CIRCULAR

Regulations on the Charter of Vocational Education Centers

 

Circular No. 57/2015/TT-BLDTBXH dated December 25, 2015, issued by the Minister of Labor, Invalids, and Social Affairs, stipulates the charter of vocational education centers, which took effect from February 10, 2016, amended and supplemented by:

Decree No. 143/2016/NĐ-CP dated October 14, 2016, issued by the Government, stipulates conditions for investment and operation in the field of vocational education, taking effect from October 14, 2016;

Circular No. 18/2018/TT-BLDTBXH dated October 30, 2018, issued by the Minister of Labor, Invalids, and Social Affairs, amends and supplements certain articles of related circulars concerning administrative procedures within the scope of the Ministry's state management functions, taking effect from December 18, 2018;

Circular No. 05/2020/TT-BLDTBXH dated August 16, 2020, issued by the Minister of Labor, Invalids, and Social Affairs, stipulates the organizational regulations and operations of public vocational education centers at district level, taking effect from October 1, 2020;

Circular No. 08/2023/TT-BLDTBXH dated August 29, 2023, issued by the Minister of Labor, Invalids, and Social Affairs, amends, supplements, and abolishes certain articles of related circulars and joint circulars concerning the submission and presentation of paper household registration books, temporary residence certificates, or other documents requiring confirmation of place of residence when implementing administrative procedures under the Ministry's jurisdiction, taking effect from October 12, 2023.

Based on the Education Law dated June 14, 2005, and the Law Amending and Supplementing Certain Provisions of the Education Law dated November 25, 2009;

Pursuant to the Law on Vocational Education dated November 27, 2014;

Pursuant to Decree No. 48/2015/NĐ-CP dated May 15, 2015, of the Government detailing certain provisions of the Vocational Education Law;

Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Implementing Resolution No. 33/NQ-CP dated April 30, 2015, of the Government at the regular meeting of the Government in April 2015;

At the proposal of the Director General of the Vocational Training Administration;

The Minister of Labor, Invalids, and Social Affairs issues this Circular to promulgate the Charter of Vocational Education Centers.1

Chapter I. GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Charter stipulates the organization and operation of public vocational education centers and private vocational education centers (hereinafter referred to collectively as vocational education centers).

Article 2. This Charter applies to vocational education centers and organizations and individuals participating in activities at vocational education centers.

3.2 This Charter does not apply to public vocational education centers at district level.

Article 3. Legal status of vocational education centers

Clause 1. A vocational education center is an educational institution operating in accordance with this Charter and other relevant laws.

Clause 2. A vocational education center has autonomy and is responsible according to the provisions of the law.

Clause 3. A vocational education center has legal personality, its own seal, and separate accounts.

Article 4. Principles for naming vocational education centers

Clause 1. The Vietnamese name of a vocational education center consists of the following components: "Vocational Education Center + main field or group of trades being trained or the specific name of the center or the name of the location or type of the center".

Clause 2. The name of the center must not be identical to that of a previously established center.

Clause 3. The Vietnamese name of the center shall be recorded in the decision on establishment, the decision allowing establishment, the seal, and various documents and transaction papers of the center, and shall be displayed at the main office.3 of the center.

Article 4. Types of vocational education centers

1. Vocational education centers under this Charter are organized in the following types:

a) Public vocational education centers;

b) Private vocational education centers4.

3. The direct management agency for public vocational education centers is the agency or organization assigned to manage vocational education centers according to the provisions of the law, including: Ministries, agencies equivalent to ministries, central bodies of political-social organizations; Departments, Bureaus, sectors, specialized agencies under the People's Committee of provinces and centrally governed cities; People's Committees of districts, towns, cities within provinces.

Article 5. State Management of Vocational Education Centers

1. Vocational education centers are subject to state management in vocational education by the Ministry of Labor, Invalids and Social Affairs; at the same time, they are subject to territorial management by the People's Committee of provinces and centrally governed cities (hereinafter referred to as provincial-level People's Committee) where the center is located.

2. Ministries, agencies equivalent to ministries, and provincial-level People's Committees shall cooperate with the Ministry of Labor, Invalids and Social Affairs to implement state management over vocational education centers in accordance with the provisions of this Charter.

Article 6. Regulations on Organization and Operation of Vocational Education Centers

1. Based on this Charter, vocational education centers shall establish regulations on organization and operation that are suitable to the specific conditions of the center, without contravening relevant laws.

2. The regulations on organization and operation of vocational education centers must include the following main contents:

a) Name of the center;

b) Objectives and mission;

c) Tasks and powers of the center;

d) Organization of training activities;

đ) Tasks and rights of teachers and managers;

e) Tasks and rights of students;

g) Organization and management of the center;

h) Relations between the center and enterprises, families, and society;

i) Finance and assets of the center;

k) Inspection, supervision, rewards, and handling of violations.

3. The regulations on organization and operation of vocational education centers shall be approved by the director of the center and must be publicly announced at the center.

Within ten working days from the date of approval of the regulations on organization and operation of the center, the director of the center is responsible for sending one copy of the decision approving the regulations on organization and operation of the center to the direct management agency of the center, the Ministry of Labor, Invalids and Social Affairs for monitoring and management, and to the Department of Labor, Invalids and Social Affairs of the province where the main office of the vocational education center is located for territorial management.

4. Approval of Amended and Supplementary Regulations on Organization and Operation

The director of the vocational education center approves decisions to amend and supplement the regulations on organization and operation of the center in accordance with Clause 3 of this Article.

Article 7. Tasks, Powers, Autonomy Rights, and Accountability of Vocational Education Centers

1. Vocational education centers perform tasks and powers as prescribed in Article 23 of the Vocational Education Law and other relevant laws.

2. The autonomy rights of vocational education centers are implemented in accordance with Article 25 of the Vocational Education Law and the following specific provisions:

a) Decide on the objectives, mission, strategy, and development plan of the center;

b) Decide on the establishment of organizational structures, development of teaching staff and management personnel based on the strategy and planning for the development of the center;

c) Collect and spend financial resources, invest in developing conditions to ensure the quality of training in accordance with the law; decide on tuition fees corresponding to the conditions ensuring the quality of high-quality training programs and regulations on financial autonomy for vocational education centers;

d) Admit students and manage student affairs; develop training programs; organize the compilation or selection of appropriate textbooks for each training program; print certificates, manage, and issue certificates to students in accordance with the law;

đ) Organize the implementation of scientific research and technological activities, international cooperation according to the development strategy and plan of the center; ensure the quality of training at the center; select educational quality assessment organizations to register for assessment;

e) Establish regulations on organization and operation of the center; define the functions and tasks of organizations under the center.

