PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree stipulates the policy on attracting and developing cadres from outstanding university graduates and young science officers working at Party, State agencies, Vietnam Fatherland Front, political and social organizations from central to district levels; public institutions of the Party, State, and armed forces including:
1. The Central Office and Departments of the Party.
2. State Audit Office.
3. Office of the President, National Assembly Office.
4. Ministries, ministerial-level agencies, agencies under the Government, and organizations established by the Government or the Prime Minister that are not public institutions.
5. People's Courts, People's Procuratorates at all levels.
6. Central agencies of the Vietnam Fatherland Front, central agencies of political and social organizations.
7. Agencies of the Party, State, Vietnam Fatherland Front, and political and social organizations at provincial and district levels.
8. Public institutions of the Party, State, and political and social organizations at central, provincial, and district levels.
9. Hanoi City and Ho Chi Minh City, in addition to implementing the policies prescribed in this Decree, shall also apply special mechanisms as provided for by law.
Article 2. Objectives and criteria for applying the cadre attraction and development policy
1. University graduates with excellent grades from domestic or foreign higher education institutions recognized as equivalent in diplomas and certificates according to the law, who have outstanding academic and discipline records throughout their undergraduate years, within the age limit specified in Article 1 of the Youth Law at the time of submitting application forms, and meet one of the following criteria:
a) Achieving third place or higher individually in provincial-level student excellence competitions, or receiving encouragement awards or higher in national-level student excellence competitions, or commendation awards or higher in international student excellence competitions in natural sciences (mathematics, physics, chemistry, biology, computer science) and social sciences (literature, history, geography, foreign languages) during secondary school;
b) Achieving third place or higher individually in national or international science and technology competitions during secondary school or undergraduate studies;
c) Achieving third place or higher individually in Olympiads in mathematics, physics, chemistry, mechanics, computer science, or other specialized fields during undergraduate studies recognized by the Ministry of Education and Training.
2. Individuals with master’s degrees, first-level specialist doctors, resident doctors, first-level specialist pharmacists in medical or pharmaceutical fields within the age limit specified in Article 1 of the Youth Law at the time of submitting application forms, and meeting the following criteria:
a) Meeting the criteria specified in point a, b, or c of Clause 1 of this Article;
b) Graduating from university with good grades or higher and having postgraduate training in the same field as their undergraduate major.
3. Individuals with doctoral degrees, second-level specialist doctors, second-level specialist pharmacists in medical or pharmaceutical fields within the age limit specified in Article 23 of Decree No. 40/2014/NĐ-CP dated May 12, 2014 of the Government on the use and promotion of individuals engaged in science and technology at the time of submitting application forms, and meeting the criteria specified in points a and b of Clause 2 of this Article.
Article 3. Principles for implementing policies to attract and develop cadres
1. Ensuring consistency and synchronization among stages of identification, selection, training, development, planning, utilization, and incentives.
2. Ensuring compliance with legal provisions, transparency, objectivity, and competition.
3. Prioritizing the allocation of unused state positions to attract outstanding graduates and young scientific cadres, but it must be appropriate to their field of study and job position within agencies, organizations, and units.
Chapter II
IDENTIFICATION AND DEVELOPMENT OF OUTSTANDING STUDENTS AND YOUNG SCIENTIFIC CADRES
Article 4. Identification of outstanding students
1. Annually, higher education institutions shall identify and compile lists of students meeting the criteria specified in Clause 1 of Article 2 of this Decree and submit them to the Ministry of Education and Training. The Ministry of Education and Training shall consolidate these lists and send them to the Ministry of Home Affairs for consideration and inclusion in the policy application scope.
2. The Ministry of Education and Training shall take the lead and coordinate with the Ministry of Foreign Affairs to monitor, identify, and compile lists of Vietnamese students graduating with excellent grades from foreign higher education institutions who meet the criteria specified in Clause 1 of Article 2 of this Decree and submit them to the Ministry of Home Affairs for consideration and inclusion in the policy application scope.
Article 5. Identification of young scientific cadres
1. Annually, agencies, organizations, units specified in Article 1 and higher education institutions shall identify, aggregate, and compile lists of young scientific cadres meeting the criteria specified in Clauses 2 and 3 of Article 2 of this Decree and submit them to the Ministry of Home Affairs for consideration and inclusion in the policy application scope.
