Quy định chi tiết một số điều của Nghị định số 107/2018/NĐ-CP ngày 15 tháng 8 năm 2018 của Chính phủ về kinh doanh xuất khẩu gạo
Thông tư số 30/2018/TT-BCT ngày 01 tháng 10 năm 2018 của Bộ trưởng Bộ Công Thương quy định chi tiết một số điều của Nghị định số 107/2018/NĐ-CP ngày 15 tháng 8 năm 2018 của Chính phủ về kinh doanh xuất khẩu gạo, có hiệu lực thi hành kể từ ngày 15 tháng 11 năm 2018, được sửa đổi, bổ sung bởi:

Căn cứ Nghị định số 98/2017/NĐ-CP ngày 18 tháng 8 năm 2017 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Công Thương;
Căn cứ Nghị định số 107/2018/NĐ-CP ngày 15 tháng 8 năm 2018 của Chính phủ về kinh doanh xuất khẩu gạo (sau đây viết tắt là Nghị định số 107/2018/NĐ-CP);
Theo đề nghị của Cục trưởng Cục Xuất nhập khẩu,
Bộ trưởng Bộ Công Thương ban hành Thông tư quy định chi tiết một số điều của Nghị định số 107/2018/NĐ-CP ngày 15 tháng 8 năm 2018 của Chính phủ về kinh doanh xuất khẩu gạo.[1]
Chương I
QUY ĐỊNH CHUNG
Điều 1. Phạm vi điều chỉnh
Thông tư này quy định về:
1. Giao dịch xuất khẩu gạo vào thị trường có hợp đồng tập trung và việc ký kết, tổ chức thực hiện hợp đồng tập trung.
2. Chế độ báo cáo của thương nhân kinh doanh xuất khẩu gạo.
Điều 2. Đối tượng áp dụng
Thông tư này áp dụng đối với thương nhân kinh doanh xuất khẩu gạo và cơ quan, tổ chức, cá nhân có liên quan.
Chương II
GIAO DỊCH XUẤT KHẨU GẠO VÀO THỊ TRƯỜNG CÓ HỢP ĐỒNG TẬP TRUNG VÀ VIỆC KÝ KẾT, TỔ CHỨC THỰC HIỆN HỢP ĐỒNG TẬP TRUNG
Điều 3. Chỉ định thương nhân đầu mối giao dịch
1. Việc chỉ định thương nhân đầu mối giao dịch hợp đồng tập trung căn cứ vào các tiêu chí quy định tại khoản 2 Điều 19 Nghị định số 107/2018/NĐ-CP.
2. Trường hợp từ hai thương nhân trở lên được chỉ định làm đầu mối tại một thị trường có hợp đồng tập trung thì thực hiện cơ chế đầu mối luân phiên theo quy định tại Điều 4 Thông tư này.
Điều 4. Cơ chế Đầu mối luân phiên
1. Cơ chế đầu mối luân phiên là cơ chế được áp dụng khi có từ hai thương nhân trở lên được chỉ định làm đầu mối tại một thị trường có hợp đồng tập trung nhưng cơ quan có thẩm quyền, hoặc nhà nhập khẩu nước ngoài được chỉ định yêu cầu mỗi đợt đấu thầu nhập khẩu gạo theo hợp đồng tập trung chỉ có một thương nhân được tham gia ký kết, giao dịch hợp đồng.
2. Trình tự cơ chế đầu mối luân phiên như sau:
a) Chậm nhất là 01 ngày kể từ ngày nhận được thông báo của nước nhập khẩu về việc nhập khẩu gạo, thương nhân đến lượt luân phiên báo cáo Bộ Công Thương và Hiệp hội Lương thực Việt Nam về khả năng tham gia đợt đấu thầu.
Trường hợp thương nhân đầu mối đến lượt luân phiên kiến nghị không tham gia thì phải báo cáo rõ nguyên nhân với Bộ Công Thương, thông báo với Hiệp hội Lương thực Việt Nam và (các) thương nhân đầu mối khác.
b) Chậm nhất là 01 ngày kể từ ngày nhận được kiến nghị từ chối tham gia đấu thầu của thương nhân đầu mối đến lượt luân phiên, thương nhân đầu mối đến lượt luân phiên liên tiếp theo trao đổi thống nhất với Hiệp hội Lương thực Việt Nam về khả năng tham gia đấu thầu.
