PART I
2. The Department of Planning and Investment has legal personality, its own seal and separate account; it is subject to the direction and management of the provincial People's Committee regarding organization, staffing, and personnel work; at the same time, it is subject to the direction, guidance, inspection, and supervision of the Ministry of Planning and Investment in terms of professional and technical matters.
Article 1. Position and Functions
1. The Department of Planning and Investment is a specialized agency under the provincial People's Committee responsible for advising and assisting the provincial People's Committee in state management of planning, planning, and investment, including: compiling comprehensive information on overall development plans, sectoral development plans, and key product development plans of the province; implementing and proposing mechanisms and policies for economic and social management within the province; domestic investment, foreign investment at the local level; managing official development assistance (ODA) sources, preferential loan sources from donors, non-governmental foreign aid sources; bidding; business registration within the local area; consolidating and uniformly managing issues related to enterprises, collective economy, cooperatives, private economy; organizing the provision of public services within the scope of management by the Department according to the provisions of the law.
2. The Department of Planning and Investment has legal personality, its own seal and separate account; it is subject to the direction and management of organization, staffing, and work of the provincial People's Committee; at the same time, it is subject to the direction, guidance, inspection, and supervision of the Ministry of Planning and Investment regarding professional and technical matters.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
b) Drafting action programs to implement socio-economic development plans according to the resolutions of the Provincial People's Council and being responsible for monitoring and summarizing the implementation status of monthly, quarterly, semi-annual, and annual plans for reporting to the provincial People's Committee to manage and coordinate the implementation of major economic and social balances of the province;
1. Submit to the provincial People's Committee:
a) Drafting the overall development plan for the socio-economic development, sectoral development plans, and key product development plans of the province; long-term socio-economic development plans, five-year plans, and annual plans of the province; allocating the capital investment budget for public works under the local budget; investment promotion plans, lists of projects calling for investment in the province; major economic and social balances of the province, including accumulation and consumption balance, development investment capital balance, financial balance; developing programs and plans to implement the sustainable development strategy and green growth of the province; programs and measures to organize the implementation of administrative reform tasks within the scope of state management assigned;
b) Drafting specific regulations on the functions, tasks, powers, and organizational structure of the Department of Planning and Investment;
c) Drafting specific regulations on conditions, standards, and positions for the heads and deputy heads of units under the Department; the heads and deputy heads of the Finance and Planning Office under the district-level People's Committee within the scope of state management over planning and investment after reaching consensus with the Department of Finance as assigned by the provincial People's Committee;
d) Drafting action programs to implement the socio-economic development plan according to the Resolution of the Provincial People's Council and being responsible for monitoring and summarizing the implementation situation of the plan monthly, quarterly, semi-annually, and annually to report to the provincial People's Committee for management and coordination in implementing major economic and social balances of the province;
đ) Drafting programs and plans for restructuring and modernizing state-owned enterprises managed by the locality; management mechanisms and support policies for the restructuring and modernization of state-owned enterprises; annual and five-year programs and plans to assist the development of small and medium-sized enterprises on the provincial territory;
e) Drafting decisions, directives; programs and measures to organize the implementation of administrative reform tasks within the scope of planning and investment management of the Department according to the provisions of the law and the delegation of the Ministry of Planning and Investment;
g) Drafting documents on the list of domestic and foreign investment projects for each planning period that are consistent with approved and adjusted master plans when necessary;
2. Submitting to the Chairman of the Provincial People's Committee:
a) Drafting decisions, directives, and other documents within the authority of the Chairman of the provincial People's Committee on the fields of state management of the Department;
b) Drafting decisions on establishing, merging, splitting, reorganizing, and dissolving organizations and units of the Department in accordance with the law;
c) Issuing, adjusting, and revoking Investment Certificates within the authority of the provincial People's Committee according to the delegation.
3. Assisting the Chairman of the provincial People's Committee in directing, guiding, inspecting, informing, and promoting the dissemination and education of laws in the field of planning and investment; organizing the implementation of regulatory legal documents, policies, plans, programs, projects, and proposals within the scope of state management of the Department after they have been issued or approved by competent authorities.
4. On planning and planning
a) Announcing and being responsible for organizing the implementation of the overall socio-economic development plan of the province after approval according to regulations;
b) Managing and directing certain areas of plan implementation assigned by the provincial People's Committee;
c) Guiding and supervising the construction and implementation of plans by departments, sectors, and district-level People's Committees in the province in line with approved socio-economic development plans, programs, and projects;
d) Cooperating with the Department of Finance to prepare the provincial budget and allocate the budget to agencies, organizations, and units in the province.
