Pursuant to Decree No. 62/2013/NĐ-CP dated June 25, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Pursuant to Decision No. 48/2014/QĐ-TTg dated August 28, 2014 of the Prime Minister on policies to support poor households in constructing houses to prevent typhoons and floods in the Central Region;

The Minister of Construction hereby issues this Circular to regulate the issuance of real estate brokerage practice certificates; guide the operation of real estate trading floors.

The Minister of Construction issues this Circular guiding the implementation of Decision No. 48/2014/QĐ-TTg dated August 28, 2014 of the Prime Minister on policies to support poor households in constructing houses to prevent typhoons and floods in the Central Region (hereinafter referred to as Decision No. 48/2014/QĐ-TTg).

Article 1. Scope of Regulation and Applicability

Thông tư này quy định chi tiết khoản 4 Điều 38 Luật Thủy sản số 18/2017/QH14 đã được sửa đổi, bổ sung tại điểm c khoản 21 Điều 14 Luật số 146/2025/QH15.

This Circular stipulates contents regarding the determination of beneficiaries, conditions, methods of support, and the organization and implementation of support for poor households in constructing houses to prevent typhoons and floods in rural areas or residing in villages, hamlets, villages, communes, wards, villages, and settlements (hereinafter referred to as villages) under towns, districts, and cities in 14 provinces and cities: Thanh Hoa, Nghe An, Ha Tinh, Quang Binh, Quang Tri, Thua Thien-Hue, Da Nang, Quang Nam, Quang Ngai, Binh Dinh, Phu Yen, Khanh Hoa, Ninh Thuan, and Binh Thuan, as provided for in Decision No. 48/2014/QĐ-TTg.

As for management, allocation, payment, and settlement of funds for supporting poor households in constructing houses to prevent typhoons and floods (including costs for managing the implementation of Decision No. 48/2014/QĐ-TTg), it shall be carried out according to the guidelines of the Ministry of Finance.

a) Households eligible for support under the provisions of Decision No. 48/2014/QĐ-TTg.

b) Relevant organizations and individuals.

Article 2. Principles of Support

1. The State provides direct support to households within the scope of beneficiaries as prescribed.

2. Support must ensure democracy, transparency, fairness, and clarity based on laws and policies of the State.

3. Construction of houses must be appropriate to practical conditions, customs, and traditions of each ethnic group and region, and integrated with local new rural construction plans.

4. Support for constructing houses to prevent typhoons and floods follows the principle: The State supports, communities assist, and households participate to build houses that meet specified standards and quality requirements; combining with other central and local investment and support programs to enhance policy effectiveness.

5. After receiving support, households must construct or renovate existing houses to ensure they can withstand typhoons and floods.

Article 3. Determination of Beneficiaries for Housing Support to Prevent Typhoons and Floods

Beneficiaries of housing support to prevent typhoons and floods as stipulated in Decision No. 48/2014/QĐ-TTg must satisfy the following conditions:

1. They are poor households according to the poverty standard set forth in Decision No. 09/2011/QĐ-TTg dated January 30, 2011,

2. Households without permanent houses or those with permanent houses but without floors higher than the usual flood level at their residence. The minimum flood level is 1.5 meters and is measured from the ground floor to the highest flood level at the construction site. Areas with regular flooding are those with a frequency of at least two consecutive years or three non-consecutive years within five years. The flood level and areas with regular flooding are determined by specialized agencies designated by the provincial People's Committee.

3. In cases where households belonging to the category defined in Clause 1 of this Article have been supported for housing through other national and local housing support programs and organizations but still lack floors above the flood level as stipulated in Clause 2 of this Article, they are eligible for support under Decision No. 48/2014/QĐ-TTg, except for those who have already received housing support under Decision No. 22/2013/QĐ-TTg dated April 26, 2013,

Article 4. Procedures for establishing and approving lists of poor households to be supported in constructing houses to prevent typhoons and floods

1. Villages shall organize reviews of poor households requesting support for constructing houses to prevent typhoons and floods. The village head shall convene meetings to disseminate the main contents of the policy supporting poor households in constructing houses to prevent typhoons and floods according to Decision No. 48/2014/QĐ-TTg to all households; organize reviews of poor households requesting support for constructing houses to prevent typhoons and floods based on the list of poor households (minutes of the meeting according to the poverty standard stipulated in Decision No. 09/2011/QĐ-TTg dated January 30, 2011 of the Prime Minister on issuing the poverty standard applicable from 2011 to 2015) managed by the People's Committee at the commune level.

The meeting must have representatives of at least 60% of the households in the village and the participation of representatives of the local authority, the Vietnam Fatherland Front at the commune level, and the village head (according to the model attached as Appendix I to this Circular). Reviews shall follow the principles of democracy, transparency, fairness, and openness. Households included in the list of those requesting support must be agreed upon by more than 50% of the participants in the meeting (through raising hands or secret ballot voting). Villages shall guide households whose names are on the approved list to submit applications for support in constructing houses to prevent typhoons and floods (according to the model attached as Appendix II to this Circular).

