PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. These regulations stipulate the high school graduation examination (hereinafter referred to as the Examination Regulations) including: General provisions; preparation for organizing the examination; candidates, conditions for participating in the examination, registration for the examination, responsibilities of examinees; examination question work; invigilation; marking; re-examination and re-evaluation; recognition of high school graduation (THPT) and issuance of the Certificate of Completion of the General Education Program; reporting and archiving systems; inspection, supervision, commendation, handling of unusual incidents, and violation processing; implementation organization.
2. The Examination Regulations apply to general secondary schools, continuing education centers (GDTX), vocational education and training centers - GDTX, and other educational institutions implementing the general education program at the secondary level or the GDTX program at the secondary level (collectively referred to as general secondary schools); departments of education and training (GDĐT), departments of education, science, and technology (collectively referred to as departments of GDĐT); higher education institutions; and related organizations and individuals.
Article 2. Purpose and Requirements
1. The purpose of the high school graduation examination is to assess students' learning outcomes according to the educational goals of the general education program at the secondary level, the GDTX program at the secondary level (collectively referred to as the secondary-level program); to use examination results to recognize high school graduation; to serve as a basis for evaluating the quality of teaching and learning at general secondary schools and the management of educational authorities. Higher education institutions and vocational education institutions may use the results of the high school graduation examination for admissions.
2. The high school graduation examination period (referred to as the examination period) must ensure strictness, honesty, objectivity, and fairness.
Article 3. Examination Subjects
Five examination subjects shall be organized, including: three independent subjects of Mathematics, Vietnamese Language, and Foreign Language; one combined subject of Natural Sciences (abbreviated as KHTN) consisting of Physics, Chemistry, and Biology; one combined subject of Social Sciences (abbreviated as KHXH) consisting of History, Geography, and Civic Education for candidates following the high school general education program, or History and Geography for candidates following the high school vocational training program.
Article 4. Examination Date, Schedule, Content, Format, and Duration
1. Examination date and schedule: Shall be stipulated in the annual guidance on organizing the high school graduation examination issued by the Ministry of Education and Training.
2. Examination content: The content of the examination shall be within the high school curriculum, mainly focusing on the twelfth-grade program.
3. Examination format: The Mathematics, Foreign Language, KHTN, and KHXH examinations shall be conducted in multiple-choice format (commonly referred to as objective tests); the Vietnamese Language examination shall be conducted in essay format (commonly referred to as subjective tests).
4. Examination duration: Vietnamese Language - 120 minutes; Mathematics - 90 minutes; Foreign Language - 60 minutes; each component subject of the KHTN and KHXH combined subjects - 50 minutes.
Article 5. Standards and Conditions for Individuals Participating in Organizing the Examination
1. Civil servants, officials, and staff participating in the examination must be individuals who:
a) Possess good moral character, have a sense of law compliance, and demonstrate high responsibility;
b) Master examination-related professional skills;
c) Are not currently under disciplinary action according to the Examination Regulations.
2. Individuals whose spouse, parent, child, brother, sister, guardian, or ward (collectively referred to as relatives) are taking the examination in the year of the examination organization shall not participate in the examination question-setting work and shall not participate in organizing the examination at the locality where their relatives are taking the examination.
3. In addition to the standards and conditions specified in Clause 1 and Clause 2 of this Article, individuals involved in setting questions and marking subjective tests must possess excellent professional competence.
Chapter II
PREPARATION FOR ORGANIZING THE EXAMINATION
Article 6. National Steering Committee
1. The Minister of Education and Training shall establish the National Steering Committee, comprising:
a) The Chairperson shall be a Deputy Minister of Education and Training;
b) The Vice-Chairpersons shall be leaders of relevant functional units under the Ministry of Education and Training; among them, the Vice-Chairperson in charge shall be the Director of the Quality Management Department (QMD) or a Deputy Director of the QMD in special cases decided by the Minister of Education and Training;
c) Members shall be leaders of some relevant units under the Ministry of Education and Training, leaders of some relevant units under the Ministry of Public Security, and the Government Inspectorate.
2. Duties and powers of the National Steering Committee:
a) Assist the Minister of Education and Training: Direct and organize the implementation of the examination organization plan nationwide; examination question-setting work, handover and printing of examination questions, decision-making on special situations related to examination questions; direct and inspect the performance of tasks by provincial steering committees and examination boards; handle issues arising during the examination organization process; report to the Minister of Education and Training and competent authorities on the examination organization situation;
b) Establish a Secretariat to assist the National Steering Committee; the Head of the Secretariat shall be concurrently held by a member of the National Steering Committee; secretaries shall be civil servants and officials from relevant units under the Ministry of Education and Training and the Ministry of Public Security;
c) Establish a Transport and Handover Team to receive, store, transport, and hand over sealed original examination envelopes from the question-setting board to examination boards; the Head of the Transport and Handover Team shall be concurrently held by a member of the National Steering Committee; members shall be civil servants and officials from relevant units under the Ministry of Education and Training and the Ministry of Public Security;
d) Depending on the level of violation of the Examination Regulations discovered during the examination, decide on appropriate measures (in special cases, submit to the Minister of Education and Training for decision): Suspend temporarily the examination activities or reorganize the examination at some examination boards or nationwide; suspend operations and recommend disciplinary action against examination board leaders violating the Examination Regulations;
e) Propose the Minister of Education and Training to establish a Review Board and inspection teams of the National Steering Committee.
3. Responsibilities, duties, and powers of members of the National Steering Committee:
a) The Chairperson decides on the implementation of duties and powers, and is responsible for the results of the National Steering Committee's work according to the provisions of these Regulations;
b) Vice-Chairpersons, members, and secretaries are responsible for the results of their assigned or delegated duties and powers by the Chairperson.
Article 7. Provincial Steering Committee
1. The Chairman of the People's Committee (PC) of the province/city directly under the Central Government (hereinafter referred to as the province) shall establish the provincial steering committee, including:
a) The Head of the Committee is a leader of the PC of the province;
b) Deputy Heads of the Committee are leaders of some relevant departments, committees, and agencies of the province; among them, the Standing Deputy Head is the Director of the Department of Education and Training (EDT) or Deputy Director of the EDT, in special cases;
c) Members are leaders of the departments of the EDT, leaders of relevant departments, committees, agencies, and leaders of the People's Committees at the district/city/district level under the province (hereinafter collectively referred to as the district/city/district level);
d) Secretaries are civil servants and staff members of the EDT and some relevant departments, committees, and agencies of the province.
2. Duties and powers of the provincial steering committee:
a) Be responsible for comprehensively directing all preparatory activities and organizing the examination according to the provisions of this Regulation;
b) Direct and inspect relevant departments, mass organizations, and educational institutions on the territory to coordinate, support, and ensure necessary conditions for the operation of the Examination Board during the organization of the examination; consider and resolve recommendations from the Chairman of the Examination Board;
c) Report to the national steering committee and the Chairman of the PC of the province on the examination organization situation, implementation of the examination regulation in the locality, and propose handling of situations arising during the examination organization;
d) Propose the Chairman of the PC of the province to commend or submit to competent authorities for commendation civil servants, staff members, and workers with achievements in examination organization work or discipline those who violate the examination regulation;
e) Implement decisions and directives related to the national steering committee.
3. Responsibilities, duties, and powers of members of the provincial steering committee:
a) The Head decides on the implementation of tasks and powers, and is responsible for the results of the provincial steering committee's tasks according to the provisions of this Regulation.
b) Vice-Chairpersons, members, and secretaries are responsible for the results of their assigned or delegated duties and powers by the Chairperson.
Article 8. Examination Board
1. Each province shall organize one Examination Board, chaired by the EDT, to conduct examinations for all candidates registered to take the examination (registration for examination - RFE) in the province. Each Examination Board has examination venues to organize the examination supervision phase during the examination period.
2. The Director of the EDT issues a decision to establish the Examination Board and its Committees, including: Secretariat; Printing and Copying Question Paper Committee; Transportation and Handover of Question Paper Committee; Supervision Committee; Grading of Essay Test Papers Committee; Grading of Multiple Choice Test Papers Committee; Re-examination of Essay Test Papers Committee; Re-examination of Multiple Choice Test Papers Committee.
a) Composition of the Examination Board: Chairperson is the Director of the EDT (or Deputy Director of the EDT, in special cases); Deputy Chairpersons are Deputy Directors of the EDT and some heads of specialized departments of the EDT; members are leaders of some departments of the EDT and principals of general education schools, among whom the standing member is the leader of the department responsible for managing the high school graduation examination of the EDT (collectively referred to as the Examination Management Department);
b) Duties and powers of the Examination Board: Receive original question paper bags/exams/subjects still sealed from the Question Paper Setting Board from the national steering committee, organize printing and copying of question papers; disseminate, guide, and direct the implementation of the examination regulation; supervise exams, store test papers, grade, re-grade; establish teams to carry out tasks as requested by the heads of the Committees; announce examination results according to the provisions of the examination regulation; answer inquiries and resolve complaints and reports related to examination organization; promptly report to the national steering committee on the Examination Board's examination organization work; organize the reception and handling of information and evidence of examination regulation violations according to Article 52 of this Regulation; summarize examination organization work within the assigned scope; propose commendations and disciplinary actions according to their functions and powers as prescribed; implement reporting systems and transfer examination data to the Ministry of Education and Training (MOET) within the prescribed deadlines; direct and handle issues occurring in the Examination Board's Committees according to the examination regulation; organize the storage, safety, and confidentiality of question papers, test papers, and related materials according to the examination regulation; report to the provincial steering committee and the national steering committee to handle situations exceeding authority. The Examination Board uses the seal of the EDT;
c) The Chairperson of the Examination Board decides on the implementation of tasks and powers, and is responsible for the results of the Examination Board's tasks according to the provisions of this Regulation;
d) The Committees, Deputy Chairpersons, and members of the Examination Board are responsible for the results of their tasks and powers as assigned or delegated by the Chairperson of the Examination Board.
3. Secretariat of the Examination Board:
a) Composition: The Head is concurrently held by a leader of the Examination Board; Deputy Heads are leaders of departments of the EDT and leaders of general education schools; members are civil servants and staff members of the EDT, leaders, and teachers of general education schools. Those participating in the Secretariat of the Examination Board may not participate in the Grading Committee, Grading Committees, and Re-grading Committees.
b) Duties and powers of the Secretariat Board of the Examination Council: Receiving and managing registration data under the Department of Education and Training; numbering candidate registration numbers, arranging examination rooms; preparing materials, forms, and lists for use at examination venues and rooms; receiving and storing sealed envelopes containing candidates' subjective test papers and answer sheets (hereinafter referred to collectively as bags) from examination venues; transferring sealed bags containing subjective test papers from examination venues to the Marking Committee; receiving and storing marked subjective test papers sealed in bags from the Marking Committee; transferring sealed bags containing marked subjective test papers from the Marking Committee to the Subjective Test Grading Committee; transferring sealed bags containing answer sheets from examination venues to the Objective Test Grading Committee and performing related tasks; receiving and storing answer keys sealed in bags from the Marking Committee after the grading of subjective test papers has been completed; managing materials related to subjective test papers and answer sheets; drafting minutes on handling points of subjective test papers (if any); entering and compiling scores, conducting checks and analyses of examination results, and compiling score distributions for each subject and component according to regulations; managing examination result data and performing other tasks assigned by the Chairman of the Examination Council.
c) The Secretariat Board of the Examination Council may only proceed with work related to test papers when at least two members of the Board are present.
d) The Head of the Secretariat Board of the Examination Council decides on the organization and implementation of duties and powers, and is responsible for the results of the Secretariat Board's performance of its duties before the Chairman of the Examination Council in accordance with this Regulation.
đ) Deputy Heads and members of the Secretariat Board of the Examination Council are responsible for the results of their performance of duties and powers as assigned or delegated by the Head of the Secretariat Board.
Article 9. Compilation of Candidate Lists and Arrangement of Examination Rooms
1. Compilation of Candidate Lists:
a) At each Examination Council (having a unique code and unified nationwide), the compilation of candidate lists is carried out separately for each examination venue as follows: Compile a list of all candidates registered at the examination venue in alphabetical order; compile a list of candidates in alphabetical order for each subject to arrange examination rooms.
b) Each candidate has a unique registration number; the registration number consists of the Examination Council code (two digits) followed by six increasing digits from 000001 to the total number of candidates in the Examination Council, ensuring no duplicate registration numbers.
2. Arrangement of Examination Rooms:
a) Graduates of high school, graduates of vocational secondary schools participating in the examination, and candidates for General Secondary Education can be arranged to take the exam together with high school students in grade 12 during the examination year (referred to as grade 12 high school students) at certain examination venues as decided by the Director of the Department of Education and Training, ensuring that at least 60% of the candidates are grade 12 high school students; the compilation of lists for room arrangements shall be conducted according to the provisions of point a, Clause 1 of this Article.
b) Examination rooms are arranged according to subjects, with a maximum of 24 candidates per room, and a minimum distance of 1.2 meters between adjacent candidates along the row; for the last room of the foreign language subject at each examination venue, candidates taking different foreign languages can be seated together, and collected test papers must be sorted by language; the compilation of lists for room arrangements shall be conducted according to the provisions of point a, Clause 1 of this Article.
c) Examination rooms of each Examination Council are numbered in ascending order.
d) Each examination room has a list of candidate photographs corresponding to the seating arrangement in the room.
đ) A list of candidates for each examination session and their responsibilities as stipulated in Article 14 of this Regulation must be posted at the entrance of each examination room.