3. Vocational education centers have the responsibility to report to competent state authorities, students, and society about the following activities:

a) Publicly announce objectives, training programs; conditions to ensure the quality of teaching and learning; tuition fees and exemptions/reductions; results of educational quality assessments; the system of certificates of the center; job positions after graduation and measures to monitor and supervise the quality of training;

b) Commit to state management agencies and take responsibility for all activities to achieve commitments; not to allow any individual or organization to exploit the name and facilities of the center to conduct activities contrary to the provisions of the law and this Charter;

c) Mechanism for students, teachers, and society to participate in evaluating the quality of training at the center;

d) Report and explain matters related to inspection and supervision upon request of competent authorities.

Chapter II. ORGANIZATION AND MANAGEMENT OF VOCATIONAL EDUCATION CENTERS

Section 1. ORGANIZATION AND MANAGEMENT OF PUBLIC AND PRIVATE VOCATIONAL EDUCATION CENTERS

Article 8. Organizational Structure of Vocational Education Centers

The organizational structure of vocational education centers shall be in accordance with Clause 2, Article 10 of the Vocational Education Law.

The organizational structure of vocational education centers, the tasks and authorities of each unit within the center shall be implemented in accordance with the provisions of the law, this Charter, and shall be detailed in the regulations on the organization and operation of the center.

Article 9. Tasks and Authorities of the Director of Vocational Education Centers

1. The director of the vocational education center is the head of the center, representing the vocational education center before the law, responsible for managing activities and directing the organization and machinery of the vocational education center.

2. The tasks and authorities of the director of the vocational education center are stipulated in Clause 3, Article 13 of the Vocational Education Law and the following specific tasks and authorities:

a) Developing and approving strategies and development training plans for the center;

b) Establishing regulations regarding: the number, structure of labor, job positions, recruitment, management, utilization, and development of teaching staff, administrative personnel, and other employees in accordance with the law;

c) Organizing recruitment, managing, and effectively utilizing teaching staff, administrative personnel, civil servants, and other employees in accordance with the law;

d) Annually organizing evaluations and classifications of teaching staff, administrative personnel, civil servants, and other employees;

đ) Considering advisory opinions of the advisory council before making decisions on issues entrusted to the advisory council for advice;

e) Continuously caring for improving working, teaching, and learning conditions for administrative personnel, teachers, civil servants, employees, and students;

g) Organizing and directing the establishment of a healthy educational environment; ensuring political security and social order within the center;

h) Implementing democratic regulations within the center; implementing state policies and systems for administrative personnel, teachers, civil servants, and students in the center as prescribed by law;

i) Being authorized to decide on measures to implement the tasks and authorities of the vocational education center stipulated in Article 7 of this Charter;

k) Entering into training contracts with students in accordance with the law;

l) Signing cooperation contracts with other vocational education institutions; production, business, and service organizations in training activities or organizational production, business, and services in accordance with the law;

m) Issuing primary certificates and training certificates to students who meet the requirements as prescribed;

n) Deciding on rewards and disciplinary actions for administrative personnel, teachers, civil servants, employees, and students within the scope of authority delegated for management.

Article 10. Procedures for Appointing, Recognizing, and Removing the Director of Vocational Education Centers

1.6 Procedures for appointing directors of public vocational education centers

a) The dossier, procedures, and appointment procedures for directors of public vocational education centers shall be carried out in accordance with the law.

b) The authority to appoint directors of public vocational education centers shall be implemented in accordance with point a, Clause 4, Article 13 of the Vocational Education Law.

2. Procedures for recognizing directors of private vocational education centers a) Selection of directors

Organizations or individuals contributing capital to establish the center or the individual owner of the center shall select the director based on the director standards of vocational education centers stipulated in Clause 2, Article 13 of the Vocational Education Law and propose the person with the authority stipulated in Clause 4, Article 13 of the Vocational Education Law to recognize.

b) The recognition application dossier consists of one set, including:

- A letter from the organization or individuals contributing capital to establish the center or the individual owner of the center requesting the competent authority to recognize, according to Model No. 87 attached hereto;

- Minutes of the meeting of the organization or individuals contributing capital to establish the center, according to Model No. 9 attached hereto;

- A self-declared curriculum vitae of the person proposed for recognition as director of the center, applying model 2a-BNV/2007 issued together with Decision No. 06/2007/QĐ-BNV dated June 18, 2007 of the Ministry of Home Affairs on the issuance of the components of the dossier of officials and civil servants and the format of the dossier management form of officials and civil servants8 and accompanying educational certificates and training certificates of the person proposed for recognition.

c) Within twenty working days from the date of receiving complete and valid recognition application dossiers for the director of a private vocational education center from the organization or individuals contributing capital to establish the center or the individual owner of the center, the Chairman of the Provincial People's Committee shall issue a decision recognizing the director of the private vocational education center in the locality.

3. Removal of the director of vocational education centers

a) The removal of the director of the center shall be carried out in one of the following cases:

A written resignation request from the director; being restricted in civil capacity; health not sufficient to perform assigned work, must take leave for treatment exceeding six months without recovery of work capacity; currently under criminal investigation; using fake diplomas or diplomas not recognized by the competent authority; more than three-quarters of the total number of teachers and administrative personnel of the center have submitted written requests for removal or committed other violations stipulated in the regulations on the organization and operation of the center.

b)9 The dossier for removing the director of a public vocational education center shall be carried out in accordance with the law.

The dossier shall be sent directly or through postal service to the authority with the power to appoint stipulated in point a, Clause 4, Article 13 of the Vocational Education Law.

Article 11. Deputy Director of Vocational Education Center

1. The Deputy Director of the Vocational Education Center assists the Director in managing and operating the center's activities.

2. Criteria for appointing and recognizing the Deputy Director

The Deputy Director of the Vocational Education Center must have good moral character and health, reputation, and management capability; hold a college degree or higher. The appointment, recognition, and removal of the Deputy Director of the Vocational Education Center shall be carried out in accordance with the provisions of the law and specified in the organizational and operational regulations of the center.

3. Duties and powers of the Deputy Director

a) Assist the Director in managing and operating the center's activities; directly oversee certain areas of work assigned by the Director and handle other tasks delegated by the Director;

b) When handling tasks assigned by the Director, the Deputy Director is responsible before the law and to the Director for the results of the assigned work.

Article 12. Advisory Board

The Advisory Board within the Vocational Education Center is established by the Director to seek opinions from managers, teachers, and representatives of organizations inside and outside the center regarding advice on certain necessary tasks related to the implementation of the center's functions and responsibilities. The Advisory Board operates on a case-by-case basis and does not receive remuneration.

The Advisory Board may include members from within the center and external members who are active in fields related to the center's activities.

The establishment, organization, operation, duties, and powers of the Advisory Board are regulated by the Director and must be specifically stipulated in the organizational and operational regulations of the center.