5. On domestic and foreign investment:
a) Taking the lead and coordinating with the Department of Finance to develop plans and allocate development investment funds for each program and project under the management of the provincial government's public investment fund in line with total investment amounts and investment structures by sector and field;
b) Taking the lead and coordinating with the Department of Finance and relevant departments to monitor, supervise, and evaluate the effectiveness of development investment fund usage for programs and projects within the local area; supervising community investment according to the law;
c) Serve as the focal point for receiving, inspecting, supervising, appraising, and reviewing investment projects within the jurisdiction of the provincial People's Committee;
d) Manage domestic investment activities and foreign direct investment in the province in accordance with the law; organize investment promotion activities according to plans approved by the provincial People's Committee; guide investment procedures within its jurisdiction.
6. Regarding management of ODA capital, preferential loan sources from donors, and non-governmental foreign aid:
a) Mobilize, attract, and coordinate the management of ODA capital, preferential loan sources from donors, and non-governmental foreign aid at the provincial level; guide departments and sectors in building lists and contents of programs using ODA capital, preferential loan sources from donors, and non-governmental foreign aid; compile lists of programs and projects using ODA capital, preferential loan sources from donors, and non-governmental foreign aid for submission to the provincial People's Committee for approval and report to the Ministry of Planning and Investment;
b) Supervise and evaluate the implementation of programs and projects using ODA capital, preferential loan sources from donors, and non-governmental foreign aid; handle issues within its authority or recommend the Chairman of the provincial People's Committee to address problems related to the allocation of counterpart funds, disbursement of ODA projects, preferential loan sources from donors, and non-governmental foreign aid involving multiple departments, sectors, districts, and communes; periodically compile reports on the situation and effectiveness of attracting and utilizing ODA capital, preferential loan sources from donors, and non-governmental foreign aid.
7. Regarding tender management:
a) Appraise and be responsible for the contents of documents submitted to the Chairman of the provincial People's Committee regarding the plan to select contractors for projects decided to be invested in by the Chairman of the provincial People's Committee; appraise tender invitation documents, prequalification documents, tender documents, request documents, results of interest evaluation, results of prequalification evaluation, and contractor selection results for tenders under projects where the provincial People's Committee is the investor;
b) Lead and organize supervision, monitoring of tendering activities, inspection, and review of the implementation of laws on tendering, and compile reports on the implementation of tendering work as prescribed.
8. Regarding enterprises, enterprise registration:
a) Appraise and be responsible for proposals for establishing, restructuring, and reorganizing state-owned enterprises managed by localities; compile situations on restructuring, modernization, development of state-owned enterprises, and the development of enterprises belonging to other economic sectors; serve as the focal point for tracking, compiling situations on the implementation and deployment of policies, programs, and plans supporting small and medium-sized enterprises;
b) Organize and be responsible for enterprise registration procedures; temporary suspension of enterprise operations; issuance, supplementation, change, reissuance, and revocation of Enterprise Registration Certificates, Branch Operation Registration Certificates, and Representative Office Registration Certificates within the jurisdiction of the Department; coordinate with relevant sectors to inspect, monitor, compile situations, and handle violations within its authority after the establishment of enterprises in the locality; collect, store, and manage enterprise registration information in accordance with the law, manage and operate the national enterprise registration information system at the local level; serve as the focal point for tracking and compiling situations of enterprises after registration.
9. Regarding collective economy, cooperatives, and private sector:
a) Serve as the focal point for compiling models and mechanisms, policies, and plans for developing collective economy, cooperatives, and the private sector; guide, monitor, compile, and evaluate the implementation of programs, plans, mechanisms, and policies for developing collective economy, cooperatives, and the private sector, and the activities of collective economic organizations, cooperatives, and the private sector in the province; organize the implementation of cooperative federation registration and people's credit fund registration within its jurisdiction;
b) Lead and coordinate with relevant agencies to resolve issues related to mechanisms and policies for developing collective economy, cooperatives, and the private sector that involve inter-departmental matters;
c) Serve as the focal point for coordinating with domestic and international organizations and individuals to study, summarize experiences, build assistance programs, attract capital, and resources to serve the development of collective economy, cooperatives, and the private sector in the province;
d) Regularly prepare reports in accordance with the guidance of the Ministry of Planning and Investment to submit to the provincial People's Committee, the Ministry of Planning and Investment, and related ministries and agencies about the development of collective economy, cooperatives, and the private sector in the province.