Article 10. Use of Information Technology and Communication Equipment and Software
1. Examination Boards shall uniformly use examination management software, multiple-choice test marking software provided by the Ministry of Education and Training; establish an accurate and updated information exchange system about the examination period between general education schools and provincial Departments of Education and Training, and between provincial Departments of Education and Training and the Ministry of Education and Training; implement data processing procedures, structures, deadlines, and reporting systems according to the regulations set forth in the organization guidelines for the High School Graduation Examination issued by the Ministry of Education and Training.
2. The Examination Board must clearly stipulate that civil servants and employees under the Committees specified in Clause 2, Article 8 of this Regulation may use computers and examination management software, multiple-choice test marking software to perform assigned tasks during the examination period; they must register their email addresses and phone numbers with the Ministry of Education and Training.
3. At each Examination Venue, a fixed telephone must be arranged for communication with the Examination Board; if it is not possible to arrange a fixed telephone, a mobile phone must be placed in the main office of the Examination Venue. All telephone communications during the examination period must be conducted with external speakers and heard openly by inspectors at the Examination Venue. In necessary cases, a computer can be arranged in the Examination Venue's duty room, ensuring that the computer is only connected to the internet when transmitting quick reports to the Examination Board under the supervision of inspectors at the Examination Venue (tasks and users must be assigned and clearly defined).
4. It is prohibited to carry and use information transmission devices in the examination and marking areas, except for those specified in Clause 3 of this Article.
Article 11. Management and Use of Examination Data
1. Examination Boards shall announce examination results after confirming the completion of transferring examination result data to the Ministry of Education and Training and completing the matching process to ensure that the data on the Ministry’s software system is consistent with the examination result data retained by the Examination Board.
2. The Ministry of Education and Training shall organize the management and appropriate use of examination data for candidates for the purposes of the examination period; provincial Departments of Education and Training shall use examination data to recognize high school graduation.
Chapter III
ELIGIBILITY AND CONDITIONS FOR PARTICIPATION IN THE EXAMINATION, REGISTRATION PROCEDURES, AND RESPONSIBILITIES OF CANDIDATES
Article 12. Eligibility and Conditions for Participation in the Examination
1. Candidates eligible to participate include:
a) Persons who have completed the high school curriculum in the year the examination is organized;
b) Persons who have completed the high school curriculum but have not taken the high school graduation examination or have taken it but have not passed it in previous years;
c) Persons who already hold a high school graduation certificate, persons who already hold a vocational secondary school graduation certificate participating to obtain results as a basis for admission registration;
d) Other special cases decided by the Minister of Education and Training.
2. Conditions for participation:
a) Persons specified in point a, Clause 1 of this Article must meet the requirement of being evaluated in grade 12 with conduct grades from average or above and academic performance not classified as poor; specifically, for students who do not need to be classified in conduct grades and self-study students under the General Secondary Education Program, there is no requirement for conduct grades;
b) Persons specified in point b, Clause 1 of this Article must hold a junior high school graduation certificate and must meet the requirement of being evaluated in grade 12 with conduct grades from average or above and academic performance not classified as poor; in cases where they did not meet the eligibility criteria in previous years due to poor academic performance in grade 12, they must register and take the end-of-year examination for some subjects with an average score below 5.0 points (at the high school where they studied grade 12 or the high school where they registered for the examination), ensuring that when replacing the average subject score with the examination score, they meet the academic performance requirements;
c) Persons who have graduated from vocational secondary school as specified in point c, Clause 1 of this Article must meet the requirement of passing the required number of high school cultural subjects according to the provisions of the Education Law and current guiding documents of the Ministry of Education and Training;
d) Candidates must register for the examination and submit all required documents within the deadline.
3. Registration for Examinations:
a) For recognition of high school graduation: high school education candidates belonging to the categories specified in points a and b, Clause 1 of this Article must take four examinations, including three independent subjects: Mathematics, Vietnamese, Foreign Language, and one combined subject chosen by the candidate; candidates under the General Secondary Education Program belonging to the categories specified in points a and b, Clause 1 of this Article must take three examinations, including two independent subjects: Mathematics, Vietnamese, and one combined subject chosen by the candidate, who may also register for the Foreign Language examination to use the results for admission;
b) Candidates belonging to the category specified in point c, Clause 1 of this Article may register for independent subjects, combined subjects, or components of combined subjects according to their preferences.
Article 13. Registration for the Examination
1. Place of Registration:
a) The subject specified in point a, Clause 1, Article 12 of this Regulation shall register at the general secondary school where they are studying grade 12;
b) The subjects specified in points b and c, Clause 1, Article 12 of this Regulation shall register at the location (called place of registration) designated by the Department of Education and Training. The head of the unit where the registration takes place shall be responsible for performing the tasks stipulated in Article 60 of this Regulation.
2. Registration Documents:
a) For the subject specified in point a, Clause 1, Article 12 of this Regulation, the registration documents include: two identical Registration Forms; original or certified copy from the original or certified copy issued from the original record or certified copy accompanied by the original for comparison (collectively called certified copy) of the high school transcript or the high school equivalent transcript or the learner's assessment form for self-study general education training as provided by the principal of the general secondary school; valid certificates to enjoy preferential treatment (if any); certified copy of the household registration book to enjoy preferential treatment related to the place of permanent residence registration; two photographs measuring 4x6 cm;
b) For the subject specified in point b, Clause 1, Article 12 of this Regulation, in addition to the documents specified in point a of this clause, the registration documents must also include: a confirmation letter from the general secondary school where the examinee studies grade 12 or the place of registration regarding the academic performance classification for students classified as having poor academic performance as stipulated in point b, Clause 2, Article 12 of this Regulation; certified copy of the Junior Secondary School Graduation Certificate; a confirmation letter of credit points (if any) issued by the principal of the general secondary school where the examinee took the exam the previous year;
c) For examinees who have graduated from high school, the registration documents include: two identical Registration Forms; certified copy of the High School Graduation Certificate; two photographs measuring 4x6 cm;
d) For examinees who have graduated from a junior college, the registration documents include: two identical Registration Forms; two photographs measuring 4x6 cm; certified copy of the Junior Secondary School Graduation Certificate, certified copy of the Junior College Graduation Certificate, certified copy of the study record book or the transcript of high school cultural subjects as prescribed by the Education Law and current guiding documents of the Ministry of Education and Training.
3. Time for Submitting Registration Documents:
The time for submitting registration documents is specified in the annual guidance on organizing the national high school graduation examination of the Ministry of Education and Training. Upon expiration of the registration document submission period, if any errors or omissions are discovered, the examinee must promptly notify the principal of the general secondary school or the head of the unit where the registration takes place or inform the Head of the Examination Venue on the day of examination procedures to correct and supplement.
4. Organization of Registration:
a) Examinees shall register according to the regulations and guidelines of the Ministry of Education and Training;
b) Examinees shall complete and submit the documents for recognition of high school graduation at the general secondary school or the place of registration as specified in the annual guidance on organizing the national high school graduation examination of the Ministry of Education and Training;
c) The principal of the general secondary school or the head of the unit where the registration takes place shall be responsible for guiding examinees to register, collecting Registration Forms, entering examinee registration information, entering information about the results of grade 12 subjects of examinees studying grade 12 in the year of examination organization; organizing the review of registration documents and publicly announcing those cases that do not meet the conditions for taking the examination as stipulated in Clause 2, Article 12 of this Regulation no later than 15 days before the examination date; managing registration documents and transferring registration documents and data to the Department of Education and Training;
d) The Department of Education and Training shall manage the registration data of examinees and send the data to the Ministry of Education and Training;
đ) The Ministry of Education and Training shall manage the national registration data.
Article 14. Responsibilities of Candidates
1. Register for the examination in accordance with the provisions of Article 13 of this Regulation and the annual organization guidelines for the National High School Graduation Examination issued by the Ministry of Education and Training.
2. Be present at the examination room at the time specified on the Examination Attendance Notification to complete the examination registration procedures:
a) Present a People's Identity Card or Citizen Identification Card (referred to collectively as the Citizen Identification Card) and receive the Examination Card.
b) If there are errors in the family name, middle name, given name, date of birth, preferential category, or preferential area, immediately report to the invigilator or staff member at the Examination Venue for prompt handling.
c) In case of losing the Citizen Identification Card or other necessary documents, immediately report to the Examination Venue Director for review and handling.
3. Be present at the examination room at the time specified for each session, comply with the instructions of the Examination Board and the guidance of the invigilators. Candidates who arrive more than fifteen minutes late after the start signal will not be allowed to take that session.
4. Must adhere to the following rules in the examination room:
a) Show the Examination Card to the invigilator;
b) Sit in the seat marked with their registration number;
c) Before starting the examination, write down their full registration number and personal information on the examination paper, answer sheet, and rough draft paper;
d) Upon receiving the examination paper, carefully check the page numbers and quality of the printed pages; if missing pages, torn, damaged, blurred, or faint pages are found, immediately report to the invigilator in the examination room within five minutes from the time the examination paper is distributed;
đ) Do not exchange answers, copy others' work, use unauthorized materials to complete the examination, or make gestures or actions that disrupt the examination room order; if they wish to express opinions, they must raise their hand to report to the invigilator, and after permission, publicly present their opinion to the invigilator;
e) Do not mark or make private symbols, do not write with pencil except for shading boxes on the answer sheet; only write in one ink color (red ink is not allowed);
g) When the end-of-examination signal is given, stop working immediately;
h) Safeguard the integrity of the examination paper, do not allow others to exploit it; immediately report to the invigilator for handling cases where the examination paper has been exploited or intentionally interfered with by others;
i) When submitting the essay examination paper, clearly state the number of examination papers submitted and sign the Examination Paper Collection Form; candidates who cannot complete the examination must still submit the examination paper (for essay examinations) and the answer sheet (for multiple-choice examinations);
k) Do not leave the examination room during the entire duration of the multiple-choice examination; for the essay examination session, candidates may leave the examination room and venue after two-thirds of the examination time has passed, but must submit the examination paper along with the question paper and rough draft before leaving the examination room;
l) In emergency situations, only leave the examination room with the permission of the invigilator and under the supervision of monitoring staff; the departure of candidates from the examination room and venue in emergency situations must be supervised by police until the end of the examination session and decided by the Examination Venue Director;
m) Only bring the following items into the examination room: writing pens, pencils, compasses, erasers, rulers, calculators without word processing functions and without memory cards (specifically detailed in the annual organization guidelines for the National High School Graduation Examination issued by the Ministry of Education and Training); the Atlas of Vietnam Geography for Geography subjects (without any markings or additional content) published by the Vietnam Educational Publishing House; recording devices that only have recording functions and cannot play, transmit, or receive audio or video signals directly without additional equipment;
n) Prohibited from bringing into the examination room: carbon paper, correction fluid, alcoholic beverages; weapons and explosive or flammable substances; communication devices or storage media containing information that could be used to cheat during the examination and marking process.
5. When taking multiple-choice examinations, in addition to the provisions of Clause 4 of this Article, candidates must also comply with the following regulations:
a) Complete the examination on the pre-printed answer sheet according to the Ministry of Education and Training's regulations; only shade the registration number box, test code box, and response box with black pencil; if shading mistakes occur or changes to answers are desired, erase all pencil marks in the old box completely, then shade the chosen box;
b) Accurately fill in all blank sections on the top of the answer sheet, including fully shading the registration number part (including leading zeros); accurately fill in the test code on both Examination Paper Collection Forms;
c) When receiving the examination paper, pay attention to checking to ensure that all component subjects in each Natural Science or Social Science examination paper have the same test code; if different test codes are found, immediately report to the invigilator in the examination room within five minutes from the time the examination paper is distributed; place the examination paper under the answer sheet, do not view the examination content until permitted by the invigilator;
d) Check the examination paper to ensure that the number of questions and pages matches the information provided in the examination paper and that all pages of the examination paper bear the same test code;
đ) Do not submit the examination paper before the end of the examination time; upon the end of the examination time, submit the answer sheet to the invigilator and sign the two Examination Paper Collection Forms;
e) Only leave the examination room after the invigilator has confirmed the completion of all answer sheets in the examination room and given permission to leave.
6. In case of unusual events, strictly follow the instructions of the invigilators and responsible personnel at the Examination Venue.
Chapter IV
EXAMINATION PAPER WORK
Article 15. Requirements for Examination Questions
1. Examination questions for each subject/examination session of the examination must meet the following requirements:
a) The content of the examination questions must comply with the provisions set out in Clause 2, Article 4 of this Regulation;
b) Ensure accuracy, scientific rigor, and pedagogical value; the wording and sentences must be clear;
c) Closely adhere to the knowledge and skill standards of the high school curriculum; ensure the ability to classify candidates;
d) For essay-type examination questions, the number of points for each question must be clearly stated; the score for the essay-type examination and the multiple-choice examination must be scaled to a maximum of ten (10) points for the entire examination and for each component subject of combined examinations;
đ) Examination questions must clearly state the number of pages (for examination questions with two or more pages); the word "END" must be clearly marked at the end of the examination questions.
2. In one examination session, each subject/examination session must have official and backup examination questions that meet the requirements stipulated in Clause 1 of this Article; each examination question must come with marking instructions and answers.
Article 16. Examination Question Composition Area, Printing, and Security Requirements
1. Unpublished examination questions, marking instructions, answers, and grading scales belong to the State Secret category of "Top Secret". Backup essay-type examination questions that have not been used may be declassified after the examination session ends.
