The Minister of Agriculture and Rural Development issues this Circular regulating decentralization, classification, determination of jurisdiction, and amendment and supplementation of certain articles of circulars in the marine and island domain.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular regulates decentralization, classification, determination of jurisdiction, and amendment and supplementation of certain articles of circulars in the marine and island domain including:
1. Detailed regulations guiding the implementation of Clause 15, Article 14 of Decree No. 136/2025/NĐ-CP dated June 12, 2025 of the Government on decentralization and classification in the agriculture and environment sector.
2. Regulations on decentralization, classification, and determination of jurisdiction in the marine and island domain when organizing two-level local administration.
3. Amending and supplementing certain articles of circulars in the marine and island domain.
Article 2. Applicability
This Circular applies to state management agencies, organizations, and individuals related to comprehensive management of marine resources and protection of marine and island environment.
Chapter II
PROCEDURE FOR RECOVERY OF MARINE AREAS ALLOCATED FOR AQUACULTURE
Article 3. Procedure for recovery of marine areas allocated for aquaculture
The procedure for recovery of marine areas allocated for aquaculture shall be carried out in accordance with Article 28 of Decision No. 11/2021/NĐ-CP dated February 10, 2021 of the Government on the allocation of certain marine areas to organizations and individuals for exploitation and utilization of marine resources, which has been amended and supplemented by certain articles in Decree No. 65/2025/NĐ-CP dated March 12, 2025 of the Government amending and supplementing certain articles of Decree No. 40/2016/NĐ-CP dated May 15, 2016 of the Government detailing implementation of certain provisions of the Law on Marine and Island Resources and Environment and Decision No. 11/2021/NĐ-CP dated February 10, 2021 of the Government on the allocation of certain marine areas to organizations and individuals for exploitation and utilization of marine resources.
Chapter III
REGULATIONS ON DECENTRALIZATION, CLASSIFICATION, AND DETERMINATION OF JURISDICTION IN THE MARINE AND ISLAND DOMAIN WHEN ORGANIZING TWO-LEVEL LOCAL ADMINISTRATION
Article 4. Amendment, replacement, and abolition of certain terms and phrases in Circular No. 36/2010/TT-BTNMT dated December 14, 2010 of the Minister of Natural Resources and Environment on Economic and Technical Standards for Surveying, Assessing Coral Ecosystems, Seagrass Ecosystems, and Coastal Wetlands and Island Wetlands
1. Replace the phrase "Director General of the Vietnam Marine and Island Administration" with the phrase "Director of the Vietnam Marine and Island Administration" in Article 3.
2. Replace the phrase "coastal districts" with the phrase "coastal communes" in Section 1.2 Chapter II of the Economic and Technical Standards for Surveying, Assessing Coral Ecosystems, Seagrass Ecosystems, and Coastal Wetlands and Island Wetlands issued together with Circular No. 36/2010/TT-BTNMT dated December 14, 2010 of the Minister of Natural Resources and Environment.
Article 5. Amend, supplement some articles, replace, abolish some words and phrases of Circular No. 18/2016/TT-BTNMT dated July 25, 2016 of the Minister of Natural Resources and Environment detailing the files on marine and island resources, guiding the establishment and management of files on marine and island resources.
1. Amend and supplement Point d Clause 2 Article 5 as follows:
“d) Location of marine islands: record information about the commune-level administrative unit, province; Distance from the marine island to the administrative center of the commune, province and distance to the nearest inland seaport;”
2. Amend and supplement Clause 2 Article 11 as follows:
“2. The examination of the file on marine and island resources must be carried out through the Examination Board established by the Chairman of the Provincial People's Committee with the structure including: 01 Chairman of the board is the Leader of the Provincial People's Committee, 01 Deputy Chairman of the board is the Leader of the Department of Agriculture and Environment, 02 Review members, 01 Secretary member is an officer of the Department of Agriculture and Environment and other members are representatives of the Departments: Civil Service, Finance, Industry and Trade, Construction, Science and Technology, Culture, Sports and Tourism, Foreign Affairs (if any), representative of the Provincial Military Command, Provincial Police and some experts, scientists.”
3. Tasks and powers of the District People's Committee delegated to the Commune People's Committee: amend and supplement Clause 2 Article 15 as follows:
“2. The Department of Agriculture and Environment shall be responsible for taking the lead, coordinating with relevant departments and the Commune People's Committee where there are marine islands to establish, update, manage the file on marine and island resources.”
4. Replace the phrase "Ministry of Natural Resources and Environment" with the phrase "Ministry of Agriculture and Environment" in Clause 2 Article 12 and Clause 2 Article 14, Clause 3 Article 16; the phrase "Department of Natural Resources and Environment" with the phrase "Department of Agriculture and Environment" in Clause 1 and Clause 3 Article 10; Clause 1, Clause 2 and Clause 4 Article 11; Clause 1 Article 12; Article 13; Clause 1 Article 14; Clause 2 Article 15; Form No. 06/QĐPD and Form No. 07/QĐPDCN.
Replace the phrase "General Department of Sea and Island Management of Vietnam" with the phrase "Sea and Island Management Department of Vietnam" in Article 12, Clause 2 Article 14.
5. Remove the term "-district:" at Form No. 03/PTY.
Article 6. Amend, supplement some articles, replace, abolish some words and phrases of Circular No. 20/2016/TT-BTNMT dated August 25, 2016 of the Minister of Natural Resources and Environment stipulating the construction, exploitation, use of databases on marine and island resources.
1. Replace the phrase "General Department of Sea and Island Management of Vietnam" with the phrase "Sea and Island Management Department of Vietnam" in Clause 1, 4 Article 5; Clause 2 Article 7; Point e, g Clause 1 Article 8; Clause 4 Article 9; Clause 1 Article 18.
2. Replace the phrase "Ministry of Natural Resources and Environment" with the phrase "Ministry of Agriculture and Environment" in Clause 1 Article 5; Clause 1 Article 6; Clause 2 Article 7; Point e Clause 1 Article 8; Clause 2 Article 15; Clause 3 Article 18.