Article 13. Departmental Units

1. Departmental units are organized according to trades or groups of trades being trained. Based on the scale and trade being trained, the Director decides to establish departmental units subordinate to the center according to the organizational structure of the center approved in the organizational and operational regulations of the center as stipulated in Article 8 of this Charter.

2. Departmental units subordinate to the center have the following responsibilities:

a) Manage teachers, other workers, and students under their departmental unit according to the division of authority by the Director;

b) Implement teaching plans, study programs, and other extracurricular activities according to the annual teaching plan of the center, including: developing the training program for the trade assigned by the center; organizing the detailed outline of subjects and modules to ensure consistency and avoid overlap between subjects and modules in the training program; organizing the development of the training program, drafting proposals, compiling materials, and textbooks in line with the center's development direction; organizing research to improve teaching methods and learning approaches to enhance training quality; establishing and implementing examination, testing, and evaluation methods for student performance and training outcomes, ensuring that graduates meet the standards set and market labor demands. The development of training programs, textbooks, and teaching materials must comply with the regulations of the Minister of Labor, Invalids, and Social Affairs;

c) Plan and organize scientific and technological activities, international cooperation; cooperate with scientific and technological organizations, production and business establishments related to the training trade, and mobilize enterprise participation in the training process of the departmental unit;

d) Develop plans for teacher team building, training programs, and facilities and equipment for training and scientific research, enhancing conditions to ensure training quality; carry out experimental activities, scientific research, and application of technology and techniques in the training process;

đ) Manage teachers, workers, and students under their own unit; develop and implement political education, ideological education, moral education, and lifestyle education for teachers and workers; plan and conduct training and upgrading of professional skills for teachers and other workers in the departmental unit;

e) Organize evaluations and classifications of managerial staff, teachers, and workers in the departmental unit and participate in evaluating managerial staff in the center according to the center's regulations;

g) Manage and utilize facilities and equipment effectively according to the Director's regulations; propose and develop plans for supplementing and maintaining training equipment;

h) Implement reporting systems as prescribed by the Director.

3. Head and Deputy Head of Departmental Unit

a) Each departmental unit has a head and may have deputy heads appointed by the Director;

b) The Head of the Departmental Unit is responsible for managing and operating the unit's activities according to the duties prescribed in Clause 2 of this Article and according to the division of authority by the Director;

c) The Head of the Departmental Unit must hold a college degree or higher relevant to the trade being trained at the departmental unit;

d) The Deputy Head of the Departmental Unit assists the Head in managing and operating the unit's activities;

đ) The appointment and removal of the Head and Deputy Head of the Departmental Unit shall be carried out in accordance with the law and specified in the organizational and operational regulations of the center.

Article 14. Functional Departments

1. The functional departments have the duty to advise and assist the director in managing, summarizing, proposing opinions, and organizing the implementation of the main tasks of the center such as: training, administrative management, governance; organization and personnel; summary, external relations; student management, learner management; financial management, equipment management, and basic construction according to the functions and tasks assigned by the director.

The director decides on the establishment of functional departments according to the organizational structure of the center that has been approved in the center's operational regulations.

2. The head of the department must have a college degree or higher.

3. The deputy head of the department assists the head in managing and directing the activities of the department according to the assigned functions and tasks. The number of deputy heads depends on the assigned functions and tasks and the scale of training at the center, which is specifically stipulated in the center's operational regulations. The appointment and removal of the head and deputy head of the vocational education center are carried out in accordance with the provisions of the law and are specified in the center's operational regulations.

Article 15. Training Service Units; Production, Business, and Service Bases

1. The vocational education center may establish subordinate units to serve training activities; production, business, and service bases to create conditions for learners and teachers of the center to practice and intern to enhance their knowledge and skills. The establishment of training service units, production, business, and service bases, and the organization of production, business, and service activities of the center shall be carried out in accordance with the provisions of the law.

2. The units established under Clause 1 of this Article do not have the function of organizing training or linking training to issue certificates.

3. The establishment, dissolution, functions, tasks, organizational structure, and activities of the units established under Clause 1 of this Article are decided by the director in accordance with current laws and must be specifically stipulated in the center's operational regulations.

Article 16. Communist Party of Vietnam Organizations, Mass Organizations, and Social Organizations

1. Communist Party of Vietnam organizations within the vocational education center operate in accordance with the Constitution, laws, and regulations of the Communist Party of Vietnam.

2. Mass organizations and social organizations within the vocational education center operate in accordance with the Constitution, laws, the Charter of the organization, and have the responsibility to contribute to achieving the vocational education goals.

Section 210 (Repealed)

Chapter III. TRAINING ACTIVITIES AND INTERNATIONAL COOPERATION

Section 1. TRAINING ACTIVITIES

Article 19. Trades Trained

The vocational education center trains trades at the primary level and regular training programs prescribed in Points a, b, c, and d of Clause 1 of Article 40 of the Vocational Education Law according to the labor market's requirements. Annually, based on the demand for direct human resource training for production, business, and services in the labor market, the vocational education center promptly adjusts the scale and trained trades of the center.

Article 20. Training Programs and Textbooks

1. Based on the minimum volume of knowledge, the ability requirements that learners achieve upon graduation for the primary level; the procedures for building, reviewing, and promulgating primary-level training programs by the Minister of Labor, Invalids, and Social Affairs, the vocational education center organizes the compilation or selection and approval of primary-level training programs to use as its own training programs.

2. The vocational education center organizes the compilation or selection and approval of regular training programs as prescribed in Points a, b, c, and d of Clause 1 of Article 40 of the Vocational Education Law; the general vocational training program of the center.

3. The vocational education center must regularly evaluate, update, and supplement training programs and textbooks to be consistent with production and service technologies.

4. The vocational education center organizes the compilation or selection of textbooks; approves textbooks to be used as teaching and learning materials of the center. Training textbooks must concretize the requirements for the content of knowledge and skills of each module and subject in the training program, creating conditions for the implementation of active teaching methods.

Article 21. Admissions

1. Vocational education centers shall develop annual admissions plans based on the direct workforce needs for production, business, and services of the industry and locality, and the training capacity of the center.

2. Vocational education centers shall organize admissions in accordance with the provisions of the Minister of Labor, Invalids, and Social Affairs.

Article 22. Organization and Management of Training at the Center

1. Vocational education centers shall organize and manage training in accordance with the provisions of Article 37 of the Vocational Education Law; organize training for trades at locations meeting the conditions and having been granted certificates of registration for vocational education activities at the primary level by competent authorities.

2. The organization and management of the training process for joint training programs with foreign countries shall be carried out in accordance with the current regulations of Vietnam on cooperation and investment with foreign countries in the field of vocational education.