2. The process of composing examination questions and printing them (collectively referred to as making examination questions) must be carried out at a secure, isolated location and must be strictly monitored by police forces for security, safety, and protection from the time of making examination questions until the end of the last subject examination session; all necessary security measures, including preventing information leaks, fire prevention, and firefighting equipment, must be provided.
3. All participants involved in making examination questions must be completely isolated from the outside. In cases of necessity and with written approval from the Chairman of the Examination Question Composition Board or the Head of the Examination Question Printing Board, participants may contact the outside world through fixed-line telephones with external speakers and recording capabilities under the supervision of guards and police. The list of participants in making examination questions must be kept confidential before, during, and after the examination session. Individuals working in the isolation area must wear identification badges and operate within permitted areas; they can only leave the isolation area after the last examination session ends. In special circumstances, with written approval from the Chairman of the Examination Question Composition Board or the Head of the Examination Question Printing Board, participants may leave the isolation area under police supervision (in accordance with the time specified in the document issued by the Chairman of the Examination Question Composition Board or the Head of the Examination Question Printing Board).
4. Envelopes (bags) containing examination questions for transportation and handover from the examination question composition site to the National Steering Committee, Examination Boards/Examination Sites must be made of durable paper, sealed tightly, dark-colored, and securely taped without peeling edges, with sufficient labels and seals; the content printed on the bags must comply with the regulations of the Ministry of Education and Training.
5. The entire process of transporting and handing over examination questions must be supervised by the police; the bags containing examination questions must be placed in locked boxes and sealed; a record of the handover and transportation process must be established.
6. Machinery and equipment at the examination question composition site, whether damaged or unused, can only be removed from the isolation area after the last examination session ends.
Article 17. Examination Question Setting Board
1. The Minister of Education and Training shall decide to establish the Examination Question Setting Board for the High School Graduation Examination (referred to as the Examination Question Setting Board).
2. Composition of the Examination Question Setting Board:
a) The Chairman of the Board is the leader of the Quality Assurance Department or the leader of the Secondary Education Department.
b) The Vice Chairmen of the Board are the Deputy Directors of the Quality Assurance Department, leaders of some related units under the Ministry of Education and Training, and leaders of departments and centers under the Quality Assurance Department.
c) Members, secretaries, and technical staff are civil servants, employees, and workers from units under the Ministry of Education and Training; among them, the permanent member is a civil servant from the Quality Assurance Department.
d) Drafters and reviewers of examination questions are civil servants, employees, and teachers currently working at educational institutions and research institutes; each examination question set for a subject includes a team leader and a drafter and reviewer.
đ) Police force mobilized by the Ministry of Public Security.
e) Security guards, medical personnel, and service staff mobilized by the Ministry of Education and Training.
3. Principles of operation of the Examination Question Setting Board:
a) Each Examination Question Setting Team and other members of the Board work independently and directly with the leadership of the Board; individuals assigned tasks must fulfill those tasks without participating in other tasks.
b) Each member of the Examination Question Setting Board must be personally responsible for the content of the examination questions and ensure confidentiality and security of the examination questions according to their duties and the laws on state secrets protection.
4. Duties and powers of the Examination Question Setting Board:
a) Organize the drafting, reviewing, refining of examination questions, marking guidelines, answers, and grading scales for the main and reserve examinations.
b) Print and duplicate examination questions in accordance with regulations and in sufficient quantity as required by the National Steering Committee; package, seal, store, and hand over original examination questions to the Examination Transport and Handover Team of the National Steering Committee.
c) Ensure absolute confidentiality and security of examination questions, marking guidelines, answers, and grading scales within the examination question setting area from the start of the examination question drafting until the end of the last subject's examination period.
d) Propose the Minister of Education and Training to issue decisions on commendation and disciplinary action (if necessary) for members of the Examination Question Setting Board.
5. The Chairman of the Examination Question Setting Board directs all activities of the examination question setting process according to the Board's duties and powers; is responsible to the Minister of Education and Training for the results of the Board's implementation tasks as stipulated in this Regulation.
6. Members of the Examination Question Setting Board are responsible for the results of their assigned or delegated duties and powers by the Chairman of the Examination Question Setting Board.
7. Examination Question Setting Process:
a) Drafting, reviewing, refining examination questions: Based on the requirements of the examination questions, each Examination Question Setting Team is responsible for drafting, reviewing, refining examination questions, answers, and marking guidelines (main and reserve) for the subjects they are assigned; the drafting, reviewing, and refining of examination questions, answers, and marking guidelines must meet the requirements stipulated in Article 15 of this Regulation.
b) For multiple-choice examination questions, the Question Bank built according to the Ministry of Education and Training's regulations serves as an important reference for drafting examination questions in the isolated area following the procedure below: The secretary uses software to randomly select multiple-choice questions from the Question Bank and transfers them to the Examination Question Setting Team Leaders (with the witnessing of the Chairman of the Examination Question Setting Board and the Team Leaders); the Team Leader assigns members of the Team to review each multiple-choice question; the Team works together, gradually refining each multiple-choice question and compiling it into an examination question set according to the content requirements stipulated in Article 15 of this Regulation; after the final refinement, the Team Leader signs off on the examination questions and hands them over to the Chairman of the Examination Question Setting Board; the secretary mixes the examination questions into different versions; the Team reviews each version of the examination questions, answers, and marking guidelines for subjective questions and signs off on each version.
c) Reviewing examination questions: After drafting, reviewing, and refining, the examination questions are organized for independent review; the reviewer is responsible for reading, solving, and evaluating the examination questions according to the requirements stipulated in Article 15 of this Regulation and proposing revision and correction suggestions if necessary; the reviewer's evaluation opinions are reported to the Chairman of the Examination Question Setting Board, serving as a basis for the Chairman to refer to during the examination question approval process.
Article 18. Copying, transporting, and delivering examination papers at the Examination Board
1. Copying examination papers:
a) The Composition of the Examination Paper Copying Committee includes: The Chairperson, concurrently serving as the Examination Board's leadership; the Deputy Chairperson, being the leadership of the Department of Education and Training or a department under the Department of Education and Training; members and secretaries are civil servants, staff members, or workers from the Department of Education and Training or general education schools; security forces ensuring safety during the copying process are mobilized by the Provincial Police and the Department of Education and Training.
b) The Examination Paper Copying Committee works in isolation from the start of unsealing the original examination paper envelopes until the end of the final examination session of the examination period.
c) The Chairperson of the Examination Paper Copying Committee is responsible to the Chairman of the Examination Board and the law, with the following tasks and authorities: Receiving original examination paper envelopes from the Chairman of the Examination Board, organizing the copying, packaging, sealing, storage, and delivery of examination paper envelopes to the Chairperson of the Examination Paper Transport and Delivery Committee of the Examination Board, witnessed by members, secretaries of the Examination Board, and police officers assigned to supervise and protect the examination papers; proposing the Chairman of the Examination Board to consider and issue decisions or propose rewards and disciplinary actions (if any) for members of the Examination Paper Copying Committee.
2. Process of copying examination papers:
a) Review and check the original examination papers, carefully inspect the trial printouts, compare them with the original examination papers before copying; in case of discovering errors or suspicious content in the original examination papers, immediately report to the Chairman of the Examination Board to request the National Steering Committee to handle;
b) Accurately control the number of examination papers according to the number of candidates in each examination room, Test Center, subject/test, organize distribution of examination papers; record the name of the Test Center, examination room, subject/test, and the number of examination papers in each envelope containing examination papers in accordance with Clause 4, Article 16 of this Regulation before packaging the examination papers;
c) Sequentially copy examination papers for each subject/test; after copying, seal and package according to the examination room, clean up thoroughly before moving on to copy the next subject/test examination papers. During the copying process, quality of the copies must be checked; trial prints and defective copies must be collected and stored according to the highest confidentiality standards;
d) Package the correct number of examination papers according to the subject/test noted on the outside of the envelope containing examination papers, sufficient for each Test Center and each examination room. At each Test Center, there must be a backup envelope containing examination papers for each subject/test (with all codes for multiple-choice examination papers). The Chairperson of the Examination Paper Copying Committee manages the packaged and sealed envelopes of examination papers for each subject/test, as well as excess, defective, blurry, poor-quality, torn, or dirty copies that have been discarded.
3. Transporting and delivering examination papers:
a) The Chairperson of the Examination Paper Transport and Delivery Committee is concurrently serving as the Examination Board's leadership; members of the Committee and police officers performing protection and supervision duties are decided by the Chairman of the Examination Board;
b) The Examination Paper Transport and Delivery Committee performs the task of receiving intact sealed envelopes of examination papers from the Examination Paper Copying Committee, storing, transporting, and distributing examination papers to Test Centers;
c) Envelopes of examination papers must be stored in locked, sealed boxes, cabinets, or safes, continuously protected 24 hours a day; keys are kept by the Chairperson of the Examination Paper Transport and Delivery Committee; the Chairperson of the Examination Paper Transport and Delivery Committee may authorize in writing the person in charge of transport teams or groups to hold and hand over keys of boxes containing examination paper envelopes to the Heads of Test Centers;
d) Establish and store records of handover of examination papers between the Examination Paper Copying Committee and the Examination Paper Transport and Delivery Committee, and between the Examination Paper Transport and Delivery Committee and the Heads of Test Centers.
Article 19. Storage and Use of Examinations and Preservation of Answer Sheets at Examination Centers
1. Examination papers and answer sheets must be stored in separate cabinets. The cabinets for examination papers and answer sheets must be secure, locked, and sealed (the seal label must have signatures from the Examination Center Director, inspector, and police), with keys held by the Examination Center Director. When opening the seals, there must be witnesses who signed the seal labels, and a record must be made noting the time of opening, reason for opening, and condition of the seal.
2. The area for storing examination papers and student answer sheets must have police guards and continuous security for 24 hours a day, and must ensure fire and explosion safety. The storage room for examination papers and answer sheets must be safe and secure; it must have security cameras recording activities continuously for 24 hours a day; it must have police guards and continuous security for 24 hours a day; there must be a Deputy Examination Center Director from a secondary school not having students taking the exam at that center present in the room throughout the period the examination papers and answer sheets are kept at the center. During examination days, the duty time of the Deputy Examination Center Director in the storage room starts from the end of the last session on the previous examination day to the start of the first session on the following examination day.
3. Opening examination paper bags and distributing examination papers to candidates must be carried out in the examination room according to the specified time and subject as stipulated in the annual organization guidelines for the National High School Graduation Examination issued by the Ministry of Education and Training.
4. Backup examination papers may only be used upon the opinion of the National Steering Committee Director.
Chapter V
SUPERVISION
Article 20. Examination Supervision Board
1. Composition: The Chairperson is concurrently held by the Examination Council leadership; the Vice-Chairperson in charge of daily operations is the leadership of the Department of Education and Training or the Department of Examination Management of the Department of Education and Training; other Vice-Chairpersons are the leadership of the Department of Education and Training, the leadership of some departments under the Department of Education and Training, and the Principal of a secondary school; members and secretaries are the leadership and specialists of departments under the Department of Education and Training, the leadership and teachers of secondary schools.
2. Responsibilities and Authorities of the Examination Supervision Board:
a) The Chairperson of the Examination Supervision Board is responsible to the Chairman of the Examination Council for examination supervision work; has the duty to direct all examination supervision work at the Examination Council, decide the time to distribute unopened examination paper bags to supervisors, and handle situations arising during examination sessions;
b) The Vice-Chairpersons, members, and secretaries of the Examination Supervision Board are responsible for the results of their tasks and authorities assigned or delegated by the Chairperson of the Examination Supervision Board.
3. The Director of the Department of Education and Training shall decide based on the number of candidates registered for the examination at the Examination Council and the material conditions and staff to establish Examination Centers at secondary schools and other educational institutions meeting the requirements for organizing examinations.
a) Composition: The Examination Center Director is the leadership of the secondary school where the Examination Center is located; one Deputy Examination Center Director is the leadership or Head of the specialized department of the secondary school where the Examination Center is located, responsible for infrastructure; other Deputy Examination Center Directors are the leadership or Heads of specialized departments from other secondary schools; the Secretary of the Examination Center is the Secretary of the Council or a teacher from the secondary school; supervisors are teachers from the secondary school or junior high school in the province; room supervisors are teachers from the secondary school; order officers, health personnel, service personnel are employees of the school where the Examination Center is located and police, military control officers;
b) The Examination Center Director and Deputy Examination Center Directors cannot belong to the same secondary school; each examination room must have two supervisors from different secondary schools; each room supervisor can monitor no more than three (3) rooms in the same row of rooms; the Examination Center Director, Deputy Examination Center Director (not responsible for infrastructure), supervisors, and room supervisors cannot perform duties at an Examination Center where students from their own school are taking the exam in the year of the examination;
c) The Examination Center Director decides on the implementation of tasks and authorities related to examination supervision work at the Examination Center, and is responsible for the results of the implementation of these tasks before the Chairperson of the Examination Supervision Board and the Chairman of the Examination Council;
d) Deputy Examination Center Directors, supervisors, room supervisors, and other members performing duties at the Examination Center are responsible for the results of their tasks and authorities assigned or delegated by the Examination Center Director;
đ) To carry out the tasks of the Examination Center, the Examination Center leadership may use the stamp of the secondary school or educational institution where the Examination Center is located.
Article 21. Registration procedures for candidates
1. Based on the registration data of candidates, the Secretariat of the Examination Board shall complete the list of candidates (including the list of candidate photos) for each examination room; issue examination cards; determine the location for candidates to complete their registration procedures.
2. On the day of registration procedures, the Head of the Examination Venue assigns venue members to guide candidates through the registration process, disseminate the Examination Regulations; confirm any errors regarding the candidate's surname, name, category, permanent residence, and area, and transfer this information to the Secretariat of the Examination Board for review and updating in the examination management software.
