Provisions on the transit of goods of the Lao People's Democratic Republic through the territory of the Socialist Republic of Vietnam Circular No. 22/2009/TT-BCT dated August 4, 2009, issued by the Minister of Industry and Trade, regarding the transit of goods of the Lao People's Democratic Republic through the territory of the Socialist Republic of Vietnam, which took effect from September 17, 2009, has been amended and supplemented by:
1. Circular No. 06/2017/TT-BCT dated May 25, 2017, issued by the Minister of Industry and Trade, amending and supplementing Circular No. 22/2009/TT-BCT dated August 4, 2009, issued by the Ministry of Industry and Trade, regarding the transit of goods of the Lao People's Democratic Republic through the territory of the Socialist Republic of Vietnam, which took effect from May 26, 2017.
2. Circular No. 38/2025/TT-BCT dated June 19, 2025, issued by the Minister of Industry and Trade, amending and supplementing certain provisions on the delegation of administrative procedures in fields under the management of the Ministry of Industry and Trade, which took effect from July 1, 2025.
Based on Decree No. 12/2006/NĐ-CP dated January 23, 2006, issued by the Government, detailing the implementation of the Law on Trade concerning international trade activities and foreign-related agency purchase, sale, processing, and transit of goods;
Pursuant to Decree No. 189/2007/ND-CP dated December 27, 2007, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Based on the Agreement on the Transit of Goods between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic dated March 13, 2009 (hereinafter referred to as the Agreement);
The Ministry of Industry and Trade stipulates the procedures for issuing and extending transit permits and transporting goods of the Lao People's Democratic Republic transiting through the territory of the Socialist Republic of Vietnam as follows:
Article 1. Issuance of Transit Permits[1]
Chapter I. PROCEDURES FOR ISSUING AND EXTENDING TRANSIT PERMITS FOR GOODS
1. For goods specified in Clause 2, Article 4 of the Agreement, the consignor submits a request for permission to transit goods to the Minister of Industry and Trade of the Socialist Republic of Vietnam. The application includes:
The procedure for applying for a transit permit for goods shall be carried out as follows:
a) A request form for permission to transit goods (in accordance with the model prescribed in Appendix 1 attached to this Circular).
The request for permission to transit goods from the Minister of Industry and Trade of the Lao People's Democratic Republic (original). Based on the consignor’s application for permission to transit, the Ministry of Industry and Trade seeks opinions from the Ministry of National Defense and the Ministry of Public Security. On the basis of the opinions of the Ministry of National Defense and the Ministry of Public Security, the Ministry of Industry and Trade responds in writing so that the consignor is aware and can implement accordingly.
b)[2] 2. For goods specified in Clause 3, Article 4 of the Agreement, the application for a permit to transit goods includes:
a) A request form for permission to transit goods (in accordance with the model prescribed in Appendix 2 attached to this Circular).
b) The request for permission to transit goods from the Minister of Industry and Trade of the Lao People's Democratic Republic (original).
3. The request for permission and extension of transit permits of the Minister of Industry and Trade of the Lao People's Democratic Republic as stipulated at point b, Clause 1, Article 1, point b, Clause 2, Article 1, and point c, Clause 1, Article 2 of this Circular shall be in English or Vietnamese. In case it is in Lao, it must be accompanied by a Vietnamese translation certified and apostilled by the diplomatic representative of Vietnam in the Lao People's Democratic Republic or the diplomatic representative of the Lao People's Democratic Republic in Vietnam.
The submission method for applications as stipulated in Clause 1 and Clause 2, Article 1 of this Circular includes direct submission, postal service, or online at the Ministry of Industry and Trade’s public service portal.
4.[3] The time limit for processing applications for transit permits as stipulated in Clause 2 of this Article is five working days from the date of receipt of complete and valid applications.
5. The processing time for the application file for issuing a transit permit as prescribed in Clause 2 of this Article is 05 (five) working days, commencing from the date when all valid documents are received.
