On Land Use Planning to 2020
and Five-Year Land Use Plan (2011-2015) at the National Level
OF THE NATIONAL ASSEMBLY
SOCIALIST REPUBLIC OF VIET NAM
BASED ON THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM IN 1992 AS AMENDED AND COMPLEMENTED BY RESOLUTION NO. 51/2001/QH10;
Pursuant to the Land Law No. 13/2003/QH11;
After examining Report No. 157/TTr-CP dated September 16, 2011, Supplementary Report No. 199/BC-CP dated October 12, 2011, and the Land Use Planning to 2020 and Five-Year Land Use Plan (2011-2015) at the National Level submitted by the Government, Audit Report No. 96/BC-UBKT13 dated October 13, 2011 of the Economic Committee of the National Assembly, and opinions of National Assembly deputies,
RESOLUTION:
I. ON THE RESULTS OF IMPLEMENTING THE LAND USE PLANNING TO 2010 AND THE FIVE-YEAR LAND USE PLAN (2006-2010)
The land use planning and plan after ten years of implementation have achieved positive results: enhancing one step further the effectiveness and efficiency of state management over land, effectively utilizing land potential for economic and social development, national defense, and security purposes. The land use planning and plan have delineated agricultural land reserves, ensuring national food security with strategic reserves and exports; forest protection and development have shown progress; basic needs for land to promote industrialization and modernization of the country and urban development have been met; significant contributions to the state budget through auctions, payments for land transfer, lease, and change of land use purpose have been made; unused land areas have gradually been put into rational use, meeting demands for economic and social development and ecological balance, environmental protection.
Alongside these achievements, the implementation of land use planning and plans still has some limitations such as: low quality of land use planning and plans; weak inter-regional and inter-provincial connectivity and planning management; non-compliance with discipline and rules in implementing planning and plans; misuse of land for improper purposes, wastage, and inefficiency still occur in many places; policies, laws, and decentralization in planning management are still inadequate; supervision, inspection, violation handling, and complaint resolution do not meet requirements.
II. ON THE LAND USE PLANNING TO 2020 AND THE FIVE-YEAR LAND USE PLAN (2011-2015) AT THE NATIONAL LEVEL
The land use planning to 2020 and the five-year land use plan (2011-2015) at the national level mainly include the following objectives, indicators, tasks, and solutions:
1. Objectives
Strictly manage land resources according to planning, plans, and laws; ensure proper, economical, and effective land use. Protect the ecological environment, effectively respond to climate change and rising sea levels, and ensure sustainable development. Maximize the potential and resources of land to meet the requirements of industrialization, modernization, economic structure adjustment, national food security, and the country's economic and social development goals, national defense, and security.

3. Tasks and Solutions for Implementation
(1) Sectoral and local land use planning and plans must be based on the national land use planning and plan decided by the National Assembly; the construction and implementation of land use planning and plans must be strictly unified from the overall national perspective to regional and local levels to meet economic and social development requirements and ensure national defense and security.
(2) Define and publicize the boundaries of paddy field land, protective forest land, and special purpose forest land that need strict protection. Allocate resources, primarily state budget funds, to ensure benefits between regions developing industry and those retaining large areas of paddy fields; increase investment in social infrastructure, technical infrastructure, and construction of facilities for rice storage, processing, and marketing in regions retaining large areas of paddy fields; implement appropriate policies and measures to reduce production costs and increase income for rice farmers to ensure their peace of mind in production.
(3) Organize strict management and monitoring of planning for the development of economic zones, industrial zones, industrial clusters, and non-agricultural production and business land. The use of land for non-agricultural production and business purposes must follow the plan, be economical, and be efficient.
Develop mechanisms and policies to attract investment in infrastructure construction, industrial development, services, and tourism in midland, mountainous, coastal areas, minimizing the use of paddy fields in the delta region.
(4) Review and define the boundaries of land used for national defense and security purposes; land for combined national defense and security and economic activities; land managed by defense and police units in localities before 2015.
(5) Reform land management mechanisms linked to production organization, forest protection, and development in agricultural and forestry companies, forest management boards to resolve land disputes definitively and improve the efficiency of land use by these entities.
(6) Increase investment in basic land survey work; build databases and complete information systems on land; determine specific land use indicators in planning to enhance responsibility and proactivity in land management and use at each level; train human resources, conduct scientific research, and apply advanced technology in land management; improve the quality of planning, assessment, management, implementation, and monitoring of land use planning and plans.
(7) Promote administrative reform in state management of land. Strengthen inspection, supervision, and timely handling of violations of laws to ensure land use in accordance with planning and plans, strictly implementing the land use indicators and plans decided by the National Assembly. During the implementation of land use planning and plans, if there are cases requiring adjustments to the indicators specified in Section II of this Resolution, the Government shall submit them for the National Assembly's consideration and decision.
(8) Promptly study, amend, and supplement the Land Law to innovate and enhance the legal effectiveness of land use planning and plans, ensuring that all land use activities comply with these plans.
III. IMPLEMENTATION
1. The Government shall allocate national land use indicators, direct the completion of defense and security land use planning and plans; land use planning and plans of localities; guide and organize the implementation of this Resolution.
Ministries, agencies at the ministerial level, government agencies, provincial and centrally governed city People's Committees within their respective duties and authorities shall establish or review and adjust sectoral and field-specific plans in line with land use planning and plans, while strengthening supervision over the implementation of indicators to ensure land use in accordance with planning and plans.
Annually, the Government shall report on the results of implementing land use planning and plans to the National Assembly.
2. The Standing Committee of the National Assembly, the National Ethnic Council, the National Assembly's committees, the National Assembly's delegations, and National Assembly deputies shall supervise the implementation of this Resolution.
3. People's Councils at all levels shall supervise the implementation of this Resolution at the local level.
4. The Vietnam Fatherland Front Central Committee, member organizations of the Front, within their respective duties and authorities, shall participate in supervision and propaganda, mobilizing the people to implement this Resolution well.