Article 22. Examination supervision procedures and responsibilities for implementation
1. According to the assignment of the Chief Supervisor, the Head of the Examination Venue is responsible for managing all examination supervision work at the venue; preserving and using examination questions and securing examination papers at the venue; assigning tasks to other venue members. Before each session, the Head of the Examination Venue must ensure that unused rooms are locked and sealed; personal communication devices of all venue staff must be stored in the venue duty room; organize for supervisors and room monitors to draw lots for task assignments, ensuring that no supervisor supervises more than one session in the same room during the examination period; organize for supervisors to draw lots for numbering candidate registration cards in the examination room.
2. Supervisors are responsible to the Head of the Examination Venue and shall perform the following tasks:
a) Be present on time at the venue to perform duties; while performing examination supervision duties, they may not carry communication devices; they may not engage in personal activities, smoke, or consume alcoholic beverages;
b) Upon signal, the first supervisor calls the candidate's name into the examination room, the second supervisor uses the examination card and candidate photo list to verify and identify the candidate; guides the candidate to sit in the designated seat and checks the items the candidate brings into the examination room, absolutely prohibiting the candidate from bringing prohibited materials and items as stipulated in Article 14 of these Regulations into the examination room;
c) Upon signal, the first supervisor collects the examination questions, the second supervisor reminds candidates of necessary examination room discipline; clearly write their names and sign on the examination papers and scratch paper sufficient for distribution to candidates (without signing extra); guide and check that candidates fold examination papers according to regulations, write down their registration number and fill in necessary candidate information on the examination papers before starting the exam;
d) Upon signal, the first supervisor holds up the examination question envelope so that candidates can clearly see both sides with the original seal intact, request two witnesses to confirm and sign the confirmation form stating that the envelope seal remains intact; open the envelope containing the examination questions, check the quantity of examination questions (if there are excess, shortage, or mixed questions, immediately report to the Head of the Examination Venue for handling); distribute examination questions to each candidate;
đ) When candidates start answering the questions, the first supervisor compares the candidate's photo in the examination card and photo list with the candidate to identify them, clearly write their names and sign on the candidate's examination papers and scratch paper; the second supervisor oversees the entire room; during the examination period, one supervisor oversees from the front to the back of the room, the remaining supervisor oversees from the back to the front until the end of the examination; supervisors may not stand close to candidates, assist candidates in answering the exam under any form; only answer public questions from candidates within the prescribed scope;
e) The supervisor who signs and writes their name on additional examination papers and scratch paper distributed to candidates shall follow the procedure specified in points c and đ of this clause;
g) Supervisors must protect examination questions during the examination period, preventing them from being taken out of the examination room. After fifteen minutes of examination time (for independent examinations and each component subject in combined examinations), supervisors submit sealed surplus examination questions to the person assigned by the Head of the Examination Venue;
h) Only allow candidates to leave the examination room earliest after two-thirds of the examination time has passed (for essay-type examinations) after the candidates have submitted their answers, examination questions, and scratch paper; if candidates must temporarily leave the examination room, supervisors must inform the room monitor to coordinate according to regulations;
i) If candidates violate examination discipline, supervisors must record and handle it according to regulations; if there are unusual situations, immediately report to the Head of the Examination Venue for resolution;
k) Fifteen minutes before the end of the examination time (for independent examinations and each component subject in combined examinations), supervisors notify candidates of the remaining time;
l) Upon the signal to end the examination, the first supervisor must immediately instruct candidates to stop answering questions and begin collecting examination papers, including those of candidates who have been recorded; the second supervisor maintains examination room order and discipline; the first supervisor calls each candidate's name to submit their examination papers while receiving them; when receiving examination papers, count the correct number of pages for each candidate's paper, require candidates to correctly record the number of pages submitted and sign on two Examination Paper Collection Forms; only after all examination papers have been collected can candidates leave the examination room;
m) Supervisors check and arrange candidates' examination papers in ascending order of registration numbers in the examination room and place them in the examination paper bag; the first supervisor directly carries the examination paper bag, two Examination Paper Collection Forms, disciplinary action records, and accompanying evidence (if any) together with the second supervisor to hand over to the venue secretary immediately after each session; upon handover, publicly count and compare the number of papers and pages of each examination paper, Examination Paper Collection Forms, and disciplinary action records along with accompanying evidence (if any).
n) After the counting is completed, each examination room's examination papers and 01 (one) Examination Paper Collection Form are placed into the examination paper bag of that examination room; they are sealed on-site by the Examination Room Secretary together with two Invigilators; the seal label is affixed to the center of all edges of the examination paper bag; the Examination Room Chief and the Examination Room Secretary directly count, sign, and clearly write their full names on the seal label; the two Invigilators cross-sign between the seal label and the examination paper bag, then stamp the cross-seal on the seal label; subsequently, transparent tape is wrapped around the length of the edges of the examination paper bag and covers the seal label; the Examination Room Secretary and the two Invigilators clearly write their full names and sign on the handover record; the remaining Examination Paper Collection Form of the examination room is left outside and submitted together with the examination paper bag and the sealed invigilation file.
3. When invigilating multiple-choice examinations, in addition to the responsibilities stipulated in Clauses 1 and 2 of this Article, the Invigilator shall perform the following tasks:
a) Receive the Multiple Choice Answer Sheet, sign on the Multiple Choice Answer Sheet;
b) Distribute the Multiple Choice Answer Sheet and guide candidates to fill in all required information on the Multiple Choice Answer Sheet;
c) Distribute the examination questions to candidates; each candidate in the same examination room has a unique question code; for each combined examination in Science and Social Studies, all component subjects have the same question code; when distributing the examination questions, require candidates to check the accuracy of the question code, place the examination questions under the Multiple Choice Answer Sheet, and not view the content of the examination questions; once the last candidate has received the examination questions, allow them to flip over the examination questions and write or mark the question code on the Multiple Choice Answer Sheet, and record the question code on both Examination Paper Collection Forms;
d) For combined examinations, candidates complete the examination on the same Multiple Choice Answer Sheet; examination questions for each component subject of the combined examination are distributed sequentially according to the scheduled time for each component subject; immediately upon the end of the examination time for any component subject, collect the examination questions and rough work from candidates who took that component subject, and simultaneously distribute the examination questions for the next component subject according to the predetermined schedule;
đ) Do not collect examination questions and rough work from candidates taking independent examinations and component subjects Biology and Civic Education in combined examinations;
e) Do not collect the Multiple Choice Answer Sheet before the end of the examination time; when collecting the Multiple Choice Answer Sheet, check the recording and marking of the question code on the Multiple Choice Answer Sheet of the candidates (the recorded and marked question code on the Multiple Choice Answer Sheet and recorded on the Examination Paper Collection Form must match the question code on the examination question sheet of the candidate);
g) Hand over to the Examination Room Leader (or a person authorized by the Examination Room Leader) the examination paper bag containing all Multiple Choice Answer Sheets arranged in ascending order of registration number and 01 (one) Examination Paper Collection Form filled in with the question code and signed by all candidates; the remaining Examination Paper Collection Form of the examination room is left outside and submitted together with the examination paper bag and the sealed invigilation file.
4. The examination room supervisor is responsible to the Examination Room Chief and performs the following tasks:
a) Supervise the performance of duties by the Invigilator, other members in the assigned area;
b) Supervise candidates allowed by the Invigilator to leave the examination room; promptly remind the Invigilator, security personnel, police, medical staff if they violate the Examination Regulations and prepare a report if necessary;
c) Recommend the Examination Room Chief to suspend the performance of duties or replace the Invigilator, security personnel, police, medical staff if there is a violation;
d) Require the Invigilator to prepare a report on candidates violating the Examination Regulations (if any); cooperate with examination inspection teams in inspecting and handling violations.
5. Security personnel, police, military control officers are responsible to the Examination Room Chief and perform the following tasks:
a) Maintain order and security in the assigned area; do not enter other areas;
b) Do not allow anyone without responsibility to enter the area they are responsible for; do not leave their post, do not engage in personal matters while on duty, do not enter the examination room, and do not communicate with candidates;
c) Report to the Examination Room Chief about situations occurring during the examination period for prompt handling;
d) Specifically, police officers assigned to support the Examination Board also have the task of escorting and ensuring the safety of examination questions and examination papers.
6. Medical staff are responsible to the Examination Room Chief and perform the following tasks:
a) Be present throughout the examination period at the location designated by the Examination Board to handle cases of candidates falling ill;
b) When the Examination Room Chief reports an unusual case of a candidate falling ill during the examination period, provide timely treatment or send to the hospital for emergency care if necessary (with an examination room supervisor performing duties at the examination site and a police officer accompanying); do not take advantage of on-site medical treatment to commit acts that violate the Examination Regulations.
Article 23. Transporting and Handing Over Exams
1. The transport and handover of candidates' exams from Examination Centers to the Examination Board shall be regulated by the Chairman of the Examination Board; the process must involve leaders of Examination Centers and police throughout the entire transportation and handover period; when handing over the exams, sealing checks and creating records with signatures of all participants involved in the handover must be conducted.
2. The Chairman of the Examination Board must implement security measures for the exams as stipulated in Clause 3, Article 18 of this Regulation; there must be police and the Secretary or Deputy Secretary of the Examination Board's Secretariat on duty continuously 24 hours a day to guard the storage room for exam preservation.
Chapter VI
MARKING EXAMS
Article 24. Marking Area
1. Marking at each Examination Board shall take place in no more than two (2) areas; each Marking Committee shall perform its duties in one area only. The marking area must ensure security and safety, have sufficient fire prevention and firefighting equipment, and be continuously guarded by police 24 hours a day; the marking location, checking location for subjective essay exams, and the storage location for subjective essay exams should be arranged close together; multiple-choice exams shall be stored in the processing and marking room for multiple-choice exams or in a separate storage room, depending on the actual conditions of the unit.
2. Exam storage rooms, cabinets, boxes, or other containers holding exam bags must be secure and sturdy, locked and sealed; the seal must bear signatures of the key holder, inspector, and police. Keys to exam storage rooms shall be held by leaders of the Marking Committees; keys to cabinets, boxes, or other containers holding subjective essay exam bags shall be held by the Secretariat member assigned to the Subjective Essay Marking Committee; keys to cabinets, boxes, or other containers holding multiple-choice exam bags shall be held by the Head of the Secretariat Team of the Multiple-Choice Marking Committee. Exam storage rooms, multiple-choice exam marking rooms, subjective essay exam marking rooms, and locations where the Secretariat and Secretariat Teams perform their tasks in the marking area must have fire prevention and explosion protection devices; they must be monitored by security cameras recording activities continuously 24 hours a day; they must be guarded and supervised continuously 24 hours a day by police. When opening and closing exam storage rooms, marking rooms, and cabinets, boxes, or other containers holding exam bags, police, inspectors, and detailed logs must witness these actions.
3. Absolutely no information transmission devices, document copying tools, personal papers, erasers, pencils, or pens not within the regulations of the Marking Committees shall be brought into or out of the marking area.
Article 25. The Committee for Making Exam Codes for Subjective Essays
1. The Committee for Making Exam Codes:
a) Composition: The Chairperson shall be concurrently held by a leader or member of the Examination Board; the Deputy Chairperson shall be a leader of a department under the Department of Education and Training or a leader of a general education school; Members shall be civil servants, staff members of departments under the Department of Education and Training, leaders, teachers of general education schools, security guards, police, health workers, and service personnel.
b) Duties and powers of the Committee for Making Exam Codes: Receive subjective essay exams enclosed in sealed bags from Examination Centers through the Secretariat of the Examination Board; code and keep confidential the exam codes for subjective essays; seal and securely store the exam code stubs throughout the marking period until the completion of subjective essay exam marking; hand over coded subjective essay exams enclosed in sealed bags from the Committee for Making Exam Codes to the Secretariat of the Examination Board; hand over sealed bags containing exam code stubs from the Committee for Making Exam Codes to the Secretariat of the Examination Board after the completion of subjective essay exam marking. The coding process for review of subjective essay exams shall be carried out by the Committee for Making Exam Codes in the same manner as the coding process for subjective essay exams for marking.
c) The Committee for Making Exam Codes operates independently from other committees of the Examination Board, directly under the direction of the Chairman of the Examination Board; it can only proceed with work related to exams when at least two (2) members of the Committee for Making Exam Codes are present; members of the Committee for Making Exam Codes shall not participate as members of the Subjective Essay Marking Committee or the Review Committee for Subjective Essay Exams.
d) The Chairperson of the Committee for Making Exam Codes decides on the organization and implementation of duties and powers, and is responsible for the results of the Committee for Making Exam Codes' performance according to this Regulation before the Chairman of the Examination Board.
e) Deputy Chairpersons and members of the Committee for Making Exam Codes are responsible for the results of their duties and powers as assigned or delegated by the Chairperson of the Committee for Making Exam Codes.
2. The coding area must ensure security and safety, have sufficient fire prevention and firefighting equipment, and be continuously guarded by police 24 hours a day; it must not have information transmission or image capture devices; participants in the coding process may not bring information transmission devices into the coding area.