Article 23. Examination, Testing, Evaluation of Learning Outcomes, and Graduation Recognition

1. Vocational education centers shall implement examination, testing, evaluation of learning outcomes, discipline, and moral development, and graduation recognition for students in accordance with the provisions of the Minister of Labor, Invalids, and Social Affairs.

2. The vocational training results of secondary school and high school students at vocational education centers shall be transferred to general schools as a basis for evaluating students in accordance with the regulations.

Article 24. Issuance and Management of Primary Certificates and Training Certificates

Vocational education centers shall implement the issuance and management of primary certificates and training certificates in accordance with the provisions of the Minister of Labor, Invalids, and Social Affairs.

Article 25. Accreditation and Quality Assurance in Training

1. Vocational education centers shall perform tasks and powers related to quality assurance work in training in accordance with Articles 67 and 69 of the Vocational Education Law.

2. Vocational education centers have the responsibility to carry out accreditation and ensure quality in accordance with the provisions of the Minister of Labor, Invalids, and Social Affairs.

Section 2. INTERNATIONAL COOPERATION ACTIVITIES

Article 26. Tasks and Powers of Vocational Education Centers in International Cooperation Activities

1. Implement forms of international cooperation in vocational education as stipulated in Article 47 of the Vocational Education Law.

2. Develop and implement short-term, medium-term, and long-term international cooperation strategies, plans, and programs of the center in line with the objectives of international cooperation activities specified in Article 46 of the Vocational Education Law and the State's policies on international integration in vocational education.

3. Organize effective management and implementation of international cooperation programs and projects within their authority.

4. Carry out negotiations and sign cooperation agreements with foreign partners in accordance with the law.

5. Build databases and information systems on international cooperation activities.

Article 27. Management of International Cooperation Activities

1. Assign tasks to units under the center to act as focal points for organizing and implementing international cooperation tasks of the center.

2. Develop and promulgate regulations on the management of international cooperation activities of the center in accordance with this Charter and other relevant legal documents.

3. Organize practical and effective international cooperation activities; conduct inspections, evaluations, and summaries of the implementation of international cooperation activities of the center.

4. Coordinate with relevant agencies to ensure security, order, and social safety in international cooperation activities.

Chapter IV. TEACHERS, MANAGEMENT STAFF, AND WORKERS

Article 28. Standards and Qualifications of Teachers in Vocational Education Centers

1. Teachers in vocational education centers must meet the following standards:

a) Possess good moral character and ethics;

b) Achieve the required qualifications in their specialized field and professional training as stipulated in Clause 2 of this Article;

c) Have sufficient health to meet occupational requirements;

d) Have a clear record.

2. Required Qualifications for Teachers

a) Teachers teaching at the basic level must have a diploma from a college or higher, or a vocational skills certificate to teach at the basic level;

b) Teachers teaching at the basic level as specified in Point a of this Clause who do not have a diploma from a pedagogical college, technical pedagogical college, or a bachelor's degree from a pedagogical university, technical pedagogical university, must have a teaching profession certificate.

Article 29. Teachers in Vocational Education Centers

1. The titles of teachers in vocational education centers are defined in Clause 3 of Article 53 of the Law on Vocational Education.

2. The Ministry of Labor - Invalids and Social Affairs and the Ministry of Interior shall issue regulations on the standards for teacher positions in vocational education centers as a basis for recruitment, implementation of working conditions, training, and other policies to improve qualifications according to the provisions of the law.

Article 30. Duties and Rights of Teachers

Teachers in vocational education centers perform duties and rights as prescribed in Article 55 of the Law on Vocational Education and the following specific duties and rights:

1. Adhere to the rules, internal regulations, and provisions of the center.

2. Implement the working conditions for teacher positions as prescribed by the Minister of Labor - Invalids and Social Affairs.

3. Be assigned to teach in their specialized fields and trades as trained; select teaching methods and tools to enhance personal capabilities, improve the quality and effectiveness of training; be provided with equipment, tools, and working conditions to fulfill tasks as prescribed by law; be supplied with information related to assigned duties and rights.

4. Enjoy salaries, allowances, subsidies, and other policies as prescribed by law; teachers in public vocational education centers working in areas with particularly difficult socio-economic conditions shall enjoy allowances and preferential policies as prescribed by the Government.

5. Receive training and enhancement of professional knowledge, teaching methods according to the center's plan and conditions; participate in management and supervision of the center's activities; participate in Party and mass organizations' work and social activities as prescribed by law.

6. Protect honor and dignity. Participate in discussions and provide opinions on development plans, program construction, teaching content and methods, organizational management of the center; enjoy summer, holiday, Tet, weekly, and other leave as prescribed by law. Attend meetings established by the center when these councils resolve issues related to students in their assigned classes.

7. Contract to lecture at other vocational education institutions or educational facilities but must fulfill the duties and rights prescribed in Article 55 of the Law on Vocational Education and ensure completion of tasks at their place of work.

8. Enjoy policies prescribed in Article 58 of the Law on Vocational Education and other benefits as prescribed by law.

9. Teachers participating in scientific and technological activities enjoy rights as prescribed in the Law on Science and Technology; teachers engaged in management in vocational education centers if they also teach shall enjoy teacher benefits as prescribed by law and lawful regulations of the center.

10. Participate in managing learners and contribute responsibly to the community.

11. Be subject to the center's supervision on teaching content, quality, methods, and scientific research.

12. Complete other tasks assigned by the center, department, or subject group.

Article 31. Duties and powers of management staff and workers

Management staff and workers performing management and service work at vocational education centers shall strictly fulfill their assigned tasks and responsibilities; they shall enjoy benefits as prescribed by law and in their employment contracts.

Article 32. Recruitment of teachers and management staff and workers

1. Teachers and management staff and workers performing management, teaching, and service work at public vocational education centers shall be recruited in accordance with the laws on civil servants and labor.

2. Teachers and management staff and workers performing management, teaching, and service work at private vocational education centers shall be recruited in accordance with the labor law.

Chapter V. STUDENTS

Article 33. Students

1. Students at vocational education centers as defined in Article 59 of the Vocational Education Law include: students of the basic training program; trainees of the regular training programs specified in Points a, b, c, and d Clause 1 Article 40 of the Vocational Education Law.

2. Students who wish to study under the training programs specified in Points a, b, c, and d Clause 1 Article 40 of the Vocational Education Law and meet the conditions prescribed by law may enter into training contracts with the director of vocational education centers.

Article 34. Duties and rights of students

Students have duties and rights as prescribed in Article 60 of the Vocational Education Law and the following specific duties and rights:

1. Implement the regulations and internal rules of the center; lead a civilized and healthy lifestyle; participate in building, protecting, and promoting the traditions of the center; comply with state laws.

