CIRCULAR
Guidelines for certain provisions of the Livestock Law on management of livestock breeds and breeding products
and pursuant to the Government's Resolution No. 249/2017/NQ-CP dated February 17, 2017 on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Decree No. 15/2017/NĐ-CP The Minister of Agriculture and Rural Development issues this Circular guiding certain provisions of the Livestock Law on management of livestock breeds and breeding products.
On the basis of Law on Animal Husbandry November 19, 2018;
At the proposal of the Director of the Livestock Production Department;
This Circular guides Clause 1 Article 15, Clause 4 Article 16, Point a Clause 4 Article 20, Point a Clause 2 Article 21, and Clause 3 Article 24 of the Livestock Law.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular applies to organizations and individuals within Vietnam, and foreign organizations and individuals engaged in activities related to livestock breeds and breeding products in Vietnam.
Article 2. Applicability
Article 3. Provisions on exchanging genetic resources of rare and valuable livestock breeds for research, selection, and creation of new livestock breeds and production and business
Chapter II
CONTENTS OF GUIDANCE
1. Organizations and individuals that may exchange genetic resources of rare and valuable livestock breeds include: breeding animals, breeding eggs, semen, embryos.
3. Annually in December or upon request from competent authorities, organizations and individuals exchanging genetic resources of rare and valuable livestock breeds shall be responsible for reporting in writing and electronically to the Minister of Agriculture and Rural Development on the situation and results of using the exchanged genetic resources of rare and valuable livestock breeds according to the form prescribed in Appendix I attached to this Circular.
Article 4. Forms of application for exchanging genetic resources of rare and valuable livestock breeds
1. Application for exchanging genetic resources of rare and valuable livestock breeds according to the form prescribed in Appendix II attached to this Circular.
2. Genetic resource history of rare and valuable livestock breeds for exchange according to the form prescribed in Appendix II attached to this Circular.
Article 5. Components of the first import dossier for male breeding animals, semen, and embryo breeding animals
1. Application for importing male breeding animals, semen, and embryo breeding animals according to the form prescribed in Appendix III attached to this Circular.
2. History of male breeding animals, semen, and embryo breeding animals for import according to the form prescribed in Appendix III attached to this Circular.
3. Official document or document authorized by the competent authority of the exporting country confirming the origin, place of manufacture, quality of the breed, and purpose of use (the document is the original or certified copy accompanied by a Vietnamese translation confirmed by the importing entity).
1. Application for exporting livestock breeds and breeding products listed in the prohibited export list for scientific research, exhibitions, and advertising according to the form prescribed in Appendix IV attached to this Circular.
2. History of livestock breeds and breeding products for export listed in the prohibited export list for scientific research, exhibitions, and advertising according to the form prescribed in Appendix IV attached to this Circular.
3. Original or certified copy of the cooperation agreement for scientific research, exhibitions, and advertising regarding livestock breeds and breeding products listed in the prohibited export list for scientific research, exhibitions, and advertising.
4. Other relevant documents concerning the export of livestock breeds and breeding products (if any).

The mandatory quality standards to be published and the quality levels for male and female breeding animals are specified in Appendix V attached to this Circular.
Chapter III
IMPLEMENTATION
Article 8. Responsibilities of relevant parties
1. The Livestock Breeding Department shall be responsible for:
a) To organize the implementation and consolidation of contents related to the management of breeding animals and breeding animal products throughout the country;
b) To conduct inspections and quality checks on breeding animals and breeding animal products throughout the country.
2. The Animal Health Department shall be responsible for providing information on the export and import situation of breeding animals and breeding animal products to the Livestock Production Department on a quarterly basis on the last day of the month or when requested by the competent authority.
3. The Department of Agriculture and Rural Development shall be responsible for:
a) Organizing the implementation of the contents stipulated in this Circular within its jurisdiction;
b) Conducting inspection and quality control work on breeding animals and breeding animal products within its jurisdiction.
4. Organizations and individuals operating in the field of breeding animals and breeding animal products shall be responsible for implementing the provisions of this Circular and related laws.
Article 9. Transitional Provisions
Licenses related to the production, business, exchange, export, and import of breeding animals and breeding animal products issued by the competent authority before the effective date of this Circular shall continue to be valid until their expiration date.
Article 10. Effective Date
This Circular takes effect from January 15, 2020.
2. This Circular replaces:
a) Decision No. 66/2005/QĐ-BNN dated October 31, 2005, issued by the Minister of Agriculture and Rural Development regarding the management and use of male cattle breeding animals;
b) Decision No. 07/2005/QĐ-BNN dated January 31, 2005, issued by the Minister of Agriculture and Rural Development regarding the management and use of male pig breeding animals;
c) Decision No. 13/2007/QĐ-BNN dated February 9, 2007, issued by the Minister of Agriculture and Rural Development regarding the management and use of male buffalo breeding animals;
d) Decision No. 108/2007/QĐ-BNN dated December 31, 2007, issued by the Minister of Agriculture and Rural Development regarding the management and use of male goat breeding animals.
3. This Circular abolishes:
Article 7 of Circular No. 43/2018/TT-BNNPTNT dated December 28, 2018, issued by the Minister of Agriculture and Rural Development, stipulates certain contents regarding the export and import of plant and animal breeding materials, plant germplasm; the import of plant protection chemicals; and the import of objects listed in the phytosanitary quarantine object list that require risk analysis prior to importation into Vietnam.
During implementation, if there are difficulties or obstacles, it is recommended that agencies, organizations, and individuals report them to the Ministry of Agriculture and Rural Development for review and appropriate amendments./.