3. Coding Method: The Chairman of the Examination Board decides on the coding method; exam codes are randomly generated by computer software to ensure that each exam (registration number) corresponds uniquely to one (1) code. The coding process can only be carried out in a segregated area under the supervision of inspectors.
a) One (1) round coding: The Committee for Making Exam Codes must be completely isolated during the entire time dedicated to coding until the completion of subjective essay exam marking; the Chairperson of the Committee for Making Exam Codes directly performs the coding using the Ministry of Education and Training's Exam Marking Support Software.
b) Two (2) independent rounds of coding: The Committee for Making Exam Codes must be completely isolated during the entire time dedicated to coding for each round; coding staff are divided into two teams: the First Round Coding Team and the Second Round Coding Team; the teams work independently and are completely isolated from each other. The First Round Coding Team may only leave the isolated area after the Second Round Coding Team has been isolated. The Second Round Coding Team must remain completely isolated during the entire time dedicated to coding until the completion of subjective essay exam marking. The Heads of the First Round Coding Team and the Second Round Coding Team directly perform the coding using the Ministry of Education and Training's Exam Marking Support Software.
4. Handing Over Coded Subjective Essay Exams to the Examination Board:
a) After completing the coding, the Chairperson of the Committee for Making Exam Codes hands over the coded exams to the Chairperson of the Secretariat of the Examination Board; the Chairman of the Examination Board decides whether to hand over the exams in one go or according to the marking progress.
b) The tip of the test booklet is kept by the Examination Paper Management Board and only handed over to the Head of the Examination Committee's Secretariat after the subjective test papers have been graded.
Article 26. Subjective Test Grading Board
1. Composition:
a) The Head of the Subjective Test Grading Board shall be concurrently held by the leadership of the Examination Committee; the Deputy Heads of the Subjective Test Grading Board are the leaders of departments under the Department of Education and Training and general secondary schools, among which, the permanent Deputy Head is the leader of the Examination Management Department or the Secondary Education Department of the Department of Education and Training;
b) A Deputy Head with expertise corresponding to the subjective test paper assigned shall concurrently serve as the Head of the Grading Discipline;
c) The Subjective Test Grading Board shall have at least two Grading Teams under the management and direction of the Head of the Grading Discipline; each Grading Team shall have a Team Leader and grading officers (GOs) who are civil servants, officials, or teachers currently teaching the relevant subject; members of the Secretariat Board and the Examination Paper Management Board of the Examination Committee shall not participate in grading;
d) Police, security guards, medical staff, and service personnel.
2. The Head of the Subjective Test Grading Board shall direct the grading work and be responsible to the Chairman of the Examination Committee for the process, progress, and quality of the subjective test grading; has the authority to change or suspend the grading work of members who are negligent, violate the Examination Regulations, or make numerous errors in their assigned tasks; is responsible for checking and verifying when irregularities occur.
3. The Deputy Head of the Subjective Test Grading Board shall be responsible for the results of the implementation of their duties and powers as assigned or delegated by the Head of the Subjective Test Grading Board.
4. The Head of the Grading Discipline shall be responsible to the Chairman of the Examination Committee and the Head of the Subjective Test Grading Board for managing and organizing the grading of subjective test papers according to the Examination Regulations; shall perform the following tasks:
a) Develop a grading plan, organize the handover of test papers, and assign grading officers;
b) Before grading, organize discussions for grading officers to understand the marking guidelines, answers, and scoring scales; during the grading process, regularly organize exchanges and learn from experiences;
c) Propose to the Head of the Subjective Test Grading Board to change or suspend the grading work of grading officers who are negligent, make numerous errors, or violate the Examination Regulations;
d) After completing the grading, organize a meeting of grading officers to summarize and learn from experiences.
5. The Team Leader of the Grading Team assists the Head of the Grading Discipline in managing and organizing the grading within each Grading Team and performs tasks within the authority of the Head of the Grading Discipline as assigned by the Head of the Grading Discipline.
6. Members of the Subjective Test Grading Board shall comply with the assignments of the Head, strictly adhere to the provisions of the Examination Regulations; grading officers shall follow the direct management of the Team Leader of the Grading Team and the instructions of the Head of the Grading Discipline.
Article 27. Grading of Subjective Test Papers
1. General Provisions on Grading of Subjective Test Papers:
a) Grade according to the marking guidelines, answers, and scoring scales provided by the Ministry of Education and Training; each test paper is scored out of 10 points; decimal points of the total score of the entire paper are rounded to two decimal places; each test paper is independently graded by two grading officers from different Grading Teams;
b) The Secretariat of the Examination Committee hands over the sealed test papers and marking sheets to the Head of the Grading Discipline;
c) The Head of the Grading Discipline gathers all Team Leaders and grading officers to familiarize them with the Examination Regulations, discuss the marking guidelines, and grade at least ten subjective test papers collectively to gain experience and unify the application of marking guidelines; thereafter, organize independent double-round grading in separate grading rooms;
d) The distribution of test papers to grading officers is conducted through a lottery system using ballots.
2. Process of the First Round of Grading:
a) The Head of the Grading Discipline organizes a lottery for the entire sealed test papers and distributes them individually to grading officers;
b) Prior to grading, grading officers check each test paper to ensure it contains the correct number of pages and test booklet numbers, and cross out all unused blank spaces left by candidates; do not grade test papers done on other types of paper than those designated for the examination;
c) In case of discovering that a test paper lacks the required number of pages or test booklet numbers, is done on scratch paper, is done on paper other than the designated examination paper, is written by more than one person, written in different ink colors including red ink, pencil, or contains unrelated drawings or writings, or is crumpled or suspected of being marked, grading officers must report and hand over these test papers to the Team Leader of the Grading Team for further handling by the Head of the Grading Discipline;
d) During the first round of grading, apart from crossing out unused blank spaces on the candidate's answer sheet, grading officers must not write anything else on the test paper or the sealed test papers; partial scores, total scores, and comments (if any) are recorded on the marking sheet of each test paper; the marking sheet must clearly state the name, signature of the grading officer, and once a sealed test paper is completed, it should be handed over to the Team Leader of the Grading Team for the Head of the Grading Discipline to hand over to the Secretariat of the Examination Committee.
3. Process of the Second Round of Grading:
a) After the first round of grading, members of the Secretariat of the Examination Committee remove the marking sheets and hand over the sealed test papers to the Head of the Grading Discipline to organize a lottery for the second round of grading, ensuring that the sealed test papers are not returned to the same grading officer who graded them in the first round;
b) The grading officer in the second round grades directly on the candidate's answer sheet and records the scores on the marking sheet; individual item scores must be recorded at the margin of the answer sheet next to the graded item; then, record the partial scores and total scores in the designated boxes, sign clearly with their full name in all designated boxes on the answer sheets;
c) Once a sealed test paper is completed, the grading officer hands over the graded test paper and marking sheet to the Team Leader of the Grading Team for the Head of the Grading Discipline to hand over to the Secretariat of the Examination Committee.
4. Handling Grading Results and Preparing Grading Records
Members of the Secretariat of the Examination Committee, the Head of the Grading Discipline, the Team Leader of the Grading Team, and grading officers compare the grading results and handle them as follows:

a) The Score Entry Team belongs to the Secretariat of the Examination Board, the Team Leader is concurrently held by a leader or member of the Secretariat of the Examination Board; the Score Entry Team consists of at least two groups, each group consisting of at least three people;
b) The Score Entry Team performs the entry of essay exam scores through two independent rounds, ensuring that each round is carried out by a different group using the Exam Grading Support software under the supervision of the inspector.
Article 28. Examination Grading Committee for Multiple Choice Exams
1. Composition of the Examination Grading Committee for Multiple Choice Exams:
a) The Head of the Examination Grading Committee for Multiple Choice Exams is concurrently held by a leader of the Examination Board;
b) Deputy Head of the Examination Grading Committee for Multiple Choice Exams is a leader of departments under the Department of Education and Training and leaders of general education schools;
c) The Grading Team, including: The Leader of the Grading Team is concurrently held by a leader of the Examination Grading Committee for Multiple Choice Exams; other members are civil servants, staff, and teachers from the Department of Education and Training and general education schools;
d) The Secretariat Grading Team, including: The Leader is concurrently held by a Deputy Head; other members are civil servants, staff, and teachers from the Department of Education and Training and general education schools;
đ) The Supervision Grading Team, including: The Leader is concurrently held by a Deputy Head; other members are civil servants, staff, and teachers from the Department of Education and Training and general education schools;
e) Police, security, health, and service personnel.
2. The Head of the Examination Grading Committee for Multiple Choice Exams directs the multiple choice exam grading process and is responsible to the Chairman of the Examination Board for the procedure, progress, and quality of the multiple choice exam grading; has the authority to change or suspend the grading work of members who are irresponsible, make many mistakes in performing assigned tasks, or violate regulations; has the responsibility to check and verify when irregularities occur according to the request of the Supervision Team.
3. The Deputy Head of the Examination Grading Committee for Multiple Choice Exams carries out tasks assigned by the Head of the Examination Grading Committee for Multiple Choice Exams.
4. The Grading Team studies carefully the instructions for use and uses the multiple choice exam grading software provided by the Ministry of Education and Training to perform processing and grading of multiple choice exams.
5. The Secretariat assists the Head of the Examination Grading Committee for Multiple Choice Exams in preparing documents, materials, forms, and minutes to serve the multiple choice exam grading process; receives and delivers exam papers from the Examination Board; opens and seals bags containing exam papers; preserves exam papers during storage time in the multiple choice exam grading room.
6. The Supervision Team works independently from other teams of the Examination Grading Committee for Multiple Choice Exams. The Supervision Team is responsible for closely monitoring the grading process of multiple choice exams and the storage process of exam papers in the multiple choice exam grading room according to the Examination Regulations. During the execution of tasks, if any irregularities are found, the Supervision Team must report to the Head of the Examination Grading Committee for Multiple Choice Exams to temporarily halt the grading process, requesting the Head of the Examination Grading Committee for Multiple Choice Exams to check, verify, and handle before continuing.
7. Members of the Examination Grading Committee for Multiple Choice Exams comply with the assignments of the Head, and strictly follow the provisions of the Examination Regulations.
Article 29. Grading Multiple Choice Exams
1. General Provisions on Grading Multiple Choice Exams:
a) Members of the Multiple Choice Exam Grading Committee, those performing related duties shall not bring pencils, erasers, and other prohibited items into the grading room according to the Examination Regulations; they shall not modify or alter the Multiple Choice Exam Answer Sheet of candidates in any form or for any reason;
b) Members of the Multiple Choice Exam Grading Team must strictly adhere to the grading procedures as prescribed; if any irregularities are discovered during the process, they must immediately report to the Head of the Multiple Choice Exam Grading Team for the Supervision Team to jointly prepare a record and report to the Head of the Multiple Choice Exam Grading Committee for handling;
c) All Multiple Choice Exam Answer Sheets (candidates' answers) must be graded using a dedicated software provided by the Ministry of Education and Training from the time of scanning until the results are obtained as individual exam scores;
d) Uniformly use the exam code in data files as stipulated by the Ministry of Education and Training;
đ) During the processing and scoring, the Multiple Choice Exam Grading Committee must strictly update and promptly report to the Ministry of Education and Training as required;
2. Handling Multiple Choice Exams:
a) Scanning answer sheets: Scan answer sheets by envelope, check envelopes on the software, seal each envelope upon completion. Immediately after scanning all envelopes/answer sheets of the Exam Board, all scanned image data automatically encrypted by the grading software must be backed up onto two identical CDs;
b) Recognizing scanned images: Immediately after recognizing all scanned images of the Exam Board's multiple choice exams, all recognized image data automatically encrypted by the grading software must be backed up onto two identical CDs;
c) Fixing technical errors: Immediately after fixing all technical errors of the Exam Board's multiple choice exams, all fixed error data automatically encrypted by the grading software must be backed up onto two identical CDs;
d) At each step in points a, b, c of this clause, both sets of identical CDs at each step must be sealed under the supervision of the Supervision Team, police, and a record prepared; only when one set of CDs is sent to the Ministry of Education and Training (through the Quality Control Department) for management and one set is handed over to the Chairman of the Exam Board for storage with permission from the Chairman of the Exam Board may the next step proceed. A report must be made to the National Steering Committee for approval to use these CDs.
3. Scoring: After completing the tasks specified in Clause 2 of this Article, the Multiple Choice Exam Grading Team opens the CD containing the Ministry of Education and Training's exam grading data, prepares a record of opening the seal and loading the grading data into the Multiple Choice Exam Grading Software under the supervision of the police and the Supervision Team; proceeds to score, rounding off to two decimal places for each exam and each component subject of the combined exam; uniformly use the exam code and subject code in data files as stipulated by the Ministry of Education and Training; during processing, the Exam Board must strictly update and promptly report to the Ministry of Education and Training (through the Quality Control Department).
4. Immediately after completing the grading of all multiple choice exams of the Exam Board, processed data files and official exam grading results (exported from the software, ensuring structure and requirements as prescribed by the Ministry of Education and Training) are stored on two identical CDs, sealed under the supervision of the Supervision Team, police, and a record prepared; one CD is sent to the Ministry of Education and Training (through the Quality Control Department) for management; one CD is handed over to the Chairman of the Exam Board for updating results into the examination management software database and storage.
5. The organization of grading multiple choice exams must be carried out in accordance with the requirements and procedures stipulated in this Article. Any issues arising during the grading of multiple choice exams must be recorded, described, and reported by the Multiple Choice Exam Grading Committee to the Provincial Steering Committee and the National Steering Committee for timely and appropriate decisions.
Article 30. Examination of Essay Exams
1. The Head of the Essay Exam Marking Board shall establish an Examination Checking Team consisting of a Team Leader to be concurrently held by the Deputy Head of the Essay Exam Marking Board and marking officials who will conduct examination checking. Marking officials conducting examination checking shall not simultaneously perform other duties within the Essay Exam Marking Board and the Examination Secretariat Board.