2. Pay tuition fees and miscellaneous fees as prescribed.

3. Participate in labor and social activities, social organizations within the center.

4. Be eligible for shortened or extended program duration, repeating grades; retain academic results according to the provisions of the law.

5. Receive vocational education certificates corresponding to their level and training programs as prescribed.

6. Use the center's equipment and facilities for learning, practice, and internship, and cultural, sports activities. Ensure safety and hygiene conditions during learning, practice, and internship as prescribed by law.

7. Directly or through legitimate representatives of student groups, make suggestions to the center regarding measures to contribute to its development and protect their legitimate rights and interests.

8. Protect the center's property and production facilities where practice and internship take place.

9. Adhere to safety and hygiene regulations.

10. Fulfill temporary work obligations as prescribed by law.

11. Study and train according to the training objectives or training contracts concluded with the center.

12. Enjoy policies for students as prescribed by law.

13. Choose suitable training programs, forms, and locations based on their own abilities and conditions and those of the center; be provided opportunities to switch programs, forms, and locations if they express a desire and are accepted by the new location.

Chapter VI. ASSETS AND FINANCES

Article 35. Management and Use of Assets

1. Public vocational education centers shall manage and use assets in accordance with the provisions of the law regarding land, houses, construction works, production facilities, business, service bases, equipment, assets transferred by the State, and those purchased, constructed, donated, gifted, or subsidized to ensure the training activities of the center.

2. Private vocational education centers shall manage and use assets in accordance with the provisions of the law regarding state-owned land and assets transferred or leased by the State and other assets owned by investors to ensure the training activities of the center.

3. All members of the center shall be responsible for maintaining and protecting the center's assets.

4. Annually, vocational education centers must organize an inventory and re-evaluate the value of the center's assets and implement reporting systems as prescribed by law. Adhere fully to financial, accounting, auditing, tax, statistical, and periodic reporting systems; disclose finances in accordance with the provisions of the law.

Article 36. Sources of Finance

1. Sources of finance for public vocational education centers

a) Budget funds from the State budget, including:

- Regular operating expenses;

- Funds for implementing other tasks assigned by the State;

- Funds for implementing training programs, teacher and management cadre training and development;

- Funds for implementing national target programs;

- Capital investment for basic construction, procurement of equipment for training activities according to approved projects and annual plans;

- Counterpart funds for implementing approved projects;

- Other funds.

b) Revenue from the center’s public services, including:

- Tuition fees and admission fees paid by students;

- Revenue from cooperative training, scientific, technological, production, business, service activities, and other public service activities;

- Dividends from joint venture and cooperation activities, bank deposit interest.

c) Aid, sponsorship, gifts, and donations;

d) Other lawful sources of revenue.

2. Revenue sources for private vocational education centers

a) Tuition fees and admission fees;

b) Revenue from cooperative training, scientific, technological, production, business, service activities in accordance with the law;

c) Dividends from joint venture and cooperation activities; bank deposit interest, bonds;

d) Budget funds from the State budget (if any), including:

- Funds for implementing training tasks ordered by the State;

- Funds for implementing national target programs;

- Funds for implementing teacher and management cadre training programs;

- Sponsorship and interest rate support;

- Other funds.

d) Other sources: Sponsorship, aid, gifts, and donations from organizations and individuals both domestically and internationally.

Article 37. Content of Expenditure

1. Regular expenditures, including:

a) Expenditure on training activities according to assigned functions and tasks;

b) Expenditure on production, business, and service activities of the center, including expenditure for fulfilling the obligation to pay state budget contributions, depreciation of fixed assets, capital repayment, and loan interest payments as prescribed by law.

2. Irregular expenditures, including:

a) Expenditure on implementing target programs;

b) Expenditure on implementing training tasks ordered by the State;

c) Expenditure on implementing teacher and management cadre training and development programs;

d) Counterpart expenditure for implementing projects funded by foreign sources as prescribed;

đ) Expenditure on implementing urgent tasks assigned by competent authorities;

e) Expenditure on constructing physical infrastructure, purchasing assets, and equipment; expenditure on implementing other investment projects as prescribed by the State;

g) Expenditure on joint venture and cooperation activities;

h) Other expenditures as stipulated by law.

Chapter VII.RELATIONSHIPS BETWEEN THE CENTER AND BUSINESSES, FAMILIES, AND SOCIETY

Article 38. Relations between the center and enterprises

The vocational education center has the responsibility to proactively coordinate closely with enterprises in training activities, including:

1. Building and organizing the implementation of training plans to meet the direct production technical workforce needs of enterprises and the labor market.

2. Inviting representatives of related enterprises to participate in the development of the training program and textbooks of the center; participating in teaching, guiding occupational internships, and evaluating students' learning outcomes.

3. Coordinating with enterprises to organize for teachers and students to visit and intern at enterprises, linking teaching and learning with practical production and services.

4. Cooperating with enterprises to train and enhance the occupational skills of enterprise workers when there is a need.

5. Cooperating with enterprises in research, production, application, and technology transfer activities.

Article 39. Relations between the center and the families of students

1. The center has the responsibility to publicly announce the plan, enrollment quotas, admission standards, and policies and benefits for students annually.

2. The center actively coordinates with the families of students to properly carry out educational work aimed at developing the comprehensive personality of students.

Article 40. Relations between the center and society

1. The center implements collaboration with production facilities, scientific research institutions, technology and engineering centers, and other training facilities to create favorable conditions for teachers and students to visit, intern, and practice production, apply technology, thereby linking teaching and learning with actual production.

2. The center regularly coordinates with relevant functional agencies of ministries, sectors, and localities, with production and business facilities to determine training needs, link training with employment and the labor market.

3. The center coordinates with cultural, artistic, and sports facilities to provide opportunities for students to participate in cultural exchange, artistic, and sports activities.

4. The center organizes for management staff, teachers, workers, and students to participate in social activities; coordinating with local authorities, political-social organizations, social organizations, and occupational associations to build a healthy educational environment.

Article 41. Relations between the center and general education schools and vocational education facilities

1. The vocational education center collaborates with junior high schools, high schools, and multi-grade general education schools in implementing general vocational training content and career counseling.

2. Dispatching teachers to teach at local junior high schools, high schools, and multi-grade general education schools to effectively implement the general vocational training program and career counseling.

3. Collaborating and linking with continuing education centers and vocational education facilities to organize training activities as stipulated in Clause 1, Article 7 of this Charter and other relevant laws.

Chapter VIII. IMPLEMENTATION

Article 42. Responsibilities of vocational education centers

Organizing the implementation of the Charter; improving the organizational structure, reviewing all aspects of operations, teacher and management staff regulations to meet the requirements set forth in this Charter; amending, supplementing, or formulating and promulgating internal regulations on organization and operation and other internal rules of the center in accordance with the provisions of this Charter.

