CIRCULAR
Circular amending and supplementing certain articles of Circular No. 52/2013/TT-BGTVTdated December 12, 2013 of the Minister of Transport on management, operation, and maintenance of road worksPursuant to Decree No. 11/2010/NĐ-CP dated February 24, 2010 of the Government on management and protection of road traffic infrastructure; Decree No. 100/2013/NĐ-CP dated September 3, 2013 of the Government amending and supplementing certain articles of Decree No. 11/2010/NĐ-CP dated February 24, 2010 of the Government on management and protection of road traffic infrastructure;

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 114/2010/NĐ-CP dated December 6, 2010 of the Government on maintenance of construction works;
The Minister of Transport issues this Circular amending and supplementing certain articles of Circular No. 52/2013/TT-BGTVT dated December 12, 2013 of the Minister of Transport on management, operation, and maintenance of road works.
Pursuant to Decree No. 10/2013/NĐ-CP dated January 11, 2013 of the Government on the management, use, and operation of road infrastructure assets;
At the proposal of the Director of the Infrastructure Structure Department and the General Director of the Vietnam Highway Administration,
Article 1. Amending and supplementing Clause 3 of Article 18 of Circular No. 52/2013/TT-BGTVT.
"3. Procedures and formalities for approving the maintenance plan of central system road works (national highways):
a) The Vietnam Road Administration shall aggregate, prepare the maintenance plan and budget for road works, and submit it to the Ministry of Transport before June 15 each year;
b) The Ministry of Transport shall review and approve the maintenance plan and budget for road works before July 10 each year; aggregate the maintenance plan and budget into the annual state budget revenue and expenditure estimate of the Ministry of Transport, and send it to the Ministry of Finance before July 20 each year;
c) Based on the Decision allocating the state budget revenue and expenditure estimate issued by the Ministry of Finance, the Ministry of Transport shall allocate additional funding from the central budget to the Central Fund. The Management Board of the Central Fund shall notify the maintenance management plan for national highways to the Vietnam Road Administration;
d) The Vietnam Road Administration shall organize a review of the list of urgent projects, items, and quantities of works that must be carried out, and be responsible for preparing the maintenance plan and budget according to the allocated funds, and submit it to the Ministry of Transport within 15 days from the date of receipt of the notification stipulated in point c of this clause;
e) The Ministry of Transport shall review and approve the maintenance plan and budget for road works; instruct the Vietnam Road Administration to implement it in accordance with regulations. Based on the approved maintenance plan for road works, the Vietnam Road Administration shall prepare a distribution plan for the maintenance management budget for national highways, and submit it to the Management Board of the Central Fund for review and approval.
Article 2. Replacing Appendix II issued together with Circular No. 52/2013/TT-BGTVT with the Appendix issued together with this Circular.
This Circular takes effect from July 15, 2014.
Article 3. Effectiveness
The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, the Director of the Vietnam Road Administration, Directors of Provincial Departments of Transport under the Central Government, Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular./.
Article 4. Organization of Implementation
The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Highway Corporation, the Directors of Transport Departments of provinces and centrally governed cities, the Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular./.