2. The Ministry of Education and Training shall take the lead and coordinate with the Ministry of Foreign Affairs to monitor, identify, and compile lists of Vietnamese young scientific cadres at foreign higher education institutions who meet the criteria specified in Clauses 2 and 3 of Article 2 of this Decree and submit them to the Ministry of Home Affairs for consideration and inclusion in the policy application scope.
Article 6. Building a database and monitoring the implementation of policies to attract and develop cadres
1. The Ministry of Home Affairs shall be responsible for leading and coordinating with the Ministry of Education and Training and relevant agencies to build a database of outstanding graduates and young scientific cadres as stipulated in Article 2 of this Decree.
2. The Ministry of Home Affairs shall introduce outstanding graduates and young scientific cadres meeting the criteria specified in Article 2 of this Decree to agencies, organizations, and units for recruitment consideration.
3. In addition to the provisions of Clause 2 of this Article, ministries, sectors, and localities shall be responsible for monitoring, identifying outstanding graduates and young scientific cadres meeting the criteria specified in Article 2 of this Decree for recruitment consideration in accordance with the standards and conditions of job positions under their management authority.
4. The Ministry of Home Affairs shall be responsible for guiding, monitoring, inspecting, auditing, and evaluating the implementation of policies to attract and develop cadres from outstanding graduates and young scientific cadres, reporting to the Prime Minister before December 31 each year; organizing mid-term and final evaluations of the implementation of these policies.
Chapter III
RECRUITMENT OF OUTSTANDING GRADUATES AND YOUNG SCIENTIFIC CADRES
Article 7. Recruitment Forms
1. Outstanding graduates and young scientific officers who meet the criteria specified in Article 2 of this Decree shall be recruited through examination.
2. The Ministry of National Defense and the Ministry of Public Security shall implement the examination for outstanding graduates and young scientific officers in accordance with the Law on Military Officers of the Vietnam People's Army, the Law on Police Officers of the Vietnam People's Public Security Force, and related guiding documents.
Article 8. Examination Content
1. Examine the academic results and research outcomes (if any) of the candidates according to the criteria stipulated in Article 2 of this Decree.
2. Interview the professional and vocational qualifications of the candidates.
Article 9. Recruitment Procedures
1. Authorities, organizations, and units with recruitment authority shall publicly announce at least three consecutive times on three major mass media channels including central or local newspapers, radio, and television, and simultaneously post on their websites regarding the conditions for registration, the number of positions to be filled, the contents of the application dossier, the deadline for submission, the location for submitting the Application Form and the application dossier, the telephone number and email address of the organization or individual receiving the dossiers.
The recruitment procedures for outstanding graduates and young scientific officers into the Ministry of National Defense and the Ministry of Public Security shall be carried out in accordance with the regulations of the Ministry of National Defense and the Ministry of Public Security.
2. Candidates participating in the recruitment process must submit one Application Form in accordance with the model issued together with this Decree to the recruiting authority within the latest thirty days from the date of the recruitment announcement.
3. Within eight days from the deadline for submitting the Application Form, the authority, organization, or unit shall notify the results of the dossier review to the candidates. Within seven days from the date of notifying the dossier review results, the authority, organization, or unit shall organize the recruitment in accordance with the provisions of Article 8 of this Decree. The authority, organization, or unit shall establish a Recruitment Board and determine the successful candidate in accordance with the current laws on civil servant and public official recruitment.
After receiving the notification of the successful recruitment result, the successful candidate shall submit the dossier to the authority, organization, or unit with recruitment authority for verification.
4. Recruitment Decision:
a) Within five working days from the date when the recruitment results are approved by the authorized person, the authority, organization, or unit with recruitment authority shall issue a recruitment decision for the candidate who best meets the requirements of the position to be filled and notify the candidate in writing; at the same time, send the list to the Ministry of Home Affairs for consolidation and monitoring (except in cases involving state secrets).
b) Within thirty days from the date of the recruitment decision, the successful candidate must report to the authority, organization, or unit to start work, except in cases where the recruitment decision specifies a different period. If the recruited person has a valid reason that prevents them from reporting for work within the specified period, they must request an extension before the end of the period and submit it to the authority, organization, or unit with recruitment authority.
The extension period shall not exceed thirty days from the deadline for reporting for work; for those studying, living, or working abroad, the extension period shall not exceed forty-five days.
