People's Council to consider and approve.

Article 25. Questioning and answering questions in writing

1. The People's Council allows answers to questions in writing for direct questions raised by People's Council representatives during the questioning session in the following cases:

a) Questions not belonging to the group of questioned issues;

b) Questions belonging to the group of questioned issues but requiring investigation and verification;

c) Questions belonging to the group of questioned issues but not answered during the questioning session.

2. The office assisting the People's Council is responsible for collecting and sending the questions of the People's Council representatives to the person being questioned, who are allowed to answer in writing by the People's Council.

Within the latest 20 days from the date of receiving the document from the office assisting the People's Council, the person being questioned has the responsibility to answer in writing to the People's Council representative who raised the question, while sending it to the office assisting the People's Council for compilation and reporting to the Standing Committee of the People's Council.

3. The office assisting the People's Council monitors and urges the person being questioned to answer questions in writing; organizes the collection, compilation, and reporting to the Standing Committee of the People's Council.

4. Within the latest 30 days from the date of receiving the written answer to the question, if disagreeing with the content of the answer, the People's Council representative has the right to request the Standing Committee of the People's Council to discuss it at the nearest People's Council meeting or to request the People's Council to examine the responsibility of the person being questioned.

5. The office assisting the People's Council compiles the requests of the People's Council representatives regarding the written answers to questions as stipulated in Clause 4 of this Article, reports to the Standing Committee of the People's Council for consideration and decision on the following matters:

a) Issues requiring further clarification by the person being questioned according to the request of the People's Council representative;

b) Issues to be raised for questioning at the nearest People's Council meeting;

c) Issues requesting the People's Council to examine the responsibility of the person being questioned.

6. From the date the Standing Committee of the People's Council decides to convene a meeting, the People's Council representative has the right to send a questioning letter to the person being questioned through the Standing Committee of the People's Council. The office assisting the People's Council is responsible for helping the Standing Committee of the People's Council to collect and transfer the questioning letters of the People's Council representatives to the person being questioned.

The deadline for answering questions, monitoring, urging, and examining the results of answering questions shall be implemented in accordance with the provisions of Clauses 2, 3, 4, and 5 of this Article.

Article 26. Report on the Implementation of the Resolution on Interpellation at the Session of the People's Council

1. Not later than twenty days before the opening day of the session of the People's Council, the person who answered the interpellation shall be responsible for sending a report on the implementation of the resolution of the People's Council on interpellation at previous sessions to the Standing Body of the People's Council to transfer it to the members of the People's Council.

2. The agency assisting the People's Council helps the Standing Body of the People's Council to compile the report on the implementation of the resolution on interpellation as stipulated in Clause 1 of this Article, and sends it to the members of the People's Council not later than five days before the opening day of the session.

Subsection 2

ACTIVITIES INTERPELLATION AND REVIEW OF THE RESPONSE TO INTERPELLATION

AT THE MEETING OF THE STANDING BODY OF THE PEOPLE'S COUNCIL;

INTERPELLATION BY THE MEMBERS OF THE PEOPLE'S COUNCIL

Article 27. Responsibility for Compiling Information to Select Groups of Issues for Interpellation and the Persons to Be Interpellated

1. Not later than thirty days before the opening day of the meeting of the Standing Body of the People's Council, the agency assisting the People's Council shall issue a document requesting the Committees of the People's Council, Delegation of the People's Council to submit proposals on issues for interpellation and persons to be interpellated. The Delegation of the People's Council shall be responsible for collecting opinions from the members of the People's Council within the Delegation and compiling proposals on issues for interpellation and persons to be interpellated. In case of necessity, the member of the People's Council may directly send proposals to the agency assisting the People's Council.

2. Not later than twenty days before the opening day of the meeting of the Standing Body of the People's Council, the agency assisting the People's Council shall be responsible for compiling proposals on issues for interpellation and persons to be interpellated from the Committees of the People's Council, Delegation of the People's Council, and members of the People's Council as stipulated in Clause 1 of this Article, and compiling opinions and suggestions from voters and public opinion about urgent issues emerging in the economic and social, national defense, security, and foreign affairs fields of the locality to serve as the basis for selecting groups of issues for interpellation and persons to be interpellated, and reporting to the Standing Body of the People's Council.

Article 28. Criteria for Selecting Groups of Issues for Interpellation and Persons to Be Interpellated at the Meeting of the Standing Body of the People's Council

1. The content of questioning shall be selected based on one of the following criteria:

a) Issues assigned by the People's Council;

b) Issues prescribed in one of the points a, b, c, or d of Clause 1 of Article 20 of this Resolution;

c) Issues for interpellation that have been answered in writing by the person to be interpellated but the member of the People's Council does not agree with the content of the answer, and the Standing Body of the People's Council agrees to allow the answer at the meeting of the Standing Body of the People's Council.

2. The selection of the content of questioning must be appropriate to the time scheduled for the questioning session.

3. The person to be interpellated shall be selected appropriately according to the group of issues for interpellation.

Article 29. Procedure and Formalities for Selecting Groups of Issues for Interpellation and Persons to Be Interpellated at the Meeting of the Standing Body of the People's Council

1. Not later than fifteen days before organizing the interpellation session, the agency assisting the People's Council shall draft the groups of issues for interpellation and persons to be interpellated, and seek the opinion of the Committees of the People's Council.

2. Based on the opinion of the Committees of the People's Council, the agency assisting the People's Council shall compile and select the groups of issues for interpellation and persons to be interpellated, and report to the Standing Body of the People's Council.

3. Not later than ten days before organizing the interpellation session, the Standing Body of the People's Council shall consider the proposal of the agency assisting the People's Council and decide on the selection of the groups of issues for interpellation and persons to be interpellated.

4. Apart from the person to be interpellated, other individuals may be invited to attend the interpellation session and participate in explaining and clarifying additional content of the interpellation related to their responsibility, their agencies, or organizations.

Article 30. Questioning Organization at the Meeting of the Standing Committee of the People's Council

1. The People's Council's working agency assists the Standing Committee of the People's Council to perform the following tasks:

a) Sending a document requesting the person being questioned to report in writing on the content related to the group of questioning issues and sending it to the Standing Committee of the People's Council no later than five days before the date of organizing the questioning session;

b) Building the program for the questioning session and notifying members of the People's Council, the person being questioned, and relevant agencies, organizations, and individuals no later than three days before the date of organizing the questioning session.

2. The person being questioned may not delegate another person to answer on their behalf, except where otherwise provided by law. In case they cannot attend the questioning session directly, the person being questioned must submit a written report explaining the reasons for the Standing Committee of the People's Council to consider and decide.

3. The duties and powers of the People's Council member, the person being questioned, agencies, organizations, and other individuals during the questioning session shall be implemented according to the provisions of Clause 3, Article 22 of this Resolution.

4. The questioning session of the Standing Committee of the provincial People's Council shall be broadcast live via radio and television, except in cases decided by the Standing Committee of the provincial People's Council.

5. The procedure for the questioning session, time for raising questions, debate, answering questions, and conducting the questioning session shall be carried out according to the provisions of Article 23 of this Resolution.

6. Members of the People's Council can participate directly in the questioning session or participate through online means.

7. At the end of the questioning session, the Standing Committee of the People's Council shall adopt conclusions on the questioning; the conclusion shall be adopted when more than half of the total number of members vote in favor.

The People's Council committee or the People's Council's working agency, assigned to take the lead and coordinate with relevant agencies to draft conclusions on the questioning, collect opinions from members of the Standing Committee of the People's Council, members of the People's Council, and the person being questioned; absorb, explain, perfect the draft conclusions on the questioning, and submit them to the Standing Committee of the People's Council for consideration and issuance.

8. Conclusions on the questioning include the following main contents:

a) Contents prescribed in Points a, b, and c of Clause 1, Article 24 of this Resolution;

b) Responsibility to report on the implementation results of the conclusions on the questioning.