2. Duties and authorities of the Examination Checking Team:
a) Conduct examination checking on at least 5% of the number of essay exams that have been marked by marking officials for the first or second marking round according to the marking schedule and the instructions of the Head of the Essay Exam Marking Board; each exam checked shall be marked by one marking official following the procedures specified in Clause 2, Article 27 of this Regulation;
b) At the end of each marking session or when deemed necessary, the Team Leader of the Examination Checking Team shall compile and report the results of the examination checking and recommendations to the Head of the Essay Exam Marking Board to apply appropriate measures to ensure fair, impartial, and rigorous marking;
c) The Examination Checking Team shall only directly work with the essay marking teams and relevant marking officials (must record the working minutes) upon request of the Head of the Essay Exam Marking Board.
3. The Head of the Essay Exam Marking Board shall decide whether to organize dialogues between markers and checkers or not.
Article 31. Management of Exam Scores
1. After completing the marking of all subjects, the Chairman of the Examination Board shall review the examination results, report, and submit all examination result data to the Ministry of Education and Training (through the Quality Assurance Department) for storage and comparison. Examination result data must be stored on two identical CDs, sealed and recorded in a sealing protocol under the supervision of inspectors and police; one CD is kept by the Chairman of the Examination Board for storage, one CD is handed over to the Ministry of Education and Training (through the Quality Assurance Department).
2. To ensure the accuracy of examination result data, the Ministry of Education and Training shall use the CD containing examination results sent by the Examination Boards to update into the system; the Examination Boards shall use the CD stored at the Examination Board to update into the QLT software, compare with the data on the system; after all Examination Boards complete the data comparison and prepare all necessary conditions, the examination results shall be announced according to regulations.
3. After reviewing the examination results and submitting examination data to the Ministry of Education and Training, the Chairman of the Examination Board shall direct the Examination Board Secretariat to print the Examination Result Certificate for candidates (according to a unified model prescribed by the Ministry of Education and Training); sign, stamp, and send it to general education schools where candidates registered for the examination. Each candidate shall be issued one Examination Result Certificate with a unique identification code.
4. All documents related to examination scores must be sealed and preserved according to regulations organized by the Chairman of the Examination Board.
Chapter VII
APPEAL AND REEXAMINATION
Article 32. Appeal Board
1. The composition of the Essay Exam Appeal Board is similar to the composition of the Essay Exam Marking Board stipulated in Clause 1, Article 26 of this Regulation; the composition of the Multiple Choice Exam Appeal Board is similar to the composition of the Multiple Choice Exam Marking Board stipulated in Clause 1, Article 28 of this Regulation. Individuals who have participated in the Shuffling Board and the Essay Exam Marking Board shall not participate in the Essay Exam Appeal Board; individuals who have participated in the Multiple Choice Exam Marking Board shall not participate in the Multiple Choice Exam Appeal Board.
2. Duties of the Appeal Boards:
a) Essay Exam Appeal Board: Check errors such as incorrect point addition, wrong point recording; re-mark examinations upon candidates' requests;
b) Multiple Choice Exam Appeal Board: Recheck errors in the process of handling multiple choice exams; check and review technical errors; re-mark examinations upon candidates' requests;
c) Report to the Chairman of the Examination Board to decide on the examination scores after re-examination.
3. The location for organizing appeals shall be arranged in areas ensuring conditions as stipulated in Article 24 of this Regulation.
Article 33. Rechecking Examination Papers
1. All candidates have the right to request rechecking of their examination papers; candidates submit rechecking applications at the registration location.
2. The location where candidates registered for the examination shall accept rechecking applications from candidates within ten days from the date of announcement of examination results and transfer data of candidates who have submitted rechecking applications to the Examination Board. Within fifteen days from the deadline for accepting rechecking applications, the Examination Board must announce and notify the rechecking results to the candidates.
3. Prior to transferring examination papers to the Rechecking Committees, the Secretariat of the Examination Board shall perform the following tasks:
a) Search for the examination paper number from the candidate's registration number to find the examination paper number or the Multiple Choice Test Answer Sheet of candidates who have submitted rechecking applications; retrieve the examination papers and compare with the Examination Paper Collection Form to check.
b) Collect examination papers requiring rechecking according to each subject into one or more bags, clearly marking the examination paper number and the number of examination sheets in each bag.
c) For subjective examination papers: Transfer the examination papers of candidates who have submitted rechecking applications to the Marking Committee for renumbering; receive the renumbered examination papers from the Marking Committee and hand them over to the Subjective Examination Paper Rechecking Committee for rechecking.
d) The handover of examination papers between the Secretariat of the Examination Board and the Subjective Examination Paper Rechecking Committee shall be carried out in accordance with the provisions of Article 27 of this Regulation; when handing over multiple choice test papers, the corresponding Examination Paper Collection Form must also be handed over.
4. Rechecking of subjective examination papers: Each subjective examination paper shall be rechecked by two examiners in accordance with the provisions of Article 27 of this Regulation and must be marked using ink of a different color from that used previously on the candidate's answer sheet. During the process related to rechecking, there must be at least two members of the Subjective Examination Paper Rechecking Committee and it must be supervised by an inspector. The rechecking results of subjective examination papers shall be handled by the Secretariat of the Examination Board as follows:
a) If the rechecking marks of the two examiners are identical, then take those marks as the rechecking score and have the two examiners sign to confirm.
b) If the rechecking marks of the two examiners differ, retrieve the examination paper and organize for the third examiner to directly recheck the candidate's answer sheet using ink of a different color under the direction of the Head of the Subjective Examination Paper Rechecking Committee.
c) If the marks of two out of three examiners are identical, take those marks as the rechecking score. If all three examiners' marks differ, the Head of the Subjective Examination Paper Rechecking Committee shall calculate the average of the three marks rounded to two decimal places as the rechecking score and sign to confirm.
d) Examination papers with a rechecking score differing from the initial mark (announced) by 0.25 points or more shall be adjusted. In cases where the rechecking score differs from the initial mark by 0.5 points or more, a direct dialogue must be organized between the first round examiners and the rechecking examiners (with minutes recorded). If any negative behavior is observed, report to the Head of the Subjective Examination Paper Rechecking Committee for handling according to regulations.
5. Rechecking of multiple choice examination papers:
a) When all assigned members for rechecking multiple choice examination papers are present, proceed to open the sealed bags containing the examination papers; Examination Boards with a large number of rechecking papers may divide them into groups to carry out the rechecking. The rechecking must ensure the principle of completing the rechecking of one bag before sealing it and opening another.
b) Compare each marked answer on the Multiple Choice Test Answer Sheet with the scanned image stored in the computer; if discrepancies exist, determine the cause; print the marking results from the marking software both before and after correcting errors for record keeping.
c) The rechecking data shall be exported from the software, recorded on two identical CDs, sealed under the supervision of the Supervisory Team, police, and documented with signatures of the Head of the Multiple Choice Examination Paper Rechecking Committee; one CD shall be sent to the Ministry of Education and Training (through the Quality Control Department) for management; one CD shall be handed over to the Chairman of the Examination Board to update the results into the examination management system database and store.
d) Upon completion of the rechecking, the Multiple Choice Examination Paper Rechecking Committee shall prepare a summary report, signed by the Head and all members, and the Supervisory Team.
đ) The Supervisory Team must directly, continuously supervise all stages of the multiple choice examination paper rechecking process.
6. Scores of examination papers adjusted after rechecking shall be reported by the Heads of the Multiple Choice Examination Paper Rechecking Committees to the Chairman of the Examination Board for decision. The Chairman of the Examination Board shall update the scores of candidates after rechecking into the examination management system software in accordance with the regulations of the Ministry of Education and Training; report and send data to the Ministry of Education and Training (through the Quality Control Department).
7. The Examination Board shall print the Certificate of Examination Results after rechecking and issue it to candidates whose examination papers have been adjusted; simultaneously, recover and cancel the Certificate of Examination Results before rechecking.
Article 34. Establishment of the Review Board
1. In cases where necessary, the Minister of Education and Training shall decide to establish a Review Board to review the entire or part of the examination papers or the results of re-examination conducted by one or more Examination Boards.
2. The Review Board of the Ministry of Education and Training: The Chairman is the leader of the Quality Assurance Department; the Vice-Chairman is the leader of the Quality Assurance Department or other units under the Ministry of Education and Training; members and secretaries are leaders, specialists from units under the Ministry of Education and Training, and some members are civil servants, officials, teachers, lecturers with high professional qualifications.
3. Members of the Review Board shall not review examination papers that they have already graded at the Written Exam Grading Committee and the Re-examination Committee for Written Exams.
4. The Review Board of the Ministry of Education and Training has the final authority to determine the official score of the examination papers.
5. The Chairman of the Review Board decides whether to organize dialogue between the first graders, re-examiners, and reviewers.
6. The Review Board of the Ministry of Education and Training uses the seal of the Quality Assurance Department.
Chapter VIII
CONSIDERATION OF HIGH SCHOOL GRADUATION AND ISSUANCE OF CERTIFICATE OF COMPLETION OF GENERAL EDUCATION PROGRAM
Article 35. Exemption from Foreign Language Exam in High School Graduation Consideration
1. Exempted candidates:
a) Members of the national team participating in international Olympic competitions in foreign languages according to the Decision of the Minister of Education and Training;
b) Holders of one of the certificates specified in the annual guidelines for organizing the high school graduation exam issued by the Ministry of Education and Training.
2. Candidates exempted from the Foreign Language Exam will be credited with 10 points for this exam when considering their high school graduation.
3. Candidates who do not register to use the exemption right for the Foreign Language Exam must participate in the exam and be considered for high school graduation like those who are not exempted.
Article 36. Exemption from All Subjects of the High School Graduation Exam
1. Individuals summoned to participate in the national selection competition for international or regional Olympic competitions in cultural subjects are exempted from all subjects of the high school graduation exam if they meet the following conditions:
a) Summoned to study in the second semester of grade 12;
b) Ranked as excellent in conduct and good or better in academic performance throughout grade 12;
c) Listed on the exemption list of the Ministry of Education and Training.
2. Individuals in teams participating in international or regional Olympic competitions in science and technology, culture and arts are exempted from all subjects of the high school graduation exam if they meet the following conditions:
a) Summoned to study in the second semester of grade 12;
b) Ranked as satisfactory or better in conduct and academic performance throughout grade 12;
c) Listed in the letter requesting exemption and confirming participation in training and competition in accordance with regulations sent by the selection agency to the provincial education department before the high school graduation exam date.
3. Severely disabled individuals and severely disabled individuals as defined in Clause 1 and Clause 2 of Article 3 of Decree No. 28/2012/NĐ-CP dated April 10, 2012 of the Government; individuals affected by Agent Orange with reduced work capacity of 61% or more; children of individuals affected by Agent Orange whose own work capacity is reduced by 61% or more, must meet the following conditions:
a) For individuals with disabilities studying under the general education program: Completing the high school curriculum; meeting the examination requirements stipulated in Clause 2 of Article 12 of this Regulation; having a disability certificate issued by the competent authority;
b) For individuals with disabilities unable to follow the general education program: Having the principal of the secondary school where they are registered confirm the implementation of the individual education plan each year during high school; having a disability certificate issued by the competent authority;
c) For individuals engaged in resistance activities and children of individuals affected by Agent Orange: Completing the high school curriculum; meeting the examination requirements stipulated in Clause 2 of Article 12 of this Regulation; having a certificate of Agent Orange exposure and reduced work capacity of 61% or more issued by the competent authority.
Article 37. Special Graduation from High School
1. Students belonging to the categories specified in Article 12 of this Regulation, if meeting the examination conditions, shall be considered for special graduation from high school in cases where they suffer accidents, illness, or extraordinary emergencies before the exam date not exceeding 10 days or during the first exam session, making it impossible for them to take the exam.
a) Conditions: Both academic performance and conduct evaluations for the entire year in grade 12 must be at least good.
b) Documents include: Hospital admission and discharge records issued by hospitals at district level or higher (if injured or ill) or confirmation from the People's Committee of the commune where the student resides (if there is an extraordinary emergency); a record proposing special graduation from high school by the general education school where the student registered for the exam, and evidence of academic performance and conduct evaluations in grade 12.
2. Students belonging to the categories specified in Article 12 of this Regulation, if meeting the examination conditions, shall be considered for special graduation from high school in cases where they suffer accidents, illness, or extraordinary emergencies after taking at least one exam and are unable to continue with the remaining exams, or after voluntarily taking the remaining exams despite suffering accidents, illness, or extraordinary emergencies.
a) Conditions: The scores of all taken exams for recognizing graduation from high school must be at least 5.0 points; academic performance in grade 12 must be at least average, and conduct evaluations must be at least good.
b) Documents include: The candidate's application for special consideration; hospital admission and discharge records from hospitals at district level or higher (if injured or ill) or confirmation from the People's Committee of the commune where the student resides (if there is an extraordinary emergency), and evidence of academic performance and conduct evaluations in grade 12.
3. Athletes who meet the conditions shall be considered for special graduation from high school according to the provisions of Article 5 of Decree No. 36/2019/NĐ-CP dated April 29, 2019 of the Government.
4. Procedures:
a) Within the latest seven days after the last exam session of the exam period, candidates must submit their special consideration documents to the head of the unit where they registered for the exam. The head of the unit where the candidate registered for the exam is responsible for receiving and transferring the special consideration documents to the Department of Education and Training.
b) The Board for Recognizing Graduation from High School will consider and decide on special consideration for candidates based on the documents and the provisions of Clause 1 and 2 of this Article.