Việc thay thế đi giao dịch, dự thầu sẽ không được tính là lượt luân phiên của thương nhân được cử đi thay thế và thương nhân được tiếp tục tham gia dự thầu đợt đấu thầu tiếp theo theo đúng lượt luân phiên chính thức của mình.
c) Trường hợp tất cả các thương nhân đầu mối không tham gia đợt đấu thầu, Hiệp hội Lương thực Việt Nam báo cáo Bộ Công Thương lý do các thương nhân đầu mối không tham dự và có thể đề xuất thương nhân khác tham gia giao dịch, dự thầu.
d) Thương nhân tham gia đợt đấu thầu báo cáo Bộ Công Thương trong trường hợp cần hỗ trợ thủ tục liên quan đến việc giao dịch, dự thầu.
3. Phân bổ chỉ tiêu cho các thương nhân đầu mối theo cơ chế luân phiên như sau:
Thương nhân đầu mối theo cơ chế luân phiên được trực tiếp xuất khẩu 20% lượng gạo trong hợp đồng tập trung, trong đó:
Thương nhân đầu mối ký kết hợp đồng tập trung được thực hiện 2/3 (hai phần ba) số lượng 20% lượng gạo trong hợp đồng tập trung. Các thương nhân đầu mối không tham gia ký kết hợp đồng tập trung được phân bố thực hiện 1/3 (một phần ba) số lượng 20% lượng gạo trong hợp đồng tập trung.
Article 5. Responsibilities of Lead Merchants in the Rotational Lead Merchant Mechanism
1. Lead merchants who enter into centralized contracts under the rotational lead merchant mechanism shall bear the following responsibilities:
a) Fulfill the responsibilities stipulated in Clause 4, Article 19, Decree No. 107/2018/NĐ-CP.
b) Fulfill two-thirds (two-thirds) of the rice allocated to them but do not fulfill or return it.
2. Lead merchants who do not enter into centralized contracts under the rotational lead merchant mechanism shall bear the following responsibilities:
a) Jointly with the lead merchant, enter into centralized contracts and work with the Vietnam Grain Association to develop trading plans and bidding strategies.
b) Cooperate with the lead merchant in monitoring market conditions and issues related to the bidding process; exchange information with the Vietnam Grain Association on trading and bidding strategies.
c) Participate in preparing the supply of goods for contract fulfillment, jointly with the lead merchant, enter into contracts, and organize their implementation.
d) Fulfill one-third (one-third) of the rice allocated to them but do not fulfill or return it.
Article 6. Allocation Objectives for Entrusted Export Quotas
1. The allocation of quotas is carried out for rice exporting merchants to entrust export, in accordance with the provisions and criteria specified in Clauses 6 and 7, Article 19, Decree No. 107/2018/NĐ-CP.
2. The Vietnam Grain Association shall not allocate entrusted export quotas to rice exporting merchants who do not hold a business license for rice export as stipulated in Decree No. 107/2018/NĐ-CP.
Article 7. Procedure for Allocating Entrusted Export Quotas
1. After receiving reports from lead merchants regarding negotiations, transactions, bidding, or the results of centralized contract signings, the Vietnam Grain Association shall immediately notify rice exporting merchants in writing to register for entrusted export quotas.
2. Within seven (7) working days from the date of notification by the Vietnam Grain Association, merchants must submit their application documents for registered entrusted export quotas via written or electronic mail (email). The application documents include:
a) A letter requesting allocation of an entrusted export quota, specifying the quantity and type of rice to be exported.
b) A report on direct rice export achievements over the past six months and inventory levels of paddy and rice (by type), including any quantities of rice stored as temporary stockpiles under instructions from competent authorities (if applicable).
c) A report on the development of raw material areas and procurement of paddy and rice produced in such areas (if a raw material area has been established).
If merchants submit their application documents after the deadline specified in Clause 2, calculated by postmark or email receipt time, they will not be considered for quota allocation.
3. Based on the application documents from merchants, balancing commodity rice supplies and domestic harvest season conditions, the Vietnam Grain Association shall develop a quota allocation plan as per Article 6 of this Circular, notify it in writing to registered merchants, and have them implement it.
The Vietnam Grain Association will monitor and urge the implementation of centralized contracts, including those for entrusted export contracts, and report on their execution status to the Ministry of Industry and Trade.
Article 8. Return of Export Quota
1. In the event that a trader is unable to fully or partially fulfill the export quota allocated, the trader shall submit a written return of such quota to the principal traders and the Vietnam Grain Association within three days from the date of allocation decision by the Vietnam Grain Association. Exceeding this period, the trader shall be deemed not to have fulfilled the export quota.