Article 31. Questioning and Answering Questions in Writing

1. The Standing Committee of the People's Council allows answers to questions in writing for direct questions raised by members of the People's Council at the questioning session in the following cases:

a) Questions not belonging to the group of questioned issues;

b) Questions belonging to the group of questioned issues but requiring investigation and verification;

c) Questions belonging to the group of questioned issues but not answered during the questioning session.

2. The People's Council's working agency has the responsibility to compile and send the contents of the questions raised by the members of the People's Council to the person being questioned, who is allowed to answer in writing.

Within twenty days from the date of receiving the document from the People's Council's working agency, the person being questioned is responsible for answering in writing to the member of the People's Council who raised the question, while also sending it to the People's Council's working agency.

3. The office assisting the People's Council monitors and urges the person being questioned to answer questions in writing; organizes the collection, compilation, and reporting to the Standing Committee of the People's Council.

4. Within thirty days from the date of receiving the written answer to the question, if disagreeing with the content of the answer, the member of the People's Council has the right to request the Standing Committee of the People's Council to discuss at the nearest meeting of the Standing Committee of the People's Council or request the Standing Committee of the People's Council to submit to the People's Council for consideration of responsibility towards the person being questioned.

5. The office assisting the People's Council compiles the requests of the People's Council representatives regarding the written answers to questions as stipulated in Clause 4 of this Article, reports to the Standing Committee of the People's Council for consideration and decision on the following matters:

a) Issues requiring further clarification by the person being questioned according to the request of the People's Council representative;

b) Issues raised for questioning at the most recent questioning session during the People's Council meeting or the Standing Committee of the People's Council meeting;

c) Issues requesting the People's Council to examine the responsibility of the person being questioned.

6. From the date the Standing Committee of the People's Council decides to organize the questioning session, members of the People's Council have the right to send written questions to the person being questioned through the Standing Committee of the People's Council. The People's Council's working agency has the responsibility to assist the Standing Committee of the People's Council in collecting and transferring the written questions of the members of the People's Council to the person being questioned.

The deadline for answering questions, monitoring, urging, and examining the results of answering questions shall be implemented in accordance with the provisions of Clauses 2, 3, 4, and 5 of this Article.

Article 32. Report on the Implementation of Conclusions from Interpellations at Sessions of the Standing Committee of the People's Council

1. The person who answered the interpellation shall submit a report on the implementation of the conclusions of the Standing Committee of the People's Council regarding previous interpellation sessions to the Standing Committee of the People's Council no later than twenty days before the opening of the interpellation session.

2. The People's Council's working agency shall assist the Standing Committee of the People's Council in compiling the report specified in Clause 1 of this Article and report to the Standing Committee of the People's Council no later than five days before the opening of the interpellation session.

Article 33. Interpellation by People's Council Deputies

1. A People's Council deputy has the right to interpellate during the interpellation session of the People's Council, the meeting of the Standing Committee of the People's Council, or send an interpellation in writing to the person being interpellated as prescribed in point a, Clause 1 and point a, Clause 2 of Article 36 of the Law on the Supervision Activities of the National Assembly and People's Councils.

2. The content of the interpellation must be specific, clear, based on evidence, and related to the duties, powers, and responsibilities of the person being interpellated.

3. The procedure and process for interpellation by a People's Council deputy during the interpellation session of the People's Council, the meeting of the Standing Committee of the People's Council, and interpellation and response to interpellation in writing shall be carried out in accordance with the provisions of Articles 22, 23, 25, 30, and 31 of this Resolution.

Section 3

ACTIVITIES OF EXPLANATION AT THE MEETING

STANDING COMMITTEE OF THE PEOPLE'S COUNCIL 

Article 34. Sources of Information for Selecting Issues for Explanation

The Standing Committee of the People's Council monitors and collects information from the following sources to select issues for explanation:

1. Information from reports by agencies, organizations, and individuals with authority on the situation of implementing policies and laws, preventing corruption, waste, and negative phenomena; violations of laws, crimes; handling complaints, petitions, suggestions, and public opinions of voters and agencies, organizations, and individuals in the locality; on the implementation of resolutions, conclusions, and supervisory recommendations of the People's Council and the Standing Committee of the People's Council;

2. Proposals from members of the Standing Committee of the People's Council, Committees of the People's Council, Delegation Groups of the People's Council, and People's Council deputies;

3. Information from mass media and public opinion about pressing issues in people's lives, economic and social development, national defense, security, diplomacy, and social order and safety in the locality;

4. Information compiled from the activities of meeting with voters by People's Council deputies;

5. Requests and proposals from relevant agencies, organizations, and individuals;

6. Other legitimate sources of information.

Article 35. Criteria for Selecting Issues for Explanation and Persons Requested to Explain

1. Issues for explanation are selected according to one of the following criteria:

a) Issues assigned by the People's Council;

b) Issues that are current, urgent, and emerging in practical social life; issues of concern to many People's Council deputies, public opinion, voters, and the people in the locality; new issues without solutions that require clarification and timely resolution to ensure the interests of the State, the rights and legitimate interests of organizations and individuals;

c) Issues showing signs of violation of legal regulations or having many shortcomings and weaknesses that have not been addressed;

d) Issues raised in resolutions, conclusions, and supervisory recommendations of the People's Council and the Standing Committee of the People's Council but not implemented or implemented ineffectively, failing to meet the requirements set forth.

2. The person requested to explain is chosen appropriately in relation to the issue for explanation.

Article 36. Procedures for Selecting Issues for Explanation, Persons Required to Provide Explanations, and Developing Plans for Organizing Explanation Sessions

1. Based on the provisions of Articles 34 and 35 of this Resolution, the Standing Committee of the People's Council decides on organizing explanations, the content of explanations, persons required to provide explanations, participants in explanations, and plans for organizing explanation sessions.

2. At least ten days before the date of the explanation session, the Committee of the People's Council or the agency assisting the People's Council assigned to take the lead and coordinate with relevant agencies shall develop a plan for organizing the explanation session to be submitted to the Standing Committee of the People's Council for decision and sent to the persons required to provide explanations, participants in explanations, and related agencies, organizations, and individuals.

The plan must clearly state the purpose, requirements, issues to be explained, scope, persons required to provide explanations, participants in explanations, time and location of the explanation session, the degree of transparency of the session, and other related contents.

3. In cases where it is not possible to directly attend the explanation session, the person required to provide explanations shall submit a written statement explaining the reasons and appoint their deputy to attend and respond on their behalf, provided that such appointment has been approved by the Standing Committee of the People's Council.

Article 37. Procedures for Organizing Explanations at Standing Committee Meetings of the People's Council

1. Explanation sessions of the Standing Committee of the People's Council are organized publicly, except when decided otherwise by the Standing Committee of the People's Council. The Chairman of the People's Council chairs the session. In the absence of the Chairman, a Vice-Chairman of the People's Council shall chair the session.

Deputies of the same-level People's Council, representatives of agencies, organizations, and individuals related to the locality, experts, and those affected by policies may be invited to attend the session. Representatives of the National Assembly Delegation may be invited to attend the session of the Standing Committee of the provincial People's Council.

2. The explanation session proceeds as follows:

a) The Chairman of the People's Council or a Vice-Chairman of the People's Council introduces the issues requiring explanation, the responsible parties for providing explanations, and the participants in explanations;

b) Members of the Standing Committee of the People's Council and attending deputies raise questions for explanation;

c) The person responsible for providing explanations must directly and fully answer the issues raised by members of the Standing Committee of the People's Council and attending deputies;

d) If members of the People's Council or attending deputies disagree with the answers given, they have the right to debate with the responsible party for providing explanations to clarify the issues being explained further;

đ) Participants in explanations must provide answers regarding the issues raised by members of the Standing Committee of the People's Council and attending deputies;

e) Representatives of agencies, organizations, or individuals attending the session may make statements (if applicable);

g) If the explanation session concerns an issue assigned by the People's Council, the Standing Committee of the People's Council completes a report on the results of the session to be reviewed and decided upon by the People's Council.

If the explanation session is decided by the Standing Committee of the People's Council, the Standing Committee reviews and approves conclusions on the issues being explained; the conclusion is adopted if more than half of the total number of members voting agree.