Article 38. Retention of Exam Scores
1. Exam scores will be retained as follows: Candidates who have participated in all required subjects/exams in the previous exam period but have not graduated from high school and have not been disciplined with cancellation of exam results may retain scores of subjects or components of combined subjects that achieved at least 5.0 points in the immediately following exam period for recognition of graduation from high school.
2. Candidates who do not use retained scores must take all registered subjects/exams for recognition of graduation from high school as if they had no retained scores.
Article 39. Preferential Points
1. Recognition of graduation from high school is calculated across three categories including Category 1, Category 2, and Category 3; among which, candidates in Category 1 are ordinary candidates without preferential points added; candidates in Category 2 and Category 3 are eligible for preferential points.
2. Category 2: Add 0.25 points for candidates belonging to one of the following groups:
a) War invalids, disabled veterans, persons enjoying benefits equivalent to war invalids with reduced work capacity below 81 percent (for General Education for Adults);
b) Children of war invalids, disabled veterans, persons enjoying benefits equivalent to war invalids with reduced work capacity below 81 percent; National Hero of Armed Forces, National Labor Hero; children of Mothers of Vietnam Martyrs; children of National Heroes of Armed Forces, National Labor Heroes;
c) Ethnic minority people;
d) Vietnamese citizens, foreigners residing in Vietnam with permanent residence registration for at least three years (as of the exam date) in extremely difficult communes, border communes, safe area communes under Program 135 investment; in extremely difficult coastal and island communes according to current regulations of the Prime Minister; in areas I, II, III of ethnic regions and mountainous areas according to current regulations of the Prime Minister, studying at general education schools not located in central districts of centrally governed cities for at least two-thirds of the time spent in high school;
đ) Persons affected by chemical toxins; children of persons affected by chemical toxins; children of persons participating in resistance activities affected by chemical toxins; persons recognized by competent authorities as having deformities, disabilities, or reduced self-care or work capacity due to the consequences of chemical toxins;
e) Age 35 or older as of the exam date (for General Education for Adults candidates).
3. Category 3: Add 0.5 points for candidates belonging to one of the following groups:
a) Ethnic minority people with permanent residence registration in extremely difficult communes, border communes, safe area communes under Program 135 investment; in extremely difficult coastal and island communes according to current regulations of the Prime Minister; in areas I, II, III of ethnic regions and mountainous areas according to current regulations of the Prime Minister, currently studying at boarding schools for ethnic minorities or general education schools not located in central districts of centrally governed cities;
b) War invalids, disabled veterans, persons enjoying benefits equivalent to war invalids with reduced work capacity of 81 percent or more (for General Education for Adults);
c) Children of martyrs; children of war invalids, disabled veterans, persons enjoying benefits equivalent to war invalids with reduced work capacity of 81 percent or more.
4. Candidates with multiple preferential criteria can only enjoy the highest preferential criterion.
5. Other preferential categories already defined in current laws and regulations will be reviewed and decided upon by the Minister of Education and Training.
Article 40. Encouragement Points
1. Students participating in competitions and activities below shall be awarded encouragement points for graduation assessment from high school:
a) Winning individual awards in the national selection examination for excellent students in Grade 12 cultural subjects: winning first, second, or third place in the national examination or first place at the provincial level will earn 2.0 points; receiving a consolation award in the national examination or second place at the provincial level will earn 1.5 points; winning third place at the provincial level will earn 1.0 point;
b) Winning individual and team awards in practical experimental examinations in Physics, Chemistry, Biology; arts and music contests; physical education and sports; defense education games; science and technology contests; international letter writing organized by the Education sector in collaboration with specialized sectors at the provincial level or higher for high school students. For individual awards: winning first, second, or third place nationally or first place provincially or a Gold Medal will earn 2.0 points; receiving a consolation award nationally or second place provincially or a Silver Medal will earn 1.5 points; earning a Bronze Medal will earn 1.0 point. For team awards: only national-level awards will be eligible for points; the number of players, athletes, or performers in team awards is specified by the Organizing Committee of each competition; the encouragement points awarded to individuals in team awards will be calculated according to the provisions for individual awards set out herein;
c) Students who win multiple awards in different competitions may only receive the highest point addition for their highest award;
2. High school students, vocational training learners subject to conduct evaluation, and vocational training learners studying both intermediate-level programs combined with cultural programs under the high school vocational training curriculum and holding a Vocational Certificate or Intermediate Diploma issued by the Department of Education and Training, educational institutions, and vocational training centers during their high school years shall be awarded encouragement points based on their conduct grades in the Vocational Certificate or Intermediate Diploma as follows:
a) Excellent grade for Vocational Certificates, Excellent and Good grades for Intermediate Diplomas will earn 2.0 points;
b) Good grade for Vocational Certificates, Good and Very Good grades for Intermediate Diplomas will earn 1.5 points;
c) Average grade will earn 1.0 point;
3. Vocational training learners holding foreign language or information technology certificates issued according to the regulations of the Ministry of Education and Training during their high school years will earn 1.0 point for each type of certificate;
4. If a candidate has multiple certificates eligible for encouragement points as stipulated in this Article, they can only receive up to a maximum of 4.0 additional points;
5. The encouragement points prescribed in Clauses 1, 2, and 3 of this Article shall be retained throughout the entire academic period and added to the examination scores for the graduation assessment of high school candidates.
Article 41. Graduation Assessment Points
1. Graduation Assessment Points (GAP): Comprising the scores of the examinations taken by candidates for graduation assessment from high school as prescribed in point a, Clause 3, Article 12 of this Regulation, preferential and encouragement points (if applicable), and the average score of Grade 12; the score of each examination is converted to a scale of 10 points to calculate the GAP.
a) The GAP for high school students is calculated using the following formula:

b) The GAP for vocational training learners is calculated using the following formula:

2. The GAP is rounded to two decimal places, automatically performed by computer software.
Article 42. Recognition of High School Graduation
1. Candidates who meet the examination conditions, are not subject to disciplinary action of result cancellation for all examination subjects and component subjects of the combined examination subject for graduation recognition, and have achieved a score of 1.0 or above on a scale of 10 for all examination subjects and component subjects, and have an average score of 5.0 points or higher will be recognized as having completed high school graduation.
2. Candidates who meet the examination conditions and are exempted from all examination subjects for high school graduation recognition according to the provisions of Article 36 of this Regulation will be recognized as having completed high school graduation.
Article 43. Examination Board for High School Graduation Recognition
1. The Director of the Department of Education and Training decides to establish the Examination Board for High School Graduation Recognition consisting of:
a) The Chairman of the Board is the leader of the Department of Education and Training;
b) The Vice Chairmen of the Board are the leaders of the Examination Management Office, the Secondary Education Office, and the General Education Office of the Department of Education and Training;
c) Members and secretaries are leaders and specialists of offices under the Department of Education and Training and leaders of general education schools.
2. The Examination Board for High School Graduation Recognition shall implement the recognition of high school graduation for candidates according to the provisions of this Chapter.
Article 44. Approval of High School Graduation Recognition
1. The dossier for approval of high school graduation recognition includes:
a) A record of information on high school graduation recognition examination;
b) A list of candidates proposed for high school graduation recognition;
c) A list and dossier of candidates granted special treatment, exempted from examination, and recognized as having completed high school graduation due to re-examination or resolution of complaints about examination dossiers;
d) A CD containing examination data;
đ) Related minutes;
e) Other types of dossiers as guided annually by the Ministry of Education and Training.
2. Procedure for approval of high school graduation recognition:
a) The Director of the Department of Education and Training approves high school graduation recognition for candidates meeting the conditions and is responsible before the Ministry of Education and Training for the results of high school graduation recognition in their province;
b) After reporting to the Ministry of Education and Training, the Director of the Department of Education and Training announces the results of high school graduation recognition and informs general education schools to post the list of candidates recognized as having completed high school graduation and issue a temporary High School Graduation Certificate to candidates;
c) The temporary High School Graduation Certificate is signed by the Principal of the general education school where the candidate registered and is valid until the official High School Graduation Diploma is issued;
d) Departments of Education and Training send the list of candidates recognized as having completed high school graduation to the Ministry of Education and Training immediately after the examination period for management and monitoring.
Article 45. Issuance and Management of High School Graduation Diploma
1. Candidates specified in point a, b Clause 1 Article 12 of this Regulation who meet the graduation conditions will be issued a High School Graduation Diploma. 2. The Director of the Department of Education and Training is responsible for managing and directing the issuance of High School Graduation Diplomas, issuing copies of High School Graduation Diplomas, and related certificates concerning bonus point addition, priority classification, and result retention during the examination period according to the regulations of the Ministry of Education and Training.
Article 46. Issuance of Certificate of Completion of General Education Program
1. Students belonging to the categories specified in point a, b Clause 1 Article 12 of this Regulation who meet the examination conditions as prescribed by the Minister of Education and Training but do not take the examination or fail to achieve the required score for high school graduation recognition will be issued a Certificate of Completion of General Education Program.
2. The authority to issue and the format of the Certificate of Completion of General Education Program are stipulated in Decision No. 39/2008/QD-BGDĐT dated August 22, 2008, issued by the Minister of Education and Training regarding the format of the Certificate of Completion of Grade 10, Grade 11, and Grade 12 Programs at the secondary level.
3. The management, use of blank forms, issuance, distribution, amendment, recovery, cancellation, and issuance of copies from the original Certificate of Completion of General Education Program shall be carried out in accordance with the regulations on diplomas and certificates stipulated in Circular No. 21/2019/TT-BGDĐT dated November 29, 2019, issued by the Minister of Education and Training regarding the Management Regulations for Junior High School Graduation Diploma, Senior High School Graduation Diploma, Junior College Teacher Training Diploma, Associate College Teacher Training Diploma, university-level diplomas, and certificates of the national education system.
4. The original book for issuing the Certificate of Completion of General Education Program must contain complete and accurate information of the Certificate of Completion of General Education Program, numbered pages, stamped with a cross-stamp, and cannot be erased or altered, ensuring strict management and permanent storage.
5. The issuance of the Certificate of Completion of General Education Program shall be applied from July 1, 2020.
Chapter IX
REPORTING AND STORAGE REGIME
Article 47. Reporting System
1. Each Department of Education and Training shall assign a number of civil servants and employees to collect data, materials, and information before, during, and after the examination period; prepare documents and report according to regulations.
2. The reporting system during the examination period shall be implemented in accordance with the annual guidance document on organizing the national high school graduation examination issued by the Ministry of Education and Training.
Article 48. Archiving Examination Files
Starting from the last day of the examination period, educational management agencies shall archive files as follows:
1. The Ministry of Education and Training shall permanently retain the list of candidates recognized as having graduated from high school by each Department of Education and Training.
2. The Department of Education and Training:
a) Shall permanently retain documents including: Score sheets; records of information for recognition of high school graduation; lists of candidates recognized as having graduated from high school; books for issuing high school graduation certificates;
b) Shall retain for twelve months documents and equipment including: Decisions establishing the Provincial Steering Committee, Examination Board, and related units; final examination reports along with various statistical data; examination board minutes; other relevant minutes related to the examination period; decisions establishing the Review Board, summary minutes, lists of candidates whose scores were changed due to review, and other relevant minutes; disciplinary files (if any); other types of files according to the annual guidance document on organizing the national high school graduation examination issued by the Ministry of Education and Training; data storage devices (hard drives, memory cards) of the surveillance camera system used during the examination period and servers used for marking multiple-choice tests;
c) Shall retain for twenty-four months documents including: Candidates' examination papers and related marking files; files for candidates granted special permission to graduate from high school, exempted from the high school graduation examination, and candidates' appeal files or appeals regarding examination files.
3. Secondary schools shall retain for twelve months candidates' registration files. Student transcripts and various certificates (originals) in candidates' examination files shall be returned to candidates by secondary schools after announcing the results of high school graduation recognition.
Chapter X
INSPECTION, AUDIT, REWARD, HANDLING UNUSUAL INCIDENTS AND VIOLATIONS
Article 49. Examination Inspection
1. The Director of the Inspectorate of the Ministry of Education and Training decides to establish inspection teams to inspect and audit the leadership and organization of the examination period and the inspection and audit of various stages of the examination at localities; in necessary cases, this decision is made by the Minister of Education and Training.
2. The Director of the Inspectorate of the province establishes inspection teams to inspect various stages of the examination organization at the locality according to the directive of the Chairman of the People's Committee of the province.
3. The Director of the Inspectorate of the Department of Education and Training decides to establish inspection teams to inspect and audit the preparation for examinations, invigilation, marking, review, and recognition of high school graduation by the Department of Education and Training; in necessary cases, this decision is made by the Director of the Department of Education and Training.
4. The Ministry of Education and Training guides the inspection and audit work of examinations according to the provisions of the law.
Organizations and individuals who have made achievements in insurance business activities contributing to economic and social development, ensuring market safety, complying well with legal provisions, and detecting violations of insurance business laws shall be awarded according to the law.
1. Reward recipients: Civil servants, employees, lecturers, teachers, students, trainees, learners, and service staff who have achieved results in organizing the examination.
CONFIRMATION BY THE AWARDING AGENCY
a) Commendation before the Examination Question Setting Council, Examination Board, and notification to the place of work or study;
b) The Director of the Department of Education and Training issues a Certificate of Merit;
c) The Minister of Education and Training, the Chairman of the People's Committee of the province, and the Chief of General Staff of the Vietnam People's Army issue a Certificate of Commendation.
