Pilot Implementation of Certain Special Financial Mechanisms for the Civil Aviation Authority of Vietnam

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on State Budget dated December 16, 2002;

Pursuant to the Law on Thrift and Combating Wastefulness dated November 29, 2005;

Pursuant to Decision No. 94/2009/QĐ-TTg dated July 16, 2009 of the Prime Minister on the Regulations concerning the Functions, Tasks, Authorities, and Organizational Structure of the Civil Aviation Authority of Vietnam under the Ministry of Transport;

Considering the proposal of the Minister of Transport,

DECISION:

Article 1. Pilot implementation of certain special financial mechanisms for the Civil Aviation Authority of Vietnam. The pilot period runs from 2012 to 2016.

Article 2. The Civil Aviation Authority of Vietnam (excluding affiliated public service units) shall implement the following special financial regimes:

1. Special expenses included in the self-managed budget:

a) Average salary: apply a salary coefficient of 1.8 times the state-prescribed salary level (grade, rank, and all types of allowances except night shift and overtime pay).

b) Aviation safety bonus: at 15% of the salary grade and position (excluding allowances) pursuant to Decision No. 234/2005/QĐ-TTg dated September 26, 2005 of the Prime Minister for civil servants directly involved in management, supervision, and ensuring traffic safety.

c) Work uniforms: The Ministry of Transport shall stipulate work uniform regulations for the Civil Aviation Authority of Vietnam; the expenditure on uniforms shall be applied according to Circular No. 18/2011/TT-BTC dated February 10, 2011 guiding amendments and supplements to Circular No. 130/2008/TT-BTC dated December 26, 2008 of the Ministry of Finance guiding the implementation of certain Articles of the Law on Corporate Income Tax and guiding the implementation of Decree No. 124/2008/NĐ-CP dated December 11, 2008 of the Government detailing the implementation of certain provisions of the Law on Corporate Income Tax.

2. Special expenses included in the non-self-managed budget:

a) Hiring flight supervisors to work regularly at the Civil Aviation Authority of Vietnam: based on job requirements, the Ministry of Transport shall decide to hire flight supervisors with appropriate remuneration levels (taking into account foreign rates).

b) Training costs, departure costs: based on the annual budget approved by the competent authority, the Ministry of Transport shall allocate the budget to the Civil Aviation Authority of Vietnam.

3. Sources of funds to ensure special expense regimes:

a) State budget allocated from administrative management expenses.

b) Revenue from fees and charges in the aviation sector; airport concession fees retained for use according to the regulations of the Minister of Finance.

c) Other income as prescribed by law (if any).

Article 3. If there is any surplus in the self-managed budget, the Civil Aviation Authority of Vietnam may allocate it for purposes specified in Decree No. 130/2005/NĐ-CP dated October 17, 2005 of the Government on the self-management and self-responsibility regime for staffing and administrative management expenses of state agencies; in which, additional income for civil servants shall not exceed 1.0 times the state-prescribed salary grade and position level.

Article 4. The Ministry of Finance shall be responsible for guiding the sources of funds for the above special expenses.

Article 5. This Decision takes effect from April 2, 2012 and applies to the 2012 to 2016 fiscal years. In the third quarter of 2016, the Ministry of Transport shall organize a review and evaluation of the results of this Decision's implementation, and on that basis coordinate with the Ministry of Finance and relevant agencies to submit a mechanism for the next phase to the Prime Minister.

Ministers: Transport, Finance, Home Affairs, Labor - Invalids and Social Affairs; Director of the Civil Aviation Authority of Vietnam and Heads of relevant agencies are responsible for implementing this Decision./.