3. Conclusions on the issues being explained include the following main contents:

a) Evaluation of the implementation of tasks, powers, and responsibilities of the person required to provide explanations, limitations, inadequacies, and causes related to the issues being explained;

b) Solutions and deadlines for addressing limitations and shortcomings;

c) Responsibilities for implementation by agencies, organizations, and individuals;

d) Responsibility for reporting on the implementation of the conclusions on the issues being explained.

4. To serve the activities of explanations, when deemed necessary, the Standing Committee of the People's Council requests agencies, organizations, and individuals to report, provide information, and supply relevant materials; requests appraisals, invites expert consultations, meets, and exchanges with agencies, organizations, and individuals related to the issues of concern; organizes reviews and verifications of issues of interest to the Standing Committee of the People's Council; organizes inspection teams to survey and collect information.

The inspection team consists of some members of the Standing Committee of the People's Council, deputies of the People's Council, and representatives of agencies, organizations, and individuals related to the issues (if necessary). The tasks and authorities of the inspection team are decided by the Standing Committee of the People's Council. The Standing Committee of the People's Council is responsible for informing related agencies, organizations, and individuals about the program and composition of the inspection team at least ten days before the inspection team begins its work.

Section 4

ORGANIZING SUPERVISION TEAMS TO CONDUCT SPECIALIZED SUPERVISION,

SUPERVISING THE ENFORCEMENT OF LAWS IN LOCALITIES

Article 38. Sources of information for selecting topics and issues for supervision

The People's Council, the Standing Committee of the People's Council, Committees of the People's Council, and People's Council deputies shall collect information from the following sources to select topics and issues for supervision:

1. Information from reports by agencies, organizations, and individuals with authority on the implementation of policies and laws, anti-corruption, thrift, negativity, violations of laws, crimes, complaints, petitions, suggestions, and public opinions from voters and local agencies, organizations, and individuals; the implementation of resolutions, conclusions, and supervisory recommendations of the People's Council, the Standing Committee of the People's Council, and Committees of the People's Council;

2. Proposals from the Delegation of People's Council deputies and People's Council deputies;

3. Information from mass media and public opinion about pressing issues in people's lives, economic and social development, national defense, security, foreign relations, social order, and safety in the locality;

4. Information compiled from the activities of meeting with voters by People's Council deputies;

5. Suggestions and recommendations from related agencies, organizations, and individuals;

6. Other legitimate sources of information.

Article 39. Criteria for Selecting Supervision Topics

1. The People's Council selects supervision topics based on the following priority criteria:

a) Issues of concern to People's Council deputies, voters, and the public that are urgent, emerging, or significantly impacting people's lives, economic and social development, national defense, security, foreign relations, social order, and safety in the locality, or other issues decided by the People's Council that are suitable for supervision requirements and local realities;

b) Not within the scope regulated by laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, other normative legal documents of higher-level state agencies, and resolutions of the same-level People's Councils that have taken effect within twelve months from the date of proposal, except for issues related to specific mechanisms, policies, and laws requiring timely solutions to urgent problems such as natural disasters, epidemics, and other critical issues in the locality;

c) Issues related to policy and law building and improvement, state management, and important decisions for the locality;

d) Issues with comprehensive content under the jurisdiction of multiple Committees of the People's Council;

đ) Ensuring comprehensiveness, balance, and appropriateness across different fields;

e) Not overlapping in content or subject matter with supervision topics already selected and supervised by the same-level People's Council, Standing Committee of the People's Council, and Delegation of National Assembly Members within twenty-four months from the date of the proposed supervision, except when re-supervising previously supervised content due to the supervised entity not implementing or fully implementing resolutions, conclusions, and supervisory recommendations;

2. The Standing Committee of the People's Council selects supervision topics based on the following priority criteria:

a) Issues assigned by the People's Council;

b) Urgent, emerging, or significant issues affecting people's lives, economic and social development, national defense, security, foreign relations, social order, and safety in the locality, which are of concern to People's Council deputies, voters, and the public, or other issues decided by the Standing Committee of the People's Council that are suitable for supervision requirements and local realities;

c) The criteria stipulated in points b, c, d, and đ of Clause 1 of this Article;

3. Committees of the People's Council select supervision topics based on the following priority criteria:

a) Issues assigned by the People's Council and the Standing Committee of the People's Council;

b) Urgent, emerging, or significant issues affecting people's lives, economic and social development, national defense, security, foreign relations, social order, and safety in the locality, which are of concern to voters and the public, or other issues decided by the Committee of the People's Council that are suitable for supervision requirements and local realities;

c) The criteria stipulated in points b, c, and đ of Clause 1 of this Article;

d) Not overlapping in content or subject matter with supervision topics already selected and supervised by the same-level People's Council, Standing Committee of the People's Council, Committees of the People's Council, and Delegation of National Assembly Members within twenty-four months from the date of the proposed supervision, except when re-supervising previously supervised content due to the supervised entity not implementing or fully implementing resolutions, conclusions, and supervisory recommendations;

đ) The scope of supervision being appropriate to the conditions for implementation by the Committee of the People's Council.

Article 40. Establishing a Supervisory Committee of the People's Council to conduct specialized supervision

1. Based on the supervision program of the People's Council, the Standing Body of the People's Council shall submit to the People's Council for consideration and approval of the Resolution to establish a Supervisory Committee to carry out specialized supervision.

The Committee of the People's Council responsible for the main field shall coordinate with relevant agencies to draft the Resolution to establish the Supervisory Committee, report to the Standing Body of the People's Council for submission to the People's Council.

2. The Resolution to establish the Supervisory Committee must clearly define the purpose, scope, objects, content of supervision, Head of the Supervisory Committee, Deputy Head of the Supervisory Committee, other members participating in the Supervisory Committee, agencies, organizations, individuals subject to supervision, responsibilities of the Standing Body of the People's Council, Committees of the People's Council, and related agencies, organizations, and individuals.

The Head of the Supervisory Committee is the Chairman or Vice-Chairman of the People's Council. Other members participating in the Supervisory Committee include representatives from the Standing Body of the People's Council, Committees of the People's Council, and some representatives of the People's Council. Representatives from the Vietnam Fatherland Front at the same level, experts with specialized knowledge and experience in the supervised topic, and related agencies, organizations, and individuals may be invited to participate in the Supervisory Committee.

3. Based on the Resolution of the People's Council, the Standing Body of the People's Council shall have the responsibility:

a) To decide on specific members joining the Supervisory Committee and adjust the composition of the Supervisory Committee when necessary upon the proposal of the Head of the Supervisory Committee;

b) To direct the Supervisory Committee to develop a supervision plan (including detailed key contents of supervision), outline reports, organize implementation, and compile results of supervision;

c) When deemed necessary, to organize explanatory activities during meetings of the Standing Body of the People's Council; request Committees of the People's Council and Delegation of the People's Council to supervise related contents concerning the specialized supervision topic.

4. The Supervisory Committee has the following tasks and powers:

a) To build and announce the supervision plan, outline report on the supervision results of the Supervisory Committee, outline report of the agency, organization, individual subject to supervision, and outline report of related agencies, organizations, and individuals within thirty days from the date the People's Council issues the Resolution establishing the Supervisory Committee. The time for agencies, organizations, and individuals subject to supervision to prepare and submit reports to the Supervisory Committee shall be determined by the Supervisory Committee but not less than twenty days from the date of issuance of the plan;

b) To implement the content and supervision plan accurately;

c) To require agencies, organizations, and individuals subject to supervision and related agencies, organizations, and individuals to provide written reports, supply relevant information and documents; to require agencies, organizations, and individuals subject to supervision to explain matters of concern to the Supervisory Committee;

d) To organize conferences and seminars to collect information serving supervision activities when deemed necessary;

đ) To examine reports from agencies, organizations, and individuals subject to supervision and related agencies, organizations, and individuals; when deemed necessary, to request appraisals, invite consulting experts, gather information, meet and exchange with related agencies, organizations, and individuals;

e) When discovering violations of laws causing damage to state interests, legitimate rights and interests of organizations and individuals, the Supervisory Committee has the right to require related agencies, organizations, and individuals to take necessary measures to promptly stop the violation of laws and restore state interests, legitimate rights and interests of organizations and individuals that have been violated; to request competent agencies, organizations, and individuals to examine and handle the responsibility of agencies, organizations, and individuals committing violations according to the law;

g) To report supervision results for the People's Council to consider and decide.