“a) Departments, agencies under the Provincial People's Committee with sea areas, the Commune People's Committee with sea areas have the responsibility to provide data on marine and island resources and environment to the Department of Agriculture and Environment;”.
Article 7. Supplementing, replacing, and abolishing certain words and phrases in Circular No. 29/2016/TT-BTNMT dated October 12, 2016, issued by the Minister of Natural Resources and Environment on technical guidelines for establishing coastal protection zones.
1. Replace the phrase "General Department of Sea Islands Vietnam" with the phrase "Sea Islands Vietnam Agency" in Clause 1, Article 33.
2. Replace the phrase "General Statistics Office" with the phrase "Statistics Office," and replace the phrase "Provincial Statistics Office" with the phrase "District Statistics Office" in Point a, Clause 2, Article 4.
3. Replace the phrase "Ministry of Natural Resources and Environment" with the phrase "Ministry of Agriculture and Environment" in Clause 1, Article 33; Clause 2, Article 35.
4. Remove the phrase "name abbreviation of district/city/district under provincial jurisdiction" from the note on the marker face in Appendix 5 on the specifications of boundary markers for coastal protection zones issued together with Circular No. 29/2016/TT-BTNMT dated October 12, 2016, issued by the Minister of Natural Resources and Environment.

Article 8. Supplementing, replacing, and abolishing certain words and phrases in Circular No. 74/2017/TT-BTNMT dated December 29, 2017, issued by the Minister of Natural Resources and Environment on technical guidelines for preparing comprehensive plans for sustainable exploitation and utilization of coastal resources.
1. Replace the phrase "Ministry of Natural Resources and Environment" with the phrase "Ministry of Agriculture and Environment" in Clause 2, Article 18; and replace the phrase "Director General of the Sea Islands Vietnam Agency" with the phrase "Director of the Sea Islands Vietnam Agency" in Clause 1, Article 18.
2. Replace the phrase "coastal and island districts" with the phrase "coastal and special zone districts" in Section IV of the Appendix issued together with Circular No. 74/2017/TT-BTNMT dated December 29, 2017, issued by the Minister of Natural Resources and Environment.
Article 9. Amending and supplementing certain articles, and replacing certain words and phrases in Circular No. 22/2018/TT-BTNMT dated November 15, 2018, issued by the Minister of Natural Resources and Environment on economic and technical standards for mapping seabed topography at a scale of 1:5,000.
1. Replace the phrase "Ministry of Natural Resources and Environment" with the phrase "Ministry of Agriculture and Environment" in Article 3.
2. Amend and supplement Point a, Section 1.2.2, Chapter II of the Economic and Technical Standards for Mapping Seabed Topography at a Scale of 1:5,000 issued together with Circular No. 22/2018/TT-BTNMT dated November 15, 2018, issued by the Minister of Natural Resources and Environment as follows:

