Circular No. 17/2020/TT-BTC abolishes certain regulatory legal documents issued by the Minister of Finance and jointly issued in the fields of state reserves management, price management, financial investment management, and administrative financial management.

Repealing certain regulatory legal documents
issued and jointly issued by the Minister of Finance
in the field of state reserves, price management, financial investment management, and
administrative and public institution financial management

THE MINISTER OF FINANCE

       Based on the Law on Enactment of Legislative Acts dated June 22, 2015;

       Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing mechanisms of the Law on Enacting Legal Normative Documents;

       Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

       At the proposal of the Director of the State Reserves General Department, the Director of the Price Management Department, the Heads of the Investment Department, the Administrative and Public Institution Financial Management Department, and the Legal Department;

       After coordinating with the Ministers of the Ministry of Information and Communications, the Ministry of Education and Training, the Ministry of Agriculture and Rural Development, the Minister of Finance hereby issues this Circular to abolish certain legal normative documents issued and jointly issued by the Minister of Finance in the fields of state reserves, price management, financial investment management, and administrative and public institution financial management,

       Article 1. Abolish entirely the following six legal normative documents issued by the Minister of Finance in the field of state reserves:

       1. Circular No. 21/2013/TT-BTC dated February 25, 2013 of the Ministry of Finance on the level of fees for importing, exporting, and storing national seed vegetable reserves managed by the Ministry of Agriculture and Rural Development.

       2. Circular No. 22/2013/TT-BTC dated February 25, 2013 of the Ministry of Finance on the level of fees for importing, exporting, and storing national plant protection chemical reserves managed by the Ministry of Agriculture and Rural Development.

       3. Circular No. 32/2016/TT-BTC dated February 25, 2016 of the Ministry of Finance on continuing to apply the fee levels for importing, exporting, and storing national seed vegetable and plant protection chemical reserves managed by the Ministry of Agriculture and Rural Development as stipulated in Circulars No. 21/2013/TT-BTC and No. 22/2013/TT-BTC until 2016.

       4. Decision No. 35/2004/QĐ-BTC dated April 14, 2004 of the Ministry of Finance on issuing standards for storing national commodity reserves.

       5. Decision No. 53/2007/QĐ-BTC dated June 22, 2007 of the Ministry of Finance on issuing industry standards: Generator - national reserve storage regulations.

       6. Decision No. 76/2007/QĐ-BTC dated August 30, 2007 of the Ministry of Finance on issuing industry standards: Unhusked rice in low-pressure conditions - national reserve storage regulations.

       Article 2. Abolish entirely the following three legal normative documents issued by the Minister of Finance in the field of price management:

       1. Circular No. 89/2011/TT-BTC dated June 17, 2011 of the Ministry of Finance guiding the method for determining the floor price of exported rice.

       2. Circular No. 198/2014/TT-BTC dated December 18, 2014 of the Ministry of Finance guiding the method for calculating the cost of raw catfish.

       3. Decision No. 128/2008/QĐ-BTC dated December 31, 2008 of the Ministry of Finance amending and supplementing Decision No. 13/2006/QĐ-BTC dated March 13, 2006 of the Minister of Finance on the prices of some specialized aviation services.

       Article 3. Abolish entirely the following five legal normative documents issued by the Minister of Finance in the field of financial investment management:

     Circular No. 163/2007/TT-BTC dated December 31, 2007 of the Ministry of Finance guiding commendation and competition on construction sites of the Son La Hydropower Plant.

    2. Circular No. 174/2009/TT-BTC dated September 8, 2009 of the Ministry of Finance guiding the mechanism for mobilizing and managing various sources of capital at 11 communes implementing the Pilot Program for Building New Rural Models during Industrialization and Modernization.

    3. Circular No. 241/2009/TT-BTC dated December 29, 2009 of the Ministry of Finance guiding the management and settlement of investment capital for the expansion and completion of the Lang-Hoa Lac Road Project.

    4. Circular No. 72/2010/TT-BTC dated May 11, 2010 of the Ministry of Finance guiding the special management mechanism for project management costs at 11 communes implementing the Pilot Program for Building New Rural Models during Industrialization and Modernization.

    5. Circular No. 157/2012/TT-BTC dated September 27, 2012 of the Ministry of Finance stipulating commendation and competition on construction sites of the Lai Chau Hydropower Plant.

    Article 4. Abolish entirely the following eight legal normative documents issued by the Minister of Finance and jointly issued in the field of administrative and public institution financial management:

    1. Circular No. 30/2010/TT-BTC dated March 5, 2010 of the Ministry of Finance guiding financial management for the provision of public service products and services in the road and inland waterway transport sectors.

    2. Circular No. 223/2010/TT-BTC dated December 31, 2010 of the Ministry of Finance stipulating the preparation, management, and settlement of funds for implementing the Comprehensive Reform Program for Statistical Indicator Systems.

    3. Circular No. 71/2011/TT-BTC dated May 24, 2011 of the Ministry of Finance guiding the establishment, management, and use of the Commendation and Reward Fund according to Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Law on Commendation and Reward.

    4. Circular No. 174/2012/TT-BTC dated October 22, 2012 of the Ministry of Finance guiding financial management for the Vietnam Legal Aid Fund.

    5. Circular No. 06/2016/TT-BTC dated January 14, 2016 of the Ministry of Finance guiding the preparation, management, use, and settlement of funds for the election of the 14th National Assembly deputies and local People's Council deputies for the 2016-2021 term.

    6. Joint Circular No. 18/2012/TTLT-BTC-BTTTT dated February 14, 2012, of the Ministry of Finance and the Ministry of Information and Communications guiding the management and use of funds to support high-quality press works at the central and local levels for the period 2011-2015.

    7. Joint Circular No. 105/2013/TTLT-BTC-BGDĐT dated August 6, 2013, of the Ministry of Finance and the Ministry of Education and Training guiding the financial management system for the 46th International Chemistry Olympiad in Vietnam in 2014.

    8. Joint Circular No. 12/2014/TTLT-BTC-BNNPTNT dated January 24, 2014, of the Ministry of Finance and the Ministry of Agriculture and Rural Development guiding the management mechanism and use of state budget funds for the implementation of the "National Forest Inventory and Census Project for the period 2013-2016."

    Article 5. Implementation organization.

    This Circular takes effect from May 15, 2020.

    Heads of units under the Ministry and relevant agencies are responsible for implementing this Circular./.