5. The Committee of the People's Council responsible for fields related to the specialized supervision topic assists the People's Council, the Standing Body of the People's Council, and the Supervisory Committee of the People's Council in performing the tasks and powers stipulated in Clause 3 and Clause 4 of this Article and drafting the Resolution on specialized supervision according to Clause 3 of Article 41 of this Resolution.

Article 41. The People's Council examines the report on the results of supervision by the Supervision Team.

1. The People's Council examines and discusses the report on the results of supervision by the Supervision Team. The dossier submitted to the People's Council includes:

a) Report on the results of supervision by the Supervision Team;

b) Draft resolution on specialized supervision;

c) Report from the agencies, organizations, or individuals subject to supervision; evidence materials and other related materials (if any).

2. The examination and discussion of the report on the results of supervision by the Supervision Team shall be conducted in the following sequence:

a) The Head of the Supervision Team presents the report on the results of supervision;

b) The People's Council discusses. During the discussion, representatives of the Supervision Team may present additional information on related issues;

c) Representatives of agencies, organizations, or individuals related to the matter express their opinions (if any);

d) The head of the agency, organization, or individual subject to supervision reports on explanations;

đ) The People's Council examines and decides on the issuance of a resolution on specialized supervision.

3. The resolution on specialized supervision includes the following main contents:

a) Evaluation of achievements, limitations, inadequacies, and reasons for limitations and inadequacies related to the specialized supervision topic; responsibility of the agencies, organizations, or individuals subject to supervision; responsibility of related agencies, organizations, or individuals;

b) Solutions and deadlines for addressing limitations and shortcomings;

c) Responsibilities for implementation by agencies, organizations, and individuals;

d) Responsibility for reporting on the implementation of the resolution on specialized supervision.

Article 42. The People's Council examines the report on the results of specialized supervision by the Standing Committee of the People's Council and Committees of the People's Council.

1. Based on the content of specialized supervision in its supervision program, the People's Council assigns the Standing Committee of the People's Council and Committees of the People's Council according to their areas of responsibility to organize supervision and report the results of supervision for the People's Council to examine at the session.

When necessary, upon the proposal of the Standing Committee of the People's Council or Committees of the People's Council, the People's Council decides to examine the report on the results of supervision on other topics by the Standing Committee of the People's Council and Committees of the People's Council.

2. The dossier submitted to the People's Council includes:

a) Report on the results of supervision by the Standing Committee of the People's Council and Committees of the People's Council;

b) Draft resolution on specialized supervision;

c) Report from the agencies, organizations, or individuals subject to supervision; evidence materials and other related materials (if any).

3. The People's Council examines the report on the results of supervision in the following sequence:

a) A representative of the agency conducting the supervisory activity presents the report on the results of supervision;

b) The People's Council discusses. During the discussion, a representative of the agency conducting the supervisory activity may provide additional information on related issues;

c) Representatives of agencies, organizations, or individuals related to the matter express their opinions (if any);

d) The head of the agency, organization, or individual subject to supervision reports on explanations;

đ) The People's Council examines and decides on the issuance of a resolution on specialized supervision. The content of the resolution on specialized supervision is implemented according to the provisions of Clause 3, Article 41 of this Resolution.

Article 43. Organizing the Supervision Team of the Standing Committee of the People's Council to conduct specialized supervision.

1. Based on its supervision program or when assigned by the People's Council, the Standing Committee of the People's Council decides to establish a Supervision Team to conduct specialized supervision.

The Committee of the People's Council responsible for the relevant field takes the lead and coordinates with related agencies to draft the resolution on establishing the Supervision Team, which is submitted to the Standing Committee of the People's Council for examination and approval.

2. The resolution on establishing the Supervision Team must clearly define the purpose, scope, subjects, content, plan, composition of the Supervision Team, and the agencies, organizations, or individuals subject to supervision.

The Supervision Team is headed by a Vice Chairman of the People's Council or a member of the Standing Committee of the People's Council, with other members including representatives of the relevant Committee of the People's Council and some representatives of the People's Council. Representatives of the Vietnam Fatherland Front at the same level, experts with knowledge and experience in the specialized supervision topic, and related agencies, organizations, or individuals may be invited to participate in the Supervision Team. Representatives of the National Assembly Delegation may be invited to participate in the Supervision Team of the Standing Committee of the People's Council at the provincial level.

3. During the supervision process, the Standing Committee of the People's Council has the following duties and powers:

a) Adjust the composition of the Supervision Team if necessary based on the proposal of the Head of the Supervision Team;

b) Direct the Supervision Team to develop a supervision plan (including specific content to focus on), outlines for reports, organize implementation, and compile the report on the results of supervision;

c) When necessary, organize explanatory activities; request Committees of the People's Council and Delegation Committees to cooperate in supervision on related matters to the specialized supervision topic.

4. The Supervisory Committee has the following tasks and powers:

a) Develop and announce the supervision plan, outline for the report on the results of supervision by the Supervision Team, outline for the report by the agency, organization, or individual subject to supervision, and outline for the report by related agencies, organizations, or individuals within 15 days from the date the Standing Committee of the People's Council issues the resolution on establishing the Supervision Team. The time for the agency, organization, or individual subject to supervision to prepare and submit the report to the Supervision Team is determined by the Supervision Team but not less than 20 days from the date of announcement of the plan;

b) Duties and powers stipulated in points b, c, d, đ, and e of Clause 4, Article 40 of this Resolution;

c) Report the results of supervision for the Standing Committee of the People's Council to examine and decide.

5. The Committee of the People's Council responsible for the relevant field assists the Standing Committee of the People's Council and the Supervision Team of the Standing Committee of the People's Council in implementing the duties and powers stipulated in Clauses 3 and 4 of this Article and drafting the People's Council resolution according to the provisions of Clause 3, Article 41 of this Resolution or the conclusion draft of the Standing Committee of the People's Council according to the provisions of Clause 3, Article 44 of this Resolution.

Article 44. The Standing Committee of the People's Council examines the report on the results of the supervision by the Supervision Delegation.

1. The Standing Committee of the People's Council examines and discusses the report on the results of the supervision by the Supervision Delegation. The dossier submitted to the Standing Committee of the People's Council includes:

a) Report on the results of supervision by the Supervision Team;

b) Draft resolution of the People's Council or conclusion of the Standing Committee of the People's Council on specialized supervision.

c) Report from the agencies, organizations, or individuals subject to supervision; evidence materials and other related materials (if any).

2. The examination and discussion of the report on the results of supervision by the Supervision Team shall be conducted in the following sequence:

a) The Head of the Supervision Team presents the report on the results of supervision;

b) The Standing Committee of the People's Council discusses. During the discussion process, representatives of the Supervision Delegation may present supplementary issues related to the matter.

c) Representatives of agencies, organizations, or individuals related to the matter express their opinions (if any);

d) The head of the agency, organization, or individual subject to supervision reports on explanations;

d) In cases where the specialized supervision is assigned by the People's Council, the Standing Committee of the People's Council completes the report on the results of the supervision, draft resolution on specialized supervision, and submits it to the People's Council for examination and decision in accordance with Clause 2 and Clause 3, Article 42 of this Resolution.

In cases where the specialized supervision is decided by the Standing Committee of the People's Council, the Standing Committee of the People's Council examines and approves the conclusion on specialized supervision.

3. The conclusion on specialized supervision by the Standing Committee of the People's Council includes the following main contents:

a) Content as prescribed in Points a, b, and c, Clause 3, Article 41 of this Resolution.

b) Responsibility to report on the implementation of the conclusion on specialized supervision.

Article 45. The Standing Committee of the People's Council examines the report on specialized supervision by the Committee of the People's Council.