Article 2. Extension of Goods Transit Permit
1. The application dossier for extending the Goods Transit Permit issued in accordance with Clause 2, Article 1 of this Circular includes:
a) Application form for extending the Goods Transit Permit (in accordance with the model prescribed in Appendix 3 attached to this Circular).
b) Goods Transit Permit already issued (a copy).
c) Request for extension of the Goods Transit Permit from the Minister of Industry and Trade of the Lao People's Democratic Republic (original).
2. The application dossier for extending the Goods Transit Permit shall be submitted to the authority that issued the permit at the address specified in Clause 4, Article 1 of this Circular.
3. The time limit for processing the extension of the Goods Transit Permit is 05 (five) working days from the date of receipt of a complete and valid dossier.
Article 3. Delegation of Issuance and Extension of Goods Transit Permit
1.[4] The Minister of Industry and Trade delegates the Department of Import-Export to receive, examine dossiers and implement the issuance and extension of Goods Transit Permits as stipulated in Clause 2, Article 1 and Article 2 of this Circular.
2. The model of the Goods Transit Permit and the reply form for the request to extend the Goods Transit Permit are prescribed in Appendices 5, 6A and 6B attached to this Circular.
Article 4. Goods Transit without Goods Transit Permit of the Ministry of Industry and Trade[5]
Other types of goods not falling under the cases prescribed in Article 1 of this Circular, when transiting through the border gates specified in Article 6 of the Agreement, the consignor or carrier only needs to handle transit procedures for the goods at the customs office, without needing a Goods Transit Permit.
Article 5. Extension of Goods Transit Time
The extension of goods transit time is approved by the customs office handling the transit procedures for goods in accordance with the provisions of the law.
Chapter II. TRANSPORTATION OF GOODS IN TRANSIT
Article 6. Border Gates and Transit Routes[6]
1. Goods transit is only permitted through international border gates.
2. The route for transporting goods in transit must comply with the regulations of the Ministry of Transport.
Article 7. Means of Transport for Goods Transit and Escorts
1. Goods transit must be transported by carriers who are legal entities licensed or legally authorized in accordance with the law.
2. Vehicles of Vietnam and Laos participating in road transport of goods in transit must comply with the Road Transport Agreement between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic signed on February 24, 1996, the Protocol of the Governments of the Socialist Republic of Vietnam and the Lao People's Democratic Republic dated July 18, 2001 amending and supplementing the Road Transport Agreement, guiding documents, amendments, supplements, or replacements of these documents, and other relevant legal provisions.
3. Entry and exit procedures for means of transport and escorts; storage procedures for goods in transit; transshipment and change of means of transport for goods in transit are carried out in accordance with the Law on Customs and guiding documents implementing the Law on Customs.
Article 8. Goods Transit Time
Goods in transit are allowed to remain in the territory of Vietnam for a maximum period of 30 (thirty) days from the date of completion of customs procedures at the import border gate, except in cases where the transit time is extended in accordance with Article 5 of this Circular.
Article 9. Documents for customs procedures for transit goods
The consignor or carrier must submit and present the required documents to the Customs authority in accordance with the laws on Customs and guiding documents.
Article 10. Supervision of transit goods through the territory of Vietnam
Transit goods are subject to supervision by the Vietnamese Customs throughout the entire period they remain on Vietnamese territory.
Article 11. Distribution, sale, and consumption of transit goods
1. It is prohibited to distribute, sell, or consume in Vietnam transit goods listed in the Catalogue of Prohibited Business Goods, Prohibited Export Goods, Temporarily Suspended Export Goods, Prohibited Import Goods, and Temporarily Suspended Import Goods issued by competent state agencies of Vietnam.
2. Except for goods listed in Clause 1 of this Article, other types of transit goods may be consumed in Vietnam in cases of force majeure upon approval in writing by the Minister of Industry and Trade.
3. The consumption of transit goods referred to in Clause 2 of this Article must be carried out through Vietnamese traders and must go through import customs procedures at the customs authority according to current regulations on export-import management.