5. Revocation of Recruitment Results
If the successful candidate does not report for work within the period specified in point b, Clause 4, Article 9 of this Decree, the head of the authority, organization, or unit with recruitment authority shall issue a decision to revoke the recruitment decision and may recruit the next highest-ranked candidate.
Chapter IV
POLICIES FOR OUTSTANDING GRADUATES AND YOUNG SCIENTIFIC OFFICERS AFTER BEING RECRUITED
Article 10. Probationary Period
1. Excellent graduates and young scientific staff members, after being recruited, must complete a probationary period of at least three months but not more than twelve months, except in cases where they have already completed at least twelve months of specialized work consistent with the requirements of the position for which they were recruited.
2. The specific duration of the probationary period shall be decided by the head of the recruitment authority.
3. During the probationary period, excellent graduates and young scientific staff members shall receive 100% of their salary and additional allowances as stipulated in Article 11 of this Decree.
4. The heads of agencies, organizations, and units employing excellent graduates and young scientific staff members shall evaluate the political integrity, ethics, and performance results of the probationers. If the probationer meets the requirements of the civil servant grade or the vocational title during the probationary period, the agency, organization, or unit managing civil servants and public officials shall issue a decision to appoint and rank the salary for the recruited civil servant or public official.
Article 11. Appointment of Civil Servant Grades and Vocational Titles of Public Officials and Salary Ranking Corresponding to Educational Qualifications After Completion of the Probationary Period ứ1. Excellent graduates shall be appointed to the specialist grade and equivalent, ranked at level 1, with a salary coefficient of 2.34; young scientific staff members with a master's degree, first-level specialist doctor, resident doctor, or first-level specialist pharmacist shall be appointed to the specialist grade and equivalent, ranked at level 2, with a salary coefficient of 2.67; young scientific staff members with a doctoral degree, second-level specialist doctor, or second-level specialist pharmacist shall be appointed to the specialist grade and equivalent, ranked at level 3, with a salary coefficient of 3.00. At the same time, they shall enjoy additional allowances equal to 100% of their current salary based on the salary coefficient. Additional allowances shall not be used to calculate contributions to mandatory social insurance, health insurance, and unemployment insurance (for public officials). The period for enjoying additional allowances shall not exceed five years from the date of the recruitment decision.
2. In addition to the additional allowance stipulated in Clause 1 of this Article, they shall also enjoy other salary allowances according to the current laws applicable to special regions, industries, or fields (if any).
Article 12. Training and Development Policy
The heads of agencies, organizations, and units authorized to manage and utilize civil servants and public officials shall be responsible for continuing to train and develop excellent graduates and young scientific staff members after recruitment to enhance their professional knowledge, skills, and foreign languages to meet the demands of tasks and duties, specifically as follows:
1. Prioritize training and development in basic knowledge of political theory, state administration, and specialized field knowledge.
2. Prioritize assigning them to perform research and technological tasks, programs, projects, and plans at the district level or higher.
Article 13. Promotion of Civil Service Grades or Advancement of Public Official Vocational Titles
1. Excellent graduates and young scientific staff members, after recruitment, may be specially selected to participate in the examination for promotion to the senior specialist grade or advancement to the equivalent public official vocational title if they meet the following conditions:
a) They are rated as having satisfactorily or excellently fulfilled their duties for three consecutive years starting from the date of the recruitment decision;
b) Young scientific staff members with a master's degree, first-level specialist doctor, resident doctor, or first-level specialist pharmacist, in addition to the condition specified in point a of this clause, must have at least one scientific topic published in reputable domestic, regional, or international specialized journals;
c) Young scientific staff members with a doctoral degree, second-level specialist doctor, or second-level specialist pharmacist, in addition to the condition specified in point a of this clause, must have at least one scientific research project published in regional or international specialized journals (ISI or SCI).
2. Appointment to the senior specialist grade or advancement to the equivalent public official vocational title, salary ranking, and additional allowances for those who pass the examination:
a) Excellent graduates shall be ranked at level 1, with a salary coefficient of 4.40, and shall enjoy additional allowances equal to 10% of their current salary;
b) Young scientific staff members with a master's degree, first-level specialist doctor, resident doctor, or first-level specialist pharmacist shall be ranked at level 1, with a salary coefficient of 4.40, and shall enjoy additional allowances equal to 25% of their current salary;
c) Young scientific staff members with a doctoral degree, second-level specialist doctor, or second-level specialist pharmacist shall be ranked at level 1, with a salary coefficient of 4.40, and shall enjoy additional allowances equal to 40% of their current salary.