1. Based on the content of specialized supervision in its supervision program, the Standing Committee of the People's Council assigns the Committee of the People's Council according to the field under its responsibility to assist the Standing Committee of the People's Council in organizing supervision and reporting the results of supervision for the Standing Committee of the People's Council to examine.

When necessary, upon the proposal of the Committee of the People's Council, the Standing Committee of the People's Council decides to examine and discuss the report on the results of supervision on other specialized topics of the Committee of the People's Council.

2. The dossier submitted to the Standing Committee of the People's Council includes:

a) Report on the results of supervision by the Committee of the People's Council.

b) Draft conclusion on specialized supervision.

c) Report from the agencies, organizations, or individuals subject to supervision; evidence materials and other related materials (if any).

3. The Standing Committee of the People's Council examines and discusses the report on the results of supervision in the following sequence:

a) The Chairman of the Committee of the People's Council presents the report on the results of supervision.

b) The Standing Committee of the People's Council discusses. During the discussion process, representatives of the Committee of the People's Council may supplement issues related to the matter.

c) Representatives of relevant agencies, organizations, and individuals express their opinions (if any).

d) The head of the agency, organization, or individual subject to supervision reports on explanations;

d) The Standing Committee of the People's Council approves the conclusion on specialized supervision. The content of the conclusion is implemented in accordance with Clause 3, Article 44 of this Resolution.

Article 46. Organization of the Supervision Delegation of the Committee of the People's Council to conduct specialized supervision

1. Based on its supervision program or when assigned by the People's Council or the Standing Committee of the People's Council, the Committee of the People's Council decides to establish a Supervision Delegation to conduct specialized supervision upon the proposal of the Chairman of the Committee of the People's Council.

The decision to establish the Supervision Delegation must clearly define the purpose, scope, objects, content, plan of supervision, composition of the Supervision Delegation, and the agencies, organizations, and individuals subject to supervision.

The Supervision Delegation shall be headed by the Chairman or Deputy Chairman of the Committee of the People's Council, with other members including Committee members of the People's Council and some representatives of the People's Council. Representatives from the Vietnam Fatherland Front at the same level, experts with specialized knowledge and experience in the content of specialized supervision, and relevant agencies, organizations, and individuals may be invited to participate in the activities of the Supervision Delegation.

2. During the supervision process, the Committee of the People's Council has the following tasks and powers:

a) Adjust the composition of the Supervision Team if necessary based on the proposal of the Head of the Supervision Team;

b) Direct the Supervision Team to develop a supervision plan (including specific content to focus on), outlines for reports, organize implementation, and compile the report on the results of supervision;

c) When deemed necessary, propose another Committee of the People's Council to cooperate in supervision on matters related to the specialized supervision topic.

3. The Supervision Delegation has the following tasks and powers:

a) Develop and announce the supervision plan, outline of the report on the results of the Supervision Delegation, outline of the report of the supervised agency, organization, or individual, and outline of the report of relevant agencies, organizations, or individuals within 15 days from the date the Committee of the People's Council issues the decision to establish the Supervision Delegation. The time for the supervised agency, organization, or individual to develop the report and submit it to the Supervision Delegation is determined by the Supervision Delegation but not less than 20 days from the date of announcement of the plan.

b) Duties and powers stipulated in points b, c, d, đ, and e of Clause 4, Article 40 of this Resolution;

c) Report the results of supervision for the Committee of the People's Council to examine and decide.

Article 47The Committee of the People's Council examines the report on the results of supervision by the Supervision Delegation

1. The Committee of the People's Council examines and discusses the report on the results of supervision by the Supervision Delegation. The dossier submitted to the Committee of the People's Council includes:

a) Report on the results of supervision by the Supervision Team;

b) Draft resolution of the People's Council, draft conclusion of the Standing Committee of the People's Council, or draft conclusion of the Committee of the People's Council on specialized supervision.

c) Report from the agencies, organizations, or individuals subject to supervision; evidence materials and other related materials (if any).

2. The examination and discussion of the report on the results of supervision by the Supervision Team shall be conducted in the following sequence:

a) Representatives of the Supervision Delegation present the report on the results of supervision.

b) The Committee of the People's Council discusses. During the discussion process, representatives of the Supervision Delegation may present supplementary issues related to the matter.

c) Representatives of agencies, organizations, or individuals related to the matter express their opinions (if any);

d) The head of the supervised agency, organization, or individual reports and explains.

d) In cases where the specialized supervision is assigned by the People's Council or the Standing Committee of the People's Council, the Committee of the People's Council completes the report on the results of supervision, draft resolution of the People's Council, or draft conclusion of the Standing Committee of the People's Council on specialized supervision and submits it to the People's Council or the Standing Committee of the People's Council for examination. The procedure and process for the People's Council to examine the report on the results of supervision are carried out in accordance with Clause 2 and Clause 3, Article 42 of this Resolution; the procedure and process for the Standing Committee of the People's Council to examine the report on the results of supervision are carried out in accordance with Clause 2 and Clause 3, Article 45 of this Resolution.

In cases where the specialized supervision is decided by the Committee of the People's Council, the Committee of the People's Council examines and issues the conclusion on specialized supervision.

3. The conclusion on specialized supervision by the Committee of the People's Council includes the following main contents:

a) Content as prescribed in Points a, b, and c, Clause 3, Article 41 of this Resolution.

b) Responsibility to report on the implementation of the conclusion on specialized supervision.

Article 48. The Delegation of People's Council Representatives shall supervise issues assigned by the People's Council or the Standing Committee of the People's Council.

1. When assigned by the People's Council or the Standing Committee of the same level, the Delegation of People's Council Representatives shall organize supervisory activities.

Based on the content of the assigned issue, the Delegation of People's Council Representatives shall develop a supervision plan, a draft supervision report outline, and notify the agencies, organizations, and individuals subject to supervision at least ten days before the start of the supervision process.

2. During the supervision process, the Delegation of People's Council Representatives shall have the following duties and powers:

a) Implement the content and supervision plan accurately.

b) Require agencies, organizations, and individuals subject to supervision to provide written reports, supply relevant information and documents related to the supervision content; explain issues of concern to the Delegation of People's Council Representatives; examine and resolve issues related to the implementation of policies and laws or related to people's livelihoods, economic and social development, national defense, security, and foreign relations at the local level.

c) Examine, verify, and invite experts to advise on issues of concern to the Delegation of People's Council Representatives; meet and exchange with agencies, organizations, and individuals related to the issues.

d) When discovering violations of the law causing damage to the interests of the State, rights and legitimate interests of organizations and individuals, propose that relevant agencies, organizations, and individuals take necessary measures to promptly stop the violation of the law and restore the interests of the State, rights and legitimate interests of organizations and individuals who have been violated; request competent agencies, organizations, and individuals to examine and handle the responsibility of agencies, organizations, and individuals who have committed violations according to the provisions of the law.

3. After completing the supervision process, the Delegation of People's Council Representatives shall finalize the supervision result report, draft resolution of the People's Council, or conclusion of the Standing Committee of the People's Council for consideration by the People's Council or the Standing Committee of the People's Council. The procedure and process for the People's Council to consider the supervision result report shall be carried out in accordance with Clause 2 and Clause 3 of Article 42 of this Resolution; the procedure and process for the Standing Committee of the People's Council to consider the supervision result report shall be carried out in accordance with Clause 2 and Clause 3 of Article 45 of this Resolution.

4. The Delegation of People's Council Representatives may use the seal of the same-level People's Council when conducting supervisory activities.

5. The Standing Committee of the People's Council and the People's Council's assisting agencies shall ensure conditions and organize services for the supervisory activities of the Delegation of People's Council Representatives.

Article 49People's Council Representative Supervision of Law Enforcement in the Local Area

1. Based on the situation of economic and social development, national defense, security, diplomacy, public order, and safety in the locality, opinions and proposals of voters, and the practical life of the people in the locality, the People's Council Representative decides to select issues for supervising the enforcement of laws in the electoral area.

2. Based on the selected supervision issue, the People's Council Representative decides on the content, supervision plan, agencies, organizations, and individuals subject to supervision, and the supervision report outline, and reports to the Standing Committee of the People's Council.