4. In the case of force majeure as stipulated in Clause 2 of this Article, the consignor sends the application file for permission to consume transit goods to the Department of Import-Export.[7] - Ministry of Industry and Trade. Address: No. 54 Hai Ba Trung Street, Hoan Kiem District, Hanoi, Vietnam. The file includes:
a) Application form for permission to consume transit goods (according to the model prescribed in Appendix 4 attached to this Circular).
b) Documentation proving the force majeure situation for the transit goods to be consumed in Vietnam.
5. The time limit for processing the application file for permission to consume transit goods is five working days from the date of receipt of a complete and valid file.
Article 12. Change of Transit Border Gate
The change of export and import border gates within the scope defined in the Agreement shall be considered and resolved by the licensing authority for transit goods under the permit and by the customs authority for transit goods without a permit.
Article 13. Rights and Obligations of the Consignor and Carrier of Transit Goods
The consignor and carrier conducting transit activities through the territory of the Socialist Republic of Vietnam have rights and obligations as prescribed in the Agreement on Transit Goods between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic dated March 13, 2009, this Circular, and other relevant legal documents.
Chapter III. IMPLEMENTING PROVISIONS
Article 14. Effective Date[8]
1. This Circular takes effect 45 days from the date of signature.
2. This Circular replaces Decision No. 0938/2000/QĐ-BTM dated June 30, 2000, of the Minister of Trade promulgating the Regulations on Lao People's Democratic Republic Goods Transiting the Territory of the Socialist Republic of Vietnam.

Circular No. 38/2025/TT-BCT amending and supplementing certain provisions on the delegation of administrative procedures in fields under the purview of the Ministry of Industry and Trade is based on the following grounds for issuance:

[8] Article 3 of Circular No. 06/2017/TT-BCT amending and supplementing Circular No. 22/2009/TT-BCT dated August 4, 2009 issued by the Minister of Industry and Trade regarding the transit of goods from the Lao People's Democratic Republic through the territory of the Socialist Republic of Vietnam, effective from May 26, 2017, provides as follows:
“Article 3. Effective Date
This Circular takes effect from May 26, 2017./.
Article 37 of Circular No. 38/2025/TT-BCT amending and supplementing certain provisions on the分级处理行政程序的分级实施规定,自2025年7月1日起生效,规定如下:
"Article 37. Implementation Provisions
1. This Circular takes effect from July 1 7 2025.
2. Accompanying this Circular are new forms replacing those in administrative procedures listed in Appendix I, and new forms prescribed in administrative procedures listed in Appendix II.
3. Transitional Provisions
Licenses, Certificates, Certifications, approval documents, consent documents for administrative procedures in the fields that have been granted, approved, or consented to by state management agencies before July 1 7 2025 shall continue to be valid until their expiration date as stated in the Licenses, Certificates, Certifications, approval documents, consent documents according to the regulations.
4. This Circular abolishes:
a) Point d, Clause 2, Article 4, Clause 3, Article 18 of Circular No. 23/2024/TT-BCT dated November 7, 2024 issued by the Minister of Industry and Trade regarding the management and use of industrial explosives and explosive precursors under the jurisdiction of the Ministry of Industry and Trade;
b) The phrase "Science and Technology Department" at point a, Clause 4, Article 11; the phrase "Department of Industry and Trade" in Note (5) Model 01, Note (7) Model 02 Appendix IV of Circular No. 23/2024/TT-BCT dated November 7, 2024 issued by the Minister of Industry and Trade regarding the management and use of industrial explosives and explosive precursors under the jurisdiction of the Ministry of Industry and Trade;
c) Appendix I promulgated with Circular No. 40/2018/TT-BCT dated October 30, 2018, issued by the Minister of Industry and Trade on the construction and content of safety management documents in oil and gas activities;
d) Article 17 of Circular No. 36/2019/TT-BCT dated November 29, 2019, issued by the Minister of Industry and Trade on product quality management under the responsibility of the Ministry of Industry and Trade;
d) The phrase "by postal service" in the content of Circular No. 11/2015/TT-BCT dated June 4, 2015 issued by the Minister of Industry and Trade regarding the transit of goods from the People's Republic of China through the territory of the Socialist Republic of Vietnam;
e) Clause 2, Article 21 of Circular No. 57/2018/TT-BCT dated December 26, 2018, issued by the Minister of Industry and Trade detailing certain provisions of Decrees related to tobacco business;
g) Article 2 of Circular No. 43/2023/TT-BCT issued by the Minister of Industry and Trade amending and supplementing certain articles of Circular No. 57/2018/TT-BCT dated December 26, 2018 issued by the Ministry of Industry and Trade detailing certain provisions of Decrees related to tobacco sales;
h) Appendices 11, 12, 13, 14, 15 promulgated together with Circular No. 43/2023/TT-BCT issued by the Minister of Industry and Trade amending and supplementing certain articles of Circular No. 57/2018/TT-BCT dated December 26, 2018 issued by the Ministry of Industry and Trade detailing certain provisions of Decrees related to tobacco sales;
i) Clause 1, Clause 2, Article 18 of Circular No. 02/2025/TT-BCT dated February 1, 2025, issued by the Minister of Industry and Trade on the protection of power engineering works and safety in the power sector;
k) Clause 2, Article 12 of Circular No. 47/2014/TT-BCT dated December 5, 2014, issued by the Minister of Industry and Trade on the management of electronic commerce websites.