Article 43. Responsibilities of the Ministry of Labor, Invalids and Social Affairs

1. Guide the implementation of this Charter within the national vocational education center system; conduct annual statistics and build a database on vocational education centers.

2. Conduct inspections and audits of the implementation of the vocational education center charter, handle violations according to the law; revoke or recommend revocation of decisions contrary to the provisions of this Charter and the law on vocational education.

3. The General Department of Vocational Training shall take the lead and coordinate with units under the Ministry and relevant agencies to guide the organization of implementation and inspection and audit of the vocational education center charter, handle violations according to the law.

Article 44. Responsibilities of the direct management agency of vocational education centers

1. Direct the organization of implementation of the vocational education center charter for subordinate vocational education centers.

2. Coordinate with the Ministry of Labor, Invalids and Social Affairs in managing subordinate vocational education centers; resolve difficulties and obstacles according to the law.

3. Inspect the implementation of this Charter and handle violations of subordinate vocational education centers according to the law.

Article 45. Responsibilities of the People's Committee of the province

1. Directly or coordinate with the Ministry of Labor, Invalids and Social Affairs to direct the organization of implementation of the vocational education center charter for public vocational education centers under the province and private vocational education centers in the locality.

2. Coordinate with the Ministry of Labor, Invalids and Social Affairs in managing vocational education centers located in the locality; resolve difficulties and obstacles according to the law.

3. Inspect and audit the implementation of this Charter within their authority and according to the current administrative division management system; handle violations of vocational education centers in the locality according to the law.

Chapter IX. IMPLEMENTING PROVISIONS11

Article 46. Effective Date

1. This Circular takes effect from February 10, 2015.

2. Repeal Decision No. 13/2007/QĐ-BLĐTBXH dated July 14, 2007 of the Minister of Labor, Invalids and Social Affairs promulgating the Model Charter of Vocational Training Centers.

The provisions on conditions, procedures, and formalities for appointing, recognizing, reappointing, and rerecognizing directors of vocational training centers stipulated in Clause 6, Article 3, Article 5, and the provisions on procedures, files, authorities for appointing, recognizing, reappointing, and rerecognizing directors of vocational training centers stipulated in Chapter III of Circular No. 42/2010/TT-BLĐTBXH dated December 31, 2010 of the Minister of Labor, Invalids and Social Affairs on the appointment, recognition, reappointment, and rerecognition of principals of vocational colleges and intermediate vocational schools and directors of vocational training centers cease to be effective from the date this Circular takes effect.

3. During the implementation process, if there are difficulties, please reflect them to the Ministry of Labor, Invalids, and Social Affairs for guidance./.

Circular No. 05/2020/TT-BLDTBXH dated August 16, 2020, issued by the Minister of Labor, Invalids, and Social Affairs, stipulates the regulations on organization and operation of public vocational education centers at the district level, based on the following grounds:

Circular No. 08/2023/TT-BLDTBXH dated August 29, 2023, issued by the Minister of Labor, Invalids, and Social Affairs, amending, supplementing, and abolishing certain articles of related Circulars and Joint Circulars concerning the submission and presentation of paper household registration books, temporary residence books, or other documents requiring confirmation of place of residence when performing administrative procedures under the jurisdiction of the Ministry of Labor, Invalids, and Social Affairs, based on the following grounds:

Based on the Residence Law dated November 13, 2020;

Pursuant to the Law on Issuing Legal Documents dated June 22, 2015 and the Law Amending and Supplementing Certain Provisions of the Law on Issuing Legal Documents dated June 18, 2020;

Based on Decree No. 62/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Pursuant to Decree No. 104/2022/NĐ-CP dated December 21, 2022, of the Government amending and supplementing certain articles of related Decrees concerning the submission and presentation of paper household registration books and temporary residence books when performing administrative procedures and providing public services;

The Minister of Labor, Invalids, and Social Affairs hereby issues this Circular amending, supplementing, and abolishing certain articles of related Circulars and Joint Circulars issued by the Minister of Labor, Invalids, and Social Affairs.

2 This Clause is added pursuant to Clause 2, Article 45 of Circular No. 05/2020/TT-BLDTBXH dated August 16, 2020, issued by the Minister of Labor, Invalids, and Social Affairs, stipulating the regulations on organization and operation of public vocational education centers at the district level, taking effect from October 1, 2020.

10 This Section includes Articles 17 and 18 which were abolished pursuant to Clause 4 of Article 5 of Circular No. 18/2018/TT-BLDTBXH dated October 30, 2018, issued by the Minister of Labor, Invalids and Social Affairs to amend and supplement certain provisions of several Circulars related to administrative procedures within the scope of the State management functions of the Ministry of Labor, Invalids and Social Affairs, effective from December 18, 2018.

11 Article 23, 24, and 25 of Decree No. 143/2016/NĐ-CP dated October 14, 2016, issued by the Government on conditions for investment and operation in the vocational education sector, effective from October 14, 2016, are stipulated as follows:

"Article 23. Transitional Provisions

1. Agencies, organizations, and individuals who have submitted applications for establishing vocational training institutions, intermediate-level colleges, and higher-level colleges to competent authorities in accordance with the Vocational Training Law No. 76/2006/QH11, the Education Law No. 38/2005/QH11 amended and supplemented by Law No. 44/2009/QH12, and the Higher Education Law No. 08/2012/QH13 shall be responsible for completing their application files for the competent authorities to consider and decide on establishment and permission to establish vocational education institutions in accordance with this Decree.

2. Vocational training institutions, intermediate-level colleges, higher-level colleges, higher education institutions, enterprises that have submitted registration forms for vocational training activities, supplementary registration forms for vocational training activities, and registration forms for intermediate-level and higher-level training programs to competent authorities in accordance with the Vocational Training Law No. 76/2006/QH11, the Education Law No. 38/2005/QH11 amended and supplemented by Law No. 44/2009/QH12, and the Higher Education Law No. 08/2012/QH13 shall be responsible for completing their application files for the competent authorities to consider and issue certificates of registration for vocational education activities in accordance with this Decree.

3. In cases where the name of the specialized agency assisting the Minister of Labor, Invalids and Social Affairs in state management of vocational education (General Department of Vocational Training) changes, it shall be implemented according to the new name.

Article 24. Implementation Organization

1. The Ministry of Labor, Invalids and Social Affairs is the central state management agency for vocational education and has the responsibility to:

a) Specify the management and organization of training through online formats or direct training combined with online training;

b) Direct the General Department of Vocational Education to:

Guide the flexible scale of annual admissions among different trades, professions, and training levels specified in the certificate of registration for vocational education activities and the certificate of supplementary registration for vocational education activities.

Annually, conduct post-inspection of the conditions ensuring the organization of vocational education activities of higher-level colleges after issuing the certificate of registration for vocational education activities and the certificate of supplementary registration for vocational education activities.