3. During the supervision process, the People's Council Representative shall have the following duties and powers:

a) Implement the content and supervision plan accurately.

b) Invite People's Council Representatives knowledgeable about the supervision content and representatives of agencies, organizations, and individuals related to the supervision to participate in the supervision activity.

c) Require agencies, organizations, and individuals subject to supervision to provide written reports, supply relevant information and documents related to the supervision content; explain issues of concern to the People's Council Representative; examine and resolve issues related to the implementation of policies and laws or related to people's livelihoods, economic and social development, national defense, security, diplomacy, public order, and safety in the locality.

d) When necessary, examine, verify, and invite experts to advise on issues of concern to the People's Council Representative; meet and exchange with agencies, organizations, and individuals related to the issues.

đ) When discovering violations of the law causing damage to the interests of the State, rights and legitimate interests of organizations and individuals, propose that relevant agencies, organizations, and individuals take necessary measures to promptly stop the violation of the law and restore the interests of the State, rights and legitimate interests of organizations and individuals who have been violated; request competent agencies, organizations, and individuals to examine and handle the responsibility of agencies, organizations, and individuals who have committed violations according to the provisions of the law.

4. After completing the supervision process, the People's Council Representative shall review and issue conclusions on the supervision content. The supervision conclusion of the People's Council Representative shall include the following main contents:

a) Evaluation of achievements, limitations, and inadequacies and reasons for limitations and inadequacies related to the supervision content; responsibilities of agencies, organizations, and individuals subject to supervision, responsibilities of related agencies, organizations, and individuals.

b) Solutions and deadlines for addressing limitations and shortcomings;

c) Responsibilities for implementation by agencies, organizations, and individuals;

d) Responsibility to report on the implementation of the supervision conclusion.

5. The People's Council Representative shall be responsible for the supervision content, the conduct of supervisory activities, and the content of the supervision conclusion and recommendations.

The Standing Committee of the People's Council and the People's Council's assisting agencies shall organize for the People's Council Representative to carry out supervision; notify the content and supervision plan of the People's Council Representative to agencies, organizations, and individuals subject to supervision at least ten days before the date of the supervision activity; support the People's Council Representative in monitoring and urging agencies, organizations, and individuals subject to supervision to implement requests, recommendations, and supervision conclusions of the People's Council Representative.

Section 5

SUPERVISION OF THE HANDLING AND RESPONSE TO PETITION PROPOSALS CỦA VOTERS 

Article 50. The Standing Committee of the People's Council oversees the handling and response to citizens' petitions.

1. The Standing Committee of the People's Council is responsible for overseeing the handling and response to citizens' petitions by competent authorities at the local level; examining reports from the People's Committee and other competent authorities at the local level on the handling and response to citizens' petitions; reporting to the People's Council on the results of oversight of the handling and response to citizens' petitions; when necessary, organizing explanatory activities, forming inspection teams to conduct specialized oversight, or assigning Committees of the People's Council and Delegations of People's Council representatives to conduct oversight.

2. The Standing Committee of the People's Council develops and implements programs and plans for overseeing the handling and response to citizens' petitions; organizing the receipt, consolidation, classification, and transfer of citizens' petitions to competent authorities for resolution and response; simultaneously monitoring, urging, and overseeing the handling and response by competent authorities.

3. At least thirty days before the opening day of the session of the People's Council, the competent authority resolving citizens' petitions shall report the consolidated results of the handling and response to citizens' petitions from the previous session to the Standing Committee of the People's Council in accordance with the joint resolution detailing the procedures for meeting with citizens by National Assembly deputies and People's Council deputies at all levels.

4. Based on the results of the handling and response to citizens' petitions by competent authorities, the Committee of the People's Council assigned by the Standing Committee of the People's Council shall coordinate with other Committees of the People's Council and the People's Council's assisting agencies to examine and evaluate the results of the handling and response to citizens' petitions and draft the report on the results of oversight of the handling and response to citizens' petitions to be submitted to the Standing Committee of the People's Council.

The Standing Committee of the Provincial People's Council requests the National Assembly Delegation to cooperate in examining and evaluating the results of the handling and response to citizens' petitions by competent authorities at the local level; providing comments on the draft report on the results of oversight of the handling and response to citizens' petitions.

5. The Standing Committee of the People's Council examines the report on the results of oversight of the handling and response to citizens' petitions according to the following procedure:

a) The Head of the Committee of the People's Council assigned to chair presents the draft report of the Standing Committee of the People's Council on the results of oversight of the handling and response to citizens' petitions;

b) The Standing Committee of the People's Council discusses;

c) A representative of the authority, organization, or individual specified in Clause 3 of this Article reports and explains related issues (if any);

d) The Chair concludes.

6. The Standing Committee of the People's Council considers issuing conclusions on the handling and response to citizens' petitions, except where it is submitted to the People's Council for consideration. The conclusion includes the following main contents:

a) Content as prescribed in Points a, b, and c, Clause 3, Article 41 of this Resolution.

b) The responsibility to report on the implementation of the conclusion on the handling and response to citizens' petitions.

7. The Standing Committee of the People's Council reports to the People's Council on the results of oversight of the handling and response to citizens' petitions.

In cases where necessary, the Standing Committee of the People's Council submits the report on the results of oversight of the handling and response to citizens' petitions for the People's Council to consider and discuss in accordance with Article 51 of this Resolution.

Article 51. People's Council shall examine reports on the results of oversight of the handling and response to citizens' petitions

1. The dossier submitted to the People's Council includes:

a) Report of the Standing Committee of the People's Council on the results of oversight of the handling and response to citizens' petitions;

b) Draft resolution on the handling and response to citizens' petitions;

c) Other relevant documents (if any).

2. The People's Council shall examine and discuss the report on the results of oversight of the handling and response to citizens' petitions in the following sequence:

a) A representative of the Standing Committee of the People's Council presents the report on the results of oversight;

b) The People's Council discusses;

c) A representative of agencies, organizations, or individuals concerned reports and explains issues related to the handling and response to citizens' petitions (if any);

d) The People's Council examines and decides on the issuance of a resolution on the handling and response to citizens' petitions.

3. The resolution on the handling and response to citizens' petitions shall include the following main contents:

a) Evaluation of achievements, limitations, shortcomings, and causes of limitations and shortcomings related to the handling and response to citizens' petitions; responsibility of agencies, organizations, or individuals under supervision; responsibility of agencies, organizations, or individuals concerned;

b) Solutions and deadlines for addressing limitations and shortcomings;

c) Responsibilities for implementation by agencies, organizations, and individuals;

d) Responsibility for reporting on the implementation results of the resolution on the handling and response to citizens' petitions.

Article 52. Responsibility of the Committee of the People's Council assigned to assist the Standing Committee of the People's Council to oversee the handling and response to citizens' petitions

1. The Committee of the People's Council assigned to assist the Standing Committee of the People's Council shall perform the following tasks:

a) Lead and coordinate with other Committees of the People's Council to examine, evaluate, and draft the report on the results of oversight of the handling and response to citizens' petitions to be submitted to the Standing Committee of the People's Council in accordance with Clause 4, Article 50 of this Resolution;

b) Lead in drafting the People's Council resolution or the Standing Committee conclusion on the handling and response to citizens' petitions.

2. During the process of performing the tasks specified in Clause 1 of this Article, the Committee of the People's Council may carry out the following activities:

a) Lead in organizing meetings or issue written requests and demands for agencies, organizations, or authorized persons to handle and respond to citizens' petitions to report, explain, and provide information; request agencies, organizations, or individuals concerned to provide information; organize examination and verification of issues that the Committee of the People's Council is interested in regarding the handling and response to citizens' petitions;

b) Organize inspection teams to collect information to serve oversight activities;

c) Invite experts for consultation; meet and exchange with agencies, organizations, or individuals concerned;

d) Request other Committees of the People's Council to cooperate in evaluating and overseeing the results of handling and responding to citizens' petitions.