2. Based on the aggregated quantity of rice returned by traders for export quotas or unfulfilled quantities, the Vietnam Grain Association will reallocate such quotas to other rice exporting traders or to principal traders engaged in transactions and contract signings. In the case of reallocation within a rotational mechanism among principal traders, it shall be carried out according to the principle that two-thirds (2/3) of the quantity is contracted by principal traders who sign concentrated contracts, while one-third (1/3) of the quantity is contracted by principal traders who do not sign concentrated contracts.
Chapter III
REPORTING OBLIGATIONS OF RICE EXPORT TRADERS
Article 9. Reporting on Contract Signing and Execution, and Rice Stock Levels
1. On a regular basis, every 20th of the month, traders shall report to the Ministry of Industry and Trade their contract signing and execution status for rice exports according to the reporting form specified in Appendix I attached hereto.
2.[2]Prior to the 5th day of each month, traders shall report to the Ministry of Industry and Trade, the provincial Department of Industry and Trade where they have their principal office, warehouses, milling or paddy processing facilities, simultaneously sending a copy to the Vietnam Grain Association regarding the actual stock levels of rice by specific types for compilation purposes. The reporting form is specified in Appendix II attached hereto.
3.[3]Reports as provided in paragraphs 1 and 2 of this Article and paragraph 1 of Article 10 of this Decree shall be submitted in electronic data format to the Ministry of Industry and Trade (Department of Import-Export) via the email address: [email protected]. After the reporting software is officially operational, traders will submit reports through the software.
In case of technical issues with the reporting software that affect data submission, traders shall update their data from the time of the technical issue until system operation resumes and send the report via the email address: [email protected]. The updating period is within five days from when the software returns to normal operation.
Article 10. Regular Quarterly and Annual Reports, and Special Reports
1. [4]Traders shall submit regular quarterly and annual reports according to Form No. 04 specified in the Annex attached to Decree No. 107/2018/NĐ-CP.
For regular quarterly reports, traders shall send them to the Ministry of Industry and Trade before the 20th day of the first month of the following quarter. For annual reports, traders shall send them to the Ministry of Industry and Trade before the 20th day of January in the following year.
2. Traders shall submit special reports as required by the Ministry of Industry and Trade regarding market conditions for exports, production status, paddy rice prices, business operations, and other requirements aimed at managing and controlling rice export activities under Article 24 paragraph 4 of Decree No. 107/2018/NĐ-CP.
Chapter IV
PROVISIONS FOR IMPLEMENTATION [5]
Article 11. Effectiveness of Implementation
1. This Circular shall take effect from November 15, 2018.
2. This Circular shall repeal Circular No. 44/2010/TT-BCT dated December 31, 2010, which detailed certain provisions of Decree No. 109/2010/NĐ-CP dated November 4, 2010, by the Government on rice export business.
3. Traders who were designated as trading agents before this Circular takes effect may continue to operate until the end of the contract already entered into.
4. For export contracts of rice that have been registered and concentrated allocation agreements that have been assigned for implementation prior to the effectiveness of this Circular, they shall be allowed to continue their execution.
5. In the process of implementing this Circular, if any issues arise or difficulties occur, the agencies, organizations, and traders engaged in rice export business may report to the Ministry of Industry and Trade for consideration and resolution./.

"Article 3. Implementation
1. The Department of Electronic Commerce and Digital Economy shall take the lead and cooperate with the Department of Import and Export and relevant units to develop software for reporting purposes by traders engaged in rice export business.
The cost of developing, maintaining, and enhancing the software for reporting purposes by traders engaged in rice export business shall be provided from the national budget or other funding sources.
2. The Department of Planning and Finance shall guide units under the Ministry in preparing budgets, reviewing, and consolidating into the annual budget of the Ministry.
3. During the implementation of reporting through software, if any issues arise, traders engaged in rice export business may report to the Ministry of Industry and Trade (Department of Import and Export) for resolution.
Traders shall update the software notified by the Ministry of Industry and Trade with relevant reporting content from January 1, 2023 until the software is officially operational."
Article 4. Enforcement
1. This Circular shall take effect from July 18, 2025.
2. In the course of implementing this Circular, if any issues arise or ambiguities occur, entities and business operators engaged in rice export shall report to the Ministry of Industry and Trade (Department of Import-Export) for consideration and resolution./."