Lists of poor households requesting support for constructing houses to prevent typhoons and floods in villages shall be arranged in order of priority as prescribed in Decision No. 48/2014/QĐ-TTg and made public in the village. Depending on specific characteristics, conditions, and circumstances, localities may provide support first to households that meet the requirements and are ready for house construction to ensure compliance with the specified schedule.

2. The People's Committee at the commune level shall be responsible for reviewing and compiling the needs of villages (lists, number of households, capital for constructing houses to prevent typhoons and floods) and submitting them to the People's Committee at the district level for approval.

3. The People's Committee at the district level shall compile and approve the list of poor households to be supported in constructing houses to prevent typhoons and floods within its jurisdiction, while simultaneously reporting to the People's Committee at the provincial level.

4. Based on the report of the People's Committee at the district level, the People's Committee at the provincial level shall direct the Department of Construction to take the lead and coordinate with relevant departments to develop and submit to the People's Committee at the provincial level for approval a plan to support poor households in constructing houses to prevent typhoons and floods in the province or centrally-administered city according to the guidelines of the Ministry of Construction. After approval, the People's Committee at the provincial level shall send the plan to the Ministry of Construction, the Ministry of Planning and Investment, the Ministry of Finance, and the Social Policy Bank for consolidation and reporting to the Prime Minister.

Article 5. Methods for constructing houses to prevent typhoons and floods

1. Technical and Quality Requirements for Housing

a) The People's Committee at the provincial level shall direct competent agencies to study and design a minimum of three typical models of houses to prevent typhoons and floods suitable for the customs and traditions of each locality (accompanied by cost estimates and projections of major materials). These designs must meet the minimum criteria regarding area, quality, and ensuring protection against typhoons and floods, with reasonable height to allow the use of the space below the floor during normal times above flood levels. Localities shall organize the introduction of these design models for people to refer to and choose from. Respect the wishes of the people, do not compel households to construct houses to prevent typhoons and floods according to the design models. Depending on specific conditions, households may construct according to experience and tradition, fitting their economic and living conditions, but must meet the minimum criteria regarding area and quality and ensure protection against typhoons and floods. In addition to design models, localities shall provide specific guidance for cases involving renovation and adding floors for houses to prevent typhoons and floods.

b) Houses to prevent typhoons and floods or renovations and additions for floors to prevent typhoons and floods must ensure a floor height higher than the highest flood level at the construction site; a minimum usable floor area of 10 square meters; main structures such as foundations, frames, floors, and roofs equivalent to the structures of solidly constructed houses (houses with components: reinforced concrete foundations, bricks/stones; reinforced concrete columns and walls, steel/iron/wood beams坚固耐用;地板和屋顶由坚固的钢筋混凝土或木头制成。对于同时遭受洪水和台风影响的地区,屋顶应使用钢筋混凝土或高质量的瓦片材料,以确保防风能力。

2. Organization of Housing Construction

a) Households listed to receive support for constructing houses to prevent typhoons and floods must submit an application for support in constructing houses (according to the model attached as Appendix II to this Circular), proposing the selection of house models and construction methods (self-construction or assistance from organizations and associations);

b) Households shall organize the construction of houses to prevent typhoons and floods or carry out renovations and additions for floors to prevent typhoons and floods themselves. For households in difficult circumstances (elderly, single, disabled) who are unable to construct houses themselves, the People's Committee at the commune level shall direct the Communist Youth Union and other organizations and associations at the local level to organize the construction of houses for these groups;

c) Households must report to the People's Committee at the commune level when completing tasks according to the stages specified or completing the entire project to organize acceptance as the basis for timely disbursement and settlement of funds;

d) The People's Committee at the commune level shall be responsible for monitoring and assisting households during the construction of houses to prevent typhoons and floods or carrying out renovations and additions for floors to prevent typhoons and floods; establish minutes confirming completion by stage and minutes confirming completion of the project for use (according to the models attached as Appendices III and IV to this Circular); mobilize organizations and associations such as the Vietnam Fatherland Front, Women's Union, Farmers' Association, Veterans' Association, and the Communist Youth Union to assist poor households in constructing houses to prevent typhoons and floods; maximize the mobilization of resources from the community and households, utilizing and exploiting local materials such as sand, gravel, pebbles, and wood to reduce construction costs.

e) The People's Committee at the commune level shall direct and supervise households to use the support capital and loan capital for housing construction in accordance with the intended purpose, ensuring that the houses must be completed to be put into use.

Article 6. Implementation Organization

1. Responsibilities of Ministries and sectors

a) The Ministry of Construction shall serve as the permanent agency, take the lead, and coordinate with the Ministries and sectors: Planning and Investment, Finance, Labor - Invalids and Social Affairs, and the Vietnam Social Policy Bank to assist the Prime Minister in compiling, monitoring, urging, inspecting, and reporting on the implementation situation in accordance with regulations, resolving difficulties within their authority, or submitting matters exceeding their authority to the Prime Minister for consideration and resolution.

b) The Ministries and sectors: Planning and Investment, Finance, State Bank of Vietnam, Government Ethnic Committee, and the Vietnam Social Policy Bank shall base on the contents of Decision 48/2014/QĐ-TTg and this Circular to coordinate with the Ministry of Construction to implement the contents within their functions as assigned by the Government.