10. Implement international cooperation in planning, planning, and investment fields in accordance with the law and the division of labor or delegation of authority by the provincial People's Committee.
11. Provide professional guidance on planning and investment fields within the management scope of the planning and investment sector to the Finance and Planning Department of the district-level People's Committee.
12. Organize research and application of scientific and technological progress; establish information systems and archives to serve state management and professional activities in assigned fields.
13. Conduct inspections, investigations, and handle complaints and denunciations in accordance with the law; handle actions within its authority or recommend competent authorities to handle violations of laws in fields under the state management of the Department; prevent corruption, practice thrift, and combat waste.
14. Specify the specific functions, tasks, powers, and working relationships of the Department's office, specialized departments, and public service units in accordance with the Department's functions, tasks, and powers, following the guidance of the Ministry of Planning and Investment and the regulations of the provincial People's Committee.
15. Manage the organizational structure, civil servant staffing, job classification, position establishment, personnel structure according to occupational titles, and the number of employees in public service units under the Department; implement salary systems and incentive policies, training, rewards, and disciplinary measures for cadres, civil servants, public officials, and workers within the scope of management of the Department in accordance with the provisions of the law and as assigned or delegated by the provincial People's Committee.
16. Manage and be responsible for financial resources and assets allocated in accordance with the law and as assigned by the provincial People's Committee.
17. Implement information and regular and urgent reporting on the situation of tasks carried out in the assigned fields of work to the provincial People's Committee and the Ministry of Planning and Investment.
18. Carry out other tasks assigned by the provincial People's Committee in accordance with the law.
đ) Based on the regulations on the delegation of organizational and cadre management, the Director of the Department decides or submits to the competent authority for decisions regarding the appointment and dismissal of heads and deputy heads of units under the Department according to the position standards set by the provincial people's committee;
1. Leadership of the Department:
a) The Department of Planning and Investment has a Director and not more than three Deputy Directors.
b) The Director of the Department is the head of the Department, accountable to the People's Committee, the Chairman of the provincial People's Committee, and the law for all activities of the Department; responsible for reporting work to the provincial People's Council, the provincial People's Committee, and the Ministry of Planning and Investment as prescribed.
c) The Deputy Director of the Department assists the Director in directing certain aspects of work and is accountable to the Director and the law for the tasks assigned. In the absence of the Director, one Deputy Director may be authorized by the Director to manage the operations of the Department.
d) The appointment, reappointment, dismissal, transfer, rotation, commendation, punishment, resignation, retirement, and implementation of policies and benefits for the Director and Deputy Directors of the Department shall be decided by the Chairman of the provincial People's Committee in accordance with the regulations of the Party and the State.

2. Organizational Structure:
a) Office;
In cases where the Department of Finance has fewer specialized departments than those listed above, the provincial people's committee decides on adjustments to the names and functions of the departments to ensure comprehensive coverage of all areas under management and compliance with legal provisions.
The Bureau of Enterprise Finance under the Department of Finance of Hanoi City and Ho Chi Minh City (if established) has legal personality, its own seal, account, and organizational structure with no more than three departments.
- General Affairs and Planning Division;
- Business Registration Division;
- Industry Economy Division;
- Bidding, Appraisal, and Investment Supervision Division;
- Foreign Economic Relations Division;
- Education, Culture, and Society Division;
- Enterprises, Cooperative, and Private Economy Division.
The Director of the Department of Planning and Investment leads and coordinates with the Director of the Department of Personnel to review and improve the specialized divisions under the Department towards consolidation, reduction of intermediate stages, multi-sector management, and submit to the provincial People's Committee for decision, but not exceeding the number of divisions specified in Point c Clause 2 Article of this Law.
For Hanoi City and Ho Chi Minh City, the number of specialized divisions of the Department of Planning and Investment can be supplemented by one division based on management requirements compared to the provisions in Point c Clause 2 Article of this Law. The Mayor will direct the development of a proposal for the establishment of the organization and must reach consensus with the Ministry of Planning and Investment and the Ministry of Home Affairs before making a decision.
If the Department of Planning and Investment has fewer specialized divisions than those stipulated in Point c Clause 2 Article of this Law, the provincial People's Committee will decide on adjusting the name and functions of the divisions to ensure comprehensive coverage of the areas under its jurisdiction and compliance with the law.
d) Public service units (if any).
Based on the nature, characteristics, and actual conditions in the area, the Director of the Department of Planning and Investment proposes and collaborates with the Director of the Department of Personnel to submit to the Chairman of the provincial People's Committee for approval to establish public service units under the Department according to the approved planning and legal provisions.