Type KK5: Map fragments of sea areas (limit from 30km to ≤40km from shore, islands) of all provinces.
Type KK6: Map fragments of sea areas (limit from 40km to ≤50km from shore, islands) of all provinces. Map fragments of the Paracel Islands, Spratly Islands, and DK areas.
Note: The type KK of hydrographic survey using SBES applies the corresponding type KK of difficulty classification when using SBES for line measurement.”.
Article 10. Supplementing, replacing, and abolishing certain terms and phrases in Circular No. 33/2018/TT-BTNMT dated December 26, 2018, issued by the Minister of Natural Resources and Environment on procedures for responding to oil spills at sea.
1. Replacing the phrase "Ministry of Natural Resources and Environment" with the phrase "Ministry of Agriculture and Environment" in Clause 4, Article 15, Clause 3, Article 21, Appendix 05; and replacing the phrase "General Department of Sea and Islands of Vietnam" with the phrase "Department of Sea and Islands of Vietnam" in Clause 1, Article 21.
2. Removing the phrase "With inter-district roads" from Appendix 02 promulgated together with Circular No. 33/2018/TT-BTNMT dated December 26, 2018, issued by the Minister of Natural Resources and Environment.
Article 11. Supplementing, replacing, and abolishing certain terms and phrases in Circular No. 52/2024/TT-BTNMT dated December 31, 2024, issued by the Minister of Natural Resources and Environment detailing the index and evaluation of results of marine and island environmental pollution control activities.
1. Replacing the phrase "districts and coastal towns" with the phrase "coastal communes and wards" in Point b, Point c, Clause 3, Article 4; and Indices 07, 08, 09, 10, 11, 12, 13, 14, 21 of Appendices I, II, III, V promulgated together with Circular No. 52/2024/TT-BTNMT dated December 31, 2024.
2. Replacing the phrase "district/city/district?" with the phrase "commune/ward/special zone?" in Appendix IV promulgated together with Circular No. 52/2024/TT-BTNMT dated December 31, 2024, issued by the Minister of Natural Resources and Environment.

Article 24. Article 25. Replace the phrase "Director General of Vietnam National Sea and Islands Administration" with the phrase "Director of Vietnam Sea and Islands Administration" in Clause 1, Article 62 of the Technical Regulations for Comprehensive Investigation and Survey of Marine Resources and Environment at Depths of 20 Meters or More Using Ships issued together with Circular No. 57/2017/TT-BTNMT dated December 8, 2017, by the Minister of Natural Resources and Environment.
2. Replace the phrase "Ministry of Natural Resources and Environment" with the phrase "Ministry of Agriculture and Environment" in Article 3 and Clause 2, Article 62 of the Technical Regulations for Comprehensive Investigation and Survey of Marine Resources and Environment at Depths of 20 Meters or More Using Ships issued together with Circular No. 57/2017/TT-BTNMT dated December 8, 2017, by the Minister of Natural Resources and Environment.
Article 27. Amend, replace, and abolish certain words and phrases in Circular No. 58/2017/TT-BTNMT dated December 8, 2017, issued by the Minister of Natural Resources and Environment on technical regulations and economic and technical norms for surface wave and current monitoring stations by radar.
1. Replace the phrase "Vietnam National Sea and Islands Administration" with the phrase "Vietnam Sea and Islands Administration" in Clause 1, Article 11, and Clause 1, Article 12 of the Technical Regulations and Economic and Technical Norms for Surface Wave and Current Monitoring Stations by Radar issued together with Circular No. 58/2017/TT-BTNMT dated December 8, 2017, by the Minister of Natural Resources and Environment.

IMPLEMENTING PROVISIONS
Article 38. Effective Date
This Circular takes effect from July 1, 2025.
Article 39. Responsibility for Implementation
The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairmen of People's Committees of provinces and centrally governed cities with sea coasts, and related agencies shall be responsible for implementing this Circular.