l) Clause 2, Article 11 of Circular No. 59/2015/TT-BCT dated December 31, 2015 issued by the Minister of Industry and Trade regarding the management of e-commerce activities through mobile applications;
v) Appendix V promulgated together with Circular No. 07/2019/TT-BCT dated June 20, 2019 issued by the Minister of Industry and Trade regarding the export of textile and garment products to Mexico under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership;
n) Clause 2, Article 5, Clause 3, Article 6 of Circular No. 12/2018/TT-BCT dated June 15, 2018 issued by the Minister of Industry and Trade detailing certain provisions of the Law on Foreign Trade Management and Decree No. 69/2018/NĐ-CP dated May 15, 2018 issued by the Government detailing certain provisions of the Law on Foreign Trade Management;
o) Article 15 of Circular No. 36/2019/TT-BCT dated November 29, 2019, issued by the Minister of Industry and Trade, stipulates the quality management of products and goods under the responsibility of the Ministry of Industry and Trade;
p) Clause 2, Article 5, Clause 3, Article 6, Clause 4, Article 7, Clause 2, Article 8 of Circular No. 12/2018/TT-BCT dated June 15, 2018 issued by the Minister of Industry and Trade detailing certain provisions of the Law on Foreign Trade Management and Decree No. 69/2018/NĐ-CP dated May 15, 2018 issued by the Government detailing certain provisions of the Law on Foreign Trade Management.”
[9] The phrase "Import-Export Management Office in the ... region" shall be replaced by the phrase "[Issuing Authority]" pursuant to Clause 5, Article 19 of Circular No. 38/2025/TT-BCT amending and supplementing certain provisions on the分级处理行政程序的分级实施规定,自2025年7月1日起生效。
[10] The phrase "Import-Export Management Office in the ... region" shall be replaced by the phrase "[Issuing Authority]" pursuant to Clause 5, Article 19 of Circular No. 38/2025/TT-BCT amending and supplementing certain provisions on the分级处理行政程序的分级实施规定,自2025年7月1日起生效。

[15] The phrase "Department of Import-Export" shall be replaced by the phrase "General Department of Import-Export" pursuant to Article 2 of Circular No. 06/2017/TT-BCT amending and supplementing Circular No. 22/2009/TT-BCT dated August 4, 2009 issued by the Minister of Industry and Trade regarding the transit of goods from the Lao People's Democratic Republic through the territory of the Socialist Republic of Vietnam, effective from May 26, 2017.
[16] The phrase "Department of Import-Export" shall be replaced by the phrase "General Department of Import-Export" pursuant to Article 2 of Circular No. 06/2017/TT-BCT amending and supplementing Circular No. 22/2009/TT-BCT dated August 4, 2009 issued by the Minister of Industry and Trade regarding the transit of goods from the Lao People's Democratic Republic through the territory of the Socialist Republic of Vietnam, effective from May 26, 2017.