3. File and procedures: The National and Provincial Steering Committees, the Examination Question Setting Council, and the Examination Board are responsible entities for considering and deciding rewards within their authority and preparing files to request rewards from competent authorities for civil servants, employees, lecturers, teachers, students, trainees, learners participating in organizing the examination and service staff who have achieved results.
4. Funds allocated for rewards are drawn from the examination organization budget.
Article 51. Handling Abnormal Situations Regarding Examinations
1. In cases where examination papers contain errors discovered during printing and while conducting examinations, the Examination Board leadership must immediately report to the National Steering Committee for appropriate measures.
2. All abnormal situations regarding examination papers must be reported to the Steering Committees at all levels for consideration and decision.
3. The National Steering Committee is responsible for handling situations involving leaked examination papers. Upon officially concluding that a paper has been leaked, the National Steering Committee will decide to suspend the examination paper/subject affected by the leak and organize a re-examination using a backup examination paper at an appropriate time, following the last examination session of the period.
Article 52. Receiving and Handling Information and Evidence of Violations of Examination Regulations
1. Locations for receiving information and evidence of violations of examination regulations:
a) National Steering Committee, Provincial Steering Committee;
b) Examination Board leadership, Examination Venue Head;
c) Provincial Inspectorate, Educational and Training Inspectors at all levels.
2. Evidence of violations of examination regulations, once verified, serves as the basis for handling violators.
3. Providing Information and Evidence of Violations of Examination Regulations:
a) Encouraging candidates, members of Examination Boards, and all citizens to detect and report violations of examination regulations;
b) Individuals who discover violations of examination regulations should promptly report to the locations specified in Clause 1 of this Article to take appropriate measures;
c) Individuals with evidence of violations of examination regulations should immediately report to the locations specified in Clause 1 of this Article for timely handling according to the law. The receipt and handling of reports on violations of examination regulations shall be carried out in accordance with the law on complaints;
d) Individuals providing information and evidence of violations of examination regulations must bear legal responsibility for the reliability and accuracy of the provided information and evidence; they may not abuse this to negatively impact the examination period.
4. Organizations and individuals entrusted with receiving information and evidence of negative actions and violations of examination regulations must:
a) Organize the receipt of information and evidence in accordance with regulations; protect the original state of evidence; verify information and evidence after receipt and propose appropriate measures to handle negative actions and violations of examination regulations to competent authorities;
b) Promptly implement measures to prevent negative actions and violations of examination regulations as prescribed;
c) Handle according to their authority or report to competent agencies or persons with authority for handling and publicly announce the results of handling individuals and organizations with negative behaviors and violations of examination regulations;
d) Protect the confidentiality of the identity of individuals providing information and evidence related to negative actions and violations of examination regulations.
Article 53. Handling Individuals Involved in Organizing Examinations and Related Individuals Who Violate Examination Regulations
1. Individuals involved in organizing examinations who are civil servants or public officials committing violations of examination regulations (discovered during or after the examination period) will be suspended from examination-related work and referred to the competent management agency for civil servants and public officials to apply legal provisions on civil servants and public officials to impose disciplinary sanctions in the following forms:
a) Warning for those violating for the first time minor offenses as stipulated in Points b, c, d of this Clause while performing duties;
b) Caution for those committing one of the following offenses: allowing candidates to cheat and bring prohibited materials into the examination room as stipulated in Point n of Clause 4 of Article 14 of these Regulations; marking exams incorrectly or adding points to exams with numerous errors; setting exam questions outside the content prescribed in Clause 2 of Article 4 of these Regulations; transmitting examination data incorrectly in structure, timing, or contrary to the Ministry of Education and Training's regulations;
c) Depending on the severity of the violation, they may be demoted in salary grade, rank, dismissed, or transferred to other work for those committing one of the following offenses: setting exam questions outside the scientific content of the exam/subject; directly solving exam questions or guiding candidates during the exam; exchanging candidates' exam papers; cheating when marking exams, giving points incorrectly, exceeding the range, or lowering candidates' scores;
d) Forced resignation or referral for criminal prosecution for those committing one of the following offenses: taking exam questions out of the examination area or bringing solutions from outside into the examination room during the exam; leaking exam questions, buying or selling exam questions; leaking exam paper numbers; tampering with candidates' answers, adding or subtracting from them; intentionally altering scores on answer sheets, marking records, or score sheets; swapping candidates' exam papers, numbers, or scores; deceit in modifying academic records or candidate files;
đ) Individuals who lose candidates' exam papers during collection, transportation, storage, marking, or other organizational work during the examination, depending on the nature and severity of the violation, will be disciplined according to one of the disciplinary forms prescribed in this Article.
2. Civil servants and public officials not involved in organizing examinations but engaging in actions such as: taking exams on behalf of others, organizing the removal of exam questions and delivery of solutions to candidates, disseminating false information affecting the examination adversely, causing disturbances leading to disorder in the examination area, will be subject to administrative penalties and recommended for forced resignation.
3. Individuals involved in organizing examinations and those related to examination organization who are not civil servants or public officials committing violations of examination regulations (discovered during or after the examination period), depending on the severity, will be penalized administratively and handled according to labor laws by competent authorities; suspended from studies for a period or expelled from school (if they are students) when committing one of the offenses stipulated in Points b, c, d, đ of Clause 1 of this Article.
4. The forms of handling violations prescribed in Clauses 1, 2, and 3 of this Article are decided by competent agencies or organizations according to the prescribed procedures. In addition to the aforementioned handling methods, competent authorities may prohibit involvement in examination-related work for up to five years.
Article 54. Handling Candidates Who Violate the Examination Regulations
All violations of the Examination Regulations shall be recorded in a report, subject to disciplinary action, and notified to the candidate.
1. Reprimand:
a) For candidates who commit a single offense; looking at another candidate's paper or exchanging papers with other candidates;
b) The form of this disciplinary action shall be decided by the Examination Board in the report prepared.
2. Warning:
a) For candidates who violate any of the following offenses: Having been reprimanded once but during the examination period for that subject, they continue to violate the Examination Regulations at the level of reprimand; exchanging work papers or scratch paper with other candidates; copying another candidate's work or allowing another candidate to copy their work;
b) The warning disciplinary action shall be decided by the Examination Board in the report prepared, accompanied by evidence (if any).
3. Suspension from Examination:
a) For candidates who violate any of the following offenses: Having been warned once but during the examination period for that subject, they continue to violate the Examination Regulations at the level of reprimand or warning; bringing prohibited items into the examination room as stipulated in Article 14 of these Regulations; taking the examination questions out of the examination room or receiving answers from outside the examination room; writing or drawing on the examination answer sheet irrelevant content; engaging in aggressive or threatening behavior towards those responsible for the examination or threatening other candidates;
b) The Examination Board shall prepare a report, collect evidence (if any), and report to the Head of the Examination Venue for a decision to suspend the examination. If the Head of the Examination Venue does not agree, it shall be reported to the Chief of the Examination Board for a decision. Candidates suspended from the examination must submit their examination papers, questions, and scratch paper to the Examination Board and leave the examination room immediately upon the decision. Suspended candidates may only leave the examination area after two-thirds (two-thirds) of the time for the essay examination has passed or after the end of the multiple-choice examination time. Candidates suspended from the examination in any year will have all examination results for that year nullified.
4. Deducting Points from Examination Papers
a) Candidates who are reprimanded during the examination of a particular subject will have 25% deducted from the total score of that subject's examination paper;
b) Candidates who are warned during the examination of a particular subject will have 50% deducted from the total score of that subject's examination paper;
c) Examination papers marked as discovered during grading will have 50% of the total score deducted;
d) Zero points (0): Examination papers copied from unauthorized materials brought into the examination room; having two or more answers for one examination; examination papers written by two or more people; parts of the examination written on scratch paper or incorrect paper;
đ) Candidates whose examinations are suspended will receive zero points (0) for that examination and are not allowed to continue with subsequent examinations;
e) The deduction of points for examination papers as specified in point c and d of this clause shall be decided by the Chief of the Essay Grading Board based on a written report from the Head of the Essay Grading Department.
5. Nullifying Examination Results for Candidates: Having two or more examinations scored zero (0) due to violations as specified in point d of Clause 4 of this Article; writing or drawing irrelevant content on the examination paper; allowing others to take the examination or complete the examination on their behalf in any form; altering or adding to the submitted work; submitting someone else's work. Based on a written report from the Chairman of the Examination Council, the Director of the Department of Education and Training shall issue a decision to nullify the examination results.
6. Nullifying Examination Results and Preparing Documentation for Submission to Competent Authorities for Consideration and Handling According to Legal Provisions for Candidates Who Violate Any of the Following Offenses:
a) Falsifying documents to benefit from preferential treatment or incentives;
b) Using illegal diplomas or certificates;
c) Allowing others to take the examination or complete the examination on their behalf in any form;
d) Engaging in disruptive or destructive actions during the examination; assaulting those involved in organizing the examination or other candidates;
đ) Using illegally obtained Examination Result Certificates.
7. For violations with criminal indications, educational management agencies shall prepare documentation for submission to competent authorities for consideration and prosecution according to legal provisions; for other violations, disciplinary actions will be taken according to the forms already prescribed in this Article depending on the nature and severity of the violation.
Article 55. Verification and Resolution of Complaints and Allegations Regarding Examinations After the Examination Board Dissolves
The verification and resolution of complaints and allegations regarding examinations after the Examination Board dissolves shall be handled in accordance with the laws on complaint and allegation resolution.
Chapter XI
IMPLEMENTATION
Article 56. Responsibilities of the Ministry of Education and Training
1. Direct the organization of examinations.
2. Establish a National Steering Committee to direct the organization of examinations.
3. Direct the organization of inspection and supervision of the implementation of the Examination Regulations.
4. Develop examination questions for annual examinations.
Article 57. Responsibilities of Provincial People's Committees
1. Bear full responsibility for directing the organization of examinations at the local level.
2. Establish a provincial Steering Committee; approve plans, schedules, and budgets for organizing examinations submitted by the Department of Education and Training; direct and assign tasks to the Department of Education and Training and relevant provincial departments and district-level People's Committees to ensure the thorough and strict implementation of the Examination Regulations and other guidance documents issued by the Ministry of Education and Training.
Article 58. Responsibilities of Departments of Education and Training
1. Direct and inspect the completion of teaching plans and student grading at general education schools.
2. Submit to the provincial People's Committee for decision on establishing a provincial Steering Committee.
3. Advise the provincial Steering Committee on organizing examinations according to the Examination Regulations and guidelines from the Ministry of Education and Training.
4. Direct and organize registration for the examination, manage registration files; prepare material conditions for the examination; coordinate with related units to organize examinations for candidates studying foreign languages under pilot programs approved by the Ministry of Education and Training for use in recognizing high school graduation.
5. Lead the establishment, direction, and implementation of tasks of the Examination Board and its committees; organize training for examination organization staff; direct educational institutions to prepare material conditions for the examination.
6. Report to the provincial Steering Committee on the implementation of examination organization tasks and issues arising during the examination process.
7. Organize the handover of examination result certificates to candidates.
8. Organize the recognition of high school graduation for candidates; direct the issuance of temporary high school graduation certificates, high school diplomas, and certificates of completion of general education; publicly announce the distribution of scores for each subject and component, and compare average examination scores with average grades from grade 12 in general education schools within the province.
9. Implement rewards and disciplinary actions for civil servants, public officials, teachers, and candidates within their authority; propose rewards and disciplinary actions according to the Examination Regulations and relevant laws for those involved in examination work; store examination records as prescribed.
10. Coordinate with finance departments and related agencies to submit to the provincial People's Committee to ensure funding for examination organization.
Article 59. Responsibilities of the School Service Bureau (Ministry of National Defense)
1. The School Service Bureau bears responsibility before the General Staff Department of the Ministry of National Defense and the Ministry of Education and Training as a Department of Education and Training for all work related to directing and managing the high school graduation examination in the Vietnam People's Army.
2. The Director of the School Service Bureau has duties and powers similar to those of the Director of a Department of Education and Training for all work related to directing and managing the high school graduation examination.
Article 60. Responsibilities of Secondary Schools
1. Complete the teaching program according to the directives of the Department of Education and Training; organize review sessions for students; guide students to obtain a Citizen Identity Card at the latest by the end of the first semester of grade 12; organize examinations to assess cultural knowledge and classify academic performance for self-study individuals when assigned responsibility by the Department of Education and Training.
2. Receive Registration Forms for Examinations, applications for re-examination; check the files of examination registrants at the school; complete examination registration data and transfer the data to the Department of Education and Training; print, stamp, and return Examination Notification Letters to candidates; manage examination registration files of candidates in accordance with regulations.
3. Organize training for civil servants, employees, teachers, and candidates on Examination Regulations; provide all necessary conditions regarding infrastructure and safety for the Examination Board if selected as an examination venue or marking location.
4. Receive applications, compile lists of candidates requesting re-examination and transfer them to the Department of Education and Training; return Examination Result Certificates to candidates who submitted Registration Forms at the school.
5. Issue Temporary Graduation Certificates and Certificates of Completion of General Education Programs.
6. Store examination files in accordance with regulations.
7. Compare average scores of examination subjects and component subjects with the average scores of corresponding subjects in grade 12 of the school's students as a basis for reforming teaching and learning methods within the school.
Article 61. Responsibilities of Higher Education Institutions
1. Establish inspection teams for examination phases or participate in inspection teams for examination phases according to the directives of the Minister of Education and Training; ensure necessary conditions for higher education institution officials and lecturers to participate and perform their duties.
2. Implement tasks related to examination organization work assigned by the Minister of Education and Training./.