The period for enjoying additional allowances shall not exceed six years from the date of the decision to promote to the senior specialist grade or advance to the equivalent public official vocational title.
3. In addition to the additional allowance stipulated in Clause 2 of this Article, they shall also enjoy other salary allowances according to the current laws applicable to special regions, industries, or fields (if any).
4. Salary ranking and cessation of additional allowances for those who fail the examination for promotion to the senior specialist grade or advancement to the equivalent public official vocational title:
a) Excellent graduates shall be ranked at level 2, with a salary coefficient of 2.67 of the specialist grade and equivalent;
b) Young scientific staff members with a master's degree, first-level specialist doctor, resident doctor, or first-level specialist pharmacist shall be ranked at level 3, with a salary coefficient of 3.00 of the specialist grade and equivalent;
c) Young scientific staff members with a doctoral degree, second-level specialist doctor, or second-level specialist pharmacist shall be ranked at level 4, with a salary coefficient of 3.33 of the specialist grade and equivalent.
The period for the next salary increment shall be calculated from the date of cessation of additional allowances as stipulated in Clause 2 of this Article.
The time for calculating the next salary increment shall be counted from the date on which the additional allowance specified in Clause 2 of this Article ceases to be received.
Article 14. Policy application for individuals who fail to meet the policy objectives for attracting and developing cadres after recruitment
Within three years from the date of recruitment, if excellent graduates and young scientific officers have two consecutive years completing tasks but still have limitations in capacity, or have two consecutive years, including one year completing tasks with limitations in capacity and one year not completing tasks, the competent authority shall reassign them to other positions and cease their additional allowances stipulated in this Decree. In case they fail to complete tasks for two consecutive years, the competent authority shall resolve termination of employment or termination of the labor contract.
Article 15. Promotion of military rank for officers in the armed forces and police rank for officers in the public security force for individuals attracted into the armed forces
1. Granting of military rank for officers in the armed forces and police rank for officers in the public security force (hereinafter referred to as rank) at the time of recruitment:
a) Excellent graduates shall be granted the rank of Lieutenant Colonel or higher;
b) Young scientific officers with a master's degree, resident physician, specialist level I physician, specialist level I pharmacist shall be granted the rank of Major or higher;
c) Young scientific officers with a doctoral degree, specialist level II physician, specialist level II pharmacist shall be granted the rank of Senior Captain or higher.
2. Promotion of rank and handling cases where the targets of the policy are not met:
a) Individuals recruited who meet the criteria and conditions prescribed by the Law on Officers of the Vietnam People's Army and the Law on Public Security Officers and guiding documents shall be promoted according to regulations;
b) Individuals recruited who do not meet the targets and requirements of the Ministry of Defense and the Ministry of Public Security shall be removed from the scope of application of this policy as prescribed in this Decree. The Ministry of Defense and the Ministry of Public Security shall provide specific guidance on this matter according to their respective authorities prescribed by the Law on Officers of the Vietnam People's Army and the Law on Public Security Officers.
Article 16. Funding for implementing the policy of attracting and developing cadres
1. Funding for implementing the policy of attracting and developing cadres from excellent graduates and young scientific officers shall be allocated from state budget funds according to current classification levels, funding of agencies, organizations, and units employing civil servants and officials; and funding from domestic and foreign organizations and individuals.
2. Agencies, organizations, and units specified in Article 1 of this Decree may mobilize resources in accordance with the law to implement the policy of attracting and developing cadres from excellent graduates and young scientific officers.
Chapter V
IMPLEMENTING PROVISIONS
Article 17. Application of the policy of attracting and developing cadres from excellent graduates and young scientific officers in enterprises
State-owned enterprises are encouraged to apply the provisions of this Decree to attract and develop human resources.
Article 18. Effective Date
This Decree takes effect from January 20, 2018.
Article 19. Responsibility for Implementation
Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial and municipal people's committees directly under the central government, and relevant agencies, organizations, and individuals are responsible for implementing this Decree./.