3. Civil Servant Establishment, Number of Staff
a) Civil servant staffing and the number of employees in public service units of the Department of Planning and Investment are allocated based on job positions, linked to functions, tasks, scope of operation, and within the total number of civil servants and employees in administrative agencies and public service units of the province or centrally administered city approved or approved by the competent authority.
b) Based on functions, tasks, organizational structure, and the list of job positions, civil service grade structure, and occupational title structure of public officials approved by the competent authority, the Department of Planning and Investment annually builds plans for civil servant staffing and the number of employees in public service units to submit to the provincial People's Committee for submission to the competent authority for examination and decision in accordance with the law.
Chapter II
FINANCE AND PLANNING DEPARTMENT
1. The position and functions of the Social and Cultural Department shall be carried out in accordance with Article 11 of Decree No. 150/2025/NĐ-CP.

The Finance and Planning Office is a specialized agency under the People's Committee of the district implementing the function of advising and assisting the district People's Committee in state management over planning, investment, business registration, enterprise registration; consolidating and uniformly managing issues related to enterprises, cooperative economy, private economy in accordance with the law.
The implementation of the advisory function to assist the district People's Committee in state management over the financial sector and assets of the Finance and Planning Office is guided by the Ministry of Finance and the Ministry of Home Affairs.
2. The Finance and Planning Office has its own seal and account; it is subject to the leadership and management of the district People's Committee regarding organizational structure, job positions, civil servant staffing, civil service grade structure, and personnel affairs; at the same time, it is subject to the leadership, inspection, and guidance of the Department of Planning and Investment regarding professional matters in the field of planning and investment.
Article 5. Tasks and Powers
The Finance and Planning Office performs tasks and powers as prescribed by law in the fields of planning, plans, and investment, and the following specific tasks and powers:
1. Submit to the People's Committee at the district level:
a) Drafting overall development master plans, five-year and annual socio-economic development plans of the district; programs and projects for socio-economic development and administrative reform in the planning and investment field in the district, consistent with the overall socio-economic development master plan and industry-level master plans of the province that have been approved.
b) Drafting decisions, directives, and guiding documents to implement mechanisms, policies, laws, and regulations of the district People's Committee and the Department of Planning and Investment concerning planning and investment work in the district.
2. Submit to the Chairman of the People's Committee at the district level programs, lists, and investment projects within the area; review and be responsible for investment projects and plans within the area under the authority of the Chairman of the People's Committee at the district level; review and be responsible for the contents of documents submitted to the Chairman of the People's Committee at the district level regarding the selection of contractors for projects decided on by the Chairman of the People's Committee at the district level; review tender invitation letters, prequalification documents, tender documents, request for proposal documents, results of interest evaluation, results of prequalification evaluation, and contractor selection results for packages within projects where the People's Committee at the district level is the investor.
3. Implement legal normative documents, mechanisms, policies, planning, plans, programs, projects, and proposals that have been approved by competent authorities; provide information, promote, disseminate, and educate about laws related to planning and investment within the area.
4. Provide information, promote investment, coordinate with relevant departments to organize the attraction of domestic and foreign investors to invest in the district; guide staff working in planning and investment at the commune level.
5. Take the lead and coordinate with relevant agencies to supervise and evaluate investments; inspect the implementation of laws on planning and investment within the district; handle complaints, denunciations, and violations according to their authority.
6. Regarding enterprises, collective economy, cooperatives, private economy:
a) Issue Business Registration Certificates for collective economic organizations, individual business households, and register cooperatives and private economies within the area in accordance with the law;
b) Aggregate, monitor, and assess the implementation of programs, plans, mechanisms, policies for developing collective economy and private economy, and the activities of enterprises, cooperatives, and collective economic organizations and private economies within the district;
c) Directly inspect individual business households based on the content in their registration files within the area; coordinate with authorized state agencies to inspect enterprises; verify the content of enterprise registrations, branch offices, representative offices, and business locations of enterprises within the area upon request from the Provincial Department of Planning and Investment;
d) Regularly prepare reports according to the guidelines of the Ministry of Planning and Investment and submit them to relevant departments and the Provincial Department of Planning and Investment for consolidation and reporting to the Provincial People's Committee and the Ministry of Planning and Investment.
7. Summarize and report on the implementation of assigned tasks to the People's Committee at the district level and the Provincial Department of Planning and Investment.
8. Organize research and application of scientific and technological progress; build information systems and archives to serve professional management tasks.