2. Responsibilities of the People's Committee at the provincial level:

a) To improve the Provincial Steering Committee for implementing poverty reduction policies to direct the implementation of policies supporting poor households to build storm and flood-resistant housing; assign the Department of Construction to serve as the permanent agency directing the implementation or assign the Provincial Steering Committee on Housing Policy and Real Estate Market to implement the policy supporting poor households to build storm and flood-resistant housing as stipulated in Decision 48/2014/QĐ-TTg;

b) To organize the implementation of policies supporting poor households to build storm and flood-resistant housing within its jurisdiction in accordance with regulations, suitable to local conditions, ensuring that assistance reaches the correct recipients, serves the intended purpose, and is effective. Allocate support funds from the local budget and management fees as prescribed in Decision 48/2014/QĐ-TTg. In addition to the funds and amounts specified in Decision 48/2014/QĐ-TTg, depending on actual conditions, provinces and centrally governed cities may provide additional support from the local budget to enhance the quality of storm and flood-resistant housing for households;

c) To organize the development and approval of the Plan to Support Poor Households in Building Storm and Flood-Resistant Housing within its jurisdiction and submit the approved Plan to the Ministry of Construction as the leading agency, while also sending it to the Ministry of Planning and Investment, the Ministry of Finance, and the Vietnam Social Policy Bank for consolidation and reporting;

d) To direct relevant agencies, local authorities at all levels to cooperate with organizations and mass organizations within the locality to mobilize community support and assistance for poor households to build storm and flood-resistant housing;

e) To regularly inspect and supervise the implementation to ensure that the policy reaches each poor household eligible for support under Decision 48/2014/QĐ-TTg; prevent any loss or corruption; ensure that poor households have storm and flood-resistant housing after receiving support as prescribed; take preventive measures against unauthorized transfer of storm and flood-resistant housing;

g) To report monthly according to Appendix V attached to this Circular and quarterly according to Appendix VI attached to this Circular on the results of implementation to the Ministry of Construction for consolidation and reporting;

h) To develop the annual funding plan for policy implementation (including all sources of funding), report on progress and disbursement results, and send them to the Ministry of Construction, the Ministry of Planning and Investment, the Ministry of Finance, and the Vietnam Social Policy Bank as a basis for consolidating the support funding and loan plans;

i) To direct the dissemination and popularization of the policy supporting poor households to build storm and flood-resistant housing to the public through local media such as newspapers, radio stations, posters, leaflets, and brochures. Publicly announce the standards and beneficiaries of the policy;

k) To issue guidelines in accordance with the contents of this Circular to ensure suitability with the characteristics and conditions of the locality to effectively implement the policy supporting poor households to build storm and flood-resistant housing;

3. Responsibilities of the People's Committee at the district level:

a) To improve the District Steering Committee for implementing poverty reduction policies to direct, inspect, and urge the implementation of Decision 48/2014/QĐ-TTg;

b) To compile and approve within their authority the list of poor households supported to build storm and flood-resistant housing within their jurisdiction;

4. Responsibilities of the People's Committee at the commune level:

a) Strengthen the Poverty Reduction Board at the commune level to implement the Policy;

b) To review and compile the list of households to be supported, and simultaneously prepare the list of households requiring loans to be submitted for approval by the People's Committee at the district level;

c) To organize the acceptance and confirmation of the volume of completed foundation construction for new households or the completion of 30% of the construction work above the flood level for households renovating and adding floors to existing houses, and confirm the completion of the construction project for use as the basis for disbursing and settling the support funds and loan funds as prescribed. Each type of record shall be made in three copies: one copy retained by the household head, one copy sent to the district-level Finance and Planning Office, and one copy compiled by the commune-level People's Committee and sent to the Vietnam Social Policy Bank for loan disbursement;

d) To prepare the completion files for each household supported in building storm and flood-resistant housing, including: - A list of poor households supported to build storm and flood-resistant housing; - Application forms for support to build storm and flood-resistant housing from households; - Records confirming the completion of storm and flood-resistant housing construction in stages and records confirming the completion of storm and flood-resistant housing for use; - Disbursement vouchers for support funds; - Loan vouchers for housing construction;

5. The Real Estate Management Agency has the responsibility to assist the Minister of Construction in guiding, urging, and inspecting the implementation of support for poor households to build storm and flood-resistant housing; to consolidate and report on the implementation situation periodically, and to propose amendments and supplements to be considered and issued by the Minister of Construction within their authority, or reported to the Prime Minister for consideration and decision;

Article 7. Implementation Provisions

1. This Circular takes effect from December 10, 2014.

2. Ministries, ministerial-level agencies, People's Committees at all levels, organizations, and individuals concerned are responsible for implementing this Circular. During the implementation process, if any difficulties arise, they should promptly reflect them to the Ministry of Construction for amendment and supplementation or report to the Prime Minister for consideration and decision. /./