Guide the updating of data on the registration of vocational education activities.

Guide, inspect, supervise the implementation of regulations on conditions for investment and operation in the vocational education sector, and handle violations in accordance with this Decree and relevant laws.

2. Ministries and central agencies of political and social organizations have the responsibility to:

a) Direct, urge, and monitor the implementation of regulations on conditions for investment and operation in the vocational education sector within their jurisdiction;

b) Report periodically every six months and annually on the implementation of regulations on conditions for investment and operation in the vocational education sector within their jurisdiction according to Model No. 01 of Appendix VII issued together with this Decree to the Ministry of Labor, Invalids and Social Affairs (General Department of Vocational Education) for monitoring and management;

c) Inspect and supervise the implementation of regulations on conditions for investment and operation in the vocational education sector within their jurisdiction, and handle violations in accordance with this Decree and relevant laws.

3. Provincial People's Committees have the responsibility to:

a) Direct the Department of Labor, Invalids and Social Affairs and other specialized agencies under provincial People's Committees to inspect and supervise the implementation of regulations on conditions for investment and operation in the vocational education sector within their jurisdiction, and handle violations in accordance with this Decree and relevant laws;

b) Direct the Department of Labor, Invalids and Social Affairs to:

Conduct post-inspection of the conditions ensuring the organization of vocational education activities of intermediate-level colleges, vocational education centers, vocational education and general education centers, and enterprises after issuing the certificate of registration for vocational education activities and the certificate of supplementary registration for vocational education activities.

Report periodically every six months and annually on the implementation of regulations on conditions for investment and operation in the vocational education sector within their jurisdiction according to Model No. 01 and Model No. 02 of Appendix VII issued together with this Decree to the General Department of Vocational Education for monitoring and management.

4. Vocational education institutions, vocational education and general education centers, and enterprises registered for vocational education activities have the responsibility to:

a) Private vocational education institutions and vocational education institutions with foreign investment must develop a roadmap to prepare the conditions for self-determination to open training programs in accordance with Clause 3 of Article 14 of this Decree to ensure that from January 1, 2024, if they meet the conditions, they can implement self-determination to open training programs in accordance with the regulations;

b) Within 36 months for intermediate-level colleges and higher-level colleges and 24 months for vocational education centers, from the date the decision on establishment or permission to establish becomes effective, intermediate-level colleges, higher-level colleges, and vocational education centers must complete the registration for vocational education activities;

c) Within 24 months from the date of issuance of the certificate of registration for vocational education activities and the certificate of supplementary registration for vocational education activities, vocational education institutions, vocational education and general education centers, and enterprises must organize training activities in accordance with the certificates issued by the competent authorities.

d) The basis has been issued with a certificate of registration for vocational education activities, or a supplementary certificate of registration for vocational education activities, may flexibly adjust the annual enrollment scale among different trades, professions, and training levels within the same group of trades, professions at the third-level code or between primary level occupations with the same name as those of college and intermediate level professions, or among primary level occupations within the same group of primary level training when meeting the conditions to ensure the registration of vocational education activities for each profession and trade after adjustment in accordance with Clause 1 and Clause 2 of Article 14 of this Decree.

The annual enrollment scale of each profession and trade after adjustment shall not exceed 10% of the total annual enrollment scale of all professions and trades within the same group of professions and trades at each training location specified in the certificate of registration for vocational education activities or the supplementary certificate of registration for vocational education activities.

The institution must publicly disclose the annual enrollment scale of each profession and trade after adjustment on its website and report to the competent authority issuing the certificate of registration for vocational education activities.

đ) When changing the contents recorded in the certificate of registration for vocational education activities, if such changes do not fall under the cases of supplementary registration for vocational education activities as stipulated in Article 18 of this Decree, the institution must report the changed contents to the competent authority issuing the certificate for monitoring and management;

e) The head of the vocational education institution, the vocational education center - general education center, or the autonomous enterprise decides the admission quota for each profession and training level according to each training form within the total annual enrollment scale specified in the certificate of registration for vocational education activities or the supplementary certificate of registration for vocational education activities;

g) Manage and use the certificate of registration for vocational education activities and the supplementary certificate of registration for vocational education activities in accordance with regulations. In case of loss, damage, or tearing, the institution must report to the competent authority issuing the certificate and provide a clear explanation;

h) Publicize the certificate of registration for vocational education activities, the supplementary certificate of registration for vocational education activities, and the conditions ensuring the organization of vocational education activities for each profession and training level specified in the certificate or in the decision on autonomous establishment of training programs on the institution's website (excluding contents classified as state secrets). Send the results of publicizing to the Department of Labor, Invalids, and Social Affairs where the vocational education activities take place for monitoring and management;

i) Update vocational education certificates and certificates issued by the institution on the Vocational Education Certificate Search Information Website at http://vanbang.gdnn.gov.vn;

k) A vocational education institution, vocational education center - general education center, or enterprise that violates the registration of vocational education activities to the extent that it must suspend vocational education activities shall not be allowed to apply for supplementary registration of vocational education activities for a period of 12 months from the date the cause leading to suspension is resolved.

Article 25. Effective Date

1. This Decree takes effect from October 14, 2016.

2. The following documents cease to be effective from the date this Decree takes effect:

a) Circular No. 24/2011/TT-BLDTBXH dated September 21, 2011, issued by the Minister of Labor, Invalids, and Social Affairs, regarding the establishment, permission to establish, division, separation, merger, dissolution of vocational colleges, intermediate vocational schools, and vocational training centers;

b) Circular No. 29/2011/TT-BLDTBXH dated October 24, 2011, issued by the Minister of Labor, Invalids, and Social Affairs, regarding the registration of vocational training activities;

c) Circular No. 25/2015/TT-BLDTBXH dated July 13, 2015, issued by the Minister of Labor, Invalids, and Social Affairs, regarding the registration of vocational education activities, issuance, revocation of certificates of registration for vocational education activities, and suspension of vocational education activities at the primary level.

3. Repeal Article 7 and Article 8 of the Charter of Vocational Colleges issued together with Circular No. 01/2015/TT-BGDĐT dated January 15, 2015, issued by the Minister of Education and Training, regarding the Charter of Vocational Colleges.

4. Repeal Chapter II and Article 30 of the Charter of Intermediate Specialized Schools issued together with Circular No. 54/2011/TT-BGDĐT dated November 15, 2011, issued by the Minister of Education and Training, regarding the Charter of Intermediate Specialized Schools.

