Repealing certain regulatory legal documents issued by the Minister

The Ministry of Science and Technology promulgates this joint issuance

Pursuant to Decree No.34/2016/NĐ-CP"5. Pursuant to Decree No.28/2023/NĐ-CP-CP June 2, 2023 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the request of the Director of the Legal Department,

After receiving the unified opinion of the Minister of Finance, the Minister of Science and Technology issues this Circular to abolish certain legal documents issued by the Minister of Science and Technology, jointly issued.

Article 1. Abolish all the circulars and joint circulars

Abolish all the following circulars and joint circulars:

1. Circular No. 22/2010/TT-BKHCN dated December 29, 2010 of the Minister of Science and Technology stipulating the issuance and inspection of Free Circulation Certificates for products and goods exported and imported under the management responsibility of the Ministry of Science and Technology.

2. Circular No. 02/2012/TT-BKHCN dated January 18, 2012 of the Minister of Science and Technology guiding the management of the High-Tech Development Program until 2020.

3. Circular No. 03/2013/TT-BKHCN dated January 30, 2013 of the Minister of Science and Technology guiding the determination, selection, evaluation, and direct implementation of scientific and technological tasks under the National Technology Innovation Program until 2020.

4. Circular No. 04/2013/TT-BKHCN dated January 30, 2013 of the Minister of Science and Technology guiding criteria for evaluating projects under the National Technology Innovation Program until 2020.

5. Circular No. 06/2014/TT-BKHCN dated April 25, 2014 of the Minister of Science and Technology promulgating principles and criteria for selecting scientific and technological tasks under the National Technology Innovation Fund.

6. Circular No. 32/2014/TT-BKHCN dated November 6, 2014 of the Minister of Science and Technology stipulating the management of the Scientific and Technological Market Development Program until 2020.

7. Circular No. 06/2015/TT-BKHCN dated March 26, 2015 of the Minister of Science and Technology stipulating standards for the title of Director and Deputy Director of Provincial Science and Technology Departments under the People's Committees of provinces and centrally governed cities.

8. Circular No. 08/2015/TT-BKHCN dated May 5, 2015 of the Minister of Science and Technology stipulating the implementation of the Bilateral and Multilateral Research Cooperation Program and the Overseas Technology Transfer Search Program until 2020.

9. Circular No. 08/2016/TT-BKHCN dated April 22, 2016 of the Minister of Science and Technology amending and supplementing certain articles of Circular No. 32/2014/TT-BKHCN dated November 6, 2014 of the Minister of Science and Technology stipulating the management of the Scientific and Technological Market Development Program until 2020.

10. Circular No. 09/2016/TT-BKHCN dated June 9, 2016 of the Minister of Science and Technology stipulating procedures and formalities for issuing permits for transporting dangerous goods, including oxidizing substances, organic peroxides (Class 5), and corrosive substances (Class 8) via road, rail, and inland waterway transport.

11. Circular No. 19/2016/TT-BKHCN dated October 28, 2016 of the Minister of Science and Technology stipulating the management of the Program to Support the Development of Science and Technology Enterprises and Public Science and Technology Organizations Implementing Autonomous Mechanisms.

12. Circular No. 09/2018/TT-BKHCN dated July 1, 2018 of the Minister of Science and Technology amending and supplementing certain articles of Circular No. 09/2016/TT-BKHCN dated June 9, 2016 of the Minister of Science and Technology stipulating procedures and formalities for issuing permits for transporting dangerous goods, including oxidizing substances, organic peroxides (Class 5), and corrosive substances (Class 8) via road, rail, and inland waterway transport.

13. Joint Circular No. 12/2016/TTLT-BKHCN-BTC dated June 28, 2016 of the Minister of Science and Technology and the Minister of Finance guiding the content of expenditures and management of the Enterprise Science and Technology Development Fund.

Article 2. Repeal part of the Circulars

a) Abolish the phrase "Calibrated at a designated calibration organization according to regulations" in point a, Clause 1, Article 20;

b) Abolish the phrase "Tested or compared at a designated testing organization according to these Circulars or at a national agency for certification of foreign reference materials or at a laboratory that has linked its measurement standards to a national agency for certification of foreign reference materials" in point a, Clause 2, Article 20;

c) Abolish Clause 3, Article 29.

2. Partially abolish Circular No. 02/2022/TT-BKHCN dated February 25, 2022 of the Minister of Science and Technology guiding the implementation of certain provisions of Decree No. 142/2020/NĐ-CP dated December 9, 2020 of the Government regarding the conduct of radiation work and support services for nuclear energy applications

Abolish the phrases "specialized in science and technology under provincial people's committees (hereinafter referred to as provincial people's committees)" and "specialized in science and technology under provincial people's committees" in Clause 4, Article 2.

Article 3. Implementation Provisions

1. This Circular takes effect from June 30, 2023.

2. The Head of the Department of Legal Affairs, Heads of units directly under the Ministry, relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