9. Manage and be responsible for staff, finance, and assets allocated according to the law and assignments or delegations from the People's Committee at the district level.
10. Carry out regular and urgent information and reporting tasks on the implementation of assigned tasks according to regulations.
11. Perform other state management tasks in the field of planning and investment according to assignments, decentralization, or delegations from the People's Committee at the district level and according to the law.
Article 6. Organization and Staffing
1. The Finance and Planning Office has a Director, not more than three Deputy Directors, and specialized civil servants.
a) The Director is the head of the Office, responsible before the People's Committee, the Chairman of the People's Committee at the district level, and the law for the performance of functions, duties, and powers delegated and all activities of the Office;
b) Deputy Directors assist the Director in managing and overseeing certain aspects of work, responsible before the Director and the law for tasks assigned by the Director. When the Director is absent, a Deputy Director appointed by the Director will manage the Office's activities;
c) Among the Office leaders (Director and Deputy Directors), there must be at least one person assigned to oversee planning and investment;
d) The appointment and removal of the Director and Deputy Directors are decided by the Chairman of the People's Committee at the district level according to professional standards issued by the Provincial People's Committee and according to the law;
e) The transfer, rotation, commendation, disciplinary action, removal, resignation, retirement, and implementation of other policies for the Director and Deputy Directors are decided by the Chairman of the People's Committee at the district level according to the law;
2. The number of civil servants in the Finance and Planning Office is determined by the Chairman of the People's Committee at the district level within the total number of civil servants allocated annually by the Provincial People's Committee based on the Job Position Plan and the approved civil servant structure.
3. Based on functions, duties, job position lists, and the approved civil servant structure, the Finance and Planning Office annually leads and coordinates with the Civil Service Affairs Office to develop a civil servant staffing plan according to the law to ensure the fulfillment of assigned tasks, and submits it for approval by the competent authority.
Chapter III
IMPLEMENTATION
Article 7. Transitional Provisions
1. For Departments of Planning and Investment currently having more Deputy Directors than stipulated in this Circular, they shall continue to maintain the current number of Deputy Directors to ensure stability. Additional Deputy Directors may only be appointed when the current number does not meet the stipulated number in this Circular.
2. For cases where individuals were appointed to head positions or deputy head positions in units under the Department of Planning and Investment before this Joint Circular takes effect, if after restructuring and improving the organizational structure of the Department of Planning and Investment they cease to hold leadership positions or are appointed to new positions with lower leadership position allowances compared to their previous leadership position allowances, they shall continue to enjoy the retention of leadership position allowances as stipulated in Decision No. 140/2009/QĐ-TTg dated December 31, 2009 of the Government Chairman regarding the retention of leadership position allowances for leadership positions during the process of restructuring and improving organizational structures.
Article 8. Effective Date
This Joint Circular takes effect from January 25, 2016 and replaces Joint Circular No. 05/2009/TTLT/BKHĐT-BNV dated August 5, 2009 of the Ministry of Planning and Investment and the Ministry of Home Affairs guiding the functions, tasks, powers, and organizational structure of specialized agencies in the planning and investment sector under provincial and district People's Committees.
Article 9. Responsibility for implementation
1. Provincial People's Committees shall be responsible for:
a) Based on the guidance provided in this Joint Circular, the provincial People's Committee shall specify the functions, tasks, powers, and organizational structure of the Department of Planning and Investment; guide the district People's Committee to specify the functions, tasks, powers, and organizational structure of the Finance and Planning Office.
b) Allocate civil servant positions and the number of staff working in public service units under the Department of Planning and Investment and the Finance and Planning Office according to job positions.
c) Direct, guide, inspect, and audit the implementation of regulations concerning the functions, tasks, powers, organizational structures, and staffing of the Department of Planning and Investment under the provincial People's Committee and the Finance and Planning Office under the district People's Committee.
2. The Chairman of the provincial People's Committee shall be responsible for:
During the implementation process, if any issues arise or difficulties occur, the provinces and centrally governed cities shall promptly reflect them to the Ministry of Finance and the Ministry of Home Affairs for consideration and resolution within their jurisdiction./.
b) Reporting to the Ministry of Planning and Investment and the Ministry of Home Affairs on the organizational structure and operations of the Department of Planning and Investment and the Finance and Planning Office in their locality.
During the implementation process, if any issues arise or difficulties and obstacles occur, provinces and centrally governed cities shall promptly reflect them to the Ministry of Planning and Investment and the Ministry of Home Affairs for consideration and resolution within their authority./.