Article 53. Responsibility of the Committee of the People's Council assisting the Standing Committee of the People's Council to oversee the handling and response to citizens' petitions

1. The Committee of the People's Council shall assist the Standing Committee of the People's Council in performing the following tasks:

a) Coordinate with the Committee of the People's Council assigned to lead assistance to the Standing Committee of the People's Council to examine and evaluate the results of handling and responding to citizens' petitions within their respective areas of responsibility;

b) Participate in building the report on the results of oversight of the handling and response to citizens' petitions to be submitted to the People's Council and the Standing Committee of the People's Council;

c) Participate in drafting the People's Council resolution or the Standing Committee conclusion on the handling and response to citizens' petitions.

2. During the process of performing the tasks specified in Clause 1 of this Article, the Committee of the People's Council may carry out the following activities:

a) Organize meetings or issue written requests and demands for agencies, organizations, or authorized persons to handle and respond to citizens' petitions to report, explain, and provide information; request agencies, organizations, or individuals concerned to provide information; organize examination and verification of issues that the Committee of the People's Council is interested in regarding the handling and response to citizens' petitions within their respective areas of responsibility;

b) Send representatives to participate in sessions and inspection teams organized by the Committee of the People's Council assigned to lead assistance to the Standing Committee of the People's Council to survey and collect information to serve oversight activities;

c) Invite experts for consultation; meet and exchange with agencies, organizations, or individuals concerned.

Article 54. Responsibility of the Delegation of People's Council Members assigned to assist the Standing Committee of the People's Council to oversee the handling and response to citizens' petitions

1. The Delegation of People's Council Members shall assist the Standing Committee of the People's Council in overseeing the handling and response to citizens' petitions through the performance of the following tasks:

a) Organize the receipt, consolidation of opinions and petitions from citizens received through the activities of meeting with citizens conducted by People's Council members and submit them to the Standing Committee of the People's Council in accordance with the joint resolution detailing the activities of meeting with citizens by National Assembly deputies and People's Council members at all levels;

b) Organize the examination and evaluation of the results of handling and responding by agencies, organizations, or authorized persons according to the requirements of the Standing Committee of the People's Council.

2. During the process of performing the tasks specified in Clause 1 of this Article, the Delegation of People's Council Members may carry out the following activities:

a) Organize meetings or issue written requests and demands for agencies, organizations, or authorized persons to handle and respond to citizens' petitions to report, explain, and provide information; request agencies, organizations, or individuals concerned to provide information; organize examination and verification of issues that the Delegation of People's Council Members is interested in regarding the handling and response to citizens' petitions;

b) Invite experts for consultation; meet and exchange with agencies, organizations, or individuals concerned.

3. The Standing Committee of the People's Council and the People's Council's support agency shall ensure conditions and organize services for the oversight activities of the Delegation of People's Council Members.

Article 55The responsibility of People's Council delegates to supervise the handling and response to citizens' petitions

1. People's Council delegates shall be responsible for supervising the handling and response to citizens' petitions through the implementation of the following tasks:

a) Reviewing and evaluating the results of the handling and response to citizens' petitions by agencies, organizations, and individuals with authority regarding the petitions received by the People's Council delegate through their activities in meeting with citizens, and shall be responsible for sending their review and evaluation results to the Standing Committee of the People's Council through the People's Council Delegation Team for consolidation and coordinated supervision.

b) Participating in activities to supervise the handling and response to citizens' petitions by the People's Council Delegation Team of which they are members; participating in the supervision activities of the Council's Committee when required.

2. During the process of implementing the task prescribed in point a, Clause 1, Article 1 of this Law, People's Council delegates may carry out the following activities:

a) Requesting agencies, organizations, and individuals with authority to handle and respond to citizens' petitions to report, explain, and provide information.

b) Requesting relevant agencies, organizations, and individuals to provide information.

c) When necessary, reviewing, verifying, and consulting experts on issues of concern to the People's Council delegate; contacting and exchanging with relevant agencies, organizations, and individuals.

3. People's Council delegates shall be responsible for reviewing and evaluating the handling and response to citizens' petitions by agencies, organizations, and individuals with authority and the content of their conclusions and recommendations.

Chapter 6

REVIEWING THE IMPLEMENTATION OF THE PEOPLE'S COUNCIL RESOLUTIONS ON SUPERVISION PEOPLE'S COUNCIL

ON SUPERVISION, REPORT ON PETITIONS FOR SUPERVISION BY

STANDING COMMITTEE OF THE PEOPLE'S COUNCIL, COUNCIL'S COMMITTEE, PEOPLE'S COUNCIL DELEGATES

Article 56. Reporting system on the implementation of the People's Council resolutions on supervision  

1. Based on actual circumstances, the People's Council decides to review the implementation of the People's Council resolutions on supervision.

The Standing Committee of the provincial People's Council shall issue plans and outlines for reporting on the implementation of the provincial People's Council resolutions on supervision and send them to the People's Committee, Chairman of the People's Committee, other members of the provincial People's Committee, People's Court, People's Procuracy, civil enforcement agency, Council's Committee at the provincial level, People's Committee of special administrative regions where there is no local government level, People's Court, People's Procuracy of the region, and other agencies, organizations, and individuals for implementation.

The Standing Committee of the commune-level People's Council shall issue plans and outlines for reporting on the implementation of the commune-level People's Council resolutions on supervision and send them to the People's Committee, Council's Committee at the commune level, and other agencies, organizations, and individuals for implementation.

2. The People's Committee, People's Court, People's Procuracy, civil enforcement agency at the provincial level, People's Committee of special administrative regions where there is no local government level, People's Court, People's Procuracy of the region, and other agencies, organizations, and individuals shall be responsible for reporting on the implementation of the People's Council resolutions on supervision and submitting them to the Standing Committee of the People's Council upon request.

For contents within the responsibility of the People's Committee, Chairman of the People's Committee, other members of the provincial People's Committee, and People's Committee of special administrative regions where there is no local government level, the provincial People's Committee shall be responsible for preparing comprehensive reports and submitting them to the Standing Committee of the People's Council. For contents within the responsibility of the People's Court and People's Procuracy at the provincial level, People's Court, and People's Procuracy of the region, the People's Court and People's Procuracy at the provincial level shall be responsible for preparing comprehensive reports and submitting them to the Standing Committee of the People's Council.

The commune-level People's Committee shall be responsible for reporting on the implementation of the commune-level People's Council resolutions on supervision and submitting them to the Standing Committee of the commune-level People's Council upon request.

The People's Committee at the commune level shall be responsible for reporting on the implementation of resolutions of the People's Council at the commune level regarding supervision and submitting them to the Standing Committee of the People's Council at the commune level upon request.

Article 57. Procedure and formalities for the People's Council to examine the implementation of its resolutions on oversight

1. The People's Council shall organize examination and discussion on reports or conduct questioning regarding the implementation of its resolutions on oversight. The dossier submitted to the People's Council includes:

a) Reports from the People's Committee, People's Court, People's Procuracy, provincial civil enforcement agency, other agencies, organizations, and individuals on the implementation of the People's Council's resolutions on oversight;

b) A consolidated report on the content of the examination conducted by the Council's Committees on the implementation of the People's Council's resolutions on oversight;

c) Reports from the People's Committee on relevant fields and consolidated reports on the examination conducted by the Council's Committees on the implementation of the People's Council's resolutions on oversight;

d) Draft resolution of the People's Council (if applicable).

2. The People's Council shall examine and discuss the reports in the following sequence:

a) The head of the agency submitting the report presents the report.

b) The Chairperson of the Council's Committee shall present the consolidated report on the content of the examination;

c) The People's Council shall discuss;

d) The head of the agency submitting the report may provide explanations on issues of concern raised by the People's Council members;

đ) The People's Council shall examine and decide on issuing a resolution on the implementation of the People's Council's resolutions on oversight.

The content of the Resolution shall be implemented according to the provisions of Clause 3, Article 16 of this Resolution, specifying completed tasks, uncompleted tasks or slow progress in each field; tasks that need to continue to be carried out; responsibility if the aforementioned tasks are not completed.