5. Repeal the provisions on conditions, procedures, and formalities for establishing, merging, dividing, separating, suspending operations, and dissolving vocational colleges as stipulated in Circular No. 14/2009/TT-BGDĐT dated May 28, 2009, issued by the Minister of Education and Training, regarding the Charter of Vocational Colleges, Article 1 of Circular No. 43/2011/TT-BGDĐT dated October 4, 2011, amending and supplementing certain articles of Circular No. 14/2009/TT-BGDĐT, and Decision No. 37/2000/QĐ-BGD&ĐT dated August 29, 2000, issued by the Minister of Education and Training, regarding the Interim Regulations on Community Vocational Colleges.

6. Repeal the term "branch" in Clause 3, Article 3 of Circular No. 57/2015/TT-BLDTBXH dated December 25, 2015, issued by the Minister of Labor, Invalids, and Social Affairs, regarding the Charter of Vocational Education Centers.

7. Repeal the provisions on the college level, vocational colleges; Article 3; point b, Clause 3 and point b, Clause 5 of Article 6 of Circular No. 08/2011/TT-BGDĐT dated February 17, 2011, issued by the Minister of Education and Training, regarding the conditions, dossier, procedure for opening training programs, suspending admissions, and revoking decisions on opening training programs at the university and college levels."

Article 10 and 11 of Circular No. 18/2018/TT-BLDTBXH dated October 30, 2018, issued by the Minister of Labor, Invalids, and Social Affairs to amend and supplement certain provisions of related circulars concerning administrative procedures within the scope of the Ministry's state management functions, shall take effect from December 18, 2018, and are stipulated as follows:

Article 10. Transitional Provisions

Administrative procedure application files that have been received by the administrative procedure implementing agency but not yet resolved before the date this Circular takes effect shall be implemented according to the provisions of this Circular.

Article 11. Implementation Provisions

1. This Circular shall take effect from December 18, 2018.

2. During the implementation process, if there are any difficulties, they should be promptly reflected to the Ministry of Labor, Invalids, and Social Affairs for research and amendment to ensure appropriateness./”

Article 45 of Circular No. 05/2020/TT-BLDTBXH dated August 16, 2020, issued by the Minister of Labor, Invalids, and Social Affairs, stipulates the organizational regulations and activities of public vocational education centers at the district level, which shall take effect from October 1, 2020, and are stipulated as follows:

Article 45. Effective Date

1. This Circular shall take effect from October 1, 2020.

2. Supplement Clause 3 to Article 1 of Circular No. 57/2015/TT-BLDTBXH dated December 25, 2015, issued by the Minister of Labor, Invalids, and Social Affairs, regarding the Charter of vocational education centers as follows: "3. This Charter does not apply to Public Vocational Education Centers at the District Level."

3. During the implementation process, if there are any difficulties, they should be reflected to the Ministry of Labor, Invalids, and Social Affairs for guidance./.”

Article 5 of Circular No. 08/2023/TT-BLDTBXH dated August 29, 2023, issued by the Minister of Labor, Invalids, and Social Affairs, amending, supplementing, and abolishing certain provisions of related Circulars and Joint Circulars concerning the submission, presentation of paper household registration books, temporary residence books, or other documents requiring confirmation of place of residence when performing administrative procedures under the Ministry's jurisdiction, shall take effect from October 12, 2023, and are stipulated as follows:

Article 5. Implementation Provisions

1. This Circular shall take effect from October 12, 2023.

2. Paperwork models that are part of the administrative procedure application files received before the date this Circular takes effect and not yet completed shall continue to be processed according to the provisions of the Circulars and Joint Circulars not amended, supplemented, or abolished by this Circular.

The Director of the Legal Department, Heads of State Management Units under the Ministry of Labor, Invalids, and Social Affairs, and relevant agencies, organizations, and individuals shall be responsible for implementing this Circular. During the implementation process, if there are any difficulties, they should be promptly reflected to the Ministry of Labor, Invalids, and Social Affairs for study and resolution./.”

12 Model No. 1 is abolished pursuant to Clause 1, Article 5 of Circular No. 18/2018/TT-BLDTBXH dated October 30, 2018, issued by the Minister of Labor, Invalids, and Social Affairs to amend and supplement certain provisions of related Circulars concerning administrative procedures within the scope of the Ministry's state management functions, which shall take effect from December 18, 2018.

13 Model No. 2 is abolished pursuant to Clause 1, Article 5 of Circular No. 18/2018/TT-BLDTBXH dated October 30, 2018, issued by the Minister of Labor, Invalids, and Social Affairs to amend and supplement certain provisions of related Circulars concerning administrative procedures within the scope of the Ministry's state management functions, which shall take effect from December 18, 2018

14 Model No. 3 is abolished pursuant to Clause 1, Article 5 of Circular No. 18/2018/TT-BLDTBXH dated October 30, 2018, issued by the Minister of Labor, Invalids, and Social Affairs to amend and supplement certain provisions of related Circulars concerning administrative procedures within the scope of the Ministry's state management functions, which shall take effect from December 18, 2018.

15 Model No. 4 is abolished pursuant to Clause 1, Article 5 of Circular No. 18/2018/TT-BLDTBXH dated October 30, 2018, issued by the Minister of Labor, Invalids, and Social Affairs to amend and supplement certain provisions of related Circulars concerning administrative procedures within the scope of the Ministry's state management functions, which shall take effect from December 18, 2018.

16 Model No. 5 is abolished pursuant to Clause 1, Article 5 of Circular No. 18/2018/TT-BLDTBXH dated October 30, 2018, issued by the Minister of Labor, Invalids, and Social Affairs to amend and supplement certain provisions of related Circulars concerning administrative procedures within the scope of the Ministry's state management functions, which shall take effect from December 18, 2018.

17 Model No. 6 is abolished pursuant to Clause 1, Article 5 of Circular No. 18/2018/TT-BLDTBXH dated October 30, 2018, issued by the Minister of Labor, Invalids, and Social Affairs to amend and supplement certain provisions of related Circulars concerning administrative procedures within the scope of the Ministry's state management functions, which shall take effect from December 18, 2018.

18 Model No. 7 is abolished pursuant to Clause 1, Article 5 of Circular No. 18/2018/TT-BLDTBXH dated October 30, 2018, issued by the Minister of Labor, Invalids, and Social Affairs to amend and supplement certain provisions of related Circulars concerning administrative procedures within the scope of the Ministry's state management functions, which shall take effect from December 18, 2018.

19 Model No. 8 is amended pursuant to Point c, Clause 3, Article 1 of Circular No. 08/2023/TT-BLDTBXH dated August 29, 2023, issued by the Minister of Labor, Invalids, and Social Affairs, amending, supplementing, and abolishing certain provisions of related Circulars and Joint Circulars concerning the submission, presentation of paper household registration books, temporary residence books, or other documents requiring confirmation of place of residence when performing administrative procedures under the Ministry's jurisdiction, which shall take effect from October 12, 2023.
