Regulations on additional salary for cadres, civil servants, public officials

and personnel receiving salaries in the armed forces with a salary coefficient of 2.34 or lower

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Resolution No. 78/2014/QH13 dated November 10, 2014 of the National Assembly on the state budget estimate for 2015;

At the proposal of the Minister of Home Affairs and the Minister of Finance,

The Government promulgates this Decree stipulating additional salary for cadres, civil servants, public officials, and personnel receiving salaries in the armed forces (People's Army and People's Public Security) with a salary coefficient of 2.34 or lower.

Article 1. Scope of Regulation

1. This Decree stipulates additional salary for cadres, civil servants, public officials, workers (including probationary and trial period employees) working in agencies, organizations, public service units of the Party, State, political-social organizations, and special-interest associations at the central level, provincial level (provincial level), district level (district level), commune level (commune level), and personnel receiving salaries in the armed forces (People's Army and People's Public Security) with a salary coefficient of 2.34 or lower (hereinafter referred to collectively as persons with a salary coefficient of 2.34 or lower).

2. Political-social organizations referred to in this Decree are those organizations specified in Article 1 of Decision No. 128-QD/TW dated December 14, 2004 of the Central Committee's Secretariat on the salary system for cadres, civil servants, and public officials of Party agencies, the Front, and mass organizations.

3. Special-interest associations referred to in this Decree are those associations specified in Article 33 of Decree No. 45/2010/NĐ-CP dated April 21, 2010 of the Government on organization, operation, and management of associations and Decision No. 68/2010/QĐ-TTg dated November 1, 2010 of the Prime Minister on defining special-interest associations.

Article 2. Applicability

1. Persons with a salary coefficient of 2.34 or lower as stipulated in Clause 1, Article 1 of this Decree include:

a) Cadres and civil servants receiving salary from the state budget working in Party, State, and political-social organizations from the central to district levels as provided for in Clause 1 and Clause 2, Article 4 of the Civil Servants Law 2008;

b) Civil servants in the leadership and management machinery of public service units as provided for in Clause 2, Article 4 of the Civil Servants Law 2008; Public officials receiving salary from the public service unit's wage fund as provided for in the Public Officials Law 2010;

c) Cadres and civil servants at the commune level as provided for in Clause 3, Article 4 of the Civil Servants Law 2008 and Decree No. 92/2009/NĐ-CP dated October 22, 2009 of the Government on job titles, quantity, and some policies and benefits for cadres and civil servants at the commune level and non-professional staff at the commune level;

d) Cadres, civil servants, and public officials receiving salary according to the state-prescribed pay scale decided by competent authorities to work in associations, non-governmental organizations, projects, and international agencies based in Vietnam;

đ) Persons working under labor contracts in agencies and units of the Party, State, and political-social organizations as provided for in Decree No. 68/2000/NĐ-CP dated November 17, 2000 of the Government on implementing the labor contract system for certain types of jobs in administrative agencies and public service units;

e) Persons working under labor contracts within the number of employees assigned by competent authorities in public service units and special-interest associations;

g) Kindergarten teachers working under labor contracts as provided for in Decision No. 60/2011/QĐ-TTg dated October 26, 2011 of the Prime Minister on certain policies for developing kindergarten education from 2011 to 2015;

h) Public officials working in Commune Health Stations as provided for in Decree No. 117/2014/NĐ-CP dated December 8, 2014 of the Government on commune, ward, and town health services;

i) Military workers, public officials, and contractual workers receiving salary from the state budget belonging to the People's Army of Vietnam;

k) Police workers and contractual workers receiving salary from the state budget belonging to the People's Public Security;

l) Personnel receiving salary from the state budget in cryptographic organizations.

2. Persons with a salary coefficient of 2.34 or lower as stipulated in Clause 1, Article 1 of this Decree shall be classified according to the following documents:

a) Resolution No. 730/2004/NQ-UBTVQH11 dated September 30, 2004 of the Standing Committee of the National Assembly approving the position salary table and position allowance table for state leaders; the specialized and vocational salary table for the judiciary and prosecution sectors;

b) Decision No. 128-QD/TW dated December 14, 2004 of the Secretariat on the salary system for cadres, civil servants, and public officials of Party agencies, the Front, and mass organizations;

c) Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for cadres, civil servants, public officials, and the armed forces;

d) Resolution No. 1003/2006/NQ-UBTVQH11 dated March 3, 2006 of the Standing Committee of the National Assembly approving the position salary and position allowance table for National Audit Office leaders; the salary, allowance, and uniform table for National Audit Office cadres and civil servants, and preferential treatment for National Auditors;

đ) Decree No. 92/2009/NĐ-CP dated October 22, 2009 of the Government on job titles, quantity, and some policies and benefits for cadres and civil servants at the commune level and non-professional staff at the commune level.

3. Non-applicable subjects:

a) Persons with a salary coefficient of 2.34 or lower working in agencies, organizations, and public service units that have already received monthly salary increase coefficients equal to or higher than 0.08 compared to the basic salary level as prescribed by competent authorities;

b) Non-professional staff at the commune level, village level, and neighborhood level receiving monthly allowances as provided for in Decree No. 29/2013/NĐ-CP dated April 8, 2013 of the Government amending and supplementing certain articles of Decree No. 92/2009/NĐ-CP;

c) Non-commissioned officers, conscript soldiers in the People's Army; non-commissioned officers, conscript soldiers serving on a fixed-term basis in the People's Public Security receiving rank allowances.

Article 3. Additional Salary Amount

1. Persons with salary coefficients from 2.34 downwards as stipulated in Clause 1, Article 2 of this Decree shall have their additional salary amount increased by 8% of the current salary level (including the salary coefficient according to rank, grade, position, title currently enjoyed multiplied by the basic salary level), specifically as follows:

2. The additional salary amount specified in Clause 1 of this Article shall not be used for calculating contributions and benefits under social insurance, unemployment insurance, health insurance, and various types of allowances.

Article 4. Implementation funds

1. Utilize the savings of 10% of regular expenses (excluding salaries and allowances with similar nature) of agencies and units.

2. Utilize at least 40% of retained fees and charges according to the regime in 2015 of administrative agencies and public service units; for service revenue, utilize at least 40% of the difference between income and expenditure from service activities. For public health units, utilize at least 35% of retained revenue (after deducting drug, blood, transfusion fluid, chemical, consumable material, and replacement material costs).

3. Utilize 50% of local government budget surplus revenue (excluding land use fee revenue and 50% of the local government budget surplus revenue forecasted for 2015 compared to the previous year's forecast after ensuring the basic salary level of 1,150,000 VND remains surplus).

4. Remaining funds from the implementation of salary reform up to the end of 2014 of administrative agencies, public service units, and local government budgets at all levels.

5. The central government budget shall supplement the funding for implementing the additional salary amount when Ministries, central agencies, and provinces/cities directly under the Central Government have implemented the provisions of Clauses 1, 2, 3, and 4 of this Article but still lack sufficient sources.

Article 5. Effective Date

1. This Decree takes effect from April 6, 2015.

2. The regulations stipulated in this Decree shall be applied starting from January 1, 2015.

Article 6. Responsibilities for guidance and implementation

1. Minister of Finance:

a) Guide the determination of needs, sources, and methods of expenditure for implementing the additional salary amount as prescribed in this Decree.

b) Review and supplement funding for implementing the additional salary amount for Ministries, central agencies, and provinces/cities directly under the Central Government according to Clause 5, Article 4 of this Decree; at the end of the year, compile and report to the Prime Minister on the results of implementation.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government shall be responsible for enforcing this Decree./.