3. The People's Council shall organize questioning at the session as stipulated in Articles 22 and 23 of this Resolution; examine and decide on issuing a resolution on the implementation of the People's Council's resolutions on oversight as stipulated in Article 24 of this Resolution, specifying completed tasks, uncompleted tasks or slow progress in each field; tasks that need to continue to be carried out; responsibility if the aforementioned tasks are not completed.

Article 58. Responsibility for examining reports on the implementation of the People's Council's resolutions on oversight

1. The Standing Body of the People's Council shall assign a Committee of the People's Council to take the lead and coordinate with other Committees of the People's Council to organize the examination of the reports as stipulated in Clause 2, Article 56 of this Resolution; consolidate the results of the examination to report to the People's Council.

2. The Committee of the People's Council shall be responsible for examining the reports as stipulated in Clause 2, Article 56 of this Resolution for contents within their areas of responsibility or as assigned by the Standing Body of the People's Council.

Article 59. The People's Council examines reports on oversight recommendations of the Standing Body of the People's Council, Committees of the People's Council, and People's Council members

1. In cases where agencies, organizations, or individuals subject to oversight fail to implement or fully implement the conclusions or recommendations of the Standing Body of the People's Council, Committees of the People's Council, or People's Council members, the Committees of the People's Council or People's Council members have the right to recommend to the Standing Body of the People's Council to report to the People's Council for examination and decision.

2. The People's Council's working body shall assist the Standing Body of the People's Council in compiling oversight recommendations of the Standing Body of the People's Council, Committees of the People's Council, and People's Council members to report to the Standing Body of the People's Council for submission to the People's Council.

3. The Committee of the People's Council assigned to take the lead and coordinate with another Committee of the People's Council:

a) Organize the examination of oversight recommendations of the Committees of the People's Council and People's Council members;

b) Organize meetings or issue written requests or proposals to agencies, organizations, or individuals subject to oversight to report and explain on the implementation of the conclusions or recommendations of the Standing Body of the People's Council, Committees of the People's Council, and People's Council members;

c) Draft the report of the Standing Body of the People's Council on the consolidation of oversight recommendations of the Standing Body of the People's Council, Committees of the People's Council, and People's Council members;

d) Draft the resolution on the issue recommended.

4. The Standing Body of the People's Council shall examine and report to the People's Council on the oversight recommendations of the Standing Body of the People's Council, Committees of the People's Council, and People's Council members. The dossier submitted to the People's Council includes:

a) Report of the Standing Body of the People's Council consolidating oversight recommendations;

b) Explanation report of agencies, organizations, or individuals subject to oversight;

c) Draft resolution on the recommended issue.

5. The People's Council shall examine and discuss the report of the Standing Body of the People's Council on oversight recommendations in the following sequence:

a) Representative of the Standing Body of the People's Council presents the report;

b) The Committee of the People's Council or People's Council member making the recommendation presents supplementary opinions (if any);

c) Agencies, organizations, or individuals subject to oversight report and explain supplementary information (if any);

d) The People's Council discusses;

đ) The People's Council examines and adopts the resolution on the recommended issue.

6. The Resolution shall include the following main contents:

a) Evaluation of the contents of the conclusions or recommendations of oversight that were not implemented or not fully implemented; limitations, inadequacies, and causes; responsibility of agencies, organizations, or individuals subject to oversight and related agencies, organizations, or individuals;

b) Specific requirements for agencies, organizations, or individuals subject to oversight and related agencies, organizations, or individuals;

c) Responsibility for implementing the resolution for agencies, organizations, or individuals subject to oversight and related agencies, organizations, or individuals;

d) Responsibility for reporting the results of implementing the resolution on the recommended issue.

Chapter IV

THE STANDING BODY OF THE PEOPLE'S COUNCIL DIRECTS, COORDINATES,

COOPERATES IN OVERSIGHT ACTIVITIES 

Article 60. Directs, coordinates oversight activities during the session, oversight activities of the Standing Body People's Council, the supervision activities of the Standing Committee People's Council

The Standing Committee of the People's Council directs and coordinates the supervision activities at the session of the People's Council and the supervision activities of the Standing Committee of the People's Council to ensure suitability with the actual situation, organizational capacity, and effectiveness through the following activities:

1. Adjusting the planned supervision activities at the sessions of the People's Council in the year, reporting to the People's Council for consideration and decision when building specific supervision programs for each session.

2. Proactively adjusting the supervision activities of the Standing Committee of the People's Council in the year.

3. Assigning the Committees of the People's Council to organize reviews and participate in reviewing reports according to Clause 1, Article 18 of this Resolution to report to the People's Council and the Standing Committee of the People's Council.

Article 61. Directing, coordinating, and coordinating the supervision activities of the Committees of the People's Council, Delegation Groups of the People's Council, and members of the People's Council.

The Standing Committee of the People's Council directs, coordinates, and coordinates the supervision activities of the Committees of the People's Council, Delegation Groups of the People's Council, and members of the People's Council to ensure suitability with the actual situation, organizational capacity, and effectiveness through the following activities:

1. Entrusting the Committees of the People's Council and Delegation Groups of the People's Council to implement some contents within the supervision program of the People's Council and the Standing Committee of the People's Council.

2. Requesting the Committees of the People's Council, Delegation Groups of the People's Council, and members of the People's Council to adjust their supervision programs, plans, and coordination of supervision activities to avoid overlapping in content, time, and location.

3. Requesting the Committees of the People's Council, Delegation Groups of the People's Council, and members of the People's Council to coordinate in conducting supervision activities in the same locality, agency, or unit.

Article 62. Information and Reporting System to Serve Directive, Coordination, and Coordination of Supervision Activities.

1. In cases where it is necessary due to practical requirements to adjust the supervision plan, the Committees of the People's Council, Delegation Groups of the People's Council, and members of the People's Council shall have the responsibility to report to the Standing Committee of the People's Council for directive, coordination, and coordination of supervision activities.

Members of the People's Council report to the Standing Committee of the People's Council through Delegation Groups of the People's Council.

2. By the latest on the 25th day of each month, the Committees of the People's Council, Delegation Groups of the People's Council shall submit written reports to the Standing Committee of the People's Council on preliminary results of supervision activities in the month (if any) and the proposed plan for the next month (if any), clearly stating the content, time, participants, and location of the work. Members of the People's Council shall report to the Standing Committee of the People's Council through Delegation Groups of the People's Council on preliminary results of supervision activities in the month (if any) and the proposed plan for the next month (if any), clearly stating the content, time, participants, and location of the work.

3. The assisting agencies of the People's Council shall be responsible for compiling reports from the Committees of the People's Council, Delegation Groups of the People's Council, and members of the People's Council, and advising and assisting the Standing Committee of the People's Council in directing, coordinating, and coordinating supervision activities..

4. In December of each year, the assisting agencies of the People's Council shall take the lead and cooperate with the Committees of the People's Council and Delegation Groups of the People's Council to build a comprehensive report and draw lessons from the coordination of supervision activities, and report to the Standing Committee of the People's Council.

Chapter V

IMPLEMENTING PROVISIONS 

Article 63. Effective date

1. This Resolution takes effect from March 1, 2026.

2. Resolution No. 594/NQ-UBTVQH15 dated September 12, 2022 of the Standing Committee of the National Assembly guiding the supervision activities of the People's Council, the Standing Committee of the People's Council, the Committees of the People's Council, Delegation Groups of the People's Council, and members of the People's Council shall cease to be effective from the date this Resolution takes effect.

Article 64. Implementation organization

1. The People's Council, the Standing Committee of the People's Council, the Committees of the People's Council, Delegation Groups of the People's Council, members of the People's Council, relevant agencies, organizations, and individuals shall be responsible for implementing this Resolution.

2. The Committee for Social Affairs and Supervision shall take the lead and cooperate with the Ethnic Council, other Committees of the National Assembly, and the Standing Committee of the Provincial People's Council to develop and issue templates for documents serving supervision activities.

3. The Standing Committee of the Provincial People's Council shall submit to the Provincial People's Council for issuance of regulations concerning the support work for the supervision activities of the People's Council, the Standing Committee of the People's Council, the Committees of the People's Council, Delegation Groups of the People's Council, and local members of the People's Council.
